“Usurping The Will Of The People”: The Dirty Tricks That Rushed Detroit Into Bankruptcy
Governor Rick Snyder (R-MI) was so desperate to make Detroit the largest American city to declare bankruptcy that his lawyers apparently used deception to make sure their filing was in before a judge could block it.
Ronald King, an attorney for Detroit’s General Retirement System and the Detroit Police and Fire Retirement System, said that he agreed to delay a hearing on an injunction that would have prevented the city from filing for bankruptcy for five minutes at the request of Snyder’s lawyers. In that five minutes, attorneys filed papers to put Detroit under bankruptcy protection, placing all legal action against the city in a temporary stay.
“It was my intention to grant your request,” Ingham County Judge Rosemarie Aquilina told the pensioners’ attorneys.
“There’s no denying this was a race to the courthouse this afternoon and yet another example of usurping the will of the people,” King said.
Pensions are protected under Michigan’s constitution, but this protection has not been tested in federal court. The city has about $18 billion in debt.
The Michigan Republican Party’s eager embrace of emergency manager powers has left about half of the state’s African-Americans without elected local representatives.
When voters repealed the emergency manager law in 2012 by 53 to 47 percent, the state’s Republican-dominated legislature quickly restored it, including a provision that made it impossible for votes to repeal the law again.
Part of the argument for these laws, which allow state officials to replace all elected city officials in municipalities deemed to be in “emergency” with an unelected bureaucrat, was that this process would prevent bankruptcy, which would be too disruptive.
When Snyder selected bankruptcy expert Kevin Orr to be Detroit’s emergency manager, however, it became clear what path the governor, who faces re-election in 2014, had in mind for the Motor City. Orr – who has already hinted at his intention to cut pensions – will manage the bankruptcy, carrying out the governor’s wishes.
Unions who have seen Snyder and a lame-duck legislature rush in a law designed to weaken unions along with tax increases on pensioners are not hopeful about the bankruptcy process.
“Every step of the way, the citizens of Detroit were told that they had to give up their right to democratic representation in order to avoid bankruptcy,” Metro Detroit AFL-CIO president Chris Michalakis and Michigan State AFL-CIO president Karla Swift said in a joint statement. “Now that this filing has come anyway, it is clear that either state control has failed or that Governor Snyder and his emergency manager appointee were not honest about their intentions in the first place.”
As the city’s debts are discharged, the question is who will be asked to pay: workers — who were promised a retirement and have already offered concessions — or investors — who knew they were taking a risk?
UPDATE: Judge Rosemarie Aquilina has ruled the Detroit bankruptcy filing violates Michigan’s state Constitution and must be withdrawn, noting that the there had been a “rush” to bankruptcy.

“The States Are Not An Alternative America”: Republican Control Of Governorships Does Not Indicate A Solid Majority Of “The People”
There are two perpetually silly memes going around the commentariat these days in connection with the very limited but loudly expressed self-examination of the Republican Party, both involving the GOP’s relatively strong standing at the state level.
The first, which I’ve attacked before (here, here and here), and will keep attacking as long as it rears its ugly head, is that there is this essentially moderate (or at least “pragmatic”) brand of Republican pol operating at the state level who “gets it” and is free of the ideological manias of Washington-style GOPers. Give them the leadership of the party, it is often said, and “reform” will take care of itself.
When you start looking for these “pragmatists,” however, they seem to be in short supply. You can apply the label to Chris Christie and Bob McDonnell, I suppose, but these gents are not about to be handed the leadership of the national party, having just been excluded from the national party’s most important 2013 event, CPAC. Looking deeper in the gubernatorial ranks, though: Does Paul LePage “get it?” Is Rick Scott a “reformer?” Are Rick Perry or Bobby Jindal or Nikki Haley or Phil Bryant or Mary Fallon or Scott Walker or Jan Brewer “non-ideologues?” Is John Kasich really “reaching out” to non-GOP constituencies? Is Rick Snyder exhibiting freedom from conservative litmus tests? No, no, no, no and no.
A closely associated meme, which CNN’s Roland Martin articulates in a well-meaning but misguided column, is that Republicans by focusing on state politics are actually running the country as the two parties wrangle in Washington. So:
[M]any Republicans have told me they couldn’t care less about Washington, because legislation with real impact is being proposed and passed in the states. That’s why you’ve seen groups quietly backing initiatives on the state level and bypassing the hot lights and screaming media in Washington….
Think about it: Obama won Ohio, Florida, Michigan, Pennsylvania, New Mexico and Nevada, all states with GOP governors. So clearly voters in those states chose the Republican alternative in statewide elections, but when it came to the presidency, said “No thanks.”
I’m not buying for a second this silly notion that the GOP will have a Damascus Road experience and drastically change. It’s not going to happen. There will be some movement on the national level, but Republican grass-roots organizers are very well aware that the message the GOP is selling statewide is a winning formula.
Sorry, Roland. Republicans are touting their success at the state level not because they don’t care what happens in Washington, but because they didn’t win the presidency or the Senate in 2012 so what else are they going to tout? Their control of 30 of 50 governorships does not indicate a solid majority of “the people” in the alternative America represented by the states, but just a majority of state governments according to measurements whereby Alaska and North Dakota count the same as New York and California. And most important of all, their victories in 2010 and defeats in 2012 did not represent some self-conscious “split decision” whereby voters preferred Republican leadership at one level and Democratic leadership at another, but different election cycles that featured different electorates. So even if Democrats decide, as Martin wants them to do, to “focus” on state elections as Republicans allegedly have, 2014 will be tough for them because of the landscape and the shape of the midterm electorate, just as Republicans, no matter where they are “focused,” will face a stiff wind in 2016.
Sorry to keep harping on these issues, but Lord-a-mighty, these are fairly simple empirical matters that an awful lot of well-compensated and highly visible writers and talkers just can’t seem to get straight, or don’t want to because it interferes with a desired grinding of axes.

“Undermining Democracy”: The GOP Plot To Steal The 2016 Election Continues
Michigan’s Republican Party approved a resolution Saturday that would change the way the states award electoral votes from the winner-take-all system that has existed since the state’s admission to the Union.
A total of 14 votes would be awarded to the candidate with the most votes in each congressional district and two would go to the overall winner of the state’s popular vote.
Under this scheme, Mitt Romney would likely have won 10 of the state’s electoral votes to President Obama’s six — despite the fact that Obama carried the state by nearly 10 percent.
The resolution was introduced by Rep. Pete Lund (R), who offered electoral college reform legislation in 2011 that would have given Romney the state, but which state Republicans rejected because they assumed the GOP nominee, a Michigan native and son of a former governor, would win the state.
Lund will likely reintroduce the bill in 2013. Republicans have majorities in both state houses and Republican governor Rick Snyder is supportive of the plan, but questions its timing.
“The right way is to talk about it in a bipartisan way … just prior to a census,” Snyder said.
Snyder’s approval rating has declined rapidly since he signed anti-union legislation during last year’s lame-duck session. He’s since tried to move back to the center by saying he’d like the state to accept Medicaid expansion.
Michigan’s shift of 10 electoral votes to Romney would not have swung the 2012 election for Romney. However, if all the states that have suggested changing the way they award their electors — Michigan, Virginia, Ohio, Wisconsin and Pennsylvania — had done so, Romney would likely be in the White House now, which is why Republican National Committee Chairman Reince Priebus endorsed the scheme.
The idea has been rejected by a few top Republicans — like Paul Ryan (R-WI) and Virginia governor Bob McDonnell (R-VA) — and thus faded from the agendas in Virginia, Ohio and Wisconsin.
But in Pennsylvania — the state where voter ID was supposed to give the election to Romney — the effort continues.
A new bill that would rig the state’s electoral votes has been introduced by 13 Republican state senators. That support represents half the total votes the bill would need to pass the Senate. The bill could be on the desk of Governor Tom Corbett — who would sign it — this week.
Pennsylvania, like Michigan, has voted Democratic in every presidential election since 1992.

“Safety Was Never The Intention”: Michigan Governor Signs Extreme Anti-Abortion Bill Into Law
Michigan Gov. Rick Snyder (R) has approved a controversial package of abortion restrictions that will limit abortion access for women who live in rural areas, require doctors to prove that mentally competent women haven’t been “coerced” into their decision to have the procedure, and enact unnecessary, complicated rules for abortion clinics and providers. The governor signed HB 5711 into law on Friday despite widespread protests against the omnibus anti-abortion measure.
Snyder claims that HB 5711 “respects a woman’s right to choose while helping protect her health and safety.” But women’s health advocates warn the law will seriously threaten women’s access to the health services they need by imposing harsh regulations on abortion clinics and providers:
Critics of the Michigan law fear its insistence on new, standalone facilities will hurt women in rural and low-income areas as it could force some clinics to close. They say questioning women on whether an abortion is voluntary subjects them to a type of interrogation.
The Center for Reproductive Rights, an abortion rights group that opposed the measure, said it could force many existing abortion providers in the state to either tear down their offices and rebuild from the ground up — or shutter their practices. […]
“Safety was never the intention of this law. The only thing this law accomplishes is to make a difficult decision even more difficult,” said Rana Elmir, the communications director for the Michigan ACLU.
Even some state lawmakers who supported HB 5711 acknowledge the law isn’t actually intended to protect women. “This is about protecting fetuses,” one Republican legislator explained.
Michigan legislators were quick to capitalize on this year’s lame duck session to push through controversial abortion restrictions, potentially because five anti-choice state lawmakers lost their seats in November’s election. The majority of Michigan voters support legal access to abortion services.
