“Our National Legacy”: North Charleston Murder Stems From American Tradition

An unarmed man shot in the back. An innocent man released after serving 30 years on death row. The centennial of Billie Holiday’s birth. These are the stories that emanated from my radio yesterday, and all bear a common thread: the devaluing of black life.

The biggest news, of course, came from North Charleston, South Carolina, where Walter Scott, an unarmed black man, was shot in the back by a white police officer after fleeing on foot from the scene of a “routine traffic stop”—also known in some parts as “driving while black.”  One difference this time: The cop was charged with murder after a damning cell-phone video, shot by a bystander, was provided to state authorities, and then posted on the website of the Charleston Post and Courier.

Scott was shot eight times. The video shows the officer, Michael T. Slager, dropping an object, which appears to be his Taser stun-gun, next to Scott’s body. Slager told his bosses that Scott had grabbed the Taser from him. In truth, it seems that what Scott was killed for was not any threat he posed to the officer’s life, but rather the ego of a white cop who couldn’t bear to have his authority defied by a black man. Think about Michael Brown and Eric Garner. Isn’t that ultimately why they died?

It may seem that police killings of black people—and general harassment of African Americans by law enforcement—are on the rise, but chances are that they are not. Chances are better than good that this is the way it’s always been. It’s just that citizens are now able to shoot videos with their phones, and to take to social media to howl about injustice the moment it occurs.

Take the case of Anthony Ray Hinton, 58, just released from Alabama’s death row after spending half his life there for two 1985 murders he didn’t commit. His conviction was based on police assertions that the bullets found at the scene of the crime matched a gun found in his mother’s house. But, when both were tested decades later, they didn’t. Here’s how Hinton explained his predicament to the BBC:

He said he was told by police the crime would be “put on him” and there were five things that would convict him.

“The police said: ‘First of all you’re black, second of all you’ve been in prison before, third, you’re going to have a white judge, fourth, you’re more than likely to have a white jury, and fifth, when the prosecution get to putting this case together you know what that spells? Conviction, conviction, conviction, conviction, conviction.’ He was [right] and that’s what happened.”

He said: “I think if I’d have been white they would have tested the gun and said it don’t match and I would have been released, but when you’re poor and black in America you stand a higher chance of going to prison for something you didn’t do.”

Yesterday also brought human-interest stories marking 100 years since the birth of the great jazz innovator, Billie Holiday—meaning that, if, like me, you listen to the kind of radio that celebrates America’s classical music (because that’s what jazz is), you may have caught the iconic strains of Holiday’s brutally graphic tour de force lament of lynching, the centuries-old practice of white mobs hunting down a black person, torturing and mutilating that person, and then usually hanging the body from a tree. For those unfamiliar, here are the opening lines (lyric by Abel Meeropol):

Southern trees bear a strange fruit

Blood on the leaves, and blood at the root

Black body swingin’ in the Southern breeze

Strange fruit hangin’ from the poplar trees

But you should really listen to the whole thing. Every American should. In fact, it should be part of the Common Core curriculum. Because until we understand this legacy—our national legacy—it’s hard to see how things will ever truly change, except, perhaps, by matter of degree.

“Freedom To Discriminate”: We’ve Been Here Before; “No Negroes, No Mexicans, No Dogs Allowed”

In 1942, with the United States newly entered into the Second World War, the Lonestar Restaurant Association in Texas printed flyers for its members to paste on their windows that read: “No Negroes, Mexicans or Dogs Allowed.”That iconic and painful reminder of America’s history of discrimination came to mind in recent days as I listened to Indiana Governor Mike Pence struggle through a mind-numbingly contorted defense of his state’s recently enacted Religious Freedom Restoration Law. Let’s be clear that what Gov. Pence singed into law has little to do with religious liberty and a lot to do with the desire to discriminate against entire sectors of our society but especially gay, lesbian, bisexual and transgendered Americans. We’ve been here before.

In the ’40s and ’50s, as the civil rights movements in Black and Latino communities gathered steam and pushed against the barriers of public and private racism and discrimination, some state governments and businesses responded by claiming that desegregation was an attack on their freedom to choose with whom to share classrooms, bathrooms, restaurants, train stations and the like. In short, they equated their freedom to discriminate with other Americans’ claims to equality. Looking back, we can take great comfort and pride that when faced with this false choice, Americans almost always chose equality.

Yet the battle for equality isn’t over; it never is. This time, the targets of discrimination are gay, lesbian, bisexual and transgender Americans. This time, the discrimination cloaks itself in the mantle of religious liberty and “freedom of conscience.” This time, the forces of discrimination have cast themselves as a persecuted minority, fending off attacks against their most sacred religious values. Nonsense. No law in this country compels a religious person to act against their religious values and ideals. No law compels that churches or mosques celebrate marriages for gays and lesbians. No law compels a rabbi, pastor or imam to give a religious benediction to homosexuality.

What the law does compel, however, is that one not discriminate in business or in government against a person for their appearance, their nationality, their color, their creed, and, yes, their sexual orientation. That’s not an attack against religious liberty; it’s a defense of American values.

For many Latinos across the country, gay and straight, this Indiana law and its companion in Arkansas, are a painful reminder of our own struggle for equality in the United States. When we see what is happening in Indiana and Arkansas and other states across the country, we recognize the discrimination because we have been and are still its targets. We see it today with attempts to pass anti-immigrant laws in Arizona, Alabama, Pennsylvania and elsewhere. And because of these historic and ongoing struggles, we cannot be silent in the face of these deeply un-American acts. We will not be silent.

The defenders of discrimination and bigotry may control many statehouses and governor’s mansions in this country, but they’re on the wrong side of history. Americans of good conscience will always rise up in defense of equality. We know. We’ve been here before.

“Ferguson, Missouri, Is Not An Exception”: The Whole Darn Country Has A Habit Of Racially Stratified “Justice”

By now, it should come as news to no one that Ferguson, Missouri, has a lousy excuse for a police department.

The behavior of many of its officers, as seen in news reports during last year’s protests and rioting over the shooting of Michael Brown, was thuggish, unprofessional, and contemptuous of the people they supposedly serve. Still, it’s welcome news that a new Justice Department report quantifies the department’s failings, vindicating the mostly African-American populace that has complained about them for years.

It lacerates Ferguson for “a pattern or practice of unlawful conduct … that violates the First, Fourth and Fourteenth Amendments … and federal statutory law.” Ferguson police, according to the report, treat the mostly black and largely poor inhabitants of the St. Louis suburb as a municipal money machine. “City and police leadership,” says the report, “pressure officers to write citations independent of any public safety need, and rely on citation productivity to fund the City budget.”

We also learn that Ferguson police are in the habit of harassing and arresting people without any legal basis. One man, for example, was sitting in his car when an officer approached and, without a shred of reason, called him a pedophile and demanded to search the vehicle. When the man declined, citing his Fourth Amendment rights, the officer is said to have pointed a gun to his head and arrested him. He ended up charged with eight counts, including “making a false declaration.”

It seems that when asked for his first name, he gave a shortened version: “Mike” instead of “Michael.” The man lost his job because of that arrest.

That race is at the root of this mistreatment is attested to by statistics. For instance, the report tells us black drivers in Ferguson are more than twice as likely as white ones to be searched during traffic stops even though white drivers are significantly more likely to be found with contraband. It’s also attested to in emails sent by city officials, such as a “joke” about an African-American woman who has an abortion and is later sent a reward check from Crimestoppers.

That the Justice Department released this report at the same time it exonerated Officer Darren Wilson in the Brown shooting seems designed to make a point: That particular Ferguson police officer may not be guilty, but the Ferguson Police Department most certainly is.

Even that condemnation, though, is ultimately too small. To process this report as just an indictment of one small town is to provide an escape hatch for the many people disinclined, through their own lack of moral courage and intellectual honesty, to admit that the whole darn country has a habit of racially stratified “justice.” We miss the point if we treat Ferguson as some bizarre exception.

So let’s close the escape hatch. Ferguson’s statistics are not shocking. To the contrary, they are replicated nationally. And the Kafkaesque experience of “Michael” reflects everyday reality: Last January, a black man named Chris Lollie was arrested in St. Paul, MN for sitting on a public bench in a skyway between buildings, waiting for his children to get out of school. In September, a black man named Levar Jones was wounded by a state trooper in Columbia, SC, who shot him while he was obeying the trooper’s orders. Last Thanksgiving, a black man named Brandon McKean was stopped in Pontiac, MI, for walking with his hands in his pockets in 32-degree weather.

And so on. Black men and women being manhandled, mistreated and misjudged by the “justice” system is the opposite of uncommon. To whatever degree we pretend the biggest issue here is the sins of one small town, we sanction that ongoing injustice and postpone a reckoning long overdue.

Ferguson is not an exception. It’s an example.

“In Concert With U.S. History”: America’s ‘Ferguson’ Confusion; Why The Problem Has Been Completely Misunderstood

Before I had a chance to peruse the Department of Justice’s long-awaited report on the killing of Michael Brown by former Ferguson, Missouri, police officer Darren Wilson, I had three predictions. The first was that the DOJ would find the city of Ferguson’s finances to be a house of cards built upon a foundation of anti-tax absolutism and white supremacy. That’s what the Washington Post’s Radley Balko found last September, and while I may not share Balko’s libertarian politics, he’s a good journalist, and that report — which described the criminal justice system in St. Louis County as one “guaranteed to produce racial conflict, anger, and resentment” —  is an excellent piece of investigative work.

My second prediction about the DOJ report was that it would find the Ferguson Police Department to be rife with bigotry, which would manifest itself most conspicuously through emails filled with the kind of racist “jokes” that many Americans prefer to call “politically incorrect.” I guessed this not because I had any special insight into the office culture of the Ferguson PD, but because the embarrassing disclosure of racist jokes disseminated among employees by email has become a recurring media story throughout the Obama years. And if the problem is widespread enough to infect the self-styled Hollywood progressives at Sony, it’s hardly a stretch to figure it’s prevalent within a police force with as much historical baggage as Ferguson’s, too.

My third and final prediction, meanwhile, was that the media’s coverage of the DOJ report would devote much more attention to the second prediction (the racist emails) than the first (the systemic dysfunction); and that the response on the part of Ferguson’s civilian leadership would similarly concern itself more with “politically incorrect” jokes than with institutional corruption. I imagined that it would play out this way primarily because that’s how it always does. For a recent example, look no further than former Los Angeles Clippers owner Donald Sterling, who saw a decade-spanning empire, which was always fundamentally built on an edifice of bigotry, crumble because he was caught saying what any right-minded person already assumed him to think.

Well, now that the DOJ report has finally been released, and now that I can look back with the benefit of hindsight, the verdict is in. And wouldn’t you know it, I went three-for-three. The report says the Ferguson PD is structurally driven to extort its African-American subjects to fill budget gaps. It also says the Ferguson PD’s email server was a like an online Comedy Cellar for the kind of racist jokes that middle schoolers tell one another when trying to be edgy. And the media has since devoted far more time and digital ink to cataloging jokes unworthy of even Carlos Mencia than it has explaining how a municipality could allow itself to so obviously rely on a system of race-based plunder.

What’s more, the early indications from authorities in Ferguson suggest that I was right to expect their response to focus primarily on the nasty jokes. Ferguson Mayor James Knowles III, last seen informing the folks at MSNBC that his city suffered from “no racial divide,” was quick to respond to the DOJ’s damning report — by firing or placing on administrative leave three officers involved with the racist emails. While he refused to answer any questions, Knowles also informed the media that the police department had recently hired three African-American women, was launching programs intended to build a stronger relationship with Ferguson’s African-American communities, and would institute mandatory diversity training for staff. Knowles also mentioned a few administrative tweaks intended to make the city’s criminal justice system less rapacious, but he also said “there is probably another side to all of [the DOJ report’s] stories.” Gotta hear both sides.

Before you start trying to make “Isquith” and “Nostradamus” rhyme, however, you should be aware of a few realities (besides that being impossible, I mean). For one thing, I’d strongly suspect my predictions were widely shared by those in the American media who focus on politics and race because, again, this story is fundamentally nothing new. For another, not everyone in the media chased the shiny red ball of racist emails, which aren’t even bad in themselves, anyway, but are simply too numerous. Lastly, while it’s very tempting to throw all of our culture’s shortcomings on these issues at the feet of the media — which, to be clear, is far from blameless — the press’s failures here are the result of larger, society-wide problems that are more deep-seated than our fondness for listicles or our penchant for calling others out.

Because, as Ta-Nehisi Coates implies in his response to the DOJ report, one of the major stumbling blocks separating the Fergusons of today from what a city in the United States is supposed to be is a level of historical ignorance and denial that makes confronting white supremacy head-on all but impossible. So long as the mainstream refuses to own up to the way race-based plunder is not contrary to but rather in concert with U.S. history, we will continue to understand racism as what happens when a bunch of mean cops sit around forwarding each other racist jokes. And until we’re willing to recognize that Ferguson is New York City is Los Angeles is Chicago and so on, fewer “politically incorrect” emails is all the change we’re going to get.

“A Quintessentially American Experience”: Black History Is More Than Just One Month

Is it already that time of year?

It must be: Black lecturers are busy on the speaking circuit; black authors have been pushed to the front shelves of bookstores; schoolteachers, black, white and brown, are teaching their charges how George Washington Carver, ah, invented the peanut.

It’s Black History Month, that annual tribute to the accomplishments of black Americans, whose ingenuity, perseverance, creativity and fortitude made America what it is today. But there is a problem with the yearly observance: It manages to make black history seem a thing apart, a separate reality, a slender appendix to the encyclopedia of American history.

It isn’t. Black history is American history — baked and bricked into the nation’s foundations. And that’s how it ought to be taught, right in the same volumes as the Boston Tea Party, the settling of the Old West, the defeat of the Nazis. Black Americans were part of each of those monumental chapters, as well as countless less-celebrated episodes.

It’s time to retire the annual celebration, as outdated now as rotary phones, segregated drinking fountains, and the term “Negro.” Ask yourself this: Will the current occupant of the White House — president of all of the United States, not merely of its black citizens — be celebrated only in February?

Carter Woodson, a black historian, started Negro History Week in 1926, when racism was still raw, public accommodations segregated and the Ku Klux Klan a powerhouse. The notion that black Americans were intellectually inferior and that they should be assigned a second- (or third- or fourth-) class status was taken for granted by most whites, including the leadership classes.

Woodson saw that black contributions to American history “were overlooked, ignored, and even suppressed by the writers of history textbooks and the teachers who use them.” He began a systematic study of black history and chose a week in February to commemorate it — timed to honor the birthdays of Abraham Lincoln, Feb. 12, and famed abolitionist Frederick Douglass, Feb. 14.

Happily, much has changed since then. Monuments stand to honor the accomplishments of black Americans, from the Buffalo Soldiers who served in segregated cavalry units after the Civil War, to the Rev. Dr. Martin Luther King Jr., who became the first black American to be commemorated on the National Mall in Washington, D.C.

Movies celebrate the bravery of the Tuskegee Airmen, who persevered at a time when most whites didn’t believe black men were capable of becoming fighter pilots. There is even a Smithsonian-run National Museum of African-American History and Culture, designed to “educate generations to come,” under construction on the National Mall.

(Yes, there is irony in the notion of a separate black history museum. But founding director Lonnie Bunch has promised that it will allow visitors to delve “deeply into the African-American experience and understand that … it is a quintessentially American experience.”)

Many black Americans would argue that Black History Month is still necessary in a land where racism, though waning, continues to exert a peculiar power. There are its blatant manifestations, evident in police brutality and in prison populations. Then there are its more subtle signs, such as research into hiring practices that shows applicants with “black” names are less likely to get jobs, regardless of their stellar résumés.

Moreover, the dominant culture remains reluctant to acknowledge the essential Americanness of its black members. We remain exotic, the other, ethnics. A vocal minority of white citizens continues to insist that President Obama is illegitimate, a foreign-born usurper. The “girl next door” is blonde; the superhero is blue-eyed.

Unfortunately, though, Black History Month merely reinforces that fundamental bias. The one-month observation — ironically, the shortest month of the year — keeps our history away from mainstream history. Instead, it should be included in every history text, taught in every history class, commemorated in every history museum — from maritime to martial, from agricultural to architectural.

The story of America is accurately told only when the stories of black Americans are included in every month of the year.
