“Where Is The Republican Voter Expansion Project?”: Republicans Used To Support Voting Rights—What Happened?

During a speech on Friday at the National Action Network, President Obama made his strongest and most extensive comments yet on the topic of voting rights. “The right to vote is threatened today in a way that it has not been since the Voting Rights Act became law nearly five decades ago,” Obama said. “Across the country, Republicans have led efforts to pass laws making it harder, not easier, for people to vote.”

The election of the first black president and the resurrection of voter suppression efforts was hardly a coincidence. New voting restrictions took effect in nineteen states from 2011–12. Nine states under GOP control have adopted measures to make it more difficult to vote since 2013. Since the Supreme Court gutted the Voting Rights Act in June 2013, half of the states (eight in total) previously covered under Section 5 have passed or implemented new voting restrictions.

These laws, from voter ID to cutting early voting to restricting voter registration, have been passed under the guise of stopping voter fraud, although there’s scant evidence that such fraud exists. Obama cited a comprehensive study by News21 that found only ten cases of in-person voter impersonation since 2000. “The real voter fraud,” the president said, “is people who try to deny our rights by making bogus arguments about voter fraud.”

Obama’s speech highlighted how Democratic leaders are embracing the cause of voting rights. (Attorney General Eric Holder has made it a signature issue, with the DOJ filing lawsuits against new voting restrictions in Texas and North Carolina last year.)

A day before arriving in New York, Obama spoke about civil rights at the Lyndon B. Johnson Presidential Library’s commemoration of the fiftieth anniversary of the Civil Rights Act—where the subject of contemporary attacks on voting rights came up often. “Is this what Martin Luther King gave his life for?” asked Bill Clinton. “Is this what Lyndon Johnson employed his legendary skills for? Is this what America has become a great thriving democracy for? To restrict the franchise?”

Democratic presidential hopefuls like Hillary Clinton and Joe Biden have recently championed voting rights. The Democratic National Committee has launched a new Voter Expansion Project and veterans of the Obama campaign started iVote to elect Democratic secretaries of state in Colorado, Iowa, Ohio and Nevada. Democrats hope that an appeal to voting rights will help mobilize key constituencies, like in 2012, when a backlash against GOP voter suppression efforts increased African-American turnout. “The single most important thing we can do to protect our right to vote is to vote,” Obama said on Friday.

It’s great that Democratic leaders are finally recognizing the severity of the attack on voting rights. But it’s sad that Republicans are almost unanimously supporting the restriction of voting rights rather than the expansion of the franchise.

Things weren’t always this way. In his new book about the Civil Rights Act, An Idea Whose Time Has Come, Todd Purdum tells the story of Bill McCulloch, a conservative Republican from Ohio who championed civil rights as the ranking Republican on the House Judiciary Committee. The Politico excerpt from the book was titled “The Republican Who Saved Civil Rights.”

There would have been no Civil Rights Act of 1964 or Voting Rights Act of 1965 without the support of Republicans like McCulloch and Senate minority leader Everett Dirksen of Illinois. For decades after the 1960s, voting rights legislation had strong bipartisan support in Congress. Every reauthorization of the VRA—in 1970, 1975, 1982 and 2006—was signed by a Republican president and supported by an overwhelming number of Republicans in Congress.

Republicans like Jim Sensenbrenner of Wisconsin, an heir to McCulloch who as the former chairman of the House Judiciary Committee oversaw the 2006 reauthorization of the VRA and is co-sponsoring a new fix for the VRA, used to be the norm within the GOP. Now he’s the rare Republican who still believes the GOP should remain the party of Lincoln. Where is the Republican Voter Expansion Project?

It’s also unfortunate that many in the media continue to report on voting rights like it’s a left-versus-right issue, as if supporting a fundamental democratic right suddenly makes one a flaming liberal. Jamie Fuller of The Washington Post called voting rights “the Democrats’ most important project in 2014.” Michael Shear of The New York Times dubbed Obama’s speech an effort “to rally his political base.”

The right to vote used to be regarded as a moral issue, not a partisan one. As President Johnson said when he introduced the VRA before Congress: “It is wrong—deadly wrong—to deny any of your fellow Americans the right to vote in this country.”

As long as Democrats are the party of voting rights and Republicans are the party of voter suppression, the right to vote will continue to be under siege.

“In Dire Demographic Straits”: The GOP’s New Voting Laws Are Nothing Less Than A War On Democracy

Can someone please explain to me why the New York Times’ top story from this past Sunday hasn’t provoked nationwide outrage?

Allow me to provide a handy summary: Having spent the last several years trumping up unsubstantiated charges of voter fraud in order to justify new laws and regulations making it more burdensome to vote in poor and minority (read: Democratic-leaning) districts around the country, the Republican Party has now changed tactics. In the name of enforcing the “uniformity” of voting rules, Republican governors and legislatures in a number of swing states have begun to increase the obstacles to voting still further. Some states are requiring that would-be voters show birth certificates or passports (which many poor people don’t possess), while others are curtailing the days, times, and places available to vote (which is particularly onerous for poor people who have little workplace flexibility and often lack transportation).

Let’s leave aside the spectacle of Republicans, usually our most fulsome champions of local control, suddenly banging on about the need for statewide uniformity in voting rules.

What’s far more noteworthy (and frankly pathetic) about these moves is that they’re a tacit acknowledgement by the Republican Party that it’s in dire demographic straits — and that one of the key pillars of its ideology over the last half-century is crumbling right before our eyes.

Ever since Richard Nixon claimed to speak for the “silent American majority,” the GOP has identified itself with the real America, the true America, the America of morals and faith and common sense, as opposed to the ersatz America of secular liberalism made up of judges, professors, journalists, and other elites who control the commanding heights of culture from decadent enclaves in New York and Hollywood. These elites have a pernicious influence and do a lot of damage, Republicans have maintained, but they’re vastly outnumbered by the real Americans who find their natural home in the GOP.

This ideology of righteous majoritarianism received intellectual validation from the first generation of neoconservatives, who wrote during the 1970s about the emergence of a “new class” of liberal professionals whose moral outlook differed from that of the rest of the country. Then, the ideology contributed to the rhetorical populism of the Reagan Revolution. Later, in a purer, high-octane form, it fueled the rise of right-wing talk radio, Fox News, and the rest of a conservative media infrastructure that exists to continually feed the flames of partisan fury through a potent mixture of flattery, demonization, and identity politics. “YOU are the real and righteous Americans,” these outlets tell their loyal listeners and viewers day after day, year after year, “and THEY are illegitimate, immoral imposters who have usurped political power.”

The story was always an exaggeration, but it once had a certain plausibility. Reagan won re-election in 1984 with 58.8 percent of the vote. Millions of his supporters were lifelong New Deal and Great Society liberals who jumped parties to become the fabled “Reagan Democrats.” It seemed for a time like the silent American majority had finally found its voice.

But then the numbers started heading south. George H.W. Bush succeeded Reagan with a softer 53.4 percent of the vote, and then went on to lose his bid for re-election in 1992. His son notoriously made it to the White House in 2000 despite losing the popular vote; four years later he won a majority — though, with only 50.7 percent of the vote, just barely. And it’s been downhill ever since.

The grassroots of the GOP and its media cheerleaders like to attribute the party’s losses in 2008 (McCain, 45.7 percent) and 2012 (Romney, 47.2 percent) to the party’s foolish decision to go with presidential candidates who were compromised conservatives. If only they’d chosen real Republicans!

But this is a self-serving fantasy. As John Judis and Ruy Teixeira have been arguing for years, with each election cycle providing confirmation of their thesis, the Republican Party faces a possibly intractable demographic problem — with its core voters (older white men) becoming an ever-smaller proportion of the electorate. This means that in the country’s only national election contest (the presidential vote), the popular margin is likely to swing increasingly in the direction of the Democratic Party. Unless, of course, Republicans can keep Democrats from voting.

But what about the GOP’s success at holding on to the House of Representatives in recent years? That, too, is a product of anti-democratic manipulation. The Democrats actually received more overall votes in House races in 2012 but failed to win control of the chamber because the GOP has used state-level redistricting to cram ever-greater numbers of Democrats into smaller numbers of districts, effectively decreasing their political power relative to their raw numbers.

Charming, isn’t it?

But also pitiable. Having built an ideology around the conviction that it speaks axiomatically for the real American majority, the Republican Party has become incapable of coping with evidence to the contrary — and willing to do just about anything, including subverting democracy, to maintain that fiction.

Republicans should be ashamed of themselves — and the rest of us should be disgusted.

“Three Feet Away”: Scott Walker’s Intimidation And Voter Harassment Program

There’s been a fair amount of attention lately on Gov. Scott Walker’s (R) newly imposed voting restrictions in Wisconsin, and for good reason. The governor’s latest measures appear to have only one purpose: making it more difficult for his constituents to participate in their democracy.

But last week’s new restrictions weren’t the end of Walker’s efforts. The Milwaukee Journal Sentinel reports:

Election observers could stand a few feet from voters and poll workers, under one of a series of election bills Gov. Scott Walker signed in private Wednesday.

The law would allow observers to stand 3 to 8 feet from the table where voters announce their names and addresses and are issued voter numbers, or from the table where people register to vote.

Consider a hypothetical scenario. A college student in Madison stops by a table to register to vote, and as she goes through the process, an elections “observer” stands 36 inches away, just to ensure the rules are being followed to his satisfaction. Months later, when she goes to her local voting precinct, another “observer” – again standing just 36 inches away – will oversee the process as she picks up her ballot.

This scenario will now be legal in Wisconsin.

Why in the world would GOP policymakers in Wisconsin consider this a good idea? According to the article, “Walker’s office said that the law will safeguard the fairness of elections by ensuring observers can see how they are being conducted.”

Just think, Wisconsin not only held generations of fair elections without “observers” hovering around voters, but has enjoyed one of the highest voter-participation rates in the country. Little did state residents know how flawed their system was.

Democratic opponents of the proposal warned of intimidation, voter harassment, and according to one state senator, observers “breathing down the necks of poll workers.”

They did not, however, have the votes to stop the measure.

All of this is the latest in a series of election-related policies approved by Wisconsin Republicans. In 2011, for example, they curtailed early voting statewide.

Last week, Walker went further, curtailing early voting even further, eliminating weekend voting and ending evening voting after 7 p.m.

There was no reason to impose these new voter-suppression policies and the rationales proponents came up with were easily discredited.

“Voter Outreach Is Hard, Voter Suppression Is Easy”: GOP Policies Putting New Hurdles Between Voters And Their Democracy

Every few years, Republican officials will say they need to do a better job reaching out to minorities, women, and younger voters. In each instance, GOP leaders will give every indication that they’re serious and sincere about it, because they arguably have no choice – Republicans realize their base is much older and whiter than the Democratic base, which creates a long-term demographic nightmare.

But in practice, GOP officials actually do have a choice. They could, in theory, adopt a more mainstream agenda and prioritize diversity, or they could manipulate voting laws, as they did in advance of the 2012 elections, making it easier for candidates to pick the voters they like, rather than allowing voters to pick they candidates they like.

And as it turns out, voter suppression is vastly easier than voter outreach.

Pivotal swing states under Republican control are embracing significant new electoral restrictions on registering and voting that go beyond the voter identification requirements that have caused fierce partisan brawls.

The bills, laws and administrative rules – some of them tried before – shake up fundamental components of state election systems, including the days and times polls are open and the locations where people vote.

The so-called “Republican war on voting” in 2011 and 2012 was unlike anything Americans have seen since the era of Jim Crow, but the results were not what the GOP had hoped for. The policies had some of the intended effects – voting lines in several battleground states were, as designed, ridiculously long – but it didn’t prevent Democrats from making electoral gains.

But this apparently has only encouraged many state Republican policymakers to try harder, as we’ve seen of late in Wisconsin, Ohio, and elsewhere.

In the bigger picture, North Carolina poses an especially interesting case.

As we’ve discussed, the voting restrictions imposed by North Carolina Republicans are arguably the most egregious in the nation. Democratic critics have been quick to point out that the new voter-suppression measures, according to the state’s own numbers, disproportionately affect African-American voters.

It’s led opponents of the policy to argue that the policies have nothing to do with addressing voter fraud – a problem that doesn’t actually exist in reality – and everything to do with identifying likely Democratic voters and putting new hurdles between them and their democracy.

A few months ago, as part of a legal challenge to the new restrictions, voting-rights advocates turned up the heat. Zack Roth reported in January:

North Carolina is asking a federal judge to keep secret Republican state lawmakers’ communications as they pushed through the nation’s most restrictive voting law last summer.

 “They are doing everything they can to try to keep us from finding out what they did and how they did it and who was involved,” Rev. William Barber II, the president of the state’s NAACP chapter, which is challenging the law, told reporters Thursday. “It’s time for what was done in the dark to come into the light.”

 Barber’s NAACP, backed by the Advancement Project, wants access to the lawmakers’ emails and other internal communications in order to bolster the case that the law’s Republican sponsors knowingly discriminated against racial minorities. In response, the state argued late last week that the communications are protected by legislative privilege.

Last week, as Roth and Adam Serwer reported, the voting-rights proponents scored a partial court victory.

North Carolina lawmakers who backed the state’s restrictive voting law are going to have to cough up emails and other documents related to the law’s passage, a federal judge said Thursday evening. […]

North Carolina had sought to block a demand by the civil rights groups that the state turn over documentation that could shed light on what the legislators were thinking when they passed the law. In an order released Thursday evening, Judge Joi Elizabeth Peake ordered the state to turn over some of the documents sought by the civil rights groups. […]

Thursday’s ruling didn’t give the law’s challengers everything they wanted, though. It said that emails that were shared only between legislators and their staffers might still be subject to legislative privilege, as North Carolina claims.

“A Clear Partisan Purpose”: GOP Steps Up Attack On Early Voting In Key Swing States

On Election Night 2012, referring to the long lines in states like Florida and Ohio, Barack Obama declared, “We have to fix that.”

The waits in Florida and Ohio were no accident, but rather the direct consequence of GOP efforts to curtail the number of days and hours that people had to vote. On January 22, 2014, the president’s bipartisan election commission released a comprehensive report detailing how voting could be smoother, faster and more convenient. It urged states to reduce long lines by adopting “measures to improve access to the polls through expansion of the period for voting before the traditional Election Day.”

That would seem like an uncontroversial and common sense suggestion, but too many GOP-controlled states continue to move in the opposite direction, reducing access to the ballot instead of expanding it. The most prominent recent examples are the swing states of Wisconsin and Ohio.

Yesterday Wisconsin Governor Scott Walker signed legislation eliminating early voting hours on weekends and nights, when it’s most convenient for many voters to go to the polls. When they took over state government in 2011, Wisconsin Republicans reduced the early voting period from three weeks to two weeks and only one weekend. Now they’ve eliminated weekend voting altogether.

Over 250,000 Wisconsinites voted early in 2012, one in twelve overall voters. Cutting early voting has a clear partisan purpose: those who voted early voted for Obama 58 to 41 percent in Wisconsin in 2012, compared to his 51 to 48 percent margin on Election Day. Extended early voting hours were particularly critical with respect to high voter turnout in big cities like Milwaukee and Madison. “It’s just sad when a political party has so lost faith in its ideas that it’s pouring all of its energy into election mechanics,” said Wisconsin GOP State Senator Dale Schultz, a critic of the legislation.

A month ago, Ohio passed legislation cutting early voting by a week, eliminating same-day voter registration and restricting the availability of absentee ballots while Secretary of State Jon Husted issued a directive doing away with early voting on weeknights and Sundays as well. 600,000 Ohioans, ten percent of the electorate, voted early in 2012. The cuts in Ohio, like Wisconsin, have a clear partisan and racial underpinning—in Cleveland, for example, African-Americans made up 56 percent of those who voted on weekends in 2008.

Republicans are adopting the early voting cuts under the guise of “uniformity”—claiming they want all counties to have the same hours, which punishes large urban counties if small rural counties don’t have the money or manpower for extended early voting hours.

But few believe that’s the only reason why early voting is on the chopping block. Many Republicans are predictably reluctant to admit that the main reason they suddenly disfavor early voting is because too many Democrats are using it or because they actually believe, in the words of Jonah Goldberg, that “voting should be harder, not easier—for everybody.” (See Rick Hasen’s piece “The new conservative assault on early voting.”)

The latter argument was endorsed by Florida GOP State Senator Mike Bennett in 2011, who said: “I wouldn’t have any problem making it harder…I want the people of the state of Florida to want to vote as bad as that person in Africa who’s willing to walk 200 miles…This should not be easy.”

That view was widely repudiated in the aftermath of the 2012 election, when even Florida repealed its cutbacks to early voting. A move to significantly reduce early voting recently failed in the Georgia legislature, which can hardly be described as moderate. But Republicans in Ohio and Wisconsin are stuck on the disgraced idea that the best way to win an election is to make it harder for your opponents to participate in one.
