“The Bane Of Political Life In America”: For Conservatives, Government Coercion Is Bad — Except When It’s Not
For conservatives, government coercion is the bane of political life in America. As members of the self-styled anti-government party, they very much are interested in making the case that coercion is inherently illegitimate, whether it is a law requiring you to purchase health care or a law requiring businesses to serve LGBT customers. The problem with this logic is that all laws are coercive — even the ones conservatives like.
Last week, I wrote about the intrinsic coerciveness of all laws in the context of protecting LGBT people from discrimination, which prompted a hilarious yet telling reaction from Sean Davis at The Federalist.
Davis, possibly because he quite obviously did not even read past the first couple paragraphs of my post, is not just wrong, but has missed the entire axis of debate. However, he does inadvertently provide a great example of just why conservatives are ill-advised to admit that all laws are coercive. Because if this is true, then conservatives will have to give up one of their favorite rhetorical tropes — being against coercion in the name of individual liberty — or resort to outright hypocrisy.
The argument was not about LGBT laws in themselves, something Davis failed to grasp. Instead it was about the justification of such laws. My position is that being against government coercion is not legitimate grounds on which to oppose any policy. This applies to liberals, too, though as members of the pro-government faction they generally don’t worry about it much.
But conservatives do. Most of what is referred to as “government” in popular media is liberal stuff like Social Security, Medicare, or food stamps. Labeling those programs as coercion gives conservatives a convenient pro-liberty sheen when they’re talking about slashing poor people’s incomes.
That changes when you bring up things like property. Though ordinary people rarely talk about it in this way, property is underpinned by exactly the same kind of coercion that bolsters civil rights or tax laws, as is the entire superstructure of what we refer to as the free market system — that is, by government coercion.
Therefore, conservatives can’t be principled anti-coercion advocates unless they are willing to throw out private property, which they obviously aren’t. Coercion can’t be bad when it supports things you don’t like and good when it supports things you do — no matter what some conservatives maintain.
Let me emphasize that this line of reasoning doesn’t mean you can’t oppose some civil rights law, just that you can’t oppose it on the grounds of being against coercion in general.
Of course, framing the discussion in this way powerfully strengthens left-wing arguments. If being anti-coercion is utter nonsense, then the debate moves to which kinds of coercion are best as judged by some other moral framework. Whether that’s utilitarianism, contract theory, or Christian ethics, under such conditions it’s a lot harder to oppose transferring income from rich to poor or social insurance programs.
Thus, when presented with left-wing slogans like “property is violence,” your average conservative, perceiving a trap, will resist. In reality there is no escape.
But what makes Davis such a great example is he genuinely doesn’t seem to understand what the problem is here. He argues in one breath that, duh, of course all laws protecting property depend on coercive violence. Then in the very next paragraph, he writes this:
At their core, however, Kohn and Cooper appear to desperately want to avoid the real question at the heart of the religious freedom debate: should the government force individuals to participate in religious ceremonies against their will? [The Federalist]
Government coercion is good, except when it’s not. That’s the kind of stark hypocrisy conservatives would do well to disguise better.

“The Grazing Moocher”: Cliven Bundy Is Free To Be Crazy And We’re Free To Call Him On It
I want to tell you one more thing I know about freedom of speech.
Having pontificated about how “the Negro” was actually better off when not burdened by freedom and government subsidies, fringe hero Cliven Bundy is shocked – shocked! – that people would dare take offense at his musings. He went on CNN Friday morning to explain (h/t ThinkProgress, which was kind enough to add the emphasis):
I took this boot off so I wouldn’t put my foot in my mouth with the boot on. Let me see if I can say something. Maybe I sinned and maybe I need to ask forgiveness and maybe I don’t know what I actually said. But you know, when you talk about prejudice, we’re talking about not being able to exercise what we think and our feelings.
We don’t have freedom to say what we want. If I call — if I say negro or black boy or slave, I’m not — if those people cannot take those kind of words and not be offended, then Martin Luther King hasn’t got his job done then yet. They should be able to — I should be able to say those things and they shouldn’t offend anybody. I didn’t mean to offend them.
Let’s set aside his truly weird suggestion that Martin Luther King Jr.’s “job” was to move society to a place where racism is completely acceptable in the public space. (I kind of thought that he was trying to move the country away from there, but whatever.)
Let’s instead talk about Bundy’s concept of freedom of speech. I get that Bundy – who achieved fame and a level of conservative-libertarian hero cred by asserting his sovereign right to freeload off of public lands – has some novel ideas about liberty and freedom. (Case in point, his belief that anyone could be better off without liberty and freedom.) But maybe I can help him out on this one.
The fact is that he does have the freedom to say what he wants. I know this because he said what he wanted and is still at large and able to make appearances on CNN trying to explain himself. He’s in absolutely no danger of being arrested for his racist views regarding black people. He has, in fact, been furnished a metaphorical megaphone in the form of just about every major media outlet in the country.
The best and most important expression of free speech is in the First Amendment to the Constitution: “Congress shall make no law … abridging the freedom of speech, or of the press…” It says the federal government is not allowed to make freely expressing yourself illegal. It doesn’t say anything about a sovereign right to express yourself without other people expressing themselves back.
As a wingnut residing on the conservative end of the political spectrum, I would think Bundy favors free markets, but he seems genuinely mystified at his experience with the free market of ideas. He proffered his thoughts on race and – as happens with markets – consumers of information and ideas weighed them and decided that they weren’t buying.
So Bundy’s feelings are hurt because he expressed and society expressed itself back. But contrary to what he seems to think, this wasn’t an absence of free speech, it was an expression of it.

From Wisconsin To Wall Street, An Economic Reckoning
The comparisons were inevitable. As Occupy Wall Street gathers momentum and new allies, progressives have quickly connected it with the other headline-grabbing uprising this year: The mass protests in Wisconsin against Gov. Scott Walker’s attack on labor unions. A statement from leaders of the American Federation of State, County, and Municipal Employees union, which endorsed Occupy Wall Street this week, was typical: “Just as a message was sent to politicians in Wisconsin, a clear message is now being sent to Wall Street: Priority number one should be rebuilding Main Street, not fueling the power of corporate CEOs and their marionette politicians.”
The essential theme connecting events in Madison and New York City is unmistakable. Both represent an economic reckoning at a time of grim unemployment rates and stagnant wages for middle-class Americans. “Both the defense of unions [in Wisconsin] and Occupy Wall Street, which is broader in its definition of the problem, are responding to two or three decades of increasing economic inequality and, until fairly recently, the inability of progressives to address those things,” says Georgetown University historian Michael Kazin, author of American Dreamers: How the Left Changed a Nation.
But the Wisconsin-Occupy Wall Street comparison is a more complicated one in its specifics. The two don’t fit neatly side by side and, in some ways, bear no resemblance at all. Here is a look at how two of the biggest populist protests of the year stack up:
The Organizers
As I reported from Madison in March, labor unions and community activist groups were, from the very beginning, the driving force in the Wisconsin protests. On November 3, 2010, the day after Republicans reclaimed the state Legislature and the governor’s mansion, union leaders began plotting how to respond to the looming assault on organized labor. And when Gov. Scott Walker unveiled his anti-union budget repair bill, and later threatened to sic the National Guard on those protesting his bill, unions marshaled their resources and called every member in their ranks. From their command center in Madison’s only unionized hotel, labor turned out more than a 100,000 supporters in a span of weeks.
Occupy Wall Street is not union-made. It was the anti-capitalist Adbusters magazine that put out the initial call for protesters to flood downtown Manhattan on September 17. Since then the protests have grown almost entirely without institutional support, an organic groundswell without leaders or executive boards or much structure at all. In recent days, unions have endorsed Occupy Wall Street, marched with them, and provided food, drinks, clothing, and more. But the protests remain a loosely organized, essentially leaderless effort.
Goals of the Movement
“Kill the bill! Kill the bill!” Wading among the crowd in Madison in February, you couldn’t go more than 10 minutes without that chant breaking out. It captured exactly what the protesters wanted: the death of Scott Walker’s anti-union bill. (They didn’t get it.) Later, those demands broadened to include fewer cuts to funding for education and social services by Walker and Wisconsin Republicans, but for much of the protests, it was perfectly clear what the angry cheeseheads wanted.
Occupy Wall Street so far has had no clear set of demands—and intentionally so, it seems. A post at OccupyWallSt.org demanded that supporters stop listing demands for fear of making protesters “look like extremist nut jobs.” The post went on, “You don’t speak for everyone in this.” The vague intentions have raised eyebrows, but they also have had the effect of welcoming a diverse group of supporters without alienating them. “The protesters have been eloquent in rejecting the idea that they produce ‘one demand’ and also in articulating in broad terms what they want,” says Robert Weissman, president of Public Citizen.
Spreading the Word
Like the protesters in Iran’s “Green Revolution” and Egypt’s Tahrir Square uprising, Wisconsin and Occupy Wall Street have made savvy use of social media for everything from rallying supporters and organizing marches to asking for food. Take Twitter: Both uprisings have built lively, if contentious, forums for debate with the hash tags #wiunion and #occupywallstreet. So many tweets poured in during Wednesday’s Occupy Wall Street march that it was impossible to keep up.
Other forms of online organizing have been pivotal. There are more than 230 Facebook pages promoting Occupy events from Tacoma, Washington, to Marfa, Texas, to Milwaukee, just as Facebook helped energize protesters in Wisconsin. And for those who couldn’t make it in person, livestreaming has brought supporters from around the country and the world closer to the action on the ground.
Laying Down the Law
Scott Walker’s bill exempted police officers from the most draconian crackdowns on workers’ rights. That put cops in a tight spot, because it was the job of the police to contain and, when necessary, crack down on the crowds of public workers who occupied the state Capitol rotunda and protested in the surrounding streets. But throughout the months-long protests, police arrested very few, allowed the occupiers to remain inside the Capitol for weeks, and generally treated angry demonstrators as best as could be hoped. Off-duty cops from around the state even joined the protesters in Madison.
Actions by law enforcement in Manhattan against Occupy Wall Street have at some turns been a very different story, with police crackdowns stealing the spotlight. This video of an NYPD deputy inspector using pepper spray on a handful of female protesters sparked outrage, added a streak of sensationalism to the story, and was picked up by mainstream news outlets. The arrest of more than 700 people who marched on the Brooklyn Bridge last weekend similarly made national headlines, leading to heaps of criticism and a class-action lawsuit against the NYPD.
Pizza for Protesters
Supporters called in pizza orders from around the world for the hearty crew of Capitol occupiers in Wisconsin. The same is happening for those camped out in Zuccotti Park, blocks from Wall Street. Pizza: It’s the nosh of choice for American uprisings in 2011.

Yearning For A Whiter America: Michele Bachmann’s Misplaced Immigration Nostalgia
In both of this month’s Republican presidential debates, Rep. Michele Bachmann hailed what she evidently believes was the golden age of American immigration — the period before the mid-1960s when, she said, “immigration law worked beautifully.”
Ms. Bachmann’s nostalgia is touching but misplaced, unless she really pines for a return to laws that explicitly favored white immigrants from a handful of Northern European countries while excluding or disadvantaging Jews, Asians, Africans and practically everyone else.
Ms. Bachmann didn’t frame it that way, of course. She blamed “liberal members of Congress” for upsetting a system that she characterized as requiring immigrants to have money, sponsors, and clean health and criminal records. In Ms. Bachmann’s world, those immigrants would learn American history and to speak English.
The Immigration and Nationality Act of 1965 fundamentally changed the system of immigration in this country but not in the way Ms. Bachmann evidently imagines. That law, pushed by Democrats including Sen. Edward Kennedy (D-Mass.) and Rep. Emanuel Celler (D-N.Y.), threw out four decades of immigration quotas whose explicit goal was to emulate America’s ethnic balance as it stood in the year 1890, when the country remained overwhelmingly white.
Specifically, the 1965 measure ended a legal regime dating from the early 1920s that generally shut out Asians (especially Japanese) and capped immigration from Latin America, Eastern and Southern Europe, and other areas at very low levels. The effect was to overhaul that hidebound, exclusive quota system. The new system, whose cornerstone gave preference to family reunification and job skills, broadened what had been a narrow pool of immigrants to include soaring numbers of newcomers from Asia and Latin America.
The shift has contributed to the nation’s diversity, dynamism and rich cultural kaleidoscope even as it challenged society, especially schools, to accommodate waves of new Americans whose looks, language and customs were unfamiliar to their neighbors.
By talking about sponsorship, English-language competency and the like, Ms. Bachmann is either confused or deliberately misleading. Most legal immigrants are still required to have family or employer sponsors, as they did in the gauzy past she idealizes. As for learning English, American history and the like, those were, and remain, requirements for citizenship, not immigration.
Ms. Bachmann, whose campaign did not respond to a request for comment, may not care for the changes and effects wrought by the 1965 bill; many other critics on the right do not. Patrick Buchanan, for example, has blamed the 2007 massacre at Virginia Tech on the immigration overhaul, noting that the gunman “was among the 864,000 Koreans here as a result of the Immigration Act of 1965, which threw the nation’s doors open to the greatest invasion in history, an invasion opposed by a majority of our people.” If Ms. Bachmann shares such views, let her address the issue honestly and head on, not in code.

“Love Thy Neighbor As Thyself”: Where Are The Compassionate Conservatives?
We heard plenty of contradictions, distortions and untruths at the Republican candidates’ Tea Party debate, but we heard shockingly little compassion — and almost no acknowledgement that political and economic policy choices have a moral dimension.
The lowest point of the evening — and perhaps of the political season — came when moderator Wolf Blitzer asked Ron Paul a hypothetical question about a young man who elects not to purchase health insurance. The man has a medical crisis, goes into a coma and needs expensive care. “Who pays?” Blitzer asked.
“That’s what freedom is all about, taking your own risks,” Paul answered. “This whole idea that you have to prepare and take care of everybody. . . .”
Blitzer interrupted: “But Congressman, are you saying that society should just let him die?”
There were enthusiastic shouts of “Yeah!” from the crowd. You’d think one of the other candidates might jump in with a word about Christian kindness. Not a peep.
Paul, a physician, went on to say that, no, the hypothetical comatose man should not be allowed to die. But in Paul’s vision of America, “our neighbors, our friends, our churches” would choose to assume the man’s care — with government bearing no responsibility and playing no role.
Blitzer turned to Michele Bachmann, whose popularity with evangelical Christian voters stems, at least in part, from her own professed born-again faith. Asked what she would do about the man in the coma, Bachmann ignored the question and launched into a canned explanation of why she wants to repeal President Obama’s Affordable Care Act.
According to the Gospel of Matthew, Jesus told the Pharisees that God commands us to “love thy neighbor as thyself.” There is no asterisk making this obligation null and void if circumstances require its fulfillment via government.
Bachmann knows a lot about compassion. She makes much of the fact that she and her husband took in 23 foster children over the years. But what of the orphaned or troubled children who are not lucky enough to find a wealthy family to take them in? What of the boys and girls who have stable homes but do not regularly see a doctor because their parents lack health insurance?
Government can reach them. But according to today’s Republican dogma, it must not.
Rick Perry, Mitt Romney, Bachmann, Paul and the others onstage in Tampa all had the same prescription for the economy: Cut spending, cut taxes and let the wealth that results trickle down to the less fortunate.
They betrayed no empathy for, or even curiosity about, the Americans who depend on the spending that would be cut. They had no kind words — in fact, no words at all — for teachers, firefighters and police officers who will lose their jobs unless cash-strapped state and local government receive federal aid. Public servants, the GOP candidates imply, don’t hold “real” jobs. I wonder: Do Republicans even consider them “real” people?
Government is more than a machine for collecting and spending money, more than an instrument of war, a book of laws or a shield to guarantee and protect individual rights. Government is also an expression of our collective values and aspirations. There’s a reason the Constitution begins “We the people . . .” rather than “We the unconnected individuals who couldn’t care less about one another . . . .”
I believe the Republican candidates’ pinched, crabby view of government’s nature and role is immoral. I believe the fact that poverty has risen sharply over the past decade — as shown by new census data — while the richest Americans have seen their incomes soar is unacceptable. I believe that writing off whole classes of citizens — the long-term unemployed whose skills are becoming out of date, thousands of former offenders who have paid their debt to society, millions of low-income youth ill-served by inadequate schools — is unconscionable.
Perry, who is leading in the polls, wants to make the federal government “inconsequential.” He thinks Social Security is a “Ponzi scheme” and a “monstrous lie.” He doesn’t much like Medicare, either.
But there was a fascinating moment in the debate when Perry defended Texas legislation that allows children of illegal immigrants to pay in-state tuition at state universities. “We were clearly sending a message to young people, regardless of what the sound of their last name is, that we believe in you,” Perry said.
The other candidates bashed him with anti-immigrant rhetoric until the evening’s only glimmer of moral responsibility was snuffed out.
