“For The Moment He Feels The Need To Look Like A Moderate”: Is Jeb Bush Actually A Moderate, Or Does The Media Just Think He Is?

In an excellent profile in the Weekly Standard, Andrew Ferguson reviews Jeb Bush’s record in Florida and concludes that, overall, he’s much more conservative than both the national press corps and right-leaning activists think. He posits at the end that Jeb could be “a self-conscious, deep-dyed conservative who for the moment feels the need to look like a moderate, especially before an admiring press and in the company of the wealthy Republicans who these days are his constant companions and marks.”

I’ve been exploring similar territory for a forthcoming piece on Bush’s political history, and there’s definitely a lot of truth to this analysis. What I’d add here, though, is that Bush’s position on immigration reform (which Ferguson doesn’t really get into) doesn’t quite fit into this framework. After a litany of standard conservative views, there’s the twist: “There is no plan to deport 11 million people,” the video shows Bush saying. “We should give them a path to legal status where they work, where they don’t receive government benefits, where they don’t break the law, where they learn English, and where they make a contribution to our society.”

The point? Other likely 2016 Republican candidates are contorting themselves on immigration. Recently, Scott Walker stressed his opposition to “amnesty” in public, while privately telling elites that he’d support, at least, a path to legal status. Dara Lind has a good rundown of the controversy here. But Bush is taking the opposite approach, not only playing up his support of legal status in both public and private, but arguing that it is the true conservative position.

So here, Bush’s position-taking isn’t just rhetorical. It’s a genuine attempt to shift his party and its base from their current default view, which is opposition to immigration reform that legalizes the status of unauthorized immigrants.

The upshot is that by challenging his party on one high-profile issue, Bush has to do less to seem moderate elsewhere, in the eyes of both the press and activists, when the general election rolls around. And somewhat fairly so! With the parties as polarized as they are, it is genuinely unusual for a candidate to forthrightly take on the base.

But, as both liberals and conservatives agree, Bush’s overall governing record has very little that’s moderate about it. So, in an interesting sense, Bush’s immigration position lets him have things both ways — it gives the media a peg to hang the moderate label on Bush, but as the right learns more about his record, it lets him tout that he is, otherwise, a down-the-line conservative.

“The Inevitable Questions”: Jeb Bush And The Two Types Of Electability Arguments

Not that it matters much now, with all the fascinating campaigning still to come, but I still think that Jeb Bush is the most likely Republican nominee, for reasons I outlined here. Josh Kraushaar of the National Journal, however, says that one of the cornerstones of Jeb’s appeal to Republican primary voters—that he’s the electable candidate—isn’t something they’re buying, partly because there isn’t a whole lot of evidence for it, other than the fact that Jeb is the kind of candidate who would seem to be more able to appeal to a general electorate. Ed Kilgore follows up:

Electability is supposed to be the Republican Establishment’s ace-in-the-hole, the argument carefully conveyed over time that wears down “the base’s” natural desire for a True Conservative fire-breather. In your head you know he’s right is the not-so-subtle message. But Jeb’s electability credentials are as baffling to regular GOP voters as they are obvious and unimpeachable to elites. And unless Jeb’s backers can supply some more convincing evidence than “trust [us] on this,” these doubts may never be quelled, particularly when you’ve got somebody in the field like Scott Walker who can boast of three wins in four years in a state carried twice by Obama—and without compromising with the godless liberals like Jeb wants to do.

Looking at it more generally, the jury is out as to whether the appropriate precedent for Jeb is somebody like Mitt Romney, who gradually won over intraparty skeptics by dint of money, opportunism, and a ruthless ability to exploit rivals’ vulnerability, or somebody like Rudy Giuliani, a guy who looked great until actual voters weighed in. And even that contrast may not capture Jeb’s problem: Rudy did well in early polls.

To the extent that Jeb does ultimately rely on an electability argument, he’s in danger of resembling a much earlier precedent: Nelson Rockefeller in 1968, whose late push to displace Richard Nixon was instantly destroyed by polls showing him performing more weakly than Tricky Dick in a general election. That’s actually where Jeb is right now. Unless and until his general election numbers turn around, and he’s running better against Clinton than anybody else, it’s going to be tough for him. All the money and opinion-leader endorsements and MSM adulation in the world cannot win the nomination for a candidate unless these resources at some point begin to translate into actual votes by actual voters. If they don’t like Jeb to begin with and think he’s a loser to boot, that may never happen.

Here’s the thing about electability: If you’re making an electability argument based on type, it’s probably full of holes, whereas if you’re making the argument based on this particular individual, it stands a better chance of being true. To take just one example, in 2008 there would have been a lot of good arguments for why a candidate like Barack Obama was unelectable. A senator hadn’t become president since John F. Kennedy, Obama only had a few years in office, he was young, and, oh yeah, he was black. But all of those were reasons why a candidate like Barack Obama wasn’t electable. That particular Barack Obama, however, turned out to be extremely electable.

There’s an anti-Jeb electability argument based on someone like Jeb, which says that when the GOP has nominated moderates it has lost, but when it has nominated conservatives it has won. This is basically Ted Cruz’s argument, and it’s true in some ways but very wrong in others. The anti-Jeb electability arguments based on this particular Jeb, especially the fact that his last name creates problems that Walker or Rubio wouldn’t have, are much more persuasive.

The electability debate figures into every primary campaign at some point, and there may be other ways in which Jeb can argue that he’s really the electable one. I still think that he’s more Romney than Giuliani, but this is obviously something he’s going to have to spend some time thinking about so he’s ready to answer the inevitable questions he’ll get from voters about it.

“A Clear Stake In The Issue”: The Media Is Obsessed With Hillary’s Emails Because The Media Is Obsessed With Stories About Itself

That the email controversy surrounding Hillary Clinton is still raging after nearly two weeks has awakened in Democrats a familiar dread. Nobody expected Republicans to give Clinton an easy time, but some of her supporters clearly hoped that time and experience had changed the way the press would adjudicate scandal accusations, or at least had diluted old suspicions so that the Clintons, their political enemies, and the media wouldn’t combine to form such a toxic brew.

As TPM’s Josh Marshall wrote, “the email story is shaping up to be another classic Clinton scandal. On the merits, the hyperventilation seems way out ahead of the actual facts…. And yet here we are againwith an almost infinite, process-driven scandal that can easily continue on into a Clinton presidency, if there is one…. Always a dance, always drama.”

The ingredients of this particular drama lend themselves to unending innuendo and recrimination. Clinton and her lawyers controlled all of her State Department–era emails, decided amongst themselves which to hand over to the government, and will presumably resist all GOP efforts to peek into the remainder, assuming they’re still retrievable. Republicans can thus whip the paranoid/birther contingent of their coalition into a state of permanent suspicion by projecting whatever malfeasance they want on to the missing emails.

But I think the nature of the email story makes it a poor proxy for gauging the relationship Clinton’s campaign will have with the press going forward. Keep in mind that this isn’t the first Clinton error Republicans have tried to exploit. When the press has taken GOP Benghazi accusations seriously, it’s gotten burned. Republicans have more credibly tried to raise questions about Clinton’s big dollar speeches and Clinton Foundation fundraising practices, but none of these stories have captured the press’ interest quite like the email controversy.

What distinguishes the email controversy is that it intersects in obvious ways with the professional interests of the same political press corps that will cover Clinton throughout the presidential campaign. It’s such big news because the news itself has a clear stake in the issue. The national press corps doesn’t generally expend a tremendous amount of energy holding senior bureaucrats to the letter of records-keeping protocols, or worrying about how much public business government officials are conducting on private email accountsthough perhaps they should.

But when reporters learned that the most public and politically aspirant of these officials had it in her power to deprive them of records to which they should be entitled, those reporters, quite predictably, responded not just as reporters but as representatives of their trade. This isn’t just any old process story, but one which practically invites reporters to miscalibrate in expressing industry outrage.

It’s also an old phenomenon, and one Clinton really should have anticipated. She hadn’t left Foggy Bottom for more than five months when the same press corps erupted over the revelation that, while conducting a leak investigation at the State Department, the DOJ had used a secret warrant to seize Fox News reporter James Rosen’s emails.

The press was correct to criticize that particular tactic, but in so doing it revealed a kind of shallowness about itself. It didn’t object to DOJ intimidation per se, but to the fact that a reporter rather than a mere civilian had been the target. If Rosen had been an imam in Michigan or a political dissident, the White House briefing room would have been mostly silent about it.

Instead they made it front page news, and forced the administration to examine itself to such great effect that Attorney General Eric Holder now considers the DOJ’s conduct toward Rosen his greatest regret. My hunch is that Hillary Clinton will have to put herself through a similar reckoning before the press lets go of the email story.

Assuming she does, though, I don’t think we can say with any certainty that it will set a tone for the media’s overall coverage of Clinton’s campaign. And as a political issue of its own, the email controversy will probably prove to be self-limiting. Republican presidential hopefuls like Jeb Bush and Scott Walker have email problems of their ownwhich, unsurprisingly, are a much bigger deal to in-state reporters in Florida and Wisconsin than to the national press corps that has been covering Clinton. Moreover, if Republicans in Congress allow their questions about Clinton’s emails to morph into a witch hunt, they’ll turn her into a martyr.

This particular Clinton drama is sui generis. Which means we’ll have to wait until the next imbroglio to learn whether the media and the Clintons will get along better this time around than they did in the 1990s.

“Media’s Email Hysteria: Why Are Republicans Exempt?”: In All Their Malignant Effrontery, The Clinton Rules Are Back

It is almost eerie how closely Hillary Clinton’s current “email scandal” parallels the beginnings of the Whitewater fiasco that ensnared her and her husband almost 20 years ago. Both began with tendentious, somewhat misleading stories published by The New York Times; both stoked highly exaggerated suspicions of wrongdoing; both were exploited by Republican partisans, whose own records were altogether worse; and both resulted in shrill, sustained explosions of outrage from reporters and commentators who could never be bothered to learn actual facts.

Fortunately for Secretary Clinton and the nation, she won’t be subjected to another fruitless $70 million investigation by a less-than-independent counsel like Kenneth Starr. The chances that the innocuous email flap will damage her nascent presidential campaign seems very small, according to the latest polling data.

Yet the reaction of the Washington media to these allegations renews the same old questions about fairness. In this instance, the behavior of Republican officials whose use of private email accounts closely resembles what Secretary Clinton did at the State Department has been largely ignored – even though some of those officials might also seek the presidency.

Recently Jeb Bush released a large volume of emails from the personal – i.e., non-governmental – email account that he routinely used as Florida governor, and then praised his own transparency with self-serving extravagance. The only problem is that those released emails represent only 10 percent of the total. The rest he has simply withheld, without any public review.

When Scott Walker served as Milwaukee county executive, before he was elected Wisconsin governor, he and his staff used a secret email system for unlawful campaign work on public time; that system emerged as part of an investigation that ultimately sent one of his aides to prison (another was immunized by prosecutors). Louisiana governor Bobby Jindal has used a personal email account for government business, as has former Texas governor Rick Perry. So have Florida senator Marco Rubio, and various congressmembers who have been heard to spout off about Clinton’s emails, such as Utah Rep. Jason Chaffetz.

Those examples epitomize hypocrisy, of course — yet none compares with the truly monumental email scandal of the Bush years, when millions of emails went missing from White House servers – and many more were never archived, as required since 1978 by the Presidential Records Act. Dozens of Bush White House staff used a series of private email accounts provided by the Republican National Committee (whose loud-talking chairman Reince Priebus now mocks Clinton as the “Secretary of Secrecy”). The RNC’s White House email clients most notably included scandal-ridden Bush advisor Karl Rove, who used the party accounts for an estimated 95 percent of his electronic messaging, and by Rove’s staff.

Among many other dubious activities, Rove aide Susan Ralston used her private RNC email to discuss Interior Department appointments with the office of crooked lobbyist Jack Abramoff, who wanted to influence the department on behalf of gambling interests. According to Abramoff associate Kevin Ring, another White House official explained to him that “it is better not to put this stuff in their email system because it might actually limit what they can do to help us, especially since there could be lawsuits, etc…” While Rove was forced to surrender some emails involving his notorious exposure of CIA agent Valerie Plame, he retained the capacity to delete thousands of emails.

Various investigations and lawsuits uncovered the astonishing breadth of the Bush White House email fiasco, such as the “recycling” of backup tapes for all of its emails between Inauguration Day 2001 and sometime in 2003. This evidently meant that vast troves of messages pertaining to the 9/11 terrorist attack went missing, of course – along with whatever Rove and his aides might have communicated on that topic, or weapons of mass destruction in Iraq, or countless other topics of public concern.

And former Secretary of State Colin Powell, whose office was also involved in both the Plame and WMD scandals, admitted recently that he used private emails in office – but that he turned over and retained none of them – zero. (Powell’s successor Condoleezza Rice claims she didn’t use email at all.) By contrast, Clinton has turned over tens of thousands of her emails to the State Department.

Thanks to a federal lawsuit filed by two nonprofit watchdog groups, the National Security Archive at George Washington University and Citizens for Responsibility and Ethics in Washington, a small proportion of the missing Bush White House emails were eventually restored – but only when the Obama administration finally settled the case in 2009. Those strict Obama rules for preserving emails (which Clinton stands accused of ignoring) resulted directly from the new administration’s determination to avoid the mess engendered by the deceptive and unlawful preservation practices of the Bush White House.

Now if Hillary Clinton’s use of a private email account is so shocking to the Beltway media, why did they barely notice (and care even less) when millions of emails disappeared during the Bush years?

The current hysteria may reflect the intense press prejudice against Clinton that several well-placed Washington journalists confessed during a brief moment of introspection following the disgraceful coverage of her 2008 campaign. And it should serve to warn voters that what Arkansas columnist and author Gene Lyons famously calls “the Clinton rules” – which encouraged inaccuracy, bias, and other forms of journalistic failure in the 1990s – are back in all their malignant effrontery.

“Strength, Toughness & Resolve Is All It Takes”: On Display At CPAC; How The Presidential Primary Makes GOP Candidates Simple-Minded

The Conservative Political Action Conference is always guaranteed to produce head-shaking moments, as one future presidential candidate after another tells the crowd of activists what they want to hear, and then some. It’s a concentrated version of the long Republican primary process, with everything that characterizes contemporary American conservatism cooked down to its viscous essence over the course of a few days.

You may have already heard about Scott Walker’s comments yesterday at the conference, in which he made an analogy between his fight to crush unions in Wisconsin and the fight against ISIS and other terrorist groups. I’ll get to that in a moment, but first I want to look at something Marco Rubio said this morning, because they go together in a way that tells us a lot about what we’re going to be hearing from these candidates for the next year and a half.

Speaking from the CPAC stage, Rubio said that “if we wanted to defeat [ISIS] militarily, we could do it.” But we haven’t done that, because President Obama “doesn’t want to upset Iran.” I’m sure many in the crowd nodded their heads. First you have the implication that despite the thousands of air strikes we’ve launched against ISIS, we’re not really trying to defeat them, and that doing so would be simple if only Obama had the backbone. But he won’t, because he’s so solicitous of another of our enemies, Iran. If you know that this president is a Muslim-coddling, terrorist-sympathizing weakling, it makes perfect sense.

But in reality, Iran, a Shiite country, despises the Sunni extremists of ISIS. ISIS threatens the government of Iraq, which is Iran’s ally (or lapdog, depending on how you look at it), which is why Iran has sent troops there to fight the terrorist group. Eliminating ISIS is exactly what Iran wants us to do.

Perhaps Marco Rubio understands that, and if given the chance he’d revise his comments. But doing so wouldn’t play too well with the people whose votes he needs, because it would be an acknowledgement that — guess what — things can get pretty complicated in the Middle East. We can be trying to stop Iran from getting nuclear weapons yet still have shared goals with them when it comes to another issue.

That simplifying impulse is what got Walker in trouble, too. When he said yesterday in answer to a question about ISIS, “If I can take on 100,000 protesters, I can do the same across the world,” the problem wasn’t, as many people said, that he was comparing Wisconsinites exercising their free speech rights in opposing his efforts to crush unions to brutal terrorists (he clarified later that that isn’t what he meant to say). The problem was that he was arguing that serious problems, whether it’s your own constituents who disagree with you or a terrorist organization, have essentially the same solution: strength, toughness, resolve. That’s all it takes, and he’s got it. He may not know a lot about foreign affairs, but he doesn’t need to know a lot about foreign affairs.

This is hardly new in the GOP. In 1964, Ronald Reagan said in a speech supporting Barry Goldwater, “They say the world has become too complex for simple answers. They are wrong. There are no easy answers, but there are simple answers. We must have the courage to do what we know is morally right.” Republicans have seldom veered from the conviction that in foreign affairs in particular, there are nothing but simple answers.

The trouble is, we’ve seen where that gets you. George W. Bush knew in his gut that every problem had a simple answer. Just as Rubio sees Iran and ISIS in a fictional alliance, Bush thought that Saddam Hussein and al-Qaeda must have been working together, because they’re all Bad Guys, right? And once we show our strength and resolve, the problems will melt before us. We all know how well that worked out.

Try to imagine a Republican presidential candidate who saw the world as a complicated place where sometimes we have to choose between bad options, being strong only gets you so far, and you have to consider the possibility that your actions could have unintended consequences. Would he be willing to say that to his party’s primary voters? Or would he tell them that actually, the answers are all simple, if only we have the courage to see them clearly and act?

I think we all know the answer to that. Campaigns in both parties are seldom going to be full of nuanced exploration of policy issues. But the GOP primary campaign forces its contenders to be particularly simple-minded, whether that’s who they really are or they’re just pretending.
