“Wrong Kind Of People”: The GOP’s Crime Against Voters
Spare us any more hooey about “preventing fraud” and “protecting the integrity of the ballot box.” The Republican-led crusade for voter ID laws has been revealed as a cynical ploy to disenfranchise as many likely Democratic voters as possible, with poor people and minorities the main targets.
Recent developments in Pennsylvania — one of more than a dozen states where voting rights are under siege — should be enough to erase any lingering doubt: The GOP is trying to pull off an unconscionable crime.
Late last month, the majority leader of the Pennsylvania House of Representatives, Mike Turzai, was addressing a meeting of the Republican State Committee. He must have felt at ease among friends because he spoke a bit too frankly.
Ticking off a list of recent accomplishments by the GOP-controlled Legislature, he mentioned the new law forcing voters to show a photo ID at the polls. Said Turzai, with more than a hint of triumph: “Voter ID, which is gonna allow Governor Romney to win the state of Pennsylvania — done.”
That’s not even slightly ambiguous. The Democratic presidential candidate has won Pennsylvania in every election since 1992. But now the top Republican in the Pennsylvania House is boasting that, because of the new voter ID law, Mitt Romney will defy history and capture the state’s 20 electoral votes in November.
Why on earth would Turzai imagine such a result? After all, the law applies to all voters, regardless of party affiliation. It is ostensibly meant only to safeguard the electoral process and eliminate fraud. Why would a neutral law have such partisan impact?
Thanks to figures released last week by state officials, we know the answer. It turns out that 758,939 registered Pennsylvania voters do not have the most easily obtained and widely used photo ID, a state driver’s license. That’s an incredible 9.2 percent of the registered electorate.
Most of the voters without driver’s licenses live in urban areas — which just happen to be places where poor people and minorities tend to live. More than 185,000 of these voters without licenses, about one-fourth of the total, live in Philadelphia — which just happens to be a Democratic stronghold where African Americans are a plurality.
Could suppressing the urban minority vote really give Pennsylvania to Romney? It probably wouldn’t have made a difference in 2008, when Obama trounced John McCain handily. But the statewide contest is often much closer — and turnout in Philadelphia typically is key to a Democratic candidate’s prospects. In 2004, for example, John Kerry’s margin over George W. Bush in the state was a mere 144,248.
Perhaps these numbers are so intoxicating that Turzai forgot the cover story about how voter ID is supposed to protect the franchise rather than selectively restrict it. His spokesman later explained that Turzai meant “the Republican presidential candidate will be on a more even keel thanks to voter ID” — in other words, there will be a level playing field once the new law eliminates all that pesky voter fraud.
That might be reasonable, except for one fact: There’s no fraud to eliminate.
Prodded by GOP political activists, the Justice Department under Bush conducted an extensive, nationwide, five-year probe of voter fraud — and ended up convicting a grand total of 86 individuals, according to a 2007 New York Times report. Most of the cases involved felons or immigrants who may not have known they were ineligible to vote.
Not one case involved the only kind of fraud that voter ID could theoretically prevent: impersonation of a registered voter by someone else. Pennsylvania and other voter ID states have, in essence, passed laws that will be highly effective in eradicating unicorns.
The Pennsylvania law and others like it are under attack in the courts; this week, a federal three-judge panel in Washington is hearing arguments on Texas’s year-old law, with a ruling expected next month. Meanwhile, Michigan Gov. Rick Snyder, a conservative Republican, broke with orthodoxy last week and vetoed bills that would have toughened an existing voter ID statute. Maybe the tide is turning. If it doesn’t, these laws will potentially disenfranchise or discourage millions of qualified voters.
In a previous column, I wrote that voter ID was a solution in search of a problem. I was wrong: The problem seems to be that too many of the wrong kind of voters — low-income, urban, African American, Hispanic — are showing up at the polls. Republican candidates have been vowing to “take back” the country. Now we know how.

“Money In, People Out”: The Twin Pillars Of The GOP’s Voter Disenfranchisement 2012 Plan
Mitt Romney escaped the record heat this weekend by attending several parties in his honor in the Hamptons. Early predictions were that one afternoon in this elite enclave would net the candidate more than $3 million for his campaign.
Less than 200 miles away in Philadelphia, where the median income hovers at $36,000 and a quarter of the city lives below the poverty line, there were no beach parties, but some disturbing news. The Philadelphia Inquirer reported that state election officials upped the number of statewide voters potentially affected by the new voter ID laws from the 90,000 that Governor Corbett claimed to 758,000. A full 9.2 percent of the state’s eligible voters could be turned away from the polls in November, despite being eligible. In Philadelphia, where over half of the city’s residents are people of color, 18 percent of registered voters lack proper ID under the state’s new laws—laws that Pennsylvania House leader Mike Turzai claimed will deliver the state to Romney in November.
These twin anecdotes seem to perfectly capture the GOP 2012 plan for victory: “voters out, money in.” Despite the massive capital advantage the Republicans have accrued, they’re still driving a strategy of disenfranchisement and destruction that imperils our democracy and seeds distrust among a populace already experiencing record lows of confidence in their elected leadership.
Next week, pundits will be hyperventilating over the political fundraising totals from the last quarter. The cover of the Sunday NY Times Magazine breathlessly asks the rhetorical question, “Can Democrats Catch Up in the Super-PAC game?” Let’s get it clear: no, they can’t and no one ever claimed they could. But they also don’t need to—what they need is to raise some money, spend it smarter than their counterparts, and provide millions of people the legal means and the emotional desire to exercise their constitutional right to vote. The right understands this key to Democratic victory, which is why outraising is not enough. Victory requires dominating the system at both ends.
More than two dozen states have passed voter ID laws, with eleven passing in the last two years. Republicans, sensing the opportunity, have continually hyped the negligible threat of voter fraud in order to make voting tougher and tougher for the elderly, the poor, Latinos and African-Americans—all of whom tend to lean Democratic. Meanwhile, back in April, casino magnate Sheldon Adelson gave $10 million on one day to Romney Super PAC, Restore Our Future. Combined with $20 million to Newt Gingrich’s failed bid plus millions more to Rove and Koch brothers front groups, Adelson has given close to $60 million all told, and has stated publicly that he’ll spend up to $100 million to defeat Barack Obama.
What’s driving these actions at both ends of the spectrum is a mix of personal entitlement, business efficiency and good old-fashioned elitism, with a healthy dose of racism. Take Adelson: he’s in for high stakes because his personal stakes are high. He’s under investigation by both the Department of Justice and the Security and Exchange Commission for violating the Foreign Corrupt Practices Act (FCPA) by paying off local officials and working with organized crime to further his gambling empire in Macau, China. The Obama administration has been diligent about prosecuting FCPA cases, while Adelson presumes the heat would be off under a Romney presidency. When you have $25 billion, what’s $100 million to secure your freedom?
Adelson also makes 90 percent of his earnings from his casinos in Macau and Singapore, a high number, but not unheard of for US companies operating abroad. Obama has promised to close the loopholes that allow these corporations to shelter earnings overseas, robbing US treasuries of billions in tax dollars. Preserving offshore tax havens is not the only place where donating big bucks to GOP Super PACs is a highly efficient business model. Mega-donors David and Charles Koch’s company, Koch Industries, spent a whopping $40 million on disclosed lobbying expenditures between 2008 and 2010. The price of a fundraiser in the Hamptons is peanuts compared to that tab. Between the tax plan and the estate tax, high-net-worth folks stand to save millions annually under Romney. The candidate himself would save almost $5 million per year under his own plan.
Apparently, when the stakes are this high, you don’t take chances. Hence, the full court press on disenfranchisement. In Florida, the GOP governor has been so intent on purging voter rolls of Latino-sounding names that the Justice Department filed an injunction and sixty-seven election supervisors courageously refused to implement the program until he proves his claims in each case.
Self-serving economics is a repugnant driver, but the psychology that allows lawmakers to deny fundamental rights to their constituents while their rank and file stand by is even more insidious. In a rare moment of honesty, a GOP donor that shelled out $25,000 to attend one of the Romney events yesterday had this to say to a LA Times reporter:
“I don’t think the common person is getting it,” she said from the passenger seat of a Range Rover stamped with East Hampton beach permits. “Nobody understands why Obama is hurting them… But my college kid, the baby sitters, the nails ladies—everybody who’s got the right to vote—they don’t understand what’s going on. I just think if you’re lower income—one, you’re not as educated, two, they don’t understand how it works, they don’t understand how the systems work, they don’t understand the impact.”
While it’s the money they flaunt, it’s the people they fear, a fact that would serve us well to remember as limited resources are spent in 2012 and beyond. As progressives work to protect the vote for every American citizen in the short term and to blunt the impact of big money on our democratic process, let’s not lose focus on long-term investments in our own not-so-secret weapon: the people—of all colors and ages, all incomes levels, in the cities and on the farms—that make this country great. When they all have a voice, we all win.

“A Very Sick Man”: Rush Limbaugh Wants To Extend Vote Suppression To Women
It did not generate the outrage that his offensive statements often do, probably just because it happened the day before July 4, but last Tuesday Rush Limbaugh made an inadvertently revealing statement. “When women got the right to vote is when it all went downhill because that’s when votes started being cast with emotion and maternal instincts that government ought to reflect,” said Limbaugh.
Limbaugh was not summarizing some serious new political science research. He was merely making assertions based on his own sexist stereotypes and the fact that women vote more Democratic than men.
The notion that women are less capable of controlling their biological weaknesses for the good of their country is often heard from right wing men. Newt Gingrich, who never served in the military, once said that women could not serve in combat because they would “get infections,” from living in ditches.
Limbaugh’s comment is also a reflection of Republican attitudes toward voting, and why they are so eager to trample voting rights. For another example, recall that Ann Coulter told the New York Observer in 2007, “If we took away women’s right to vote, we’d never have to worry about another Democrat president. It’s kind of a pipe dream, it’s a personal fantasy of mine.”
Limbaugh’s defense is that he was joking. But you never hear liberals joke that the world would be better if men or white people were not allowed to vote.
Republicans like Coulter and Limbaugh believe that groups who vote Democratic shouldn’t have the right to vote. The available mechanisms they are using, such as voter ID laws, target Democratic-leaning groups such as African-Americans, young people, city dwellers, and poor people. According to the Philadelphia Inquirer, “More than 758,000 registered voters in Pennsylvania do not have photo identification cards from the state Transportation Department, putting their voting rights at risk in the November election.” That’s 9.2 percent of Pennsylvania’s 8.2 million voters.
If there were a mechanism for disenfranchising women, the GOP would be pushing it.

“Voting Rights Are Precious”: A Crack In The GOP’s Support For Voter-ID Laws
There’s little question what the political calculus behind voter-ID laws is. Advocates argue that the laws, which require government photo identification to vote, are necessary to prevent voter fraud—despite there being virtually no evidence that such fraud is a problem. In practice, the laws will disproportionately have an impact on poor people and those of color, two Democratic-leaning groups that are less likely to have such IDs. Predictably, Republicans have been pushing for these laws, while Democrats generally oppose them.
That is, until earlier this week, when Michigan Governor Rick Snyder shot down his own party and vetoed a state voter-ID law. He also vetoed laws that would have made it harder to conduct voter-registration drives and to confirm U.S. citizenship for voters. All three—pushed by Republican Secretary of State Ruth Johnson and sponsored by Republican lawmakers—would likely have dampened turnout, particularly among disadvantaged communities.
During hearings on the measure, protesters stormed the Capitol. “This is a naked assault on that sacred right to vote and to not have unnecessary obstacles placed in their path,” said one Democratic state representative.
The governor’s press release, titled “Snyder signs most of election reform legislation,” shows he wasn’t exactly chomping at the bit to make his announcement and in both cases cited “confusion” as the key reason for knocking down the measures.
But in a letter to lawmakers, Snyder expanded his point. “Voting rights are precious,” he wrote, “and we need to work especially hard to make it possible for people to vote.”
As the latest results from Wisconsin’s recall election showed, high turnout does not necessarily help Democrats. Snyder, and others of a more moderate ilk, may recognize that there’s no reason Republican candidates shouldn’t be reaching out to new voting populations. Keeping voter turnout down is hardly a long-term strategy, and as the Prospect‘s Jamelle Bouie recently noted, there’s a lot of room for Republicans to grow in popularity among nonwhites.
Right now, Snyder stands alone. Last week, New Hampshire’s Republican-dominated state legislature overturned a veto from Democratic Governor John Lynch on similar legislation. Several state voter-ID laws are stuck in the courts. But the news from Michigan may help spur others who have wavered on the issue.
The fundamental right to vote should not be a partisan issue, and Snyder’s decision may have a welcome ripple effect on others in the GOP who see the troubling implications of these laws.

“Rigging The System To Keep Power”: Republicans’ Voter Suppression Project Grinds On
Mitt Romney was in Michigan this week trying to make it competitive in the presidential election. It’s a steep climb for the native Michigander because President Barack Obama’s auto bailout, which Romney opposed, has helped bring the state’s unemployment rate down by 5.7 points since 2009.
But Romney has a strong ally there: legislation being pushed this month by his fellow Republicans aimed at preventing the nonpartisan League of Women Voters from undertaking the voter-registration drives it has sponsored for nearly a century.
Across the country, the Republicans’ carefully orchestrated plan to make voting harder — let’s call it the Voter Suppression Project — may keep just enough young people and minorities from the polls that Republicans will soon be in charge of all three branches of the federal government.
Yes, both sides try to change voting laws to favor their team. The 1993 “motor voter” law that made voting more convenient by extending registration to the Department of Motor Vehicles helped mostly Democrats. That was at least in the long American tradition of expanding the franchise.
The Republican effort to restrict voting isn’t just anti- Democrat, it’s anti-democratic. No fair-minded person believes the tall tales of voters pretending they were someone else, which have been debunked by the Brennan Center for Justice and others. What fool would risk prison or deportation to cast a single vote?
This isn’t about stopping vote-stealing and other corruption, for which there are already plenty of laws on the books. It’s about rigging the system to keep power.
First we saw the efforts during the George W. Bush administration by Karl Rove and Justice Department officials to get rid of U.S. attorneys who refused to pursue bogus voter- fraud cases. When Republican prosecutors complained, Rove and company ran for cover.
Then came Crawford v. Marion County, the 2008 case in which the U.S. Supreme Court ruled that mandatory photo-identification laws were constitutional on the basis of ballot protection. The evidence presented included not a single case of in-person impersonation fraud — the only fraud that photo ID laws can prevent. And the millions of Americans — mostly less-affluent seniors — without driver’s licenses? Good luck.
The big Republican victory in the 2010 election was essential to the Voter Suppression Project. With the help of ALEC — a conservative lobbying outfit that spreads cookie- cutter bills to state legislatures — Republicans moved with lightning speed to implement their scheme. Since 2011, 18 states have enacted voter-suppression bills, with similar ones pending in 12 more.
In the presidential race, it’s hand-to-hand legal combat, with almost every battleground state embroiled in a struggle over voter eligibility.
Michigan’s bills attack the League of Women Voters by requiring some volunteers to attend state-approved training sessions before they can register voters. The catch is that the bill makes no provisions for such sessions. Ha! It does threaten them with penalties for registration offenses that aren’t specified.
The bill is modeled on Florida’s, parts of which a federal judge invalidated May 31 because he said they had “no purpose other than to discourage” constitutionally protected activity.
In Ohio, the Obama campaign helped collect enough signatures to put a referendum on the ballot repealing restrictions on absentee voting. Preferring not to face the voters directly on voter suppression, the Republican-controlled legislature repealed its own law, although it left intact a related measure that prohibits early voting on the three days before an election. That’s designed to discourage the tradition in black communities of busing worshippers from church to the polling place.
Several battleground states have new photo-ID requirements. Pennsylvania’s law allows valid student ID, but with a number of restrictions. Same in Wisconsin, which attached a series of bring-me-the-witch’s-broomstick demands for students looking to use a school ID. Fortunately, a state judge ruled against the Wisconsin law, although it’s being appealed.
Virginia’s legislation allows multiple forms of photo ID but restricts registering for an absentee ballot in person. A New Hampshire bill that required those without photo ID to fill out an onerous affidavit was thankfully just vetoed by Governor John Lynch.
The Obama campaign is obviously concerned about these ballot-access issues for political reasons. But even those with no dog in this fight should recognize that a great democracy doesn’t sully itself by suppressing the precious right to vote.
