“How America Was Lost”: Maybe We Should All Start Wearing Baseball Caps That Say, “Make America Governable Again”
Once upon a time, the death of a Supreme Court justice wouldn’t have brought America to the edge of constitutional crisis. But that was a different country, with a very different Republican Party. In today’s America, with today’s G.O.P., the passing of Antonin Scalia has opened the doors to chaos.
In principle, losing a justice should cause at most a mild disturbance in the national scene. After all, the court is supposed to be above politics. So when a vacancy appears, the president should simply nominate, and the Senate approve, someone highly qualified and respected by all.
In reality, of course, things were never that pure. Justices have always had known political leanings, and the process of nomination and approval has often been contentious. Still, there was nothing like the situation we face now, in which Republicans have more or less unanimously declared that President Obama has no right even to nominate a replacement for Mr. Scalia — and no, the fact that Mr. Obama will leave soon doesn’t make it O.K. (Justice Kennedy was appointed during Ronald Reagan’s last year in office.)
Nor were the consequences of a court vacancy as troubling in the past as they are now. As everyone is pointing out, without Mr. Scalia the justices are evenly divided between Republican and Democratic appointees — which probably means a hung court on many issues.
And there’s no telling how long that situation may last. If a Democrat wins the White House but the G.O.P. holds the Senate, when if ever do you think Republicans would be willing to confirm anyone the new president nominates?
How did we get into this mess?
At one level the answer is the ever-widening partisan divide. Polarization has measurably increased in every aspect of American politics, from congressional voting to public opinion, with an especially dramatic rise in “negative partisanship” — distrust of and disdain for the other side. And the Supreme Court is no different. As recently as the 1970s the court had several “swing” members, whose votes weren’t always predictable from partisan positions, but that center now consists only of Mr. Kennedy, and only some of the time.
But simply pointing to rising partisanship as the source of our crisis, while not exactly wrong, can be deeply misleading. First, decrying partisanship can make it seem as if we’re just talking about bad manners, when we’re really looking at huge differences on substance. Second, it’s really important not to engage in false symmetry: only one of our two major political parties has gone off the deep end.
On the substantive divide between the parties: I still encounter people on the left (although never on the right) who claim that there’s no big difference between Republicans and Democrats, or at any rate “establishment” Democrats. But that’s nonsense. Even if you’re disappointed in what President Obama accomplished, he substantially raised taxes on the rich and dramatically expanded the social safety net; significantly tightened financial regulation; encouraged and oversaw a surge in renewable energy; moved forward on diplomacy with Iran.
Any Republican would undo all of that, and move sharply in the opposite direction. If anything, the consensus among the presidential candidates seems to be that George W. Bush didn’t cut taxes on the rich nearly enough, and should have made more use of torture.
When we talk about partisanship, then, we’re not talking about arbitrary teams, we’re talking about a deep divide on values and policy. How can anyone not be “partisan” in the sense of preferring one of these visions?
And it’s up to you to decide which version you prefer. So why do I say that only one party has gone off the deep end?
One answer is, compare last week’s Democratic debate with Saturday’s Republican debate. Need I say more?
Beyond that, there are huge differences in tactics and attitudes. Democrats never tried to extort concessions by threatening to cut off U.S. borrowing and create a financial crisis; Republicans did. Democrats don’t routinely deny the legitimacy of presidents from the other party; Republicans did it to both Bill Clinton and Mr. Obama. The G.O.P.’s new Supreme Court blockade is, fundamentally, in a direct line of descent from the days when Republicans used to call Mr. Clinton “your president.”
So how does this get resolved? One answer could be a Republican sweep — although you have to ask, did the men on that stage Saturday convey the impression of a party that’s ready to govern? Or maybe you believe — based on no evidence I’m aware of — that a populist rising from the left is ready to happen any day now. But if divided government persists, it’s really hard to see how we avoid growing chaos.
Maybe we should all start wearing baseball caps that say, “Make America governable again.”

“Fulfilling Their Constitutional Duties”: On SCOTUS, Pressure Falls On Endangered GOP Senators
All corners of the Republican Party have made themselves very clear: they intend to, in Donald Trump’s words, “delay, delay, delay” the confirmation of Antonin Scalia’s replacement on the Supreme Court until after the 2016 election. Ted Cruz has signaled his intention to lead a blockade, and Mitch McConnell intends to run a blockade.
All of this would be unprecedented, despite conservative protestations to the contrary. Conventional wisdom seems to suggest that McConnell can hold the Supreme Court nomination hostage for the whole year. But is that true?
It’s not necessary for the entire GOP to confirm the nominee. It only requires a few GOP Senators to join with the Democrats to fulfill their Constitutional duties. And as it turns out, there are quite a few Republican Senators in blue states who would be pilloried as intransigent obstructionists if they refused to confirm commonsense consensus nominees.
Among these Senators would be Senator Mark Kirk in Illinois, who is already Democrats’ primary target for a Senate takeover. Wisconsin’s Ron Johnson is less ideologically likely to cross the aisle, but with Russ Feingold already seeming likely to defeat him in November, it’s not clear that Johnson can afford to give Democrats yet another cudgel with which to attack him. The same goes for Senator Kelly Ayotte in New Hampshire, Pat Toomey in Pennsylvania and Rob Portman in Ohio.
President Obama will certainly nominate a number of popular, reasonable and consensus nominees, from recently confirmed Homeland Security Secretary Jeh Johnson to D.C. Circuit Court of Appeals Judge Sri Srinivasan. With each attempted and withdrawn nomination the Republican Party would look worse as a whole, but the careers of the specifically imperiled Senators would be particularly threatened–and with them the Republican Senate majority itself.
Will Ayotte, Kirk and their colleagues kowtow to McConnell and Cruz and likely eliminate their ability to hold their seats, or will they do the right thing, perform their constitutional duty and protect their Senate careers?
Time will tell.

“Where Does Scalia Think Cruz Was Born?”: Hey Supreme Court, Please Settle This Ted Cruz Birther Thing
Here are four words I never thought I would write: Donald Trump is right. As Trump said this week, it would be “very precarious” if Ted Cruz were the GOP nominee given that Cruz was undisputedly born in Canada.
Where Trump was wrong was when he made his focus on how precarious that would be “for Republicans.” Trump, possibly for the first time ever, was being too restrained. It would be precarious for our entire nation if Cruz were elected and then the U.S. Supreme Court deemed him ineligible to serve as president.
Think about the impact it would have to our nation as we collectively waited for the Court’s decision. It would be a national crisis. Our allies would not know who is actually our president, and our enemies might use the crisis to their advantage. Plus it would cause a dramatic drop in the stock market (investors hate uncertainty.)
Now, just so it’s crystal clear, I’m neither a Cruz birther nor am I advocating that Cruz may be ineligible to be president. What I’m saying is that the Supreme Court has not addressed the specific of issue whether a person in Cruz’s position is eligible to be president in accordance with the requirements of the U.S. Constitution.
Specifically, Article II, Section 1 of the Constitution provides that a person cannot be president unless he or she is “a natural born Citizen.” Cruz was born in Calgary, Canada in 1970 and first moved to the United States when he was four years old. At the time of Cruz’s birth, his mother was a United States citizen but his Cuban-born father was not.
So is Cruz a “natural born citizen”? There are countless articles debating this issue. While some legal scholars support Cruz’s eligibility, others like Fordham Law School constitutional law professor Thomas Lee informed me that the question of whether Cruz is a “natural born citizen” can be answered with two words: “It depends.”
Lee, who was an editor of the Harvard Law Review and clerked for Supreme Court Justice David Souter, explained that the issue could go either way. Lee noted there are two views of constitutional interpretations that he believes would support Cruz—the textualist and evolutionist views.
But under the “originalist” view, Cruz could be deemed ineligible. Constitutional orginalists interpret the Constitution by looking at the meaning of the document when it was originally written. Ironically, Cruz is a constitutional orginalist and that is part of his appeal to conservatives. As Lee noted, Cruz should actually disqualify himself from the presidency if he remained true to being an originalist.
Once again, however, while learned people have offered well-reasoned opinions, we still don’t have the definitive guidance of the Supreme Court on this issue. But this is no academic exercise. There were already objections filed in New Hampshire to knock Cruz off the ballot for being ineligible.
And while the New Hampshire Ballot Commission recently ruled in Cruz’s favor, its decision didn’t resolve this issue at all. In fact, it added to the uncertainty. The commission’s decision noted that since the question of what constitutes a “natural born citizen” has not been “answered with certainty” by the courts, the commission has “no clear standard to apply.” It added: “this Commission is not the appropriate forum for the determination of major Constitutional questions.”
Summing up the quandary well, Brad Cook, the Republican chair of the commission, told the media at the time of rendering the decision, “It would be really nice if somebody would get this issue of law decided who has authority to decide constitutional issues, so every four years we don’t have this come up again.”
And that’s where we are now. Given Cruz’s ascendancy in the polls and the plausible chance he could be the GOP presidential nominee, this issue needs to be decided by the federal courts now. But this is trickier than it would seem. We the people just can’t simply ask the nine Supreme Court Justices to give us a quick answer.
Professor Lee noted that there are likely only a few parties who would have the legal standing to bring a lawsuit in federal court to challenge Cruz’s eligibility. “Individual voters would not have standing,” Lee noted because federal courts require a “concrete injury,” not a more “generalized grievance.”
Bottom line, Lee believes it will take one of Cruz’s fellow presidential candidates to bring a lawsuit. Lee doubted that Super PACs would have standing in federal court unless they could show a concrete injury.
If a GOP presidential candidate were to now file a lawsuit in the federal courts where Cruz is on the ballot, it could go a long way to resolving this issue. Waiting is precarious for all of us. What if Cruz wins the GOP nomination and the Democratic nominee or a third party presidential candidate then files a lawsuit to deem Cruz ineligible? Imagine if Cruz is deemed ineligible only a few weeks before Election Day? The Democratic nominee would likely win in a cakewalk.
However, the worst-case scenario for us all would be that such a lawsuit isn’t filed until Cruz won the election and before he was sworn in as president. Talk about a national crisis. Does the Vice President elect get sworn in while we wait for the court?
Lee did caution, however, that the Supreme Court could deem this issue a “political question” and decline to get involved. But President Cruz would still likely be dogged by this issue his entire term, leading to a possible crisis in confidence.
That’s why it’s in the best interest of all Americans – regardless of political party- to resolve this issue sooner rather than later. It will give us all peace of mind. Plus it deprives Trump of another non-policy issue to distract us with, which is truly great for America.

“Teamwork On The Supreme Court”: Discipline On The Left Side, Disarray On The Right
Now that the current term is over for the Supreme Court, analysts are digging into the record to draw conclusions about what happened. In a fascinating analysis, Adam Liptak writes: Right Divided, a Disciplined Left Steered the Supreme Court.
The stunning series of liberal decisions delivered by the Supreme Court this term was the product of discipline on the left side of the court and disarray on the right.
In case after case, including blockbusters on same-sex marriage and President Obama’s health care law, the court’s four-member liberal wing, all appointed by Democratic presidents, managed to pick off one or more votes from the court’s five conservative justices, all appointed by Republicans.
They did this in large part through rigorous bloc voting, making the term that concluded Monday the most liberal one since the Warren court in the late 1960s, according to two political-science measurements of court voting data.
“The most interesting thing about this term is the acceleration of a long-term trend of disagreement among the Republican-appointed judges, while the Democratic-appointed judges continue to march in lock step,” said Eric Posner, a law professor at the University of Chicago.
For example, this session there were 19 SCOTUS decisions that were decided 5/4. In 10 of those, the four liberals voted together and were joined by one conservative. In contrast, the conservatives only voted together 5 times.
Ian Millhiser suggests that the problem for the conservative justices is that they “represent three – and possibly as many as five – distinct versions of judicial conservatism.”

He points out that Scalia purports to be an “originalist” (like Thomas), but mostly votes as a partisan. And he can’t seem to find a way to characterize Kennedy.
Liptak credits the cohesion among the liberal justices to the leadership of Justice Ginsberg. But I’m also interested in how they managed to pretty consistently pick off one of the conservative justices to vote with them. I was reminded of something Adam Winkler wrote about Elena Kagan almost 2 years ago. He described her as a justice in the mold of Earl Warren.
Warren didn’t accomplish these by embarrassing his colleagues or by making sharper arguments on the merits. Warren was a master politician, one who’d sit with the other justices and bring them along slowly and steadily to his side. He sought to understand other justices’ concerns and address them. Unlike most of today’s justices, Warren was willing to work the halls to gain five votes.
He says this about why Kagan was chosen to be the dean of Harvard’s Law School:
She was seen as someone who could bring together a faculty known for ideological and personal divisions that institutionally hobbled the law school, especially when it came to hiring. As dean from 2003 to 2009, she calmed faculty tensions, launched an aggressive hiring spree that netted 32 new professors, and earned praise from both left and right.
I remember that some liberals opposed Elena Kagan’s nomination. But it strikes me that President Obama would see “bridge-builder” as a necessary role for someone to play on the Supreme Court. It’s exactly how people describe his tenure as President of the Harvard Law Review.
If that’s the case, here’s what we know about the 3 women on the Supreme Court: the senior member is Ruth Bader Ginsberg – the Notorious RBG – tiny woman who throws quite a punch. Then there’s my hero, Sonia Sotomayor, the wise Latina with a heart as big as they come. And finally, there’s Elena Kagan, the bridge-builder. What a team!

“Supreme Court; If It’s Worth It For Corporations, Pollution May Be Okay”: EPA Can Only Regulate Pollution When It’s Cost-Effective
While LGBTs and healthcare reformers are still nursing their celebratory hangovers, the final Supreme Court case of the 2014-15 term just junked twenty years of environmental regulations.
The case, Michigan v. EPA, specifically dealt with the EPA’s regulation of mercury emissions from power plants under the Clean Air Act—a long, twenty-year process that has been opposed by industry at every turn, even as mercury air pollution from coal-fired power plants has ++irreparably poisoned the Great Lakes .
Today, the clock has been set back. In its third 5-4 decision of the day, with Justice Kennedy again providing the swing vote, industry has prevailed. Writing for the court, Justice Scalia held that the EPA had to factor in costs in deciding whether to regulate, not just how to regulate.
If you think about it, this is an impossible task practically and philosophically.
Practically speaking, the regulatory process for mercury has lasted twenty years—in large part because the EPA weighed dozens of options, evaluating the costs and benefits of each. Today’s decision requires the EPA to balance costs and benefits at the very beginning of the process, before either the costs or the benefits are known.
EPA’s position was that, while costs must, of course, be taken into account in deciding how to regulate toxic chemicals like mercury, the initial decision of whether to regulate them should not be dictated by how much it costs to do so. What matters at that point—whether regulation is “appropriate and necessary” under the statute—is only whether public health is at stake.
In policy-speak—as I wrote in a law review article twenty years ago—the difference is between “risk assessment” and “risk management.” Risk assessment is when you notice a leak in your basement, and decide you have to do something about it. Risk management is when you evaluate your options, and decide what to do.
The difference is obvious, and intuitive. But it does mean that the initial decision may not take cost into account.
Thus the EPA argued that the words “appropriate and necessary” do not imply a balancing of costs and benefits, only a determination of public health. Justice Scalia said this was not “reasonable decisionmaking.” As Justice Kagan said in her dissent, the EPA took costs into account later in the regulatory process. But Justice Scalia said that is not enough—the initial decision, too, must include costs.
This is as incoherent philosophically as it is practically. Think about it this way: Who owns the right to your health?
In the EPA’s reasoning, you do. Under the Clean Air Act, if someone else’s activities are going to meaningfully endanger your health, the government is entitled to stop them.
In Justice Scalia’s reasoning, now the law of the land, the toxic chemical emitters do. If it is economically efficient to poison you with mercury—if the costs to them outweigh the benefits to you, calculating an economic value of your health—then they get to do it.
If this seems outrageous, it’s because it is. Justice Scalia had to focus exclusively on the first sliver of the regulatory process in order to make his argument. “EPA’s interpretation precludes the Agency from considering any type of cost,” he writes. But that’s only true at the initial decision of whether to regulate or not (risk assessment). In subsequent decisions of how to regulate (risk management), cost was taken into account many times.
Which is what makes sense philosophically, as well as practically. Deciding whether to regulate a toxic substance should not be an economic decision. Deciding how to do so should be—of course, the government should choose the most efficient method of regulation, and balance costs and benefits appropriately. But the decision of whether a toxic substance is toxic is a matter of science, not money.
Zooming back a bit, Michigan v. US now starts to look a lot like the corporations-are-people cases like Citizens United and Hobby Lobby. In this growing body of cases, corporate interests have been equated with individual ones. Corporations have rights to free speech and the free exercise of religion.
Now their right to make money running dirty power plants is equated with the right of human beings to breathe free of mercury pollution. Your rights, their rights—what’s the difference?
Ironically, Justice Scalia’s originalism—which last week had him arguing that if a practice could be banned in 1868, it could be banned in 2015—would have cut the other way here, if he took it seriously. For the first hundred years of US history, there were no corporations as we know them today. Corporate charters were time-bound, limited, and revocable. Only in the Gilded Age did they attain “legal personhood” as we know it today.
This is the point conservatives often miss in decrying the growth of government and regulation. Yes, government has grown well beyond anything the Founders could have imagined. But the Founders could not have imagined today’s mega-corporations either.
Peabody Energy, one of the primary backers of the current lawsuit, has an annual revenue of $6.79 billion. In 1812, the largest non-banking corporation in America, the American Fur Company, was worth about $1 million—about $17.2 million in 2015 dollars.
In other words, just one of the corporations fighting the EPA’s mercury regulations is worth 394 times the largest US corporation in existence two centuries ago. While the growth in governmental power since then, represented by regulations like the Clean Air Act, has indeed been significant, it is dwarfed by the growth in corporate power.
Michigan v. US now stands for the principle that corporate interests are equal in kind to human interests. Whether the EPA should regulate mercury depends on whether it’s cost-effective to do so, treating the costs to industry and the benefits to health equally.
Because corporations are people, right?
