“The Problem Of Political Precedents”: When Failure Is Rewarded, It Encourages More Failure
In a democracy, fear is supposed to be a powerful motivator for policymakers. There’s a constant realization that there’s always another election coming, and those who want to keep their jobs – and avoid voters’ wrath – will have to be responsible stewards of the public trust.
But what if these norms start to break down? What if the incentives baked into the cake prove to be faulty?
Kevin Drum made a comment last week that struck a chord, noting that Americans seemed inclined to blame Democrats, not Republicans, “for the rising dysfunction of the federal government.”
[This] is especially galling for Democrats, but it’s a win for Republicans and yet another sign of change in the way Washington is likely to work in the future. Republicans have discovered that a sufficiently united party can obstruct everything and anything but largely escape blame for the resulting gridlock.
This lesson has not been lost on Democrats, and it bodes ill for the future regardless of who wins our next few elections.
I think that’s correct and it’s a point that’s not repeated nearly enough.
In a democratic model, the last couple of years have been a mess of historic proportions. Republicans, consciously or not, decided to roll the dice – they would ignore the 2012 election results, refuse to govern, and kill measures regardless of their merit, popular support, or bipartisan appeal. They would shut down the government. They would eschew compromise. They would ignore calls to present policy solutions of their own. They would create the least productive Congress in modern American history.
And then they would wait for the American people to give them a reward.
Which voters delivered yesterday with a lovely bow on top.
When there is no accountability in a political system, there is no incentive for even well-intentioned policymakers to behave responsibly. It seems quite twisted: an unpopular party with unpopular ideas failed miserably at basic governance, and was rewarded handsomely for its efforts. The process isn’t supposed to work this way, and yet we now know it works exactly this way.
The resulting precedent is more than a little discouraging. When failure is rewarded, it encourages more failure. When obstruction is rewarded, it encourages more obstruction. When radicalism is rewarded, it encourages more radicalism. When a refusal to compromise is rewarded, it means politicians will be led to believe they, too, should refuse to work on bipartisan solutions.
It’s not a recipe for sound governance.

“The Right Makes The Case Against Governing”: The Goal Isn’t To Advance The Nation’s Interests
Rush Limbaugh told listeners today that congressional Republicans may have a popular mandate after their midterm successes, but they “were not elected to govern.”
That’s not a typo. One of the nation’s most prominent Republican media voices wants to make one thing clear, right now, in the wake of a GOP triumph: there are those within the party who are eager to prove that Republicans can govern. And those people are wrong.
National Review, a leading conservative outlet, fleshed out a very similar argument this morning, warning their GOP allies of “the governing trap.”
The desire to prove Republicans can govern also makes them hostage to their opponents in the Democratic party and the media. It empowers Senator Harry Reid, whose dethroning was in large measure the point of the election. […]
A prove-you-can-govern strategy will inevitably divide the party on the same tea-party-vs.-establishment lines that Republicans have just succeeded in overcoming…. Even if Republicans passed this foolish test, it would do little for them. If voters come to believe that a Republican Congress and a Democratic president are doing a fine job of governing together, why wouldn’t they vote to continue the arrangement in 2016?
It’s a fascinating perspective.
1. Governing would require some compromise.
2. Compromising makes you a “hostage,” which is unacceptable.
3. Ergo, don’t try to govern.
The goal of this attitude isn’t to advance the nation’s interests, even incrementally. Rather, the argument – reaching levels of public cynicism that are truly awe-inspiring – is that the sole focus of a political party is to do nothing until that party has absolute power over all branches of government.
Danny Vinik had a good take on the piece, describing it as “indicative of how dysfunctional Washington has become.”
When most legislation could pass by majority vote and policymakers frequently crossed party lines, divided government could still enact new laws and programs. That is no longer the case. We’re rapidly entering an era where a party must control the White House, House and Senate – the latter with a filibuster proof majority – to move legislation. If you don’t control all three, then your best political and legislative strategy is not to compromise, but to play politics so that you can control all three in the future. The National Review editors have figured this out.
The question now becomes whether congressional Republicans find the argument persuasive.

“When The Pot Calls The Kettle Lazy”: Thanks To Boehner’s ‘Leadership’, Capitol Hill Has Set New Benchmarks For Ineptitude
House Speaker John Boehner (R-Ohio) hosted a lively press conference with Capitol Hill reporters yesterday – the “boner” joke won’t be forgotten anytime soon – but there was something in his opening statement that was so audacious, I’m surprised it was largely ignored.
“You know, back in 2012 the president chose politics over governing. He took the year off, got little done, and this year I’m beginning to see the same pattern of behavior. We’ve seen more and more that the president has no interest in doing the big things that he got elected to do.”
Boehner added that President Obama intends to “pack it in for the year” and “just wait for the election.”
There’s hypocritical rhetoric. There’s breathtaking hypocritical rhetoric. Then there’s rhetoric so hypocritical that it ruptures the space-time continuum.
Reasonable people can debate the merits of competing proposals or policy strategies, but for Speaker Boehner to suggest President Obama is uninterested in governing, lacks ambition, and intends to do nothing for the rest of the 2014 is so head-spinning that it’s genuinely alarming Boehner was able to say the words out loud without laughing hysterically.
Let’s briefly review reality in case it still matters. John Boehner claimed the Speaker’s gavel three years ago, and since that time, he’s racked up zero major legislative accomplishments. While Obama has at times been desperate to get something, anything, done with this Congress, Boehner has tried and failed to lead House Republicans towards anything resembling governing.
The result has been the least productive Congress since clerks started keeping track several generations ago. Thanks to Boehner’s “leadership,” Capitol Hill is establishing new benchmarks for ineptitude, giving the “do-nothing Congress” phrase an updated definition to reflect levels of ineffectiveness few thought possible before 2011.
And yet the Speaker wants to complain that Obama “got little done” after Republicans took control of the House majority.
As for the president having “no interest” in doing “big things,” this is the exact opposite of our version of reality. Obama it appears is preoccupied with doing big things – the Speaker should have listened a little closer to the State of the Union address being delivered a few feet in front of him – while Boehner has said it’s time for Americans to start expecting less. Indeed, House Republicans leaders have been quite explicit on this point, saying the GOP does not like and does not want big policy breakthroughs.
Finally, the very idea that the president intends to coast through the rest of 2014 without doing any actual work buries the needle on the Irony-o-meter because it’s House Republicans who’ve already announced, more than once, that they intend to coast through the rest of 2014 without doing any actual work.
We’ve become all too familiar with the GOP’s reliance on the “I’m rubber, you’re glue” game, but this is ridiculous.
I have no idea whether Boehner actually believes what he said yesterday. But whether the rest of us should believe his comments is clear.

“Threatened By The Armageddon Caucus”: GOP Leaders Have Given Right-Wing Members Veto Power That Impedes Governing
Are you ready for the Big Magilla of American politics? This fall, every important domestic issue could crash into every other: health-care reform, autopilot budget cuts, a government shutdown, even a default on the national debt.
If I were betting, I’d wager that we will somehow avoid a total meltdown. House Speaker John Boehner seems desperate to get around his party’s Armageddon Caucus.
But after three years of congressional dysfunction brought on by the rise of a radicalized brand of conservatism, it’s time to call the core questions:
Will our ability to govern ourselves be held perpetually hostage to an ideology that casts government as little more than dead weight in American life? And will a small minority in Congress be allowed to grind decision-making to a halt?
Congress is supposed to be the venue in which we Americans work our way past divisions that are inevitable in a large and diverse democracy. Yet for some time, Republican congressional leaders have given the most right-wing members of the House and Senate a veto power that impedes compromise, and thus governing itself.
On the few occasions when the far-right veto was lifted, Congress got things done, courtesy of a middle-ground majority that included most Democrats and the more moderately conservative Republicans. That’s how Congress passed the modest tax increases on the well-off that have helped reduce the deficit, as well as the Violence Against Women Act and assistance for the victims of Hurricane Sandy.
All these actions had something in common: They were premised on the belief that government can take practical steps to make American life better.
This idea is dismissed by those ready to shut down the government or to use the debt ceiling as a way of forcing the repeal or delay of the Affordable Care Act and passing more draconian spending reductions. It needs to be made very clear that these radical Republicans are operating well outside their party’s own constructive traditions.
Before their 2010 election victory, Republicans had never been willing to use the threat of default to achieve their goals. The GOP tried a government shutdown back in the mid-1990s, but it was a political disaster. Experienced Republicans are trying to steer their party away from the brink, the very place where politicians such as Sen. Ted Cruz (Tex.) and a group of fourscore or so House members want it to go.
Particularly instructive is the effort to repeal health-care reform. The very fact that everyone now accepts the term “Obamacare” to refer to a measure designed to get health insurance to many more Americans is a sign of how stupidly partisan we have become. We never described Medicare as “Johnsoncare.” We didn’t label Social Security “FDRsecurity.”
Tying the whole thing to Obama disguises the fact that most of the major provisions of the law he fought for had their origins among conservatives and Republicans.
The health-care exchanges to facilitate the purchase of private insurance were based on a Heritage Foundation proposal, first brought to fruition in Massachusetts by a Republican governor named Mitt Romney. Subsidizing private premiums was always a Republican alternative to extending Medicare to cover everyone, the remedy preferred by many liberals.
Conservatives even once favored the individual mandate to buy insurance, as MSNBC columnist Tim Noah pointed out. “Many states now require passengers in automobiles to wear seatbelts for their own protection,” the Heritage Foundation’s Stuart Butler said back in 1989. “Many others require anybody driving a car to have liability insurance.” Since all of us will use health care at some point, Butler argued reasonably, it makes sense to have us all in the insurance pool.
But that was then. The right wing’s recent rejection of a significant government role in ending the scandal of “a health-care system that does not even come close to being comprehensive and fails to reach far too many” — the words were spoken 24 years ago by the late Sen. John Chafee, a Rhode Island Republican — tells us why Congress no longer works.
The GOP has gone from endorsing market-based government solutions to problems the private sector can’t solve — i.e, Obamacare — to believing that no solution involving expanded government can possibly be good for the country.
Ask yourself: If conservatives still believed in what both left and right once saw as a normal approach to government, would they speak so cavalierly about shutting it down or risking its credit? This is what’s at stake in the Big Magilla.

“Placating The Pyromaniacs”: Don’t Repeal Any Laws, Repeal John Boehner And House Republicans
It would be impossible to name the craziest thing said by a Republican so far this year. This year? This week.
New entrants arrive constantly and the competition is feral. And yet paradoxically they don’t even shock anymore. But one recent Republican remark should arrest you and deserves your contemplation: John Boehner’s statement on Face the Nation Sunday that he and his House Republicans “ought to be judged on how many laws we repeal.”
It’s not an outrageous statement in the Obama-wants-to-impose-Sharia vein, but in its way it’s more disturbing. The Republican Party now sees dysfunction as not just an unfortunate consequence of a set of historical factors, something that they might work every now and again to correct. Now, the Republican Party sees dysfunction as its mission.
This, I think you’ll agree, is new. Let’s put it more emphatically. It’s absolutely new in American history. Well, there exists some precedent back in the 1840s and ’50s (also led then by reactionaries who were mostly Southern). But in our modern history, let’s say, since we solved the problem of the peculiar institution and later became the world’s most powerful nation, we’ve been a functioning democracy. There have been many moments of ugliness and sclerosis. But the particular qualities of the American system have generally produced what you could reasonably call governance.
From the start, we were not a parliamentary system, in which loyalty to the party is paramount and demanded. For a range of reasons, individual House members and especially senators have always had more autonomy than legislators in parliamentary systems do. This, along with the facts of our vast geography and diversity of interests, made our parties more flexible and ensured that cross-party ad-hoc coalitions could get laws passed.
We also had a tradition of legislative deference to the president—on foreign policy most of all, but also on domestic issues to some extent. A president’s top few priorities were always given a hearing, and compromise was usually reached. Tip O’Neill didn’t share Ronald Reagan’s priorities by a long shot, but he saw that Reagan won handily and he didn’t use the Rules Committee or any other trick to prevent the new president from enacting his agenda, though of course he did try to alter it. Even Newt Gingrich, after passing as much of his agenda as he could, sat down and talked turkey with Bill Clinton on a range of issues and struck a deal on Social Security and the budget.
I reread the above two paragraphs and I see that I sound a bit like a textbook, and a quaint one at that, one printed long ago. Certainly, the words and sentiments are irrelevant to most of the GOP members of the House. They really don’t care about any of those things. Consider this fascinating, and morbid, little fact: of the 230-odd Republican House members, fully half, 115, have served since only 2010 or 2012. They didn’t come to pass legislation. They came to burn the place down.
Boehner is handing them his trusty Bic lighter. Yes, a man wants to hold on to his job, I understand that. And yes, a speaker shouldn’t necessarily tip his hand on how he feels about an issue—immigration, say—until later in the process. But is Boehner being canny, or a coward? Virtually everything Boehner says publicly is designed to placate the pyromaniacs. And if he’s ever said anything behind closed doors designed to challenge them, they’ve kept it an awfully good secret (which would not happen; it would be leaked within seconds to ensure that he felt the lash of the Tea Partying millions).
They have brought us to a place we’ve never been before: post-governance America. Oh, they have to pass some bills to keep Social Security checks going out, defense contractors being paid, that sort of thing. But passing the minimal number of bills needed to keep the economy from crashing to Middle Earth isn’t the same thing as legislating. Or compromising. Those, they won’t do. As Jonathan Chait notes this week, their “negotiating” position with Obama is this: We’ll raise the debt ceiling for the rest of your term. All you have to do is sign the Ryan budget into law and privatize Medicare. Right.
I don’t see any way out of this. We are stuck here for years. In all likelihood, because of the 2010 gerrymandering, the Republicans are going to control the House at least until 2021. That’s eight. More. Years. And Boehner, let us not forget, is the “moderate” among those in the leadership. Say he lets an immigration vote happen and pisses them off, back to Cincinnati (Cincinnati? What am I saying? He’ll become a corporate lobbyist and buy a nice house in Leesburg.) Then we get Speaker Eric Cantor, or Speaker Paul Ryan. I have trouble envisioning what “worse” could be, but it would most certainly get worse under either of those two.
This isn’t a partisan crisis. It’s a historical crisis. And the political system can’t solve it. We need leaders from other walks of life, especially from the various branches of the business world, to stand up and say to the Republicans that dysfunction cannot be your mission. You must govern. Govern conservatively, but govern. And we need, as I’ve said before, big-dollar organizations that can boot some of these people out of office and replace them with a few Dick Lugars. We don’t need to repeal any laws. Repealing a hundred or so people is what we need.
