“Conservative GOP Governors Are Accepting Obamacare”: Wagging A Finger With One Hand, Holding Out The Other Hand For The Money

Many GOP governors who loudly condemned Obamacare are secretly signing up for the Affordable Care Act’s Medicaid Expansion. And they aren’t just Republicans in Democrat states. A growing number are from Southern conservative states, like Alabama and Tennessee.

Tennessee Governor Bill Haslam announced his state would oppose Obamacare, saying that he would rather have any money sent to his state go to private insurance, according to Bill Barrow with the Associated Press. But after getting reelected, Haslam announced that he had struck a deal that would allow that Medicaid expansion, according to Dave Boucher with The Tennessean.

Ditto Alabama Governor Robert Bentley, who once claimed that “the anything but Affordable Care Act has done nothing to gain our trust,” according to Tom Baxter with Saporta Report. But there was Bentley, after getting easily reelected, claiming “he could support the expansion in the form of a block grant, with a lot of strings attached,” Baxter writes.

In other red states, Republicans are doing the same, wagging a finger at Obamacare with one hand and holding out the other hand for the money. Kansas Governor Sam Brownback condemned GOP Governors for taking the Medicaid expansion money, as noted on his own website. But then, buffeted by a deficit from ill-advised tax cuts, Brownback took the money, calling it something else, in order to balance the budget, according to Salon.

It is unlikely that Representative Mike Pence cast many votes in favor of Obamacare while in Congress. But as Indiana Governor, he’s signed on to the Medicaid expansion, according to Dana Milbank from the Washington Post.

Arizona Gov. Jan Brewer joined her name to the lawsuits challenging the constitutionality of Obamacare. But then, she signed up for the dollars from Washington, DC after dodging a primary challenge, as reported by CBS.

Florida Governor Rick Scott, another Republican, had few kind words for Obama or the ACA. But once it was clear that he wouldn’t face a primary challenger, Scott took the money, according to the Miami Herald, hoping to boost his reelection chances. He was able to hold onto the Governor’s Mansion in Tallahassee as a result.

And it was Ohio Governor John Kasich who called for repealing Obamacare, well, at least most of it. Now he’s saying it is here to stay, as noted by CNN, and other Republicans better get used to it being around.

Michael Hiltzik with the Los Angeles Times is reporting that even Texas is considering the Medicaid expansion, modeled after Utah’s acceptance of the ACA plan.

There are a few reasons for this. While the House of Representatives and Senate can pass repeal after repeal votes, governors have to balance budgets. Also, many of these governors talk the conservative talk to beat back or forestall Tea Party primary challengers. Given that only a dwindling number of these are succeeding, there’s no need to kowtow to this group after reelection. They can use some creative accounting to accept the money, or call it something else so it will have a lower profile (Alabama could call it Bamacare, for example).

Of course, this is bound to infuriate the most conservative members of the Republican Party, but only if they are paying attention. Besides, this is still the party of Jeb Bush, who was linked to a firm that benefited from Obamacare, as reported by The Daily Mail. It’s also the party of Mitt Romney, whose Romneycare had many similarities to Obamacare, according to health expert Brad Burd.

“We Need Our Police To Be Better Than This”: It’s Part Of Having The Badge And The Right To Use Force

In 1951, Harry Truman fired Gen. Douglas MacArthur during the Korean War. The two never got along, but that wasn’t why Truman canned him. “I didn’t fire him because he was a dumb son of a bitch, although he was,” explained Truman after the fact. “I fired him because he wouldn’t respect the authority of the president.” You expect soldiers of all ranks to understand the need to respect the chain of command, regardless of personal feelings.

Soldiers—and cops, too.

Which is one big reason the display by members of the New York Police Department at the funeral of slain patrolman Rafael Ramos is particularly disturbing. At Ramos’s funeral service Saturday, NYPD rank-and-file—along with members of police forces attending from around the country—turned their backs when Mayor Bill de Blasio delivered his eulogy. This was a very public fuck you to a politician widely perceived by conservatives and law-and-order types as weak on crime and in the pocket of social-justice warriors. Yet the cops’ protest illustrates exactly what drives so much fear of the police: the worry that cops react emotionally and impulsively in situations that call for cool rationality and a reliance on training and strategic restraint. “It wasn’t planned,” said one of the protesters. “Everyone just started doing it.”

“I certainly don’t support that action,” said NYPD Commissioner Bill Bratton. “I think it was very inappropriate at that event.” Bratton—whom de Blasio appointed and who first served as commissioner under tough-guy Rudy Giuliani—is very much in the tradition of “Give ’em Hell” Harry Truman. Which is to say that he at times lets his emotions get the best of him, as when he spuriously implicated President Obama for strained relations between police and citizens, saying that cops feel as if they “are under attack from the federal government at the highest levels.”

But if de Blasio is in fact soft on crime, he made an exceedingly strange choice in tapping Bratton, credited with helping drive crime down in ’90s New York under Giuliani and in 21st-century Los Angeles, to lead the NYPD. As a cop’s cop, Bratton is in the best possible situation to restore respect for authority among New York’s finest.

The NYPD—and cops more generally—have a public relations problem in the wake of the Michael Brown, Eric Garner, and a long string of other cases. Acting like a bunch of high-school jocks protesting a ban on keg parties isn’t exactly going to win over many hearts and minds. It’s exactly the inability of the cops who killed Garner to restrain themselves that bothered so may of us who watched the video of the encounter. The same goes for the hysterical overreaction and escalation of force used against protesters in Ferguson over the summer.

Yes, cops are under stress and tension (though their jobs are far less dangerous than normally supposed). But they are trained to rise above mere emotional responses; that’s one of the reasons they are given a state-sanctioned monopoly on force. Yet even after the funeral protest, de Blasio was booed and heckled while addressing a new class of recruits as well.

That’s not the worst of it. In the wake of the murders of Ramos and Liu, the head of the Patrolmen’s Benevolent Association, Patrick Lynch, immediately issued a statement claiming that “there’s blood on many hands tonight” and “that blood on the hands starts at City Hall in the office of the mayor.” In fact, Ramos and Liu were killed by deranged gunman Ismaaiyl Brinsley, a career criminal who shot his girlfriend in Baltimore, drove to New York, and bragged about “putting wings on pigs.”

I’m no de Blasio partisan, but the mayor’s willingness to entertain the notion that Eric Garner needn’t have died in police custody has about as much to do with the murders of Ramos and Liu as Sarah Palin’s defense of the Second Amendment had to do with madman Jared Loughner’s shooting of Gabby Giffords. Which is to say: nothing.

The New York Post reports that an email circulating among the NYPD declares, “We have… become a ‘wartime’ Police Department… We will act accordingly.” The email further advised that “two units are to respond to EVERY call,” regardless of the severity of the situation or “the opinion of the patrol supervisor,” a tactic that, the Post notes, not only bucks the chain of command but would “effectively cut in half the NYPD’s patrol strength.”

Prior to the killing of Ramos and Liu, the last time an NYPD cop was ambushed in such a way was in 1988; their deaths were the first in the line of fire since 2011. Yet the email references the 1970s, “when police officers were ambushed and executed on a regular basis.” We normally associate such massive displays of overreaction with pearl-clutching undergraduates calling for “trigger warnings” when faced with reading The Great Gatsby.

Echoing Truman talking about MacArthur, Bratton has said that it was wrong for cops to disrespect de Blasio at the Ramos service because “he is the mayor of New York [and] he was there representing the citizens of New York to express their remorse and their regret at that death.” The police commissioner is sitting down with the unions representing the NYPD rank and file to work through issues that range “far beyond race relations in this city” and include contract disputes about pay, benefits, and more (these latter issues suggest that police outrage at city leaders may be as much a negotiating tactic as in-the-moment reactions).

Based on the responses so far by the Patrolmen’s Benevolent Association and the cops themselves, those won’t be pleasant conversations. But Bratton himself has granted that black people “of all classes” have told him they fear the police. Such attitudes join the growing discomfort with militarized police who always seem ready to escalate force and refuse to acknowledge any culpability when things go wrong.

As Bratton and the NYPD start talking among themselves, the commissioner will do well to paraphrase another Trumanism: “The buck stops here.” The police cannot ultimately control public opinion unilaterally. What they can do, though, is acknowledge that a change in their attitudes, behavior, policies, and willingness to engage in discussions about how people see them can help them win back the public trust.

“Blinded By Tribalism, Threatening Public Safety”: The NYPD’s Insubordination—And Why The Right Should Oppose It

In New York City, “NYPD traffic tickets and summonses for minor offenses have dropped off by a staggering 94 percent following the execution of two cops,” the New York Post reports, attributing the “virtual work stoppage” to rank-and-file police officers who “feel betrayed by the mayor and fear for their safety.”

The statistics cited suggest significant solidarity among cops. Overall arrests rates fell 66 percent “for the week starting Dec. 22 compared with the same period in 2013, stats show. Citations for traffic violations fell by 94 percent, from 10,069 to 587, during that time frame. Summonses for low-level offenses like public drinking and urination also plunged 94 percent—from 4,831 to 300. Even parking violations are way down, dropping by 92 percent, from 14,699 to 1,241.”

As a ploy in contract negotiations, this tactic may prove effective, but it puts the NYPD in an unenviable position with respect to explaining what happens next. If this significant work slowdown has basically no effect on the safety of New York City, the NYPD’s prior policing will appear to have been needlessly aggressive, and the case for deploying more cops on the street in the future will be undermined. Scott Shackford zeroes in on this line from the Post article: “… cops were turning a blind eye to some minor crimes and making arrests only ‘when they have to’ since the execution-style shootings of Officers Rafael Ramos and Wenjian Liu.”

He riffs:

Well, we can only hope the NYPD unions and de Blasio settle their differences soon so that the police can go back to arresting people for reasons other than “when they have to.” The NYPD’s failure to arrest and cite people will also end up costing the city huge amounts of money that it won’t be able to seize from its citizens, which is likely the real point. That’s the “punishment” for the de Blasio administration for not supporting them. One has to wonder if they even understand, or care, that their “work stoppage” is giving police state critics exactly what they want—less harsh enforcement of the city’s laws.

That’s how some policing reformers see it. Others, like me, don’t object to strictly enforcing laws against, say, public urination, traffic violations, or illegal parking, but would love it if the NYPD stopped frisking innocents without probable cause or even reasonable suspicion, needlessly escalating encounters with civilians, and (especially) killing unarmed people, goals that are perfectly compatible with data-driven policing that targets actual disorder. Keep squeegee men at bay—and leave innocent black and Hispanic men alone.

What if the “broken windows” theory is correct and the work slowdown causes an increase in disorder and thus more serious crime? The NYPD will have put the safety and perhaps even the lives of New Yorkers in jeopardy to punish a politician for purportedly disrespecting them. Such a course might succeed in decreasing de Blasio’s popularity. But the public is unlikely to think that willfully putting New Yorkers in jeopardy to settle a political score is a forgivable tactic. It is certainly at odds with the notion that NYPD officers represent “New York’s finest,” heroes who willingly sacrifice themselves to protect and serve.

Due to de Blasio’s progressive politics and the political right’s reflexive “law and order” alliance with police, many conservatives are siding with the NYPD in its standoff with de Blasio. AlterNet reports that it has emails “revealing plans to organize a series of anti-de Blasio protests around the city” that are “billed as a non-partisan movement in support of ‘the men and women of the NYPD'” but actually orchestrated “by a cast of NYPD union bosses and local Republican activists allied with Rudy Giuliani.” The first rally is planned for January 13.

The right should greet it with the skepticism they’d typically summon for a rally on behalf of government workers as they seek higher pay, new work rules, and more generous benefits. What’s unfolding in New York City is, at its core, a public-employee union using overheated rhetoric and emotional appeals to rile public employees into insubordination. The implied threat to the city’s elected leadership and electorate is clear: Cede leverage to the police in the course of negotiating labor agreements or risk an armed, organized army rebelling against civilian control. Such tactics would infuriate the right if deployed by any bureaucracy save law enforcement opposing a left-of-center mayor.

It ought to infuriate them now. Instead, too many are permitting themselves to be baited into viewing discord in New York City through the distorting lens of the culture war, so much so that Al Sharpton’s name keeps coming up as if he’s at the center of all this. Poppycock. Credit savvy police union misdirection. They’re turning conservatives into their useful idiots. If the NYPD succeeds in bullying de Blasio into submission, the most likely consequence will be a labor contract that cedes too much to union negotiators, whether unsustainable pensions of the sort that plague local finances all over the U.S., work rules that prevent police commanders from running the department efficiently, or arbitration rules that prevent the worst cops from being fired. Meanwhile, Al Sharpton will be fine no matter what happens. Will the law-and-order right remain blinded by tribalism or grasp the real stakes before it’s too late? Look to National Review and City Journal before laying odds.

“Southern GOP Politics”: Steve Scalise’s David Duke Scandal Says More About Republicans Than The Party Will Ever Admit

If you happen upon an end-of-the-year list of 2014’s biggest political bombshells, chances are Eric Cantor’s primary-election defeat to a right wing-backed neophyte named David Brat will make the cut. Because it took basically all of Washington by surprise, it has embedded itself in the psyche of the political establishment over the last six months as a seminal event. And for the last six months, I’ve been an evangelist for the theory that, while surprising, Cantor’s defeat ultimately proved to be pretty inconsequential.

In the end I was wrong, but not for the reasons everyone still reflecting on that story predicted back in June. Republican policy hasn’t moved substantially to the right since then. The hardline flank of the Republican Party is no more influential now than it was before. If anything, GOP leaders have become more willing and better equipped to tamp down rebellions than they were earlier this year.

But by beating Cantor, Brat shook up the leadership hierarchy in the House, and spooked the remaining leaders into welcoming one of those hardliners into their ranks as a token. That token was Steve Scalise, the Louisiana conservative who copped this week to addressing a David Duke–founded neo-Nazi group in 2002, after a local blogger found evidence of his participation, which had gone unnoticed for a decade, lying in plain sight on a prominent white supremacist website.

Scalise may survive this revelation. But another shakeup could be in the offing, and there lies the potential for real conflict among House Republicans. As an emissary to conservatives, Scalise represented a compromise between figures with closer ties to the leadership and more rebellious backbench members. If he has to be removed for this reason, leadership will feel burned and so will the right.

But the more important issue is what happened back in 2002, and what it says about Republican politics, especially in the South.

If more details emerge, and it turns out Scalise was closer to white hate groups than he’s let onif he knew his audience and was speaking their languagehe’s finished. But on the whole, and in a strange way, that might be a better outcome for the party than if Scalise muddles through, claiming ignorance.

Let’s assume that Scalise is telling the truththat poor staffing explains his participation, and that he rushed in and out of the event too quickly to realize what was up, or that he was led into the hotel conference center blindfolded, ears plugged, and fled the scene the moment his remarks concluded.

There’s a problem with southern Republican politics if an up-and-coming star stumbles heedless into a white supremacist convention in the course of his constituent outreach, and then doesn’t notice the mistake for more than a decade.

Conservatives have compared the Scalise revelation unfavorably to Chris McDaniel’s neo-confederate sympathies, which establishment Republicans happily deployed against him when he was poised to topple an incumbent senator in Mississippi; and to the Klan-curious comments that got Trent Lott, another Mississippian, ousted from Senate leadership in 2001.

But whether Scalise’s transgressions are worse than McDaniel’s and Lott’s is a subjective and unnecessary question. The appropriate question, whether Scalise stays or goes, is, Why does this kind of thing happen at all? Conservatives are much less interested in that kind of introspection than in making tu quoque allusions to Robert Byrd and New Black Panthers. But that’s because they’re confusing a structural argument for an ad hominem attack, and responding in kind.

White identity has always driven politics in the South, but where it once propelled Democrats to power, it now, with less outward vitriol, helps elect Republicans. The Byrd reference is unintentionally appropriate for this reason. In the last years of his life, Byrd became the exception that proved the rule. Whites fled the Democratic Party hastily, and it is now virtually impossible for white Democratic candidates to win statewide elections in the deep South (or even in Byrd’s West Virginia). But whites didn’t abandon Democrats because white identity politics changed; they abandoned Democrats because Democrats stopped reflecting the interests of those politics. And white voters aligned with Republicans because Republicans took up their mantle.

Today, that is mostly reflected in conservative rhetoric and Republican social policy, less in visible allegiance between politicians and white supremacists. Things aren’t as bleak as they once were. Under fire, and with 12 years of separation, Scalise and his staff are unafraid to denounce Duke and his hate group. Back in 1999, when Duke was considering a run for Congress, Scalise wasn’t able to be so blunt. “The voters in this district are smart enough to realize that they need to get behind someone who not only believes in the issues they care about, but also can get elected. Duke has proven that he can’t get elected, and that’s the first and most important thing.”

There’s a generous and an ungenerous way to read that statement. But the generous read isn’t particularly exculpatory. Presumably Scalise wasn’t offering voters a delicate assurance that he or another Republican would submerge their white supremacism more skillfully than Duke. But if in 1999 you said “the first and most important thing” about Duke wasn’t his despicable racism, but merely that he couldn’t get elected, it says something important about the voters you were trying not to offend. Many of those voters are still alive today.

“To A Healthier Democracy”: Ending Armageddon

Meg Greenfield, the late Post editorial page editor, counseled against writing in “High C” all the time. By this she meant that an editorialist or columnist who expressed equally noisy levels of indignation about everything would lack credibility when something truly outrageous came along that merited a well-crafted high-pitched scream.

We now seem to be living in the Age of High C, a period when every fight is Armageddon, every foe is a monster, and every issue is either the key to national survival or the doorway to ruin.

This habit seems especially pronounced in the way President Obama’s adversaries treat him. It’s odd that so many continue to see Obama as a radical and a socialist even as the Dow hits record levels and the wealthy continue to do very nicely. If he is a socialist, he is surely the most incompetent practitioner in the history of Marxism.

The reaction to Obama is part of a larger difficulty that involves pretending we are philosophically far more divided than we are. In all of the well-off democracies, even people who call themselves socialists no longer claim to have an alternative to the market as the primary creator and distributor of goods and services. The boundaries on the left end of what’s permissible in the public debate have been pushed well toward the center. This makes the hysteria and hyperbole all the more incomprehensible.

But let’s dream a little and assume that the American left signed on to the proposals put forward by Lane Kenworthy of the University of California-San Diego in his challenging (and, by the way, very pro-market) book “Social Democratic America,” published this year. Kenworthy’s argument is that we can “successfully embrace both flexibility and security, both competition and social justice.”

His wish list is a straightforward set of progressive initiatives. A few of them: universal health insurance and early education, extensive new help on job searches and training, a year of paid parental leave, an increased minimum wage indexed to prices, expansions of efforts that supplement wages such as the Earned Income Tax Credit, and the government as an employer of last resort.

His program, he says, would cost around 10 percent of our gross domestic product. Now that’s a lot of money, and the debate about whether we should spend it would be anything but phony. Yet would such a level of expenditure signal the death of our constitutional system? Would it make us like, say, Cuba? No and no. It might make us a little more like Germany, the Netherlands or the Scandinavian countries. We can argue if we want to do this, but these market democracies happen to share with us an affection for freedom and enterprise.

And when it comes to High C, there’s nothing quite like our culture wars, in which disagreements about social issues are seen as battles between libertines and bigots. When I look around, I see a lot of liberals who live quite traditional family lives and even go regularly to churches, synagogues and mosques. I see a lot of conservatives who are feminists when it comes to their daughters’ opportunities and who oppose bigotry against gays and lesbians.

The ideological resolution I’d suggest for the new year is that all sides stop fighting and pool their energies to easing the marriage and family crisis that is engulfing working-class Americans.

This would require liberals to acknowledge what the vast majority of them already practice in their own lives: that, all things being equal, kids are better off with two loving and engaged parents. It would require conservatives to acknowledge that many of the pressures on families are economic and that the decline of well-paying blue-collar work is causing huge disruptions in family formation. I’d make a case that Kenworthy’s ideas for a more social democratic America would be good for families, but let’s argue it out in the spirit of a shared quest for remedies.

Maybe it’s asking too much, but might social conservatives also consider my friend Jonathan Rauch’s idea that they abandon their campaign against gay marriage in favor of a new campaign on behalf of the value of committed relationships for all of us?

Disagreement is one of the joys of freedom, so I am all for boisterous debate and tough political and philosophical competition. It’s how I make my living. But our democratic system would be healthier if it followed the Greenfield rule and reserved the harshest invective for things that are genuinely monstrous.
