“The Senate’s 47 Percent”: Many Republicans Seem To Believe Anything Is Permissible As Long As It’s Designed To Foil Obama
In September 2002, three Democratic congressmen visited Iraq in an effort to prevent a war they thought was a terrible idea.
Rep. Mike Thompson (D-CA) said very little there, explaining afterward that his sole purpose was to tell Iraqi officials that “if they want to prevent a war, they need to prevail upon Saddam Hussein to provide unrestricted, unfettered access to the weapons inspectors.”
On the other hand, former Rep. David Bonior (D-MI) and especially Rep. Jim McDermott (D-WA) were quite outspoken while on Iraqi soil. McDermott urged Americans to take Saddam’s promises on weapons inspections at “face value” and charged that President Bush was willing to “mislead the American people.”
Needless to say, supporters of Bush and his policies did not deal kindly with McDermott and Bonior. Writing at the time in the pro-war Weekly Standard, Stephen Hayes called them “The Baghdad Democrats” and said: “What apparently didn’t concern the congressmen was the damage their trip might do abroad to any U.S.-led effort to deal with Saddam.”
Perhaps it’s not surprising that Republicans are now reminding everyone of the trio’s journey. To defend the 47 Republican senators who signed a letter to “the leaders of the Islamic Republic of Iran,” they invoke the everybody-does-it argument: that interfering with a president conducting a negotiation is as American as apple pie.
The letter itself, written in strangely condescending language that a good civics teacher would never use, instructs the Iranians about our Constitution. Any deal reached by President Obama without congressional approval would be nothing more than an “executive agreement,” the senators said. It could be voided “with the stroke of a pen” by a future president, and “future Congresses could modify the terms of the agreement at any time.” It was a blatant effort to blow up the negotiations.
In fact, it is utterly baffling that champions of this letter would even bring up McDermott and his colleagues. For one thing, many of the very same people who denounced the Democratic trio are now praising the letter. Hayes, for example, in an article posted last week headlined “A Contrived Controversy,” said the letter, offered by “patriotic senators,” was “a fact-based, substantive argument, in public, about a matter of critical importance to the national security of the United States.”
Let’s see: It’s patriotic if members of Congress contact a foreign leader to interfere with a president whose policies you don’t like, but outrageous for politicians to do a similar thing to undermine a president whose policies you support.
Which goes to the larger point: The three members of Congress went to Iraq on their own, without any support from their party’s leaders, and were actively taken to task even by opponents of Bush’s policies. At the time, I wrote a column highly critical of the visit that I didn’t enjoy writing because I respect the three men. I also noted that, in light of all the pressures to fall into line behind Bush, “anyone with the gumption to dissent these days deserves some kudos for courage.”
Nonetheless, I argued that just as the Vietnam anti-war movement was damaged by “the open identification of some in its ranks with America’s enemies,” so did the congressional visit set back the cause of those who, at the time, were trying to get Congress to pass a far more restrained war resolution.
By contrast, the 47 Republicans undercutting Obama included the Senate majority leader and the chairman of the Armed Services Committee and clearly speak for most of their party. Only seven Senate Republicans, to their credit, refused to sign, including Senator Bob Corker (R-TN), the chairman of the Foreign Relations Committee.
Two stipulations: While I support Obama’s effort to reach an agreement with Iran, I also believe in a strong congressional role in setting foreign policy and embrace the freedom to dissent from a president’s choices on war, peace and diplomacy. And, yes, most of us have had moments of inconsistency when our beliefs about a substantive matter distorted our views on process issues.
But tossing off a letter to leaders of a foreign state plainly designed to sandbag a president in the middle of negotiations goes far beyond normal procedural disagreements. It makes Congress and the United States look foolish to the world. It weakens our standing with allies and adversaries alike. And, yes, many Republicans seem to believe anything is permissible as long as it’s designed to foil Obama.
This is far more damaging to us than what those three congressmen did in Baghdad.

“Crime-For-Profit Syndicates”: Why Are We Taxpayers Subsidizing Corporate Crime?
“Do the crime, do the time,” the old saying goes. Unless, of course, the criminals are corporate executives. In those cases, the culprits are practically always given a “Get out of jail free” card.
Even the corporate crimes that produce horrible injuries, illnesses, death, massive pollution, consumer ripoffs, etc. are routinely settled by fines and payoffs from the corporate treasury, with no punishment of the honchos who oversee what amount to crime-for-profit syndicates. The only bit of justice in these money settlements is that some of them have become quite large, with multibillion-dollar “punitive damages” meant to deter the perpetrators from doing it again. Yet the same bad corporate actors seem to keep at it.
What’s going on here is a game of winkin’ ‘n’ noddin’, in which corporate criminals know that those headline-grabbing assessments for damages they’ve caused have a secret escape hatch built into them. Congress has generously written the law so corporations can deduct much of their punitive payments from their income taxes! As Senator Pat Leahy points out, “This tax loophole allows corporations to wreak havoc and then write it off as a cost of doing business.”
For example, oil giant BP certainly wreaked havoc with its careless oil rig explosion in 2010, killing 11 workers, deeply contaminating the Gulf of Mexico and devastating the livelihoods of millions of people along the Gulf coast. So, BP was socked with a punishing payout topping $42 billion. But — shhhh — 80 percent of that was eligible for a tax deduction, a little fact that’s been effectively covered up by the bosses and politicians.
This crazy quirk in America’s laws to deter corporate crime forces victims to help subsidize criminals. Follow the bouncing ball here: First, a court orders a corporation to pay punitive damages to a victim of its criminal acts; second, the corporate offender pays up, and then merrily subtracts a big chunk of that payment from its income tax, effectively taking money out of our public treasury; third, while the criminal is counting its tax break, the victim is notified that the punitive damage money he or she received from the corporation will be taxed as “regular income;” fourth, that means a big chunk of the victim’s payment goes into the treasury to replenish the public money the corporate villain subtracted.
This is nothing but shameful pandering by government officials to rich and powerful criminals. It’s bad enough that corporate-financed lawmakers legalize such encouragement of criminality, but corporate-coddling judges are playing the same disgraceful game — drastically reducing the amounts that juries order corporations to pay. In a Montana case, for example, a jury awarded $240 million in punitive damages to the families of three people, including two teenagers, killed in a car crash. The deaths were blamed on a steering defect that South Korean automaker Hyundai was found to have known about and “recklessly” ignored for more than a decade. But a district judge has since supplanted the jury’s ruling with her own. While declaring that Hyundai’s “reprehensibility” certainly warrants a sizeable punishment, she cut the corporation’s punitive payment down to $73 million.
Hello — that’s not punishment to a $79-billion-a-year car giant, it’s pocket change. Why would Hyundai executives quit putting corporate profits over people’s lives if that’s their “punishment”?
Plus, we taxpayers and the victims’ families are still lined up to subsidize whatever “punishment” Hyundai ultimately pays. With subsidies and wrist-slaps, the corporate criminal whirligig will continue to spin, making a mockery of justice. Fortunately, Senator Leahy has had the good sense to introduce legislation to lock down this escape hatch for thieves, killers and other executive-suite villains. “Congressional Dysfunction, The Serialized Tragicomedy”: Democrats Should Restrict Their Legislative Actions To Maximum Of Seven Days
The problem with modern-day politics, aside from everything, is that it lacks consistent excitement.
Sure, there are moments when debate over a major bill gets attention, but our interest fades once the bill passes and we drift back to more intriguing things, like reality television shows about dumb people.
Last week, however, lawmakers in the GOP-controlled Congress took a step that could turn American politics into must-see TV: They serialized democracy.
At issue was a bill to continue funding the Department of Homeland Security, the folks responsible for protecting our borders and keeping the country safe from terrorism. Most would agree it’s important to have that part of the government functioning, largely so it can do its “keeping the country safe from terrorism” thing.
After the requisite amount of harrumphing and whatnot, lawmakers could have just funded the department and moved on to other matters, allowing us to get bored and shift our attention to the myriad Kardashians we have to keep up with.
Instead, a wily group of Republicans decided the Homeland Security funding bill would be a great thing to use as leverage against President Barack Obama’s recent executive action on immigration, which is supposed to shield from deportation about 5 million immigrants who live in the U.S. illegally. The GOP lawmakers said they would only fund the Department of Homeland Security if the bill also rolled back Obama’s executive action, which they say is illegal and tyrannical and really hurt their feelings.
The problem is, Democrats won’t vote for a DHS funding bill that overrides the president’s immigration action, and even if they did, Obama would veto the whole thing. Also, the president’s attempt at immigration reform was recently suspended by a federal judge.
But legal limbo and the Sisyphean nature of legislatively doing away with Obama’s executive action would not deter these Republicans. They stuck to their guns, shot down short-term funding measures and — as the clock ticked to the deadline — finally agreed to give the Department of Homeland Security a week’s worth of additional money.
Several Republicans criticized their own party for being unable to reach agreement on a long-term bill that would keep the DHS running. And Democrats, naturally, had a field day.
Democratic Congressional Campaign Committee communications director Matt Thornton told Politico: “If this is a harbinger of things to come, the American public is in for a very long, painful and unproductive Congress.”
That’s one way to look at things. The other is that America is in for a long, gloriously dramatic and delightfully farcical new season of “Congress.”
With a one-week funding extension, Republicans gave us not just a dramatic cliffhanger — What happens when the homeland you love is no longer protected? — but the promise of another week of political intrigue.
Will Obama cave to the GOP’s pressure, take back his executive action and finally admit he’s a Kenyan-born radical transported through time to bring American society to its knees? Will House Speaker John Boehner rise from his office tanning bed, march to the congressional clubhouse where ultra-conservative lawmakers make forts out of stacks of money and shout, “SERIOUSLY, GUYS?!?”
This is not a failure to govern on the part of Republicans. It’s an ingenious way to methodically push the political narrative forward and keep Americans enthralled.
Perhaps the wildly popular public radio podcast Serial — which drew millions of online listeners by using an episodic format — gave lawmakers this idea. Wherever the concept came from, it’s gold.
Following the Republicans’ “short-term decisions equal long-term drama” lead, Democrats should now restrict their legislative actions to a maximum of seven days.
For example, rather than flatly vetoing the GOP’s Keystone XL pipeline bill, Obama should have issued a special one-week veto. That would have given us days of delicious bickering between legislators, oil companies and environmentalists. Why watch The Real Housewives of Beverly Hills when you could see The Real Final Supplemental Environmental Impact Statements for the Keystone XL Pipeline Project of the State Department?
Here’s the bottom line: Episodic politics would put plenty of butts on sofas and finally get Americans tuning in to what their government is doing or, in most cases, not doing.
What’s to lose? If the whole process is going to be ridiculous, it might as well be ridiculously good TV.

“Upending The Status Quo”: How Obama Is Shrewdly Using Partisanship To Sideline Netanyahu And Save The Iran Nuclear Deal
The conventional wisdom is that partisanship in Washington, D.C., is one of the biggest obstacles to solving America’s most entrenched problems, from fixing the immigration system to closing the inequality gap. But if the fallout from Israeli Prime Minister Benjamin Netanyahu’s forthcoming address to Congress is any indication, partisanship can be a pretty useful tool when it comes to upending the status quo.
Throughout the controversy, the White House has been happy to run its relationship with Netanyahu through the partisan vortex, helping splinter a bipartisan consensus that was once the most potent domestic threat to a U.S. rapport with Iran — a deal that would constitute the crowning accomplishment of President Obama’s foreign policy legacy.
Of course, Netanyahu has himself to blame more than anyone. By accepting an invitation from House Speaker John Boehner (R-Ohio) to essentially hammer the administration before a joint session of Congress, without notifying the White House or the State Department, he took his longstanding disdain for Obama to new heights. When even Fox News anchors are questioning your treatment of the president, this may be a sign you have crossed a line.
He exacerbated his problems by rejecting an invitation from Democratic Sens. Dick Durbin (Ill.) and Dianne Feinstein (Calif.) to privately meet with Democrats, in what they said was an attempt to “balance the politically divisive invitation from Speaker Boehner.” Netanyahu explained that the meeting would “compound the misperception of partisanship regarding my upcoming visit,” but it seems his rejection accomplished that just fine on its own.
“Since when does an Israeli prime minister say no to a meeting with Democrats?” bemoaned a former Israeli official to The New York Times. And referring to Durbin and Feinstein, he said, “By the way, their Israeli voting record is impeccable. Not good, not very good, impeccable.”
This gets to the crux of the problem for Obama, as he potentially heads into the final stretch of a years-long attempt to reach a deal on Iran’s controversial nuclear program. He not only has to fend off opposition from Republicans, but staunch pro-Israel members of his own party, some of whom seem intent on passing additional sanctions on Iran to scuttle any deal. The problem is so acute that, as recently as January, Obama faced the prospect of a united Congress overriding his veto for the first time in his presidency.
But that has changed. By aligning himself so plainly with the GOP, Netanyahu may have made it impossible for Democrats to join the Republicans. As Dov Zakheim writes at Foreign Policy, “Netanyahu’s determination to address Congress has all but destroyed any chance the Hill’s passing new sanctions and overriding a presidential veto. The deal will therefore go ahead.”
The Obama administration appears to realize this, taking the fight to Netanyahu in a highly public way. The White House made clear it would snub Netanyahu, saying both Obama and Vice President Joe Biden would not meet with him. It still has not said who (if anyone) will be attending the annual summit this weekend of the American Israel Public Affairs Committee, the powerful pro-Israel lobby. [Update: Rice and Samantha Powers, the U.S. ambassador to the U.N., will attend.] Then this week, National Security Advisor Susan Rice said Netanyhu’s speech was “destructive” to U.S.-Israeli relations — not “unhelpful” or any other boilerplate diplomatic language, but “destructive.”
Then Secretary of State John Kerry used his testimony on Wednesday to the House Foreign Affairs Committee to remind everyone that Netanyahu supported the U.S. invasion of Iraq in 2003. Never mind that Kerry was for it before he was against it — he noted that Netanyahu is a hysterical hawk and associated the Israeli prime minister with the most divisive foreign policy issue of the last generation. After all, everyone knows that there is little rank-and-file Democrats hate more than the Iraq War and those who egged the Bush administration on. (Kerry’s attack was all the more remarkable given the fact that his friendship with Netanyahu goes back to the 1970s.)
This is all bad news for those who believe that a U.S. accord with Iran would spell doom for Israel. But for those who believe that diplomacy and negotiations are far better than the alternatives, they might have partisanship to thank.

“The Catastrophe Bibi Is Courting”: Bolstering His Re-Election And Pushing For War, He Should Be Careful What You Wishes For
So Bibi Netanyahu did not back down, and he’s here now in the United States, and he’s giving the speech Tuesday. In doing so, he has forced a true low point in U.S.-Israel relations. As has been often observed, he’s turning Israel into a partisan issue—up to somewhere around a quarter of congressional Democrats are refusing to attend the speech. That’s a crack, a big one. If he remains prime minister after the March 17 elections, the fissures between Netanyahu’s government and Barack Obama and the Democrats will only widen.
Congressional support for Israel is due for a reconsideration. As Scott McConnell wrote last month in The American Conservative (an anti-neocon magazine), Congress “does not come close to representing the views of the American people” on Israel, either with respect to Iran or the occupation. McConnell cites all the requisite poll numbers that make the case.
Now, Congress can go a long time without representing American public opinion. On certain big-money issues like banking, that’s all Congress does. But on most issues, Congress at least has to act like it’s listening to the American people, and on foreign policy questions in particular, Congress, and for that matter the president, can’t usually go where the American people don’t want to go. Obama probably wanted to drop a smattering of bombs on Syria in 2013, but public opinion was dead set against it. And remember how the Bush administration had to work public opinion in 2002 and 2003 to make sure the lies about Saddam Husssein’s nuclear ambitions got support levels up to 60 percent or so before it launched the war.
So one of these days, in two years or five or six, congressional fealty to Israel will cease being so bipartisan and reflexive—and that will be entirely an outcome of Netanyahu (and John Boehner’s and Ron Dermer’s and AIPAC’s) making.
But all that is just politics. Netanyahu is creating a much bigger problem here. Ultimately, he wants war with Iran. And American neoconservatives want it, too. Few of them will say so (although some do—see below). But that’s what they want, and we need to be clear about it.
Think about it. What is the alternative to negotiating with Iran? Well, there is only one: not negotiating with Iran. And what are the possible courses of action under that option? At the end of the day, there are two. Number one, let Iran do what it wants. Number two, ultimately, be willing to start a war to block Iran’s nuclear ambitions.
Knowing the neocons’ world view as I’m sure you do, how willing do you think they’d be to let Iran do what it wants? Correct. Not very. That leaves war. There is the step of tougher sanctions as a middle course, but sanctions, even crippling ones, don’t usually change a regime’s behavior. So the clear implication of the anti-negotiation position is war—with a country of 77 million people, a huge army, and formidable wealth. As a point of comparison, Iraq in 2003 had about a third of Iran’s population.
As noted above, not many on the right are going to be honest enough to speak openly of war. The Republican presidential candidates, for example, don’t want the American public to think they’re crazy, so they won’t admit this—although interestingly, Rick Santorum became, I believe, the first Republican candidate to call for up to 10,000 U.S. combat troops on the ground to fight the so-called Islamic State.
With regard to Iran, the candidates hide behind the usual euphemisms. But a few war-makers are coming out of the closet. Matt Welch of Reason noted last week that on a panel at CPAC, both John Bolton and new Arkansas Sen. Tom Cotton spoke openly of the desire for regime change in Iran. Bolton said U.S. policy toward Iran should be “overthrow of the ayatollahs.” Cotton added that we need regime change and “replacement with a pro-Western regime.”
Where is Netanyahu on this? Every indication he’s given us is that he’s on the Bolton-Cotton team. I don’t doubt that the prime minister sincerely believes that a nuclear-armed Islamic Republic would be catastrophic for Israel, and we should not dismiss that concern. No opponent of the neoconservative approach should be foolish enough to think that we can trust Iran. Israel has good reason to be worried. (I will, however, mention here Israel’s own 100-odd nuclear warheads, just on principle, because they always go unmentioned in columns like these.)
So Netanyahu wants, at the very least, a bombing campaign. But you know as well as I do that most of the leading experts say Iran’s centrifuge capacities are now too numerous and too geographically disparate for a bombing campaign of the usual scope to be very effective. That means a bombing campaign of unusual scope.
Do Netanyahu and Bolton really expect that Iran would not retaliate in such a case? Of course it would retaliate. And far more likely against Israel than against the United States. But the United States would be dragged into it, which is exactly what Bolton and Cotton told CPAC we should all want.
It seems to be what Netanyahu wants, too. It’s what he wanted back in 2002, when—then as a private citizen—he went to Congress and made the case for war against Iraq. As Josh Marshall noted last week, some of his words from back then are enough to make you shudder: “If you take out Saddam, Saddam’s regime, I guarantee you that it will have enormous positive reverberations on the region.”
It had the opposite effect, of course. It strengthened Iran and gave us ISIS. And now we’re supposed to make up for that huge mistake by trusting Netanyahu and the neocons again?
I’m sure Netanyahu’s words will be measured Tuesday. He wants Israel’s levels of support in America to be high, and he wants to win re-election. But don’t be fooled. He and his Republican backers are leading us down a potentially catastrophic path. And catastrophic not least for Israel itself: If this path someday reaches its logical end point, it won’t be only liberal Democrats in America who’ll conclude that we should just let Israel fight its own battles.
