“Reproductive Rights Are Political”: Yes, Planned Parenthood Has To Be In The Politics Business
On Sunday’s “Meet the Press” Chuck Todd, a journalist I respect, asked an interesting, but odd, question of Cecile Richards, the president of Planned Parenthood: “Should you be in the politics business?”
This is a circular argument: Planned Parenthood has been in the politics business since it opened its doors. Female sexuality, and the control thereof, has always been inherently political. The term “sexual revolution” is not an abstract concept – the introduction of the pill 50 years ago was what marked the full entry of American women into the workforce. The pill is credited with a third of the increase in wages for American women.
There is nothing more physically and economically determinative to a woman than deciding if or when to have children, a decision to which Planned Parenthood has made an enormous contribution for millions of us.
This is why social conservatives continue to attack not just abortion, but contraception – if you’re against abortion and contraception, it’s not just about abortion. And it’s why Planned Parenthood has become a talisman to the right, a symbol of what they fear most – women controlling their own reproductive destiny. Two-thirds of the 1 million abortions in this country are done by private practitioners other than Planned Parenthood, but there are no mass protests and bloody fetus pictures outside their offices.
Why? Because Ruth Bader Ginsburg is right – the right’s War on Women is fundamentally a war on poor women. Two-thirds of women who have an abortion already have a child, and the overwhelming reason cited for the procedure is that they can’t afford another one. There’s a reason the original Roe plaintiff, Norma McCorvey, was working class. Rich women could get abortions before Roe, and they will if the Supreme Court overturns it next spring – which is possible, since the court has taken up the Texas abortion restrictions.
Historically, fights over female autonomy are hardly unique to either our country or even our millennia. Sex and power for women have always been intertwined and an object of fascination, fear and political manipulation for men.
Anne Boleyn was executed by Henry VIII for accusations of infidelity – and not producing a son, as were many royal wives, never mind that the man determines the sex of the child. Her daughter Elizabeth I, arguably Britain’s greatest monarch, was the Virgin Queen, precisely because once she married and surrendered her sexuality to a man it diminished her imperium.
So what it comes down to, again, is that this is about power. House Republicans are creating a Planned Parenthood investigative “committee” to weaken political opponents and catalyze their base, the same way they set up the Benghazi “committee” to weaken Hillary Clinton and fire up conservatives.
And in the states, right-wing Republicans are attacking Planned Parenthood with every political means at their disposal, including electing retrograde state legislatures that in turn enact horrific, humiliating laws designed to slut-shame women out of having abortions and restrict access to contraception.
What angers conservatives about Planned Parenthood isn’t just what they do – contraception, reproductive health care and, yes, abortions. It’s how the organization does it – without judgment or shame – and the result it produces: women in control of their own bodies, both physically and politically.

“Teamwork On The Supreme Court”: Discipline On The Left Side, Disarray On The Right
Now that the current term is over for the Supreme Court, analysts are digging into the record to draw conclusions about what happened. In a fascinating analysis, Adam Liptak writes: Right Divided, a Disciplined Left Steered the Supreme Court.
The stunning series of liberal decisions delivered by the Supreme Court this term was the product of discipline on the left side of the court and disarray on the right.
In case after case, including blockbusters on same-sex marriage and President Obama’s health care law, the court’s four-member liberal wing, all appointed by Democratic presidents, managed to pick off one or more votes from the court’s five conservative justices, all appointed by Republicans.
They did this in large part through rigorous bloc voting, making the term that concluded Monday the most liberal one since the Warren court in the late 1960s, according to two political-science measurements of court voting data.
“The most interesting thing about this term is the acceleration of a long-term trend of disagreement among the Republican-appointed judges, while the Democratic-appointed judges continue to march in lock step,” said Eric Posner, a law professor at the University of Chicago.
For example, this session there were 19 SCOTUS decisions that were decided 5/4. In 10 of those, the four liberals voted together and were joined by one conservative. In contrast, the conservatives only voted together 5 times.
Ian Millhiser suggests that the problem for the conservative justices is that they “represent three – and possibly as many as five – distinct versions of judicial conservatism.”

He points out that Scalia purports to be an “originalist” (like Thomas), but mostly votes as a partisan. And he can’t seem to find a way to characterize Kennedy.
Liptak credits the cohesion among the liberal justices to the leadership of Justice Ginsberg. But I’m also interested in how they managed to pretty consistently pick off one of the conservative justices to vote with them. I was reminded of something Adam Winkler wrote about Elena Kagan almost 2 years ago. He described her as a justice in the mold of Earl Warren.
Warren didn’t accomplish these by embarrassing his colleagues or by making sharper arguments on the merits. Warren was a master politician, one who’d sit with the other justices and bring them along slowly and steadily to his side. He sought to understand other justices’ concerns and address them. Unlike most of today’s justices, Warren was willing to work the halls to gain five votes.
He says this about why Kagan was chosen to be the dean of Harvard’s Law School:
She was seen as someone who could bring together a faculty known for ideological and personal divisions that institutionally hobbled the law school, especially when it came to hiring. As dean from 2003 to 2009, she calmed faculty tensions, launched an aggressive hiring spree that netted 32 new professors, and earned praise from both left and right.
I remember that some liberals opposed Elena Kagan’s nomination. But it strikes me that President Obama would see “bridge-builder” as a necessary role for someone to play on the Supreme Court. It’s exactly how people describe his tenure as President of the Harvard Law Review.
If that’s the case, here’s what we know about the 3 women on the Supreme Court: the senior member is Ruth Bader Ginsberg – the Notorious RBG – tiny woman who throws quite a punch. Then there’s my hero, Sonia Sotomayor, the wise Latina with a heart as big as they come. And finally, there’s Elena Kagan, the bridge-builder. What a team!

“The Voters Should Choose Their Representatives”: The Supreme Court’s Election Reform Ruling Is A ‘Big F-ing Deal’
This, in the words of Joe Biden, is a big fucking deal.
The Supreme Court’s vote on marriage equality and its refusal to gut health-care reform justly got the banner headlines over the last few days. But a less-publicized case on Arizona’s independent redistricting commission had those of us fighting for election reform holding our breath in the march toward the last day of decisions.
At stake was nothing less than the ability to fight back against the forces of polarization, paralysis, and hyper-partisanship in our politics. Out of 435 House seats, only 35 are considered competitive, and the rigged system of redistricting is to blame. It’s a process of collusion between the two parties that takes place every 10 years in state legislatures and draws the congressional district lines—a subversion of democracy where politicians pick their people rather than people picking their politicians.
The result is a screwed up incentive system where members of Congress are virtually guaranteed re-election as long as they don’t lose a low turnout partisan primary, which means they live in fear of offending the base rather than reaching across the aisle to solve problems.
Increasingly, the remedy for this corrupt status quo has been voters bypassing the state legislators with ballot referendums that create independent redistricting commissions. California has done it to great effect, dislodging 14 incumbents who decided to retire after the independent commission promised to make their re-elections less than rubber-stamped.
And that’s what Arizonans did in advance of the 2010 districting, which upset then-Governor Jan Brewer. First she tried to remove the independent commission’s chairwoman, Colleen Mathis, in a power grab that was overruled. Then Brewer decided to take the commission to court, arguing that the panel—composed of two Republicans, two Democrats, and one independent—tried to “elevate ‘competitiveness’ over other goals.” Seriously.
“This isn’t anything more than Republicans trying to hold on to a majority in a state where they constitute less than a third of the voters,” explained former Phoenix mayor Paul Johnson at the time. But still the baseless, desperate, cynical case wound its way to the Supreme Court.
If the court decided that the voters’ attempt to impose a nonpartisan redistricting commission over the self-dealing of the Arizona state legislators was unconstitutional, the best mechanism citizens have to restore fairness to congressional mechanisms would have been removed.
As Stanford law professor Nate Persily, the author of the new book Solutions to Political Polarization in America, explained: “Not only would many redistricting commissions, such as Arizona and California’s, have been thrown out, but any state regulation of congressional elections that was passed by initiative would have been legally vulnerable. This would have cast doubt, for instance, on California’s nonpartisan primary, Arizona’s voter ID law, and any number of other laws regulating voter registration, campaign financing, and ballot technology.”
It could have meant open season on election reforms of all kinds. But happily, by a narrow 5-4 vote, with Justice Anthony Kennedy serving in his role as the swing vote—possibly aided here by his roots in California, which has seen evidence of success in election reform—the Supreme Court decided to back the integrity of Arizona’s independent redistricting commission.
As Justice Ruth Bader Ginsburg wrote in her majority decision (PDF): “We see no constitutional barrier to a State’s empowerment of its people.” She continued by pointing out that “‘[P]artisan gerrymanders,’ this Court has recognized, ‘[are incompatible] with democratic principles’” and attested to the fact that reforms like independent redistricting commissions have resulted in “districts both more competitive and more likely to survive legal challenge.” Quoting founding fathers from Madison to Hamilton, the decision concluded that Arizona voters sought to restore “the core principle of republican government,” namely, “that the voters should choose their representatives, not the other way around.”
The decision is a big win for election reform and a defeat for those professional partisan forces that want to keep the rigged system of redistricting in place. Now the prospect for future nonpartisan election reforms remains open and inviting to more citizens who understand that when you change the rules, you change the game.

“A Cop’s ‘Large Hunch’ About Criminal Wrongdoing Won’t Do”: The Supreme Court Just Checked Cops’ Power To Extend Traffic Stops
Cases involving the Fourth Amendment’s proscription on unreasonable searches and seizures are the sleepers of every Supreme Court term. Unless the justices are confronted with new technologies or particularly invasive government practices—like body-cavity or thermal-imaging searches—these decisions rarely grab headlines, leaving only prosecutors, defense attorneys, and law professors to ponder their significance.
But this can’t be the norm—not in the wake of Ferguson, with heightened awareness of abusive policing. Today more than ever, an understanding of what limits the Constitution places on police and the Supreme Court’s interpretation of those limits should be essential knowledge. Anything less, to borrow the words of Justice Sonia Sotomayor, would simply reduce the Fourth Amendment “to a useless piece of paper.”
Because at the root of Rodriguez v. United States, decided Tuesday by the Supreme Court, lies one of the most common, and perhaps the only, interaction law-abiding citizens will ever have with law enforcement: traffic stops. Being pulled over is so mundane, I wondered in February whether Chief Justice John Roberts had ever been inconvenienced by the practice, perhaps as a result of driving with a broken taillight—the kind of infraction that triggered the killing of Walter Scott in South Carolina earlier this month.
When Rodriguez was argued in January, Roberts asked how exactly traffic stops go down in real life, saying lightheartedly, “Usually, people have told me, when you’re stopped, the officer says, ‘License and registration.’” That drew laughs from the courtroom—the implication being that Roberts wouldn’t admit to ever having broken the law—but it also suggested that perhaps he doesn’t quite grasp how humiliating these encounters can be. This prompted a rebuttal in open court from Sotomayor, who told the chief that she’d been stopped and that the experience of being kept longer than the time required to give her a ticket was “annoying as heck.”
Whether Roberts eventually grasped as much is unclear, but he did join the six-justice majority that agreed that police can’t extend the length of a traffic stop beyond the time necessary to inquire into the alleged traffic violation. In a triumph for citizens’ rights, the Supreme Court ruled that “a police stop exceeding the time needed to handle the matter for which the stop was made violates the Constitution’s shield against unreasonable seizures.”
That’s a big deal, if only because a lot can happen whenever police extend a traffic stop, even for a few minutes longer than necessary. To be sure, police already have wide latitude to stop anyone who is observed violating traffic laws; if probable cause exists that you’re not obeying the rules of the road, police are justified in stopping you. But what if, during the course of the stop, police also suspect you’re up to no good? Can they just hold you while they call in the dogs, as happened in Rodriguez, or for backup to conduct a wider criminal investigation? The lower courts that originally considered Rodriguez thought so, reasoning that a stop lasting, say, seven to ten minutes longer than necessary “was not of constitutional significance”—that the annoyance merely amounted to a “de minimis intrusion” on a motorist’s freedom of movement.
The Supreme Court didn’t buy that argument. “Authority for the seizure… ends when tasks tied to the traffic infraction are—or reasonably should have been—completed,” wrote Justice Ruth Bader Ginsburg for the majority. The court focused exclusively on the true “mission” of traffic stops—incidentals such as “checking the driver’s license, determining whether there are outstanding warrants against the driver, and inspecting the automobile’s registration and proof of insurance.” All of these things are well and good when the initial stop is valid.
The problem arises when a well-meaning officer turns the traffic inquiry into a prolonged, crime-fighting one. Such unrelated “detours” away from the original traffic mission, the court observed, are unconstitutional without independent, reasonable suspicion that an actual crime has taken place. A cop’s “large hunch” about criminal wrongdoing won’t do.
That’s a commonsense approach—no one should be stopped for even a moment longer than absolutely necessary. But will the ruling deter police from trying other dilatory tactics? Rodriguez, for one, doesn’t explicitly forbid officers from, say, taking their sweet time while running your license plate or from engaging in “friendly” small talk aimed at eliciting consent. These end-runs are still largely acceptable, and only time will tell what other methods cops will employ to bide their time and divine suspicion where initially there was none.
Until then, the Supreme Court should be commended for making the right call and delivering a ruling that, though far from a blockbuster, should encourage anyone who cares about the continued vitality of the Fourth Amendment. In post-Ferguson America, there’s just no other section of the Constitution that matters more—the power of policing rises and falls with every pronouncement on it.

“The Conscience Of A Corporation”: A Deeply Held Relationship With Five Members Of The Supreme Court
So here is Walmart, insisting that “our core basic belief of respect for the individual” is at odds with an Arkansas bill that would allow religious-based discrimination. And here is Marriott, slamming as “idiocy” similar measures in other states. And somewhere in there is the family-run pizzeria, asserting that Indiana’s new law allows them to deny wedding day pies to people whose choice of spouses they don’t approve of.
These businesses sell Chinese-made consumer goods, hotel rooms, and rounded dough burdened with pepperoni and extra cheese. Since when did they start spouting off about the deeply held convictions guiding their corporate consciences?
You can blame last year’s Supreme Court decision in the Hobby Lobby case for unleashing a herd of ponies that have gone off in quite unpredicted directions. There, in a partisan 5-to-4 ruling straight from Republican fever nests, the court gave certain corporations the right to challenge laws that they claim violate their religious beliefs. In that case, it was about contraception in the health care package.
Let’s pause to consider this new entity — a moneymaking organization no different from a lone human being who feels conscience-bound to live a certain way because of a deeply held relationship with God. Let’s pause, because five members of the Supreme Court would not.
One justice, the irrepressible Ruth Bader Ginsburg, warned of the consequences of giving corporations a soul: “The court, I fear, has ventured into a minefield.”
Ginsburg predicted that the court’s “expansive notion of corporate personhood” would invite profit-making companies to start using religion as an excuse to ignore laws they didn’t like. And indeed, states packed with right-wing legislators who see phantom persecution behind every new episode of “Modern Family” have clamored to give companies a spiritual opt-out clause.
So it is in Indiana. State lawmakers were also told to look before taking a big leap into spiritual exemptions for business. In a letter in February, legal scholars warned of corporations’ citing religious justification for “taking the law into their own hands.”
But, lo, look what happened on the way to forcing religion into the marketplace: The corporations — Apple, Nike, Yelp, Gap, PayPal, Big Pharma companies like Eli Lilly and the nine largest companies with headquarters in Indiana — have rebelled. They are saying: No, don’t give us the power to discriminate. We’d rather remain soulless purveyors of product to the widest possible customer base. Which is, I suppose, how capitalism is supposed to work. Bless the free market.
Indiana’s law is “not just pure idiocy from a business perspective,” said Marriott’s president, Arne Sorenson, but “the notion that you can tell businesses somehow that they are free to discriminate against people based on who they are is madness.”
Not March Madness, the culmination of which is what Indiana thought we’d all be celebrating in the Hoosier State this weekend. But political lunacy, of the type that’s been on display ever since the Republican Party hitched itself to the crazies who dominate its media wing.
But let’s not get too far ahead of ourselves. Walmart, which effectively killed the Arkansas bill a few days ago, remains locked in poverty wage mode, despite its recent boast of raising pay to at least $9 an hour. Apple, and most tech companies now strutting across the moral stage, continues to do business with countries where a person can be executed for being gay.
Their outrage is selective, and calculated: In corporate America, the branding conceit of the moment includes just the right dash of social activism. A little environmental nudge from your cereal, a talk about race from your barista — it’s mostly harmless.
Chick-fil-A learned a lesson in its journey from behind the grease counter and back over gay marriage. After condemning same-sex marriage and becoming a culture-war battleground, the corporate leaders of a company that professes to run on biblical principles now say they will stick with chicken talk. Everyone is welcome.
Good call. Nothing in the secular world keeps Chick-fil-A’s founders from free worship in private. For that matter, nothing in the secular world deprives any business owner of a lawful spiritual pursuit outside of the public square. Their profits will rise or fall because of consumer demand, rather than which side of a biblical exhortation the chicken-eater may be on.
All of this, the free market in tandem with the First Amendment, has worked pretty well in a clamorous democracy such as ours. It’s only when activist judges — thy names are Clarence Thomas, Antonin Scalia, Samuel Alito, Anthony Kennedy and John Roberts — have tried to broaden the intent of the founders that we’ve gotten into trouble.
In 2010, those five judges created the notion of corporate personhood — giving companies the unfettered right to dominate elections. After all, Exxon is just a citizen like you and me. And in 2014, those five judges gave corporations a soul, a further expansion of business entity as a citizen. Well, they tried to. As the saying goes, a corporation will never truly be a citizen until you can execute one in Texas.
