“Straying From The Partisan Script”: What James Comey And John Roberts Have In Common

In conservative circles, Supreme Court Chief Justice John Roberts used to be a respected figure, held in high regard. Roberts enjoyed a lengthy record as a center-right jurist, and when then-President George W. Bush nominated him to the high court, Republicans everywhere were delighted.

Roberts did not, however, stay in the right’s good graces. After the chief justice voted to uphold the constitutionality of the Affordable Care Act – twice – quite a few conservatives, and even some Republican presidential candidates, turned on Roberts, questioning his judgment, intellect, and integrity.

Right about now, I suspect FBI Director James Comey can relate to how Roberts must feel about his former admirers abruptly changing their opinions.

Comey, in case anyone’s forgotten, is a lifelong Republican who served as a top official in the Bush/Cheney Justice Department. He cut his teeth as a public-sector attorney in the 1990s, when Comey signed on “as deputy special counsel to the Senate Whitewater Committee,” where he went after, of all people, Hillary Clinton.

I’m not aware of anyone on the right questioning Comey’s abilities or professionalism ahead of yesterday’s announcement in the email matter. On the contrary, Republicans gave Comey a vote of confidence as recently as June. Politico published this report one month ago today:

Should the FBI not recommend an indictment of Hillary Clinton following its investigation of the setup of her private email server, House Oversight Committee Chairman Jason Chaffetz (R-Utah) on Monday said he and his Republican colleagues would “probably” accept the outcome.

“Oh, probably, because we do believe in [FBI Director] James Comey,” the Utah Republican said during an appearance on Fox News’ “Outnumbered.” “I do think that in all of the government, he is a man of integrity and honesty.”

Yesterday, however, Chaffetz said the exact opposite, and accused Comey of failing to carry out his duties. Other GOP members of Congress made related arguments, while some Republican pundits adopted an even harsher posture.

The pattern matters. John Roberts was an excellent justice, Republicans said, right up until he strayed from the partisan script. Trey Gowdy was the perfect person to lead the GOP’s Benghazi Committee, they said, right up until he failed to dig up dirt on Hillary Clinton.

And Jim Comey was a fine FBI director, right up until he left his party dejected by exercising independent judgment.

In reality, Roberts, Gowdy, and Comey aren’t guilty of corruption or partisan betrayals – their “failures” exist solely in the minds of lazy ideologues. What their Republican critics don’t seem to appreciate is that their ostensible allies asked them to go too far, ignore their responsibilities, abuse an otherwise legitimate process, and look out for the “team,” whether the facts warranted it or not.

Comey didn’t play along with a partisan game, and his reward is a round of condemnations from the same people who, up until 24 hours ago, sang their praises.

“The Simple Answer Is Donald Trump”: Why Republicans Couldn’t Make 2016 Their Version of 2008

Parties exist in large part to bring order and stability to politics. When you go into the voting booth in November, you’ll be confronted with a bunch of races you know nothing about, but the party affiliations of the candidates will tell you almost everything you need to know in order to make reasonable choices. You can predict much of what a candidate for county council will do just by knowing which party she represents—and that goes for president, too.

Yet every four or eight years, the parties have to offer the country something entirely new for the office of the presidency, something that will be untainted by the party’s past mistakes and perfectly positioned to take advantage of the other party’s more recent ones. And only when timing and individual ambition come together can a party give the country exactly what it’s looking for.

Republicans had hoped that they could achieve that this year, that it could be for them what 2008 was for the Democrats: an election they’d always remember, when they rid themselves of a president they hated and swept into the White House someone they were truly excited about, who carried their dreams with him and brought a majority of the nation around to their way of seeing things. But it won’t happen.

Why not? The simple answer is “Donald Trump,” but it’s more complicated than that.

To understand why, let’s recall what 2008 was like—though you could make a similar comparison to 2000, 1992, 1980, or 1976. In all those elections, one party offered a candidate who seemed to embody everything the president whom voters were rejecting had failed to be. And critically, that candidate was both what his party wanted and what the country was ready for.

In 2008, Barack Obama really did represent Democrats in a multitude of ways. He was African-American, from the party’s largest and most loyal constituency group. He was from one of America’s largest cities, in a party that finds its greatest strength in growing urban areas. And perhaps most of all, he was the kind of person so many Democrats would like to see themselves as: thoughtful, intellectual, urbane and cosmopolitan, the kind of guy who can talk literature with Marilynne Robinson, croon the opening of “Let’s Stay Together,” and help Steph Curry work on his jump shot.

And the nation as a whole was open to the kind of change he represented. So could Republicans have found someone to do the same thing this year? On the simplest level, it’s a much greater challenge now than it was then. In 2008, the most important change Democrats wanted—getting rid of George W. Bush—was the same change the country was looking for. That’s not the case with Republicans today. Barack Obama’s approval rating is right around 50 percent, which in this severely polarized era is somewhere between solid and excellent. At this time eight years ago, on the other hand, Gallup measured Bush’s approval at an abysmal 28 percent.

That doesn’t mean there isn’t plenty of dissatisfaction out there waiting to be activated. But it’s worthy of note that even in previous elections where candidates succeeded by portraying themselves as anti-establishment figures ready to shake up the status quo—Bush did it in 2000, Bill Clinton did it in 1992, Jimmy Carter did it in 1976—those candidates never used anti-Washington rhetoric that was as angry and bitter as what we’ve heard from Republicans this year. Instead, they said they’d transcend partisanship and bring a new spirit of conciliation and integrity.

Maybe nobody believes that kind of thing anymore, no matter what their party. But if Obama embodied Democrats in 2008 (and still does), who embodies today’s Republicans? It certainly wasn’t someone like Marco Rubio, whom everyone seemed to agree was the most palatable candidate to the general electorate. He was supposed to be the new face of the GOP, and he opened his presidential campaign by saying that “The time has come for our generation to lead the way toward a new American century,” and that “yesterday is over, and we are never going back.”

But that’s not what Republicans turned out to want—in fact, going back to yesterday is exactly what they’re after. They’re looking not just for someone who isn’t Barack Obama, but a wholesale reversion to the past, to a time when hierarchies of home and community were clear, when the nation’s culture was their culture, before “diversity” became something people were supposed to value. So it’s no accident that their favored candidate is a 69-year-old white man who tells them he can “Make America Great Again” by tossing out immigrants, keeping out Muslims, and building enormous walls.

Donald Trump is the opposite of Barack Obama, and not just because he’s old and white. Impulsive, shallow, ignorant, prone to emotional outbursts and consumed with every petty slight, Trump couldn’t be more different from “no drama” Obama. That’s what Republicans wanted, at least a plurality of them. The problem is that the broader voting public doesn’t yet seem to be demanding the opposite of Obama, at least if Trump is what that means.

“Chuck Grassley’s Supreme Court Coup”: To Protect The Court From Politics, Seat Nine Chuck Grassleys And Go Home

Sen. Chuck Grassley is in a tough spot. The Republican from Iowa, who chairs the Senate Judiciary Committee, has to decide whether or not to grant Judge Merrick Garland a hearing or to continue the unprecedented obstruction of President Obama’s Supreme Court nominee. When a guy dressed like Ben Franklin is trolling you through town halls in Iowa, you know you’re in trouble.

But Grassley’s bigger problem is that he has indicated in the past that he knows better than to take a torch to the Supreme Court for the sake of partisanship. Like most court-watchers, Grassley is well aware that the institution is often political, and that it always has been. But like most court-watchers, he is also aware that the continued viability of the institution rests on the jagged myth that the court can transcend politics and those moments when the court actually lives up to that ideal.

Grassley surely knows better than most that the court has only the public’s esteem to shore it up—and he knows better than anyone that the public trust demands at least some confidence the judicial project is about more than brute power and party loyalty.

Grassley knows all that, but as pressure on him has ramped up to hold hearings—and a vote—on a seat that remains empty, he’s apparently decided it doesn’t matter anymore. On Tuesday, Grassley gave a speech that went after the Supreme Court as a purely political institution, pantsing the entire high court, and Chief Justice John Roberts by name, on the floor of the United States Senate. In so doing, he not only damaged the Senate’s relationship with the court in a way he may not be able to repair, but also exposed his own hypocrisy as chairman of a judiciary committee tasked with ensuring that the court can function.

Grassley went after Roberts specifically for having the temerity to give a speech before Justice Antonin Scalia’s death, where he noted that “the [nomination] process is not functioning very well” and that well-qualified nominees—including current Justices Samuel Alito, Elena Kagan, and Sonia Sotomayor—should have been confirmed along bipartisan lines.

No way, said Grassley. If politics have overtaken the nomination process, it’s the court’s fault. “What’s troubling is that a large segment of the population views the justices as political,” Grassley said. And whose fault is that? “The justices themselves have gotten political,” he declared. “And because the justices’ decisions are often political and transgress their constitutional role the process becomes more political.” In fact, Grassley added, (apolitically) his own constituents believe that Roberts “is part of this problem.”

“They believe that the number of his votes have reflected political considerations, not legal ones,” Grassley continued, adding with a flourish “so, physician, heal thyself.” To add a little mob flair, he then warned the chief not to insert himself into Garland’s nomination fight.

To be fair to Grassley here, we should consider: Isn’t he just telling the truth about politics influencing court opinions?

The problem with this defense is that the judiciary chair’s double-helix of hypocrisy gives him no standing to call out Roberts or any member of the court. Grassley has—at various times in his career—argued that the court is different from the other two patently political branches. For instance: In January 2006, with Alito having just been appointed to the high court, Grassley argued that the politics had nothing to do with the nomination process, nor the court. “The Senate’s tradition has been to confirm individuals who are well qualified to interpret and to apply the law and who understand the proper role of the judiciary to dispense justice,” he said. This coming from the man who is now arguing that politics is the reason we can’t have a hearing.

But the extra special hypocrisy sauce here is that Grassley now says that the only way to depoliticize the court would be to appoint nominees who conform their political views to those of the Republican Party. “Justices appointed by Republicans are generally committed to following the law,” he said. And then he argued that the court is too political because Republican nominees don’t act sufficiently politically. “There are justices who frequently vote in a conservative way,” he said. “But some of the justices appointed even by Republicans often don’t vote in a way that advances conservative policy.”

Wait, what? So the problem for Grassley isn’t “political” justices—it’s justices appointed by Republicans who don’t advance “conservative policy” 100 percent of the time. And with that, he revealed his real issue. His Senate floor attack isn’t about depoliticizing the court at all. It’s about calling out Roberts for being insufficiently loyal to the Tea Party agenda when he voted not to strike down Obamacare.

What is really being said here is that there is only one way to interpret the Constitution and that is in the way that “advances conservative policy.” According to Grassley’s thinking, a justice who fails to do that in every single case before him or her is “political” and damaging the court. By this insane logic, the only way to protect the court from politics is to seat nine Chuck Grassleys and go home. And to achieve this type of court he will stop at nothing, including trash talking the entire institution from the Senate floor and threatening the chief justice who will, because he is chief justice, decline to respond.

Again, remember back at the time of the fight over Alito when the same Sen. Grassley warned, “the Supreme Court does not have seats reserved for one philosophy or another. That kind of reasoning is completely antithetical to the proper role of the judiciary in our system of government.” What that seems to have meant in retrospect: There is only a single judicial philosophy and if I don’t get a nominee who shares that philosophy, I’ll happily slander the whole court.

Grassley’s aides like to claim that he believes in his heart that this unexpected election-year vacancy offers the country a rare opportunity for a national debate about the role of the Supreme Court. We have a forum for just such a debate. It’s called a confirmation hearing. But Grassley doesn’t want a debate. He wants a coup.

Speaking Thursday afternoon at the University of Chicago Law School on the court’s role, President Obama warned against exactly this form of dangerous and destructive politics. When people “just view the courts as an extension of our political parties—polarized political parties” he warned, public confidence in the justice system is eroded. “If confidence in the courts consistently breaks down, then you see our attitudes about democracy generally start to break down, and legitimacy breaking down in ways that are very dangerous.”

Sen. Grassley has made the choice to hold no hearings and have no vote for an eminently qualified jurist because—as he has now openly stated—there are only two legitimate justices on the Supreme Court, the two who agree with his viewpoint 100 percent of the time. Grassley, and the rest of his Republican colleagues who continue to refuse hearings and a vote on Merrick Garland, have seamlessly and shamelessly turned the entire judicial branch into their own, private constitutional snowglobe.

“Just A Clownish Governor”: Paul LePage’s Latest Tantrum Is A Doozy, Even For Him

Susan Deschambault, a Maine Democrat, recently won a state Senate special election, and as part of the process, she was invited to Gov. Paul LePage’s (R) office for an official swearing-in ceremony. So, Deschambault and her family drove 72 miles, arriving at the governor’s office bright and early on Friday morning for her 9 a.m. appointment.

What she did not know, however, is that LePage preferred to throw a tantrum, refusing to swear Deschambault in because the far-right governor is mad at Democratic legislators. The Portland Press Herald reported:

Gov. Paul LePage abruptly canceled a swearing-in ceremony Friday morning for a newly elected senator in response to Democratic lawmakers’ votes against one of his nominees.

Senator-elect Susan Deschambault, a Democrat who won a special election Tuesday for the Senate District 32 seat representing the Biddeford area, showed up with her family at LePage’s office for her scheduled swearing-in at 8:50 a.m. only to be told the event had been canceled.

According to LePage’s spokesperson, the governor – a grown adult – was looking for payback. Apparently, the Republican nominated a conservative talk radio figure to serve on the Maine Unemployment Insurance Commission, but Democrats defeated the nomination last week.

The unhappy governor, in an “I’ll show you…” frame of mind, took out his frustrations on Deschambault, turning her and her family away when they showed up for the ceremonial event.

The newly elected Democrat reportedly thought this was some kind of April Fool’s joke, before realizing that LePage wasn’t kidding. He simply wouldn’t swear her in.

The Bangor Daily News ran a piece over the weekend, wondering what in the world LePage hoped to gain from this: “What was gained by refusing to swear in Susan Deschambault? Nothing. Literally nothing…. Now the story is about how a woman who won an election had her family travel to the capital to celebrate her accomplishment, only to have made the trip for nothing because of a partisan disagreement. How is this a win?”

The NBC affiliate in Portland reported yesterday that the governor’s office announced that the newly elected lawmaker will eventually be sworn in – when LePage feels like it.

Two days after the ceremony was postponed, Gov. LePage attended the opening of a store in Swanville. When asked whether or not the oath would happen, he answered, “Yeah, she’s going to be sworn in. But it’s not on her schedule. My schedule is a little busier than hers.”

When pressed further if he would be the person to administer the oath, he said, “Of course I am. You know, they kick you and beat you and slap you over the head. And then the very next morning at 8 o’clock, they’re there before you put your briefcase down, your cup of coffee on the desk, they want to be sworn in. She will be sworn in according to the laws of the Constitution of the State of Maine.”

In case you were wondering, Deschambault’s special-election victory did nothing to change the makeup of the chamber – the 35-member Maine Senate will still have a Republican majority, 20 to 15, even after she’s sworn in. In other words, there’s no legislative or policy reason to delay the process.

Rather, this is just a clownish governor throwing the latest in a series of tantrums, simply because he can.

“Sanders Polls Well With Independents”: But He Might Lose His Appeal If He Were The Democratic Nominee

Anyone who stares at polls for a good while probably knows that Bernie Sanders is significantly more popular with both independents than Republicans than is Hillary Clinton. Indeed, this is probably at the heart of Sanders’ fairly regular advantage over HRC in general election trial heats.

There are two common interpretations of Sanders’ regularly higher ratings among non-Democrats. The first, popular among Clinton supporters, is that he simply isn’t well-known enough to draw the ire of conservatives and moderates. The second, which you hear some Bernie fans articulate, is that he represents a subterranean majority of voters that transcends party labels. The first take undermines Sanders’ electability claims; the latter reinforces it.

But there’s a third interpretation that should arise every time one hears Sanders described as an “independent running for the Democratic nomination” or even as a “democratic socialist.” What he’s not being described as is a Democrat.

At The Upshot this weekend, political scientist Lynn Vavreck reminded us that pure, simple partisanship is largely what is driving the anger in American politics at the moment:

That Democrats and Republicans have different views on issues — even issues about race and rights — is not surprising. But recent work by Stanford University’s Shanto Iyengar and his co-authors shows something else has been brewing in the electorate: a growing hostility toward members of the opposite party. This enmity, they argue, percolates into opinions about everyday life.

Partisans, for example, are now more concerned that their son or daughter might marry someone of the opposite party (compared with Britain today and the United States in 1960). They also found that partisans are surprisingly willing to discriminate against people who are not members of their political party.

We’ve entered an age of party-ism.

So being less marked with the sign of the Democratic beast, it’s unsurprising that Sanders is less despised by those who dislike that party (Republicans) or both parties (true independents).

Would that survive a Democratic national convention in which Sanders (assuming he somehow wins the nomination) is kissing every Democratic icon in sight? And is then embraced in the final emotional moments of the convention by Hillary and Bill Clinton and Barack Obama?

I don’t think so. Whatever vehicle Sanders rides into Philadelphia, he would ride out of Philadelphia on a donkey. That could lose him some points among non-Democrats.
