‘Government Shutdown Prevention Act’ Undermines Democracy

Legal training is not a requirement to serve in Congress, although many of the members are, and have been, lawyers. Nor is it necessary for a House or Senate member to have served in another government post, although many have, and their experience at forging alliances and compromises has been helpful. We no longer have literacy tests for voters, a technique southern states used until the 1960s, effectively to disenfranchise African-American voters.

Yet, it might not be a bad idea to require incoming members of Congress to take a basic test in civics.

How else, other than an alarming misunderstanding of the basic of American government, to explain the effort of House Republicans to shut the Senate out of the budget process? Their sanctimoniously titled “Government Shutdown Prevention Act” would do just that, deeming that if the Senate failed to pass a measure to keep the government running amid the current budget dispute, that the House-passed version would become law.

The idea is bizarre on so many levels—not least because the Senate would actually have to pass the Government Shutdown Prevention Act for the House to assume a dictatorial role in one of the three branches of the world’s greatest democracy. The current fashion of anti-intellectualism in politics aside, do the House Republicans not understand the elementary-school fundamentals of how a bill becomes a law.

The freshman GOP lawmakers are annoyed with the Democratic-controlled Senate, this time for failing to cave in on the dramatic cuts the House Republicans want in the budget. Join the club, folks: The House has long been irritated by the Senate. Ask the House Democrats, who approved more than 300 bills in the last Congress that ended up dying in a Senate that failed to pass them or even consider them.

But the rudimentary lesson of lawmaking (FYI—a bill has to be passed by both the House and the Senate, then signed by the president, to become law. If the president vetoes a bill, each chamber of Congress must summon a two-thirds majority to override the veto) are nowhere near as important as the lesson about getting things done in a country of diverse interests. The Tea Party crowd ran campaigns of anger and frustration, blaming Congress for its failure to get balanced budgets and myriad other things. There’s a reason for that, and it’s not because members are stupid (they’re not, and some of them are absolutely brilliant) or lazy (they work longer hours than most Americans imagine) or weak. It’s because this is a country of wildly divergent attitudes and perspectives, reflected in the lawmakers those citizens send to Congress. The Tea Partyers believe they were sent to Washington with a mission, and they likely were. So were Nancy Pelosi and other liberal members whose constituents have drastically different perspectives than those in the Tea Party team’s districts. And their views are no less valid.

Legislating requires compromise, and compromise is hard, especially during times of economic stress. Being a congressman is a difficult job, forcing them to balance their districts’ needs with the national interest. The new members signed up for this job. They should do it.

Meanwhile…Washington’s Budget Folly

The Senate on Wednesday voted down the House budget bill, with its string of $61 billion in mostly political cuts through Sept. 30. That formally puts an end to the House’s grandstand play. But the Senate also rejected its Democratic leaders’ own plan to cut $6.5 billion. The government’s financing is due to run out in eight days. To prevent a shutdown, the two chambers will probably have to agree to yet another short-term financing bill.

That would be politically and fiscally irresponsible. But the House Republicans will be happy to agree, as long as Democrats agree to a vigorish of $2 billion a week in cuts to vital government programs.

Unless the White House and Democratic lawmakers start pushing back a lot harder — and do a better job of explaining the disastrous effects on the economy and everyday life — the Republicans will win the argument. If it keeps going on this way, they will get the $61 billion they demanded.

The White House again threatened on Wednesday to veto the House bill, and said it supported the Democratic bill that did not even draw a simple majority. It has been hosting what appear to be unproductive talks among legislative leaders; Vice President Joseph Biden Jr., who is nominally in charge of the talks, is now visiting Eastern Europe and tried to mediate by telephone.

President Obama has yet to take a firm public stand and make clear his bargaining limits and priorities. Understandably, he does not want the government to shut down and is hoping that quiet negotiations will produce better results than loud declarations of principle. But there is no sign that the House freshmen have an interest in compromise, or that Representative John Boehner, the House speaker, has any control of his caucus.

A brief shutdown, painful as it would be, would be far less damaging than a sudden withdrawal of tens of billions in government spending from the economy, which would lead to widespread layoffs.

Mr. Obama could well follow the example of Senator Charles Schumer of New York, the third-ranking Democrat in the Senate, who on Wednesday called for a “re-set” of the negotiating process. The only way to have a meaningful discussion of the budget, he said in a speech, is to consider all of its parts at once over the long term, not for a few weeks or months at a time. That includes all the issues the Republicans wouldn’t deal with in their bill: cuts to the entitlement programs and to the Pentagon budget and ways to raise revenues at the same time.

The Republicans, as Mr. Schumer noted, aren’t really interested in lowering the deficit. If they were, they would never have insisted on $800 billion in tax cuts for the wealthy without paying for them, or on repealing the health care law, which saves $230 billion over a decade.

They are only interested in slashing government, no matter the cost to the country. It is time for the president — and responsible Congressional leaders of both parties — to reject their tactics and their goal.

Senate Democrats Weigh Making Big Mistake On Health-Care Reform

I’m getting some worried e-mails from Hill staffers who think Senate Democrats might rubberstamp a policy House Republicans passed to undermine the Affordable Care Act. It’s the sort of policy decision that won’t get much attention but could have some very big, and very bad, effects, so let’s take a moment and go through it.

If you’ve been paying attention to the debate over the Affordable Care Act, you’ve probably heard about the 1099 provision. Essentially, small businesses manage to avoid paying taxes on a lot of small transactions. The 1099 provision would’ve forced them to report those transactions, raising about $20 billion over 10 years. But it would’ve require a lot of paperwork. So much paperwork, in fact, that Democrats agreed to repeal it.

When the Senate repealed the provision, they paid for it by canceling other spending that Congress had authorized, but that hadn’t yet been put to a particular purpose. House Republicans took a different approach. They’re trying to sharply increase the amount of subsidies that families will have to pay back if their income increases during the course of a year. The Center on Budget and Policy Priorities has a longer explanation of how this would work, but here’s the short version:

Under their proposed policy, a family with income at 225 percent of the poverty line who needed subsidies for the first half of the year but canceled them mid-year when the husband got a better job could get a bill for more than $4,500 at the end of the year.

A more worrying example goes the other way: Imagine a family where the breadwinner makes much more than 400 percent of poverty, but loses his job late in the year. He tries to apply for subsidies so the family can keep getting health insurance but is told that he shouldn’t bother — because his total income that year will still be above 400 percent of poverty, he’ll get a bill at the end of the year forcing him to pay back the money.

The Affordable Care Act, unfortunately, already includes a “payback” policy along these lines — the House Republicans are just proposing to make it much, much worse. This will do two things: make people hate the Affordable Care Act for bait-and-switching them, and keep people from entering the exchanges because they’ve heard horror stories of huge bills. It’s clear why the GOP wouldn’t mind that outcome, but there’s no reason for Democrats to accept it. The Senate should stick with the 1099 repeal that the Senate has passed.

The Games People Play: How Boehner Is Playing The Democrats

Richard Nixon espoused what he called “the madman theory.” It’s a negotiating approach that induces the other side to believe you are capable of dangerously irrational actions and leads it to back down to avoid the wreckage your rage might let loose.

House Republicans are pursuing their own madman theory in budget negotiations, with a clever twist: Speaker John Boehner is casting himself as the reasonable man fully prepared to reach a deal to avoid a government shutdown. But he also has to satisfy a band of “wild-eyed bomb-throwing freshmen,” as he characterized new House members in a Wall Street Journal interview last week by way of comparing them fondly to his younger self.

Thus are negotiators for President Obama and Senate Democrats forced to deal not only with Republican leaders in the room but also with a menacing specter outside its confines. As “responsible” public officials, Democrats are asked to make additional concessions just to keep the bomb-throwers at bay.

This is the perverse genius of what the House Republicans are up to: Nobody really thinks that anything like their $57 billion in remaining proposed budget cuts can pass. It’s unlikely that all of their own members are confident about all of the cuts they have voted for. But by taking such a large collection of programs hostage, the GOP can be quite certain to win many more fights than it would if each reduction were considered separately.

Begin with the outrageous $1.1 billion, 15 percent cut from Head Start, a program that offers preschool education to roughly 965,000 poor children. According to the Center for Law and Social Policy, this would knock 218,000 kids out of Head Start and force 16,000 classrooms to close.

That is an excellent way to lose the future, as Obama ought to be saying. What could be a better use of public money than helping our poorest children early in life so they might achieve more in school, and later?

And for those who say that Head Start is not as good as it should be, the administration announced plans in September to require lower-performing Head Start programs to compete against other entities for continued funding. Isn’t this the sort of competition conservatives say they’re for?

Given what science has shown about the importance of a child’s first years, we need better and broader early childhood programs. Slashing them can only cause harm – to parents, to children and to the country.

Then there are the cuts at the other end of the education continuum. The House budget would reduce the maximum Pell Grant, which helps needy kids go to college, by $845, from $5,550 available now. According to Mark Kantrowitz, who publishes the FinAid Web site that gives financial-aid advice, 1.7 million low-income students would lose eligibility for Pell Grants, almost a fifth of current recipients. Is that what Americans voted for last November?

But here is where the Republicans’ strategy works so brilliantly. Let’s assume that neither the administration nor Senate Democrats – even the most timid among them – can allow the Head Start or Pell Grant cuts to go through. That still leaves a lot of other truly worthy programs to be defended. By heaping cut upon cut, Republicans get advocates of each particular cause fighting among themselves.

And with so many reductions on the table, voters who would actually oppose most of them if they knew the details don’t get to hear much about any individual item because the media concentrate almost entirely on the partisan drama of the shutdown fight, not the particulars.

You can also imagine the argument from those Democrats petrified of their own shadows. “Well,” say the scaredy-cats, “we have to save Pell Grants and Head Start, so why don’t we give House Republicans what they want on the National Endowment for the Arts – or their cuts in foreign aid, the Centers for Disease Control and Prevention, medical research, the Women Infants and Children program, meals-on-wheels or mine safety inspections? I mean, we have to give them something, or those crazies will shut down the government, and we might get blamed.”

Boehner can just sit back and smile benignly as Democrats battle over which concessions they should give him. When the negotiating gets tough, he can sadly warn that his freshmen need more because he can’t guarantee what they’ll do. The perpetually tanned one is a shrewd dude. Democrats who underestimate him will be playing into his hands.

Deficit Hawks and The Games They Play

For 30 years, conservative ideologues have played moderate deficit hawks for suckers.

You’d think this might endow those middle-of-the-road deficit-busters with a touch of humility. Fat chance. They stick with their self-righteous moralism, pretending to be bipartisan and beyond ideology. In fact, they make the problem they want to solve worse by continuing to empower the tax-cuts-in-every-season conservatives.

It’s thus satisfying to see President Obama ignore the willfully naive who are wailing over deficits. He knows that new revenue will have to play a big role in deficit reduction. He also knows that House Republicans are pretending we can cut our way out of this mess and would demagogue any general tax increases.

So he has proposed some serious spending cuts and some modest revenue increases to keep things stable as he embarks on a long struggle to move our dysfunctional budget politics to a better place. This annoys his deficit-obsessed critics, by which I mean just about everyone who says he should simply embrace the proposals of the Bowles-Simpson commission. Obama should smile, let them rage and go about his business.

Let’s look at history. When Ronald Reagan took office in 1981, he won big tax cuts coupled with big increases in military spending. The tax cuts and a severe recession tanked government revenue.

Unlike today’s conservatives, Reagan at least acknowledged mathematical reality and signed some tax increases. But these were insufficient, and it fell first to George H.W. Bush – the last truly fiscally responsible Republican – and then to Bill Clinton to restore budgetary sanity.

But the conservatives who dug the hole did nothing to get us out of it. On the contrary, they denounced the first President Bush for raising taxes, and every Republican voted against Clinton’s economic plan. For their bravery in supporting tax increases in 1993, Democrats lost control of Congress in 1994.

By the end of the Clinton years, we had a handsome surplus. In came the second President Bush who, with Republicans in Congress, declared the surplus too big. It was one problem they worked very hard to solve. Two tax cuts and two wars later, we were plunged into deficits – again. And the economic downturn that started on Bush 43’s watch made everything worse, cutting revenue and requiring more deficit spending to get the economy moving.

Where were the moderate deficit hawks in all this? They have a very bad habit. When conservatives blow up our fiscal position with their tax cuts, the deficit hawks are silent – or, at best, mumble a few words of mild reproach to have something on the record – and let the budget wreckage happen. Quite a few in their ranks (yes, including some Democrats) actually supported the Bush tax cuts.

But when it’s the progressives’ turn in power, the deficit hawks become ferocious. They denounce liberals if they do not move immediately to address the shortfall left by conservatives. Thus, conservatives get to govern as they wish. Liberals are labeled as irresponsible unless they abandon their own agenda and devote their every moment in power to cutting the deficit.

It’s a game for chumps. The conservatives play it brilliantly. By winning their tax cuts and slashing government revenue, they constrain what liberals can do whenever they get back into power.

How do we know our difficulties stem primarily from a shortage of revenue? Consider what would happen if we allowed all the tax cuts scheduled to expire in 2012, including the ones enacted under Bush, to go away. That would produce nearly as much deficit reduction over the next decade – roughly $4 trillion – as all the maneuvers of the Bowles-Simpson commission put together. If you want to be serious about closing the deficit, ending the Bush tax cuts is a good place to start.

The commission’s work showed just how effective conservatives have been. By saying they will never, ever, ever raise taxes, conservatives intimidate moderates into making concession after concession.

In the end, the Senate conservatives on the commission – but not the House conservatives – supported some mild tax increases. But Bowles-Simpson proposed about twice as much in spending cuts as in revenue increases. You would think that moderates could at least hold out for a 50-50 split. But no, they’ll do anything to win over a few conservatives.

As a result, any conservative who supports even the smallest tax increase is hailed as courageous. Any liberal who proposes moderate spending cuts is condemned as a gutless coward unless he or she also supports slashing Social Security and Medicare. What’s “moderate” or “balanced” about this?

I hope Obama has the spine to keep calling the bluff of the deficit hawks until they get serious about changing the politics of deficit reduction. We can’t afford another 30 years of fiscal evasion.
