How Dare Cheney Criticize Obama For Taking Out A Terrorist
By near-universal account of those who condemn terrorism, the killing of jihadist Anwar al-Awlaki was a good thing. This was a man believed to be behind the attempted Christmas Day, 2009 bombing of a U.S. aircraft over American soil. It was a man U.S. officials say was trying to blow up American cargo planes by putting explosives into the packages on the planes, a man believed to have been hatching plans to poison fellow Americans.
Al-Awlaki was killed last week in Yemen in a drone strike, not only ridding the world of a dangerous terrorist, but depriving al-Qaeda of a powerful recruiter.
And Dick Cheney wants President Obama to apologize for it.
The irrepressible former vice president sees the killing as justified, to be sure. He’s just mad because he thinks Obama is hypocritical for criticizing what the Bush administration, in almost comically euphemistic terms, described as “enhanced interrogation techniques” used on imprisoned al Qaeda suspects. As Cheney told CNN’s State of the Union:
They’ve agreed they need to be tough and aggressive in defending the nation and using some of the same techniques that the Bush administration did. And they need, as I say, to go back and reconsider some of the criticisms they offered about our policies.
The self-centeredness of the comment is astonishing. A key al-Qaeda subject is killed, and Cheney is thinking about what it means for the reputation of the previous administration? If we’re demanding apologies here, why not demand apologies from the people who are screaming about the budget deficit now after voting for laws and wars that vastly increased the budget deficit? And the al-Awlaki killing doesn’t have anything to do with waterboarding. We don’t know whether al-Awlaki was found because of “enhanced interrogation techniques.” There are surely legitimate questions to be asked about whether and why a U.S. citizen should be targeted, either on U.S. soil or abroad. But hypocrisy isn’t the issue here.
Former President Bush has been gracious and quiet as his successor takes on the problems of the economy and national security. If Bush has disagreed with what Obama has done, he’s kept it to himself—something that is not only just good manners for a former president, but in the specific arena of national security, important to giving a sense of continuity in front of the international audience. How unfortunate that Cheney cannot behave in the same way.

Recovering The Constitution From Conservatives
Tea Party types and other conservatives talk about how they’d like their country back.
I’d like my Constitution back.
The rise of these self-proclaimed constitutional conservatives is an ominous development that has received too little notice — and too little push-back.
Until now. Under the banner of “Constitutional Progressives,” a coalition of liberal groups has begun making an important, two-part argument: first, that a progressive government agenda is consistent with constitutional values; and second, that the constitutional conservative approach represents a dangerous retrenchment of the government’s role.
This bid to “rebut the constitutional fairy tales being peddled by the Tea Party,” as Douglas Kendall of the Constitutional Accountability Center put it, could not be more timely, with the dizzying rise of Texas Gov. Rick Perry (R).
The constitutional conservative critique, as articulated by Perry, Rep. Michele Bachmann (R-Minn.) and others, goes far beyond the familiar laments about activist judges. It is, at bottom, an argument against the 20th century — specifically against the notion that the Constitution envisions and empowers a muscular federal government able to ensure that its citizens have clean air, healthy food and safe workplaces.
To grasp the radical nature of the constitutional conservative approach, consider the record of every Republican president since the New Deal.
Richard Nixon ran on the pledge of appointing “strict constructionist” judges, but he created the Environmental Protection Agency, telling Congress that “our national government today is not structured to make a coordinated attack on the pollutants which debase the air we breathe, the water we drink and the land that grows our food.” Nixon didn’t doubt — as do the modern constitutional conservatives — that environmental regulation was an appropriate and constitutional role for the federal government.
Likewise, George W. Bush inveighed against judges “legislating from the bench.” Yet he presided over the largest expansion of Medicare — the addition of a prescription drug benefit — in the history of the program and oversaw a sweeping new role for the federal government in assuring quality education by local schools. Bush didn’t question — as do the constitutional conservatives — whether these were permissible activities for the federal government.
The constitutional conservative vision is dramatically different. It sees a hobbled federal government limited to a few basic activities, such as national defense and immigration. The 10th Amendment, reserving to states the powers not granted to the federal government, would be put on steroids. The commerce clause, giving the federal government the authority to regulate commerce among the states, would be drastically diminished.
Certainly, there’s a legitimate debate about the proper role of the federal government and the scope of federal vs. state power. But that is a different argument than the one long thought settled during the New Deal: that the Constitution grants the federal government power to regulate a broad array of activities in the national interest.
The danger posed by the constitutional conservative approach is to attempt to lash together debates about what the federal government should do and what the Constitution allows it to do.
A white paper by the liberal Center for American Progress spells out the potential consequences of the constitutional conservative vision. Programs such as Social Security, Medicare and Medicaid would be deemed to exceed the federal government’s enumerated powers.
The federal government would cease to have any role in education, eliminating funding for public schools and college financial aid, and in combating poverty, ending food stamps and unemployment insurance. Laws on everything from child labor to food safety would be overturned.
None of this is likely to happen, of course, for the simple reason that most Americans don’t want it to. When Perry was pushed during a debate about the implications of his views on the constitutionality of Social Security, for example, he waved off the question as an interesting intellectual exercise.
But the emergence of the constitutional conservative argument has real-world consequences — even without a constitutional conservative in the White House. It shifts the legal debate significantly rightward, energizing and empowering conservative judges and justices. And it changes the nature of the political debate as well by narrowing the turf on which, at least in the view of some lawmakers, the federal government is deemed authorized to operate.
“This is a way to weaponize the Constitution to prevent a real debate about how the government can solve national problems,” Kendall told me.
Strong words, but the constitutional conservative vision is too extreme to continue to ignore it in the hope that it will fade on its own.

Politics Without Purpose: September 11 Should Not Be Another Media Event
It was another one of those weeks in the capital when our leaders debated matters crucial to the survival of American civilization.
Did President Obama try to upstage the Republican presidential debate by asking to address a joint session of Congress that same night? And did House Speaker John Boehner dis the president, and the presidency, by denying him that slot?
Tempted though I was to weigh in on this important matter, I decided instead to head over to the Smithsonian’s National Museum of American History, to preview a small but immensely powerful exhibit marking the 10th anniversary of the Sept. 11 attacks.
There, displayed for the first time, are sacred relics of 9/11: the crumpled piece of the fuselage where the American flag had been painted on the Boeing 757 that crashed in a Pennsylvania field, a flight-attendant call button from the plane, a window shade, a landing gear strut, and a log book with the pages intact. The exhibit is simple and raw, without glass or showcases. Some dried mud caked on an airplane seatbelt was flaking off onto a tablecloth.
Nearby is the door from a fire truck crushed at Ground Zero and the beeper of a man who died in the South Tower. There’s a Pentagon clock frozen at about the time American Airlines Flight 77 struck the complex and the phone on which Ted Olson received the last call from his wife on the doomed plane. Most poignant, perhaps, is the postcard from another passenger, written to her sister the day before the crash to give the address of a new home in which she would never live.
The spare exhibit brought back the horror of that time. But it also reminded me of the pride in what followed, the national unity and sense of purpose.
The warm feelings didn’t last long, of course, destroyed by the war in Iraq and the politicization of homeland security. By now, we have lost all sense of purpose in politics, alternately distracted by Sarah Palin’s bus tours, Anthony Weiner’s private parts, David Wu’s tiger suit, Donald Trump’s birth-certificate campaign, and Dick Cheney’s broadsides.
Obama, whose uncertain trumpet has ceased to rally even his own troops, contemplated his long-delayed jobs agenda while lounging on Martha’s Vineyard last month. His leading Republican rival for the presidency talks of treason and secession. Another challenger arranges to quadruple the size of his California home (his defense: He’s only doubling the living space). Lawmakers play games with the debt ceiling and wound the nation’s credit rating but can’t agree on anything to put Americans back to work.
The political extraneousness of the moment, in other words, is like that of early September 2001. We spent those days amusing ourselves with Gary Condit and shark attacks. President George W. Bush spent August on a record-long ranch vacation. The biggest issue under debate: stem-cell research. Warnings about Osama bin Laden were ignored while the administration obsessed over rewriting a missile treaty with Russia.
What will it require to end the drift this time? A depression? Another attack? Or is there a less painful way to regain national purpose?
“For most people,” curator David Allison told me as I toured the Smithsonian exhibit, “Sept. 11 is only a media event.” The exhibit is a modest attempt at changing that, taking that day’s ruins out of storage and rekindling memory. The lucky few who see the exhibit during its short run will be reminded that there are things more important than whether the president addresses Congress on a Wednesday or a Thursday.
Consider the simple postcard, written by Georgetown economist Leslie Whittington to her sister and brother-in-law, as Whittington, her husband and their 8- and 3-year-old daughters headed off to Australia for a sabbatical. The card, postmarked Sept. 12 at Dulles Airport, must have been mailed just before the family boarded American Flight 77. The note says, in its entirety:

A “Federal Family” Affair: Coordinated Efforts, Except At Fox News
FEMA chief Craig Fugate and National Weather Service director Jack Hayes recently wrote an op-ed about preparations for hurricane season. They noted the coordinated efforts of “the entire federal family, state, local and tribal governments, the faith-based and non-profit communities, and the private sector.”
This wouldn’t be especially interesting, except as reader J.M. noted via email, Republican media outlets are apparently worked up about the phrase “federal family.”
Here, for example, is a Fox News report that ran on Monday:
[B]efore Irene fizzled, the Obama White House wanted to make sure that Irene was no Katrina and that, in fact, the president and his aides would be seen in compassionate command of the situation.
Hence the introduction of what may be the most condescending euphemism for the national government in its long history of condescending euphemizing: “federal family.”
This new phrase was supposed to, [Fox News’ Power Play] supposes, make anxious East Coasters feel the love of a caring federal government — tender squeeze from the Department of Homeland Security, a gentle embrace from the National Oceanic and Atmospheric Administration. The phrase was a centrally distributed talking point, appearing in op-eds, press releases and statements from across the administration.
No major hurricane had hit the U.S. mainland in the Obama era, and the “federal family” had obviously been saving up a lot of new approaches to differentiate itself from the clan under President George W. Bush.
National Review’s Andrew McCarthy was also troubled by the “federal family” phrase, as was Doug Powers at Michelle Malkin’s site, though both appeared to be working from the assumptions of the Fox News report.
There’s just one problem: Fox News’ report is completely wrong and based on lazy assumptions, which could have been avoided if it had taken 30 seconds to check.
Fox News said the “federal family” phrase was “introduced” by the Obama administration, adding that it’s a “new phrase” intended to draw a distinction between Obama’s team and Bush’s. What Fox News didn’t bother to find out is that the Bush administration also used the “federal family” phrase, many times, as did the Clinton administration, many times. It simply refers to a group of federal agencies that work together on emergency response.
It’s not “new”; it wasn’t “introduced” by the Obama administration; it’s not part of a “condescending” liberal scheme to make Americans love the government; it has nothing to do with embarrassing the Bush administration, since the Bush team used the same rhetoric. Fox News just didn’t bother to get its facts straight before misleading its audience.
There’s a good reason those who rely on Fox News seem so confused, so often — they’re routinely lied to.

Austerity Versus Salvation: What Price Life?
So the big, bad storm huffed and puffed and didn’t blow all the houses in.
Reversing Katrina, on the sixth anniversary of that shameful episode in American history, the response to Irene was more powerful than Irene.
And that made some solipsistic Gothamites who missed their subways and restaurants grouchy. There is no greater abuse to New Yorkers than inconvenience.
Once the storm became “Apocalypse Not,” as The New York Post called it, there were those who accused Mayor Michael Bloomberg and Gov. Chris Christie of New Jersey of overreacting to make up for their infamous underreactions to last year’s Christmas blizzard, when Hizzoner was baking in Bermuda and the Guv was playing at Disney World in Florida with his family.
In a Wall Street Journal column, Bret Stephens suggested “a new edition of the Three Little Pigs, this one for the CYA age.”
Ordered to evacuate from his Manhattan home near the Hudson River, Stephens took his family to his parents’ wood-framed house in Connecticut, where a 50-foot elm crashed in the yard. So he went hard on the Chicken Little mayor. “What’s the wisdom of the ages,” Stephens asked, “when a mayor wants to erase the stain of mishandling last winter’s snowstorms by forcibly relocating people from his zone of responsibility to places that are somebody else’s zone of responsibility?”
Should those whose job it is to prepare for the worst be punished because the worst didn’t happen?
What determines your judgment of politicians’ reaction is what happens to you. Those washed out from North Carolina to New Jersey to Vermont don’t think government overreacted. As Mel Brooks once said, “Tragedy is when I cut my finger. Comedy is when you walk into an open sewer and die.”
Asked at a Saturday hurricane briefing about the response in relation to the debate about the role of government, Christie made it clear that saving lives was the most important thing. The Republican said he didn’t think that Democrats and Republicans were debating this: “Protecting the safety of our citizens is one of the bedrock roles of government.”
Not so bedrock for some of the Flintstones types in Washington who are now hotly debating austerity versus salvation. The impressively hands-on performances of Christie, Bloomberg and Gov. Andrew Cuomo of New York were not enough to make Tea Partiers, Republican presidential candidate Ron Paul and Republican House Majority Leader Eric Cantor root for big government against rampaging nature.
Paul, a libertarian whose scorn of government is so great that he doesn’t even want it to coordinate in natural disasters, insisted that FEMA, which he calls “a giant contributor to deficit financing,” should be shut down.
Though his state of Virginia was the epicenter of an earthquake before being hit by Irene, Cantor has insisted that additional money for cash-strapped FEMA must be offset by spending cuts, echoing his remarks in May that money sent to traumatized tornado victims in Joplin, Mo., would mean cuts somewhere else.
The callous comments about disaster relief in recent days by Cantor, Paul and, believe it or not, the disgraced former FEMA Chief Michael “Heck of a job, Brownie” Brown infuriated Bernie Sanders, the independent Vermont senator touring his inundated state. He told Carl Hulse of The Times that coming together to help on disasters “is what being a nation is about.”
In a briefing at the White House Monday, FEMA Director Craig Fugate said that the lesson of Katrina is for the federal government to “get things going earlier” and not wait until an overwhelmed state “says we’re going to need help.”
Too bad that didn’t occur to W. in 2005. He met with Gov. Kathleen Blanco of Louisiana and New Orleans Mayor Ray Nagin on Air Force One and correctly assessed that they were not up to the job but then retreated behind clinical states’ rights arguments as a great American city drowned.
In his new memoir, Dick Cheney faults Blanco for dithering and not requesting that the president federalize the response to Katrina. It’s a variation on Rummy shrugging that “You go to war with the army you have.”
Always the hard-liner, Cheney notes: “President Bush has written that he should have sent in U.S. troops earlier, which may be true, but which to my mind lets state authorities off the hook too easily.” Why save lives if you can slap bumbling Democrats around? Proving once more that he is truly delusional, Vice praised President Bush in the wake of Katrina for “reaching out to people who needed to know that their government cared about them.”
The awful hypocrisy is this: As we saw when they spent trillions trying to impose democracy on Iraq and Afghanistan, W. and Cheney believe in big government, in a strong, centralized executive power. But with Katrina, they chose not to use it.
