“Free Stuff!”: Jeb’s Outreach To Black Voters; It Isn’t ‘We’ll Take Care Of You With Free Stuff’

Man, Republicans just can’t help themselves, can they? Here’s Jebbie in South Carolina talking about reaching out to African-American voters, per a report from WaPo’s Sean Sullivan:

“Look around this room,” a man told Bush, who spoke to a mostly white crowd. “How many black faces do you see? How are you going to include them and get them to vote for you?” asked the man, who was white.

Bush pointed to his record on school choice and said that if Republicans could double their share of the black vote, they would win the swing states of Ohio and Virginia.

And if they had some ham, they could make a ham sandwich, if they had some bread. But I digress.

“Our message is one of hope and aspiration,” he said at the East Cooper Republican Women’s Club annual Shrimp Dinner. “It isn’t one of division and get in line and we’ll take care of you with free stuff. Our message is one that is uplifting — that says you can achieve earned success.”

The “free stuff” reference sounds familiar, doesn’t it?

According to a pool report, [Mitt] Romney, who struggled badly with minority voters in the 2012 election, said during a Montana fundraiser that year: “I want people to know what I stand for and if I don’t stand for what they want, go vote for someone else, that’s just fine. But I hope people understand this, your friends who like Obamacare, you remind them of this, if they want more stuff from government tell them to go vote for the other guy — more free stuff.” Romney was explaining his remarks that day at the NAACP’s national convention, where he was booed.

Now in commenting on this latest Bush gaffe, the ever-fair Greg Sargent notes that Jeb’s not attacking po’ folks for taking “free stuff:”

Bush was not criticizing recipients of government help as self-designated victims. Rather, he was implicitly criticizing the Democratic vision of government, suggesting that Dems want to use government handouts (“free stuff”) to destructively trap people in dependency (“take care of you”) in order to capture and hold their votes.

As applied to African-Americans, this is the old “Plantation” meme, according to which Democrats have ensnared people by the diabolical means of helping them stay alive and make ends meet, as opposed to “empowering” them with benign neglect.

This sort of rap coming from the scion of a rich and powerful family might go over better if he were preceded by some commitments to letting African-Americans vote and abandoning mass incarceration as a social control mechanism and taking seriously complaints about police misconduct. As it is, it’s just free rhetoric.

“Bye-Bye Federal Criminal Justice Reform?”: Hard To Imagine GOP Congressional Leaders Bucking Their Base To Push Reform

There’s a powerful tendency in the chattering classes, impervious so far to contrary data, to think of Donald Trump as just a summer sideshow that will close down directly once the real candidates–you know, Jeb!–get in gear and Party Elites send down the word that the base has had its fun and now needs to get into line. You don’t have to think he’s actually going to get the nomination (and I still don’t, though I wouldn’t bet the farm I don’t have on it at this juncture) to understand he’s having an impact on the GOP and indirectly the country.

Most obviously, no Republican who wants to seriously compete for the nomination is going to get all loud-and-proud about comprehensive immigration reform, no matter what’s down there in the footnotes of their policy tomes.

But my biggest fear has been that Trump’s poisoning the well for criminal justice reform at the federal level, and Michael Grunwald shares it:

Criminal justice reform, a perennial lost cause for civil rights lefties, had its surprise bipartisan moment this year. Conservative Republican voices like anti-tax activist Grover Norquist and the Koch brothers led campaigns against mass incarceration and mandatory drug sentences. GOP presidential candidate Jeb Bush has embraced the pro-reform Right on Crime initiative, while Rand Paul and Ted Cruz have co-sponsored reform bills with liberal Democratic senators.

But the Kumbaya reform moment may not survive the Summer of Trump.

After roiling the politics of immigration with jeremiads about border walls and Mexican rapists, Donald Trump has scrambled the politics of crime by running as a pro-cop, anti-thug “law-and-order” candidate, denouncing rioters in Baltimore and Ferguson, vowing to “get rid of gang members so fast your head will spin.” And as with immigration, his rivals are echoing his appeals to the angry id of their party’s white base, distancing themselves from bipartisan reform. Bush is now touting his own “eight-year record of cracking down on violent criminals” as governor of Florida, while attacking Trump as “soft on crime” because of his past support for Democrats and marijuana decriminalization. Candidates like Cruz and the usually Koch-friendly Scott Walker are also trumpeting their toughness on criminal justice issues, blaming President Barack Obama and the Black Lives Matter movement for recent attacks on police officers. In this climate, it’s even harder than usual to imagine GOP congressional leaders bucking their base to push reform.

Trump has been dismissed as a sideshow, but for now at least, he’s the main show.

I suppose it’s possible that a Republican presidential candidate or two will decide to get attention as someone who’s “fighting” Trump on this or that issue instead of positioning him- or her-self to inherit his support when whatever it is that’s supposed to strike him down finally happens. But I wouldn’t count on it, particularly on an issue–crime–that is more viscerally immediate to angry and frightened white people than immigration.

“A Battle Cry Among Some In The Academy”: My Police Academy Teaches The ‘War On Cops’ Myth

The trumpets of the thin blue line and right-wing news sources have been sounding, piping out warnings of a “War on Police.” You may have heard it on talk radio, seen it on Fox News or even read it in the New York Post, but now the rhetoric of charlatans has reached me in class at my police academy in a Northern red state.

The War on Cops is a grossly inaccurate response to recent police killings which are on track for another year that will rival the safest on record. Gunfire deaths by police officers are down 27 percent this year, according to the Officer Down memorial page, and police killings in general are at a 20-year low, given current numbers for 2015. Police deaths in Barack Obama’s presidency are lower than the past four administrations, going all the way back to Ronald Reagan’s presidency.

Not a single iota of evidence supports a War on Police, but it has become a battle cry among some in the academy.

Over 80 percent of police departments in the United States are facing issues with low recruitment numbers. As an Iraq War veteran I sought to solidify my chance of employment working in law enforcement by attending a local police academy. I enjoyed serving my country as military police and will do such now as a sworn police officer back home.

What are they telling us in a post-Michael Brown academy? The culture of police brutality is infrequently addressed, but what is continually mentioned is the notion that there is a War on Police. By whom? Depends on whom you ask.

Some instructors blame the Obama administration, which has provided extra funding to police departments to hire Iraq War veterans such as myself. Others, citing news organizations and politicians, try to pin it on the Black Lives Matter movement.

How are they attempting to substantiate this? By highlighting a few high-profile police killings in the past few months, especially the tragic, execution-style death of a Texas sheriff at a gas station. Many activists tried to tie the accused murderer, Shannon Miles, to the Black Lives Matter movement in the immediate aftermath as a motive. He had no ties to the movement.

Miles, however, had been previously declared mentally incompetent.

“The Obama administration and Eric Holder are undermining the police. We have officers dying left and right and he’s dicking off in Alaska,” says one of my instructors, referring to the president’s trip to Alaska last week.

Our instructor is likely trying to warn us to take heed of the dangers of the job, and not expect to be thanked by politicians for doing it. But he has made the government and the people we’re meant to serve out to be boogeymen in the process.

Bad guys have been shooting cops for years, but this is neither a new nor growing phenomenon. A whole generation has grown up knowing the phrase “fuck the police” as a song lyric, a response to the mass incarceration culture spawned from a War on Drugs that numbers show disproportionately and unfairly targets black Americans.

I understand as a law enforcement professional—and as someone capable of fairly reading mountains of data—that the Drug War has been unfairly used as a tool of oppression against the black community. It is why the American public overall has shown they have less confidence in police in recent times.

But there is no War on Police. This Us vs. Them mentality still prevails even in fresh academy cadets. Perhaps some of these people will become future jackbooted, truncheon-wielding oppressors. Or perhaps they will encounter the reality that betrays the fear they are taught.

“The Hillary Doubters Are Wrong”: Yes, She’s Vulnerable, But She’s Still The Heavy Favorite

When it comes to Hillary Clinton and her place in the presidential primary, the political media needs to start being able to hold two ideas in mind at once. The first, and most familiar to anyone who has followed this campaign, is that Clinton is vulnerable.

Her email—and use of a private server—has grown from a scandal to a fiasco. The FBI has stepped in with an investigation to see if Clinton’s system was compromised by foreign hackers, and to see if she knowingly passed classified information—including “top secret” intelligence—through her server. Clinton is also due to face a House select committee for a public hearing on the 2012 attack on an American consulate in Benghazi, Libya. Maybe she’ll perform well and avoid missteps. But she might stumble, exposing herself and her campaign to more attacks and scrutiny.

There have also been challenges on key policy questions. To the most vocal progressive activists, Clinton still needs to account for her role in the Bill Clinton White House on issues like mass incarceration, police militarization, and the drug war. As first lady, for example, she pushed the “three strikes” provision of the 1994 crime bill and supported greater prison time for offenders. “There is something wrong when a crime bill takes six years to work its way through Congress and the average criminal serves only four,” she said at the time. The same is true for her positions in the Senate, where she voted in favor of federal police funding that flowed to SWAT teams and other vectors for militarization. There’s also her economic record: As a senator from New York, she backed a 2001 bill that would become the much loathed (among liberals) 2005 bankruptcy law. And she still hasn’t acknowledged or apologized for the racially tinged rhetoric used by her campaign in the most heated moments of her 2008 race against Barack Obama.

But, again, this isn’t the whole story. There’s still that other idea about Clinton to keep in mind, even as we consider her problems and weaknesses: Clinton is winning the Democratic presidential primary, and it’s not even close.

Despite the reporting around it—which has treated her as a losing candidate—the latest Quinnipiac poll shows Clinton with a wide lead over her opponents. She wins 45 percent of the Democratic Party, to 22 percent for Vermont Sen. Bernie Sanders and 18 percent for Vice President Joe Biden. Aggregate polls show a similar picture; in the Huffington Post Pollster average, Clinton holds 48.9 percent of the primary vote, compared with 22.5 percent for Sanders and 12.5 percent for Biden. There’s no contest.

There’s an easy and obvious rejoinder: What about 2008? Wasn’t Clinton winning at this point in that primary; wasn’t she “inevitable”? And look what happened: She lost to a popular upstart with the public behind him.

This sounds persuasive, but it doesn’t fit the facts. As writer Harry Enten notes for FiveThirtyEight, Clinton was much weaker in the previous primary than she is now. “Back in 2008,” he writes, “she was trailing in early Iowa polls. She earned only a third of the vote in early New Hampshire polls and was below 40 percent nationally.” Now, by contrast, she’s well ahead in national polls, well ahead in Iowa, and only somewhat behind in New Hampshire.

Moreover, because primaries aren’t popularity contests, the most important measure of success is party support. Barack Obama wasn’t an upstart; behind his run was the party machinery, or at least the part that didn’t want Clinton. Today, where do Democratic fundraisers stand? What do Democratic interests groups think? How will Democratic lawmakers act?

On each score, Clinton isn’t just winning—she dominates. Most fundraisers are in her corner; it’s why Biden will have a hard time raising money if he decides to run. Interest groups are still quiet, but Democratic lawmakers are overwhelmingly pro-Hillary. Clinton has more than 100 endorsements from sitting Democrats, including seven governors and 29 senators. Biden, who doesn’t appear to have decided whether to run yet, has two. Former Maryland Gov. Martin O’Malley has one. Bernie Sanders has none. This is unprecedented. Not only is Clinton ahead of her previous endorsement total, according to analysis by FiveThirtyEight, but she’s racked up more endorsements of significance at this stage of the race than any nonincumbent Democratic presidential candidate, ever. At this point in 1999, for instance, Al Gore had two-thirds as many endorsement points (a measure that weights senators and governors more than House representatives) as Clinton does now; at this point in 2003, John Kerry had less than one-tenth Clinton’s current support; at this point in 2007, Obama had less than one-sixth. The closest analogue to Clinton isn’t anyone in the Democratic Party—it’s George W. Bush, who had much greater endorsement support than Clinton at this stage of the 2000 Republican presidential primary and ultimately won easily, despite an early challenge from John McCain.

Of course, life is arbitrary, and Hillary’s campaign could still fall apart. It’s not hard to imagine how it might happen: The FBI investigation could lead to indictments, ending Clinton’s campaign with a court appearance. Or, she could refuse to answer any questions on her previous positions and open space for a challenger.

Then again, neither email nor crime is an impossible albatross; other candidates have had worse. George H.W. Bush had to deal with fallout from Iran-Contra, while Al Gore had Bill Clinton’s impeachment in the background. Both won their respective nominations with little difficulty. Sure, Clinton could lose. But it’s hardly a live possibility.

“Our Current Investments In Justice System Are Unwise”: Criminal Justice Reform Ignores Victims Of Crime. That Makes No Sense

When policymakers think of the people who comprise the victims’ rights movement, young people of color from low-income communities may not be the first group that leaps to mind. But the facts suggest these survivors should be.

My organization conducted two years of research and found that one in five Californians experience crime – but its impact is concentrated and unequal. The majority of crime victims live in lower-income communities and repeat victimization is even more concentrated (echoing research on victimization in the entire US). When it comes to violent crime, those most likely to be repeatedly victimized are young people of color, especially African-American and Latino males.

Two out of three crime survivors reported being victimized more than once in the last five years. Many repeat victims have long histories of suffering multiple types of crimes, such as sexual exploitation, abuse or community violence. Worse still, only a small number of survivors receive any help, despite often experiencing severe depression, anxiety and post-traumatic stress in the aftermath of crime.

Young people of color from low-income communities bear an unconscionably disproportionate burden of violence and crime – and are victimized at staggering rates while also the least likely to get help to recover from trauma. Most frequently victimized, least often supported. There is something terribly wrong with this picture.

Beyond lacking access to recovery support, most crime victims also disagree with the direction criminal justice policymaking has taken over the last few decades of prison expansion. While the traditional approach to victims’ rights has focused on toughening punishments for people convicted of crime and strengthening the rights of victims during criminal proceedings, our research shows that most survivors of crime think that our current investments in justice system are unwise. Two out of three California victims surveyed believe bloated prisons either make inmates better at committing crimes or have no impact on crime at all. Most survivors want greater investments into rehabilitation, mental health treatment and prevention over bigger prisons and jails.

Listening to crime victims can tell us a lot how we should reform our safety and justice systems. We must embrace survivors as unexpected advocates for justice reform. It’s time to stop pretending that building more prisons protects survivors – it doesn’t.

Procedural rights for victims are critical, and accountability for people who commit crime is an essential component of an effective criminal justice system. Yet, many victims never even get to a courtroom. National statistics reveal that over half of violent crime goes unreported, eliminating any possibility of a prosecution. And even when violent crimes are reported, less than half result in an arrest. So focusing only on criminal proceedings leaves out the experiences and needs of the majority of crime survivors.

Packed prisons and extreme sentencing for the fraction of crimes that result in a conviction also depletes the very resources needed to improve victim protection and community safety. We need to rethink what investments can serve and protect as many victims as possible, including the communities most impacted by crime. We should pay special attention to the needs of those at greatest risk of being repeatedly victimized, such as youth of color.

When victims go without trauma recovery support, they risk being victimized again and falling through the cracks in life: dropping out of school, suffering health problems, self-medicating to the point of addiction and even turning to crime themselves.

David Guizar knows this well: growing up in South Central Los Angeles, his older brother – and father figure – was shot and killed when David was 10. He never learned what happened, nor did his family learn about or access any services that exist for survivors of violent crime.

David felt lost after his was family broken, and he filled the void with alcohol and drugs for decades, finally getting sober in 2006. Then, in 2012, another one of David’s brothers was killed when a stranger tried to enter a family wedding.

“After our family’s losses, we never heard about existing supports for survivors of crime, which would have made a big difference in our ability to recover,” said Guizar. “California clearly has the money – the state spends $10 billion per year on a prison system to respond to crime – but I and other survivors want lawmakers to know that we can invest these resources in smarter ways to help survivors both recover from and prevent crime.”

Instead of continuing to create harsh penalties that, in turn, create more prisons as our response to crime, we should invest in mental health care and trauma-informed services for anyone traumatized by violence, as well as safe places to go when crisis erupts, family support programs and economic recovery assistance for victims. We also need to improve the relationship between police, prosecutors and the communities they serve, so that victims trust – and can safely cooperate with – law enforcement to solve more crimes.

Despite the prevalence of pro-victim rhetoric during the prison-building era, few policymakers have asked themselves who experiences crime, who is most vulnerable to repeat crime or what survivors need to recover and avoid future harm. Most crime victims have never been at the center of attention of criminal justice policies, nor have their experiences and needs been considered as penal codes and prison populations mushroomed over the past three decades.

But the evidence suggests that when you ask the people most affected, survivors are less interested in spending tax dollars to fill more prisons and instead want to prioritize investments that will actually prevent crime in the first place. It is time for policymakers to finally listen – and put the perspectives of those most vulnerable to harm at the center of policies.
