“Virtual Walls And Rhetorical Deportations”: Adapting What Trump Actually Said Can’t Cover Up Reality
One of the reasons that so many people underestimated the possibility of Donald Trump’s rise in the Republican Party is that we zeroed in on his policy proposals and actually took them seriously. If you remember, during the primary debates there was a lot of ink spilled on the nuanced differences between Rubio, Cruz and Trump on illegal immigrants. None of that ever mattered. What Trump was communicating to his supporters didn’t have anything to do with all of that. His message has always been emotional – not thoughtful or logical.
That’s what makes the comments by Rep. Chris Collins – the first member of Congress to endorse Trump – so fascinating.
The first member of Congress to endorse Donald Trump for president doesn’t envision one of Trump’s main campaign promises – a wall at the Mexican border – ever becoming a reality that stretches from the Pacific Ocean to the Gulf of Mexico.
“I have called it a virtual wall,” Rep. Chris Collins said in an interview with The Buffalo News.
“Maybe we will be building a wall over some aspects of it; I don’t know,” the Clarence Republican said of Trump’s proposed barrier to keep illegal immigrants and drugs from crossing the southern border.
Collins, who has become one of the presumptive GOP nominee’s main media surrogates, also cast doubts on another central Trump campaign promise: the candidate’s vow to deport the nation’s 12 million undocumented immigrants.
“I call it a rhetorical deportation of 12 million people,” Collins said.
He then gestured toward a door in his Capitol Hill office.
“They go out that door, they go in that room, they get their work papers, Social Security number, then they come in that door, and they’ve got legal work status but are not citizens of the United States,” Collins said. “So there was a virtual deportation as they left that door for processing and came in this door.”
Collins added: “We’re not going to put them on a bus, and we’re not going to drive them across the border.”
Collins went on to say that Trump wouldn’t necessarily agree with this interpretation of his proposals. In other words, they are Collins’ way of adapting what Trump actually said in a way that allows him to support the candidate. I wonder if anyone finds that as interesting as I do. I suspect that it is pretty common in campaigns that are fueled primarily by emotions rather than workable policies. In other words, it is rampant in the world of post-policy Republicans.
So beyond assuming virtual walls and rhetorical deportations, why does Collins support Trump? Here’s what he said:
“I’m comfortable with his judgment as a CEO, and I’m comfortable with his 60,000-foot level vision for America,” Collins said, noting that many of the details in Trump’s proposed policies are yet to be worked out.
Oh my! He’s comfortable with Trump’s judgement and vision, but pesky “details” about things like rounding up and deporting millions of people can get worked out later. Rep. Collins’ approach to politics is why I wrote this the other day:
That might be what this campaign comes down to – a contest between someone who is trying to reflect our feelings of anger and fear and someone who is determined to tackle the challenges we face as a country.
Donald Trump’s judgment and vision are those of a narcissistic bully let loose on the national stage. Using words like “virtual” and “rhetorical” can’t cover up that reality.

“Hardly Unprecedented”: On Immigration, Law Is On Obama’s Side
The legal controversy surrounding the Obama administration’s immigration enforcement policies will soon come to a head when the Supreme Court justices hear the case United States v. Texas on Monday. Texas claims that the president’s executive decisions lack legal sanction by Congress and have injured the state.
But whether or not you like President Obama’s actions, he has operated under longstanding provisions of law that give the executive branch discretion in enforcement. This presidential prerogative has been recognized explicitly by the Supreme Court. Moreover, the nature of immigration enforcement and the resources (or lack thereof) appropriated by Congress necessitate exactly the type of choices that the president has made.
Congress has repeatedly granted the executive branch broad power in enforcing immigration laws. The 2002 law creating the Department of Homeland Security explicitly said the executive should set “national immigration enforcement policies and priorities.” The Supreme Court has recognized the leeway Congress gives the executive branch in deportations. In a 2012 majority opinion written by Justice Anthony M. Kennedy and joined by Chief Justice John G. Roberts Jr., the court noted that “a principal feature of the removal system is the broad discretion exercised by immigration officials,” including the decision “whether it makes sense to pursue removal at all.”
Setting enforcement priorities is vital to the effectiveness of our immigration laws. Congress can’t anticipate every situation. This is why the Supreme Court recognized in 1950 that immigration law is an area where “flexibility and the adaptation of the congressional policy to infinitely variable conditions constitute the essence of the program.”
The immense moral and legal consequences of a deportation campaign targeting up to 11 million undocumented immigrants are obvious. Even Americans whose frustration has overcome their compassion and led them to support the harshest immigration enforcement would be likely to reconsider if they actually saw such an operation in action.
A huge roundup like that would require an extraordinary expansion of federal law enforcement capabilities and resulting intrusions into American society. But in reality, there is no prospect for such a campaign because Congress has not made available more than a small fraction of the necessary money and manpower.
This is why, by its nature, immigration enforcement requires executive discretion.
The administration’s initiatives allow Homeland Security officials to forgo deportation, on a case-by-case basis, of undocumented residents who came here as children before June 15, 2007, and of certain undocumented parents of children who are American citizens or legal residents. Both are in keeping with similar programs put in place by both Republican and Democratic presidents dating from the Eisenhower administration.
In 1990, for example, under President George H.W. Bush, the immigration service, relying in part on authority dating from the Reagan administration, offered extended voluntary departure and work authorization to the spouses and children of aliens who had previously been granted legal status.
President Obama’s actions, therefore, are hardly unprecedented. There are two major differences. First, he gave speeches advocating for explicit programs with names, rather than relying on subtler agency direction.
Second, immigration policy has been caught up in today’s hyper-partisanship, where a strident anti-immigration tide within the Republican Party overwhelms all bipartisan compromise. All 26 state officials who have challenged the administration’s executive actions in the Supreme Court case are Republicans, and last month the G.O.P.-led House of Representatives voted to file an amicus brief on behalf of the entire House.
From these howls of outrage, you wouldn’t know that the Obama administration has vastly exceeded the deportations under President George W. Bush. And Mr. Bush vastly exceeded those of President Clinton. President Obama’s directives to focus enforcement efforts on those who have committed crimes in the United States and recent border crossers are a rational executive prioritization, given the resources and the realities.
These facts undercut Texas’s argument that it is unduly burdened by the president’s decisions. With deportations aimed at criminals and new border crossers, we would seem close to an optimal state-friendly federal immigration policy.
When the president took his executive action on immigration, he was not flouting the will of Congress; rather, he was using the discretion Congress gave him to fulfill his constitutional duty to “take Care that the Laws be faithfully executed.”

“Aiding The Rise Of Donald Trump”: Rubio Is Gone, But The Damage He Caused Remains
Tuesday night Donald Trump’s main ally in the Republican primary campaign, Sen. Marco Rubio, finally called it quits. He was praised by many Republican pundits, as he typically is, for some of the aspirational language he used in his non-victory speech, though most of those pundits shied away from a fair assessment of Rubio’s behavior during this presidential campaign season.
Here is such an assessment: Rubio ran on a promise of being the candidate of the future with a bold, optimistic platform, but he never delivered on that promise. In the process, he did perhaps irreparable harm to his party and to the country.
First, he ended the campaign season with a platform that can only be characterized as far-right. Sure, Rubio started his campaign with a number of extreme views – for example, he wanted the state to force rape victims to give birth to the child of their rapists and incest victims to give birth to the child of their fathers, while plotting to forcefully disband hundreds of thousands of same-sex marriages.
But it was only a year ago that the senator proposed a tax plan, with Sen. Mike Lee of Utah, that would raise taxes on millions of people in the middle class. By now, his proclaimed tax reform preference involves raising the debt-to-GDP ratio to 150 percent, while lowering Warren Buffett’s tax rate to zero. And that’s not all: He has also gone from supporting amnesty to wanting to deport children who have spent practically their entire life in the U.S., as well as supporting the deportation of the parents of U.S. citizens. In addition, he has proposed closing down not just mosques but also cafes and the like where Muslims may gather.
Now, some of Rubio’s supporters will claim that he does not actually believe in those things and he was just trying to out-Trump Trump, but by endorsing them he made them more respectable.
Second, he has done more than perhaps anyone but Trump to coarsen public debate. It was Rubio, after all, who introduced – and I can’t believe I’m writing this – discussions of penis size to the presidential race.
Third, he has done more than perhaps even Jeb Bush and his donors to help Trump win the Republican nomination in simple delegate terms.
Instead of dropping out after losing in Iowa, New Hampshire, South Carolina and Nevada (where he used to live!), Rubio set a target of losing the first 25 or so states. He roughly succeeded in losing those states, but in the process he helped Trump amass a significant delegate lead over his most serious opponent, Sen. Ted Cruz. He did this not only by winning delegates himself here and there, but perhaps most harmfully in states like Idaho and Texas by denying Cruz outright majorities that would have made those states winner-take-all. In those two states alone, Trump added 120 delegates to his lead. It is extremely likely that without Rubio, Cruz would have been the Republican front-runner going into this week, thereby fundamentally transforming the dynamics of the race.
Perhaps the senator will yet redeem himself. His almost-tearful press conference this weekend indicated that he might try – but for now, the damage he has done is tremendous.

“Poetic Justice, A Big Beautiful Wall”: Will Latinos Wall Off Trump From The White House?
How’s this for poetic justice? Donald Trump’s favorite scapegoats could end up having the satisfaction of blocking him from the White House.
Latino voters have the potential to form a “big, beautiful wall” between Trump and his goal. If Trump gets the Republican nomination and Hispanics are provoked into voting in numbers that more nearly approach their percentage of the population — and if, as polls suggest, they vote overwhelmingly against Trump — it is hard to see how the bombastic billionaire could win.
Such an outcome would serve Trump right. Unfortunately for the GOP, it would also threaten to make Latinos a reliable and perhaps monolithic voting bloc for the Democratic Party, just as African Americans have been since the 1960s. If this were to happen, simple arithmetic would make it increasingly difficult for Republicans to win the White House.
In 2012, Mitt Romney won just 27 percent of the Latino vote; his policy of “self-deportation” for undocumented immigrants is believed to have contributed to this poor showing. After Romney’s defeat, a GOP postmortem called on the party to regain its footing with the nation’s largest minority group. “We must embrace and champion comprehensive immigration reform,” the report said.
This never happened. A group of senators who became known as the Gang of Eight, including Marco Rubio, managed to win passage of a reform bill, but House Republicans refused even to consider the legislation. It seemed the immigration issue would once again be a liability for the GOP in the presidential contest.
Then along came Trump, who opened his campaign by charging that immigrants coming from Mexico were criminals and rapists — and promising to build a wall along the border to keep them out. As for the 11 million undocumented immigrants already here, Trump’s solution is not self-deportation but rather forced deportation: He pledges to round them all up and send them home.
Trump may be all over the map on a host of issues, but xenophobic opposition to Latino immigration has been his North Star. He invites supporters to see their nation under siege from Latinos who allegedly take away jobs, commit crimes and alter traditional American culture. Last year, he criticized campaign rival Jeb Bush — whose wife is from Mexico — for speaking Spanish at a rally. “He should really set the example by speaking English while in the United States,” Trump said.
Trump’s chauvinism has been winning approval among the mostly white, working-class voters who form the core of his support. But there are signs that he may also be animating Latinos — to come out and vote against him.
A poll last month by The Post and Univision showed that just 16 percent of Latino voters had a favorable view of Trump, as opposed to 80 percent who view him unfavorably. The remaining GOP candidates — Rubio, Ted Cruz and John Kasich — all do considerably better. But no Republican does nearly as well as Democrats Hillary Clinton and Bernie Sanders, both of whom are seen favorably by healthy majorities.
In a hypothetical matchup, according to the poll, Clinton would beat Trump among Latino voters by 73 percent to 16 percent. Assuming those who had no opinion went equally for the two candidates, Clinton’s share of the Latino vote would approach 80 percent. Swing states with large Hispanic populations such as Florida, Nevada, New Mexico and Colorado would effectively be off the table for the GOP.
Moreover, the sheer number of Latino voters will almost surely increase across the nation. According to the Pew Research Center, the 23.3 million Hispanics who were eligible to vote in 2012 will have grown to 27.3 million by Election Day, mostly from young citizens who turn 18. The specter of a Trump presidency is giving urgency to widespread voter-registration drives.
Trump’s claim that he “won” among Hispanic voters in Nevada is based on entrance polling at the party caucuses, but the sample was so small as to be virtually meaningless. More pertinent is that more than twice as many Hispanics participated in the Democratic caucuses as in the Republican ones.
Assuming Trump wins the nomination, where does this leave him? If Latinos come out to vote against him in greater-than-usual numbers, he would have to win what looks like an impossibly high percentage of the white vote to be competitive. Even if the Latino vote just grows proportionally with population, he would have a hard time winning states that GOP presidential candidates can’t afford to lose.
He may wish he could say “I’m sorry” in Spanish.

“Marco Rubio’s Mad Rush To The Right Continues”: On The First Day In Office, My True Love Gave To Me…
From the outset of the 2016 campaign, Marco Rubio has tried to adopt a clever straddle on immigration. He has edged towards the hard line stances of Donald Trump and Ted Cruz, while carefully keeping the door ajar to re-entering in the general election as the GOP’s Great Hispanic Hope, the candidate whose background and relative moderation on the issue would allow him to solve the GOP’s demographic woes.
Rubio may have just slammed that door shut — or, at least, made it a whole lot harder for himself to pull off this long planned reentry.
In an interview with CNN’s Jake Tapper, Rubio clarified that on Day One of his presidency, he will end President Obama’s executive action protecting the DREAMers — people brought here illegally as children — from deportation.
In the interview, Rubio was asked to respond to Ted Cruz’s ongoing insistence that Rubio has not said clearly that he would end Obama’s Deferred Action for Childhood Arrivals on Day One, something Cruz has repeatedly said he would do. To buttress his point, Cruz has cited an interview Rubio gave to Univision in which he said DACA would have to end at some point, while saying he “wouldn’t undo it immediately,” and keeping his timeline vague. Asked for comment, Rubio replied:
“Right after that interview, Univision reported that I said that DACA has to go away, and that it will. I will on my first day in office get rid of it because it’s unconstitutional. I was against it when the president did it. I remain against it now. It cannot be permanent policy. And I’ve said that repeatedly.”
So there you have it. Under President Rubio, hundreds of thousands of people would lose their temporary reprieve from deportation — and the other benefits of DACA, such as work permits — on the first day of his presidency.
It’s important to understand that this has serious substantive significance. It’s true that Rubio has repeatedly said, albeit vaguely, that under his presidency, DACA would end eventually. (See this Politifact article documenting his repeated statements to this effect.) But saying you’ll end DACA on Day One — as Rubio has now done — is very, very different from this. That’s because DACA is granted in stints of several years; it needs to be perpetually renewed over time by the president. The pledge to end it immediately is a flat out promise not to renew it, and to cancel it on a hard date. The president has the authority to do this, since the original grant was done by executive action. And it would mean instant disruption.
Indeed, Rubio himself believes this to be the case. Here’s what he said in February 2015, according to Politifact:
“What I’m not advocating is that we cancel it right now at this moment, because you already have people that have signed up for it. They’re working, they’re going to school. It would be deeply disruptive. But at some point, it has to come to an end.”
Rubio previously thought doing this would be “deeply disruptive,” but he is now advocating for “canceling it right now at this moment,” or at least, on his first day in office.
To be sure, Rubio can legitimately vow to end Obama’s executive deportation relief while simultaneously supporting the general goal of legislative legalization for undocumented immigrants later (which Rubio has hedged on, too, by saying he’ll only back legalization once some undefined state of border security is attained first). But Rubio himself has been reluctant to say he’d end DACA on Day One, very likely because he understands that this would complicate his hopes of moderating on the issue as the nominee. That’s now changed. And apparently, he shifted precisely because he’s been getting attacked hard from the right over it, and needed a way to defuse these attacks. That immediate set of political imperatives has apparently won out over his longer term ones. And Democrats will surely conclude that Rubio has now saddled himself with a major vulnerability in the coming general election battle for Latino voters.
