“The Vets We Reject And Ignore”: Leave No Fallen Comrade Behind Applies At Home And To All Veterans, Regardless Of “Bad Paper”

Today, we honor the nation’s 22 million veterans, including more than 2.5 million who served in Iraq, Afghanistan and other fronts in the war against Al Qaeda. But we are turning our backs on hundreds of thousands of veterans who were discharged “under conditions other than honorable” and so do not qualify as veterans under federal law.

Their discharges, which include overly broad categories encompassing everything from administrative discharges for minor misconduct to dishonorable discharges following a court-martial, nevertheless make them ineligible for the health care, employment, housing and education benefits offered by the Department of Veterans Affairs.

Because of the “bad paper” they carry in the form of their discharge certificates, many of these veterans struggle upon leaving the military. And when they falter, the burden for supporting them falls heavily on their local communities because federal agencies cannot, by law, help them.

No federal agency publishes the numbers of bad paper discharges. But historical studies suggest that at least several hundred thousand veterans fall into this category. Approximately 260,000 of the 8.7 million Vietnam-era veterans were pushed out of the service with bad paper. More recently, according to documents separately obtained by the Colorado Springs Gazette, the Army discharged 76,165 soldiers between 2006 and 2012 with bad paper. Of these recent Army discharges, only one in seven were kicked out following a criminal conviction for a serious offense. The rest were discharged for smaller breaches of military discipline like missing duty or abusing alcohol or drugs. For many of them, their misconduct was likely related to the stresses of war.

Instead of showing compassion for these troops who were carrying the invisible wounds of war, their commanders kicked them out. These troops’ getting pushed out under such circumstances would be enough of a blow, but these commanders compounded the injury by giving them bad paper, instead of merely administratively separating them from the service.

While assessing the needs of veterans in the Western United States, my research team met with community leaders and nonprofit agency staff members in seven cities with the largest populations of veterans, and interviewed others in outlying cities and rural areas as well. Across these communities, veterans with bad paper were believed to be significantly overrepresented in the at-risk veterans populations. All too frequently these veterans become part of the nation’s chronically homeless or incarcerated populations.

When they end up in distress or on the streets, their communities must bear this burden alone.

We have a moral obligation to those who serve, especially those who serve us in combat. At times, the military must discharge those who can’t perform or conform. However, commanders should exercise far greater discretion and compassion in trimming the ranks. Bad discharges indelibly mark veterans as damaged goods and cost society a great deal too.

Congress should also allow the V.A. to more broadly provide mental health care, homelessness support and other forms of crisis intervention to veterans with bad paper. The V.A. has case-by-case authority to do so now, but that does not help veterans with bad paper who have acute needs. A more compassionate policy would not diminish the military’s ability to maintain discipline, nor would it cheapen the valor of those who have served honorably.

The military has a process to fix bad paper, but that process takes too much time, and veterans often need legal help to prevail in an incredibly bureaucratic and difficult process.

The story of John Shepherd Jr., who earned a Bronze Star for valor in Vietnam but was kicked out after disobeying an order to return to combat after developing severe post-traumatic stress disorder, shows how difficult these cases can be. Mr. Shepherd went without V.A. support for 40 years until a team of students and lawyers at Yale Law School helped him correct his record this month.

Excellent programs exist to help veterans in such cases, but they deserve more resources. Small investments in pro bono legal services can help unlock a lifetime of access to the V.A. and help the neediest veterans with bad paper move on with their lives.

Finally, the veterans community should do more to lift up those veterans who have been discharged with bad paper, particularly in those cases where combat experience lies at the heart of the bad discharge. The American military ethos calls on all of us to leave no fallen comrade behind. That applies at home, too, and to all veterans, regardless of whether they carry bad paper.

“Syria And The Return Of Dissent”: Liberating The Country From The Shackles Imposed During The Bush Years On Open Discussion

The debate over Syria is a jumble of metaphors, proof that every discussion of military action involves an argument about the last war. Yet beneath the surface, the fight in Congress over President Obama’s proposed strike against Bashar al-Assad’s regime is a struggle to break free from earlier syndromes to set a new course.

Obama himself is using the imperative that he back up his “red line” against chemical weapons as an occasion to revisit his Syrian strategy. And both of our political parties are emerging from a post-9/11 period of frozen foreign policy thinking to a more natural and intellectually honest exchange over America’s long-term role in the world.

The mood of the public and of many in Congress is summarized easily: “No more Iraqs.” It’s a sensible impulse because the Iraq war never delivered on the promises of those who urged the country to battle. Especially among Democrats who initially endorsed the war, there is a lingering guilt that they never asked the Bush administration the questions that needed to be posed. Belatedly, those queries — about what the intelligence shows and what our goals are — are now being directed to Obama on Syria.

Still, there is another reaction among Democrats and liberals, including Obama. It is a return to a pre-Iraq view that shaped the Clinton administration’s policies in Bosnia and Kosovo after it failed to stop the Rwandan genocide: There are times when American power can be used to keep local wars from flying out of control, to prevent or limit humanitarian catastrophes and, yes, to advance the country’s interests.

Many Democrats supported Bush on Iraq because they mistakenly placed the war in the context of a humanitarian intervention. Yet this guardedly interventionist wing of the party also includes people such as House Democratic leader Nancy Pelosi, who opposed the commitment in Iraq but never stopped believing in the positive uses of American military power. These Democrats are swinging Obama’s way on Syria not for partisan reasons but because he shares their position in the quarrel inside the party.

Nonetheless, Obama faces substantial resistance among Democrats because Vietnam and Iraq turned a large section of the party into principled noninterventionists who set an extremely high bar to any use of America’s armed forces. The same can be said of libertarian Republicans such as Sen. Rand Paul and Rep. Justin Amash. This left-right anti-war coalition has a long American pedigree, going back to the periods before both World War I and World War II.

But that only begins to describe the complexity of the argument on the Republican side. Many in the party instinctively skeptical of foreign entanglements suppressed their doubts during the Bush years. With a Democrat in the White House and 9/11 more than a decade behind us, they now feel they can express them again. This group overlaps with a GOP faction whose one driving ideology involves standing against anything Obama is for.

Republican interventionists, in the meantime, are divided among themselves. Neoconservatives such as Sen. John McCain have an expansive attitude toward deploying American forces and still believe in the Iraq war. Realists such as Sen. Bob Corker do not want a repeat of Iraq but are willing to give Obama a limited mandate to act in Syria. House Speaker John Boehner rather bravely urged passage of a resolution on Syria, knowing that inaction there would undermine a tough approach toward Iran. He finds himself somewhere between these two camps.

Ultimately, after intricate negotiations, the balance of power among all these factions will almost certainly give the president the congressional victory he needs to take action — in part because majorities in both houses know that an Obama defeat on Syria would be devastating to American foreign policy. Wednesday’s 10 to 7 Senate Foreign Relations Committee vote for a resolution was a sign of things to come.

And by forcing this necessary vote in Congress, Obama has forced himself to recalibrate a Syrian strategy that had reached a dead end and to clarify his goals. He is stepping up support for more moderate Syrian opposition elements and his plans to “degrade” Assad’s military are more extensive than simply a warning shot. But he remains deeply wary of committing American troops on the ground.

With luck, Obama will get by this crisis while sending a strong message of American determination to uphold international norms. In the longer run, despite the repeated references to the recent past, the Syria debate signals that the country is finally liberating itself from the shackles imposed during the Bush years on an open discussion of our country’s interests and purposes. Democracy is often slow, but it eventually works.

“How Soon We Forget”: Bob Dole As A Tribune Of Civility Is Laughable

So now we’re supposed to fall in love with Bob Dole: the enfeebled old solon went on Fox News this week and said his beloved Grand Old Party should be “closed for repairs” for having abandoned civility and comity, and for lacking “ideas.” All right then; let’s give Bob Dole half credit. It is true that Bob Dole was on the Republican side of the hyphen for plenty of pieces of bipartisan legislation (never mind that many of those laws were awful—like “Bayh-Dole,” the 1980 law that let universities patent, and thus privatize, their publicly financed inventions). But let’s also call it half bullshit. All in all, Bob Dole was much more an architect of the Republican Party’s culture of hyper-partisan nastiness than a tribune of civility.

Once, when LBJ was thundering toward his 1964 landslide, megalomaniacally rolling up road miles to defeat as many incumbent Republicans as possible, he told the reporters traveling with him, “You all know a bit about the Republicans in Congress, and there must be at least a few of them that you think deserve to be defeated. Give me some names and either Hubert and I will try to get into their districts in the next few days and talk against ’em.” After they got over their shock, one piped up proposing that Dole kid, the young congressman out of Kansas: he was a nasty man, a hatchet man—a traducer of the civility of Washington. Which was largely how Bob Dole rose in Republican counsels. How soon we forget.

It’s one of those ineluctable patterns in American political culture. As I wrote in 2004 upon Ronald Reagan’s death: “each generation of nonconservatives sees the right-wingers of its own generation as the scary ones, then chooses to remember the right-wingers of the last generation as sort of cuddly. In 1964, observers horrified by Barry Goldwater pined for the sensible Robert Taft, the conservative leader of the 1950s. When Reagan was president, liberals spoke fondly of sweet old Goldwater. Nowadays, as we grapple with the malevolence of President Bush, it’s Reagan we remember as the sensible one.” As, thus, does Robert Dole: in today’s Republican Party, “Reagan wouldn’t have made it.”

And now, like clockwork, Bob Dole volunteers Bob Dole as the cuddly one, thereby basking in the pundits’ lionization of Bob Dole. Bob Dole!

Rick Perlstein is not buying it. Bob Dole, who in 1971 when Richard Nixon expanded the Vietnam War into Laos, called Democrats who protested to Nixon publicly (but not Republicans who did the same thing privately) “the new Chamberlains in what they hope will be another era of appeasement,” saying George McGovern has went “as close as anyone has yet come to urging outright surrender.”

The next year, as Nixon’s Republican National Committee chair, Bob Dole eagerly stood up on his hind legs for the Watergate-plagued president, then peed on Woodward and Bernstein: “For the last week, the Republican Party has been the victim of a barrage of unfounded and unsubstantiated allegations by George McGovern and his partner-in-mudslinging, the Washington Post…McGovern appears to have turned over the franchise for his media attack campaign to the editors…who have shown themselves every bit as surefooted along the low road.”

Others can add their greatest hits from their own personal Wayback Machines. Meanwhile, let’s count down for another Bob to bob forth with some blathering about Bob: Bob Woodward. It can’t really be long.

“The Failure Wasn’t His, It Was Ours”: George McGovern Will Die Vindicated On War And Peace

Speaking at the Democratic National Convention in 1972, George McGovern kicked off his ill-fated presidential bid by focusing on his opposition to the ruinous war in Vietnam. “I have no secret plan for peace. I have a public plan. And as one whose heart has ached for the past ten years over the agony of Vietnam, I will halt a senseless bombing of Indochina on Inaugural Day,” he said. “There will be no more Asian children running ablaze from bombed-out schools. There will be no more talk of bombing the dikes or the cities of the North. And within 90 days of my inauguration, every American soldier and every American prisoner will be out of the jungle and out of their cells and then home in America where they belong. And then let us resolve that never again will we send the precious young blood of this country to die trying to prop up a corrupt military dictatorship abroad. This is also the time to turn away from excessive preoccupation overseas to the rebuilding of our own nation. America must be restored to a proper role in the world. But we can do that only through the recovery of confidence in ourselves.”

Over the course of his career, McGovern made a lot of arguments that I personally find unpersuasive. But he sure did get the most important issue of his time right. Think of all the Americans who’d be alive today if the country had listened to McGovern rather than his opponents about the Vietnam War. Think of all the veterans who’d have been better off. Think of how many Vietnamese civilians would’ve been spared death by napalm. But America didn’t listen.

The country would eventually come to see Vietnam as a mistake.

But ours is a people who are dismissive of men who lose presidential elections. We behave as though the electoral outcome discredited their ideas, even on matters where they’re ultimately proved right.

Of course, it was about more than one war for McGovern. A World War II veteran, he liked to say that he’d been persuaded by Dwight Eisenhower, under whom he served, about the dangers of the military industrial complex. The Democratic Party grew comfortable with it over time.

But McGovern never did.

When America launched its war in Iraq, a lot of Democrats signed on. McGovern opposed it. “I oppose the Iraq war, just as I opposed the Vietnam War, because these two conflicts have weakened the U.S. and diminished our standing in the world and our national security,” he wrote.

He was right again.

After Obama took office, McGovern wrote him an open letter, published in Harper’s magazine, that said, “When I entered the U.S. Senate in 1963, the defense budget was $51 billion. This was at a time when our military experts felt it necessary to have the means to win a war against the combined powers of Russia and China. Today we have a military budget of over $700 billion, and yet neither Russia nor China threatens us, if indeed they ever did. Nor does any other nation.”

Once again, few Americans are listening.

It’s strangely common to think of men defeated in presidential elections as losers, though they are invariably men who’d be regarded as especially accomplished if they’d never run for the office. McGovern was a decorated combat veteran, a college professor, a three term senator, and a humanitarian who worked for years to alleviate global hunger, among other things. As he lays dying in hospice, his country remains as beholden to the military industrial complex as ever, years after the decisive defeat of its only credible geopolitical foe. When the obituaries are published, they’ll note McGovern’s electoral loss. It’s far less likely that they’ll note the two ruinous wars America would’ve been spared had its leaders and voters taken McGovern’s advice.

The failure wasn’t his, it was ours.

“Whistling Pass The Graveyard”: The Path To Amnesia, How To Forget On Memorial Day

It’s the saddest reading around: the little announcements that dribble out of the Pentagon every day or two — those terse, relatively uninformative death notices: rank; name; age; small town, suburb, or second-level city of origin; means of death (“small arms fire,” “improvised explosive device,” “the result of gunshot wounds inflicted by an individual wearing an Afghan National Army uniform,” or sometimes something vaguer like “while conducting combat operations,” “supporting Operation Enduring Freedom,” or simply no explanation at all); and the unit the dead soldier belonged to. They are seldom 100 words, even with the usual opening line: “The Department of Defense announced today the death of a soldier who was supporting Operation Enduring Freedom.” Sometimes they include more than one death.

They are essentially bureaucratic notices designed to draw little attention to themselves. Yet cumulatively, in their hundreds over the last decade, they represent a grim archive of America’s still ongoing, already largely forgotten second Afghan War, and I’ve read them obsessively for years.

Into the Memory Hole

May is the official month of remembrance when it comes to our war dead, ending as it does on the long Memorial Day weekend when Americans typically take to the road and kill themselves and each other in far greater numbers than will die in Afghanistan. It’s a weekend for which the police tend to predict rising fatalities and news reports tend to celebrate any declines in deaths on our roads and highways.

Quiz Americans and a surprising number undoubtedly won’t have thought about the “memorial” in Memorial Day at all — especially now that it’s largely a marker of the start of summer and an excuse for cookouts.

How many today are aware that, as Decoration Day, it began in 1865 in a nation still torn by grief over the loss of — we now know — up to 750,000 dead in the first modern war, a wrenching civil catastrophe in a then-smaller and still under-populated country? How many know that the first Decoration Day was held in 1865 with 10,000 freed slaves and some Union soldiers parading on a Charleston, South Carolina, race track previously frequented by planters and transformed in wartime into a grim outdoor prison? The former slaves were honoring Union prisoners who had died there and been hastily buried in unmarked graves, but as historian Kenneth Jackson has written, they were also offering “a declaration of the meaning of the war and of their own freedom.”

Those ceremonies migrated north in 1866, became official at national cemeteries in 1868, and grew into ever more elaborate civic remembrances over the years. Even the South, which had previously marked its grief separately, began to take part after World War I as the ceremonies were extended to the remembrance of all American war dead. Only in 1968, in the midst of another deeply unpopular war, did Congress make it official as Memorial Day, creating the now traditional long holiday weekend.

And yet, when it comes to the major war the United States is still fighting, now in its 11th year, the word remembrance is surely inappropriate, as is the “Memorial” in Memorial Day. It’s not just that the dead of the Afghan War have largely been tossed down the memory hole of history (even if they do get official attention on Memorial Day itself). Even the fact that Americans are still dying in Afghanistan seems largely to have been forgotten, along with the war itself.

As the endlessly plummeting opinion polls indicate, the Afghan War is one Americans would clearly prefer to forget — yesterday, not tomorrow. It was, in fact, regularly classified as “the forgotten war” almost from the moment that the Bush administration turned its attention to the invasion of Iraq in 2002 and so declared its urge to create a Pax Americana in the Greater Middle East. Despite the massive “surge” of troops, special operations forces, CIA agents, and civilian personnel sent to Afghanistan by President Obama in 2009-2010, and the ending of the military part of the Iraq debacle in 2011, the Afghan War has never made it out of the grave of forgetfulness to which it was so early consigned.

Count on one thing: there will be no Afghan version of Maya Lin, no Afghan Wall on the National Mall. Unlike the Vietnam conflict, tens of thousands of books won’t be pouring out for decades to come arguing passionately about the conflict. There may not even be a “who lost Afghanistan” debate in its aftermath.

Few Afghan veterans are likely to return from the war to infuse with new energy an antiwar movement that remains small indeed, nor will they worry about being “spit upon.” There will be little controversy. They — their traumas and their wounds — will, like so many bureaucratic notices, disappear into the American ether, leaving behind only an emptiness and misery, here and in Afghanistan, as perhaps befits a bankrupting, never-ending imperial war on the global frontiers.

Whistling Past the Graveyard of Empires

If nothing else, the path to American amnesia is worth recalling on this Memorial Day.

Though few here remember it that way, the invasion of Afghanistan was launched on a cult of the dead. These were the dead civilians from the Twin Towers in New York City. It was to their memory that the only “Wall” of this era — the 9/11 Memorial at Ground Zero in lower Manhattan — has been built. Theirs are the biographies that are still remembered in annual rites nationwide. They are, and remain, the dead of the Afghan War, even though they died before it began.

On the other hand, from the moment the invasion of Afghanistan was launched, how to deal with the actual American war dead was always considered a problematic matter. The Bush administration and the military high command, with the Vietnam War still etched in their collective memories, feared those uniformed bodies coming home (as they feared and banished the “body count” of enemy dead in the field). They remembered the return of the “body bags” of the Vietnam era as a kind of nightmare, stoking a fierce antiwar movement, which they were determined not to see repeated.

As a result, in the early years of the Afghan and then Iraq wars, the Bush administration took relatively draconian steps to cut the media off from any images of the returning war dead. They strictly enforced a Pentagon ban, in existence since the first Gulf War, on media coverage and images of the coffins arriving from the war fronts at Dover Air Force Base in Delaware. At the same time, much publicity was given to the way President Bush met privately and emotionally — theoretically beyond the view of the media — with the families of the dead.

And yet, banned or not, for a period the war dead proliferated. In those early years of Washington’s two increasingly catastrophic wars on the Eurasian mainland, newspapers regularly produced full-page or double-page “walls of heroes” with tiny images of the faces of the American dead, while their names were repeatedly read in somber tones on television. In a similar fashion, the antiwar movement toured the country with little “cemeteries” or displays of combat boots representing the war dead.

The Pentagon ban ended with the arrival of the Obama administration. In October 2009, six months after the Pentagon rescinded it, in an obvious rebuke to his predecessor, President Obama traveled to Dover Air Base. There, inside a plane bringing the bodies of the dead home, he reportedly prayed over the coffins and was later photographed offering a salute as one of them was carried off the plane. But by the time the arrival of the dead could be covered, few seemed to care.

The Bush administration, it turns out, needn’t have worried. In an America largely detached from war, the Iraq War would end without fanfare or anyone here visibly giving much of a damn. Similarly, the Afghan War would continue to limp from one disaster to the next, from an American “kill team” murdering Afghan civilians “for sport” to troops urinating on Afghan corpses (and videotaping the event), or mugging for the camera with enemy body parts, or an American sergeant running amok, or the burning of Korans, or the raising of an SS banner. And, of course, ever more regularly, ever more unnervingly, Afghan “allies” would turn their guns on American and NATO troops and blow them away. It’s a phenomenon almost unheard of in such wars, but so common in Afghanistan these days that it’s gotten its own label: “green-on-blue violence.”

This has been the road to oblivion and it’s paved with forgotten bodies. Forgetfulness, of course, comes at a price, which includes the escalating long-term costs of paying for the American war-wounded and war-traumatized. On this Memorial Day, there will undoubtedly be much cant in the form of tributes to “our heroes” and then, Tuesday morning, when the mangled cars have been towed away, the barbeque grills cleaned, and the “heroes” set aside, the forgetting will continue. If the Obama administration has its way and American special operations forces, trainers, and advisors in reduced but still significant numbers remain in Afghanistan until perhaps 2024, we have more than another decade of forgetting ahead of us in a tragedy that will, by then, be beyond all comprehension.

Afghanistan has often enough been called “the graveyard of empires.” Americans have made it a habit to whistle past that graveyard, looking the other way — a form of obliviousness much aided by the fact that the American war dead conveniently come from the less well known or forgotten places in our country. They are so much easier to ignore thanks to that.

Except in their hometowns, how easy the war dead are to forget in an era when corporations go to war but Americans largely don’t. So far, 1,980 American military personnel (and significant but largely unacknowledged numbers of private contractors) have died in Afghanistan, as have 1,028 NATO and allied troops, and (despite U.N. efforts to count them) unknown but staggering numbers of Afghans.

So far in the month of May, 22 American dead have been listed in those Pentagon announcements. If you want a little memorial to a war that shouldn’t be, check out their hometowns and you’ll experience a kind of modern graveyard poetry. Consider it an elegy to the dead of second- or third-tier cities, suburbs, and small towns whose names are resonant exactly because they are part of your country, but seldom or never heard by you.

Here, then, on this Memorial Day, are not the names of the May dead, but of their hometowns, announcement by announcement, placed at the graveside of a war that we can’t bear to remember and that simply won’t go away. If it’s the undead of wars, the deaths from it remain a quiet crime against American humanity:
