“Reclaiming Democracy”: A Resounding Vote Against Koch Brothers Dollarocracy

Even as the US Supreme Court attempts to expand the scope and reach of the already dangerous dominance of our politics by billionaires and their willing servants, Americans are voting in overwhelming numbers against the new politics of dollarocracy.

The headline of the week with regard to the campaign-finance debate comes from Washington, where a 5-4 court majority has—with its McCutcheon v. Federal Election Commission decision—freed elite donors such as the politically-ambitious Koch Brothers to steer dramatically more money into the accounts of favored candidates, parties and political action committees. The decision makes it clear that the high court’s activist majority will stop at nothing in their drive to renew the old Tory principle that those with wealth ought to decide the direction of federal, state and local government.

But the five errand boys for the oligarchs who make up that majority are more thoroughly at odds with the sentiments of the American people than at any time in the modern history of this country’s judiciary.

We know this because the people are having their say with regard to the question of whether money is speech, whether corporations have the same rights as human beings and whether billionaires should be able to buy elections.

In every part of the country, in every sort of political jurisdiction, citizens are casting ballots for referendum proposals supporting a Constitutional amendment to overturn US Supreme Court rulings that have tipped the balance toward big money.

In so doing, these citizens are taking the essential first step in restoring democracy.

On Tuesday, thirteen Wisconsin communities, urban and rural, liberal and conservative, Democratic-leaning and Republican-leaning answered the call of constitutional reform. Even as groups associated with billionaire donors Charles and David Koch were meddling in local elections in the state, voters were demanding, by overwhelming margins, that the right to organize fair and open elections be restored.

It even happened in Wisconsin Governor Scott Walker’s hometown of Delavan, where voters faced the question:

Shall the City of Delavan adopt the following resolution:

RESOLVED, the City of Delavan, Wisconsin, calls for reclaiming democracy from the corrupting effects of undue corporate influence by amending the United States Constitution to establish that:

1. Only human beings, not corporations, unions, nonprofit organizations nor similar associations are entitled to constitutional rights, and

2. Money is not speech, and therefore regulating political contributions and spending is not equivalent to limiting political speech.

BE IT FURTHER RESOLVED, that we hereby instruct our state and federal representatives to enact resolutions and legislation to advance this effort.

76 percent of the Delavan residents who went to the polls voted “Yes!”

They were not alone. A dozen other Wisconsin communities faced referendums on the same day. Every town, village and city that was offered a choice voted to call on state and federal officials to move to amend the US Constitution so that citizens will again be able to organize elections in which votes matter more than dollars.

The Wisconsin votes provided the latest indication of a remarkable upsurge in support for bold action to renew the promise of American democracy. Since the Supreme Court began dismantling the last barriers to elite dominance of American politics, with its 2010 Citizens United decision, sixteen states and more than 500 communities have formally requested that federal officials begin the process of amending the constitution so that the court’s wrongheaded rulings can be reversed.

Last fall, John Bonifaz, the co-founder and executive director of the reform group Free Speech For People, calculated that “In just three years since the Supreme Court’s Citizens United ruling, we have come one third of the way to amending the US Constitution to reclaim our democracy and to ensure that people, not corporations, shall govern in America.”

Since the start of 2014, however, the movement has seen a dramatic acceleration in the grassroots pressure for action. During the first weeks of March, forty-seven town meetings called for a constitutional amendment—in a move that put renewed pressure on the New Hampshire legislature to act on the issue.

It is the experience of big-money politics that has inspired renewed activism for reform.

Wisconsin has had more experience than most states with the warping of democracy by out-of-state billionaires, “independent” expenditures and SuperPAC interventions. Governor Walker’s campaigns have reaped funds from top conservative donors, including the Koch Brothers. And a Koch Brothers-funded group, Americans for Prosperity waded into contests this spring for the local board of supervisors in northern Iron County, where mining and environmental issues are at stake; and in the city of Kenosha, where school board elections revolved around questions of whether to bargain fairly with unions representing teachers. In other parts of the state, business interests poured money into school board contests and local races Tuesday, providing a glimpse of the role corporate cash is likely to play in local, state and national elections in the months and years to come.

The Koch Brothers had mixed success Tuesday. Three Iron County Board candidates who were attacked by Americans for Prosperity mailings and on-the-ground “field” efforts in the county won their elections—beating incumbents who were promoted by the outside group. But in Kenosha, two school board contenders who were seen as anti-union zealots won.

There were, however, no mixed results when voters were given a clear choice between dollarocracy and democracy.

The signal from Wisconsin is that grassroots politics can and does still win.

In fact, it wins big.

Encouraged by groups such as United Wisconsin and Move to Amend, activists went door to door in the depths of winter to place amendment questions on local ballots in towns, villages and cities across the state. Many of the communities were in heavily Republican regions of Wisconsin. Yet, the pattern of support was strikingly consistent; in no community did an amendment proposal win less than 60 percent of the vote, and in several the support was over 85 percent.

“Citizens United opened the floodgates to unlimited corporate spending in our elections. Now, Wisconsin voters are standing up to the corrupting influence the flood of special interest money has had on our elections and in our state and national capitols where laws are made,” says Lisa Subeck, the director of United Wisconsin. “Tuesday’s victories send a clear message to our elected officials in Madison and in Washington that we demand action to overturn Citizens United and restore our democracy.”

Whether all those elected representatives will get the message remains to be seen. Several of the communities that voted Tuesday are in the district of Congressman Mark Pocan, D-Madison, who has already introduced an amendment proposal and has been an ardent backer of reform. But many other communities are represented by recipients of the big-money largesse of Wall Street traders, hedge-fund managers, casino moguls and billionaires looking to cover their bets.

Communities in the home district of House Budget Committee chairman Paul Ryan, R-Wisconsin, voted by margins as high as three to one to support an amendment strategy. The results were similar in conservative Waukesha County, which has historically been a Republican stronghold; in the city of Waukesha, for instance, 69 percent of the electorate called for action to amend the constitution. In Wauwatosa, the Milwaukee suburb where Governor Walker now maintains his voting residence, the vote for an amendment was 64 percent.

Wisconsin has several legislative proposals to put the state on record in support of a constitutional amendment. But they face uphill climbs in the current Republican-controlled legislature. And Walker shows no enthusiasm for reforming the system that has so richly rewarded his campaigns. Yet, grassroots activists like Ellen Holly, who helped organize the amendment vote in Walworth County—the heart of Paul Ryan’s district and Walker’s old home turf—is not blinking. She says it’s essential for the Move to Amend campaign to take the fight into even the most conservative areas and to deliver messages to politicians like Ryan.

The widespread support for overturning Citizens United, especially from rural and Republican-leaning areas offers a reminder that the reform impulse is bipartisan and widespread. The same goes from the broad coalitions that have developed. Among the loudest voices on behalf of the referendum campaign in rural Wisconsin was the Wisconsin Farmers Union, which hailed Tuesday’s voting as “a clear message that we the people are ready to take back our democracy.”

“Citizens United has allowed big money to drown out the voices of ordinary people and created an environment where, too often, our elected officials are sold to the highest bidder,” says Subeck, a Madison city council member who this year is running for the legislature on a promise to focus on campaign-finance issues. “To fully restore public trust in our democracy, we must return control of our elections to the people through common sense campaign finance reform, starting with the reversal of Citizens United.”

“Laying It All Out On Medicare”: No Mistaking Paul Ryan’s Policy

The release of a new Paul Ryan budget plan is always the occasion for a lot of ridicule from liberals, for a whole bunch of reasons, and this year’s will be no different. Ryan’s budgets always manage to combine a remarkable cruelty toward poor people with a sunny optimism that draconian cuts to social services will result in a veritable explosion of economic growth, allowing us to balance the budget without taking anything away from the truly important priorities (like military spending) or, heaven forbid, forcing wealthy people to pay more in taxes.

I’m sure there are other people preparing detailed critiques of the Ryan budget, but I want to focus on one thing this brings up: the question of how we talk about Medicare. As he has before in his budgets, Ryan proposes to repeal the benefits of the Affordable Care Act, like subsidies for middle-class people to buy insurance and the expansion of Medicaid, but he’d keep the tax increases and Medicare cuts that the bill included in order to pay for it all, which helps him achieve his “balanced” budget.

Yes, it’s true that when Ryan was running for vice president, he joined Mitt Romney in condemning those very Medicare savings. But nobody really believed he was doing anything at the time but being a team player. So we can give him credit for taking at least a step toward putting his money where his mouth is on Medicare. Sure, it may be couched in some misleading words (the document refers to “strengthening Medicare” no fewer than ten times), but there’s no mistaking the policy.

Because the rest of his party is, to put it kindly, of two minds when it comes to the program. On one hand, they will tell you, Medicare is unsustainable, a ravenous beast that will devour the entire nation’s financial well-being if we don’t find a way to suppress its appetite. In Washington-speak, this is translated as “doing something about entitlements.” We have to Do Something About Entitlements! If you don’t want to Do Something About Entitlements, you’re just not serious about our nation’s fiscal challenges.

On the other hand, Republicans believe that Medicare is utterly sacrosanct, a jewel whose every facet is so perfect that even the most modest attempt to curtail its costs should be met with howls of anguish and outrage. Or at least that’s what they believe at election time, when they’ll air one ad after another condemning Democrats for cutting the Medicare seniors so desperately need. Democrats all over the country have been subjected to ads saying, “Congressman Fnurbler voted to cut $716 billion from Medicare!” over a picture of an elderly couple sitting at the kitchen table, looking over their bills with an engulfing despair, then meeting each other’s eyes in a tragic look that says, “Thanks to Congressman Fnurbler, all is lost. If only we had been able to pay our gas bill so we could stick our heads in the oven and end it all right now.”

Republicans are so deeply opposed to the idea of cutting Medicare that they can’t even stomach anyone trying to see if Medicare is spending its money wisely. Mention the Independent Payment Advisory Board, a component of the ACA that was designed to restrain Medicare costs if they rose too fast, and steam will come out of their ears. (The IPAB would make recommendations to Congress on ways to save money, and Congress would have to act on them. But since Medicare spending has slowed dramatically in the last couple of years, the requirement has yet to kick in, and President Obama hasn’t bothered to appoint anyone to what is still a theoretical board.) They waged a virtual war on comparative effectiveness research, effectively saying that it was dangerous to even ask which competing treatments work well and which don’t.

In other words, most Republicans believe we must, must, must reduce the cost of Medicare—excuse me, Do Something About Entitlements—but are adamantly opposed to every step that has been taken to reduce the cost of Medicare. I’m sure that lots of them are sympathetic to Ryan’s vision, which is to essentially turn the program into a voucher system, in which the government helps you buy private insurance, and over time costs magically go down (and if you’re thinking that sounds a lot like what people are getting on the Obamacare exchanges, any Republican will tell you that it’s totally different because freedom).

So let’s give Paul Ryan some credit. Sure, his numbers might not add up. But when he puts out a budget, there’s no mystery about where he’s coming from and what he wants to do.

“Calling The Republican’s Bluff”: Who Cares About The Value Of Work?

Finding a way out of our current political impasse requires some agreement on what problems we need to solve. If anything should unite left, center and right, it is the value of work and the idea, in Bill Clinton’s signature phrase, that those who “work hard and play by the rules” ought to be rewarded for their efforts.

This is why one of last week’s most important and least noted political events was the introduction of the 21st Century Worker Tax Cut Act by Sen. Patty Murray, D-Wash. Murray favors a minimum wage increase to $10.10 an hour, but she also has other ideas that would help Americans at the bottom of the income structure to earn more.

Let’s start with principles, and then move to specifics.

There’s a new vogue among conservatives: to talk less about entrepreneurs and to stop talking altogether about “makers” and “takers.” Instead, many of the wisest heads on the right are urging a focus on work. The new emphasis reflects a realization that President Obama won in 2012 in large part because Mitt Romney and his party failed to convey empathy for those who live on wages and salaries.

An early champion of this view was Ramesh Ponnuru, a writer for National Review. “The Republican story about how societies prosper — not just the Romney story — dwelt on the heroic entrepreneur stifled by taxes and regulations,” he wrote shortly after the election. It is, Ponnuru added, “an important story with which most people do not identify.”

Writing earlier this year in National Affairs magazine, Henry Olsen of the Ethics and Public Policy Center was more biting. “Modern conservatives,” he argued, “have tended to discount the moral value of the average person, focusing instead on extolling the moral superiority of the great.”

Two other conservative thinkers, Reihan Salam and Rich Lowry, say the antidote is for Republicans to become “the party of work.” As they see it, work “stands for a constellation of values and, like education, is universally honored.” The GOP, they said, “should extol work and demand it.”

Yes, that last phrase — “demand it” — could lead to a darker kind of politics involving the demonization of those who simply can’t find jobs. Thus did Rep. Paul Ryan, R-Wis., get into trouble for mourning “this tailspin of culture, in our inner cities in particular, of men not working and just generations of men not even thinking about working.”

No matter what Ryan was trying to say, he seemed to be emphasizing the flaws of the unemployed themselves rather than the cost of economic injustice. My Post colleague Eugene Robinson captured this well: “Blaming poverty on the mysterious influence of ‘culture’ is a convenient excuse for doing nothing to address the problem.”

Nonetheless, many conservatives really do realize that they need to embrace hardworking Americans. But the question stands: What are they willing to do about it?

This is where Murray comes in. Her bill would rid the tax code of certain disincentives to work. She notes that “the second earner in a household often pays a higher tax rate on his or her earnings than the first.” Her plan would right this by offering a 20 percent deduction on the second earner’s income up to roughly $60,000 a year. (The benefit is focused on lower-income families, so it phases out at about $130,000 in joint annual income.) For a $25,000-a-year second earner in the 25 percent bracket, she says, this would mean $1,250 “back in their pocket for groceries, child care or retirement savings.”

She’d also expand the earned-income tax credit for workers without children and lower the eligibility age from 25 to 21. The changes would increase their maximum benefit from $487 to about $1,400 a year. It’s hardly nirvana. But it’s real money, especially for someone earning around $15,000 a year. The proposal would cover its roughly $15 billion annual cost by closing loopholes already identified as worthy of being scrapped by the GOP’s leading tax reformer, Rep. Dave Camp of Michigan.

You can, of course, look at what Murray is doing as a way of calling the conservatives’ bluff on the matter of work. But that will be true only if the right allows its bluff to be called.

In making their case, Salam and Lowry quoted Abraham Lincoln on the need “to advance the condition of the honest, struggling laboring man.” If conservatives are serious about this (and about the honest, laboring woman, too) they’ll join Murray in raising the minimum wage and in seeking a tax code more in harmony with the dignity of work.

“Blowing Away The Smoke”: A Democrat-Sponsored Tax Cut Calls The GOP’s Anti-Poverty Bluff

For months now, as congressional Republicans have blocked repeated attempts to extend benefits to the long-term unemployed, as they’ve fought to deny low-income Americans access to health insurance, as they’ve advocated to cut tens of billions from the food stamp program, as they’ve resisted proposals to raise the minimum wage, they have simultaneously professed their commitment to American workers and the poor.

Senator Patty Murray put forth a new test of that commitment on Wednesday, by introducing legislation to expand the Earned Income Tax Credit. The EITC is already one of the largest and most effective anti-poverty programs, rewarding low-wage earners for their work and lightening their tax burden. It’s also one of the very few specific anti-poverty policies Republicans have praised in recent months.

Murray’s bill, the “21st Century Worker Tax Cut Act,” would increase the maximum credit for childless adults and create a new tax deduction for families with two working parents. It’s intended to complement the Democrats’ campaign for a higher minimum wage, and to force Republicans to take a real stand on help for American workers. Given their recent nods towards the EITC, one might reasonably expect Republicans to consider Murray’s proposal seriously. (President Obama also proposed an EITC expansion in his budget for 2015.) Even the tax loopholes Murray proposes closing in order to pay for the expansion have already been singled out for elimination by the Republican chairman of the House Ways and Means Committee, Robert Camp. But these are not reasonable times.

The Republican’s recent expressions of support for expanding the EITC have always seemed more opportunistic than sincere. Rather than actively working to extend the credit to more Americans, the GOP instead uses the EITC as “a protective shield against populist attacks,” as Jonathan Chait put it; specifically, as a counterpoint to calls from the left to raise the minimum wage.

“The minimum wage makes it more expensive for employers to hire low-skilled workers, but the EITC, on the other hand, gives workers a boost—without hurting their prospects,” Representative Paul Ryan said of the EITC in a January speech at the Brookings Institution. “It gives families flexibility—it helps them take ownership of their lives.”

Conservative pundits and academics have taken a similar line. Two economists at the American Enterprise Institute argued last year that “expanding the earned income tax credit is a much more efficient way to fight poverty than increasing the minimum wage.” Steve Moore of the Heritage Foundation argued in favor of a higher EITC in January, as did former Bush advisor Glenn Hubbard. Another former Bush advisor, Harvard economist Gregory Mankiw, wrote recently that the EITC was “distinctly better” than raising the minimum wage because the costs are born by taxpayers rather than employers.

In his own much-hyped poverty speech in January, Senator Marco Rubio advocated for replacing the EITC with a “federal wage enhancement” subsidy. The vague contours of the alternative he proposed suggested that what he had in mind was nearly identical to the EITC, but with more support for people without kids.

Rubio was right to point out that one of the major shortcomings of the current EITC is that it offers minimal assistance to childless workers. As the program operates now, people without children who are under 25 are ineligible, and the maximum credit for those between 25 and 64 is $487. Families with children receive more substantial benefits. In 2011, their average credit was $2,905.

Murray’s bill addresses Rubio’s professed concern for childless workers by lowering the eligibility age to 21 and raising the maximum credit for childless workers to about $1,400. Those changes would benefit thirteen million people, according to a Treasury Department estimate. The legislation also increases support for families with two working parents by allowing a secondary earner to deduct twenty percent of their income from their federal taxes. This could offset childcare, transportation, and other costs associated with entering the workforce, thus encouraging more stay-at-home parents to find jobs. More than seven million families would benefit from this new deduction, according to the Joint Committee on Taxation.

The bill also doubles the penalties for tax payers who fail to comply with the Internal Revenue Service’s “due diligence” requirement, a reform that addresses Republican concerns about the costs of improper claims.

If Republicans really wanted to use the EITC as a vehicle for boosting low wages, this legislation provides an excellent starting point for negotiation. But they’re unlikely to engage with it seriously, because their lauding of the EITC was never serious to begin with. For example, Rubio’s proposal to expand the credit for childless workers would have been accomplished by taking money away from workers with kids, instead of by increasing the size of the program overall.

Republicans will face a tricky situation if Harry Reid brings Murray’s bill up for a vote in the Senate. “If Republicans aren’t interested in supporting this bill, they’ll need to explain why they are rejecting the alternative that they have often pointed to in order to justify opposing raising the minimum wage,” a senior Democratic aide told The Nation.

If recent votes on unemployment insurance are any indication, Republicans are far more likely to risk hypocrisy and find reasons to kill the bill than do any real governing, even on policies they profess to support. If a vote doesn’t accomplish much for low-wage workers, it may at least blow away some of the smoke from the GOP’s show.

“Wealth Over Work”: We’re On The Way Back To “Patrimonial Capitalism”, Where Birth Matters More Than Effort And Talent

It seems safe to say that “Capital in the Twenty-First Century,” the magnum opus of the French economist Thomas Piketty, will be the most important economics book of the year — and maybe of the decade. Mr. Piketty, arguably the world’s leading expert on income and wealth inequality, does more than document the growing concentration of income in the hands of a small economic elite. He also makes a powerful case that we’re on the way back to “patrimonial capitalism,” in which the commanding heights of the economy are dominated not just by wealth, but also by inherited wealth, in which birth matters more than effort and talent.

To be sure, Mr. Piketty concedes that we aren’t there yet. So far, the rise of America’s 1 percent has mainly been driven by executive salaries and bonuses rather than income from investments, let alone inherited wealth. But six of the 10 wealthiest Americans are already heirs rather than self-made entrepreneurs, and the children of today’s economic elite start from a position of immense privilege. As Mr. Piketty notes, “the risk of a drift toward oligarchy is real and gives little reason for optimism.”

Indeed. And if you want to feel even less optimistic, consider what many U.S. politicians are up to. America’s nascent oligarchy may not yet be fully formed — but one of our two main political parties already seems committed to defending the oligarchy’s interests.

Despite the frantic efforts of some Republicans to pretend otherwise, most people realize that today’s G.O.P. favors the interests of the rich over those of ordinary families. I suspect, however, that fewer people realize the extent to which the party favors returns on wealth over wages and salaries. And the dominance of income from capital, which can be inherited, over wages — the dominance of wealth over work — is what patrimonial capitalism is all about.

To see what I’m talking about, start with actual policies and policy proposals. It’s generally understood that George W. Bush did all he could to cut taxes on the very affluent, that the middle-class cuts he included were essentially political loss leaders. It’s less well understood that the biggest breaks went not to people paid high salaries but to coupon-clippers and heirs to large estates. True, the top tax bracket on earned income fell from 39.6 to 35 percent. But the top rate on dividends fell from 39.6 percent (because they were taxed as ordinary income) to 15 percent — and the estate tax was completely eliminated.

Some of these cuts were reversed under President Obama, but the point is that the great tax-cut push of the Bush years was mainly about reducing taxes on unearned income. And when Republicans retook one house of Congress, they promptly came up with a plan — Representative Paul Ryan’s “road map” — calling for the elimination of taxes on interest, dividends, capital gains and estates. Under this plan, someone living solely off inherited wealth would have owed no federal taxes at all.

This tilt of policy toward the interests of wealth has been mirrored by a tilt in rhetoric; Republicans often seem so intent on exalting “job creators” that they forget to mention American workers. In 2012 Representative Eric Cantor, the House majority leader, famously commemorated Labor Day with a Twitter post honoring business owners. More recently, Mr. Cantor reportedly reminded colleagues at a G.O.P. retreat that most Americans work for other people, which is at least one reason attempts to make a big issue out of Mr. Obama’s supposed denigration of businesspeople fell flat. (Another reason was that Mr. Obama did no such thing.)

In fact, not only don’t most Americans own businesses, but business income, and income from capital in general, is increasingly concentrated in the hands of a few people. In 1979 the top 1 percent of households accounted for 17 percent of business income; by 2007 the same group was getting 43 percent of business income, and 75 percent of capital gains. Yet this small elite gets all of the G.O.P.’s love, and most of its policy attention.

Why is this happening? Well, bear in mind that both Koch brothers are numbered among the 10 wealthiest Americans, and so are four Walmart heirs. Great wealth buys great political influence — and not just through campaign contributions. Many conservatives live inside an intellectual bubble of think tanks and captive media that is ultimately financed by a handful of megadonors. Not surprisingly, those inside the bubble tend to assume, instinctively, that what is good for oligarchs is good for America.

As I’ve already suggested, the results can sometimes seem comical. The important point to remember, however, is that the people inside the bubble have a lot of power, which they wield on behalf of their patrons. And the drift toward oligarchy continues.
