“We Need More Voting, Not Less”: Republicans Are Gaming The Electoral System By Suppressing The Vote
For decades, we in America have lamented our voter turnout. There has been widespread concern about not only the 60 percent participation in presidential elections, but the drop-off to about 40 percent in off years and the miserable turnout for local elections and primaries that often doesn’t reach 20 percent. So why do Republicans in key states seem intent on preventing certain citizens from voting?
The critics of our system cite European countries that continuously have turnout numbers between 70 percent and 80 percent. (Austria, Sweden and Italy usually hit the 80 percent mark.) They point to how hard we make it for citizens to register, the problem with requiring additional documents at polling places and the recent passage of laws to combat so-called “voter fraud.”
We can go one of two directions in this country: We can make voting easier or we can make it harder. It is difficult to understand why some Republicans desire to make it harder. It is even more difficult to understand their desire to stop African-Americans, Hispanics and young people from voting, unless, of course, you take the view that Republicans have cynically decided to suppress the vote of these more Democratic-leaning groups.
The New York Times editorial board today pointed to those who are trying to make voting easier and those who are trying to make it harder. It cited six states that have recently created online registration systems and four that have either allowed voters under 18 to pre-register or put in place election day registration or expanded early voting.
Sadly, the Times also pointed to the 15 states that have passed new restrictions on voting that are mostly controlled by Republicans. 11 states have put in place restrictive voter ID laws, reduced time for early voting was passed in eight states, and some students are being prevented from voting where they reside for college.
According to he Times, 10 states have made it more difficult to even register to vote. A total of 34 states now have restrictive voter ID laws.
One of the most outrageous aspects of this movement by Republican operatives is that it is combating a problem that doesn’t exist. Voter fraud is not a serious problem in our elections, but preventing key groups of minorities, poor people and the young from exercising their constitutional rights certainly is becoming one.
We need to open up our electoral system, not close it. We need to have universal voter registration at 18. We need to have more early voting, not less, more vote by mail, not less, more consolidation of voting days, not less, and more use of technology to provide online registration. We need to explore weekend voting and also new ways to clean up voter lists and keep them current.
At the end of the day, it is time for Republicans to stop trying to game the system and win elections by denying citizens the right to vote. It will only come back to bite them – and bite them hard.

“No Break In The War On Voting”: Republican Hostility To Voting Rights Is The Problem
In case you were wondering if Rand Paul’s three-day revolt against the War on Voting his party is waging was either stimulating or might reflect a moment of glasnost on the subject, MSNBC’s Zachary Roth has some cold, cold water for you:
Paul’s walk-back is the inevitable result of some much larger trends. It’s not just that polls show voter ID remains popular—though that’s undoubtedly affecting the picture. More important is the GOP’s strategy for winning elections. For all the talk about the need to court Hispanics, the reality is that the easiest short-term path to victory for Republicans is to double-down on their advantage white voters, and work to make the electorate as white as possible. That means restrictions on voting—which hit blacks and Hispanics hardest—are likely to be a page in the party’s playbook for a while.
It’s no coincidence that some of the most important presidential swing states—Ohio, Florida, Wisconsin, and North Carolina—have been the sites of the fiercest voting rights battles. Republicans know that without most of those states, they could be shut out of the White House for decades.
Nor is it a surprise that the list of Paul’s potential rivals for the nomination includes Republicans, like Rick Perry, Scott Walker, Ted Cruz, and John Kasich, who have led the way in blocking access to the ballot. Not a single GOPer in the 2016 conversation has opposed voter ID—including Paul.
The Republican National Lawyers Association—the closest thing there is to an official GOP position on voting issues—is certainly showing no signs of retreating. Not only does the group defend voter ID as zealously as ever—it even opposes a recent recommendation from a bipartisan presidential commission to expand early voting.
The GOP’s approach to the Voting Rights Act is even more revealing about the direction it’s heading. In 2006, the overwhelming majority of Republican lawmakers joined with Democrats to reauthorize the landmark civil rights law. But Rep. Jim Sensenbrenner, a Republican, has so far failed to get party leaders to sign on to legislation to fix the law after it was weakened by the Supreme Court last year—even though it contains a special carve-out for voter ID, designed to win GOP support.
I would add that despite all the talk (abating lately) of Republicans needing to change positions, strategy and tactics to look less hostile to minority voters, you almost never hear Republicans admitting that hostility to voting rights is part of their problem. That may have been Rand Paul’s most important heresy: even bringing the subject up. Bet that won’t happen again.

“Where Is The Republican Voter Expansion Project?”: Republicans Used To Support Voting Rights—What Happened?
During a speech on Friday at the National Action Network, President Obama made his strongest and most extensive comments yet on the topic of voting rights. “The right to vote is threatened today in a way that it has not been since the Voting Rights Act became law nearly five decades ago,” Obama said. “Across the country, Republicans have led efforts to pass laws making it harder, not easier, for people to vote.”
The election of the first black president and the resurrection of voter suppression efforts was hardly a coincidence. New voting restrictions took effect in nineteen states from 2011–12. Nine states under GOP control have adopted measures to make it more difficult to vote since 2013. Since the Supreme Court gutted the Voting Rights Act in June 2013, half of the states (eight in total) previously covered under Section 5 have passed or implemented new voting restrictions.
These laws, from voter ID to cutting early voting to restricting voter registration, have been passed under the guise of stopping voter fraud, although there’s scant evidence that such fraud exists. Obama cited a comprehensive study by News21 that found only ten cases of in-person voter impersonation since 2000. “The real voter fraud,” the president said, “is people who try to deny our rights by making bogus arguments about voter fraud.”
Obama’s speech highlighted how Democratic leaders are embracing the cause of voting rights. (Attorney General Eric Holder has made it a signature issue, with the DOJ filing lawsuits against new voting restrictions in Texas and North Carolina last year.)
A day before arriving in New York, Obama spoke about civil rights at the Lyndon B. Johnson Presidential Library’s commemoration of the fiftieth anniversary of the Civil Rights Act—where the subject of contemporary attacks on voting rights came up often. “Is this what Martin Luther King gave his life for?” asked Bill Clinton. “Is this what Lyndon Johnson employed his legendary skills for? Is this what America has become a great thriving democracy for? To restrict the franchise?”
Democratic presidential hopefuls like Hillary Clinton and Joe Biden have recently championed voting rights. The Democratic National Committee has launched a new Voter Expansion Project and veterans of the Obama campaign started iVote to elect Democratic secretaries of state in Colorado, Iowa, Ohio and Nevada. Democrats hope that an appeal to voting rights will help mobilize key constituencies, like in 2012, when a backlash against GOP voter suppression efforts increased African-American turnout. “The single most important thing we can do to protect our right to vote is to vote,” Obama said on Friday.
It’s great that Democratic leaders are finally recognizing the severity of the attack on voting rights. But it’s sad that Republicans are almost unanimously supporting the restriction of voting rights rather than the expansion of the franchise.
Things weren’t always this way. In his new book about the Civil Rights Act, An Idea Whose Time Has Come, Todd Purdum tells the story of Bill McCulloch, a conservative Republican from Ohio who championed civil rights as the ranking Republican on the House Judiciary Committee. The Politico excerpt from the book was titled “The Republican Who Saved Civil Rights.”
There would have been no Civil Rights Act of 1964 or Voting Rights Act of 1965 without the support of Republicans like McCulloch and Senate minority leader Everett Dirksen of Illinois. For decades after the 1960s, voting rights legislation had strong bipartisan support in Congress. Every reauthorization of the VRA—in 1970, 1975, 1982 and 2006—was signed by a Republican president and supported by an overwhelming number of Republicans in Congress.
Republicans like Jim Sensenbrenner of Wisconsin, an heir to McCulloch who as the former chairman of the House Judiciary Committee oversaw the 2006 reauthorization of the VRA and is co-sponsoring a new fix for the VRA, used to be the norm within the GOP. Now he’s the rare Republican who still believes the GOP should remain the party of Lincoln. Where is the Republican Voter Expansion Project?
It’s also unfortunate that many in the media continue to report on voting rights like it’s a left-versus-right issue, as if supporting a fundamental democratic right suddenly makes one a flaming liberal. Jamie Fuller of The Washington Post called voting rights “the Democrats’ most important project in 2014.” Michael Shear of The New York Times dubbed Obama’s speech an effort “to rally his political base.”
The right to vote used to be regarded as a moral issue, not a partisan one. As President Johnson said when he introduced the VRA before Congress: “It is wrong—deadly wrong—to deny any of your fellow Americans the right to vote in this country.”
As long as Democrats are the party of voting rights and Republicans are the party of voter suppression, the right to vote will continue to be under siege.

“Voter Outreach Is Hard, Voter Suppression Is Easy”: GOP Policies Putting New Hurdles Between Voters And Their Democracy
Every few years, Republican officials will say they need to do a better job reaching out to minorities, women, and younger voters. In each instance, GOP leaders will give every indication that they’re serious and sincere about it, because they arguably have no choice – Republicans realize their base is much older and whiter than the Democratic base, which creates a long-term demographic nightmare.
But in practice, GOP officials actually do have a choice. They could, in theory, adopt a more mainstream agenda and prioritize diversity, or they could manipulate voting laws, as they did in advance of the 2012 elections, making it easier for candidates to pick the voters they like, rather than allowing voters to pick they candidates they like.
And as it turns out, voter suppression is vastly easier than voter outreach.
Pivotal swing states under Republican control are embracing significant new electoral restrictions on registering and voting that go beyond the voter identification requirements that have caused fierce partisan brawls.
The bills, laws and administrative rules – some of them tried before – shake up fundamental components of state election systems, including the days and times polls are open and the locations where people vote.
The so-called “Republican war on voting” in 2011 and 2012 was unlike anything Americans have seen since the era of Jim Crow, but the results were not what the GOP had hoped for. The policies had some of the intended effects – voting lines in several battleground states were, as designed, ridiculously long – but it didn’t prevent Democrats from making electoral gains.
But this apparently has only encouraged many state Republican policymakers to try harder, as we’ve seen of late in Wisconsin, Ohio, and elsewhere.
In the bigger picture, North Carolina poses an especially interesting case.
As we’ve discussed, the voting restrictions imposed by North Carolina Republicans are arguably the most egregious in the nation. Democratic critics have been quick to point out that the new voter-suppression measures, according to the state’s own numbers, disproportionately affect African-American voters.
It’s led opponents of the policy to argue that the policies have nothing to do with addressing voter fraud – a problem that doesn’t actually exist in reality – and everything to do with identifying likely Democratic voters and putting new hurdles between them and their democracy.
A few months ago, as part of a legal challenge to the new restrictions, voting-rights advocates turned up the heat. Zack Roth reported in January:
North Carolina is asking a federal judge to keep secret Republican state lawmakers’ communications as they pushed through the nation’s most restrictive voting law last summer.
“They are doing everything they can to try to keep us from finding out what they did and how they did it and who was involved,” Rev. William Barber II, the president of the state’s NAACP chapter, which is challenging the law, told reporters Thursday. “It’s time for what was done in the dark to come into the light.”
Barber’s NAACP, backed by the Advancement Project, wants access to the lawmakers’ emails and other internal communications in order to bolster the case that the law’s Republican sponsors knowingly discriminated against racial minorities. In response, the state argued late last week that the communications are protected by legislative privilege.
Last week, as Roth and Adam Serwer reported, the voting-rights proponents scored a partial court victory.
North Carolina lawmakers who backed the state’s restrictive voting law are going to have to cough up emails and other documents related to the law’s passage, a federal judge said Thursday evening. […]
North Carolina had sought to block a demand by the civil rights groups that the state turn over documentation that could shed light on what the legislators were thinking when they passed the law. In an order released Thursday evening, Judge Joi Elizabeth Peake ordered the state to turn over some of the documents sought by the civil rights groups. […]
Thursday’s ruling didn’t give the law’s challengers everything they wanted, though. It said that emails that were shared only between legislators and their staffers might still be subject to legislative privilege, as North Carolina claims.

“An Illegitimate Power Structure”: To Defeat GOP’s Restrictive Voting Laws, Debunk ‘Voter Fraud’
Growing up in Jim Crow Arkansas, Bill Clinton saw how the state’s dominant political and racial elite maintained power by suppressing the rights of minority voters who threatened their authority – and as a young activist worked to bring down that illegitimate power structure. So when Clinton says “There is no greater assault on our core values than the rampant efforts to restrict the right to vote” – as he does in a new video released by the Democratic National Committee – the former president knows of what he speaks.
In the segregationist South of Clinton’s youth, the enemies of the universal franchise were Democrats, but times have changed. Not just below the Mason-Dixon line but across the country, it is Republicans who have sought to limit ballot access and discourage participation by minorities, the poor, the young, and anyone else who might vote for a Democratic candidate.
No doubt that is why, at long last, the Democratic Party has launched a national organizing project, spearheaded by Clinton, to educate voters, demand reforms, and push back against restrictive laws. Returning to his role as the nation’s “explainer-in-chief,” Clinton may be able to draw public attention to the travesty of voter ID requirements and all the other tactics of suppression used by Republicans to shrink the electorate.
His first task is to debunk the claims of “voter fraud” fabricated by Republican legislators and right-wing media outlets as the rationale for restrictive laws. Lent a spurious credibility by the legendary abuses of old-time political machines, those claims make voter suppression seem respectable and even virtuous.
Some years ago the Brennan Center for Justice, based at New York University and led by former Clinton speechwriter Michael Waldman, issued a 45-page report on voter fraud that remains definitive. “There have been a handful of substantiated cases of individual ineligible voters attempting to defraud the election system,” the report noted. “But by any measure, voter fraud is extraordinarily rare.” And because fraud is so unusual, GOP counter-measures such as voter ID do much more harm than good.
As the Brennan Center study noted, even some Republicans know that their leaders have exaggerated stories of fraud for partisan advantage. In 2007, the Houston Chronicle quoted Royal Masset, the former political director of the Texas Republican Party, who observed that among Republicans it is “an article of religious faith that voter fraud is causing us to lose elections.” Masset admitted that suspicion is false, but said he believed that requiring voters to provide photo ID could sufficiently reduce participation by legitimate Democratic voters to add three percent to Republican tallies.
More recently one of the dimmer lights in the Pennsylvania Republican Party – the majority leader of the state House of Representatives, in fact – boasted that the voter ID statute he had rammed through the legislature would “allow Governor Romney to win the election” in November 2012. Although Mike Turzai later insisted that “there has been a history of voter fraud in Pennsylvania,” the state government conceded in court that it could cite no evidence showing that “in-person voter fraud has in fact occurred in Pennsylvania or elsewhere.”
Clinton can also consult the President’s Commission on Election Administration, a bipartisan panel appointed by President Obama to improve the country’s voting systems. In its final report issued last January, the commission forthrightly acknowledged that true voter fraud is “rare.” It was a singular admission by a group whose co-chairs included Benjamin Ginsberg, an aggressive Republican election attorney who bears the burden of responsibility for the outcome of Bush-Gore 2000.
If he is in a bipartisan mood, as he often is, Clinton would surely find the commission’s report uplifting – especially its recommendations to make voting more modern, more efficient, and above all more accessible. For both parties to improve and expand the democratic rights of citizens would be uplifting indeed.
But Clinton is more likely to find himself feeling less kindly toward the Republicans, as they continue to promote outrageous suppression while feigning outrage over “fraud.” The Democrats may be equally motivated by partisan self-interest – but so long as they defend the rights of the intimidated and the disenfranchised, their moral force will be undiminished.
