Voter Fraud: The GOP Search For A Non-existent Problem

Earlier today I dared the Internet to send me examples of voter fraud — particularly of a scale that would justify erecting barriers against whole groups of voters through photo ID requirements and other such pernicious nonsense.

The Internet obliged, weakly.

A few readers reminded me that the conservative columnist Ann Coulter was accused of voter fraud in 2009, for voting by absentee ballot in Connecticut in 2002 and 2004 despite the fact that she was living in New York. The Connecticut Election Commission investigated, but decided to take no further action since Ms. Coulter was a registered voter in the state and did not vote elsewhere. I never imagined defending Ms. Coulter, but this does not seem like a threat to our democratic way of life.

Lots of people on Twitter directed me to posts on the right wing blog Red State, which put together a handy compilation of examples (apparently just for me). First among them was the case of the 2003 Democratic mayoral primary in East Chicago, Indiana, in which campaign workers for the incumbent paid voters to cast absentee ballots. Red State also mentions the investigation of a Troy, NY, city council race, a series of ballot “manufacturing” cases in Alabama, and an alleged plot by three poll workers to throw a 2005 state senate election in Tennessee to the Democratic candidate, Ophelia Ford.

Suspend the elections! Demand genetic fingerprinting at the polls!

If that’s the worst that’s out there, I’m sorry, but I’m still not afraid of voter fraud. Counting all the Alabama incidents separately and throwing in Ann Coulter, that brings us to a grand total of eight cases. That is most certainly not a national crisis requiring action from the government. (It’s an odd reversal, come to think of it: Liberals insisting the government butt out, conservatives demanding it butt in.)

Besides, from what I can tell every one of the Red State incidents revolved around corrupt poll workers or local officials or some other functionary messing with absentee ballots. That’s an age old problem but one that voter ID laws will not fix.

I’m still not seeing evidence of large numbers of individuals impersonating someone else to cast a ballot or voting despite the fact that they don’t meet eligibility requirements. Surely they must be out there, or the anti-voter-fraud lot would not be so up in arms.

So, just for fun, let’s consider an example that my Twitter followers did not cite. As the Times editorial board noted in October, Kansas’ secretary of state, Kris Kobach, pushed for an ID law on the basis of a list of 221 reported instances of voter fraud in Kansas since 1997. But when The Wichita Eagle looked into the cases, it found that they were almost all honest mistakes: “a parent trying to vote for a student away at college, or signatures on mail-in ballots that didn’t precisely match those on file. In one case of supposed ‘fraud,’ a confused non-citizen was asked at the motor vehicles bureau whether she wanted to fill out a voter registration form, and did so not realizing she was ineligible to vote.”

Maybe I’m still missing something really big (and no, not the 1960 elections or whatever LBJ may or may not have got up to in Texas more than 50 years ago). Or maybe voter ID laws, as the saying goes, are a solution in search of a problem.

The Real Voter Fraud Scandal: Conservatives Are Trying To Restrict And Distort The Will Of The Voters

Well over a year before the 2012 presidential election, there’s a battle going on over next year’s ballots—how they’ll count and who will get to cast them. At stake is an attempt to distort the voters’ will by twisting the rule of law.

Most recently, Pennsylvania has been the focus of this battle. Dominic Pileggi, the state Senate majority leader, wants to change the way the Keystone State distributes its electoral votes, divvying them up according to how each presidential candidate performed in each congressional district, with the remaining two electoral votes going to the candidate who won the popular vote.

So while Barack Obama’s 55 percent of the vote in Pennsylvania in 2008 netted him all 21 of its electoral votes, the Pileggi plan would have shaved that figure to 11 electors. (Nationwide, Obama won 242 congressional districts while John McCain got 193.) The change would be even sharper as Pennsylvania’s new congressional map is expected to have 12 of the state’s 18 seats drawn to favor the GOP. Obama could win a majority of the Keystone vote again but only score eight of the state’s 20 electors. Do we really want to bring gerrymandering into presidential elections?

The politics here aren’t obscure: Every Democrat since Bill Clinton in 1992 has won Pennsylvania. This is a naked attempt to undercut Democratic nominees. (And while Pennsylvania would join Nebraska and Maine with such a law, Nebraska Republicans are trying to return to the unit rule after Obama won a single elector there in 2008.) But the Pennsylvania gerrymander gambit is only one aspect of a broader push to rig the game.

The 2010 elections marked a huge shift in control of state legislatures from Democrats to Republicans. The result, according to Tova Wang, a Senior Democracy Fellow at the progressive think tank Demos, has been “an attack on voting rights in this country like we haven’t seen in years and years.”

So far this year, bills have been introduced in at least 38 state legislatures designed to make it harder for Americans to exercise their right to vote. Fourteen have actually enacted such laws, according to a report released this week by the Brennan Center for Justice at New York University School of Law, which found that the new rules could make it “significantly harder for more than five million eligible voters to cast ballots in 2012.” As Rolling Stone reported recently, Kansas and Alabama, for example, now require proof of citizenship to register to vote; Florida and Texas have raised barriers to groups like the League of Women Voters conducting voter registration drives; Florida and Iowa barred ex-felons from voting, instantly removing nearly 200,000 voters from their states’ rolls; Florida, Georgia, Ohio, Tennessee, and West Virginia have cut back on early voting; and Maine repealed its law allowing citizens to register and vote on Election Day or on the two business days immediately preceding it (even though GOP Gov. Paul LePage had himself used that law to register the day before the 1982 election).

Perhaps the GOP’s most popular vote suppression tool is a set of new laws requiring voters to present photo identification before they cast ballots. Seven states—Alabama, Kansas, Rhode Island, South Carolina, Tennessee, Texas, and Wisconsin—have enacted such measures this year. At first glance this may seem reasonable. Who doesn’t have a valid photo ID? The answer may surprise you. A 2006 study by the Brennan Center found that 11 percent of U.S. citizens lack one, a figure in line with a 2005 report by an election reform federal commission which suggested 12 percent of U.S. citizens lack driver’s licenses. Drilling down, the Brennan Center found that the groups worst off in this regard tend to be core Democratic constituencies: 25 percent of voting age African-Americans and 15 percent of voting age citizens who make less than $35,000 annually lack valid photo IDs.

In Ohio, where such a law is pending, roughly 940,000 citizens lack valid IDs, according to a study by a nonpartisan voters group. Or take Wisconsin: Less than half of Milwaukee County African-Americans and Hispanics have driver’s licenses, according to a study from the University of Wisconsin-Milwaukee, and the figures are worse for younger voters. Indeed, the Wisconsin law is especially pernicious, specifically not accepting student IDs, even from state institutions. Texas’s voter ID law is even more blatant in who it’s aimed at. State gun permits are acceptable, but student IDs and government employment cards are not.

And these laws are a solution searching for a problem. Conservatives have long bemoaned the menace of voter impersonation, but the evidence for this threat is nonexistent. George W. Bush’s Justice Department spent years ferreting out voter fraud and managed to prosecute not one voter for impersonating another. “Out of the 300 million votes cast [between 2002 and 2007] federal prosecutors convicted only 86 people for voter fraud,” Rolling Stone reported. A 2007 study by the Brennan Center found the instances of voter fraud to be literally infinitesimal. “You’re more likely to get killed by lightning than commit in-person voter fraud,” says the Brennan Center’s Michael Waldman. Which only makes sense: That thousands of people are casting illegal votes in others’ names while evading determined detection (always managing to choose people who weren’t going to vote anyway) doesn’t pass the smell test.

Knock away the spurious reasons for the push to restrict voting and you’re left with bare-knuckled partisanship. “There has never been in my lifetime, since we got rid of the poll tax and all the Jim Crow burdens on voting, the determined effort to limit the franchise that we see today,” former President Bill Clinton told a group of young political activists over the summer. He’s right, and it must be fought at every level.

GOP Escalates Voter Suppression In Ohio

If any Democrats you know need a reason to raise hell about the GOP-led effort to restrict early voting, please direct them to Ken McCall’s Dayton Daily News article, “Changes to early voting rules could hurt Dems.” The headline is actually an understatement, as McCall’s article makes clear:

A Republican-sponsored state law designed to curb voter fraud by significantly limiting the number of days to vote early has a greater potential to hurt Democrats than Republicans, according to a Dayton Daily News analysis of voter patterns from the 2008 presidential election.The Daily News examined precinct-level voting results in five counties and found that Democratic voters were much more likely than Republicans to come to boards of elections offices and vote early in the 2008 presidential election, especially in urban counties.

The analysis of voting in the 2,830 precincts in Montgomery, Franklin and Hamilton counties found that precincts won by Democrat Barack Obama had significantly more early votes than those that went for his Republican challenger, John McCain.

And the more a precinct went for Obama, the more early, in-office votes were cast….In the top 10 Obama precincts — all from Dayton and all voting 98 percent for the Democrat — early, in-office votes made up almost 29 percent of all votes cast. In the top 10 precincts for McCain — all in rural or suburban areas of the county — only 2.4 percent of the ballots were cast at the board of elections before Election Day….

House Bill 194, now known as the Elections Reform Bill, contains more than 180 changes to election law, including provisions cutting early, in-office voting by about two-thirds — from 35 days to the equivalent of 11.

Even the nonpartisan League of Women Voters has expressed concern about the bill as an instrument of voter suppression. “The League never talks about people’s motivations, but the effect of it will be to depress the vote,” according to the League’s Peg Rosenfeld, quoted in McCall’s article.

Former Ohio Secretary of State Jennifer Brunner has filed petitions to overturn the law. Hopefully there will be mounting protests against the legislation, which targets African American voters as well as Democrats. In any event, the Republican-lead campaign against early voting should underscore the urgency of Dems having stronger GOTV programs in every state where early voting is under assault.

It’s about as naked an attempt to suppress pro-Democratic voters as we are likely to see in the months ahead. For all of the GOP’s flag-waving and blustering about freedom, when you get right down to it, they want to make it harder for people to vote.

Maine GOP Chair: We Must Make It Harder To Vote Because ‘Democrats Intentionally Steal Elections’

For nearly four decades, Maine has been one of eight states which provides same-day voter registration to voters at the polls. This policy of enfranchising the greatest number of Maine voters is likely to end, however, now that the GOP-controlled state legislature has passed a bill ending same-day registration and Tea Party Gov. Paul LePage is expected to sign it. Worse, state GOP Chairman Charlie Webster explained it was necessary to disenfranchise the thousands of Maine voters who take advantage of same-day registration every election year in order to save Maine from one of his paranoid fantasies:

“If you want to get really honest, this is about how the Democrats have managed to steal elections from Maine people,Webster told a columnist for the Portland Press Herald in a piece published Friday. “Many of us believe that the Democrats intentionally steal elections.”

Sadly, Maine’s voter disenfranchisement bill is only the latest example of the Republican war on voting that began almost immediately after the GOP took over several statehouses this year. Numerous GOP state legislatures have rammed through “voter ID” laws which disenfranchise thousands of elderly, disabled, and low-income voters. Republicans typically justify these voter disenfranchisement laws by claiming that they are necessary to combat voter fraud at the polls, but in-person voter fraud is only slightly more common than unicorns. A recent Supreme Court decision upholding a voter ID law was only able to cite one example of in-person voter fraud in the last 143 years.

Nor are voter ID laws the only front in the GOP’s war on voting. As Jonathan Chait explains, their efforts also include measures “restricting early voting, shortening poll hours, [and] clamping down on students voting at their campus.” And in Wisconsin, Gov. Scott Walker (R) even plans to  gut his state’s public financing program — a program designed to make candidates less dependent on wealth donors — in order to pay for a voter disenfranchisement law.

Yet, while the Maine GOP may have won a skirmish in the war on voting with their repeal of same day registration, it is anything but certain that they will win this war. The state’s Democrats hope to invoke Maine’s “people’s veto” process, which allows the voters to repeal a newly enacted state law by referendum. To invoke this procedure, they must collect just over 57,000 signatures before a 90-day window closes.

Rigging The Game Is Easier Than Earning Votes

It’s not unusual to find a fair amount of 2012 optimism in Democratic circles. The economy is improving; Republican overreach is causing voters to recoil; and President Obama will be on the top of the ballot again, giving Dems a boost they lacked in 2010.

But for all that cautious confidence, it’s worth noting that Dems can’t win if their supporters can’t vote. And with that in mind, the Democratic Legislative Campaign Committee reported this week on Republican efforts in state legislatures to rewrite voting laws “to make exercising one’s right to cast a ballot more difficult.”

After examining the plethora of bills introduced in statehouses this year that, among other things, would reduce poll hours and require voters to show photo ID, it seems clear that Republicans are trying to make it harder for certain groups to vote. The Advancement Project, an advocacy group of civil rights attorneys, called the push “the largest legislative effort to scale back voting rights in a century.”

According to the National Conference of State Legislatures (NCSL), Republican legislators have introduced bills that would diminish access to the voting booth in over 40 states. All of these Republican proposals focus on one apparent goal: restrict ballot access and shrink the electorate — often in ways that would decrease Democratic votes.

Many of the proposals are in the form of voter ID legislation, which would require potential voters to present specified forms of identification in order to cast a ballot. Republicans supporting these measures claim they’re necessary to prevent “voter fraud.”

Too bad that “voter fraud” isn’t a problem that actually exists.

By all appearances, GOP efforts fall under the “When in doubt, disenfranchise” category. The Republican-led efforts aren’t addressing actual problems with the integrity of the voting process, unless you consider likely Democrats participating in elections to be a “problem.”

Of particular interest are voter-ID efforts, which are likely to disproportionately affect African Americans, the poor, and voters under the age of 30.

In other words, state Republican officials are targeting — without cause — the constituencies least likely to vote Republican. What a coincidence.

But there are related GOP efforts to stand in the precinct door. Patrick Caldwell has reported on Texas Republicans’ proposals designed to limit access to the polls, including absurd new restrictions on registering new voters. There are also measures in states like New Hampshire to block college students from registering in their adopted home states because, as one prominent GOP leader put it, “Voting as a liberal. That’s what kids do.”

We’re talking about a systematic effort, which is unfolding nationwide for a reason. The easiest way to win an election has nothing to do with candidates, fundraising, or grassroots operations. It’s to stack the deck long before the election — rigging the system so that those most likely to vote the “wrong” way simply don’t get to participate. We saw some of this during the Bush era, relying on odious tactics like “voter caging,” but the strategy is clearly expanding and intensifying.

Ideally, if Republicans are so panicky about losing elections, they should field better candidates and adopt a more sensible policy agenda, not push schemes to block Americans from voting. Indeed, Republicans routinely pull a lot of stunts, but few are as offensive as these anti-voting tactics. It’s one thing to lie one’s way through a campaign; it’s more damaging to the integrity of the country to stop people who disagree with you from even having a say in the process.

In a close election, where a percentage point or two can help dictate the future of the country, just how damaging can these tactics be? I guess we’ll find out soon enough.
