“If Democracy Goes Too Far”: ‘The Bullet Box’ Is An Option If The Ballot Box Fails, Says Gun-Rights Advocate

All Second Amendment enthusiasts are not the same. There are those who strongly believe in the right to bear arms for purposes of self-protection against criminals and for hunting and other sports usages. And then there are those who believe the ultimate purpose of the Second Amendment is to keep revolutionary violence on the table as a fallback plan if in their view “essential rights” are threatened, including gun rights themselves.

You can pretty clearly put many members of the Gun Owners of America, a group that considers the NRA a bunch of accomodationist squishes, in the latter category. The group’s longtime executive director, Larry Pratt, made that clear on his own radio show this week:

[T]he courts do not have the last word on what the Constitution is. They decide particular cases, they don’t make law. Their decisions, unlike the Roe v. Wade usurpation, don’t extend to the whole of society, they’re not supposed to. And we may have to reassert that proper constitutional balance, and it may not be pretty. So, I’d much rather have an election where we solve this matter at the ballot box than have to resort to the bullet box.

While Pratt’s term “bullet box” is attracting attention, this is a very old sentiment not just among gun enthusiasts but in broad swaths of movement conservatism. Recent proclamations in favor of the right to overthrow the government as essential to the maintenance of constitutional order have come from 2016 presidential candidates Ted Cruz and Mike Huckabee. But perhaps the clearest statement was made in 2012 by now-senator Joni Ernst, one of the GOP’s rising stars:

“I have a beautiful little Smith & Wesson, 9 millimeter, and it goes with me virtually everywhere,” Ernst said at the NRA and Iowa Firearms Coalition Second Amendment Rally in Searsboro, Iowa. “But I do believe in the right to carry, and I believe in the right to defend myself and my family — whether it’s from an intruder, or whether it’s from the government, should they decide that my rights are no longer important.”

Ernst, of course, like other Second Amendment ultras, is implicitly arrogating to herself the right to decide when godless socialist tyranny — you know, things like Obamacare or environmental regulations or court-imposed reproductive rights — has gone so far that it’s time to bring out the shooting irons and start executing one’s enemies. But you have to wonder how people like Ernst and Cruz and Huckabee and Pratt would react if such rhetoric was coming from the political left — say, a black nationalist group. The right-to-revolution thinking really does boil down to Mao’s famous edict that “political power grows out of the barrel of a gun.”

For the present, it’s enough for Pratt to remind the rest of us that his tolerance for democracy and judicial supremacy has its limits, and if pushed too far, the “bullet box” is ever-ready.

“Everywhere And Nowhere”: Trump Is Waging An Assault On The Entire Structure Of Our Democracy. Now What?

Donald Trump and Paul Ryan had their much-anticipated meeting on this morning, and while Ryan did not endorse Trump (yet), they issued a joint statement talking about their “many areas of common ground.” Speaking afterward to reporters, Ryan said, “It was important that we discussed our differences that we have, but it was also important that we discuss the core principles that tie us together,” and that “Going forward we’re going to go a little deeper in the policy weeds to make sure we have a better understanding of one another.”

This is a fool’s errand, not just for Ryan but for us in the media as well. And it poses a profound challenge to democracy itself.

Just in the last couple of days, something has changed. Perhaps it should have been evident to us before, but for whatever reason it was only partially clear. The pieces were there, but they didn’t fit together to show us how comprehensive Trump’s assault on the fundamentals of American politics truly is.

And that has left the media — whose job it is to report what’s happening and describe it to the citizenry in a coherent way that enables them to make a reasonable decision — at loose ends. We simply don’t know how to cover a candidate like this. We need to figure it out, and quickly.

The foundation of democratic debate is policy, issues, the choices we make about what we as a nation should do. That’s what the government we create does on our behalf: it confronts problems, decides between alternatives, and pursues them. That’s also the foundation of how we in the press report on politics. Yes, we spend a lot of time talking about the personalities involved, but underneath that are competing ideas about what should be done. Should we raise taxes or lower them? Spend more or spend less? Make abortions easier or harder to get? Give more people health coverage or fewer? How do we combat ISIS? How should we address climate change? How can we improve the economy? How can we reduce crime? What sort of transportation system do we want? Which areas should government involve itself in, and which should it stay out of?

We all presume that these questions (and a thousand more) are important, and that the people who run for office should take them seriously. We assume they’ll tell us where they stand, we’ll decide what we think of what they’ve said, and eventually we’ll be able to make an informed choice about who should be the leader of our country.

Donald Trump has taken these presumptions and torn them to pieces, then spat on them and laughed. And so far we seem to have no idea what to do about it.

Let me briefly give an illustration. On the question of the minimum wage, Trump has previously said he would not raise it. Then Sunday he said he did want to raise it. Then in a separate interview on the very same day he said there should be no federal minimum wage at all, that instead we should “Let the states decide.” Then yesterday he said he does want to increase the federal minimum wage.

So when you ask the question, “Where does Donald Trump stand on the minimum wage?”, the answer is: everywhere and nowhere. He has nothing resembling a position, because what he said today has no relationship to what he said yesterday or what he’ll say tomorrow. And we’re seeing it again and again. Will he release his tax returns? Yes, but then no, but then yes and no. Does he want to cut taxes for the wealthy? His plan says yes, his mouth sort of says no, but who knows? What about his promise for “a total and complete shutdown of Muslims entering the United States” that so thrilled his supporters? Now he says it’s “only a suggestion.”

We assume that with an appropriately tough and smart interview, one or more of us in the media will eventually pin Trump down on any particular issue, and then we’ll have our answer and he can be judged accordingly. But that won’t happen.

So because we don’t know what else to do, we’re trying to hold him to the standards we use for every other candidate: what does he propose, and how reasonable are those proposals? For instance, Politico attempted to take a serious look at Trump’s policy statements, and concluded that “Trump bounces across the political spectrum,” but “Many of his proposals are either unrealistic in terms of executive power or would run into a brick wall with Congress, making a Trump administration borderline impotent on the very issues that are driving his supporters to the polls.”

We should give them credit for trying, but the problem is that if you want to evaluate Trump’s positions, you can only do so based on what they’ve been up until the moment you’re making the judgment. But if he gets asked about the same issues tomorrow, the odds that he’ll take the same position are essentially random, like a coin flip.

The problem isn’t that Trump’s positions don’t add up to a coherent ideology along the liberal-conservative spectrum, it’s that you can’t even call them “positions,” because you can never be sure which of them he’ll hold next week, much less if he eventually becomes president.

And remember, that’s really the point of the campaign: to figure out what kind of president each of the contenders would be. There’s always some measure of uncertainty, since we don’t know exactly what crises the next president will confront or what kind of manager he or she would be. But with every other person who ran this year, an informed observer could tell you 90 percent of what they would do if they eventually became president. You might love or hate Hillary Clinton, but we can all come to at least a basic agreement about the policies she’ll pursue. At this point, can anybody say what Trump would do as president? About anything?

It’s important to be clear that Trump isn’t just a “flip-flopper.” When that charge has been leveled in the past, whether against a Democrat or Republican, it was because they had one position (or set of positions) and then changed them. Even if the critique was animated by the concern that they might change again in the future, at any given moment you knew where they stood. You might judge them too opportunistic, or like their previous position more than their current one. But there was a progression and a logic to where they stood, and the assumption was that whatever their position was, they’d act on it.

This is the way we’ve tried to explain Trump, assuming that there’s some kind of linear progression to what he says about issues: he was in one place appealing to primary voters, and there are things he might change to appeal to general election voters. But it’s clear now that that was a mistake, because that’s now how this works with him.

That leaves us unable to talk about Trump and issues in the way we normally would. And this is a serious problem. The basic issue divides between the parties comprise one of the key foundations on which we build our explanations of politics. They structure the arguments and the contest for power, they give meaning to the whole game. They’re the reason all of this silliness matters, because at the end of it we’ll be choosing a new government, led by one individual who will make choices that affect all of us in profound ways.

It’s clear now that Donald Trump may be unique in American history — not just in his inexperience, not just in his ignorance, not just in his bombast, and not just in his crypto-fascist appeal. He’s unique in that he doesn’t care in the least about the the things that politics and government are all about, and he won’t even bother to pretend he does. I’ll confess that I don’t know where this leaves us in the media, and how we should approach his candidacy from this point forward in order to help the public understand it. But that may be the most important question we need to answer right now.

“Giant Gap In Voter Participation”: If You Want A More Democratic Nominating Process, Take A Look At Caucuses First

There are, among the 50 states (the territories are another matter), 20 nominating contests left in this presidential cycle between the two parties.  Nineteen of them are primaries, which means (with the exception of North Dakota Democrats) we can close the book on this year’s caucuses. The numbers are not very pretty in terms of participation.

An analysis published last week by Larry Sabato’s Crystal Ball of turnout in both parties for primaries and caucuses over the course of this year shows a predictable but still startling disconnect between levels of participation in the two basic types of events:

As a matter of participation, it matters considerably whether a state or territory uses a primary or a caucus. So far this year, in the 22 states where both parties have held primaries, the combined turnout of registered voters has been a reasonably healthy 36.1%. But in the eight states where both parties have used caucuses instead of primaries, just 11.3% of registered voters have cast a ballot.

Turnout in the all-caucus states ranged from a high of 17.6 percent in Utah (followed closely by Iowa at 17.1 percent) all the way down to 6.5 percent in Alaska. There were five additional states that held caucuses in one party and either conventions or yet-to-be-held primaries in the other, and their caucuses rang in at single-digit turnout percentages.

Those in either party who like to complain about party elites controlling the nominating process instead of voters should be focusing on the primary-caucus participation differences before worrying about anything else. In particular, Bernie Sanders and his supporters, who have been making the case that closed primaries unacceptably disenfranchise independents, should be equally willing to oppose the use of caucuses, which exclude far more voters, including those who in a primary state might be offered an opportunity for early or absentee voting (though it should be noted that Iowa pioneered limited absentee and distance voting in this year’s caucuses). That would involve, of course, acknowledging that many of Sanders’s best states, where he’s often been able to win very high percentages of delegates, have been in low-turnout caucus states (he’s won them in Utah, Minnesota, Hawaii, Kansas, Maine, Alaska, Washington, Colorado, Wyoming, and Nebraska). And that’s why Sanders’s share of the popular vote is significantly lower than his share of pledged delegates.

Fairness is fairness, though, and reforms cannot follow any one campaign’s grievances. Sabato argues that caucuses themselves should be reformed, and where that’s not possible, abolished:

[C]aucus states should be required by the parties or state law to make extensive efforts to include soldiers, the ill and infirm, and those who must be working or traveling during the designated caucus time. Some early, absentee balloting is simply essential to any basic notion of fairness.

Even with reforms, the giant gap in voter participation between primaries and caucuses cannot be bridged. Why not have each caucus state hold a separate primary? Occasionally, state parties have done just this — such as Texas Democrats, whose “Texas Two-Step” was done away with before 2016, or Washington Republicans, who used both a caucus and a primary in some prior cycles. Some proportion of the delegates can be picked or apportioned by the caucus and the rest by the primary. This hybrid could combine the benefits of each nominating system. This would apply to Iowa, too. To satisfy “first-in-the-nation” New Hampshire, a primary state, Iowa has to choose a caucus — but the Hawkeye State could stage a separate primary later in the calendar.

One practical problem is that some state parties hold caucuses for financial reasons: Legislatures don’t authorize (or pay for) state-run primaries, leaving parties holding the bag. If they chose, of course, the national parties could use their leverage over credentialing delegates to coerce states to hold primaries, and barring that, could require state parties to make caucuses more like primaries — abandoning, for example, the complex multistep delegate-selection processes or non-presidential discussion topics that make caucuses, especially among Democrats (who often follow the Iowa model), a lengthy and voter-unfriendly prospect. For that matter, it’s worth noting that technically caucus participants are not “voters,” but “caucusgoers.” The distinction is a useful reminder that attending a caucus does not bring with it the protections and privileges of voting, and thus should not yield its rewards, either.

“There Are Rules Involved”: Want To Change The System, Trump And Sanders Supporters? Learn How It Works First

Civic participation is one of the most important responsibilities of being an American. I’m old enough to remember when being selected to lead your homeroom class in the daily Pledge of Allegiance was a source of great pride. As kids, with our hands over our hearts, shoulders squared, we’d recite those venerable words, “…and to the republic, for which is stands…” with purpose. Unfortunately, the moral imperative of being a good steward of this great nation and understanding what it takes to preserve life, liberty and the pursuit of happiness, is an afterthought for many, if any thought at all.

Without question, the insurgent candidacies of Donald Trump and Bernie Sanders have jolted many Americans out of their normal political malaise. Bringing more citizens into the political fold is a good thing. But, what many of them are now realizing is that it takes more than just rolling out of bed to rage against the machine at big political rallies to select the next leader of the free world.

Surprise! There are rules involved. Rules governing the presidential election date back to our founding and the establishment of the Electoral College. The Constitution also gives latitude to the states in how to structure their nominating process. Electing the president wasn’t necessarily meant to be easy. Nothing worth safeguarding usually is. The founders deliberately designed our constitutional republic that way to avoid the tyrannical pitfalls of past societies like ancient Greece or the monarchies of Europe.

The Framers wanted multi-layered stakeholders invested in the best interest of the republic making it less vulnerable to the rash whims of a majority. They understood how pure democracy without checks and balances historically led to the subjugation of minority voices. It was true then and still rings true today. That’s why our Constitution does not allow for direct voting to elect the president.

The inconvenient truth is it’s our responsibility as citizens to be informed and understand how our voting laws work. And it’s the responsibility of any serious candidate for president to do the same. In this day and age, when the answers to almost anything are no more than a Google search or Siri question away, there’s no excuse for ignorance of the law/rules. With freedom comes responsibility by each and every one of us to pay enough attention to make sure those freedoms are protected.

The act of voting is one of the most fundamental rights and privileges of being an American, yet millions take it for granted and seemingly can’t be bothered to learn how their state voting procedures and deadlines work, i.e. Colorado or even New York for that matter. Just ask Trump’s own children.

It’s typical of not only Donald Trump’s personality to shift blame onto everyone and thing other than himself when he fails miserably, but it’s a growing characteristic of our society. Perhaps many are victims of their own uninformed apathy.

Perhaps there’s a lack of emphasis on the importance of civic engagement and what that entails.

Which brings me to a story shared with me by a former elementary school teacher of a charter school in a Maryland suburb of Washington, D.C.  She wanted to incorporate lessons on World War II into her curriculum. When she approached the principal about her plan, the principal scoffed and said, “What do we need to know about World War II for?” Seriously? If this is the attitude of some educators, no wonder it’s so easy to throw slogans around like Make American Great Again when so many don’t even understand what made America great in the first place.

Unfortunately, this teacher’s experience is not isolated. It’s going on in school districts around the country. Federal education policies like No Child Left Behind and Race to the Top have shifted emphasis away from social studies and history to a focus on standardized testing. In 2012, 21 states required testing in history and only nine of them required it to graduate. Only one-third of Americans can name the three branches of government, much less say what each does.

As a result of this disheartening trend, the Civics Education Initiative was born. It seeks to require high school students, as a condition for graduation, to pass a test on 100 basic facts of U.S. history and civics similar to the United States Citizenship Civics Test. The national effort is gaining traction with Arizona, Utah, and the Dakotas now requiring the civic proficiency test for graduation. A dozen other states are considering the same. It’s a start.

A dumbed down electorate is more susceptible to the manipulation of charismatic figures willing to allegedly “tell it like it is” while preying on their fears and ignorance of the history and framework of the country. It allows for someone like Donald Trump, or Bernie Sanders for that matter, to whip mobs of people into a frenzy believing they’ve been disenfranchised by a system they don’t even understand.

Scores of folks on both the Left and the Right complain that “This is not how democracy works!” They are right. This is how a constitutional republic works.

Is our system infallible? Of course not. Various changes have been made from the enactment of the 12th Amendment to the creation of the McGovern Frasier Commission after the tumult of the 1968 Democratic National Convention. If people are unhappy with the current rules, then by all means work to improve them.

However, the time to do that is not in the middle of an election cycle when the rules have already been set and agreed upon by all campaigns involved. There’s no whining in politics.

Albert Einstein famously said, “First you learn the rules of the game. Then you play better than everyone else.” Prior to running for president, Trump retweeted that very quote in 2014.  Too bad in 2016 he’s chosen to kvetch about allegedly “rigged” rules instead of putting in the campaign work to finish the job and win. It’s much easier to play the victim than take responsibility. Nowadays, it’s always someone else’s fault.

It takes effort to become President of the United States. Just like it takes effort to be a good citizen. When something is important enough, we make it a priority. It’s not the government’s job to compel us to pay attention.

How far we’ve come from President Kennedy’s decree to “ask not what your country can do for you but what you can do for your country.”

Let’s start by learning how it works.

“The Most Dangerous Blot On Our Constitution”: How The House Of Representatives Can Steal The Election For The GOP

While Republicans are busy trying to deny Donald Trump their party’s nomination, another group of conservative strategists is surely developing a more draconian backup plan: call it the Steal It In the House Option.

What might have once seemed inconceivable is now entirely possible this fall: a presidential election decided not by the voters, not even by the Electoral College, but by as few as 26 state delegations in the House of Representatives. If no general election candidate receives a majority of the electoral votes—270—the Constitution requires that the House of Representatives will elect the president.

And if that anti-democratic process isn’t bad enough, consider this perverse clause in the Constitution: each state would receive one vote regardless of population. California, with nearly 40 million citizens, gets one vote. Wyoming, with fewer than 600,000, gets one vote. Go figure.

Each House delegation would caucus and cast that state’s vote. How would that work out this fall? Thirty-two state delegations are controlled by Republicans, 15 by Democrats, three evenly split. The District of Columbia and the territories cannot vote.

Not since the tumultuous election of 1824 has this outcome occurred. Andrew Jackson won both the popular vote and a plurality of electoral votes over John Quincy Adams, but two other candidates won enough electors to deny Jackson a majority. Subsequently, the House of Representatives threw the election to Adams. Jackson’s supporters nearly rioted, and the Tennessean swept Adams out of office four years later.

That’s ancient history, but two scenarios could create a similar electoral mess this year. While an independent presidential candidate is highly unlikely to win the election, there is a growing likelihood that such a campaign could prevent either party nominee from winning outright.

1. Hillary Clinton wins a plurality of electoral votes over Republican nominee Donald Trump, but falls short of the necessary 270. An independent candidate (Rick Perry?) wins a large state such as Texas. House Republicans, repelled by both Trump and Clinton, throw the election to Perry or whoever the independent candidate is—and who finished a very distant third in the voting. (The House can choose from any of the top three vote getters.)

2. The Stop Trump movement succeeds in denying him the nomination, instead choosing Ted Cruz or John Kasich in a brokered convention in Cleveland. Trump launches an independent campaign and wins one or more states, a distinct possibility. Clinton wins a large plurality but fails to reach 270 electoral votes. The House elects Cruz or Kasich.

In either case, the Republican-controlled House, utilizing an arcane provision in the Constitution, subverts the will of American voters and prevents Hillary Clinton from winning the presidency. Farfetched? It’s not hard to imagine a deeply partisan House doing whatever it takes to deny Mrs. Clinton the presidency.

In 1968 George Wallace won five states and 46 electoral votes. It’s not a reach to envision Trump racking up a similar total in 2016, including typically tossup states such as Michigan or Florida.

Texas A&M scholar George Edwards, in Why the Electoral College Is Bad for America, writes, “…it is virtually impossible to find anyone who will defend the selection of the president by the House of Representatives, with each state having one vote. Even the most ardent supporters of the electoral college ignore this most blatant violation of democratic principles.”

There are other, even more bizarre possibilities lurking in November. In more than 20 states electors are not bound to vote for the candidate who wins their state. Could pressure be exerted to convince a few ”faithless” electors to switch to another candidate? While unlikely, in this election cycle anything seems possible.

Should such a political apocalypse occur this year, there is a silver lining. Perhaps Congress would then move to abolish an anachronistic system of filling the most powerful office in the world. That would certainly please the ghost of Thomas Jefferson, who wrote after surviving the first contingency presidential election:

“I have ever considered the constitutional mode of election…as the most dangerous blot on our Constitution, and one which some unlucky chance will some day hit.”
