“For 2016, Let Franken Be Franken”: Democrats Have The Perfect Trump Slayer: Al Franken

Now that the general election matchup is settled, the Democratic Party is starting to coordinate their anti-Trump strategy and messaging. As usual, their product is almost unbelievably lame: “Dangerous Donald.” Apparently that is the best slur they can come up with, so if you live in a swing state, get ready to hear that 900 times a day for the next six months.

But in the meantime, somebody else needs to actually come up with some decent Trump put-downs — something that at a minimum does not portray him as some sort of cool, leather-jacketed rebel. Elizabeth Warren has been putting together a reasonable first pass, getting in multi-day Twitter fights with Trump by ridiculing his pathetic business record and his extensive history of vile sexism.

However, there is one Democratic senator with the detailed, on the ground expertise this garbage reality show hellscape of an election requires. Someone, indeed, whose entire career has been leading up to this point. That someone is Al Franken, the junior Democratic senator from Minnesota.

The very obvious weakness of Trump when it comes to political trench warfare is that, like most bullies, he can dish it out, but he can’t take it. He can utterly humiliate a gutless patrician like Jeb Bush, but it’s extremely easy to bait him into undignified bursts of outrage. On one level, Trump sort of thrives on this stuff. In the context of the Republican primary, stooping to his level of juvenility didn’t work for Marco Rubio or Ted Cruz.

However, the general election will be very different than the Republican primary. First, none of the other Republicans were any better than Bush at trading barbs. Marco Rubio sounded like a panicky high-schooler reading from a memorized sheet of insults his dad wrote down for him, and Ted Cruz sounds like a smug oleaginous weasel regardless of what he’s saying. Anyone who’s even slightly creative and self-confident ought to be able to do far better than that.

The general election will also be before a very different audience than the Republican primary electorate. Before GOP base voters, Trump’s bigotry and sexism played pretty well, or could at least be looked past. But before the rest of the country, he can’t afford to stoop to the vile slurs that are quite obviously right below the surface. He needs to look presidential as much as possible, and one way to throw a wrench in that effort is to bait him into saying vile stuff.

As I said, Elizabeth Warren has a good start. But Al Franken is, so far as I can tell, the only former comedian in Congress from either party. He was on Saturday Night Live for many years, and wrote several comedy books, including Rush Limbaugh Is a Big Fat Idiot and Lies and the Lying Liars Who Tell Them: A Fair and Balanced Look at the Right — both genuinely funny and full of quite nasty insults. He knows this stuff backwards and forwards.

One thing Franken could do, aside from baiting Trump himself, is teach Democratic politicos how not to sound like the bloodless technocrats who have long since had the personality crushed out of them. He could knock together a few slideshows, hold a conference or two, and teach at least a few how to perform a reasonable approximation of “witty.” Because it’s probably best if people like Warren and Franken et al take point in mocking Trump, allowing Clinton to stay above the fray.

During his Senate career, Franken has been relatively modest and quiet, probably due to the personality-crushing mechanism (read: constant begging of rich people for money) I described above. But he surely remembers how to be mean to Republicans.

This election’s GOP nominee deserves his special talents more than any other in United States history. So for 2016, let Franken be Franken.

“Tied To The Party’s Nominee”: Why Donald Trump Is Big Trouble For Republican Senators And Congressmen

Mitch McConnell can always be counted on to put a brave face on things. Asked on CNN’s State of the Union on Sunday whether he’s encouraging Republican Senate candidates to distance themselves from Donald Trump should he be the party’s nominee, McConnell essentially said that it isn’t a problem. “We are going to run individual races no matter who the presidential nominee is,” McConnell said. “Senate races are statewide races. You can craft your own message for your own people. And that’s exactly what we intend to do this fall, no matter who the nominee is.”

It’s certainly what many of them will try to do. But can they get away with it?

A few might. But distancing yourself from your party’s leader may be harder now than it has ever been.

To see why, we have to start with an understanding of how much information voters have about different candidates. We can think about a kind of information hierarchy, the top of which is the presidential race. That contest will dominate all the news sources people have about politics: newspapers, local and national TV news, social media, even the conversations they have with family, friends, and co-workers. If the race is between Trump and Hillary Clinton, the clash of these two big, controversial personalities will dominate the news.

The next level down is races for Senate or governor — amply funded, and featuring incumbents with whom people have at least a passing familiarity, but not nearly as prominent as the presidential race. You’ll absolutely hear Trump and Clinton’s messages, whether you believe them or not, but with the lower offices, it’s a challenge just to get the candidate’s name and face in front of people. Go to House seats, and then farther to state legislature or local races, and voters hear only the occasional snippet, drowned out by everything else that’s going on.

That means that it can be difficult to convince voters of something a bit complicated, something that requires them to undo their default assumptions. And one of those assumptions is that candidates from the same party are going to be partners.

Split-ticket voting (choosing one party’s candidate for president and a different party’s candidate for lower offices) has declined in recent years, which is understandable in an era of partisan polarization and tight party unity. Half a century ago, when both parties contained a relatively broad ideological spectrum — for instance, the Democratic Party had both Northern liberals and Southern conservatives — it made more sense to view an individual senator or congressman as a free agent who might act independently of his or her party. But today, most important votes break firmly along partisan lines, which means that your senator is probably not going to surprise you, or the president, with anything he or she does.

That’s not to say there are no more maverick legislators who frequently abandon their party to support the other side’s position. There are a few, like Joe Manchin (D-W.Va.) or Susan Collins (R-Maine). But there are fewer of them after every election, and they’re almost gone. The more party unity there is, the more every race is nationalized.

So a message like, “I don’t agree with my party’s leader, even though I will sometimes, but not at other times, and I agree with you that he’s a jerk” is going to be less persuasive now than it might have been at another time.

This could be especially tricky for the Republican incumbents representing swing states. We often think of “purple” states as containing mostly moderate voters, but that’s often not the case. Instead, they may have roughly equal numbers of strong liberals and strong conservatives. You can see that in places like Iowa and Wisconsin, both of which will have incumbent Republican senators facing serious challenges this year. That makes things complicated for those Republicans — they don’t want to alienate the Trump fans who will be coming out to vote for president, but they also don’t want to push away voters who can’t stand him.

And you can bet that in nearly every competitive Senate race, there are going to be ads targeting the Republican that will try to tie him or her to the Republican presidential nominee, particularly if Trump’s popularity stays as low as it is now. “Senator X stands with Trump,” they’ll say, as sinister music plays in the background. “Demeaning women. Threatening immigrants. Encouraging violence. Is that what we want representing us? Tell Senator X and Donald Trump that our state says no thanks.”

Some Republican incumbents are running in extremely conservative states, in which case they probably don’t have to worry. But others will face two questions: Whether they even want to distance themselves from Trump, and if they do, whether they can do it successfully. One thing’s for sure: it isn’t going to be as easy as Mitch McConnell would have you believe. And the farther you go down the ballot, the harder it’s going to get.

“Democrats, Don’t Blow It”: Ask Yourselves, Whom Would You Prefer To Name Future Supreme Court Judges?

The death of Antonin Scalia has set off yet another epic partisan struggle as Senate Republicans seek to deny President Obama his constitutional right to nominate the next Supreme Court justice. They want to wait out Obama’s last year in office, hoping his successor will be one of their own.

If the Democrats choose Bernie Sanders as their presidential candidate, Republicans will almost certainly get their wish. Furthermore, the Republican president would probably have a Republican-majority Senate happy to approve his selection.

The makeup of senatorial races this November gives Democrats a decent chance of capturing a majority. Having the radical Sanders on the ballot would hurt them in swing states.

Some Sanders devotees will argue with conviction that these purplish Democrats are not real progressives anyway, not like our Bernie. Herein lies the Democrats’ problem.

No sophisticated pollster puts stock in current numbers showing Sanders doing well against possible Republican foes. The right has not subjected Sanders to the brutality it routinely rains on Hillary Clinton — precisely because he is the candidate they want to run a Republican against. Should Sanders become the nominee, the skies will open.

One may applaud Sanders’ denunciation of big money in politics, but a moderate Democrat in the White House could do something about it. A democratic socialist not in the White House cannot. Campaign finance reform would be a hard slog under any circumstances, but a seasoned politician who plays well with others could bring a reluctant few to her side.

Some younger liberals may not know the history of the disastrous 2000 election, where Republicans played the left for fools. Polls were showing Al Gore and George W. Bush neck-and-neck, particularly in the pivotal state of Florida.

Despite the stakes, prominent left-wing voices continued to back the third-party candidacy of Ralph Nader. You had Michael Moore bouncing on stages where he urged cheering liberals to vote for the radical Nader because there was no difference between Gore and Bush. Republicans, meanwhile, were running ads for Nader. That was no secret. It was in the papers.

When the Florida tally came in, Bush held a mere 537-vote edge. The close results prompted Florida to start a recount of the votes. Then, in a purely partisan play, the conservative majority on the Supreme Court stopped the recount, handing the election to Bush.

The bigger point is that Gore would have been the undisputed winner in 2000 had Nader not vacuumed up almost 100,000 Florida votes, most of which would have surely gone to him.

Same deal in New Hampshire, where Nader siphoned off more than 22,000 votes. Bush won there by only 7,211 ballots.

Now, Sanders is an honorable man running a straightforward campaign for the Democratic nomination. One can’t imagine his playing the third-party spoiler.

But what makes today similar to 2000 is how many on the left are so demanding of ideological purity that they’d blow the opportunity to keep the White House in Democratic hands. Of course, they don’t see it that way. This may reflect their closed circle of like-minded friends — or an illusion that others need only see the light, and their hero will sweep into the Oval Office.

The other similarity to 2000 is the scorn the believers heap on the experienced liberal alternative. They can’t accept the compromises, contradictions and occasional bad calls that attach to any politician who’s fought in the trenches.

The next president will almost certainly be either Clinton or a Republican. Democrats must ask themselves: Whom would you prefer to name future Supreme Court judges?

“A Clear Partisan Purpose”: GOP Steps Up Attack On Early Voting In Key Swing States

On Election Night 2012, referring to the long lines in states like Florida and Ohio, Barack Obama declared, “We have to fix that.”

The waits in Florida and Ohio were no accident, but rather the direct consequence of GOP efforts to curtail the number of days and hours that people had to vote. On January 22, 2014, the president’s bipartisan election commission released a comprehensive report detailing how voting could be smoother, faster and more convenient. It urged states to reduce long lines by adopting “measures to improve access to the polls through expansion of the period for voting before the traditional Election Day.”

That would seem like an uncontroversial and common sense suggestion, but too many GOP-controlled states continue to move in the opposite direction, reducing access to the ballot instead of expanding it. The most prominent recent examples are the swing states of Wisconsin and Ohio.

Yesterday Wisconsin Governor Scott Walker signed legislation eliminating early voting hours on weekends and nights, when it’s most convenient for many voters to go to the polls. When they took over state government in 2011, Wisconsin Republicans reduced the early voting period from three weeks to two weeks and only one weekend. Now they’ve eliminated weekend voting altogether.

Over 250,000 Wisconsinites voted early in 2012, one in twelve overall voters. Cutting early voting has a clear partisan purpose: those who voted early voted for Obama 58 to 41 percent in Wisconsin in 2012, compared to his 51 to 48 percent margin on Election Day. Extended early voting hours were particularly critical with respect to high voter turnout in big cities like Milwaukee and Madison. “It’s just sad when a political party has so lost faith in its ideas that it’s pouring all of its energy into election mechanics,” said Wisconsin GOP State Senator Dale Schultz, a critic of the legislation.

A month ago, Ohio passed legislation cutting early voting by a week, eliminating same-day voter registration and restricting the availability of absentee ballots while Secretary of State Jon Husted issued a directive doing away with early voting on weeknights and Sundays as well. 600,000 Ohioans, ten percent of the electorate, voted early in 2012. The cuts in Ohio, like Wisconsin, have a clear partisan and racial underpinning—in Cleveland, for example, African-Americans made up 56 percent of those who voted on weekends in 2008.

Republicans are adopting the early voting cuts under the guise of “uniformity”—claiming they want all counties to have the same hours, which punishes large urban counties if small rural counties don’t have the money or manpower for extended early voting hours.

But few believe that’s the only reason why early voting is on the chopping block. Many Republicans are predictably reluctant to admit that the main reason they suddenly disfavor early voting is because too many Democrats are using it or because they actually believe, in the words of Jonah Goldberg, that “voting should be harder, not easier—for everybody.” (See Rick Hasen’s piece “The new conservative assault on early voting.”)

The latter argument was endorsed by Florida GOP State Senator Mike Bennett in 2011, who said: “I wouldn’t have any problem making it harder…I want the people of the state of Florida to want to vote as bad as that person in Africa who’s willing to walk 200 miles…This should not be easy.”

That view was widely repudiated in the aftermath of the 2012 election, when even Florida repealed its cutbacks to early voting. A move to significantly reduce early voting recently failed in the Georgia legislature, which can hardly be described as moderate. But Republicans in Ohio and Wisconsin are stuck on the disgraced idea that the best way to win an election is to make it harder for your opponents to participate in one.

“Wrong Winners”: The Long Past And Perilous Future Of Gaming The Electoral College system

Following another bitter presidential loss, Republicans in several states are pushing for rule changes that would boost their odds in future races — essentially, switching the Electoral College allocation method in Democratic-leaning swing states from the current winner-take-all system to one that would help Republicans capture at least some electoral votes in those battlegrounds.

In the short run, of course, such changes would probably help Republicans siphon off electoral votes in states like Virginia, Ohio, Michigan, and Pennsylvania. But these rule changes would also make a mockery of the concept of fair elections, and harm the twin Republican principles of conservativism and federalism.

Currently, all but two states award Electoral College votes using a winner-take-all system (called the Unit Rule). The Unit Rule is not mandatory. Other methods have been used in the past, including having the state legislature hand out the electoral votes however it sees fit. Another popular alternative method, one that is currently used by Maine and Nebraska, is giving one electoral vote to the winner of each congressional district.

The Unit Rule is widely used today because of its political benefits. In the early days of the republic, it was not clear which system was best. Some politicians were strong proponents of the district-based system — including Thomas Jefferson. But this philosophical position quickly gave way to expediency. When Jefferson ran for president in 1800, his native Virginia transferred over to the Unit Rule to hand Jefferson the full allotment of his home state’s votes.

In the ensuing elections, many states switched allocation methods. Eventually, the trend toward a more democratic system in the 1820s led to the phasing out of the state legislatures’ allocating votes. At the same time, politicians realized that the district system diluted the impact of a state’s vote, and prevented state lawmakers from delivering their entire electoral bounty to their preferred candidate. By 1836, all states except South Carolina used the winner-take-all method.

However, over the years, there have been occasional attempts to switch to a different plan to help various favored candidates. For instance, in 1892, Michigan switched to the district plan to help Grover Cleveland, and then switched back to the Unit Rule for the 1896 election.

Fast forward to the modern day. Since the super-tight 2000 election, there have been numerous attempts to switch the allocation methods of states. Republicans tried to loosen Democrats’ stranglehold on deep-blue California by pushing for a district-based system, which would have been devastating to Democrats. Liberals have made similar noises about revising the laws of North Carolina and Colorado. None of these plans have come fruition.

Since Obama’s landslide victory in November, all of the talk about changing the system — and there has been a lot of it — has been on the Republican side. Thanks to the GOP’s big wins in the 2010 elections, Republicans control the legislatures and the governors’ offices of a number of states that voted for Obama, including Michigan, Pennsylvania, Wisconsin, Ohio, and Virginia. These states are now targets for a switch to the district-based method.

This would clearly damage Democrats’ short-term political prospects. For example, under the system proposed by Virginia, the state’s electoral votes would have gone from 13 for Obama to 9-4 in favor of Mitt Romney — because he won a bunch of congressional districts despite decisively losing the state’s popular vote.

Such rule changes would immediately nationalize state legislative elections. Thanks to their role in gerrymandering, state legislative elections are already receiving increased attention from national figures. If states started fussing with the rules of the Electoral College, this attention would skyrocket. Consider this: In the 2011 Wisconsin recalls of nine state senators, total campaign spending topped $44 million. Imagine how much would be spent if the presidency were thought to be on the line.

From the point of view of federalism, this would destroy the ideal of state governments as “laboratories of democracy.” These state legislative races would no longer focus on local issues — instead, they would be decided by national topics that have nothing to do with an average legislator’s job. We could also expect an increase in recall elections run to gain a majority in a closely divided legislature.

Gerrymandering, already a bipartisan blight on our political system, would only grow in importance. Mid-decade gerrymandering would become the norm. Essentially, every election would become an attempt to game the system.

We’ve actually seen this before. It goes on every four years, as states try to rejigger the rules, and especially the dates, of their presidential nominating contests. It is not pretty, and it is not a good way to run a system.

Another problem is with the conservative ideal of keeping the Electoral College intact. The Electoral College managed to survive the 2000 presidential debacle. Part of the reason was politics, and part of the reason was that there was a clear villain in the process, namely Florida’s botched election system. But yet another part is that whatever the merits of the complaints against the Electoral College, it’s a historic and relatively straightforward process — win a state, win its votes.

Of course, the current electoral allocation method skews attention to swing states, and ignores voters in any states that are solidly blue or red, including three of the four biggest states (California, New York, and Texas). Switching to the district-based system would result in more attention for these states’ local issues. However, the district-based system may be more likely to misfire. It would have increased Bush’s Electoral College totals in 2000, despite his losing the popular vote to Al Gore.

Indeed, the district-based system proposed by Republicans (and occasionally, in the past, Democrats) would actually be designed to increase the likelihood of “wrong winners” — someone who loses the popular vote but wins the presidency.

Can the Electoral College handle being a continual contra-indicator of the national popular vote? It is likely that repeated misfires of the Electoral College would fatally undermine the system. Eventually, if one party is specifically disadvantaged, it would have to go all-in to replace the Electoral College with a national popular vote system. And at some point in the future, a party would accomplish that.

Attempts to game the Electoral College for short-term political gain may temporarily help Republican candidates. But in the long term, they would have a devastating impact on the concept of fair elections, and on the ideals of federalism and conservativism. Republicans would be well advised to consider whether the short-term pleasure is worth the long-term pain.
