“Congress Largely On The Sidelines For Paris Deal”: Mitch McConnell Is Powerless To Block Obama’s Climate Change Deal
One of the few times countries around the world have reached a climate change deal to cut global greenhouse gasses was the 1997 Kyoto treaty, which required binding cuts from industrialized nations. Top Republicans told the press it was “dead on arrival” and would never gain approval from the Senate. And that was, more or less, the end of Kyoto—other countries pointed to the U.S. never ratifying it as reason enough to ignore their own commitments.
Senate Majority Leader Mitch McConnell has now pledged to kill the latest emerging global consensus to act on climate change. His strategy is to obstruct a deal at the next major conference in Paris at the end of the year. As Politico reported earlier this week, congressional Republicans have returned from their August recess with every intention of derailing a deal long before we get to December. An aide to McConnell is reaching out to foreign embassies to detail how the GOP-controlled Congress plans to stop President Obama’s climate plan from moving forward.
But this won’t be another Kyoto, because McConnell just isn’t a credible threat to the global negotiations. Well aware that Republicans have not changed their minds on UN climate treaties—and have in fact gone to a greater extreme—negotiators have put together a different kind of deal for a Paris conference at the end of the year, one that looks nothing like Kyoto. Republican obstinacy is so predictable, it’s already baked into the structure, politics, and messaging ahead of a deal in Paris.
At Paris, countries are responsible for putting forward their own emissions plans. Though it’s not clear what structure the final deal will take—including which elements are binding and which are not—the emissions cuts proposed at Paris probably won’t require Senate approval because they won’t be binding, as they were in Kyoto. Obama has pledged U.S. climate action through executive authority. (Of course, that also means that many of his pledges in Paris will rely on the commitment of his successor.)
McConnell’s strategy is clear: Send the world some very mixed messages on what the U.S. intends to do about its own greenhouse gas emissions. He’s emphasizing Republican plans to block the Clean Power Plan, a key part of Obama’s strategy to cut the U.S.’s carbon footprint by reducing emissions from electricity 32 percent by 2032. The GOP’s likely tool will be the Congressional Review Act, which requires only a majority vote to repeal a law—but it’s still subject to Obama’s veto, which makes repeal unlikely. The Senate may also take up a bill passed by the Environment and Public Works Committee that delays the Clean Power Plan until court challenges are resolved, a process that could take years and years—but though the Supreme Court could send the regulation back to the Environmental Protection Agency, defenders insist it is on sound legal ground. One tactic might work in the short term: Congress’s control over appropriations gives the GOP the ability to withhold the $3 billion Obama promised to the Green Climate Fund, an international fund to help poorer nations adapt to climate change. But it’s unlikely that alone would be enough to blow up broader negotiations.
Despite the largely hollow threats from McConnell, the Obama administration has been conducting its own outreach to large polluters like China to explain how the U.S. can deliver on its promises in good faith without Congress’ input—as long as a Democrat is in office, that is. In March, the U.S. submitted its pledge to cut greenhouse gas emissions up to 28 percent by 2025 over 2005 levels. When negotiators ask State Department climate envoy Todd Stern about the “solidity of U.S. action,” he says he assures them that “the kind of regulation being put in place is not easily undone,” signaling that the White House is confident its Clean Power Plan and other EPA regulations can survive court battles and congressional opposition.
All this means mixed news for Paris: The bad news is that a single Republican is powerful enough to undo the deal—but not until long after December, and only if the GOP wins the White House in 2016. The good news, though, is this means Congress is largely on the sidelines for Paris and won’t make or break the negotiations. It won’t be Mitch McConnell who sinks a deal.

“Is Donald Trump Leading A Proto-Fascist Movement?”: Trump’s Political Message Is Uncut Xenophobia If Not Outright Racism
With the increasingly unsettling success of Donald Trump’s presidential campaign, I am beginning to wonder: Does America have a fascism problem?
That may sound like an inflammatory question, but the point isn’t to say Trump is the next coming of Hitler. So what do I mean by fascism? Robert Paxton, in an excellent book about the subject, summed it up this way:
A form of political behavior marked by obsessive preoccupation with community decline, humiliation, or victimhood and by compensatory cults of unity, energy and purity, in which a mass-based party of committed nationalist militants, working in uneasy but effective collaboration with traditional elites, abandons democratic liberties and pursues with redemptive violence and without ethical or legal restraints goals of internal cleansing and external expansion. [The Anatomy of Fascism]
The first half of the definition fits the Trump movement pretty well. His slogan “Make America Great Again” isn’t too far from the average political bromide, but its intention is much different than, say, Reagan’s “Morning in America.” Reagan did deal in his fair share of veiled race-baiting, but Trump straight-up rants about how non-white foreigners are ruining the country. From claiming unauthorized Mexican immigrants are drug dealers and “rapists,” to saying he wants to deport 11 million people, to arguing that China is “killing us” on trade, Trump’s political message is uncut xenophobia if not outright racism — all of which is coupled with how he, as a very masculine tough guy who will never back down, is going to fix everything. Just watch him give the bum’s rush to the most famous Hispanic journalist in the country!
This has been an enormous political success, with hundreds of thousands of people enthusiastically flocking to the Trump banner (just look at the people in this picture). With the exception of Bernie Sanders, Trump is now drawing bigger crowds than any other candidate. That mass basis is a key foundation of fascism — without the delirious crowds, the fascist demagogue is little more than a deranged street preacher. Many of those supporters are out-and-proud white nationalists, as documented in a fascinating New Yorker investigation.
So we’ve got the victim complex, the incipient personality cult, the mass nationalist support, and the obsession with purifying the polity (like this Trump fan arguing that the government should pay a $50 bounty to murder people crossing the border).
However, on the second half of the definition, Trump is clearly not there. Paxton demonstrates that nowhere did fascists come to power by themselves; instead they relied on support from elite conservatives who feared left-wing populist movements. But today, there is not much sign that the Republican establishment is ready to team up with Trump, and neither is there a socialist party on the verge of electoral victory. On the contrary, the GOP brass has clearly been trying to get rid of Trump, and the most left-wing challenger in the presidential race is a moderate social democrat who is far behind the centrist front-runner.
Trump has also not proposed any wars of aggression, or the abolition of democratic principles. Cleansing wars of conquest and a scorn for democracy were both signature fascist ideas.
But I also think it’s fair to call Trumpism a proto-fascist movement, not in line with Hitler, but with the likes of Benito Mussolini, who was at the forefront of European fascism. Before the Nazis, he was regarded as a somewhat clownish dictator with an unusual degree of mass support. He was a racist, authoritarian warmonger, but nowhere close to the genocidal maniac that Hitler was.
Who’s to say where we’d be under different conditions? If the American economy were as bad as it is in the eurozone, and if Bernie Sanders was cruising to easy victory in the Democratic primary, loudly promising confiscatory tax rates, Trump might well be a genuinely terrifying figure.

“Get The Facts Jeb”: Why Jeb Bush Should Pledge To Roll Out The Welcome Mat For Asian Birth Tourists
Jeb Bush used to be the Mr. Rogers of GOP presidential candidates — a gentle fellow who would put you to sleep a few minutes after coming on TV. Now Bush is the GOP’s Bambi — a frozen deer who doesn’t know which way to turn as the headline-beaming monster truck that is Donald Trump bears down upon him.
Nowhere is this clearer than in Bush’s recent cringe-inducing suggestion that the real abusers of America’s birthright citizenship are Asian birth tourists — not Latino “anchor babies,” as Trump claims.
But as the GOP’s token pro-immigration candidate, if Bush had half of Trump’s cojones, he wouldn’t throw Asians under the bus to save Latinos. He’d tell Trump that “anchor babies” are a problem more hyped up than Trump’s bouffant — and birth tourism is a blessing that America should wholeheartedly welcome.
“Anchor babies” are a myth invented by restrictionists to try and scrap America’s constitutionally guaranteed right to birthright citizenship. The term used to refer to pregnant Latino women who supposedly deliberately and illegally came to America to give birth to American children who would become mom and dad’s green card sponsors. But this scheme can involve wait times of up to 31 years (kids can’t sponsor before age 21, and parents sometimes have to wait 10 years outside America before qualifying). Hence, restrictionists couldn’t find many examples to whip up anti-immigrant hysteria. So now they have dubbed every one of the 300,000 children born to undocumented parents annually as anchor babies whose real purpose is to prevent their unauthorized parents from being deported.
This argument is ridiculous. Vanishingly few undocumented immigrants have children specifically to escape deportation. They have children because they want to — for any number of non-cynical reasons. And yes, this can sometimes help them escape deportation. But don’t conflate that consequence of birth with the motives for pregnancy.
Anchor babies don’t exist in any meaningful sense. Birth tourism, however, does. And that’s a good thing.
No super-reliable figures are available, but the number commonly bandied about puts birth tourist babies at a mere 35,000 annually. Unlike the poor, unauthorized Latino parents of mythical “anchor babies,” birth tourism involves relatively well-off couples, the vast majority from China, who come to America when it comes time to give birth so their kid will score U.S. citizenship.
Another benefit for these Chinese couples: Beijing’s autocrats don’t count children born with other nationalities against a couple’s one-child quota. No doubt, a U.S. passport for their newborn is a huge attraction. But America is not the only destination for couples trying to dodge China’s draconian birth control policies. Mainland Chinese couples also flock to Hong Kong (all of which the pro-life, pro-family conservative editors of National Review Online should understand and applaud rather than running confused pieces like this conflating “anchor babies” and birth tourists to promote their anti-birthright citizenship crusade).
Immigration restrictionists love to deride “anchor baby” parents for being in the United States illegally. But that’s not true with birth tourists. They come here legally. Even a recent Rolling Stone “expose” of Los Angeles-based maternity agencies acknowledged: “Birth tourists, arriving on legal visas, aren’t breaking any laws while in the country.” Meanwhile, a May Bloomberg Businessweek story about these agencies — that for a fee of up to $50,000 help a couple obtain U.S. visas, put them up in hotels during their long stay in America, arrange doctors and hospitals and then passports for their infant — found that most of them go out of their way to coach their clients in “cheng shi qian” (honest visa applications). This is not to say that no one lies, but it is far from standard practice — which is why a Department of Homeland Security raid on maternity hotels earlier this year didn’t seem to come up with many instances of visa fraud, despite a long undercover investigation.
Restrictionists constantly accuse “anchor baby” parents of mooching off American taxpayers by using emergency services for child delivery and collecting welfare through their American child. (Never mind that unauthorized parent-headed households receive far less welfare than native ones of similar income, and are far less prone to welfare dependency.) But none of that applies to birth tourists, who, with few exceptions, pay for the entire cost of delivery out of pocket. In fact, the agency that formed the cornerstone of the Bloomberg story went out of its way to ensure that its clients don’t use public money, and keep copious documentation to prove that.
More to the point, birth tourist babies go home to be raised during their most expensive phase — only to possibly return to America after their 18th birthday, during their most productive phase. In effect, birth tourism allows America to outsource the raising of its citizens, resulting in enormous savings, given that it costs a whopping $300,000 to raise a child in a middle-income family in America today.
Every adult immigrant, even poor Latinos, constitute a windfall for America, given that America reaps the dividends of another society’s investment in them. (Indeed, immigration is arguably a far cheaper way than having children for a society to maintain its population level.) But birth tourist babies are a special boon because they are the product of super-ambitious parents who are obviously sparing no expense or effort to build their child’s full potential and give him/her options.
This is why it is all the more unfortunate that Jeb Bush put birth tourists in the crosshairs of his party’s ugly war on immigration. He has said in the past that Latinos who come to America illegally to give their children a better life are engaging in an “act of love.” This is equally true for Asian birth tourists.
Bush should have used their example to defend and strengthen America’s birthright citizenship against Trump’s attacks. Instead, in his panic about his nose-diving poll numbers, he may have done the opposite — none of which inspires much confidence in another Bush presidency.

“Party Loyalty Isn’t All That Important”: How Donald Trump Exposed The Limits Of Ideology In A Most Ideological Party
Donald Trump figured something out about the Republican Party. Maybe it was a flash of insight, or maybe he stumbled into it and doesn’t even realize what he found. But here it is: Even in this most ideological of parties, ideology has its limits.
This is a party, after all, that has spent the last few years on its own miniature version of the Cultural Revolution, a tireless search for ideological heretics who can be exposed, shamed, and banished. It has made compromise into something beneath contempt, and required all who would wear the name “Republican” to demonstrate that the hatred of Barack Obama and all he touches vibrates within every cell of their beings. When the party confronts a policy development it doesn’t like, it demands not just that the idea be opposed, but that it be opposed again and again and again, no matter how fruitless the blows battered against it (the number of votes to repeal the Affordable Care Act is well past 50, all failed).
Yet the party’s effort to find a leader is now led — by a wide margin — by a man who at best is a piecemeal conservative, taking a harshly right-wing stance here and an oddly liberal one there. This seems to be a result of the fact that Trump has never thought much about policy, and doesn’t really care.
If you want to understand Trump’s appeal in the primaries — both its power and its limits — there are two articles that came out in the last few days that you should read. The first, from The Washington Post‘s David Weigel, explains how Trump’s talk about foreign countries stealing American jobs is resonating with economically troubled voters, particularly in places where manufacturing has declined. Instead of talking about job retraining or anything else realistically modest, Trump all but promises that he’ll go to China and punch the commies in the face until they give us our jobs back.
The second, from Bloomberg‘s Melinda Henneberger, describes how Republican voters, besotted with Trump’s style, barely notice that his positions on issues are a hodgepodge of conservative and liberal ideas. “After he finished talking in New Hampshire on Friday night, I asked half a dozen Republicans who said they liked him what they had heard in his long, stream-of-consciousness oration that struck them as conservative,” she writes, “and none of them could point to anything in particular.” But it didn’t matter.
The approach Republican politicians have taken toward their voters in recent years is a combination of policy and posture. The policies are a version of what they’ve always offered, just a little bit more conservative and a lot more pure. The posture is one of opposition to Barack Obama — unyielding, inflexible, even petulant or downright angry. The easiest way to assure Republican voters you’re one of them is to show them how much you hate the guy in the White House.
Which may be understandable, since the president is the axis around which elite politics revolves. When your party is out of power, you’re inevitably going to define yourself in relation to him. But then along comes Trump, who has an entirely different posture.
Though it may be odd coming from a guy who waged a campaign to prove that Obama isn’t actually an American citizen (and apparently still believes it), Trump seems to barely have time to talk about this administration, except as the most recent example of larger problems he’s promising to fix with a sweep of his hand. His message isn’t, I’ll reverse everything that happened in the Obama years, it’s, Everyone else is a bunch of losers, and I’m a winner. That applies to Democrats, Republicans, everyone. The force of his persona is such that when he displays some lack of fealty to conservative ideals — like saying that single-payer health care “works well in Canada” — ideological conservatives may be horrified, but he just rolls right past it. And that tells us that ideological purity isn’t all that important to Republican voters, at least not all of them.
If it was, Trump would be pulling 5 percent in the primary polls, not 25 percent. His flirtation with a third-party run would also be bringing him down, but it isn’t, which suggests that there are lots of Republicans for whom party loyalty isn’t all that important.
Of course, 25 percent isn’t a majority, and it’s probably necessary to demonstrate both ideological fealty and a fundamental commitment to the GOP in order to get the nomination. But Trump has shown that there are other impulses within the Republican electorate, like resentment, dissatisfaction with targets bigger than Obama, and the desire for a confident leader who will promise the moon.
Even in a party now defined by its ideological extremism, it isn’t always about ideology. Whether any of the party creatures who make up the rest of the field can capture and exploit those impulses is something we’ll have to wait and see.

“The High Price Of Rejecting The Iran Deal”: Foreign Governments Will Not Continue To Make Costly Sacrifices At Our Demand
The Iran nuclear deal offers a long-term solution to one of the most urgent threats of our time. Without this deal, Iran, the world’s leading state sponsor of terrorism, would be less than 90 days away from having enough fissile material to make a nuclear bomb. This deal greatly reduces the threat of Iran’s nuclear program, making Iran’s breakout time four times as long, securing unprecedented access to ensure that we will know if Iran cheats and giving us the leverage to hold it to its commitments.
Those calling on Congress to scrap the deal argue that the United States could have gotten a better deal, and still could, if we unilaterally ramped up existing sanctions, enough to force Iran to dismantle its entire nuclear program or even alter the character of its regime wholesale. This assumption is a dangerous fantasy, flying in the face of economic and diplomatic reality.
To be sure, the United States does have tremendous economic influence. But it was not this influence alone that persuaded countries across Europe and Asia to join the current sanction policy, one that required them to make costly sacrifices, curtail their purchases of Iran’s oil, and put Iran’s foreign reserves in escrow. They joined us because we made the case that Iran’s nuclear program was an uncontained threat to global stability and, most important, because we offered a concrete path to address it diplomatically — which we did.
In the eyes of the world, the nuclear agreement — endorsed by the United Nations Security Council and more than 90 other countries — addresses the threat of Iran’s nuclear program by constraining it for the long term and ensuring that it will be exclusively peaceful. If Congress now rejects this deal, the elements that were fundamental in establishing that international consensus will be gone.
The simple fact is that, after two years of testing Iran in negotiations, the international community does not believe that ramping up sanctions will persuade Iran to eradicate all traces of its hard-won civil nuclear program or sever its ties to its armed proxies in the region. Foreign governments will not continue to make costly sacrifices at our demand.
Indeed, they would more likely blame us for walking away from a credible solution to one of the world’s greatest security threats, and would continue to re-engage with Iran. Instead of toughening the sanctions, a decision by Congress to unilaterally reject the deal would end a decade of isolation of Iran and put the United States at odds with the rest of the world.
Some critics nevertheless argue that we can force the hands of these countries by imposing powerful secondary sanctions against those that refuse to follow our lead.
But that would be a disaster. The countries whose cooperation we need — including those in the European Union, China, Japan, India and South Korea, as well as the companies and banks that handle their oil purchases and hold foreign reserves — are among the largest economies in the world. If we were to cut them off from the American dollar and our financial system, we would set off extensive financial hemorrhaging, not just in our partner countries but in the United States as well.
Our strong, open economic relations with these countries constitute a foundation of the global economy. Nearly 40 percent of American exports go to the European Union, China, Japan, India and Korea — trade that cannot continue without banking connections.
The major importers of Iranian oil — China, India, Japan, South Korea, Taiwan and Turkey — together account for nearly a fifth of our goods exports and own 47 percent of foreign-held American treasuries. They will not agree to indefinite economic sacrifices in the name of an illusory better deal. We should think very seriously before threatening to cripple the largest banks and companies in these countries.
Consider the Bank of Japan, a key institutional holder of Iran’s foreign reserves. Cutting off Japan from the American banking system through sanctions would mean that we could not honor our sovereign responsibility to service and repay the more than $1 trillion in American treasuries held by Japan’s central bank. And those would be direct consequences of our sanctions, not to mention the economic aftershocks and the inevitable retaliation.
We must remember recent history. In 1996, in the absence of any other international support for imposing sanctions on Iran, Congress tried to force the hands of foreign companies, creating secondary sanctions that threatened to penalize them for investing in Iran’s energy sector. The idea was to force international oil companies to choose between doing business with Iran or the United States, with the expectation that all would choose us.
This outraged our foreign partners, particularly the European Union, which threatened retaliatory action and referral to the World Trade Organization and passed its own law prohibiting companies from complying. The largest oil companies of Europe and Asia stayed in Iran until, more than a decade later, we built a global consensus around the threat posed by Iran and put forward a realistic diplomatic means of addressing it.
The deal we reached last month is strong, unprecedented and good for America, with all the key elements the international community demanded to stop Iran from getting a nuclear weapon. Congress should approve this deal and ignore critics who offer no alternative.
