“Crisis To Crisis Management”: Congress’s Continual Game of Political Chicken

The proposal from the House of Representatives to push off the debt ceiling crisis for three months came with an ironic rhetorical frame: If the Senate will, in that time frame, pass a budget, we can start facing our long-term fiscal challenges instead of managing crisis to crisis. Oh, and if they don’t pass a budget all lawmakers will stop drawing salaries.

The basic idea that crisis to crisis management is the worst form of governance for our country is right on the money: Short-term continuing resolutions and other stop-gap measures ensure inefficiency because government agencies are hamstrung by their inability to plan beyond a few months. And absolutely the Senate should present a budget that lays out a vision for how to put our country on a path towards a healthy fiscal future. But, the politics over the debt ceiling in the last three years have been a leading contributor to the culture of avoiding hard decisions in favor of incendiary rhetoric we see in Congress today.

The debt ceiling debate in the summer of 2011 spawned the so-called “super committee” and so-called “fiscal cliff.” So, in the past two years we’ve seen the creation and failure of the super committee, an underwhelming fiscal cliff deal that paired special interest tax breaks with an increase to the rates for higher income individuals, and a short delay of the looming threat of sequestration, the across the board spending cuts that were supposed to motivate the super committee—and Congress—to come together to act. In the next two months we have another opportunity to avoid the sequester and the expiration of the current continuing resolution, the bill that funded government for six months at fiscal year 2012 levels in lieu of passing actual appropriations bills. And of course a debt ceiling vote is on the horizon.

All of these crises are manufactured. Those willing to put off raising the debt ceiling to make a political point are willing to hurt our economy and our standing in the world to make that same point.

At the root of these manufactured crises are a winner-take-all approach to the disagreements between and even within the political parties. At each crisis, Democrats and Republicans demand a total victory and a grand bargain only to end up placating one another with crumbs of a bad deal and promise to revisit the issues at the next manufactured crisis. Our nation cannot afford this continual game of political chicken. We cannot afford the impact of defaulting on our debts. Policymakers need to work together and come up with reforms to spending, taxes, and entitlements. No more political theater, no more back room discussions on grand bargains. It’s time for the hard work of legislating solutions to the nation’s fiscal challenges.

“A Disturbing Sign”: Why Are Some Leading Dems Getting Soft On An Assault Weapons Ban?

In the wake of the horrific mass shooting in Newtown, Connecticut, support for re-banning assault weapons grew exponentially inside and outside of the Beltway. It’s only natural when an AR-15 is used to slaughter twenty schoolchildren and six educators, only months after another was used to shoot seventy-one people inside a movie theater.

Yesterday, Chicago Mayor Rahm Emanuel—seen as recently as 2006 recruiting pro-gun Democrats to run in House races—said that Newtown was a “tipping point, a galvanization for action.” He’s now calling for an assault weapons ban, expanded background checks, and is ordering Chicago municipal pension funds to divest from all gun manufacturers.

Indeed, it was a tipping point. Five days after the shootings, President Obama stood in the White House briefing room and explicitly called for another assault weapons ban, and Vice President Joe Biden is expected to recommend one this week. Senator Dianne Feinstein announced she’d introduce a strong bill in the Senate, and all the pieces looked to be in place.

But in the past twenty-four hours, there have been disturbing signs of pre-emptive surrender by key Democrats on the assault weapons ban.

Senate Majority Leader Harry Reid told a PBS affiliate in Las Vegas that he didn’t think the assault weapons ban could pass the House, and thus he wanted would “focus” on what could. His comments echoed many pro-gun talking points about Hollywood and violent video games, and Reid openly tried to throw cold water on the gun-control movement:

“We have too much violence in our society, and it’s not just from guns. It’s from a lot of stuff. And I think we should take a look at TV, movies, video games and weapons. And I hope that everyone will just be careful and cautious. […]

“Let’s just look at everything. I don’t think we need to point to anything now,” he said. “We need to be very cool and cautious. […]

“I think that the American people want us to be very cautious what we do. I think they want us to do things that are logical, smart, and make the country safer, not just be doing things that get a headline in a newspaper.”

On Monday, Representative Mike Thompson—appointed by House Minority Leader Nancy Pelosi to head the House’s gun violence prevention task force—also signaled surrender on the assault weapons ban, according to Politico:

Rep. Mike Thompson (D-Calif.), the chairman of the House Democrats’ gun violence task force, said the magazine ban and universal registration requirement would be far more effective than an assault weapons ban without the political cost.

“Probably the most recognizable thing you can say in this debate is ban assault weapons,” Thompson said. “But the other two issues” – forbidding high-capacity ammunition magazines and requiring universal registration for gun purchases – “those two things have more impact on making our neighborhoods safe than everything else combined. Anytime you try and prohibit what kind of gun people has it generates some concern.”

It’s not that Reid and Thompson are necessarily wrong in their political calculus—maybe an assault weapons ban can’t pass the House.

But publicly dooming the effort before it starts is self-enforcing, and repeats a Democratic proclivity that has frustrated progressives to no end: heading into negotiations and votes with a pre-compromised position.

Americans favor an assault weapons ban 58-39, according to an ABC/Washington Post poll released Monday. The president is about to stick his neck out and propose it, and then push for it in the weeks to come. Moreover, as Thompson and Reid both correctly noted, it’s the headline-grabbing issue here: rampages with assault weapons are what is driving the momentum on gun control.

Democrats would naturally be wise to push forward aggressively on the ban, as they have mostly done up to this point. If they fail, they fail. At least they’d likely be able to wrest more concessions from the GOP on background checks and high-capacity magazine bans during the legislative battle, and potentially force Republicans into a difficult vote where they would effectively be supporting military style weapons on the street.

Yet, it appears Reid and Thompson—absolutely key figures in the legislative battles in the Senate and House respectively—want to drop the assault weapons ban from the legislative agenda. It’s not yet clear that they will, but even signaling a lack of confidence is damaging to both the legislative prospects for meaningful gun control, and for public attitudes and activist motivation. And it’s not the debate demanded by what happened in Newtown.

“Their Cause Is Nonsense”: “No Labels”, A Rich Moderate Group Vows To Focus On Actual Reform Proposals, However Nonsensical

For two years, the nonprofit group “No Labels” has brought together some of the most respected and influential members of the New York and Washington political and business elite to publicly fight for a set of vague goals related to “civility” and “problem-solving.” They have, so far, failed to advance their cause, because their cause is nonsense. But they keep trying, bless their hearts. Their newest rerelaunch is underway, with some sort of conference in New York today, and their new mascots are figures hated by everyone besides people who reflexively think angering your own party is self-evidently virtuous: Former Utah Gov. John Huntsman and current Sen. Joe Manchin, D-W. Va.

So, we have a conservative Republican whom Republicans hate and a conservative Democrat whom Democrats hate. Classic No Labels!

But No Labels says they’ve heard your complaints. They claim they’re finished with promoting “centrism.” Instead of imagining themselves the arbiters of the imaginary “middle,” they will fight for real reforms that will end congressional dysfunction.

“We started off thinking there was a broad group in the middle, but quickly realized that wasn’t productive. People have very different notions of what the middle is,” said Mark McKinnon, a longtime adviser to former President George W. Bush and a No Labels founder. “So we grew beyond that, and now have strong conservative and strong liberal partisans who want to participate.”

That perspective is shared by the group’s new co-chairs — West Virginia Democratic Sen. Joe Manchin and former Republican Utah Gov. Jon Huntsman, who gave their first joint interview to Yahoo News since taking their new roles.

“It’s not about centrism, it’s about a new attitude toward the realities we face. It’s about finding Democrats and Republicans who will check their egos at the door,” said Huntsman, whose decidedly centrist run for the 2012 Republican presidential nomination flamed out early in the primary process.

That is actually refreshing to hear, from these people. No Labels is learning! I have argued before that rich self-declared “moderates” should focus on specific procedural reforms instead of spending all their time crying about Tip O’Neill and begging for civility. Of course, instead of starting big money-wasting nonprofits, they could contribute to the various existing nonpartisan think tanks and advocacy organizations already fighting for electoral and congressional reform — whoo, FairVote! — but I guess there is always room at the party.

So what’s first on the agenda? Nonpartisan redistricting? An end to the secret hold? Oh, no, it’s this gimmicky budget thing again:

Both lawmakers acknowledged that the Problem Solvers’ group wasn’t ready to bridge the partisan divide over looming crises like the coming battle over raising the nation’s debt ceiling, not to mention longer-term challenges like the solvency of Medicare and Social Security.

But they’ve coalesced around issues pertaining to the way Congress functions, like “No Budget, No Pay” legislation pushed by No Labels that would bar lawmakers from receiving a salary without passing a federal budget.

This proposal to cut off congressional pay if they don’t pass a budget has long been a cornerstone of the No Labels policy agenda. It neatly illustrates the ignorance that drives the entire campaign. “Passing a budget” is the goal, not “passing a good budget.” A budget that increased military spending while cutting anti-poverty programs would, then, be preferable to a continuing resolution maintaining current spending levels. Furthermore, the penalty is mostly symbolic and arguably destructive: Congress is full of very rich people, and cutting off their salaries only harms the members of Congress with net worths closer to those of the average Americans they ostensibly represent. This is the sort of “reform” proposal that sounds very good when a caller proposes it on talk radio, until you think about it for 10 additional minutes.

No Labels simply can’t bring themselves to end their love affair with deeply silly symbolic proposals that have nothing to do with the forces preventing Congress from “solving” real “problems.” They are pushing for filibuster reform and straight up-and-down votes on appointments — good! — but they pair those goals with incredibly silly proposals like mandatory bipartisan seating. As long as the people who can command media attention waste their time on gimmicks, actually constructive reform campaigns will continue to be sidelined and dismissed.

“Dumb And Dumber”: Congress Is Awful Because Members Spend All Day Long Talking To Rich People

Members of Congress don’t know anything about “the issues” and they spend all their time fundraising, according to both a new Huffington Post story and “an easy inference to make after observing Congress for almost any length of time.”

The HuffPo’s Ryan Grim and Sabrina Siddiqui obtained a PowerPoint presentation given to incoming Democratic freshmen legislators by the Democratic Congressional Campaign Committee, and the DCCC’s recommended schedule for House members includes four hours spent on the phone begging rich people for money and one hour spent begging rich person for money in person. This is the daily schedule.

As Kevin Drum notes, this leaves no time for studying or homework. Members rarely know much about anything, policy-wise. An unnamed member confirmed to HuffPo that these guys basically are exactly as ill-informed as you feared:

One member of Congress said that the fundraising takes up so much time that members don’t even have time to become experts on bills they sponsor. “One thing that’s always been striking to me is even the members playing a leading role on specific issues actually could not talk about the issues,” said the member, who didn’t want to be quoted by name. “They didn’t have enough knowledge on their own issues to talk about them at length. I’m probably guilty of that.” He recalled one meeting early in his career, where he brought several members together to try to hash out a compromise, just as he had done earlier as a state legislator.

“Staff members were all twitching at the discussion, because their principals were saying things that were just flat-wrong or uninformed or wondering aloud about what the industry practices really were,” he recalled. “The staff members of course had a pretty good idea. … The members were sitting around the table having a remarkably uninformed and unproductive discussion.”

This, as much as anything else, is why our Congress is both dysfunctional — legislators have no clue what they’re voting for or against most of the time — and so attentive to the priorities of the very wealthy.

Newt Gingrich completely dismantled the internal institutions that used to provide Congress with objective information and research, both because that information frequently contradicted conservative dogma and because he knew that doing so would force Congress to rely on outside (ideological) organizations for information, which would strengthen the corporate-funded policy shops and think tanks that powered the conservative movement. Now nearly everything Congress “knows” about policy comes directly from self-interested, industry-funded groups. Simultaneously, as Lorelei Kelly recently wrote, congressional staff began shrinking, which means expertise was, once again, outsourced — now, increasingly, lobbyists perform the educational function that well-versed staffers used to.

So: the constituents members of Congress have the most direct contact with, and the ones they see themselves as reliant upon to remain in office, are the ones who have the ability to write massive checks. And the people the members talk to to understand the issues are either think tank ideologues or paid representatives of industry or both.

The result is Congress as it’s been since the second Clinton term: Hundreds of dim bulbs, a couple of brilliant-but-evil guys, and a handful of dedicated and intelligent people who frequently do weird and inexplicable things like “voting for the horrible 2005 bankruptcy bill.”

The annoying thing is that the solutions to these problems are incredible simple: public financing of elections and huge increases in congressional staff budgets. But you might notice that both of those solutions involve spending more money on the government, making them non-starters in our age of bipartisan agreement that government spending is unseemly.

The alternative to constant fundraising by the members is for outside groups to take care of it for them, which is a model conservatives already sort of practice. In their “Behind the Caucus” column on Rep. Tom Cotton, an Arkansas freshman who will vote against raising the debt ceiling because he explicitly wants the United States to default, Politico’s Mike Allen and Jim VandeHei explain that Cotton won his primary because the ultra-conservative Club for Growth simply sent Cotton “a FedEx envelope full of checks that he didn’t ask for.” And that certainly saves some time. Allen and VandeHeil also note that Cotton, and his peers, explain why we are probably about to induce a recession for no reason:

Many in the media — us included — often underestimate just how conservative and how impervious to criticism and leadership browbeating these members are when appraising the chances for change in the next two years.

Hey, Mike and Jim, that’s what we’ve been saying for a while now. We’re screwed, because the people who spent thousands getting Cotton elected are the ones explaining the issues to him and his dumber peers.

“A Rigged Democracy”: In The House Of Representatives, Deck Stacked For Republicans

As a new Congress convenes, it has become an unquestioned truth among Republicans that their party has as much of a mandate as President Obama because voters returned them to power in the House.

The mantra has been intoned by John Boehner, Paul Ryan, Mitch McConnell, Newt Gingrich, Grover Norquist and many other party eminences, and there is a certain logic to saying that the voters, by giving Republicans the House, were asking for divided government.

But the claim to represent the voters’ will doesn’t add up.

The final results from the November election were completed Friday, and they show that Democratic candidates for the House outpolled Republicans nationwide by nearly 1.4 million votes and more than a full percentage point — a greater margin than the preliminary figures showed in November. And that’s just the beginning of it: A new analysis finds that even if Democratic congressional candidates won the popular vote by seven percentage points nationwide, they still would not have gained control of the House.

The analysis, by Ian Millhiser at the liberal Center for American Progress using data compiled by the nonpartisan Cook Political Report, finds that even if Democrats were to win the popular vote by a whopping nine percentage points — a political advantage that can’t possibly be maintained year after year — they would have a tenuous eight-seat majority.

In a very real sense, the Republican House majority is impervious to the will of the electorate. Thanks in part to deft redistricting based on the 2010 Census, House Republicans may be protected from the vicissitudes of the voters for the next decade. For Obama and the Democrats, this is an ominous development: The House Republican majority is durable, and it isn’t necessarily sensitive to political pressure and public opinion.

According to the Jan. 4 final tally by Cook’s David Wasserman after all states certified their votes, Democratic House candidates won 59,645,387 votes in November to the Republicans’ 58,283,036, a difference of 1,362,351. On a percentage basis, Democrats won, 49.15 percent to 48.03 percent.

This in itself is an extraordinary result: Only three or four other times in the past century has a party lost the popular vote but won control of the House. But computer-aided gerrymandering is helping to make such undemocratic results the norm — to the decided advantage of Republicans, who controlled state governments in 21 states after the 2010 Census, almost double the 11 for Democrats.

To be sure, Democrats tend to be just as flagrant as Republicans when they have the chance to gerrymander. And the Republican advantage isn’t entirely because of redistricting; Democrats have lopsided majorities in urban clusters, so the overall popular vote overstates their competitiveness in other districts. An analysis by FairVote found that nonpartisan redistricting would only partially close the gap, which comes also from the disappearance of ticket-splitting voters who elected centrist Democrats.

But the 2012 House results show the redrawing of districts to optimize Republican representation clearly had an impact. Consider three states won by Obama in 2012 where Republicans dominated the redistricting: In Pennsylvania, Democrats won just five of 18 House seats; in Virginia, Democrats won three of 11; and in Ohio, Democrats won four of 16.

Using Wasserman’s tally, Millhiser ranked districts by the Republican margin of victory and calculated that for Democrats to have won the 218 seats needed for a House majority they would have had to have added 6.13 percentage points to their popular-vote victory margin of 1.12 points.

To put the Republican advantage in perspective, Democrats could win the House only if they do significantly better than Republicans did in their landslide year of 2010 (when they had a 6.6-point advantage). That’s not impossible — Democrats did it in 2006 and 2008 — but it’s difficult. Republicans don’t have a permanent House majority, but they will go into the next several elections with an automatic head start. For many, the biggest political threat comes not from Democrats but from conservative primary challengers.

In theory, the Supreme Court could decide before then that this rigged system denies Americans fair and effective representation. But this won’t happen anytime soon. For now, Democrats need to recognize that the Republican House majority will respond only sluggishly to the usual levers of democracy.
