“The Freedom To Provoke”: The Right To Free Speech Does Not Include The Right Not To Be Criticized
It’s still a radical document, the U.S. Constitution, no part of it more so than the First Amendment. Almost everybody’s for freedom of speech, particularly for themselves and people who agree with them. However, the part about no establishment of religion vexes True Believers of every persuasion. How can government possibly remain neutral in matters of faith?
But what really confuses people is an episode like the recent failed terrorist attack in Garland, Texas. Does our commitment to freedom of expression require that we condemn Elton Simpson and Nadir Soofi, the two self-proclaimed ISIS jihadists who got themselves shot to death during an abortive attempt to massacre participants in a well-publicized contest to draw ugly cartoon caricatures of the Prophet Mohammad?
Absolutely it does. Those two murderous dimwits got exactly what they came looking for. Although nobody’s saying so, something tells me the police officer who took them down wasn’t just the average traffic cop. That fellow would have been all over TV by now. This guy has remained anonymous. Amateurs are ill advised to get into gun battles with professionals.
But are we therefore also required to admire Pamela Geller, co-founder and president of Stop Islamization of America, the organization that sponsored the cartoon contest? No, we are not. The right to free speech does not include the right not to be criticized.
I’m glad nobody shot her. However, Geller’s actions were deliberately and characteristically provocative, coarse and contemptuous of others’ beliefs; in short, the very definition of bigotry. In the final analysis, those actions are also damaging to this country’s ability to prevail in its long twilight struggle with radical Islamic terrorism.
The amazing thing is how observers find this hard to see. Writing in his Washington Post media column, the normally sensible Erik Wemple takes issue with Geller’s critics. “And who’s being treated as the public enemy on cable?” he asks incredulously. “The woman who organized a cartoon contest.”
I’m pretty sure Wemple would take a different view of a Stormfront competition to caricature the ugliest hook-nosed rabbi.
But hold that thought.
“To her enduring credit,” Wemple adds “Fox News’ Megyn Kelly has been screaming all week about the folly of the ‘too-provocative’ crowd.”
Indeed she has. Interestingly enough, the lovely Ms. Kelly’s antagonists include Fox News luminaries Bill O’Reilly and Donald Trump, along with MSNBC’s Chris Matthews, CNN’s Jake Tapper, Republican presidential candidate Jeb Bush and others Wemple characterizes as “folded into a crouch of cowardice and rationalization.”
Megyn Kelly’s thunderous rebuttal to O’Reilly was couched in melodramatic terms Geller herself would find appropriate: “You know what else the jihadis don’t like? They hate Jews. Should we get rid of all Jews? That’s the path we’re going to go down catering to the jihadis. There’s no satisfying them.”
Holy false dichotomies, Batman! So the choices are deliberately offend the religious sensibilities of millions of peaceable Muslims or get rid of Jews?
This kind of black-and-white thinking is pretty much the stock in trade of propagandists like Geller intent upon persuading Americans that not only ISIS and al Qaeda extremists but Islam itself and Arabs in particular are terrorist enemies of the United States. All Arabs, everywhere.
The problem, argues former George W. Bush speechwriter Michael Gerson, is that the worldwide battle with Islamic fundamentalism can’t be won without Muslim allies — loyal U.S. citizens who report suspicious activities; allies and proxies who fight against violent Islamism; hundreds of millions of people around the world who repudiate Salafism by the peacefulness and tolerance of their daily lives.
When Americans engage in high-profile, attention-seeking acts of blasphemy, they are not joining U.S. military and intelligence forces at the front line; they are complicating and undermining their work.
President Obama has said much the same thing.
Things might also be different if Pamela Geller didn’t have such an extensive track record. “On her website,” reports the Jewish Daily Forward “Geller has denounced President Obama as ‘a third worlder and a coward’ who ‘will do nothing but beat up on our friends to appease his Islamic overlords’ and as ‘a muhammadan’ who “wants jihad to win.”
The Anti-Defamation League has criticized Geller for “consistently vilifying the Islamic faith under the guise of fighting radical Islam.” The British government refused to let her enter that country in 2011. She has characterized other Jews who criticize her as worse than “21st-century kapos,” a reference to Jews who served as guards in Nazi death camps.
Astonishingly, after extreme-right terrorist Anders Behring Breivik murdered 70 people at a Norwegian Labour Party summer youth camp in 2011, he credited Geller with inspiring him. She then assailed the Scandinavian left for harboring anti-Israel sentiments, posting a camp photo on her Atlas Shrugs website captioned: “Note the faces which are more Middle Eastern or mixed than pure Norwegian.”
Non-Aryan Untermenschen, Hitler would have called them.

“In Defense Of ‘Uppity-ism'”: Michelle Obama, “Rise Above The Noise”; All Black Americans Should Take Her Advice
It became clear during the 2008 presidential campaign that America was going to have some real trouble handling the prospect of a black president of the United States and a black first lady. Despite hip-hop having defined much of pop culture since the 1980s, a fist bump was all of a sudden unfamiliar: Is it a salute or a “terrorist fist jab?” Cue the disingenuous shrugs.
Coded and blatant racial insults were everywhere during that election season and haven’t abated in the seven years since. Michelle Malkin, herself a woman of color, called Michelle Obama one of her husband Barack’s “cronies of color” in her 2009 book Culture of Corruption: Obama and His Team of Tax Cheats, Crooks, and Cronies. A Fox News Channel graphic colloquially insulted the married mother of two daughters, calling her “Obama’s baby mama.” Another slur came from conservative radio host Rush Limbaugh in 2011, when in the course of lying about the public paying for presidential vacations, he charged the first lady and family with “a little bit of uppity-ism.” There are, of course, many more vitriolic examples.
“Uppity,” translated from thinly-veiled racial code, is meant to describe a black person who doesn’t know her or his place. It is as paternalistic as it is racist, meant to convey that a black person is somehow lower, in need of guidance back to the subjugated existence that makes the dominant caste more comfortable. Heaven forbid one even consider her or himself an equal. Or superior!
It’s a word I’ve been called once to my face, a few times online, and likely more behind my back. Unlike “nigger,” I’ve always felt oddly affirmed by it. It’s a term of hatred, no doubt, but someone who thinks me “uppity” considers my very existence a threat. That’s a good thing. We are threats to them and their detestable worldview, and Michelle Obama’s life, perhaps even more so than Barack’s, is a testament to this.
The first lady reminded us of these insults and slights in a commencement speech on Saturday, all in the context of facing “pressure to live up to the legacy of those who came before you; pressure to meet the expectations of others”—a fitting message for the new graduates of the historically black Tuskegee University in Alabama, where the Tuskegee Airmen, famed black military pilots of World War II, were educated while they trained at nearby Moton Field.
“As potentially the first African American first lady, I was also the focus of another set of questions and speculations; conversations sometimes rooted in the fears and misperceptions of others,” she said during her speech. “Was I too loud, or too angry, or too emasculating? Or was I too soft, too much of a mom, not enough of a career woman?”
These sorts of questions are regularly hurled at women in America, of which the first lady is an avatar of sorts. They have a special appeal to sexists seeking to challenge the manhood of the president, a job that required the kind of fortitude and strength our culture has misguidedly sought to find in a pair of testicles. But given the entirety of Michelle Obama’s experience, we have to consider these narrowing notions in the context of race.
In an essay for The Root last September about the New York Times Arts review, historian Blair L.M. Kelley reminded how deeply rooted the stereotype of the angry, emasculating black woman is:
Beginning in the early 1830s, the first ‘black women’ American audiences saw on the American stage were minstrel ‘Negro wenches.’ Using burned cork and greasepaint to blacken their skin, white men in their performances as black men and women became wildly popular in the mid-19th century. White men used crude drag along with the burned cork to mark black women as grotesque, loudmouthed, masculine and undeserving of the protections afforded to white ‘ladies’ in American society.
Michelle Obama told the graduates how out here in the world that this sort of framing may seem small in the face of those denied a house or a job because of their race, and she’s right. But I’m glad she brought them up. (Frankly, I’m always happy to see a black person in the public sphere reflect black reality, as opposed to the white stories we’ve been forced to tell and celebrate for so long.) Microaggressions like this feed the systemic, more obvious incarnations of racial discrimination. And in that light, “uppity-ism,” as Limbaugh termed it, is worth claiming for our own and defending.
“Eventually,” she told the graduates, “I realized that if I wanted to keep my sanity and not let others define me, there was only one thing I could do and that was to have faith in God’s plan for me. I had to ignore all of the noise and be true to myself—and the rest would work itself out. So throughout this journey, I have learned to block everything out and focus on my truth.” The First Lady closed by urging the graduates to “rise above the noise,” a fitting metaphor for the Tuskegee crowd.
Being deemed “uppity” signifies a specific kind of arrogance to a predominantly white power structure. For that, I embrace the term. Not as how oppressors seek to define it, but for what it literally represents: a desire to prove yourself superior to an inherently racist society and above the category they would otherwise assign you.
I’m hardly the first to do so; former National League president and baseball player Bill White used the word as a title for his frank memoir four years ago. “It’s a person, especially someone of a different color, who says, ‘Hell no’ and stands his ground,” he told the Times. It’s a crude declaration of the power of black ambition and steadfastness. Those are things I’ll never look down upon.

“Nobody’s Symbol, But Somebody’s Mother”: Toya Graham Simply Doing What Mothers Do
A few thoughts about Toya Graham, just in time for Mother’s Day.
You may not know her name, but you probably know what she did. You’ve probably seen the viral video of Graham, during last week’s unrest in Baltimore, using some rather pungent language and some open-handed smacks upside the head to pull her 16-year-old son out of the riot zone. She told CBS News he had gone there in defiance of her orders. When she saw him, dressed for mayhem in a black face mask, rock in hand, “I just lost it.”
In so doing, Graham, a single mother of six, has inadvertently become enmeshed in the ongoing shouting match between left and right. She has become a symbol — though neither side can agree on what she is a symbol of.
On the right, where many observers seem just a little too giddy over the image of a black boy being smacked, Fox “News” contributor Ben Stein called her “Rosa Parks for 2015.” It was an inane observation that minimized the legacy of Rosa Parks, but it was perfectly in line with the conservative view that says our most pressing concern in Baltimore’s unrest is “behavior” — i.e., the need to rein in lawless Negroes smashing windows and setting fires in the city.
Fact is, behavior is, indeed, our most pressing concern: but it’s the behavior of police in dealing with African-American citizens. Freddie Gray, a 25-year-old black man whom police arrested for carrying an illegal knife — a charge that is hotly disputed — somehow wound up with a partially severed spine while in their custody and died. Death seems to come with jarring frequency to unarmed black men who interact with police, something that ought to trouble us all.
The fact that some knuckleheaded black kids used the protest over Gray’s death as a pretext to riot — in other words, to behave as knuckleheaded white kids do after sports victories, sports defeats, and during last year’s pumpkin festival in Keene, NH — makes that no less true.
On the left, meantime, there is a tad too much dewy-eyed hand wringing over Graham’s resorting to violence to drag her son off the street. While conceding that her actions were “understandable and maybe even reasonable” under the circumstances, Eliyahu Federman, a columnist for USA Today, nevertheless wants you to know her parenting style was not “ideal” — whatever that means.
“Shouting and insulting teens just doesn’t work long term,” he writes. “You are more likely to positively modify teen misbehavior by calmly and maturely discussing the consequences of the misbehavior.” One struggles to imagine how a calm and mature discussion with a willful teenager might have played out at ground zero of an urban riot.
Look: that video — the hitting, the cursing — is not a pretty picture. Such tactics would never be endorsed by Parents magazine. On the other hand, the largely white and middle-class readership of that magazine likely does not live where Graham does, nor struggle with the challenges and fears she faces.
Every pundit, yours truly included, has the sometimes-regrettable habit of reducing people in the news to symbols of our own social and political concerns. But if we want to understand what she did, it might help to concede that Graham is nobody’s symbol, but somebody’s mother. As she said, she “lost it” because she feared her son might end up like Freddie Gray, another tragic police “oops.”
For most of us, that is a distant and unimaginable fear. But for some of us, it is a fear all too close and all too imaginable, a night terror that gnaws at sleep. Understand this, and that video becomes less of a mystery. When she saw her son in danger, Toya Graham waded in to save him from it — at all costs and by any means necessary.
Is that not what mothers do?

“Hillary Clinton Is Quaking In Her Boots”: Two More Candidates To Begin Doomed Runs For Presidency
What leads a man to look in the mirror and say, “I could be president of the United States”? Anybody can say they should be president, of course—after all, aren’t all your ideas the right ones?—but it takes a remarkably optimistic spirit to think that you can do what it takes to make it to the White House. Can you raise all that money, run that huge organization, out-strategize your opponents, overcome the inevitable stumbles and controversies, have the stamina and fortitude and cleverness to do it all better than anyone else, and convince the American people that you’re the one?
Somebody has to do it, of course. But if you’re a politician who last ran for office thirteen years ago, who had a relatively undistinguished record, who represents a wing of your party that no longer exists, and whom nobody ever accused of being charismatic in the first place, what makes you look in that mirror and say, “Yeah. I’m ready. Let’s do this”?
America, I give you George Elmer Pataki:
Ready to get on that train to Victorytown? No? No matter, Pataki is in New Hampshire, pressing the flesh and winning hearts and minds. And he’s not the only one with visions of electoral glory dancing through his head:
Mike Huckabee, who stepped down from his Fox News Channel show, “Huckabee,” in January, is expected to return to Fox this evening to make his 2016 presidential campaign official. Huckabee said Friday he is “moving toward” announcing a second bid for the White House.
Huckabee told reporters in Washington this morning he would make a little news on “Special Report with Bret Baier,” which airs on FNC at 6 p.m. ET.
Huckabee’s bid is, if equally destined for failure, at least a little easier to understand. Unlike Pataki, Huckabee isn’t a walking Ambien, and he’s kept in touch with the Republican electorate since his last run in 2008 by being a ubiquitous presence on radio and television. But he’s also a con artist who seems to spend most of his time devising ways to separate gullible conservatives from their money. Not only is that likely to be raised by his opponents should he actually gain any momentum in the primaries, running for president isn’t a good way to make money, at least in the short term. He already had what I assume is a lucrative career. So he must really believe he can win. After all, Huckabee is a man of fervent and sincere faith.
Maybe it’s the imperfections of the announced candidates that lead people like Pataki and Huckabee to give it a shot. After all, Jeb Bush is a Bush, Marco Rubio is a whipper-snapper, Scott Walker is untested nationally—if you were motivated enough, you could come up with a scenario in which everyone else falls and you’re left as the obvious choice. But these guys? I’m sure Hillary Clinton is quaking in her boots.

“This Is What White Supremacy Looks Like”: A Party At The Bundy Ranch, A Funeral In North Charleston
This weekend, the Bundy ranch in Nevada will host a reunion to celebrate owner Cliven Bundy’s continued lawlessness. Bundy became a hero of the far-right a year ago when his refusal to pay 20 years’ worth of federal grazing fees for his cattle—totalling $1.1 million—brought federal agents to collect, which Bundy and several hundred armed right-wing militia members repelled with a show of force. Fox News and other right-wing news outlets raced to the ranch to report on what Bundy supporters called the “Second American Revolution” and the “American Spring,” the moment when the rhetoric of “tyranny” and “totalitarianism” under President Obama would materialize into actual armed conflict against the loathsome federal government.
For anyone confused about whether a political movement which celebrates the Second Amendment and rallies around an iconography of war and rebellion is interested in actual combat against the “liberal” federal government, the Bundy affair answered any remaining questions: Yes, the prospect excites many far right-wing conservatives like nothing else. Fox News’ Sean Hannity was giddy in his initial introduction of Bundy as someone threatening a “range war” against the federal government. Fox News covered the ranch saga daily, with Bundy presented as a hero, and Hannity alone would feature Bundy on his show numerous times over the several weeks of the standoff, at times giving the rebel rancher a primetime microphone multiple times a week to rally right wingers to his cause.
Two extremists, Jerad and Amanda Miller, who traveled to Bundy’s ranch, only to be turned out, would go on to execute two Nevada police officers in June, draping the familiar Gadsden “Don’t Tread on Me” flag over the corpses and pinning a note to their government victims saying, “This is the start of the revolution.” Jerad and Amanda heard the call for a “range war” and took it upon themselves to be the vanguard of the Bundy rebellion.
In the end, the two officers were the only casualties and Bundy’s boys went home with not so much as a band-aid, as federal agents were backed down by a veritable army of militiamen. The government blinked, and Bundy was allowed to continue to flout a law he’d decided didn’t apply to him.
That, ladies and gentlemen, is white power.
And this is black vulnerability: In the intervening year since the Nevada showdown, much of America has become outraged by a series of cases of unarmed black men killed by police. The epidemic of police violence against black men has been ongoing for decades, of course, but a confluence of a new public attentiveness and video evidence in some cases has pushed the crisis into the mainstream discourse.
The latest case, the shocking murder of Walter Scott in North Charleston, SC, should be held up for comparison with the Bundy standoff. Before the video surfaced and contradicted his report, Scott’s killer, Officer Michael Slager, justified his use of deadly force by claiming that Scott gained control of Slager’s taser, thus making him a threat worthy of fatal elimination.
So the threat of a 50-year-old black man with a taser is so great that 8 shots into the back can be justified — but line up hundreds of white men on horseback and armed to the hilt with military-grade weapons, and agents of the government are powerless.
A single unarmed black man in Staten Island selling loosies is considered enough of a threat to be choked to death in broad daylight. Yet armed ex-military men protecting a criminal with high-powered rifles trained on federal agents are not enough of a threat to law and order to similarly merit the use of force.
Is that what we learn when we look at the cases? Does the specter of some imagined violent nature of black men exceed the fear stoked by white men with actual guns, actually pointed at state agents, fingers on triggers?
Or is it that the Bundy army was too much of a threat? The simmering anger on the American right since President Obama’s election has seethed just at the precipice of violence, and for Obama’s troops — as they would be viewed — to rightly fire on white people angry about taxes would have no doubt enraged extremists to a degree unseen since perhaps the 19th century. These weren’t the creepy cultists of the Waco standoff; Bundy was a hero headlining Fox News, the Drudge Report, and the other leading conservative news outlets. He would have been a martyr to Tea Partiers and the far right.
The militia and “Patriot” movements have seen “stunning growth” during the Obama years, according to the Southern Poverty Law Center, a group that tracks violent extremism. Bloodshed at the Bundy ranch could have very well sparked violence elsewhere, just as the federal sieges at Ruby Ridge and Waco during the 1990s animated the nascent militia and Patriot movements.
What lesson then have we learned from Cliven Bundy? What lesson do we learn from Walter Scott? Or Eric Garner. Or Michael Brown? Sean Bell?Oscar Grant? Amadou Diallo? Ramarley Graham? Maybe the Huey P. Newton Gun Club in Texas has the right idea. Named after Black Panther Party co-founder Huey Newton, the group takes advantage of open carry laws in the Lone Star State to patrol their neighborhoods in squads of men and women armed with assault rifles, what Newton and the Panthers did in Oakland in 1966.
But while Panther-style armed resistance might protect some victims from police violence, it’s hard to imagine it remedying the underlying problem: white supremacy and the assumption of black men as almost supernaturally dangerous. That’s why Slager’s initial story about Walter Scott would have probably sufficed, were it not for the video; the perceived threat posed by black men is that great. And it’s why Bundy’s men were permitted to point sniper rifles at state officials and still not be considered a threat worthy of elimination.
Saturday will be a day of celebration in Nevada; the day brings a funeral to North Charleston.
