“McConnell’s “Three No’s” Under Fire”: No Meetings, No Hearings, No Vote
I have to admit that Senator McConnell’s ability to keep his troops of Republican Senators in line over these last seven years has been what some might call “impressive.” The plan to totally obstruct anything President Obama and Democrats attempted to do meant that he had to get Senators from traditionally blue/swing states to go along. Time after time we witnessed his ability to do that.
Shortly after the death of Justice Scalia, McConnell announced the ultimate in total obstruction tactics. He issued three “no’s” to any nominee put forward by this President: no meetings, no hearings, no vote. But on this one, he hasn’t managed to make it stick.
A quarter of Republican Senators (16) have announced that they will meet with Obama’s nominee, Judge Merrick Garland. Last week, three Senators came out in favor of holding hearings: Kirk, Collins and Moran. And now, Senator Kirk has said that he would consider voting for Garland.
Sen. Mark Kirk on Tuesday became the first Republican to say he might be willing to vote for President Obama’s nominee to the Supreme Court.
“Obviously I would consider voting for him,” the Illinois senator told reporters before he met with the nominee, Judge Merrick Garland. “That’s the whole purpose.”
While not going as far as Kirk, Senator Collins indicated something similar.
“The President, whether Republicans like him or not, is our President until next January, until Inauguration Day and it just seemed to me that there was no basis for saying that no matter who the President nominates, we were not going to consider that individual.”…
Hearings and meetings “are the best way to thoroughly understand a nominee’s views,” Collins said. “Undoubtably, there will be issues that would arise in a hearing that would provide grounds for people who don’t want to vote for Judge Garland or in those who do.”
Obviously this isn’t enough of a break in McConnell’s troop discipline to get movement on hearings – much less a vote – on Judge Garland’s nomination. But the key figure in all this is Senator Chuck Grassley, who chairs the Senate Judiciary Committee. As Steve Benen reported yesterday, he is going to extraordinary lengths in his blue/swing state of Iowa to avoid public confrontation over his position. First of all, he is not publicly announcing his speaking engagements and/or meetings with constituents. Secondly, he is only visiting staunchly conservative areas of the state where he received 80-90% of the vote in his last election. Finally, even in those areas, he is facing “tough and repeated questions over his refusal to hold hearings on a nominee to the Supreme Court.”
It is anyone’s guess about whether the “no hearings” and “no vote” portion of McConnell’s plan will hold for the next seven months. But it is clear that the Majority Leader is facing some insurrection from the troops he had previously managed to keep in line.

“The Best Of Their Options”: Why Republicans Might Actually Put Merrick Garland On The Supreme Court
Today President Obama announced that Merrick Garland is his nominee to fill the seat of the late Antonin Scalia on the Supreme Court. This pick is something of a surprise, given Garland’s reputation as a moderate, and most importantly, his age — Garland is 63, meaning he would likely spend only 10 or 15 years on the Court if he is confirmed.
Of course, he may not be confirmed, since Republicans have made clear that they will refuse to hold hearings or votes on any nominee Obama offers, and have said they’ll even refuse to meet the the nominee. Mitch McConnell reiterated that again today. So there’s a clear political strategy behind this nomination on the White House’s part.
But there’s also a way in which Garland could end up actually making it to the Court — not because the White House managed to outmaneuver Republicans, but because they decided that confirming him was the best of their options.
First, let’s look at the White House’s thinking. Of course they’re going to say that this decision was made purely on Garland’s merits, and politics never entered in to it, that Garland was picked because he’s eminently qualified, and he’s well-respected by both Democrats and Republicans. Garland may have all the admirable qualities Obama spoke of today, but it’s also true that he is the hardest pick for Republicans to oppose. He’s probably the most moderate of the names that were mentioned, and when you combine that with his age (and the fact that he’s a white man), Republicans won’t be able to say that Obama is trying to appoint some radical leftist who will pull the Court far to the left for the next 30 or 40 years.
That means that Garland is the one whose appointment most clearly portrays Republicans as obstructionists when they refuse to consider him. That will not only help Hillary Clinton when she argues that Republicans are unreasonable and irresponsible, but it will also put some vulnerable Senate Republicans in uncomfortable positions, particularly Chuck Grassley of Iowa, Mark Kirk of Illinois, Kelly Ayotte of New Hampshire, and Pat Toomey of Pennsylvania, all of whom face tough challenges in the fall. So while it may not have a transformative effect on the election, Garland’s nomination could, at least by a bit, increase the chances both that Clinton is elected president and that Democrats will be able to take back the Senate.
The White House is also probably assuming that Republicans will oppose Garland, as they’ve promised. Garland has already had a full career and this is doubtless his last opportunity to ascend to the Supreme Court, so he may have been more willing than other potential nominees to go through this process, with the small chance that he will actually be confirmed.
But might he actually be confirmed? The answer is yes. Here’s how it might happen:
1. Hillary Clinton wins in November. Given that Donald Trump looks like he will be the nominee of the Republican Party, this looks like a strong possibility.
2. Democrats take back the Senate. Democrats need a net gain of four seats in order to get to 50, which was about an even bet before; with Trump leading the Republicans, that looks even more likely.
3. Democratic Senate leaders consider eliminating the filibuster for Supreme Court nominations. If Clinton were to win, Republicans could decide that they can live with an eight-member Supreme Court for four years, and simply refuse to confirm any Clinton nominee. If they do that, and if Democrats gain a majority, the Democrats would almost certainly get fed up enough to just take the final step and eliminate the filibuster for those nominations (they already eliminated filibusters for lower-court nominations in 2013). Indeed, they’re already considering it.
4. Republicans return after the election and confirm Garland. If Clinton wins and Democrats take the Senate, Republicans will face a choice between Garland and whoever Clinton would nominate — and that person would probably be more liberal, and far younger. So Garland, a moderate who might only spend 10 or 15 years on the Court, would suddenly look like easily the best option. So before the next Senate takes office in January, Republicans would quickly confirm Garland and cut their losses.
Liberals are reacting with a decided lack of enthusiasm over Garland’s nomination, both because of his moderation and his age. For them, the best of all scenarios is that Garland’s nomination flounders, Hillary Clinton gets elected, and appoints a younger and more liberal justice. They might get their wish — if Republicans don’t figure out what’s most in their interests first.

“For The Far-Right, It’s One Leader Down, One To Go”: Emblematic Of The Larger Story About GOP Radicalization
There may be 54 Republicans in the Senate, but only one has publicly expressed support for Sen. Rand Paul (R-Ky.). That endorsement came from none other than Senate Majority Leader Mitch McConnell (R-Ky.), Paul’s grudging home-state partner.
With this support in mind, it was curious to see Kentucky’s junior senator on Fox News this morning, confronted with a simple question: do you support McConnell’s position as majority leader? Three times the Fox host asked Rand Paul for an answer, and as TPM noted this morning, three times the senator dodged.
The furthest Paul was willing to go was this faint praise for his colleague: “Well, there is no election. There is no battle going on.” In other words, Paul supports McConnell insofar as he has no other choice right now.
But for many Capitol Hill conservatives, the fact that there is “no battle going on” is precisely the problem. Far-right members have helped force House Speaker John Boehner (R-Ohio) out of Congress, and Politico reported late last week that many of these same lawmakers are equally eager – if not more so – to change Senate leaders, too.
Rep. Matt Salmon (R-Ariz.), a hardliner who frequently worked at odds with Boehner, was texting Sen. Mike Lee (R-Utah) on Friday morning to make a suggestion: “Next guy in the crosshairs is probably gonna be McConnell.” Lee, who chairs the conservative arm of McConnell’s GOP conference, texted back to doubt that conclusion.
But Salmon and many other House conservatives are unswayed.
“Mitch McConnell is infinitely worse as a leader than Boehner. He surrenders at the sight of battle every time,” Salmon said.
To the extent that reality matters, Mitch McConnell, perhaps more than any Republican in the nation, has been the embodiment of anti-Obama obstructionism. No GOP lawmaker of the Obama era has gone as far as McConnell to reject every White House proposal – regardless of merit, regardless of consequence, regardless of whether or not Republicans actually agreed with the administration.
The Kentucky senator has practically pioneered the art of mindless, knee-jerk obstructionism, relying on tactics with no precedent in the American tradition, undermining governance in ways that seemed impossible in the recent past.
But for far-right lawmakers, this record just isn’t good enough.
Boehner’s resignation “should be an absolute warning sign to McConnell,” Rep. Mick Mulvaney (R-S.C.) told Politico. He added that conservatives’ focus will now “invariably and should turn to McConnell in the Senate.”
Over the weekend, the chairman of the Republican Party of Louisiana urged McConnell to resign.
The odds of McConnell stepping down anytime soon are roughly zero. Boehner faced growing pressure from a significant faction of his own caucus, but McConnell faces sporadic pressure from Ted Cruz – whom most Senate Republicans are generally inclined to ignore. The qualitative and quantitative differences between the two GOP leaders are striking: McConnell was elected unanimously by his members, for example, while Boehner was not.
The importance of these developments isn’t the practical threat McConnell faces. Rather, the fact that the anti-McConnell push exists at all is emblematic of the larger story about GOP radicalization. The rationale behind the far-right campaign against Boehner is that he failed to beat President Obama – as if that were a credible outcome – which put him at odds with Republican expectations. As the bulls eye shifts from one end of Capitol Hill to the other, McConnell faces the same foolish, misguided complaint, his record of confrontation with the White House notwithstanding.
The Majority Leader’s position is secure, at least for the foreseeable future, but as the GOP base continues to direct its ire at party leaders, it’ll be worth watching to see how many Senate Republicans dodge as clumsily as Rand Paul did this morning.

“Gridlock Only Gets You So Far”: Voters Will Catch On To The Fact That The GOP Is Using Obstruction To Win Elections
There are three reasons that the Republicans pursue gridlock: ideological purity, hatred of President Barack Obama and because it helps them win elections. The first two they may be able to get over, but not the third.
Republicans discovered in 2010 that by opposing anything and everything of any consequence that Obama proposed, gridlock would ensue and the public’s anger and cynicism toward Washington would grow. Rallying around the tea party’s themes and the deep economic frustrations from the near depression, they swept out incumbent Democrats by the score.
Republican Senate Leader Mitch McConnell made it known that his number one goal was the defeat of Obama in 2012. That did not work out so well, but the Republicans quickly pivoted to 2014, where there was clearly fertile ground to elect more of their party. Part and parcel of this strategy was to not pass any meaningful legislation on immigration reform, job creation, education, tax reform or to improve America’s infrastructure and, finally, doing their very best to rally the base against anything having to do with government. The growing anger towards Washington and the party in control of the presidency – the Democrats – provided another windfall.
The difference now is that the anger which pollsters determined in 2010 created a majority for “standing up for principle” has now shifted to “it’s time to compromise, to get things done.” In short, voters want government to work and are sick and tired of the obstruction and gridlock.
Despite their efforts to shift blame, the Republicans now are boxed in, because it is pretty clear that they are the problem, not the party proposing solutions. Norman Ornstein and Thomas Mann, respected political analysts, have laid this out very clearly in their writings, including the book “It’s Even Worse Than It Looks.” So even if Republicans decide that the “shut the government” caucus led by Texas Sen. Ted Cruz should be hidden away in the basement of the Capitol, they are still confronted with many political players who believe they were elected by being obstructionists.
The goal of the Democrats, then, should be to revise and reinvigorate the plans to legislate and solve America’s problems and convince the voters that the Congress, controlled by Republicans, is once again blocking progress. When the Republican leadership is convinced that gridlock is now a losing game politically, they may actually change their behavior. Their rigid ideology and their hatred for Obama will give way to a new political reality – the public is on to them and, much like President Harry Truman in 1948, the “do-nothing Congress” label will be laid at their feet.
The Republicans have to confront these past six years and change their behavior. They will only do so only if it becomes crystal clear that the public understands and is sick and tired of their embracing of Washington gridlock.

“A Bid To Remain Relevant”: Rand Paul’s Flailing Search For A Hawkish Foreign Policy
Rand Paul this week derided President Obama’s approach to ISIS, then explained what he would do differently if he were president. It turned out, though, that the Republican senator from Kentucky and the president pretty much see eye to eye on the issue.
In a Time op-ed, Paul wrote that he would have “acted more decisively and strongly against ISIS” by launching airstrikes, arming the Kurdish rebels, bolstering Israel’s Iron Dome missile defense, and securing the U.S. border.
One problem: Obama has already done just that, or most of it, anyway. Obama has ordered more than 125 airstrikes in the past month against ISIS; shipped arms to Kurdish forces; provided $225 million in emergency funding for the Iron Dome; and, in the face of GOP obstructionism on immigration, eyed executive action to strengthen the border.
The only area where Paul diverges from Obama is that he would order Congress back from vacation to hear his plan. Given Congress’ apparent reluctance to take on this issue, this is the foreign policy equivalent of Vanilla Ice’s claiming that adding one more note to Ice, Ice, Baby meant he wasn’t ripping off Freddie Mercury.
Paul’s excoriation of Obama is remarkable given that only a few months ago, he explicitly defended the president and blamed ISIS’ proliferation on former President George W. Bush and his gung-ho interventionism.
“I don’t blame President Obama,” he said in a late June appearance on Meet the Press. At the same time, he threw cold water on the idea of a U.S. military intervention, saying, “I’m not so sure where the clear-cut American interest is.”
And as recently as August, Paul wrote a column arguing that hawkish interventionists had “abetted the rise of ISIS.”
On the one hand, it’s not surprising Paul is cribbing the administration’s ideas. Grandstanding aside, almost everyone is pretty much on the same page about how to handle ISIS.
But Paul’s newfound hawkishness is remarkable given his past tendency toward isolationism, which formed the heart of his unique appeal within the GOP. It was also the greatest obstacle to his winning the GOP presidential nomination in a party full of foreign policy hawks.
That dovish position grew even more problematic once Russia invaded Crimea, and once ISIS began swarming across Syria and Iraq. Though Pew last year found Americans’ appetite for foreign entanglements waning, that trend has now reversed, most sharply among Republicans.
Paul is now racing to shed the “isolationist” tag that dogged his proto-presidential candidacy. His Time op-ed even bears the none-too-subtle headline, “I am not an isolationist.”
But Paul is also spitting the same anti-interventionist lines that boosted him in the first place among his war-weary, libertarian faithful. Paul is speaking out of both sides of his mouth, and as a result his Time column reads like a bunch of flip-flopping nonsense.
Paul insists he is merely adapting: “I am not an isolationist, nor am I an interventionist,” he wrote in Time. “I look at the world and consider war, realistically and constitutionally.”
It’s certainly possible for changing circumstances to alter one’s global calculus. But they can just as easily alter one’s political calculus, too. In Paul’s case, it’s hard to see his abrupt about-face as anything but a bid to remain relevant as his party lurches rightward on foreign policy.
