“Humanae Vitae”: Birth Control, Bishops And Religious Authority

The Obama administration’s ruling requiring certain Catholic institutions like hospitals and universities to offer health insurance covering birth control prompted a furious response from the Catholic bishops.  The bishops argued that this was a violation of conscience since birth control is contrary to teachings of the Catholic Church, as expressed in Pope Paul VI’s 1968 encyclical “Humanae Vitae.”

What interests me as a philosopher — and a Catholic — is that virtually all parties to this often acrimonious debate have assumed that the bishops are right about this, that birth control is contrary to “the teachings of the Catholic Church.” The only issue is how, if at all, the government should “respect” this teaching.

As critics repeatedly point out, 98 percent of sexually active American Catholic women practice birth control, and 78 percent of Catholics think a “good Catholic” can reject the bishops’ teaching on birth control.  The response from the church, however, has been that, regardless of what the majority of Catholics do and think, the church’s teaching is that birth control is morally wrong.  The church, in the inevitable phrase, “is not a democracy.”   What the church teaches is what the bishops (and, ultimately, the pope, as head of the bishops) say it does.

But is this true?  The answer requires some thought about the nature and basis of religious authority.  Ultimately the claim is that this authority derives from God.  But since we live in a human world in which God does not directly speak to us, we need to ask, Who decides that God has given, say, the Catholic bishops his authority?

It makes no sense to say that the bishops themselves can decide this, that we should accept their religious authority because they say God has given it to them.  If this were so, anyone proclaiming himself a religious authority would have to be recognized as one.  From where, then, in our democratic, secular society does such recognition properly come?  It could, in principle, come from some other authority, like the secular government.  But we have long given up the idea (“cujus regio, ejus religio”) that our government can legitimately designate the religious authority in its domain.  But if the government cannot determine religious authority, surely no lesser secular power could.  Theological experts could tell us what the bishops have taught over the centuries, but this does not tell us whether these teachings have divine authority.

In our democratic society the ultimate arbiter of religious authority is the conscience of the individual believer. It follows that there is no alternative to accepting the members of a religious group as themselves the only legitimate source of the decision to accept their leaders as authorized by God.  They may be wrong, but their judgment is answerable to no one but God.  In this sense, even the Catholic Church is a democracy.

But, even so, haven’t the members of the Catholic Church recognized their bishops as having full and sole authority to determine the teachings of the Church?  By no means.  There was, perhaps, a time when the vast majority of Catholics accepted the bishops as having an absolute right to define theological and ethical doctrines.  Those days, if they ever existed, are long gone.  Most Catholics — meaning, to be more precise, people who were raised Catholic or converted as adults and continue to take church teachings and practices seriously — now reserve the right to reject doctrines insisted on by their bishops and to interpret in their own way the doctrines that they do accept.  This is above all true in matters of sexual morality, especially birth control, where the majority of Catholics have concluded that the teachings of the bishops do not apply to them.  Such “reservations” are an essential constraint on the authority of the bishops.

The bishops and the minority of Catholics who support their full authority have tried to marginalize Catholics who do not accept the bishops as absolute arbiters of doctrine.  They speak of “cafeteria Catholics” or merely “cultural Catholics,” and imply that the only “real Catholics” are those who accept their teachings entirely.  But this marginalization begs the question I’m raising about the proper source of the judgment that the bishops have divine authority.  Since, as I’ve argued, members of the church are themselves this source, it is not for the bishops but for the faithful to decide the nature and extent of episcopal authority.  The bishops truly are, as they so often say, “servants of the servants of the Lord.”

It may be objected that, regardless of what individual Catholics think, the bishops in fact exercise effective control over the church.  This is true in many respects, but only to the extent that members of the church accept their authority.  Stalin’s alleged query about papal authority (“How many divisions does the Pope have?”) expresses more than just cynical realpolitik.  The authority of the Catholic bishops is enforceable morally but not militarily or politically.  It resides entirely in the fact that people freely accept it.

The mistake of the Obama administration — and of almost everyone debating its decision — was to accept the bishops’ claim that their position on birth control expresses an authoritative “teaching of the church.”  (Of course, the administration may be right in thinking that the bishops need placating because they can cause them considerable political trouble.)  The bishops’ claim to authority in this matter has been undermined because Catholics have decisively rejected it. The immorality of birth control is no longer a teaching of the Catholic Church.  Pope Paul VI meant his 1968 encyclical, “Humanae Vitae,” to settle the issue in the manner of the famous tag, “Roma locuta est, causa finita est.”  In fact the issue has been settled by the voice of the Catholic people.

“Total Self-Absorption”: Newt’s Toxic Narcissism

Before he dumped Marianne for Callista, Newt Gingrich approached his second wife of 18 years with the possibility of an open marriage.

I ask you: how awesome is that?

In an interview airing tonight on Nightline, Marianne recalls Newt complaining to her. “You want me all to yourself. Callista doesn’t care what I do.”

Assuming Marianne can more or less be believed, let’s update what we now know of the former speaker’s personal history:

1.  Gingrich dumped his first wife, Jackie, while she was being treated for cancer.

2.  Some 12 years into his second marriage, he started sleeping with a much younger Hill staffer.

3.  Six years into the affair, he asked wife No. 2 for an open marriage.

4.  When she declined, Newt pressed ahead with a divorce—shortly after Marianne was diagnosed with multiple sclerosis.

5.  The dissolution of Newt and Marianne’s union occurred as the then-speaker was galumphing around the country loudly proclaiming President Clinton to be morally unfit for office.

My God, it’s like a bad telenovela—only starring homely people.

I have to admit, while the tales of Gingrich’s mistreatment of the women in his life are, of course, appalling, I also find them utterly irresistible—and more than a little satisfying. Not because I care about Gingrich’s rank hypocrisy. Unlike many journalists, hypocrisy isn’t what gets my blood boiling. All politicians are hypocrites to one degree or another. They have to be.

No. What entrances me about these Newtonian love stories are how perfectly they jibe with the former speaker’s broader character portrait: namely, that of a pure, unadulterated narcissist, a man whose sense of himself as a world historic figure leads him to believe that whatever is good for him must be what is good. Period. In Gingrich’s worldview, the end justifies the means—and the end is invariably the advancement of Newt Gingrich’s personal aims.

The entire sweep of Newt’s personal life brings to mind a line from Whit Stillman’s 1990 film, Metropolitan, in which one of the cast of young, rich Manhattanites scolds another, “When you’re an egoist, none of the harm you do is intentional.”

I’d say that this line could apply to all aspects of Newt’s life except that, in many of his political dealings, Newt absolutely intends to cause harm. Demonizing the opposition is frequently his aim, and his aim in that department tends to be quite good.

But with his wives, one gets the sense that Gingrich never set out to hurt anyone. He simply didn’t give a damn—or at least enough of a damn to make an effort to minimize damage to the other person on his way out the door.

Lots of people cheat on their spouses. Lots of people leave their spouses. It takes a special kind of ego to carry on a lengthy affair with another woman, then grandiosely suggest to your wife: so howzabout you content yourself with just a slice of Newt pie and agree to share the rest?

Hypocrisy, infidelity, dishonesty, immorality—none of those interest me here. When it comes to Newt, the ultimate driver—and the biggest danger—has always been the man’s total self-absorption and near-messianic self-regard.

That ought to make even the most devout Newt fan a little nervous.

“Classless Chris Christie”: There’s Just Nothing Admirable About A Bully

I don’t find much to like about New Jersey Gov. Chris Christie (R). Political reporters tend to adore the guy — I guess for some, the “loveable loudmouth” is an archetype with appeal — but I find his policy agenda misguided, his incessant whining about President Obama misguided, and his approach to governing deeply irresponsible.

But on a more personal level, I just wish the guy had a little more class. Torie Bosch had this piece today on Christie’s ugliness yesterday.

On Sunday, Jan. 8., New Jersey Gov. Chris Christie was speaking at a Romney for President rally in New Hampshire when he was interrupted by some female hecklers. It’s difficult to make out exactly what Christie’s critics were yelling, but it’s something to do with jobs going down. Ever the class act, Christie’s response: “You know, something may be going down tonight, but it ain’t going to be jobs, sweetheart.” […]

The video … was uploaded to the New Jersey GOP’s YouTube account. They seem to think his remark about “going down” is a zinger, something to be proud of, rather than recognizing it as flagrantly demeaning, even misogynistic. How would Christie have responded to male protesters saying the same thing? Probably not by changing the subject to what acts they perform in the bedroom.

This fits in, unfortunately, with a larger pattern. Christie has a habit of trying to shout down anyone who challenges him, and the governor and his staff tend to be only too pleased to record the incidents and promote them. The public is apparently supposed to be impressed by his outbursts.

There’s just nothing admirable about a bully.

For that matter, governors — and presidential campaign surrogates, for crying out loud — should have a little better sense than to think cheap oral-sex jokes targeted at women protestors are acceptable.

The Legacy Of The Clarence Thomas-Anita Hill Hearings

Even now, with the healing distance of two decades, the subject of Anita Hill and Clarence Thomas retains its power to provoke and divide.

It was 20 years ago this month that Hill’s allegations of sexual harassment surfaced, threatening to derail Thomas’s imminent confirmation to the Supreme Court. I spent the weekend-long marathon of hearings in the Senate Caucus Room, the majestic setting of soaring marble columns and gilded ceiling contrasting with the squalid details of Hill’s allegations.

 It was both riveting and horrifying. By the time the Senate Judiciary Committee hearings were gaveled to a close at 2 a.m. Monday, I — like everyone else — was simply relieved that it was over.

Looking back, it is possible to trace the larger cultural and political legacy, both good and bad, of that painful moment.

First, the Thomas-Hill hearings heralded a coarsening of the national dialogue. It goes too far to suggest cause and effect; there is no straight line between the hearings and, say, wardrobe malfunctions or “Jersey Shore.” But the hearings, with their nationally televised discussion of Thomas’s alleged tastes in pornography and his explicit overtures, crossed an invisible line into a cruder culture.

A few years earlier, I had covered a trial involving a sexual act that the existing stylebook would let me describe, rather misleadingly, only as “sodomy.” A few years later, the nation found itself in a graphic discussion about the precise meaning of “sexual relations” and the DNA evidence on Monica Lewinsky’s blue dress.

The intervening experience of the Thomas-Hill hearings, with the discussion of Thomas’s alleged interest in “Long Dong Silver” and commentary about pubic hair on a Coke can, helped define deviancy downward. As we sat at the press table during the most explicit testimony, the New York Times reporter turned to me, a stricken look on his face, and asked how we were going to write about all this, given our newspapers’ notorious queasiness about sexual matters. In the end, our stories were unexpurgated.

Second, the hearings heralded — although again they did not create — an intensifying of the partisan divide. The 1987 fight over the failed nomination of Robert Bork was intense but nowhere near as personal or partisan.

As with the Clinton impeachment several years later, the Thomas nomination witnessed each side automatically lining up in support of, or in opposition to, the protagonist. Senators who wanted to see Thomas on the high court credited his version of events; those who wanted him defeated for other reasons chose to believe Hill. The facts themselves took second place to political interests.

Indeed, the very women’s groups most exercised about Thomas’s alleged misconduct were notably, shamefully silent when it came to Clinton’s behavior with a White House intern and his false statements under oath.

In hindsight, the Thomas confirmation seems almost quaint, with the Senate’s majority vote in favor of the nominee. The possibility of a filibuster was bargained away early on. Today, an option that once seemed nuclear has become the norm.

The third legacy of the Thomas hearings is a positive one: lower tolerance for sexual harassment and greater political prominence for women. Back then, an all-male Senate Judiciary Committee was inclined to ignore the Hill allegations. That would not happen today, with two women on the panel, California Sen. Dianne Feinstein and Minnesota Sen. Amy Klobuchar. Two women served in the Senate in 1991; there are 17 today.

As to sexual harassment, of course such behavior still occurs and some women still endure it, rather than speak out. But Hill’s reluctant testimony educated and chastened many men, and it emboldened many women. The workplace of 2011 may not be perfect, but it is a better, fairer place.

For me, the final legacy of the hearings is entirely personal: It’s how I met my husband, who worked on the committee staff for a Democratic senator. Late on the weekend that the Hill story leaked, as I was scrambling to confirm it, he returned my phone call, explaining that he had been away at his grandmother’s 90th birthday party.

Who, he asked, was Anita Hill? He seemed like a nice guy, so with uncharacteristic patience, I brought him up to speed, instead of following my instinct to pronounce him useless and hang up. It was only months later — after we started dating — that I discovered he was feigning ignorance out of professional caution.

Twenty years and two beautiful children later, I still believe Anita Hill. But I owe an odd, unpayable debt to Justice Thomas.

With HPV Vaccine Rumors, Michele Bachmann Is The New Joe McCarthy

Joe McCarthy knew how to rile up the base. He knew his political hot buttons. He knew how to stoke fear and create a movement. He knew how to build a following by ratcheting up the rhetoric, the facts be damned.

Sadly, Rep. Michele Bachmann has followed in his mold: questioning the  patriotism of members of Congress, fanning the flames of hatred of gays  and lesbians and, now, attacking the vaccine to prevent cervical cancer.

This  HPV political maneuver may be her last. This should be her “have you no  sense of decency” moment, just as the Army-McCarthy hearing was in the  1950s.

Somehow, the anti-vaccine movement has gained steam in the United  States. Rumors that traditional vaccines caused autism began to spread.  They were disproved but not before many parents declined to vaccinate  their children.

A Science Times article in the New York Times (“Remark on  Vaccine Could Ripple for Years”) points to a three to four year drop in  vaccination rates after such publicity. Diseases such as measles and  whooping cough, supposedly under control, have seen outbreaks. According  to the Times, “measles cases in the United States reached a 15-year high last spring. ”

The  HPV virus is, unfortunately, far too common. More than 25 percent of  women 14 to 49 have been infected, 44 percent in the 20 to 24 age range.  Not only can HPV cause cervical cancer but it can cause other cancers  as well.

Last year only 32 percent of teenage girls had been given the vaccine.

If Michele Bachmann’s scare tactics prove true to form, there will be  a drop in the number of girls and women protected. By putting out false  information, by repeating the statement of someone at the debate that  the vaccine caused mental retardation, she set back the effort to save  women’s lives. Hardly a pro-life position.

In fact, the vaccine can prevent unnecessary surgery for several  hundred thousand women a year and even allow women to successfully carry  a pregnancy to term.

Over 35 million doses have been distributed without any serious side  effects. Thank goodness doctors and clinics and reputable research  organizations moved quickly to take on Michele Bachmann.

But,  make no mistake, she even stayed on the issue in Thursday’s debate. This  woman won’t quit, no matter the facts or the implications of her  actions.

She sees a political opening and she takes it, she sees a chance to  rile the base and she seizes it, she sees a good sound bite and off she  goes.

If, in fact, the experts are correct and this will set back  vaccinations for years, Bachmann will need to do more than apologize for  her McCarthy-like tactics. As he ruined innocent lives, she may  responsible for doing the same. She will have to look herself in the  mirror and know that her actions led to more women losing their lives.
