“The Bane Of Political Life In America”: For Conservatives, Government Coercion Is Bad — Except When It’s Not
For conservatives, government coercion is the bane of political life in America. As members of the self-styled anti-government party, they very much are interested in making the case that coercion is inherently illegitimate, whether it is a law requiring you to purchase health care or a law requiring businesses to serve LGBT customers. The problem with this logic is that all laws are coercive — even the ones conservatives like.
Last week, I wrote about the intrinsic coerciveness of all laws in the context of protecting LGBT people from discrimination, which prompted a hilarious yet telling reaction from Sean Davis at The Federalist.
Davis, possibly because he quite obviously did not even read past the first couple paragraphs of my post, is not just wrong, but has missed the entire axis of debate. However, he does inadvertently provide a great example of just why conservatives are ill-advised to admit that all laws are coercive. Because if this is true, then conservatives will have to give up one of their favorite rhetorical tropes — being against coercion in the name of individual liberty — or resort to outright hypocrisy.
The argument was not about LGBT laws in themselves, something Davis failed to grasp. Instead it was about the justification of such laws. My position is that being against government coercion is not legitimate grounds on which to oppose any policy. This applies to liberals, too, though as members of the pro-government faction they generally don’t worry about it much.
But conservatives do. Most of what is referred to as “government” in popular media is liberal stuff like Social Security, Medicare, or food stamps. Labeling those programs as coercion gives conservatives a convenient pro-liberty sheen when they’re talking about slashing poor people’s incomes.
That changes when you bring up things like property. Though ordinary people rarely talk about it in this way, property is underpinned by exactly the same kind of coercion that bolsters civil rights or tax laws, as is the entire superstructure of what we refer to as the free market system — that is, by government coercion.
Therefore, conservatives can’t be principled anti-coercion advocates unless they are willing to throw out private property, which they obviously aren’t. Coercion can’t be bad when it supports things you don’t like and good when it supports things you do — no matter what some conservatives maintain.
Let me emphasize that this line of reasoning doesn’t mean you can’t oppose some civil rights law, just that you can’t oppose it on the grounds of being against coercion in general.
Of course, framing the discussion in this way powerfully strengthens left-wing arguments. If being anti-coercion is utter nonsense, then the debate moves to which kinds of coercion are best as judged by some other moral framework. Whether that’s utilitarianism, contract theory, or Christian ethics, under such conditions it’s a lot harder to oppose transferring income from rich to poor or social insurance programs.
Thus, when presented with left-wing slogans like “property is violence,” your average conservative, perceiving a trap, will resist. In reality there is no escape.
But what makes Davis such a great example is he genuinely doesn’t seem to understand what the problem is here. He argues in one breath that, duh, of course all laws protecting property depend on coercive violence. Then in the very next paragraph, he writes this:
At their core, however, Kohn and Cooper appear to desperately want to avoid the real question at the heart of the religious freedom debate: should the government force individuals to participate in religious ceremonies against their will? [The Federalist]
Government coercion is good, except when it’s not. That’s the kind of stark hypocrisy conservatives would do well to disguise better.

“How A President Paul Would Remake Society”: Rand Paul Is Building A Bridge — To The Early 1800s
The official launch of Rand Paul’s presidential campaign this week showcased an interesting blend of proposals, with the junior senator from Kentucky agitating against the forthcoming Iran deal, racially unjust incarceration, and NSA surveillance. The bulk of it, however, was dedicated to a libertarian vision of government — one drastically at odds with the last century of American governance and more.
This vision isn’t just contained to his speeches. Paul’s budget proposals provide a blueprint for how a President Paul would remake society, and the result is eyewateringly radical. When it comes to domestic policy, his views are far to the right even of Paul Ryan, whose budgets would decimate the legacy of the New Deal. It’s a vision of government from the age of Thomas Jefferson, and ludicrously unsuited to the 21st century.
And yet Paul, despite fashioning himself as an outsider, will likely be a contender in the Republican primary, which means his ideas deserve close scrutiny.
Dylan Matthews has done a deep dive into the various Paul budgets of the last three years, and the findings are jarring. “The gap between Paul’s budget and Ryan’s,” he writes, “is nearly as big as the gap between Ryan’s and Democrats.”
On one occasion or another, Paul has proposed completely abolishing the Departments of Education, Housing and Urban Development, and Energy; the Bureaus of Reclamation and Indian Affairs; all foreign aid; and the Earned Income Tax Credit and Child Tax Credit. On the tax side, he proposes a flat income tax and scrapping the tax on estates, capital gains, dividends, large gifts, as well as the Alternative Minimum Tax.
As Matt Bruenig concludes, this would amount to a stupendous redistribution of income from poor to rich, likely unprecedented in American history. The poor would see their taxes massively increased, while the rich would enjoy a corresponding decrease.
In Paul’s dream world, other government departments get merely eviscerated. The Interior Department is cut by 78 percent, State by 71 percent, the General Services Administration by 85 percent, and the Transportation and Agriculture departments by a comparatively modest 49 percent cut each. The military was cut by 30 percent in early budgets, though Paul has since reversed himself on that.
But wait, there’s more! Science gets gored by Paul, with 20 percent of funding taken from the National Institutes of Health, 25 percent from NASA, 20 percent from the U.S. Geological Survey, 62 percent from the National Science Foundation, and even 20 percent from the Centers for Disease Control and Prevention (which, you may recall, recently prevented an outbreak of Ebola in the U.S.).
These aggressive cuts to discretionary spending are the simple result of huge tax reductions combined with a balanced budget. But Paul also appears to be groping as far towards the libertarian “night watchman state” — limited to the police, military, and courts — as he dares. Though Paul’s views, tainted by roots in his father’s very long history of bigoted conspiracy nutbaggery, are far from the austere purity of Robert Nozick, it’s clear Paul thinks most of what the government has done since the 1930s is illegitimate.
He’s a supporter of the Lochner doctrine, named after a 1905 Supreme Court case that conveniently discovered an unwritten “liberty of contract” in the 14th Amendment and thus abolished most laws regulating working conditions. He’s a fan of the Supreme Court decisions against the New Deal. His latest budget argues that anything but a flat tax is likely unconstitutional. It seems clear that if he had his druthers, he really would abolish everything but the police, the military, and the courts.
This extreme suspicion of federal government is only matched by his reverence for rich people and businesses; Paul does not touch property law, special legal protections for corporations, or even the wretched mortgage interest deduction. His position would fit reasonably well in the Gilded Age or the pre-World War I era, when “due process” for workers was often non-existent.
But it was Thomas Jefferson who made the most sustained effort to bring the libertarian utopia into being. Fighting against Alexander Hamilton and his allies, Jefferson did about all he could, especially early in his first term, to implement the night watchman state. It didn’t work very well, and he began abandoning the effort by the end of his term — and he was living in an agrarian slave society. Trying it in 2016 is patently preposterous.

“Can’t Stop, Won’t Stop”: GOP Will Never Stop Coming For Obamacare
Obamacare turned 5 on Monday, a birthday achieved despite sustained and repeated efforts to smother the law in its cradle.
The law has taken some hits, including a 2012 Supreme Court decision that buckled the knees of the bill’s backers but seemed to make the Affordable Care Act the settled law of the land.
Now the Supreme Court has again taken up another challenge to the law.
King v. Burwell hinges on whether or not four words buried deep in the text of the law contain the seeds of Obamacare’s destruction by eliminating tax subsidies for people living in states that declined to set up their own insurance exchanges.
But even if they lose again at the court, conservatives say that they will continue to try to undo the law through the courts.
Michael Cannon, a health-policy expert at the Cato Institute, said the most promising challenge to the ACA comes from the state of Maine, which, after the Roberts court ruled in 2012 that the federal government was limited in how much it could compel states to expand Medicaid, sued to roll back its existing Medicaid coverage.
Last year, a federal appeals court ruled against the state, but Gov. Paul LePage has appealed to the Supreme Court, even as Maine’s attorney general has refused to represent the state in its challenge of the law.
Other remaining challenges include Sissel v. U.S. Department of Health and Human Services, which argues the ACA is unconstitutional because it violated the Constitution’s origination clause that states spending bills must originate in the House, not the Senate.
“They are both kind of long shots,” acknowledged Cannon, noting that “the Supreme Court has never struck anything down on origination grounds” and that the House likely lacks standing in its lawsuit against the administration.
If the administration loses King v. Burwell, most health-policy experts predict that it will create a “death spiral” as low-income beneficiaries lose their subsidies in states that did not set up their own exchanges, and insurers are forced to raise rates. But conservatives say they will not delay in kneeing the law into the grave by filing lawsuits in states that set up their own exchanges.
Because many states rushed to do so, conservatives say they expect that governors and their health departments may have violated their state constitutions, and so even residents of those states that believed they were immune from the Burwell decision could face a loss of subsidies as well.
If the Supreme Court decides in favor of the government in King, conservative legal scholars said that what they decide to do in the future to tear down the law depends upon precisely the way in which the judgment is rendered. Halbig v. Burwell mirrors the King case in many respects, but other cases could still go forward, in particular one in Indiana in which several dozen school districts have argued that the employer mandate to provide health insurance puts too much of a burden on state and local governments.
Smaller challenges to the law, meanwhile, continue to mount. Little Sisters of the Poor sued to exempt themselves from the contraceptive mandate. If successful, the suit would allow more organizations to opt out than the Hobby Lobby decision did.
Another challenge, brought by the Goldwater Institute of Arizona, takes aim at the Independent Payment Advisory Board, which was designed to permit the Executive Branch to limit Medicare payments. Even some of the law’s liberal supporters, like former Vermont Gov. Howard Dean, have said that the board should be eliminated or rethought.
Meanwhile, conservative legal scholars say they continue to pore over the text of the law in the hopes that they will find some other legal weaknesses that were not readily apparent. The King case, after all, hinges on four words in the text that were discovered by a legal scholar months after the law was passed.
“This law is so complicated that even those who have read it don’t understand the depths of it,” said John R. Graham, a senior fellow at the conservative National Center for Policy Analysis. “Every time we look at it, we find something else to take to a judge.”
And such lawsuits, he added, help galvanize opposition to the bill years after it has passed.
“They keep the energy up, keep Obamacare on the front pages, keep hope alive.”
Which is necessary, because many conservatives still hope that the law will collapse under its own weight.
“They have really reached the limit of sign-ups. Enrollment is flattening as people see more and more how expensive the coverage is, how high the deductibles are, all the hoops they have to jump through, and they realize it is just not very attractive insurance,” said Grace-Marie Turner of the Galen Institute. She said that many states would be able to opt out of some of the law’s provisions in 2017, and find their own alternatives.
“There is going to be huge momentum going forward to make changes to this law,” Turner said. “I could go on forever about how damaging this law has been to people’s lives. It has to be changed.”

“The Right’s Word-Deed Problem”: Republicans Rely On All Sorts Of Magic Tricks That Shove Choices And Problems Down The Road
Briefly, there seemed a chance we might have a cross-party discussion of the biggest economic problem the country faces: the vexing intersection of wage stagnation, declining social mobility and rising inequality.
Even the most conservative Republicans were starting to talk about this challenge in rather urgent terms. In a moment whose irony he noted, Senator Ted Cruz (R-TX) told a bunch of rich Republicans gathered by the Brothers Koch earlier this year that those doing well in America were “the top 1 percent, the millionaires and billionaires the president loves to demagogue, one or two of whom are here with us tonight” while the “people who have been hammered for the last six years are working men and women.”
And on it went through the country’s top Republicans. Senator Marco Rubio (R-FL) stressed “opportunity inequality” and Mitt Romney, in another ironic turn, charged that “under President Obama, the rich have gotten richer.”
It would be wonderful if conservatives really wanted to deal constructively with the predicament they so passionately describe. But thanks to the House and Senate GOP budgets, we now know that conservatives and Republicans (1) aren’t serious about the plight of working class and lower-income Americans, and (2) would actually make their situations much worse.
Their spending plans fail even on conservative terms: They are not fiscally responsible. Instead, they rely on all sorts of magic tricks that shove choices and problems down the road.
One heartening sign is that at least some conservatives find these budgets ridiculous. For example, James Pethokoukis of the American Enterprise Institute headlined his commentary for The Week: “The disappointing unseriousness of the House GOP’s budget.”
Pethokoukis wrote: “House Republicans say they want to balance the federal budget and eventually eliminate the federal debt. They do not have a plan to do so. Oh, to be sure, they have a plan! Just not a realistic one that will actually accomplish their goals.”
He noted that of the $5.5 trillion in cuts from planned spending, $2 trillion would come from “repealing the Obamacare insurance subsidies and Medicaid expansion and replacing them with … well, nothing right now.”
The wholesale assault on efforts to provide lower-income Americans with health insurance is the clearest sign that Republicans don’t want to deal with inequality. The inability to get health insurance is one of the biggest burdens on low-income families, particularly those working for low wages and few or no benefits.
Obamacare has helped 16.4 million Americans get health insurance. Where would they turn? And Republicans would compound the damage: The Senate proposes cutting an additional $400 billion from Medicaid over a decade, the House more than double that. Robert Greenstein of the Center on Budget and Policy Priorities notes that on other low-income programs, the Senate budget cuts even more than the House. The vagueness of these plans makes it hard to tally how much damage would be done to food stamps, Pell Grants for low-income college students and the like, but Greenstein estimates that about two-thirds of the cuts in both plans come “from programs for the less fortunate, thereby exacerbating poverty and inequality.”
Greenstein concludes that under such proposals — here’s hoping President Obama is relentless in blocking them — “ours would be a coarser and less humane nation with higher levels of poverty and inequality, less opportunity,” and an “inadequately prepared” workforce.
Another bit of hypocrisy: These budget writers care so much about national security that they’re not willing to raise a dime in taxes to cover their sharp increases in defense spending. Senator Bernie Sanders, the Vermont independent, called out his conservative colleagues for how differently they treat defense and social spending.
“You’re always telling us the deficit is so bad we’ve got to cut programs for the elderly, for the sick and for the poor,” Sanders said, “and suddenly, all of that rhetoric disappears.”
Budgets are, by their nature, boring. That’s why those who assemble these long columns of numbers figure they can assail the well-being of the least privileged people in our society even as they profess to care about them so much.
I’d respect these folks a lot more if they said what they clearly believe: They think more inequality would be good for us. It almost makes you nostalgic for the candor of the Romney who spoke about the “47 percent” and the Paul Ryan who once divided us between “makers” and “takers.” Honesty beats saccharine words about the struggles of working people any day.

“Ted Cruz Cannot Be Serious”: With Ill-Conceived Fantasies, Cruz Is Entirely Unsuited To Be President
The big news of the day is that Senator Ted Cruz is officially running for president. Not setting up an exploratory committee or any of that perfunctory foreplay, but actually running. “It is a time for truth. It is a time for liberty,” he said in a 30-minute speech at, yeah, Liberty University. “It is a time to reclaim the Constitution of the United States.” Cruz’s address was full of red meat for the conservative crowd. But other than his oratorical skills, Cruz is entirely unsuited to be president. Luckily for America, his candidacy is likely doomed to fizzle.
Cruz recapped his life story, focusing on the role faith plays in his life, before diving into his traditional conservative talking points. He asked the crowd to imagine “millions of young people coming together and standing together, saying, ‘We will stand for liberty'” and “instead of economic stagnation, booming economic growth.” He asked people to imagine the next president repealing Obamacare, abolishing the Internal Revenue Service, implementing a flat tax and “finally, finally, finally secur[ing] the borders.” The crowd cheered each time.
The rest of the Republican field, whenever they officially announce their candidacies, will probably make similar promises; it’s hard to picture a candidate winning the Republican nomination without vowing to repeal Obamacare. As the Washington Post’s Greg Sargent writes, the Republican primary will reveal whether Cruz’s policy positions are extreme within the GOP or whether he differs mainly in his tactics.
His positions, regardless of where they fall within the Republican Party, are ill-conceived fantasies. Take taxes. A flat tax may appeal to the conservative base but it entirely misrepresents the actual problems with the U.S. tax code. The tax code is complicated not because of its progressive structure but because it is full of deductions, exemptions and credits that make it hard to calculate your taxable income. Cruz promotes the flat tax by saying it “lets every American fill out his or her taxes on a postcard.” But the exact same could be said about a progressive tax system. Senator Marco Rubio, another presumptive presidential candidate, didn’t propose a flat tax in his recently released tax plan (although he did say he wants to get there someday) because doing so is just not feasible. A flat tax would need to be set at a high enough level to fund critical government programs, requiring a massive tax increase on the middle class and poor. That’d be a political nightmare.
On Obamacare, Cruz wants to repeal the law … and then basically see what happens. This is, of course, the Republican Party’s position as well. But it’s unacceptable as a presidential candidate’s health care agenda. If you want to repeal the health care law, you better have a replacement plan. The same goes with abolishing the IRS. A Cruz government would eliminate the agency but it would still collect taxes—somehow. Cruz has never said how that would work. Would there be a new agency to replace the IRS? Would it have employees? Who, after all, would collect all those postcards? All unanswered questions.
Yet above all, one particular position should disqualify Cruz—or anyone else who holds it—from the presidency: using the debt ceiling as a hostage device. Breaching the debt ceiling would be disastrous. It’s hard to forecast exactly what would happen, but we can somewhat forecast day one after default. The government would have to prioritize its payments. Do you withhold food stamps from low-income Americans? Delay Social Security checks? Maybe we should stop payments on infrastructure projects. Those missed payments would harm millions of Americans and cause mass disruptions around the country as cash flow problems cause companies to become insolvent. Over the long term, it would permanently raise our borrowing costs, making our interest payments more expensive. In short, it would be self-inflicted economic Armageddon. Cruz considers his willingness to risk that catastrophe a selling point, touting his role in opposing the debt ceiling hikes on his website.
Beyond his policy positions, Cruz has demonstrated himself to be particularly un-presidential. During the 2013 government shutdown, for one, he demanded that President Barack Obama defund Obamacare in return for keeping the government open and avoiding a default on the national debt. It was a ridiculous demand that elevated Cruz’s national profile and ended with Republican approval ratings cratering. In the process, he infuriated much of the Republican establishment—not the only time he has done that.
That episode wasn’t an outlier. Throughout his time in the Senate, Cruz has shown a distinct lack of interest in policymaking or governing. Instead, he has calculated every move to prepare for a 2016 run. Every politician considers the optics of their positions, of course, but Cruz has taken it to the next level, with little care for how his actions affected the Republican Party or his colleagues. In doing so, he probably doomed his candidacy. On Monday, Five Thirty Eight’s Harry Enten convincingly argued that Cruz’s extreme views and his few friends within the Republican Party make it highly unlikely that he will win the nomination.
And that means Cruz’s role in the Republican primary will likely benefit Democrats. He’ll pull the rest of the party to the right on immigration, taxes and health care. Moderates such as former Florida governor Jeb Bush may have to resist the urge to adopt more conservative positions. In December, for instance, Bush said that the GOP candidates had to be willing to “lose the primary to win the general without violating your principles.” But that position is easy to hold 23 months before the general election and more than a year before the first primary. It will become harder to sustain as Cruz and others repeatedly hammer the moderates.
In Cruz’s speech Monday, he never mentioned Hillary Clinton. Instead, he painted a bleak picture of America and its role in the world, saying that the American dream “is slipping away from our hands.” He sees a desperate need for a conservative president to “restore that shining city on a hill that is the United States of America.” Implied throughout: Democrats are ruining America. Yet his actions are only making a Hillary Clinton presidency more likely. The Senator who would hold the government hostage has become the candidate doing the same to his party.
