Is Utah About To Elect Another Senator Who Thinks Medicare Is Unconstitutional?

Last year, Sen. Mike “A Noun, A Verb, and Unconstitutional” Lee (R-UT) upset longtime Sen. Bob Bennett (R-UT) in the Utah GOP’s arcane candidate selection process — allowing the Tea Party to elevate someone to the Senate who believes that everything from Medicare to Social Security to child labor laws somehow violate the Constitution. Since then, Utah’s senior Sen. Orrin Hatch (R) has tripped over himselfto pretend that he is just as radical as young Sen. Lee.

Alas, all of Hatch’s extremist posturing may be for naught, as the Tea Party has found someone who shares their apparent policy goal of ensuring that people who can’t afford health care are left to fend for themselves:

During a recent media blitz in Washington, D.C., Dan Liljenquist, a state senator from Utah, went after Sen. Orrin Hatch, arguing he has done more than any other Republican to promote nationalized health care. […] The skirmish is the first between these potential 2012 opponents. Liljenquist, a Republican, says he won’t make an official decision until early next year, but he has prepared for a possible run for Hatch’s seat. […]

[Liljenquist] argued that Hatch is not committed to returning power to the states, focusing on the State Children’s Health Insurance Program that Hatch spearheaded in 1997. That program, which pays for health coverage for poor children, has come under fire from tea party Republicans who see it as a step toward a national takeover of health insurance. Liljenquist went as far as to call it “unconstitutional.”

Liljenquist’s suggestion that the State Children’s Health Insurance Program (SCHIP) is unconstitutional is absurd. SCHIP works by providing funds to states to help them pay for health insurance for children. Because the Constitution allows the federal government “to lay and collect taxes” and to use those revenues to “provide for the…general welfare of the United States,” there is simply no doubt that it can spend money on providing health care to vulnerable young people.

Moreover, other essential health care programs — such as Medicare and Medicaid — stand on similar constitutional footing as SCHIP. So if Liljenquist thinks one of these programs is unconstitutional, it is likely that he believes that we must eliminate all three.

In other words, if Liljenquist succeeds in taking Hatch’s Senate seat, Utah could become the only state in the union to have its entire Senate delegation believe that the Constitution requires millions of children, low-income Americans and seniors to be cast out into the cold with no meaningful access to health care.

Wall Street’s Worst Nightmare: Elizabeth Warren To Run For Senate

Elizabeth Warren, consumer advocate and chief architect of the Consumer Financial Protection Bureau, will announce on Wednesday that she will run for the U.S. Senate seat in Massachusetts currently held by Republican Scott Brown.

Should Warren prevail in defeating the six candidates who have already announced their intention to compete in the Democratic primary, the result may be the greatest economic boon to Massachusetts media outlets since the days of Kennedy money as Wall Street ponies up serious bucks in an effort to defeat their arch-nemeses. Democratic contributors can be expected to respond in kind as bringing the Massachusetts senate seat back into the Democratic column is considered an important key to retaining the Democratic majority in the Senate.

While Warren is not expected to make a formal, public announcement, the Boston Globe reports that a video will go up on Warren’s website tomorrow announcing her intentions and saying, in part—
The pressure on middle class families are worse than ever, but it is the big corporations that get their way in Washington. I want to change that. I will work my heart out to earn the trust of the people of Massachusetts.

If track record counts for anything, you can believe that Elizabeth Warren will do precisely as she says. Because of that track record, the Harvard Law professor, who went to Washington and built a major following by relentlessly attacking the financial institutions for their anti-consumer agenda, will surely have the support of national progressives and Democrats, support she has unquestionably earned.

The possibility of Warren’s election presents GOP senators with a rich dose of irony. Warren was the obvious and most deserving person to serve as the first leader of the CFPB, the consumer protection agency she almost single-handedly created. However, in an effort to protect their Wall Street cronies and financial backers, the Republicans in the Senate made it very clear that her nomination would never be approved.

As the administrator of the CFPB, Warren would have been under the thumb of Congress. As a member of the Senate, it will be a very different story.
Payback can be rough.

Republican House Bills: A Glimpse Into The Tea Party’s Vision For America

If the House ran America, what would America look like?

It would no longer have a far-reaching health-care law. The House voted to repeal that legislation in January.

It would no longer have federal limits on greenhouse gases. The House voted to ax them in April.

And it would not have three government programs for homeowners who are in trouble on their mortgages. The House voted to end them all.

These and many other changes are included in an ambitious slate of more than 80 bills that have passed since Republicans took control of the chamber this year.

Most of these measures will die in the Democrat-controlled Senate. Still, they are a revealing kind of vision statement — the first evidence of how a tea-party-influenced GOP would like to reshape the country.

That vision is aimed at dismantling some Democratic priorities. The GOP’s philosophy holds that paring back an expensive and heavy-handed government bureaucracy would help restore the country’s financial footing and give private businesses the freedom to grow and create jobs.

After seven months, it is still only half a vision.

On major issues such as health care, climate change and bad mortgages, the House has affirmed that fixes are needed — if it can ever manage to repeal the old ones.

It hasn’t said exactly what those changes should be.

“The Republican Party is sort of united in terms of what they’re against. But there’s not a great deal of consensus right now in terms of what they’re for,” said Michael D. Tanner, a senior fellow at the libertarian Cato Institute and an expert on health-care reform and recent GOP history.

This month, a divided Congress finally staggered into its summer recess. Its business has been split between the terrifyingly urgent — including standoffs that threatened a government shutdown and a national debt default — and the purely theoretical.

The theoretical part has come because neither the House nor the Senate is likely to approve big ideas dreamed up by the other. The Democrat-held Senate has reacted to this by withdrawing into legislative hibernation.

House Republicans have instead been passing bills that tell a story — about the country they want but can’t quite get.

“The new House Republican majority was voted into office to change the way Washington does business and make the government accountable to the American people once again. Our agenda has reflected these goals,” said Laena Fallon, a spokeswoman for House Majority Leader Eric Cantor (Va.).

But even within the Republican ranks, there is a desire for more details about the party’s vision for replacing Democratic policies.

Rep. Trey Gowdy (S.C.) said the GOP must put forward its own solutions on issues such as health care, job creation and mortgage assistance. He said he is not convinced that there is a need to take on climate change in the same way.

“Being the party of ‘no’ . . . is an appropriate response” in some cases, Gowdy said. “It’s not appropriate when you’ve been extensively critical of someone else’s ideas” and have none to replace them, he said.

“For substance reasons, and for credibility reasons, we also need to have a comprehensive . . . alternative that goes beyond saying, ‘Your plan is bad,’ ” Gowdy said.

The best-known part of the House’s vision has to do with spending. The chamber passed a budget that calls for a Medicare overhaul that would force new recipients to buy private insurance after 2022. It also passed, with five Democratic backers, a bill that demanded a balanced budget amendment: essentially, a spending limit written into the Constitution.

But the House’s measures have gone far beyond the budget.

It has passed legislation to forbid new energy-efficiency standards for light bulbs and to punish shining a laser pointer at an airplane in flight. It voted to take away federal funding for National Public Radio and for public financing of presidential campaigns.

The House also took a stand against President Obama on the military campaign in Libya, rejecting a motion to approve U.S. involvement. And it voted to rein in Environmental Protection Agency efforts against “mountaintop-removal coal mines” by requiring the EPA to defer to decisions by state regulators.

On three major issues, the House seemed to acknowledge that simply repealing a Democratic idea might not be enough — and that it did not have its own solutions.

On Jan. 19, for instance, 242 Republicans and three Democrats voted to repeal the landmark health-care law.

In place of the legislation, Republicans had said they would craft their own solutions for problems involving high costs and the denial of coverage for preexisting conditions. Their slogan, outlined in last fall’s Pledge to America, was “Repeal and Replace.”

No replacement has occurred.

A bill that would limit liability in malpractice lawsuits has passed in committee. Other ideas are being developed, aides said.

On climate change, the EPA is requiring larger power plants and industrial facilities to reduce greenhouse gas emissions to obtain new permits.

But many in Congress worried that the effort would drive up energy prices and kill jobs. So in April, 236 House Republicans and 19 Democrats voted to make the EPA stop in its tracks.

In place of regulations, they approved only a vaguely worded “sense of the Congress” about climate change.

“There is established scientific concern over warming of the climate system,” the bill says. It adds that Congress should attack the problem “by developing policies that do not adversely affect the American economy, energy supplies, and employment.”

But how? When? The measure doesn’t say.

And it doesn’t need to, said Tim Phillips, president of the conservative group Americans for Prosperity. He said his group thinks that simply repealing this legislation — and the health-care law — is enough for now.

“The big-government assault [has been] so damaging to the economy and the government. They’re doing the right thing by just trying to stop and reverse,” Phillips said.

Environmental groups have said that the House’s bill would leave the nation powerless to fight an escalating global problem.

“They clearly aren’t going to pass any legislation themselves that would address that pollution,” said Dan Lashof of the Natural Resources Defense Council.

The House also has voted to eliminate three federal programs meant to aid homeowners in danger of foreclosure. Two help modify loans to create lower payments. The third gives no-interest loans to borrowers who are in trouble. All have been criticized for moving too slowly and helping too few.

In March, the House decided to do away with them. The Congressional Budget Office said that doing so could save taxpayers $2.4 billion.

“None of the programs . . . have been successful,” Michael Steel, a spokesman for House Speaker John A. Boehner (R-Ohio), wrote in a statement.

GOP’s Debt Ceiling Fight Is About Bringing Down Obama

Impeach  him.

Not the president. Barack Obama is holding a huge  global and domestic crisis in his hand. To use a Washington metaphor,  he’s dangerously close to being left “holding the bag” on the  Treasury debt ceiling limit. He keeps talking sweet reason about  the art of compromise to Republicans in Congress—not a language they speak.   Obama played golf with the House Speaker John Boehner, a Republican who  drones on about “small business” every chance he gets. Obama is  not getting traction or making friends with Boehner because he does  not grasp the conversation about the debt limit is not about the debt limit. It’s about taking his presidency down—this week—even if it hurts the  United States of America, which it will. A small price to pay for this  tea-drinking crowd of 87 GOP House freshmen which turned the chamber upside  down six months ago.

“This is no way to run the greatest country on  earth,” Obama  declared in a belated speech, sounding a call to arms around  the  country, last night. That in itself says so much—he’s right, but  he’s  the man who’s elected by the people—not John Boehner who was elected by a  small-town  slice of Ohio—to run the country! Everything was  calculated to leave  Obama in the lurch—by Boehner, House Majority  Leader Eric Cantor of the old  Confederate capital, Richmond, Va. and at  least one other mastermind. The  conspiracy has succeeded flawlessly so  far. They separated Obama from his  own party in Congress; in his  dealings with only Republicans he went way  beyond Bill Clinton’s  “triangulation” strategy. Obama made  allies feel like they were shut  out of the deal-making room when he  offered concessions that cut at the  heart of the Democratic Party‘s proud  history on social programs dating  to the New Deal.

The GOP—and I mean the George W. Bush years and the  current crop  of Senate Republicans, too—has a new deal for you, too. It’s  called  the New Steal. It goes like this: we’ll take all the peace and   prosperity of the Clinton tax code years up until 2000 and then squander  it on  a couple unwinnable wars of choice—and by the way, make rich  people pay less  into the Treasury than they did during those golden  years. They might start one  of those illusory “small businesses.”

The reason President Clinton was acquitted at his  impeachment trial  in the Senate for a fling with Monica Lewinsky was because he  built  bonds of loyalty, teamwork and camaraderie with Democrats in both houses   of Congress. Not one of them came forward on the floor to speak  against him,  except pious Sen. Joe Lieberman, who suggested a censure. He  was utterly alone in  his opportunistic little ploy. Clinton’s true  friends all stood by him in the  Senate—because he was their  president.

Obama, a bit of a loner, needs more bosom buddies  among lawmakers.  In a crisis, you find out who your friends are. The one  who could have  steered him straight, sailing into the wind, was the late great   senator, Edward M. Kennedy. When Kennedy got his Irish up and roared on   the floor, he scared the forest. Obama does not scare the Republican  jungle.

Let’s impeach Rush Limbaugh as the master of public  dis-coarse. He’s  the real reason we have so many angry white men in office who  are  plotting against the president. He’s writing the back-story of this   debt drama, consulting closely with House Republican leaders step by  step.  I believe it even if I can’t see it because he did the same thing  in  1994, in cahoots with Newt Gingrich, who recruited a new House  Republican  freshman class to take over the House. Yes, I saw Rush with  my own eyes  getting all the glory as class mascot at a fancy dinner at  Camden Yards in  Baltimore for the new Republican victors that enabled  Gingrich to become speaker. The government shutdowns and showdowns  against President Clinton  resulted—remember?

Are Members Of Congress Engaged In Insider Trading?

When Congress isn’t sending billions in taxpayer money to bail out Wall Street firms, some of its legislators appear to be using information unavailable to the general public to personally profit on stock trades.

So says a study just published in Business and Politics. A portfolio that imitates the stock purchases of House members outperforms the market by more than 6 percent in the course of a year, its authors found. “A previous study of the stock returns of U.S. Senators in a leading finance journal indicates that their portfolios show some of the highest excess returns ever recorded over a long period of time, significantly outperforming even hedge fund managers,” they wrote. “Until now, there has been no similar study of Members of the U.S. House of Representatives.”

Now we know that from 1985 to 2001, the specific interval used to generate the data, senators do the best, House members follow, and the average American investor brings up the rear. In defense of Congress, however, most legislators weren’t exploiting their advantage: on average only 27 percent of senators and 16 percent of House members bought and sold common stock. Interestingly, in the House “by far the most successful traders were those Representatives with the least seniority.” The authors acknowledge that result is counterintuitive, and posit this explanation:

Whereas Representatives with the longest seniority (in this case more than 16 years), have no trouble raising funds for campaigns, junkets and whatever other causes they may deem desirable owed to the power they wield, the financial condition of a freshman Congressman is far more precarious. His or her position is by no means secure, financially or otherwise. House Members with the least seniority may have fewer opportunities to trade on privileged information, but they may be the most highly motivated to do so when the opportunities arise.

So what should be done?

It’s presented as a thorny problem. “To restrain Members from taking personal advantage of non-public information and using their positions for personal gain, Congress has decided that such unethical behavior is best discouraged by the public disclosure of financial investments by Representatives and the discipline of the electoral process,” the authors point out, but “to form a reasonable opinion of a Representative’s conflicts of interest, voters must familiarize themselves with their Representative’s personal asset holdings, the details of each law under consideration in the House and the voting record of the Representative. This could be difficult for any voter.”

That’s why faster disclosure would work best here. Forget filing periodic reports. Just force Members of Congress to be transparent about their stock trades in real time. Voter oversight wouldn’t even be needed — the idea is that self-interested traders would closely monitor the buying and selling of stock by legislators, who’d thereby lose a lot of their ability to get a jump on other investors.

Right?
