“The Nation’s Cult Leader”: From ‘Yes We Can’ To ‘I Alone Can Fix It’

At roughly this point eight years ago, when Democrats were desperate to reclaim the White House after two terms of a Republican president, then-Sen. Barack Obama accepted the party’s nomination and delivered a speech that emphasized unity. “In America, our destiny is inextricably linked,” he said, “that together our dreams can be one.”

The speech used the word “we” constantly. “America, we cannot turn back,” Obama said. “We cannot walk alone. At this moment, in this election, we must pledge once more to march into the future.”

The campaign’s slogan, of course, was “Yes we can.”

It was therefore a little jarring last night to hear one of the more memorable lines from Donald Trump’s acceptance speech at the Republican convention: “Nobody knows the system better than me, which is why I alone can fix it.” He added, “I will restore law and order to our country.”

Trump concluded, “I am your voice.”

The language was a little jarring, as The Atlantic’s Yoni Appelbaum explained very well.

[Trump] did not appeal to prayer, or to God. He did not ask Americans to measure him against their values, or to hold him responsible for living up to them. He did not ask for their help. He asked them to place their faith in him.

He broke with two centuries of American political tradition, in which candidates for office – and above all, for the nation’s highest office – acknowledge their fallibility and limitations, asking for the help of their fellow Americans, and of God, to accomplish what they cannot do on their own.

To be sure, the Republicans in attendance didn’t seem to mind. The more Trump positioned himself as the nation’s savior, the more the crowd cheered.

But as a rule, when a man with authoritarian instincts condemns the political system and declares, “I alone can fix it,” he sounds less like a president and more like a cult leader.

“Badly Misleading And Dangerous”: About Those Rising Murder Rates: Not So Fast

Are the increases in murders in major cities like Chicago, Milwaukee, and New York City indicative of a broader trend in American cities? That’s the conclusion encouraged by a front-page New York Times article, Murder Rates Rising Sharply in Many U.S. Cities. It’s a scary story, conjuring images of the high-crime 1990s and fueling speculation about an ostensible “Ferguson Effect” — the unsubstantiated notion that, as The Times put it, “less aggressive policing has emboldened criminals.” This is badly misleading and, at a time when criminal justice reform is making notable bipartisan advances, it’s also dangerous.

Of course, The Times isn’t an academic journal, and its story wasn’t meant to be a rigorous analysis of a big database; it was a glimpse into a current conversation with some new numbers. Still, it’s worth taking a closer look at those numbers.

My own analysis of publically available homicide statistics for a broader selection of cities yields conclusions that are rather different from those stated or implied in the Times article. The differences are related to how cities were selected and the way the data were interpreted.

City Selection

It is not clear how the cities examined by the Times were chosen. The article included ten cities with populations ranging from over 8 million (New York) to just over 317,000 (St. Louis). But there are 60 U.S. cities with estimated 2014 populations in that range. The Times included only four of the 20 most populous U.S. cities. The authors do not explain how those cities were chosen, leaving readers to assume that the findings presented are representative of a broader increase in homicides across U.S. cities. That does not appear to be the case.

In just a few hours, I was able to locate publically available data to support similar analyses for 16 of the 20 most populous cities, and the results, summarized below, suggest a much less pervasive increase than one might infer from the Times analysis.

Interpretation of Statistics

First, not all of the increases cited by the Times are statistically reliable; that is, some of them are small increases, or are based on small numbers of cases, such that the observed increases could have occurred by chance alone. Among the 16 top-20 cities for which I found publically available data, only three experienced statistically reliable increases. Only one of the top-20 cities included in the Times’ sample, Chicago, experienced an increase that was statistically significant. Five of the smaller cities included by the Times did experience statistically reliable increases, but what of the other 35 cities with populations in that range?

Even where a statistically reliable increase has been experienced, a single year-to-year increase does not necessarily imply a meaningful trend. Often, such changes fall within the range of normal year-to-year fluctuations. For example, I was able to obtain historical data on year-to-year changes in homicide counts for Chicago, the only top-20 city in the Times analysis that had a statistically significant increase from 2014 to 2015. From 2009 to 2010, homicides increased 5.1 percent. The next year, however, there was a 13.1 percent decrease. The year after that, a 28.5 percent increase, and then decreases of 16.4 and 3.4 percent in 2013 and 2014, before homicides climbed back up 11.3 percent in 2015. Looked at over a longer time period, the numbers do not demonstrate a stable trend.

Thus, neither the Times analysis nor my own yields compelling evidence that there has been a pervasive increase in homicides that is substantively meaningful. It seems premature to be discussing broad explanations and long-term solutions for what may not be a broad or long-term phenomenon. And yet the spike in a few cities has already prompted speculation that the numbers reflect the increased availability of guns, or the demoralization of police.

Of course, the lack of compelling evidence of a broad-based increase does not prove that no such increase is occurring. Trends in homicide rates (and crime rates generally) are extremely important topics that warrant further investigation. But before we begin to speculate about causes and potential remedies, we need a more comprehensive understanding of the prevalence and location of increases in homicide rates that actually depart from normal fluctuations. This suggests a need for analyses that span several years, for as many medium- and large-sized jurisdictions as possible. It would also be useful to undertake such analyses for related crimes, such as non-fatal shootings, non-fatal stabbings, and aggravated assaults, since the difference between those and homicides may often be a matter of random luck, the type of weapon readily available, or the distance to the nearest emergency room.

Only then will we be in a position to undertake rigorous efforts to explain the problem and explore potential remedies.

“Bye-Bye Federal Criminal Justice Reform?”: Hard To Imagine GOP Congressional Leaders Bucking Their Base To Push Reform

There’s a powerful tendency in the chattering classes, impervious so far to contrary data, to think of Donald Trump as just a summer sideshow that will close down directly once the real candidates–you know, Jeb!–get in gear and Party Elites send down the word that the base has had its fun and now needs to get into line. You don’t have to think he’s actually going to get the nomination (and I still don’t, though I wouldn’t bet the farm I don’t have on it at this juncture) to understand he’s having an impact on the GOP and indirectly the country.

Most obviously, no Republican who wants to seriously compete for the nomination is going to get all loud-and-proud about comprehensive immigration reform, no matter what’s down there in the footnotes of their policy tomes.

But my biggest fear has been that Trump’s poisoning the well for criminal justice reform at the federal level, and Michael Grunwald shares it:

Criminal justice reform, a perennial lost cause for civil rights lefties, had its surprise bipartisan moment this year. Conservative Republican voices like anti-tax activist Grover Norquist and the Koch brothers led campaigns against mass incarceration and mandatory drug sentences. GOP presidential candidate Jeb Bush has embraced the pro-reform Right on Crime initiative, while Rand Paul and Ted Cruz have co-sponsored reform bills with liberal Democratic senators.

But the Kumbaya reform moment may not survive the Summer of Trump.

After roiling the politics of immigration with jeremiads about border walls and Mexican rapists, Donald Trump has scrambled the politics of crime by running as a pro-cop, anti-thug “law-and-order” candidate, denouncing rioters in Baltimore and Ferguson, vowing to “get rid of gang members so fast your head will spin.” And as with immigration, his rivals are echoing his appeals to the angry id of their party’s white base, distancing themselves from bipartisan reform. Bush is now touting his own “eight-year record of cracking down on violent criminals” as governor of Florida, while attacking Trump as “soft on crime” because of his past support for Democrats and marijuana decriminalization. Candidates like Cruz and the usually Koch-friendly Scott Walker are also trumpeting their toughness on criminal justice issues, blaming President Barack Obama and the Black Lives Matter movement for recent attacks on police officers. In this climate, it’s even harder than usual to imagine GOP congressional leaders bucking their base to push reform.

Trump has been dismissed as a sideshow, but for now at least, he’s the main show.

I suppose it’s possible that a Republican presidential candidate or two will decide to get attention as someone who’s “fighting” Trump on this or that issue instead of positioning him- or her-self to inherit his support when whatever it is that’s supposed to strike him down finally happens. But I wouldn’t count on it, particularly on an issue–crime–that is more viscerally immediate to angry and frightened white people than immigration.

“Challenging The Tough On Crime Craze”: Obama Administration Works On Both The Front And Back End Of Criminal Justice Reform

Recently I wrote about Evan McMorris-Santoro’s profile of Deputy Attorney General Sally Yates. In the course of describing her work on mandatory minimum sentences, he explains something interesting about the politics involved in criminal justice reform.

The divide is now between so-called front-end advocates, who want changes to sentencing laws and penalties given to criminals when they first enter the system, and so-called back-end advocates who would rather leave sentencing alone and focus on parole eligibility and anti-recidivism programs.

The politics are simple, and crucial. Front-end changes are more risky, opening up politicians to attack ads saying they favored lower sentences for criminals and reduced penalties for drug dealers. The most ardent criminal justice advocates are pushing front-end changes. Back-end changes are an easier sell politically, but have much less impact on prison populations, according to advocates. They’re usually the most favored solution by politicians who are still closely tied to the tough-on-crime model of criminal justice that produced mandatory minimums for drug crimes in the first place.

It’s important to note that while Deputy AG Yates is focused almost exclusively on ensuring that front-end changes are included in any criminal justice reform legislation, the Obama administration is not ignoring back-end reforms. For example, the ongoing work of the Clemency Initiative that has already commuted the sentences of 89 prisoners is an example of back-end changes.

Josh Mitchell and Joe Palazzolo report that the Obama administration has decided to implement another back-end reform.

The Obama administration plans to restore federal funding for prison inmates to take college courses, a potentially controversial move that comes amid a broader push to overhaul the criminal justice system.

The plan, set to be unveiled Friday by the secretary of education and the attorney general, would allow potentially thousands of inmates in the U.S. to gain access to Pell grants, the main form of federal aid for low-income college students. The grants cover up to $5,775 a year in tuition, fees, books and other education-related expenses.

They go on to explain that this will be a 3-5 year experimental study on the impact of education on recidivism rates. That is mostly due to the fact that in 1994 Congress prohibited state and federal prisoners from getting access to Pell grants, but the Dept. of Education has the authority to temporarily waive rules in order to study their effectiveness.

I’d suggest that there’s not much doubt about what the results will be.

A 2013 study by the Rand Corp. found that inmates who participated in education programs, including college courses, had significantly lower odds of returning to prison than inmates who didn’t.

It is encouraging to watch as, one by one, the reactionary policies of the war on drugs and the 90’s era “tough on crime” craze are challenged and revoked.

“Why All Americans Should Support Obama On Prison Reform”: Our Prison System Makes A Mockery Of The Justice System

Last week, Barack Obama became the first sitting U.S. president to visit federal prison. It’s a shame it took so long, because so many Americans are prisoners, and because so many former presidents probably belonged in there themselves.

Obama’s first words on prison reform last week were absolutely right: “We should not be tolerating overcrowding in prison. We should not be tolerating gang activity in prison. We should not be tolerating rape in prison — and we shouldn’t be making jokes about it in our popular culture. That’s no joke. These things are unacceptable.”

Much of the commentariat blames our prison system’s woes on the politics of “law and order” from the 1970s through the early part of the new millennium. But what Obama is asking for is “law and order” for our prisoners and prisons. He deserves bipartisan support in this.

On a philosophical level, people who think about prison conditions and sentencing issues tend to divide themselves between retributivists and rehabilitators. Backers of retributive justice believe sentences should be punishing. Rehabilitators believe the criminal justice system should aim to restore criminals to society. I agree with both of them, and think they should agree with each other. I doubt that a convict can be properly rehabilitated unless he is also punished. To punish someone for a crime is to take his moral agency seriously. Taking that agency seriously is a sign of respect not just for the victims of crime, but the perpetrators.

America’s prisons cannot possibly qualify as either punitive or rehabilitative. Instead, they are vindictive, chaotic, and degrading. A prison sentence should be the punishment in and of itself. But today, prisoners are expected to cope with unimagined and uncountable horrors. They are incentivized to join gangs. They are encouraged to commit more violence in order to avoid violence. Rape is pervasive and the threat of rape encourages prisoners to submit themselves to other violent men. There is no instance in which being plunged into barely controlled danger, or being raped, can be a just punishment.

The message a prison sentence should send to the convict is that his crime was a grave violation of a just law, and that his punishment may be unpleasant but it will habituate him to a life of simple order. At the end of paying his debt, he’ll be restored to full freedom.

Instead, our prison system makes a mockery of the justice system. It says that our laws are a joke since we certainly don’t intend to prevent them from being broken even in institutions so closely monitored by the state itself. It tells prisoners that they are human garbage, unworthy of even the most basic respect or safety. The pervasiveness of our jokes about prison rape suggest that we believe that there are some deserving victims of violent sexual assault. There are none. My colleague Pascal-Emmanuel Gobry said it well in a column denouncing prison:

Can there be anything more abject than a society whose police-procedural TV shows include prison rape jokes — and nobody is outraged? Everyone knows that it goes on. Everybody knows that it’s endemic… And we joke about it. On those grounds alone, the entire [prison] system deserves to be scrapped.

President Obama has done well to help humanize prisoners. He has emphasized that some receive unduly long or harsh punishments just for being “teenagers doing stupid things” in the absence of real help from functioning families and social institutions. His statement of empathy, that he could have ended up in prison himself, will be used cynically by his haters. It may well reek of sentimentalism even to some of his supporters. But it is a more vivid way of repeating John Bradford’s statement upon seeing a group of men led to execution: “There but for the grace of God, go I.”

There are all sorts of social, scientific, and even fiscal reasons to justify prison reform and sentencing reform. But the key to gaining momentum in this effort is to remind the public that America’s imprisoned are human beings. They may deserve punishment for their crimes, but they do not deserve to become victims of yet more crime.
