Rick Santorum’s “Liberty, Happiness And The Role Of Stuff”
Today’s Wall Street Journal features an op-ed in which Rick Santorum pledges that “…in my first 100 days as president, I’ll submit to Congress and work to pass a comprehensive pro-growth and pro-family Economic Freedom Agenda”. No one is more receptive than I to an “economic freedom agenda”, yet Mr Santorum’s has my bullshit detector howling like an air-raid siren.
In a recent speech at the First Redeemer Church in Cumming, Georgia, Mr Santorum said that economic policy focused on the accumulation of wealth is unhealthily concerned with “pursuing stuff”.
Property is just stuff. And America isn’t just about pursuing stuff. That’s one of the problems I have sometimes with our fellow conservatives, is that all we talk about — ‘Oh, Rick, presidential candidates just focus on stuff. Focus on taxing and spending, the economy. Don’t talk about anything else. Just focus on stuff. That’s what Americans really care about.’
Mr Santorum here is discussing rival interpretations of the idea of “liberty” and “the pursuit of happiness” in the Declaration of Independence. Though it is nonsense to think that there is any one thing that “Americans really care about”, Mr Santorum is surely right that Thomas Jefferson and his fellows in the founding 1% had more than just the accumulation of property in mind. But he is wrong that they were committed to the pre-modern Catholic interpretation of freedom and happiness Mr Santorum invoked in his speech:
America and our founders understood that if we were just a bunch of folks that cared about stuff, we have a very, very narrow view of freedom. We have a very, very narrow view of what God’s call is in our lives. Because that’s why He gave us these rights. To pursue happiness.
…..’Happiness’ actually had a different definition, ‘way back at the time of our founders. Like many words in our lexicon, they evolve and change over time. ‘Happiness’ was one of them. Go back and look it up. You’ll see one of the principal definitions of happiness is ‘to do the morally right thing.’ God gave us rights to life and to freedom to pursue His will. That’s what the moral foundation of our country is.
As a matter of historical fact, the dominant conception of happiness at the time of the founding was the empiricist hedonism of John Locke. Locke had it that we are moved by our beliefs and desires, and that the master desire is to enjoy pleasure and avoid pain. As for happiness, Locke said, “Happiness then in its full extent is the utmost Pleasure we are capable of…” “Property” almost took the place of “the pursuit of happiness” in the Declaration precisely because the founders’ notion of happiness was so materialistic. Happiness is pleasure, and property or “stuff” is such an indispensable source of pleasure and bulwark against misery that the pursuit of property and the pursuit of happiness almost come to the same thing. For Christians such as Locke, and many of the founders, it was so important to heed God’s will not so much because divine commands are inherently authoritative, but because Heaven’s promise of infinite pleasure made Christian virtue a prudent bet.
Anyway, the likes of Jefferson would have agreed that to be happy is “to do the morally right thing” only to the extent that “to do the morally right thing” is already defined in terms of conduciveness to happiness. And the idea that the point of freedom is to do God’s will would have been affirmed only to the extent that it is due to God’s will that we are constituted to seek “the utmost Pleasure we are capable of…” The big political idea of the Enlightenment is that earthly happiness, not divine authority, is the only credible moral foundation of political authority. The long and short of it is that Mr Santorum is guilty of revisionist history. One only has to remember that John Jay, the first chief justice of the Supreme Court, tried to make it illegal for Catholics to run for office in New York to get a sense of just how unlikely it is that the founders would have signed on to anything resembling Mr Santorum’s interpretation of liberty, happiness, and the role of “stuff”.
It’s no surprise, then, that Mr Santorum’s ten-point plan makes only incidental contact with economic freedom as many free-market-minded folk understand it. It may or may not be a good idea to rig our regulatory structure to make it easier for giant petrochemical companies to frack or build giant pipelines, but it’s unclear what it has to do with economic freedom. Do pipelines and fracking have something to do with God’s will in Mr Santorum’s mind?
Mr Santorum promises to “triple the personal deduction for children and eliminate the marriage tax penalty”. What does any of this have to do with economic freedom? If paying people to have children makes them more free, why don’t the childless deserve equal freedom? Because freedom is the freedom to do God’s will and God wants us to have big families? The “pro-family” elements of Mr Santorum’s plan are transparent attempts at social engineering through fiscal policy.
Mr Santorum says he’ll “cut means-tested entitlement programs by 10% across the board, freeze them for four years, and block grant them to states—as I did as the author of welfare reform in 1996.” This is unintelligible. If subsidising families through the tax code somehow adds to their freedom, then reducing subsidies to the relatively poor—to those who qualify for means-tested benefits—must logically decrease theirs. This is simply upside down. There is a compelling case that individuals require a certain material minimum to ensure that their economic liberties have real worth. If Mr Santorum’s cuts would leave Americans below that threshold, they would amount to an assault on the economic freedom of the disadvantaged.
If “economic freedom” means “a system rigged to the advantage of petrochemical companies and large middle- and upper-class families”, Mr Santorum’s proposal might have a lot to be said for it. I could be wrong, but I suspect it doesn’t really mean that.

“Fictionalized History”: Steer Clear Of Newt’s Courses
Newt Gingrich raised some eyebrows recently when he said he intends, if elected president, to teach an online course. It’s worth pausing to appreciate the fact that Gingrich’s desire to teach while holding public office isn’t new.
In the 1990s, Gingrich taught “Renewing American Civilization” at Kennesaw State College in Georgia. The course became infamous because it was at the heart of a congressional ethics investigation that led to severe penalties for the disgraced former Speaker. But back in 1995, before the ethics scandal broke in earnest, the Washington Monthly ran a piece by Allan Lichtman that scrutinized Gingrich’s skills as a history professor.
Wouldn’t you know it, Gingrich had a little trouble keeping his facts straight here, too. He taught what Lichtman described as “fictionalized history.”
The thesis of Gingrich’s course is that American history was an uninterrupted continuity of opportunity and progress from colonial times until what he calls the “breakdown” of 1965. If you read the papers, you know what comes next: That’s when the elite liberal state, aided by the counterculture, introduced the infections of dependency, bureaucracy, and failure. He’s teaching the course in part to balance out the liberal’s view of the world. Did you know, for example, that Thomas Edison “is almost never studied in the counterculture because all his values are exactly wrong? He was successful, and he was very work-oriented, he was highly creative.” […]
Gingrich’s historical selectivity and outright errors are, well, revealing. He manages to get through the entire Civil War without ever mentioning slavery. Of the Declaration of Independence, he says “They originally wrote, ‘We are endowed by our creator with certain inalienable rights, among which are life, liberty, and the pursuit of property.”’ Property? John Locke, yes. The Declaration of Independence, never.
Not surprisingly, much of Gingrich’s course is preoccupied with the history of the welfare state-the “actively destructive” welfare state, that is. He doesn’t acknowledge any of the good that government has done over the past 30 years, when federal investments in education, electrification, research, and facilities built Gingrich’s modern South.
If Freddie Mac paid Gingrich $1.8 million for to take advantage of his expertise as a “historian,” I’m afraid the mortgage giant paid too much.
If students paid anything at all to take one of one Gingrich’s courses, I’m afraid they were charged too much, too.

In Seach Of Human Liberty And Equality, The Constitution Is Inherently Progressive
Progressives disagree strongly with tea party views on government, taxation, public spending, regulations and social welfare policies. But we credit the movement for focusing public debate on our nation’s history, the Constitution and the core beliefs that shape American life.
This conversation is long overdue — and too often dominated by narrow interpretations of what makes America great.
Since our nation’s founding, progressives have drawn on the Declaration of Independence’s inspirational values of human liberty and equality in their own search for social justice and freedom. They take to heart the constitutional promise that “We the People” are the ultimate source of political power and legitimacy and that a strong national government is necessary to “establish justice, … provide for the common defense, promote the general welfare and secure the blessings of liberty.”
Successive generations of progressives worked to turn these values into practice and give meaning to the American dream, by creating full equality and citizenship under law and expanding the right to vote. We sought to ensure that our national government has the power and resources necessary to protect our people, develop our economy and secure a better life for all Americans.
As progressives, we believe in using the ingenuity of the private sector and the positive power of government to advance common purposes and increase freedom and opportunity. This framework of mutually reinforcing public, private and individual actions has served us well for more than two centuries. It is the essence of the constitutional promise of a never-ending search for “a more perfect union.”
Coupled with basic beliefs in fair play, openness, cooperation and human dignity, it is this progressive vision that in the past century helped build the strongest economy in history and allowed millions to move out of poverty and into the middle class. It is the basis for American peace and prosperity as well as greater global cooperation in the postwar era.
So why do conservatives continue to insist that progressives are opposed to constitutional values and American traditions? Primarily because progressives since the late 19th century rejected the conservative interpretation of the Constitution as an unchangeable document that endorses laissez-faire capitalism and prohibits government efforts to provide a better existence for all Americans.
Progressives rightly charge that conservatives often mask social Darwinism and a dog-eat-dog mentality in a cloak of liberty, ignoring the needs of the least well-off and the nation as a whole.
As President Franklin D. Roosevelt said in his 1944 address to Congress, “We have come to a clear realization of the fact that true individual freedom cannot exist without economic security and independence. ‘Necessitous men are not free men.’ People who are hungry and out of a job are the stuff of which dictatorships are made.”
Yet according to modern conservative constitutional theory, the entire Progressive, New Deal and Great Society eras were aberrations from American norms. Conservatives label the strong measures taken in the 20th century to protect all Americans and expand opportunity — workplace regulations, safe food and drug laws, unemployment insurance, the minimum wage, limits on work hours, the progressive income tax, civil rights legislation, environmental laws, increased public education and other social welfare provisions — as illegitimate.
Leading conservatives, like Texas Gov. Rick Perry, claim that Social Security and Medicare are unconstitutional. Sen. Mike Lee (R-Utah) even argues that national child labor laws violate the Constitution.
They lash out at democratically enacted laws like the Affordable Care Act and claim prudent regulations, including oversight of polluters and Wall Street banks, violate the rights of business.
This is a profound misreading of U.S. history and a bizarre interpretation of what makes America exceptional.
There are few Americans today who believe America was at its best before the nation reined in the robber barons; created the weekend; banned child labor; established national parks; expanded voting rights; provided assistance to the sick, elderly and poor; and asked the wealthy to pay a small share of their income for national purposes.
A nation committed to human freedom does not stand by idly while its citizens suffer from economic deprivation or lack of opportunity. A great nation like ours puts forth a helping hand to those in need. It offers assistance to those seeking to turn their talents, dreams and ambitions into a meaningful and secure life.
America’s greatest export is our democratic vision of government. Two centuries ago, when our Founding Fathers met in Philadelphia to craft the Constitution, government of the people, by the people and for the people was a radical experiment.
Our original Constitution was not perfect. It wrote women and minorities out and condoned an abhorrent system of slavery. But the story of America has also been the story of a good nation, conceived in liberty and equality, eventually welcoming every American into the arms of democracy, protecting their freedoms and expanding their economic opportunities.
Today, entire continents follow America’s example. Americans are justifiably proud for giving the world the gift of modern democracy and demonstrating how to turn an abstract vision of democracy into reality.
The advancements we made collectively over the years to fulfill these founding promises are essential to a progressive vision of the American idea. The continued search for genuine freedom, equality and opportunity for all people is a foundational goal that everyone — progressives and conservatives alike — should cherish and protect.

The World According To Clarence Thomas And Ayn Rand
The Los Angeles Times highlights some of Justice Clarence Thomas’s more extreme solo opinions, most of which seem to be rooted in this: every year Thomas has his new clerks come to his home to watch a movie—”the 1949 film version of the classic of libertarian conservatism, Ayn Rand’s The Fountainhead.”
Explains a lot, and not just his willingness to be the only (often crazy) dissenter on key cases.
Among them, he has declared that the Constitution gives states a right to establish an official religion. Prisoners, he wrote, have no constitutional right to be protected from beatings by guards. Teenagers and students have no free-speech rights at all, he said in an opinion Monday, because in the 18th century, when the Constitution was written, parents had “absolute authority” over their children.Two years ago, the court ruled that a school official could not strip-search a 13-year-old girl to look for two extra-strength ibuprofen pills. Thomas — alone — dissented, calling the search of her underwear “reasonable and justified.”
Alone, he voted to strike down a key part of the Voting Rights Act that is credited with giving blacks political power in the South. And he was the lone justice to uphold the George W. Bush administration’s view that an American citizen could be held as an “enemy combatant” with no charges and no hearing….
“He is the most radical justice to serve on the court in decades,” said Erwin Chemerinsky, dean of the UC Irvine Law School and a liberal constitutional scholar. He “would change the law dramatically and give little weight to precedent. It’s easy to overlook how radical [he is] because his are usually sole opinions that do not get attention.”
He’s the Federalist Society’s dream Justice, a true “constitutional conservative.” Ed Kilgore writes about the radicalism of the movement in reference to Michele Bachmann, but it’s applicable here.
…[C]onstitutional conservatives think of America as a sort of ruined paradise, bestowed a perfect form of government by its wise Founders but gradually imperiled by the looting impulses of voters and politicians. In their backwards-looking vision, constitutional conservatives like to talk about the inalienable rights conferred by the Founders—not specifically in the Constitution, as a matter of fact, but in the Declaration of Independence, which is frequently and intentionally conflated with the Constitution as the part of the Founders’ design. It’s from the Declaration, for instance, that today’s conservatives derive their belief that “natural rights” (often interpreted to include quasi-absolute property rights or the prerogatives of the traditional family), as well as the “rights of the unborn,” were fundamental to the American political experiment and made immutable by their divine origin….The obvious utility of the label is that it hints at a far more radical agenda than meets the untrained eye, all the while elevating the proud bearer above the factional disputes of the conservative movement’s economic and cultural factions.
On the economic side of the coin, most mainstream politicians are not going to publicly say that the monstrosities they associate with ObamaCare, “redistribution of wealth,” or Keynesian stimulus techniques are rooted in their desire to reverse the New Deal, as well as a long chain of Supreme Court decisions that also happened to make possible the abolition of segregation. But many conservative activists actually think that way, and have in mind as their goal nothing so modest as a mere rollback of federal social programs to the levels of the Bush or even the Reagan administration. Bachmann and other candidates can talk to most voters as though they are simply trying to defend America from a vast overreach by the 44th president. But to the radicalized conservative base that dominates contests like the Iowa Caucuses, the constitutional conservative label hints broadly at a more audacious agenda ultimately aimed at bringing back the lost American Eden of the 1920s, if not an earlier era.
It’s an interesting concept for Thomas to align with, given that he would have been considered only 3/5ths of a man “in the 18th century, when the Constitution was written.” Or perhaps he’s interpreting it as three out of five African-Americans being counted, and assuming he’d of course be among the three. Of course, if we returned to his preferred era of governance, he could be in prison on the basis of his marriage alone. And it’s a pretty safe bet, had so many of the laws he has dissented from so strenuously not been passed and upheld, the last place he’d find himself now is on a seat in the highest court of the land.
All of which would only be an interesting quirk of Thomas’s personality if he weren’t part of an increasingly extreme majority on the court, manifesting this hard-right, highly corporatist, and dangerous philosophy. That he’s guided by Ayn Rand should be enough to put his place on the court in question, if his ethical lapses alone weren’t enough to do so.

“In The Course Of Human Events”: The Declaration Of Interdependence
When, in the course of human events, it becomes necessary for one people to dissolve the political bonds which have connected them with another, and to assume among the powers of the earth, the separate and equal station to which the laws of Nature and of Nature’s God entitle them, a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation.
We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable rights, that among these are life, liberty and the pursuit of happiness.
Okay, the Declaration of Interdependence sounds a lot like the Declaration of Independence.
By saying that it is a self-evident truth that all humans are created equal and that our inalienable rights include life, liberty, and the pursuit of happiness, our Founding Fathers were telling us that we are all in this together, that we are interdependent, that we have a moral duty to protect these inalienable rights for all humans. President Lincoln, perhaps above all others, was instrumental in making clear that the second sentence of the Declaration was “a moral standard for which the United States should strive,” as Wikipedia puts it.
The double appeal to “Nature” — including the explicit appeal to “the laws of Nature” in the first sentence — is particularly salient. For masters of rhetoric like the authors of the Declaration, a repeated word, especially in an opening sentence, is repeated for the singular purpose of drawing attention to it (see “Why scientists aren’t more persuasive, Part 1“).
Yes, the phrase “laws of nature” meant something different to Jefferson than it does to us (see here). But as a living document, and as a modern Declaration of Interdependence, the words have grown in meaning.
It is the laws of Nature, studied and enumerated by scientists, that make clear we are poised to render those unalienable rights all but unattainable for billions of humans on our current path of unrestricted greenhouse gas emissions. It is the laws of Nature that make clear Americans can’t achieve sustainable prosperity if the rest of the world doesn’t, and vice versa.
Ironically — or perhaps intentionally — the toughest inalienable right to maintain is “the pursuit of happiness.” Certainly, the catastrophic global warming we know we face (thanks to our understanding of the laws of nature) threatens life and liberty (see “Memorial Day, 2030“).
But if we keep listening to the deniers and delayers, if we fail to sharply reverse our current emissions path nationally and globally, then we are headed toward 5°C (9°F) planetary warming by century’s end and 850+ ppm — with sea level rise of 4 to 6 feet or higher, rising perhaps a foot a decade or more for centuries, the U.S. Southwest and one third of the Earth’s habited land a permanent Dust Bowl, half or more species extinct, and much of the ocean a hot, acidic dead zone (see “Intro to global warming impacts: Hell and High Water“).
Not bloody many people will be pursuing “happiness” under those conditions. They will be desperately trying to avoid misery, when they aren’t cursing our names for betraying our moral values.
If we don’t aggressively embrace the clean energy transition starting immediately with the climate bill in front of Congress — and help lead the entire world to a similar transition — then the Ponzi scheme we call the global economy will probably be in some stage of obvious collapse by our 250th anniversary, July 4, 2026.
That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness.
And so “happiness” is repeated also, underscoring its importance to the Founders. “Life” and “Liberty” are really the very minimum we owe our fellow humans. We have a moral obligation to work toward freedom from want and care for all.
The party of Lincoln has, tragically, abandoned the values embraced and articulated by its greatest thinker and rhetorician — and those embraced and articulated by our Founders in the Declaration see (WashPost: “The GOPs climate-change denial may be its most harmful delusion”).
When is the last time a major conservative politician ever talked about “a decent respect to the opinions of mankind” except to mock the entire notion (see Gingrich sums up GOP ethos: “I am not a citizen of the world! I think the entire concept is intellectual nonsense and stunningly dangerous”).
We live in unique times. We must all hang together or we will surely all hang separately.
