“A Generation Later, Rubio Flubs ‘Morning In America'”: The Whole “Morning” Metaphor Is A Little Too Subtle For Marco
Marco Rubio’s new television ad is generating a fair amount of attention, but not for reasons his campaign will like. In the opening moments of the minute-long “morning in America” spot, viewers see a boat crossing a harbor – which wouldn’t be especially interesting except for the fact that it’s a Canadian harbor.
And while that’s obviously amusing, it’s not the only reason to pay attention to the ad.
The “morning in America” reference, of course, is not accidental. It’s a phrase many Americans, especially Republicans, will probably recognize as a signature theme of Ronald Reagan’s 1984 re-election campaign. Remember this ad from 32 years ago? For those who can’t watch clips online, here’s the script:
“It’s morning again in America. Today more men and women will go to work than ever before in our country’s history. With interest rates at about half the record highs of 1980, nearly 2,000 families today will buy new homes, more than at any time in the past four years. This afternoon 6,500 young men and women will be married, and with inflation at less than half of what it was just four years ago, they can look forward with confidence to the future. It’s morning again in America, and under the leadership of President Reagan, our country is prouder and stronger and better. Why would we ever want to return to where we were less than four short years ago?”
And now, consider the message of Rubio’s version of the same ad. Note it’s mirror-image parallels.
“It’s morning again in America. Today, more men and women are out of work than ever before in our nation’s history. People pay more in taxes than they will for food, housing, and clothing combined. Nearly 20 trillion in debt for the next generation, double what it was just eight years ago. This afternoon, almost 6,000 men and women will be married, and with growing threats and growing government, they’ll look forward with worry to the future. It’s morning again in America and under the leadership of Barack Obama and Hillary Clinton our country is more vulnerable, divided, and diminished than ever before. Why would we ever want for more years, again, of that?”
Maybe the whole “morning” metaphor was a little too subtle for Marco Rubio.
The point of Reagan’s “morning in America” was optimism. “Mornings,” as a metaphor, are about new beginnings, fresh starts, and the hopes that come with a new day and new possibilities. It’s why the Republican icon made it the theme of his re-election campaign – he wanted people to feel good about the country.
Our dreams are dying; they’re just getting started. It’s not the end of an American promise; it’s the beginning.
Rubio’s ad keeps saying “it’s morning again in America,” except the Florida senator doesn’t seem to understand that he’s using “morning” incorrectly. To hear Rubio tell it, the United States is on the verge of a dystopian nightmare as our country descends into a hellhole. Rubio’s “morning” isn’t about new beginnings and new possibilities; it’s about waking up, opening the window shade, and feeling as miserable and pessimistic as possible.
It’s as if the senator got confused, and thought “morning” and “twilight” were effectively the same thing.
This is, however, part of a pattern. For months, Rubio’s polls were stagnant when he tried to run a positive, optimistic campaign, so he decided to scrap his message and adopt Trump’s script as his own. As of a couple of months ago, Rubio began telling the public the United States is “in decline”, the American dream is “dying.”
This new commercial is a continuation of the theme. Rubio is selling crushing pessimism with a smile, assuming people won’t pay attention to the fact that he’s not pitching Reagan’s message; he’s offering the literal opposite.

“It’s Tricky Dick All Over Again”: Donald Trump Is Running For Richard Nixon’s Third Term
Conservative candidates usually beg for comparisons with Ronald Reagan, but Donald Trump’s political spirit animal is Dick Nixon.
And in true Trump fashion, he hasn’t been subtle about wearing his unfashionable influence on his sleeve. The signs are everywhere.
Travel through the primary states and you’ll see the placards plastered at events and scattered by the roadside: “The Silent Majority Stands With Trump.” That is, of course, a direct lift from Nixon’s oft-resuscitated slogan, which was meant to resonate with the “non-shouters, non-demonstrators” during the Vietnam War.
It’s no small irony that the children of these “forgotten Americans” now are being asked to rally around the ultimate shouter in American politics, a billionaire who avoided military service during the draft. The economic and cultural resentments of the white working class Nixon courted have only grown more intense in the wake of the Great Recession amid a fundamentally more diverse America led by a black president.
But lifting Nixon’s Silent Majority slogan barely scratches the surface of the debt Trump owes Tricky Dick.
In 1968, Vietnam was raging and Nixon campaigned on a “secret plan to end the war.” Now we’re embroiled in a multi-front war with ISIS and—you guessed it—Trump has offered up a secret plan to end the war against ISIS.
Days after kicking off his campaign, he told Fox News’s Greta Van Susteren: “I do know what to do and I would know how to bring ISIS to the table, or beyond that, defeat ISIS very quickly… and I’m not gonna tell you what it is… I don’t want the enemy to know what I’m doing.”
Trump’s love of bluster balanced with a complete lack of policy detail doesn’t stop with war.
Take health care: Trump is running on a platform of “repeal and replace with something terrific.” When pressed for detail by George Stephanopoulos, The Donald replied, “Nobody knows health care better than Donald Trump”—retreating to Nixon’s favored third-person self-reference. “We’re going to work with our hospitals. We’re going to work with our doctors. We’ve got to do something… We’ll work something out. That doesn’t mean single-payer.”
In Trump’s world, it doesn’t matter that he once backed single-payer in a book that bears his name. And of course it doesn’t matter that Nixon’s own health care reform plan was considerably to the left of Obamacare. Our debates have been unburdened by fact for some time now, and that suits candidates like Trump just fine.
Nixon’s enemies list is another dark legacy Trump enthusiastically apes. Trump is quick to attack critics by name on the campaign trail—from mocking a disabled New York Times reporter to going after everyone from Megyn Kelly to George Will to The Daily Beast. For a candidate who loves to engage in rough-and-tumble verbal combat, his thin skin is a bit of a mystery. But Trump’s enemies list is so notorious that Vanity Fair lampooned it back in 2011 during his birther-backed flirtation with the presidency.
While Nixon’s enemies list can seem quaint almost a half-century later, they were far from simple partisan score-settling. We now know that Nixon’s lackeys looked at planting evidence on investigative journalist Jack Anderson, spreading damaging rumors about his sex life and even plotting to kill him, with the methods varying from putting poison in his medications to smearing massive doses of LSD on his steering wheel.
This is chilling stuff that smacks more of Vladimir Putin than an American president. But it’s a reminder of how much character matters in a commander in chief, because tone comes from the top. In an era of social media mobs and hardcore partisan news sites, pushback could turn to private citizen-directed opposition research and something uglier.
The deepest irony in the Trump-Nixon overlap has surfaced only in the past few weeks, as The Donald tries to appear more presidential. “Bring Us Together” was a signature Nixon 1968 campaign line, allegedly inspired by a sign held by a little girl at a rally and eagerly adopted by speechwriters like William Safire. Now Trump is punctuating his interviews and debate performances with the same line, promising to unite the nation if elected, despite all campaign tactics to the contrary.
Trump’s use of the line has already led to some surreal exchanges, as when Stephanopoulos asked him to explain how his opposition to marriage equality after the Supreme Court decision would lead to a more united nation. “It’s very simple,” he replied. “We’re going to bring our country together. We’re going to unify our country. We’re going to do whatever we have to do. I’m going to put the absolute best judges in position. If their views—we’re going to see what their views are. I will make the determination at that time.”
Such rhetorical tap-dancing means less than nothing and offers false comfort to some increasingly resigned establishment Republicans desperately looking for a silver lining if Trump is their party’s nominee. They hope the candidate doesn’t mean half of what he says, that he’s just pandering to get conservative populist votes. It’s a strained domestic extension of Nixon’s self-described “madman theory” in foreign policy, a belief that negotiating leverage is increased if your opponent believes that you might go nuclear. Extreme statements are all part of the art of the deal.
Perhaps not coincidentally, some prominent remaining Nixon aides have been backing or advising The Donald.
Trump’s sometime adviser Roger Stone, master of the dirty trick and artful smear, boasts a Nixon tattoo on his upper back. Former Nixon speechwriter and paleo-conservative populist Pat Buchanan, who innovated many of the anti-immigrant and anti-trade policies Trump now advances, declared him “The Future of the Republican Party.”
And while Trump’s once-close relationship with Fox News chairman Roger Ailes has been publicly strained with the recent Iowa debate boycott, Ailes basically innovated the cozy relationship between politics and television while working for Nixon in 1968.
Perhaps Trump is a secret political nerd who internalized all the divide-and-conquer strategies Nixon innovated at the time. Or perhaps he’s been getting advice on the dark arts of politics from acolytes of the former master.
Trump shares with Nixon a tough-guy pragmatism, a ruthless and occasionally unhinged determination to win driven by deep insecurity. Nixon also believed people vote out of fear more than hope. But whatever Nixon’s many failings, he was a policy wonk who loved the mechanics of politics. Trump is a blunt force instrument in politics, a born marketer with bluster a mile wide and an inch deep.
As he aims for the nomination, Trump might be taking Nixon’s cynical advice to “run right in the primary election, then run to the center in the general election” to heart. But as Nixon and the nation found out, character is destiny. And Trump’s exploitation of our worse impulses for political gain will also end in tears.

“Now That It’s 2016, New Heights Of Hypocrisy”: GOP Cynicism On The Supreme Court Reaches A New Low
A spokesman for Mitch McConnell said that the Senate should confirm judicial appointees through at least the summer. The cutoff for confirming judges in an election year, known as the ‘Thurmond Rule,’ “doesn’t need to be June, especially because we’re so far behind on the legislative calendar,” he said.
Similarly, Senator Jeff Sessions (R-AL) said, “Let me say this about the Thurmond Rule. It is a myth. It does not exist. There is no reason for stopping the confirmation of judicial nominees in the second half of a year in which there is a Presidential election.”
Even a Bush spokesperson said that the “only thing clear about the so-called ‘Thurmond Rule’ is that there is no such defined rule.”
Of course, all that was in 2008, when George W. Bush was the lame-duck president and Democrats controlled the Senate.
Now that it’s 2016, and the tables are turned, McConnell has said he’d be shocked, shocked if President Obama nominated a Supreme Court justice as late as February of his final year in office.
In fact, while there’s hypocrisy on both sides of the aisle, a review of recent history reveals more of it on the Republican side.
Let’s begin at the beginning. For 166 years, Supreme Court confirmations used to be a matter of course, with rare exceptions. In the 19th century, they usually took only a few days. The current process of Judiciary committee hearings began only in 1955, in the wake of Brown vs. Board of Education, with segregationists and other conservatives outraged at the “activist” Warren Court.
The custom of not confirming judges in a presidential election year began with the avowed segregationist Strom Thurmond, who opposed LBJ’s appointment of Abe Fortas as Chief Justice back in 1968. (Notice, by the way, the “Thurmond Rule” wasn’t even about filling a vacancy – it was about moving Fortas from Associate to Chief Justice.)
Prior to that time, Supreme Court nominations in election years were par for the course. Justice Frank Murphy was nominated in 1940, Cardozo in 1932, Clarke and Brandeis in 1916, and Pitney in 1912.
But there were many reasons for conservatives to oppose Fortas. As an associate justice, he had maintained an unusually close relationship with LBJ (allegedly, Fortas helped write one of LBJ’s State of the Union speeches). There was a minor scandal involving speaking fees. There was Fortas’s religion – it was one thing to have a “Jewish seat” on the Supreme Court, but quite another to have a Jew as Chief.
But mostly, it was ideology. Fortas was a full-fledged member of the Warren Court, extending due process rights to minors, and writing the opinion that effectively banned creationism from public schools.
The tactic worked. The Fortas appointment was withdrawn, and the position of chief justice has been held by a conservative for the last 46 years (Burger, Rehnquist, Roberts).
Since then, the “Thurmond Rule” has been understood as holding that lifetime appointments of all types should not be made in the final six months of a president’s term in office.
In practice, however, the “Thurmond Rule” could best be described as the “Sore Loser’s Rule,” since it is wielded by whichever party doesn’t hold the White House at the moment. In July, 2004, Republican Senator Orrin Hatch said there was no such thing. And Republican Senator John Cornyn threatened in 2008 that if Democrats invoked the Thurmond Rule, Republicans would go nuclear: “We could require 60 votes on every single motion, bill and procedural move before the Senate,” he said at the time.
Now, it’s the Republicans’ turn to invoke the rule, and Democrats’ turn to be outraged.
But some hypocrisy is more equal than others.
First, the Thurmond Rule has never been extended back this far. In 2008, Democrats didn’t invoke it until the late summer; Senator Dianne Feinstein said it kicks in after the first party convention. It’s February now, and even the longest Supreme Court confirmation in history – that of Justice Brandeis, in 1916 – took 125 days. (Brandeis was called a “radical” and bitterly opposed by conservatives, with antisemitism even more overt than Fortas later faced.) So this would be an unprecedented expansion of the “Rule.”
Second, the ‘Rule’ has never been applied to Supreme Court vacancies. On the contrary, when President Reagan nominated Anthony Kennedy to the court, he was confirmed 97-0 on February 3, 1988, with Senator McConnell voting in favor.
Now, in fairness, Kennedy was nominated in November, 1987, after the Bork-Ginsburg controversies had left the court with eight justices for five months – seven months counting Kennedy’s confirmation. It was arguably a special case. Moreover, Kennedy was a consensus nominee who has emerged as the swing vote over the last decade precisely because he votes equally with conservatives (as in Citizens United) and liberals (as in the same-sex marriage cases).
But if no justice were confirmed now, the vacancy would be even longer: twelve months at least.
Third, the statistics cut sharply against Republicans.
According to a detailed study by the Brookings Institute, the Senate has already slowed down the pace of judicial confirmations to record levels. In the case of Reagan, Clinton, and Bush, confirmations didn’t slow down until the second half of the presidents’ eighth year in office. In their seventh years, the Senate confirmed 23, 17, and 29 judges, respectively. In Obama’s seventh year? 10.
In other words, the two-term Republican presidents fared almost twice as well as the two-term Democrat presidents, with Obama faring the worst by far.
Moreover, the “Thurmond Rule” has rarely been applied with the orthodoxy Republicans now are claiming. An exhaustive 2008 report by the non-partisan Congressional Research Service unearthed a goldmine of historical information that belies the current majority’s claims:
In 1980, the Republican-led Senate confirmed 10 out of 13 judges nominated by President Carter in September, with Senator Thurmond himself coming under fire for trying to block some of them.
In October, 1988, the Democratic-led Senate Judiciary committee led by Joe Biden confirmed 11 out of 22 of Ronald Reagan’s judicial appointees. In October, 1992, the same committee confirmed 11 of George H.W. Bush’s.
In 2000, the Republican-led Senate confirmed 31 of President Clinton’s 56 nominations. And the 2004 Senate (narrow Republican majority, Republican president) confirmed a whopping 80% of nominees—despite claims that the Democrat minority was obstructing them.
In 2008, a Brookings Institute review found that George W. Bush’s confirmation rate was 58% for circuit court nominations, 43% for district courts—in other words, roughly the same.
In short, until this one, an opposing-party Senate has never observed the Thurmond Rule. Not in 1980, not in 1988, not in 1992, not in 2000. There are typically slowdowns in confirmations, but never a standstill. And the rule has never been invoked before the summer, let alone before the cherry blossoms bloom. Perhaps unsurprisingly, we’re in new territory this year, and at new heights of hypocrisy.

“Fulfilling Their Constitutional Duties”: On SCOTUS, Pressure Falls On Endangered GOP Senators
All corners of the Republican Party have made themselves very clear: they intend to, in Donald Trump’s words, “delay, delay, delay” the confirmation of Antonin Scalia’s replacement on the Supreme Court until after the 2016 election. Ted Cruz has signaled his intention to lead a blockade, and Mitch McConnell intends to run a blockade.
All of this would be unprecedented, despite conservative protestations to the contrary. Conventional wisdom seems to suggest that McConnell can hold the Supreme Court nomination hostage for the whole year. But is that true?
It’s not necessary for the entire GOP to confirm the nominee. It only requires a few GOP Senators to join with the Democrats to fulfill their Constitutional duties. And as it turns out, there are quite a few Republican Senators in blue states who would be pilloried as intransigent obstructionists if they refused to confirm commonsense consensus nominees.
Among these Senators would be Senator Mark Kirk in Illinois, who is already Democrats’ primary target for a Senate takeover. Wisconsin’s Ron Johnson is less ideologically likely to cross the aisle, but with Russ Feingold already seeming likely to defeat him in November, it’s not clear that Johnson can afford to give Democrats yet another cudgel with which to attack him. The same goes for Senator Kelly Ayotte in New Hampshire, Pat Toomey in Pennsylvania and Rob Portman in Ohio.
President Obama will certainly nominate a number of popular, reasonable and consensus nominees, from recently confirmed Homeland Security Secretary Jeh Johnson to D.C. Circuit Court of Appeals Judge Sri Srinivasan. With each attempted and withdrawn nomination the Republican Party would look worse as a whole, but the careers of the specifically imperiled Senators would be particularly threatened–and with them the Republican Senate majority itself.
Will Ayotte, Kirk and their colleagues kowtow to McConnell and Cruz and likely eliminate their ability to hold their seats, or will they do the right thing, perform their constitutional duty and protect their Senate careers?
Time will tell.

“Sanders’ ‘Medicare For All'”: The Devil Is In The Details
Bernie Sanders is a proud and self-described socialist, a veteran Vermont senator who wants to bring some European ideas to the United States. One of those ideas is a single-payer health care system: a government-funded program in which the patient bears little to no cost. Sanders describes it as “Medicare for all.”
It’s an excellent idea. The United States is the richest country in the world, and it ought to grant every citizen guaranteed access to doctors and hospitals. That’s what Canada, Japan and the countries of Western Europe have all done.
But Sanders is vague — and his supporters quite naive — about the prospects of bringing a single-payer system to the United States. He insists that he could accomplish that in a prospective first term “if many millions of people demand it.”
Here’s the rub: They won’t — at least not in the systematic and sustained manner that would be required to bring about that sort of, well, revolutionary change to the American medical-industrial complex.
There’s a reason that the U.S. doesn’t have “Medicare for all”: politics. Do Sanders and his supporters remember the epic battle to pass the Affordable Care Act?
Democrats have been trying to pass a version of universal health care since the days of Franklin Delano Roosevelt. But conservatives have fought every proposal that would increase access for ordinary Americans, including Medicare; Ronald Reagan, then a neophyte political activist, toured the country campaigning against it.
Bill Clinton made universal health care a cornerstone of his presidential campaign in 1992, and he appointed his wife, Hillary, to head a task force to propose legislation after he won. They tried mightily to pass it, but conservatives denounced it, and the insurance industry spent millions to defeat it.
That’s why President Barack Obama brought the insurance industry on board when he started toward the Affordable Care Act. He knew he needed their support to have a prayer of passage. So the ACA preserves the business of selling health insurance through private companies.
Still, it has helped millions of families; nearly 9 million more Americans had health insurance in 2014 than the year before, according to government data. Moreover, the ACA prevents insurance companies from banning patients because they are sick and prohibits insurers from placing “lifetime caps” on the amount of money any person can collect for health care.
Would a single-payer plan have been even better? You bet. But listen to Obama’s former aide, David Axelrod, describe the difficulties of trying to pass such a proposal.
“I support single-payer health care, but having gone through health reform, we couldn’t even get a national consensus around the public option! It was Democratic votes that were ultimately missing on that issue,” Axelrod remembered. (The public option was a proposal for a government-run health insurance plan to compete with private health insurers.)
History shows that Obama and his allies spent months trying to make the ACA more palatable to conservatives to entice a few GOP votes. Actually, the mandate requiring that all adults have health insurance was originally a conservative idea. While the federal government provides subsidies to help families with modest incomes buy insurance, it doesn’t pay the full cost. (Obamacare also sets aside billions for states to expand Medicaid, but the Supreme Court made that optional, and many states have refused to expand.)
Still, the ACA did not get a single Republican vote in the end — not one. Republicans are still trying to repeal the law, taking more than 60 votes in Congress and going to the Supreme Court with challenges. Most of those Republicans will be easily re-elected to Congress.
Given recent history, it’s clear that Sanders’ plan would face very long odds — and that’s before details become clear. The Vermont senator proposes an extraordinary range of patient care — dental and vision coverage, mental health care, long-term care — while, he says, saving trillions of dollars. Many health care experts say that can’t be done, so health care spending would likely increase. You don’t have to be a conservative voter to fear where that would lead us.
If Vermont’s audacious senator has a plan for overcoming an ultraconservative GOP caucus in Congress, a right-leaning U.S. Supreme Court, and millions of voters who still flinch from the word “socialist,” he ought to lay it out. It would be quite a revolutionary plan, indeed.
