“Boom Times For The NRA”: The United Nations Is Coming After Your Guns, Send Us Money!
There’s a lot happening at the moment—government shutdown, war in Syria, Iranian president sort of maybe not denying the Holocaust—so there was very little attention given to the fact that yesterday, the United States government signed the United Nations Arms Trade Treaty (ATT), commonly known as the small-arms treaty. It’s meant to prevent the arming of human-rights abusers—potential perpetrators of genocide, and the like—by obligating states not to sell conventional weapons, from small arms up to tanks and helicopters, to foreign governments or entities that are going to use them to commit war crimes and massacre civilians. When it was voted on by the UN, the only countries that voted against it were Syria, Iran, and North Korea.
And today, the National Rifle Association is celebrating. That might strike you as odd, but the ATT is political gold for them. It’s the international equivalent of a failed gun control effort in Congress, which is far, far better than no gun control effort at all. It gives them the opportunity to scream, “They’re coming for your guns!”, raise money, keep their congressional allies asking “How high?” when they say jump, acquire new members, and reinvigorate their existing members. And it all happens without even the tiniest threat to anyone’s actual gun rights. Who could ask for anything more?
The last year has been just fantastic for the NRA. You might have thought that the Newtown massacre and all the other mass shootings we had would have been a threat to the organization and its insane views. Au contraire. Yes, there may be more Americans who’ve now been exposed to what those views are, and who now think less highly of the NRA. But on just about every other measure you could come up with, nothing’s better for them than having a bunch of kids get mowed down, or having the United States sign a treaty that touches on the international arms trade.
Why? Because what the NRA needs to keep its internal momentum going is a threat. Not a real threat, mind you, but a threat that sounds just plausible enough to gun owners (when presented with the NRA’s particular zealous interpretation) to sound like it might someday impinge on their ability to buy all the killing machines they want, yet in reality poses no threat at all.
Throughout Barack Obama’s first term, the NRA was constantly crying, “Obama and Pelosi are coming for your guns!” But after a while, it wasn’t all that persuasive. For a gun-grabber, Obama was remarkably passive. In his whole first term, he signed only two laws dealing with guns, both of which expanded gun rights (you’re now allowed to take your guns to national parks and on Amtrak trains, so congrats on that). But then Newtown happened, and Obama finally proposed some gun control legislation. It didn’t matter that the legislation was almost absurdly modest; what mattered was that the NRA could say, “See! See! We told you he was coming for your guns! Send us more money!” The NRA got its boost in membership and fundraising, and the congressional effort came to nothing. They won on both ends.
And the same thing will happen with the Arms Trade Treaty. Ever since it was proposed, the NRA has been saying that if we signed on, blue-helmeted UN troops would be coming to your door to confiscate your guns. That this is false and ridiculous never mattered. All that mattered was that there is, in fact, a UN treaty, and it says something about small arms. And that’s enough. None of their members are going to bother to read it (here it is, if you’re so inclined). When they hear what it does and doesn’t do, they’ll assume that’s just liberal lies. And so the treaty gives the NRA another chance to say “They’re coming for your guns! Send us money!”
For the sake of accuracy, we should note that just about every single thing the NRA says about the ATT is false. The NRA claims the treaty “covers firearms owned by law-abiding citizens,” meaning the UN might try to take your guns. That’s false. In reality, the treaty covers only cross-border trade; it explicitly states that it has nothing to do with the domestic policies of any country. What it says is that nations agree not to sell arms to other nations when they know they’re going to be used in war crimes. So for instance, if we sold a bunch of rocket launchers to the Syrian government right now, knowing that the launchers would be used to target civilians, we’d be in violation of the treaty. The NRA claims the treaty mandates a “registry of law-abiding firearms owners.” That’s false. In reality, the treaty requires record-keeping of transnational arms sales, something the United States already does.
Which brings us to perhaps the most important thing to understand about this treaty: the United States already has export controls that do exactly the same thing for our own arms sales. It doesn’t impose any new obligations on us. By joining the treaty, we’re trying to get other countries to hold to the same standards we do. But because of the opposition of Republicans, the treaty will never pass the Senate.
Speaking of which, those Republican politicians use the nonexistent threat of gun confiscation for the same purposes as the NRA does. A few months back, Rand Paul sent out a fundraising letter saying this: “Will you join me by taking a public stand against the UN “Small Arms Treaty” and sign the Official Firearms Sovereignty Survey right away? Ultimately, UN bureaucrats will stop at nothing to register, ban and CONFISCATE firearms owned by private citizens like YOU.” And how can you prevent such a terrible thing? By sending Rand Paul money, of course. For the gun-rights gang, these are the best of times.

“This Is A War Crime”: The U.N.’s Syria Report Strengthens President Obama’s Hand
United Nations inspectors confirmed Monday that hundreds of Syrians who died in an Aug. 21 attack outside Damascus were killed with sarin nerve gas.
The highly anticipated U.N. report marks the first official conclusion by independent scientists that the victims had been gassed. “The findings are beyond doubt and beyond the pale,” Secretary-General Ban Ki Moon said. “This is a war crime.”
Neither Ban nor the U.N. inspectors would say who committed the atrocity — Syrian President Bashar al-Assad and the rebels fighting to topple him have accused each other.
The Obama administration and its allies, however, jumped on the findings, saying that only Assad forces had the capacity to carry out such a massive attack with chemical weapons — bolstering their push for a strong U.N. resolution to quickly seize and destroy Syria’s stockpile of deadly gases.
“The regime possesses sarin, and we have no evidence that the opposition possesses sarin,” Samantha Power, the U.S. ambassador to the U.N., told CNN.
The U.N. inspectors, who visited the scene of the attack, also found rocket fragments indicating that the nerve gas had been delivered with two types of artillery-launched rocket — the M14 and the 330mm. Assad’s military has these big guns; the rebels don’t.
Furthermore, arms experts doubt that opposition fighters have the expertise to use these rocket launchers effectively, even if they have captured some from Assad’s army. “It’s hard to say with certainty that the rebels don’t have access to these delivery systems,” Dina Esfandiary, a chemical weapons expert, tells Britain’s Telegraph. “But even if they do, using them in such a way as to ensure that the attack was successful is the bit the rebels won’t know how to do.”
The timing of the U.N.’s assessment works in President Obama’s favor. The U.S. has just reached an agreement with Russia for the international community to take control of Assad’s stockpile — estimated at 1,000 tons of sarin, mustard gas, and other poisons — by the middle of next year. Secretary of State John Kerry is demanding a U.N. resolution that will leave open the option of using force if Assad doesn’t fulfill his promise to hand over his chemical arsenal, and the U.N. report will make it easier to rally other nations behind a get-tough approach.
If the Security Council fails to reach a deal, and Assad doesn’t hand over his chemical weapons, the issue could be thrust back into the hands of Congress, which was debating whether to authorize Obama to order missile strikes against Syria when the unexpected diplomatic push put military action on hold. The U.N. report gives Obama outside evidence to present to reluctant lawmakers to back up his accusations against Assad.

“The Power Of Words”: Syria Moving To Sign The Chemical Weapons Treaty Is A Win For The U.S.
The Syrian regime today told the United Nations that it intends to sign and abide by the Chemical Weapons Convention. This commitment does two things that change the dynamics of the international response to Syria regardless of whether it is implemented.
First, it ends arguments about whether Syrian dictator Bashar Assad has chemical weapons, and whether the concern with his using them is “just” an American preoccupation. Second, it gives the international and intrusive United Nations machinery a real and expanding role in dealing with Syria’s chemical stocks, potentially starting to move Russia off center stage.
The Washington Post’s Ezra Klein interprets an interview that Assad gave today as a “ransom note”: that Assad will not agree to move forward on chemical weapons destruction unless the U.S. agrees to stop arming his opponents. It’s almost touching to see Assad trying to inflate the importance of recent U.S. arms shipments, even as Syrian rebels continue to say they aren’t getting what they want. But if Assad has that interpretation, it’s a major plus for Washington. Here’s why every step toward getting Syria’s name on the Chemical Weapons Convention is a plus for Washington:
Implementation is no longer in Russia’s hands alone. As American politics takes a detour into obsessing with Vladimir Putin and his Thursday op-ed, Assad’s move to the U.N. actually begins the process of pushing Russia back out of the spotlight. Rather than foresee a future in which Assad hands chemicals straight to Russia, Assad’s signal of intent to sign the Chemical Weapons Convention kicks off a process that should put the U.N. out front in moving quickly to get Assad’s signature and establish what will comprise ratification. (You can see Assad claiming rebel attacks make it hard for the Syrian People’s Council, elected last year during the civil war, to meet. But its speaker has been sending fan letters to anti-war Western politicians without difficulty.)
As soon as that happens – or before, if Syria were to announce that it will begin abiding by the Convention, as Russia should be asked to pressure it to do – Syria becomes liable for declaring all of its weapons and production sites within 30 days, allowing 100 percent of them to be inspected by trained international inspectors affiliated with the Organisation for the Prohibition of Chemical Weapons and destroyed in a manner that can be verified by the OPCW. The Russians have apparently suggested to Washington that a model for how Syrian stocks are verifiably destroyed could be the joint U.S.-Russian destruction of old Soviet stocks carried out under the provisions of the Nunn-Lugar Agreement. Phones over at Nunn’s Nuclear Threat Initiative, which on its own has overseen removal of nuclear materials from some dicey places, should be ringing off the hook about now.
The standard for success becomes clearer. Pundits weighed in faster than a senator to a camera on the difficulty of destroying all of Syria’s chemical stocks. That’s the wrong standard. 16 years after the U.S. and Russia joined the treaty, we’ve destroyed 90 percent of our stocks and Russia 65 percent of its. What’s the right standard? Every pound destroyed is a pound that can’t be used by Assad, can’t fall into the hands of extremist groups and doesn’t swell the target list for possible military intervention.
Assad puts himself on the line internationally. The treaty text is simple, committing its signatories “never … to use chemical weapons” and “to destroy chemical weapons it owns or possesses.” The treaty also foresees a compliance mechanism – a soft one, but one much-discussed in recent days: “the Conference shall, in cases of particular gravity, bring the issue, including relevant information and conclusions, to the attention of the United Nations General Assembly and the United Nations Security Council.” The use of “shall” is important. The treaty doesn’t say that treaty members vote on whether or not to refer to the Security Council, or that they “may” refer serious noncompliance to the Security Council. It says that they will. So one of Russia’s prior avenues for vetoing Security Council consideration would be removed.
Most important, Assad runs the risk, if his regime uses chemical weapons again, that Washington’s strike plans will be right back on the table, with considerably more international support. The rebels know this, and are likely to push him as hard as they can. Which hardly adds up to a win for Assad. It does, however, add up to the chance for a big win for the U.N., the Chemical Weapons Treaty, and the power of … words.

“That Threat Worked”: It’s Critical To Keep The Military Option Alive
For all you innumerable skeptics of President Obama’s calls for military strikes on Syria, consider this:
For decades, Syria has refused to confirm that it has chemical weapons. Now, facing a limited strike, its position abruptly changed to: Oh! We do have them after all! And we want to sign the Chemical Weapons Convention! We want to show them to United Nations inspectors.
In short, the mere flexing of military power worked — initially and tentatively. And while it seems that neither Congress nor the public has any appetite for cruise missile strikes on Syria, it will be critical to keep the military option alive in the coming weeks or Russia and Syria will play us like a yo-yo.
Frankly, I’m skeptical that a deal can be worked out in which Syria hands over its chemical weaponry, and President Obama may have exchanged a losing struggle with Congress with a Sisyphean struggle with Russia. But it’s not impossible. And even if Syria cheated and stalled and eventually handed over only half of its chemical arsenal and none of its biological arsenal, that would still be a huge win for global security.
So here’s a three-track strategy for Syria going forward:
• Negotiate with Moscow on removal of Syrian chemical weapons and insist on conditions to ensure we’re not being played, including immediate disclosure to the United Nations of chemical weapons stockpiles, a binding Security Council resolution confirming the deal, a reference in the resolution to “serious consequences” for noncompliance, and immediate installation of camera monitors on at least a few locations.
• Groundwork in Congress to authorize a limited missile strike if Syria does not comply, partly to retain leverage with Moscow.
• Expansion of efforts to arm and support moderate Syrian rebels, accompanied by covert cyberwarfare on the Syrian regime, to try to change the momentum on the ground.
Ultimately, that’s the best hope to coerce President Bashar al-Assad to step down so that all sides can try to reach a cease-fire and power-sharing agreement. Yet if we’re going to sustain the pressure, we have to address these fundamental questions: Can we really promote peace with military force? Is it possible to help a country by bombing it?
Longtime readers know that I adamantly opposed the Iraq war and Afghan surge, oppose strikes on Iranian nuclear sites and tend to think we overinvest in military tools and underinvest in diplomatic ones. So many readers were stunned that I’ve endorsed missile strikes on Syria — and I’m hearing screams of betrayal.
“You can’t kill people to show that it’s wrong to kill people,” Christine protested on my Facebook page.
“When has violence, killing and aggression helped anything,” demanded Jan, also on Facebook.
The answer is: Sierra Leone, Mali, Ivory Coast, Bosnia and Kosovo. In each of those countries, an outside military force intervened at minimal cost and saved large numbers of lives. In several (as Clausewitz would have predicted), war buttressed diplomacy and helped achieve peace agreements.
We think of warfare in binary terms, as if our options are invasions or nothing at all, but that’s misleading. All-out wars have a poor record, but modest interventions of the kind President Obama is talking about in Syria have a more successful (though still mixed) history.
That’s even true in Iraq, although I hate to mention the word because it sends a shudder up every reader’s spine. While the war that began in 2003 was a disaster, two limited interventions succeeded in Iraq. One was President Clinton’s 1998 bombing of Iraqi military sites for a few days (maybe the closest parallel to Obama’s plan for Syria); it may have convinced Saddam Hussein to abandon W.M.D. programs. The other is the no-fly zone over Iraq’s Kurdish areas in the 1990s to prevent a genocide there. They were limited uses of force that proceeded so smoothly that they are hardly remembered.
“War is obviously terrible, but it’s not the ultimate evil,” notes Kenneth Roth, executive director of Human Rights Watch. “Some things are worse, and one is the deliberate slaughter of civilians.”
Human Rights Watch doesn’t take a position on a strike on Syria, and Roth notes that military intervention isn’t the first tool to reach for to prevent mass atrocities. Sometimes armed intervention hurts. Sometimes it helps. We’re left to decide on a case-by-case basis.
In Syria, for two-and-a-half years, we’ve given the regime a green light, and the killing has escalated from 5,000 a year to 5,000 a month — and, last month, to a poison gas attack that was perhaps the biggest massacre in the war. Now Obama’s threat of military strikes has turned the light yellow, Syria is scrambling to adjust, and there is some hope of a diplomatic solution.
Let’s not allow the light to go green again.

“Genuine Democracy, What A Concept”: President Obama Gives Democracy A Chance In Syrian Crisis
Regarding the Obama administration and Syria, preliminary thoughts about a rapidly evolving situation:
It’s not necessary to think that President Obama has performed brilliantly throughout this debacle to suspect that next time around it’s going to be much harder for an action-hero president to stampede the country into war. As a corollary, hawkish politicians will find it more difficult to intimidate skeptics by questioning their patriotism.
On the eve of George W. Bush’s catastrophic invasion of Iraq 10 years ago, this column observed that “regime change” wasn’t a conservative policy, but “utopian folly and a prescription for endless war.” It suggested that over the longer term, Bush’s neoconservative advisors “may have misjudged the American people as well. Mostly, Americans wish to be left alone; they have no heart for endless wars of empire.”
Maybe I was right about that.
Ten years ago, fools were pouring Bordeaux wine into gutters and ordering “freedom fries” because the French urged the Bush administration to let U.N. weapons inspectors in Iraq do their work. Ten years ago, American agents were kidnapping suspected terrorists and delivering them into Syrian dictator Bashar al-Assad’s dungeons to be tortured. Ten years ago, “diplomacy” was a dirty word, a synonym for cowardice.
Ten years ago, President Bush, having promised to put his case against Saddam Hussein to a vote in the UN Security Council, reneged on that vow, ordered weapons inspectors busily finding no weapons of mass destruction in Iraq to clear out, and commenced his “shock and awe” bombing campaign. The “embedded” American news media treated the subsequent invasion like the world’s largest Boy Scout Jamboree.
These days, diplomacy gets more respect. Most Americans hope for the success of a French-sponsored Security Council resolution transferring custody of Syria’s arsenal of chemical weapons to international monitors. The numbers in a recent New York Times poll reflect a massive change in public opinion. Six out of ten Americans oppose bombing Syria. Sixty-two percent say the United States should avoid taking the lead role in solving foreign conflicts.
Ten years ago, a strong plurality favored U.S. activism. Asked last week if America should use force to turn dictatorships into democracies, people said no by a remarkable 72 to 15 percent. “A war-weary public that can turn an eye from children being gassed—or express doubt that it happened—is another poisoned fruit of the Bush years,” comments New York Times columnist Tim Egan.
Actually, the great majority, 82 percent in a recent CNN poll, believe that the Assad regime launched nerve gas weapons against its own people. But they’ve also witnessed reports of stupefying barbarities by his enemies, and bitter experience has left people wary of believing that American bombs can make things better. They fear that cruise missiles would only be the catalyst for an interminable, slow-motion grind like the Afghan war, which nearly everybody supported at the start.
This reluctance is also why—assuming the Russian, French, and Syrian agreement holds up—that political damage to President Obama for his hesitant, crawfishing approach to the Syrian crisis is apt to prove more limited than Beltway drama critics think. Obama’s ambivalence is widely shared.
As Michael Tomasky points out, Republican hypocrisy has been shocking even by GOP standards. During the 2012 campaign, Mitt Romney took a hawkish line, proposing to arm Syrian rebels and to conduct covert operations against the Assad regime. As recently as April, putative 2016 GOP presidential hopeful Marco Rubio chided Obama’s passivity.
“It is in the vital national security interest of our nation to see Assad’s removal,” he insisted. Regime change!
Last week Rubio voted no in the Senate Foreign Relations Committee.
If President Obama’s for it, GOP opportunists are against it. The end.
That said, the irony of Russian president Vladimir Putin appearing to rescue Obama from a political trap built by George W. Bush and baited by his own bluffing rhetoric about “red lines” would be almost disabling but for the horrors of nerve gas.
A deadly anachronism, gas weapons don’t work when it rains or the wind blows. They’re essentially useless in modern combat. Their appeal to a tyrant like Bashar al Assad is as an indiscriminate means of genocide, exterminating defenseless civilians like insects. Not to mention farm animals, pets, birds—basically anything with a nervous system.
Historical memories of the horrors of gas barrages during WWI are particularly strong among the Russians and French. On this subject, there really is an international community.
This too: however indecisive President Obama appeared to Beltway cognoscenti, he treated the American people like adults and honored the Constitution.
“I put [the question] before Congress,” Obama explained “because I could not honestly claim that the threat posed by Assad’s use of chemical weapons on innocent civilians and women and children posed an imminent, direct threat to the United States.”
Genuine democracy—what a concept.
