“It’s Time To Leave The 19th Century Behind”: Let’s Stop Whistling Dixie; Missouri’s Toxic Political Culture Must Change

Quite properly, journalistic reaction to events in Ferguson, Missouri, has focused on the militarization of the police, on the role of racism in the killing of unarmed African-American men, and on the political disenfranchisement that allows communities like Ferguson to operate in obvious defiance of public sentiment.

But there is another element peculiar to Missouri politics that must have light shed upon it. That is the sharp right-ward turn conservative politics in that State has taken. In its best moments, conservatism stands for caution, for prudence, for a government that is efficient yet serves the needs of all.

There was a time when conservatives in Missouri stood for these things, but that is no longer the case. Rather, what is visible to the outside observer is a dangerous movement towards the outermost fringes. For it is fair to say that a toxic neo-confederatism has emerged as a force to be reckoned with at the very heart of Missouri’s government — its state legislature.

Let’s consider Brian Nieves, a State Senator from West St. Louis. Nieves is not some obscure back-bencher. He’s been a member of the State Legislature since 2002, rising to the position of House Majority Whip before moving on to the Senate, where he now chairs the Committee on General Laws.

And what has Senator Nieves been doing in this position of trust? He has injected neo-confederatism into the law-making function. Consider Senate Joint Resolution 45, a state constitutional amendment Nieves proposed in January, 2012, which sought to revive the discredited Confederate principle of state nullification. The amendment would have declared that Missouri enjoyed the “sovereign” right to treat as null and void all federal law on gun control; abortion; climate change; federally-subsidized health care; same-sex marriage; hate crimes; and a range of other topics. In other words, had this amendment been adopted, Missouri would have been free to reject as non-binding a large body of federal statutes and judicial decisions.

Nullification, of which this is a modern manifestation, is an idea that has its origins in the efforts of the Southern planter class of the 1820’s and 1830’s to defend slavery against an encroaching federal government. In 1832, the federal government tried to enforce a tariff in South Carolina that posed a threat to the profitability of the slave-based cotton trade that formed the cornerstone of that State’s economy.

Purporting to defend the Constitution from an allegedly unconstitutional tariff, the South Carolina Ordinance of Nullification declared that laws which “violated the true meaning and intent [of the Constitution] are null, void, and no law.” When President Andrew Jackson threatened a military response, South Carolina backed down, although three decades later it chose secession rather than recognize Abraham Lincoln as President of the United States.

Nieves’ joint resolution did not carry the day. But that did not deter the nullificationists in the State Legislature from a second, more successful attempt to assert Missouri’s self-proclaimed right to nullify federal law.

“The Second Amendment Preservation Act,” it was called, and it was introduced in January, 2014. It took direct aim at federal gun control legislation. Listing numerous federal laws on the subject, it declared the named provisions “shall be invalid in this state, shall not be recognized by this state, are specifically rejected by this state, and shall be considered null and void and of no effect in this state.” Just like the South Carolina slave owners of the 1830s, the bill’s sponsor declared that the proposed law was needed to defend the Constitution against an aggressive and out-of-control federal government.

This time, the nullificationists enjoyed greater success. In February, 2014, the Missouri Senate approved the bill by a vote of 23-10, with near-unanimous Republican support. The Missouri Tea Party rejoiced. In April, 2014, the State House of Representatives also passed the bill.

It is past time, way past time, 150 years past time, to be playing around with Confederate ideology. That Republicans in the Missouri legislature gave overwhelming support to a piece of legislation whose origins can be traced to the ugliest moments in America’s slave-owning past stands as a badge of infamy. The Missouri Republican Party would do well to repudiate this legislation and promise to stop playing with the dynamite of nullification.

I’ve got news for Missouri’s political class. They need to stop reviving the odious, discredited ideology of the Southern slaveocracy. They must instead return to reality and address the social crisis Ferguson represents. For in truth, African-Americans face substantial obstacles in Missouri. The four-year high-school graduation rate for African-Americans is 76 percent (as of 2009/2010). (The white graduation rate is 89 percent). The poverty rate for African-Americans is 27.7 percent (as of 2007/2011). The white poverty rate for the same period is 12.1 percent. The unemployment rate of African-Americans (2008/2012) is 18.0 percent. (For white Missourians it is 7.3 percent). The incarceration rate for African-Americans (as of June 30, 2012) is 38.2 percent.

It’s time for Missouri’s right-wingers to leave the nineteenth century behind. It is time for all Missourians — indeed, time for all Americans — to start building a more just and equitable world, one free of institutional racism and yawning racial disparities. Missouri was once the home of far-sighted progressives. Harry Truman desegregated the Armed Forces in 1948. Democratic Senator Stuart Symington voted for the 1964 Civil Rights Act at great political risk. Missouri, it is time to get serious. The world is watching.

“Rush Limbaugh And Impressionable Young Minds”: Coming Soon To An Elementary School Near You?

Last year, radio host Rush Limbaugh published a children’s book called Rush Revere and the Brave Pilgrims. For those unfamiliar with it, msnbc’s Traci G. Lee reported a while back that the book “tells the story of a fictional history teacher named Rush Revere, who travels back in time to experience the pilgrims’ journey to America and their first Thanksgiving in the New World.”

A year later, Conor Friedersdorf reports that at least one third-grade teacher has embraced the book to teach children about, of all things, the Civil War.

A woman named Ivy, an elementary-school teacher from Summerville, South Carolina, is using material from a Rush Limbaugh book as part of the history curriculum for her third graders. Her husband alerted her to the children’s title, Rush Revere and the Brave Pilgrims: Time Travel Adventures With Brave Americans. She read it immediately. “And I said, ‘Okay, how am I gonna incorporate this book into the classroom?’ because the kids need to hear it,” she explained during a Wednesday call to Rush Limbaugh’s program. “They need to read this book.”

She recognized just one problem. “The dilemma is that we don’t teach the Pilgrims in the third grade,” she said. But a popular talk-radio host had written a book! The mere fact that it covered a period of history her students weren’t learning about wasn’t going to dissuade her from getting Limbaugh into the classroom.

The teacher, who called into Limbaugh’s show today, apparently explained, “So what I decided to do was to use your author’s note that explains the principles of the founders in our country as a way to introduce the Civil War. And from there, I decided, well, I’m gonna go ahead and read a little bit of this book ‘cause I need these kids to get excited about it. Even if I can’t finish it, I’ll give a book talk and then they can go out to the library and get it, and so forth.”

I guess the teacher deserves credit for creativity, if nothing else. “Ivy” is taking a Rush Limbaugh book about a talking horse on the deck of the Mayflower to teach kids about the Civil War, which took place more than two centuries later.

How? Because of American exceptionalism, of course.

As Friedersdorf’s piece went on to explain, the teacher told Rush, “[B]ecause of what you said in the book and the way that you explained the Founders’ passion for our country, it was because of that that slavery inevitably was abolished.”

Seriously? A school teacher responsible for instructions on history actually thinks this way? Does she not know what the Founders did on the issue of slavery?

After his chat with “Ivy” and before a commercial break, Limbaugh told listeners, “For people like Obama and Eric Holder, I believe – and there will never be any way to prove this because they would never admit this – but I believe that there is a genuine, long held, deeply felt contempt for the Constitution. And it’s all about slavery…. That’s the chip on their shoulder.”

“Fundamentalism, The Political Kiss Of Death”: Experienced Veterans Of Culture Wars, Just Not On The Winning Side

Jonathan Rauch writes that Christian conservatives, in response to their defeat in the “culture wars,” are likely to isolate themselves from the wider society.

I think that is precisely what they will do. It’s what they’ve done before. After the failure of Prohibition and their Pyrrhic victory in the Scopes trial, they headed for the backwoods, hiding out in their tent revivals and two-bit tabernacles.

The iconoclastic libertarian, H.L. Mencken, skewered and roasted them with all the glee of the Calvinistic deity in newspapers across the country. They earned every column inch.

Even into the 1960s, they continued their retreat, establishing thousands of “Christian” schools in protest of 1) the ruling on prayer in government schools, 2) sex education, and 3) desegregation of government schools. They wanted the right to pray, repress and hate–three constant traits of the American fundamentalist.

Oddly, it was the victory of Jimmy Carter, a born-again Christian, who gave them a lust for power–in spite of Carter holding none of the hateful values inspiring his fellow fundamentalists. Once they saw the glimmer of political power, however, nothing could restrain them. The greatest lust is not sex, it’s power.

It is said in Luke that Satan took Jesus to a mountaintop and showed him “all the kingdoms of the world” and said to him, “All this power I will give thee, and the glory of them; for that is delivered unto me; and to whomsoever will I give it. If thou therefore wilt worship me, all shall be thine.”

Jesus resisted, it is said, but for American Christians this temptation was too great. With Jerry Falwell and Pat Robertson playing the role of Satan, they were promised political domination of this country, and by implication, the world. The temptation was too great.

In the end, they tied their wagons to the anemic presidency of the village idiot, George W. Bush, discrediting themselves and their message in the process.

America turned against the demands of the Christian Right. The campaign to bring back censorship failed. The campaign to ban abortion fizzled with public opinion now as split as when the battle started. They will never have the nation-wide ban on abortion they seek.

Their crusade against gay people backfired spectacularly–not only did they fail to make it a felony to be gay, but gay couples are legally marrying in state after state.

During the “war” Americans, became more secular and less Christian. More Americans today say they are non-believers than when the Moral Majority set out to make this a “Christian nation.”

They lost because they fought tooth and nail against the oldest American value–individual rights and liberty. Americans have long held those as core values. I won’t say Americans have always lived up to those values–they haven’t, but I will say they always clung to them.

As much as the Religious Right pretends they are patriots, in terms of American core values, they are traitors to the Enlightenment tradition of the Founders, instead they preached an authoritarian religion which, when all was said and done, had no appeal for the American people.

Time and time again, we have been able to judge the final victory of a cultural war by determining the side of the American fundamentalist. The staunchest advocates of slavery were fundamentalists, so much so that the largest fundamentalist denomination in the country originated in a defense of slavery: the Southern Baptist Convention. Fundamentalists supported Prohibition. They tended to oppose equality of rights for women.

During the war against Jim Crow, racist fundamentalists put out pamphlets on the evils of “miscegenation.” Figures such as Jerry Falwell claimed “civil rights” was communistic. Some outposts, such as Bob Jones University, refused to admit black students even into the 1970s. Fundamentalists are experienced veterans of culture wars, just not on the winning side. If anything, their support for a cause is the kiss of death.

“On July 4, A Message For Patriots Of All Persuasions”: We Need To Remind Ourselves, There Is No Monoply On Patriotism

When the flags fly proudly on the Fourth of July, I always remember what my late father taught me about love of country. He was a deeply patriotic man, much as he despised the scoundrels and pretenders he liked to mock as “jelly-bellied flag flappers.”  It is a phrase from a Rudyard Kipling story that aptly describes the belligerent chicken-hawk who never stops squawking – someone like Dick Cheney or Rush Limbaugh.

Like many who volunteered for the U.S. Army in World War II, my dad never spoke much about his four tough years of military service, which brought him under Japanese bombardment in the Pacific theatre. But eventually there came a time when he attached to his lapel a small, eagle-shaped pin, known as a “ruptured duck” – a memento given to every veteran. With this proof of service, he demonstrated that as a lifelong liberal, he loved his country as much as any conservative.

Would such a gesture resonate today? Right-wingers have long sought to establish a monopoly on patriotic expression. On this holiday, when we celebrate the nation’s revolutionary founding, we need to remind ourselves just how hollow that right-wing tactic is and always has been. Only our historical amnesia permits the right – infested with neo-Confederates and other dubious types — to assert an exclusive franchise on the flag, the Declaration of Independence, the Constitution, and the whole panoply of national symbols. In the light of history, it should be plain that progressives are fully entitled to a share of America’s heritage; indeed, perhaps even more than their right-wing rivals.

Let’s begin at the official beginning. Although “right” and “left” didn’t define political combat at that time on these shores, there isn’t much doubt that behind the American Revolution, and in particular the Declaration of Independence, was not only a colonial elite but a cabal of left-wing radicals as well.

How else to describe Samuel Adams and Thomas Paine, the revolutionary idealists who declared their contempt for monarchy and aristocracy? It is true that many of their wealthier and more cautious comrades in the Continental Congress disdained Adams as a reckless adventurer “of bankrupt fortune,” and Paine as a rabble-rousing scribbler. Of course popular democracy was a wildly radical doctrine in colonial times, only tamed in the writing of the Constitution by the new nation’s land-owning elites and slaveholders.

The right-wingers of that era were the Tories — colonists who remained loyal to the British crown, opposed to change, and, in their assistance to George III’s occupying army, exactly the opposite of patriots. Only after two centuries of ideological shifting can Tea Party “constitutionalists” claim that the republican faith of the Founding Fathers is “conservative.”

The Civil War was just as plainly a struggle between left and right, between patriots and … well, in those days the Confederate leaders were deemed traitors (a term avoided since then out of a decent concern for Southern sensibilities). Academics dispute the war’s economic and social basis, but there is no doubt that the 19th-century left sought to abolish slavery and preserve the Union, while its right-wing contemporaries fought to extend slavery and destroy the Union.

Reverence for the Confederacy remains an emotional touchstone for right-wing Southern politicians and intellectuals (not to mention the Ku Klux Klan, assorted neo-Nazis, and many activists in the Tea Party). All of these disreputable elements denigrate Lincoln, our greatest president, and promote nostalgia for the plantation, sometimes known as “the Southern way of life.” The latest example is Chris McDaniel, the defeated Tea Party candidate for the Senate in Mississippi, a flag-waver if ever there was one – except when he was delivering fiery speeches to the secessionist Sons of Confederate Veterans. At the risk of offending every “conservative” who runs around with a Stars and Bars bumper sticker, it is hard to see how his conduct qualifies as American patriotism.

Still another inglorious episode in the annals of the right preceded World War II. The “America First” movement that opposed U.S. intervention against Hitler camouflaged itself with red, white and blue but proved to be a haven for foreign agents who were plotting against the United States. (Philip Roth brilliantly depicted this sinister campaign in The Plot Against America.)

Although Communists and pacifists had opposed American entry into the war for their own reasons, the broad-based left of the New Deal coalition understood the threat from the Axis very early. After Pearl Harbor most conservatives honorably joined the war effort, but some continued to promote defeatism and appeasement. And the historical roots of postwar conservatism — the “Old Right” of Joseph McCarthy and Pat Buchanan, the Buckley family and yes, the Koch brothers — can be traced to those prewar Nazi sympathizers.

What does true patriotism mean today? Do you truly love your country if you are a corporate leader hiding billions of dollars in profits offshore or insisting on the declining wages that have ruined the American dream? Do you love your country if you demand the right to pollute its air and water and despoil its countryside, no matter the cost to future generations? Do you love your country when you scheme to deprive your fellow citizens of the right to vote, which so many died to preserve?

Somehow the wingers righteously wrap themselves in Old Glory, as if our heritage belongs to them alone. On this holiday, and every other day, it surely does not.

“The Roots And Lessons Of Memorial Day”: A Reminder That Politics Can Have Dire Consequences

Memorial Day is a peculiarly appropriate holiday for our times. Its origins lie in the Civil War, which resulted from the failure of a deeply polarized political system to settle the question of slavery.

Reading the history of the period leading up to the war is jarring because its political conflicts bear eerie similarities to our own — for the sharp regional differences over how the federal government’s powers should be regarded; for the way in which advocates of slavery relied on “constitutional” claims to justify its survival and spread; for the refusal of pro-slavery forces to accept the outcome of the 1860 election; and for the fierce disagreements over how the very words “morality,” “patriotism” and “freedom” should be defined.

Our nation argued over what the Founders really intended and over the Supreme Court’s authority to impose a particular political view — in the case of the Dred Scott decision, it was the pro-slavery view — and to override growing popular opposition to slavery’s expansion. Religious people sundered their ties with each other over the political implications of faith and biblical teachings. And, yes, we struggled over race and racism.

We are not on the verge of a new civil war, and no single issue in our moment matches slavery either in its morally evocative power or as a dividing line splitting the nation into two distinct social systems. But Memorial Day might encourage us to re-engage with the story of the pre-Civil War period (the late David M. Potter’s Pulitzer Prize-winning history of the era, “The Impending Crisis,” has helpfully been reissued) for clues from the past as to how we might understand the present.

The holiday itself and how it was transformed over the years also carry political lessons for us now.

Memorial Day, as veterans are always the first to remind us, is not the same as Veterans Day. Memorial Day honors the war dead; Veterans Day honors all vets. Memorial Day started as Decoration Day on May 5, 1868, initiated by the Grand Army of the Republic, the vast and politically influential organization of Union veterans. The idea was to decorate the graves of the Union dead with flowers. Students of the holiday believe that Gen. John A. Logan, the commander in chief of the GAR (and the Republican vice presidential nominee in 1884), eventually set May 30 as its date because that would be when flowers were in bloom across the country.

The South, of course, saluted the Confederate war dead. A group of women in Columbus, Miss., for example, decorated the graves of the Southern dead at the Battle of Shiloh on April 25, 1866. This and other comparable ceremonies led to a vigorous competition over where the holiday originated.

It was only after World War I that Memorial Day was established as a holiday commemorating the fallen in all American wars. And it was not until 1966 that President Lyndon Johnson declared Waterloo, N.Y., as the official birthplace of Memorial Day, although that has not stopped the disputes over where it began.

Seen one way, the Memorial Day story traces a heartening journey: a nation whose Civil War took the lives of an estimated 750,000 Americans (more than 2 percent of the U.S. population then) could and did gradually come back together. A holiday that was initially a remembrance of those who died because the nation was so riven is now a unifying anniversary whose origins are largely forgotten.

Marking Memorial Day, moreover, may now be more of a moral imperative than it ever was. As a nation, we rely entirely on a military made up of volunteers. We are calling on a very small percentage of our fellow citizens to risk and give their lives on behalf of us all. We should recognize how much we have asked of so few, particularly in the years since 2001.

But it would be a mistake to ignore the roots of Memorial Day in our Civil War. Memorial Day is a call to political responsibility, even more so in some ways than the Fourth of July. The graves that Logan asked his contemporaries to decorate were a reminder that politics can have dire consequences. Distorting political reality (the pro-secession forces, for example, wrongly insisting that the resolutely moderate Abraham Lincoln was a radical) makes resolving differences impossible. As we honor our war dead, let us pause to consider how we are discharging our obligations to their legacy.
