“Universal Election Day Registration”: Jimmy Carter And The Conservative Abandonment Of Voting Rights
Being a Georgian and a kiddie volunteer for Jimmy Carter’s first gubernatorial contest in 1966, I thought I was an expert on Most Things Jimmy. But Rick Perlstein, who was seven years old when Carter became our 39th president, has unearthed a proud moment of that presidency which I and probably others watching at the time had all but forgotten: a 1977 election reform initiative which still seems bold in its clear purpose and scope.
Everyone loved to talk about voter apathy, but the real problem, Carter said, was that “millions of Americans are prevented or discouraged from voting in every election by antiquated and overly restricted voter registration laws”—a fact proven, he pointed out, by record rates of participation in 1976 in Minnesota, Wisconsin, and North Dakota, where voters were allowed to register on election day. So he proposed that election-day registration be adopted universally, tempering concerns that such measures might increase opportunities for fraud by also proposing five years in prison and a $10,000 fine as penalties for electoral fraud.
He asked Congress to allot up to $25 million in aid to states to help them comply, and for the current system of federal matching funds for presidential candidates to be expanded to congressional elections. He suggested reforming a loophole in the matching-fund law that disadvantaged candidates competing with rich opponents who funded their campaigns themselves, and revising the Hatch Act to allow federal employees “not in sensitive positions,” and when not on the job, the same rights of political participation as everyone else.
Finally, and most radically, he recommended that Congress adopt a constitutional amendment to do away with the Electoral College—under which, three times in our history (four times if you count George W. Bush 33 years later), a candidate who received fewer votes than his opponent went on to become president—in favor of popular election of presidents. It was one of the broadest political reform packages ever proposed.
As Perlstein notes, Carter’s proposal initially drew support from national leaders of the GOP. But then the engines of the conservative movement became engaged in blocking it, led by Ronald Reagan, making arguments that sound extremely familiar today: real voters don’t need convenience; universal voting will empower looters in league with the Democratic Party; voter fraud will run rampant; and the Electoral College is part and parcel of our infallible system of federalism. The initiative was filibustered to death (in another fine usage of an anti-democratic device), Reagan beat Carter in 1980, and another rock of progress rolled down another long hill.
And now Jimmy Carter, at 90, is suffering from apparently incurable cancer, but is still speaking out:
This spring, when only those closest to him knew of his illness, Jimmy Carter made news on Thom Hartmann’s radio program when he returned to the question of democracy reform. In 1977, he had pledged “to work toward an electoral process which is open to the participation of all our citizens, which meets high ethical standards, and operates in an efficient and responsive manner.” In 2015, he was still at it.
He declared our electoral system a violation of “the essence of what made America a great country in its political system. Now it’s just an oligarchy, with unlimited political bribery being the essence of getting the nominations for president or to elect the president.”
The best possible tribute to Carter at death’s door is what Perlstein is doing: remembering his finest moments in causes then lost but now redeemable, if we take them up again.

“His Hands Are As Dirty As Anyone’s”: If Jeb Bush Wants To Be A Different Kind Of Republican, He Should End GOP War On Voting
Jeb Bush appears before the Urban League today — the only other Republican candidate who accepted their invitation was Ben Carson — where he will tell them that antipoverty programs have failed, and the path to greater success for African-Americans is the one the GOP wants to pave. Politically, Bush surely wants credit for showing up in front of an audience not exactly guaranteed to be friendly. As Eli Stokols noted, “Just about everywhere Jeb Bush goes, he talks about his willingness to go everywhere.”
But at a moment when his party is fighting with all its might to limit the number of African-Americans who make it to the polls, it’s going to be awfully hard to make a case that the GOP has their interests at heart.
That issue is on display in a trial now going on in North Carolina. But before we get to that, here’s part of what Bush had to say:
“I know that there are unjust barriers to opportunity and upward mobility in this country. Some we can see, others are unseen but just as real. So many lives can come to nothing, or come to grief, when we ignore problems, or fail to meet our own responsibilities. And so many people could do so much better in life if we could come together and get even a few big things right in government.”
That’s about as close as he came to acknowledging that racism exists, and about as much on the topic as you’ll hear from any Republican. And while Jeb will happily tout his record on things like charter schools as helping African-Americans, one topic he didn’t raise was voting rights. That may be because on that subject, his hands are as dirty as anyone’s.
When he was governor of Florida, Bush’s administration ordered a purge of the voter rolls that disenfranchised thousands of African-Americans, in a happy coincidence that made it possible for his brother to become president. The private corporation they hired to eliminate felons from the rolls did so by chucking off people who had a name similar to those of felons; people who had voted all their lives showed up on election day to be told that they couldn’t vote.
The remarkable outcome taught Republicans an important lesson. Here you had an election in which their candidate got fewer votes than his opponent, and the whole thing was decided in a state where his brother was the governor and the co-chair of his state campaign was the state’s chief election official. He won by an official margin of 537 votes, and the purge was just one of the things that made it possible. The lesson was this: when it comes to voting, we can get away with almost anything. What came out of that election, as Ari Berman documents, was a wave of Republican efforts to win elections by keeping people less likely to vote Republican from being able to cast a ballot. African-Americans aren’t the only people on that list, but they’re at the top.
So we see cases like North Carolina, where once the conservatives on the Supreme Court gutted the Voting Rights Act — a landmark law for which some African-Americans literally gave their lives — the state rushed to pass a menu of voting restrictions, all of which are designed to reduce the number of non-Republicans who make it to the polls. Young people are more likely to vote for Democrats? The North Carolina law eliminated pre-registering, where teenagers can register before they turn 18 if they’ll be of age on election day. African-Americans are disproportionately more likely to lack a photo ID? The law requires it. African-American churches mount “souls to the polls” efforts, bringing people to vote early on the Sunday before election day? The law ends early voting on that Sunday.
This law is on trial in a federal courtroom in Winston-Salem; closing arguments are happening today. To be honest, whatever happens in that trial, the five conservatives on the Supreme Court have made it clear that they are quite open to all kinds of restrictions on voting rights. So from a practical standpoint, Republicans may continue to enjoy success in their efforts to make voting as inconvenient and difficult as possible, at least for the wrong people.
But if Jeb Bush is wondering whether he can get African-Americans to vote for him, the answer is almost certainly no, and the continuing struggle over voting rights is one big reason. It’s awfully hard to convince African-Americans you love them when you’re still on the wrong side of a conflict that was at the center of the civil rights struggle. African-Americans look at places like Florida, North Carolina, Texas, or Wisconsin — or almost every state where Republicans are in charge — and say, “They’re still trying to keep us from voting, half a century after the Voting Rights Act!”
If Bush really wants to be a different kind of Republican, he could try to end the Republican war on voting rights. He could say, “We can have a secure voting system, and still make it easy and convenient for every American citizen to vote.” Because it really wouldn’t be that hard. He could advocate extended early voting (including Sundays), and looser identification measures that are geared toward allowing every legitimate voter to cast their ballot, not shutting out as many people as possible. He could acknowledge that in-person voter impersonation, the only kind of fraud that ID requirements can stop, is so incredibly rare (one investigation found only 31 cases in over a billion ballots cast between 2000 and 2014), that it’s wrong to disenfranchise thousands of people on the off-chance you might stop it. He could acknowledge that members of his party have used voting restrictions as a way to give themselves partisan advantage.
Or he could hope that showing up to the Urban League and shaking black people’s hands will be enough to wipe out decades of history, his own and his party’s. I’m pretty sure that won’t do the trick.

“Dispensed With The Niceties”: Hillary Clinton’s Grand Strategy To Beat The GOP: Take Bold Positions Early And Often
For the better part of 20 years now, Bill Clinton’s presidency has been synonymous with a hazy political concept called triangulation. Since his advisers made the term famous, it has been used to describe everything from standard-issue compromise, to the willingness to confront reactionary elements in one’s own party (think Sister Souljah), to the appropriation of another political party’s policy ideas. The latter is as close to a proper definition as there is.
One big concern bedeviling progressives is that Hillary Clinton’s candidacy will mark the return of triangulation—the preemptive ceding of ideological turf, at a time when, thanks to partisan polarization, such concessions amount to outright victories for the Republican Party. But the early days of Hillary Clinton’s candidacy suggest these fears are overblown—that she is engaged in an entirely different kind of political positioning, one that carries the promise of significant progressive victories or at least of clarifying the terms of key policy debates dividing the parties.
The nature of the strategy involves staking out a variety of progressive issue positions that enjoy broad support, but it’s not as straightforward as simply identifying the public sentiment and riding it to victory. The key is to embrace these objectives in ways that makes standard Republican counterspin completely unresponsive, and thus airs out the substantive core of their ideas: Rather than vie for conservative support by inching rightward, Clinton is instead reorienting liberal ideas in ways that make the Republican policy agenda come into greater focus.
Most recently, Clinton has adopted an aggressive position in support of expanded voting rights. “We have a responsibility to say clearly and directly what’s really going on in our country,” she said in her latest campaign speech Thursday, “because what is happening is a sweeping effort to disempower and disenfranchise people of color, poor people, and young people from one end of our country to the other.”
This is standard Democratic boilerplate, but in service of something new. Most Democrats have been engaged for some time now in rearguard actions to protect voters from disenfranchisement efforts, and promote a remedy to the damage the Supreme Court did to the Voting Rights Act. These are important efforts, but easily countered. It isn’t unpopular to argue that voters should have to show ID, for instance, or to rail against phantom voter fraud, and it’s easy to gloss over the complex nature of the Voting Rights Act in ways that obscure the real goal of these policies, which is to systemically reduce turnout among disproportionately Democratic constituencies—the poor, the young, and ethnic minorities.
Clinton’s plan, by contrast, demands clarity from her opponents. She has proposed that every American, except those who opt out, be automatically registered to vote when they turn 18, and that every state offer at least 20 days’ worth of early voting. Republicans can’t easily oppose this—and oppose it they must—without being explicit about the fact that they want to keep the voting rolls as trim as possible.
Most Democrats likewise support President Barack Obama’s administrative efforts to liberalize immigration enforcement, and want to create a citizenship track for unauthorized immigrants. Republicans oppose both aims, but have been able to muddle that fact using vague procedural language. Generally speaking, it’s not the liberalization of immigration law they oppose, but the unilateral nature of Obama’s actions. They oppose amnesty, but keep the door to a nebulous “legal status” ajar. Both positions are malleable enough to allow the Republican presidential nominee to tack dramatically left in the general election, and gloss over the hostility the GOP has shown to immigrants since promising to liberalize after Obama’s reelection.
For over a year, Democrats humored the GOP’s wordplay in order to preserve the possibility of striking a legislative compromise that includes something Republicans could call “legal status.” Now that the immigration reform process has collapsed, Clinton has dispensed with the niceties. In promising to preserve Obama’s immigration policies, she called out “legal status” as a ruse. “When [Republicans] talk about legal status,” she said, ’“that is code for second-class status.” She has taken the standard Democratic position and weaponized it. Republicans can’t pretend there’s no daylight between their views and Democrats’ views, because Clinton has defined the Republican position for them, by contrast.
Because this kind of obscurantism pervades the GOP’s substantive agenda—through tax policy, social insurance reforms, workplace regulation—Clinton should be able to deploy the tactic across a wide array of issues. Seizing the first-mover advantage is one of the undiscussed upsides of Clinton’s dominance in the Democratic primary field. It doesn’t guarantee her victory over a Republican opponent, but it will assure that the debate between the two of them occurs mostly above board.

“Should Voting Be A Choice?”: Voter Non-Participation Is A Giant Pimple On The Face Of American Democracy
President Obama gave a rather unusual answer to a question about money in politics during an event in Cleveland this week. His antidote for the burgeoning influence of fat stacks of Supreme Court-sanctioned cash on elections was fairly simple: make everyone vote.
“If everybody voted, then it would completely change the political map in this country,” he said, adding that voting was mandatory in other countries. Universal participation would “counteract money more than anything.”
He might have a point.
Voter participation–or, more accurately, non-participation–is a giant pimple on the face of American democracy, one that the U.S. been unable to pop since the 1960s.
Every two years, an average of 56 percent of eligible voters (PDF) participate in their own self-governance, weighed heavily towards presidential contests. Midterms usually draw around 40 percent, putting 2014’s dismal effort only slightly below average.
Line that up next to other industrialized democracies and it’s not pretty. Great Britain usually gets around three quarters of its population to the polls in national elections.
Greece, the birthplace of democracy and modern geopolitical punchline, gets 86 percent. Australia’s citizens turn out in droves, averaging a 95 percent turnout down under.
How do the Aussies do it? Quite simply, they make their citizens vote–or at least show up.
They are forced to register, forced to appear at a polling station on Election Day, and forced to at least make a mark on the ballot paper. By law, they don’t actually have to choose a candidate or party, but you’d imagine the phrase “might as well” applies here.
Australia, cited by the president in his Wednesday remarks, is not the only country with compulsory voting, and not the only one to see strong turnout. Argentina has it, and usually sees around 85 percent participation. Brazil does too, and usually turns out at a rate around 80 percent. All of these are enforced compulsory systems: that is, there is a penalty (normally a fine) if a citizen cannot reasonably explain why they did not vote.
Now, none of those three are examples of ideal democratic outcomes at present, but at least they have robust participation. The United States faces a formidable participation gap, partly because, quite frankly, not enough people care.
But the U.S. has also been doing all the wrong things, policy-wise, for decades.
Rather than make it easier to vote, lawmakers here have been putting up barriers to participation.
New York and Ohio eliminated same-day voter registration in 1965 and 1977 respectively. According to political scientist Marjorie Random Hershey, turnout dropped by 7 percent in the subsequent elections and between 3 and 5 percent over the longer term (PDF). Many states have imposed early closing dates for registration, and if there were no closing date (in other words, same-day registration), some experts “estimate that…turnout would increase by 6.1 percent” across the nation. Early voting has also been scaled back in a number of states, including Ohio and North Carolina, where 7 in 10 black Americans vote early.
Then there are Voter ID laws, passed to combat the largely mythical phenomenon known as voter fraud.
To start, voter fraud does not exist in any significant sense. Out of the 197 million votes cast in federal elections between 2000 and 2005, only 26 (yes, twenty-six) votes eventually resulted in convictions for voter fraud. That is .00000013 percent, and it indicates that no one committing voter fraud could have affected any federal election in any way during that time.
Yet eight states have strict photo ID requirements to vote, and a further six have strict non-photo ID policies. And these policies can suppress the vote.
Hershey’s study cites Vercellotti and Anderson’s (2006), which found that “non-photo and photo ID rules were associated with lower turnout in 2004, in the range of 3 to 4 percent.” Laws enacted in Kansas and Tennessee dropped turnout by 2 percent between 2008 and 2012, according to the non-partisan Government Accountability Office. Texas’s policies, some of the most restrictive in the nation, were also heavily scrutinized after the 2014 election.
All of these figures are across the demographic board, leaving aside that these policies have been accused of being partisan and discriminatory, disproportionately affecting minorities and the socioeconomically disadvantaged.
Voter ID is just the latest in a long line of counterproductive policies when it comes to the ballot box. The suppression numbers associated are not huge, but there is a pile-on effect.
That’s because the decision to vote is an economic one. There’s an element of civic duty or pride, sure, but the individual essentially conducts a cost–benefit analysis with regard to how they spend their time and money. The more obstacles that are put in the way of voter participation, from restricting early voting to banning voting out-of-district to requiring IDs (which cost time and money to procure), the higher the opportunity cost and the fewer people will vote.
The end result is that the laws and regulations governing voting in some states are thoroughly undemocratic.
Thankfully, though, the U.S. is not some sort of uniformly hopeless electoral dystopia. Some states are making progress. Oregon, along with more recent converts Washington and Colorado (the Civic-Minded Stoner Bloc) has conducted all mail-in voting for years. All enjoyed turnouts of 64 percent turnout or higher in 2012, well above the national average, with Colorado at 71 percent.
This week, Oregon crossed into new territory in its efforts to get out the vote. Under the new policy, all eligible voters will be registered automatically unless they opt out. Now the Oregon secretary of state’s office will mail all voting-age citizens a ballot 20 days before any election. They need only send it back with a few marks of a pen.
Oregon’s is a step in the right direction, emphasizing ease of voting over mandates. Compulsory voting does not hold all the answers–though some political scientists credit it with as much as double-digit gains in turnout percentage–and there are other ways to avoid ghastly-looking turnout numbers. After all, Britain and Greece are doing just fine without it. Belgium, where mandatory voting policies have not been enforced since 2003, averages 90 percent turnout.
Though it would likely bring more people to the polls, it’s not immediately clear how, as the president says, mandatory voting would combat money’s influence on American politics. Maybe he’s hoping that the few people whose lives aren’t consumed by political advertisements in the run-up to Election Day–that is, who don’t own a TV or computer–would show up. Maybe his roots in community organizing tell him there’s strength in numbers, that there’s power to be found in the kind of mass participation by informed citizens that is simply lacking today.

“Pointing The Way To A New, More Offensive Effort”: Could Oregon’s Voting Law Signal A Democratic Push To Open Up Elections?
This is apparently what happens when a Democratic secretary of state — the kind in charge of elections, not the kind in charge of diplomacy — unexpectedly becomes her state’s governor:
On Monday, Oregon became the first state that will automatically register voters using information collected at the DMV.
Anyone eligible will be given an opportunity to opt out — but otherwise they become registered voters. The administration estimates that about 300,000 people will be added to the rolls, increasing the number of registered voters from 2.2 million to 2.5 million.
Federal law already requires states to allow people to register to vote while filling out paperwork for a driver’s license. Oregon’s new law will make the process automatic.
Democrats have felt no end of frustration over the spread of voter ID laws, not only because they disenfranchise huge numbers of people in the name of solving an essentially imaginary problem (in-person voter impersonation), but also because they seem almost impossible to stop. The Supreme Court has approved ID laws multiple times, even ones that are nakedly partisan, and voter ID laws are now in effect in 31 states. Republicans have also tried other ways to make registration and voting as difficult as possible, including restricting early voting. But other than mounting traditional registration and education drives and challenging new laws in court, Democrats haven’t come up with too many ways to fight back.
But Oregon could be pointing the way to a new, more offensive effort on Democrats’ part. Instead of just trying to counter Republican voting restrictions, they could find new ways to open up the voting system and get more people to the polls. This law doesn’t completely solve the problem of the unregistered (it only reaches people who have gone to get driver’s licenses or other ID from the DMV), but it goes a long way in that direction.
And critically, the Oregon law begins from the premise that everyone should be part of the electorate, and if they aren’t, then policy ought to be changed. Under the new law, you can opt out of registration if you want, but the default is that you’ll be registered. The implicit assumption behind Republican restrictions is that voting isn’t a right but a privilege, one you have to earn by jumping through a series of hoops.
We all know why that is: When you make registering and voting inconvenient or difficult, a certain number of potential voters will be eliminated from the pool, and those voters — whether because they’re younger or poorer or more minority — are more likely to vote for Democrats. You could argue that on the flip side, Democrats who want to make registering and voting easier are just as motivated by their partisan interest. Which may be true — as Sean McElwee details, a variety of studies have found that the non-voting population is substantially more liberal than the population that actually votes. But it’s still in Democrats’ favor that unlike Republicans, they’re not trying to restrict anyone’s rights in order to accomplish their goal.
Republicans claim — sometimes even without giggling — that their only concern is the integrity of the ballot and they never even consider the possibility that ID requirements will benefit their partisan interests. So they ought to be taken at their word. If we put enough effort into it, there’s no reason we couldn’t have a system that was secure and made fraud extremely difficult, but also made voting the default option. Ten states use same-day registration, which makes voting much easier, and they haven’t been overwhelmed by fraud. We ought to be able to come up with more ideas for making voting easier without sacrificing security.
Just imagine if elections were about which party or candidate was more appealing, and not about who could get more of their voters to the polls while discouraging the other party’s supporters from turning out. That would be quite something.
