“The Nature Of Campaign Reporting”: The Circular Logic Behind Media Coverage Of The Clinton Email Story
Yesterday, Hillary Clinton took some questions from the press about her emails, a story that jumps back on to the front pages whenever there’s some new development, whether it’s truly meaningful or not. And without much indication of serious malfeasance on Clinton’s part, we’re reaching the point where a circular logic is taking over: the story is a story because it’s a story, and therefore we need to keep talking about it because it’s a story.
A reporter asked Clinton at that press conference: “Is this an indication that this issue isn’t going to go away for the remainder of your campaign?” It was an all too familiar meta-inquiry, not about the substance of the issue (though there were questions about that too) but about the questions the reporters themselves are asking, and whether the candidate thinks reporters are going to keep asking them. Unfortunately, candidates get questions like that all the time. How will this controversy affect your campaign? Why aren’t these questions going away? Doesn’t this issue suggest that this is an issue? It’s as if the reporter decides that asking about the substance isn’t getting anywhere, so they might as well treat the candidate like a panelist on The McLaughlin Group. And the candidate never says anything remotely interesting or informative in response.
Now before the chants of “Clinton apologist!” begin, let me say that like many liberals, I have complicated feelings about Clinton, some positive and some not so positive. I’ve written many critical pieces about her in the past; I’ve even criticized her for setting up a private email server.
But we have to be clear about just what it is we’re looking for in this story.
Republicans are no doubt hoping that lurking somewhere in Clinton’s emails is evidence of a terrible crime she committed whose revelation will destroy her career forever and deliver the White House to the GOP for a generation. But just for the sake of argument, let’s assume that no such horror will be revealed. What do we have then? Well, we have the plainly foolish decision to use a private server for work email, which we’ve known about for months. Maybe you think that a person who would do such a thing is unfit for the presidency, or maybe you don’t (though that would disqualify Jeb Bush).
Then there’s the possibility that she discussed sensitive or classified material in emails. She says she didn’t, but as yet we don’t know for certain. You might or might not consider that disqualifying as well. But the government classifies an absurd amount of material, even things that are publicly available; what would really matter is the details, like whether somebody else said something about a classified matter in an email to her (which wouldn’t be her fault), and more importantly, what specifically the material was. And while some argue that private email servers are more vulnerable to hackers and therefore it’s particularly bad if she ever discussed classified information there, government systems get hacked all the time. That isn’t to excuse the original decision to set up the private account, it’s just to say that if there’s going to be a new accusation, like “She received classified information!”, then we should get as specific as we can about it so we can judge how serious it is.
Or maybe you want to argue that this issue is important because it shows that Clinton has a “penchant for secrecy.” Which she obviously does, but you have to go further and say exactly what that means and how it might affect her presidency. It isn’t enough to say, “Cuz, um, Nixon!” The problem with Richard Nixon wasn’t that he was secretive. All presidents are secretive to one degree or another. The problem with Nixon was that he and his aides committed dozens of crimes, for which many of them went to prison. Out of Watergate we got the oft-repeated cliche, “It’s not the crime, it’s the cover-up,” but that’s completely misunderstood. It’s the cover-up that gets you caught; the crime is what matters (and in Nixon’s case, the cover-up involved committing more crimes).
We’re still waiting for somebody to explain the crime Hillary Clinton committed. And to repeat, maybe there is one; who knows. Reporters who find this story interesting should keep digging into the substance, and eventually they and the investigators looking into it will be able to tell us definitively whether there’s anything there.
But the campaign reporters trailing Clinton around aren’t adding much of anything to the story, they’re just asking whether they’ll be asking more questions about it. That’s partly the nature of campaign reporting, and partly because with a Democratic race that’s far less compelling than what’s going on over on the Republican side, they’re starved for things to talk about (and they’d be much more interested if Bernie Sanders and Clinton were attacking each other, which they aren’t). It’s also because of what are often referred to as the “Clinton Rules,” which state that when it comes to Bill and Hillary Clinton, you can whip up a faux scandal out of nothing, then keep talking about it because it’s “out there,” regardless of whether anything problematic has actually been discovered.
The email story may not be the most ridiculous fake scandal in the history of the Clintons, because there’s a lot of competition for that title. As has often been the case, it was a poor decision Hillary Clinton made that got the scandal ball rolling. But there are only so many times you can ask “What is she hiding???” before you have to come up with something that she might actually be hiding.

“President Obama On Finding Openings”: An Incredibly Wise Grasp Of How History Works
After President Obama gave his speech about the Iran Nuclear Deal at American University, he met with ten journalists to discuss it further. I found this part of Max Fisher’s report to be fascinating.
Toward the end of our meeting with President Obama, one of us asked whether the Iran nuclear deal might change the future of that country’s poisonously anti-American politics, and Obama drifted from the technical and political details he’d otherwise focused on into something of a more reflective tone.
“I just don’t know,” he said, leaning back a bit in his chair for the first time since he’d arrived. “When Nixon went to China, Mao was still in power. He had no idea how that was going to play out.
“He didn’t know that Deng Xiaoping would suddenly come in and decide that it doesn’t matter what color the cat is as long as it catches mice, and the next thing you know you’ve got this state capitalism on the march,” Obama said, paraphrasing the famous aphorism by Mao’s successor that capitalistic policies were acceptable if they helped China. “You couldn’t anticipate that.”…
To hear him draw a connection between the nuclear deal and China’s transformation, then, was striking. It suggested that Obama, though he has repeatedly insisted he does not expect the character of Iran’s regime to change, does see it as a possibility, one potentially significant enough that it evokes, at least in his mind, President Nixon’s historic trip to China.
At the same time, the lesson Obama seemed to draw from the comparison was not that he, too, was on the verge of making history, but rather that transformations like China’s under Deng, opportunities like Nixon’s trip, can have both causes and consequences that are impossible to foresee. His role, he said, was to find “openings” for such moments.
That is an incredibly wise grasp of how history works – even for the most powerful person on the planet. It is a striking rebuke of much that we hear from would-be Republican leaders these days who presume that a President of the United States can control world events via military dominance. For those with some knowledge of history, it is especially important given that the discussion is taking place about a country where we tried that back in 1953 and paid the price for it via the Islamic Revolution in 1979.
It reminds me of comments President Obama has made in two other interviews with journalists. First of all, David Remnick.
“I think we are born into this world and inherit all the grudges and rivalries and hatreds and sins of the past,” he said. “But we also inherit the beauty and the joy and goodness of our forebears. And we’re on this planet a pretty short time, so that we cannot remake the world entirely during this little stretch that we have.” The long view again. “But I think our decisions matter,” he went on. “And I think America was very lucky that Abraham Lincoln was President when he was President. If he hadn’t been, the course of history would be very different. But I also think that, despite being the greatest President, in my mind, in our history, it took another hundred and fifty years before African-Americans had anything approaching formal equality, much less real equality. I think that doesn’t diminish Lincoln’s achievements, but it acknowledges that at the end of the day we’re part of a long-running story. We just try to get our paragraph right.”
In other words, one of the ways you find openings is to get your paragraph right.
Secondly, he said this in an interview with Tom Friedman.
What struck me most was what I’d call an “Obama doctrine” embedded in the president’s remarks. It emerged when I asked if there was a common denominator to his decisions to break free from longstanding United States policies isolating Burma, Cuba and now Iran. Obama said his view was that “engagement,” combined with meeting core strategic needs, could serve American interests vis-a-vis these three countries far better than endless sanctions and isolation. He added that America, with its overwhelming power, needs to have the self-confidence to take some calculated risks to open important new possibilities — like trying to forge a diplomatic deal with Iran that, while permitting it to keep some of its nuclear infrastructure, forestalls its ability to build a nuclear bomb for at least a decade, if not longer.
Openings are made possible when your self-confidence allows you to take calculated risks.
To sum up: Getting your paragraph right by staying true to your North Star, combined with the self-confidence to take calculated risks, creates openings that can lead to transformative change.
Decades from now we’ll be bearing the fruit of openings this President has made possible with that kind of wisdom.

“The Southern Strategy Is Dead”: Does The Republican Party Have An Alternative?
On Monday afternoon, South Carolina Gov. Nikki Haley (R) announced that she now supports removing the Confederate flag from the grounds of the statehouse in Columbia. While the reaction of the Republican presidential candidates to the terrorist attack last week in Charleston and the subsequent debate about the flag has been cowardly at best, this is nevertheless a significant moment, with broad implications for the place of race in American politics. To put it simply, the GOP’s “Southern Strategy” is all but dead.
As political strategies go, it had a good run — nearly half a century. In 1968, Richard Nixon campaigned on behalf of the “silent majority” who wanted nothing of civil rights protests and uppity young people; he told them he’d deliver the “law and order” they craved, and there was little question who they were afraid of. It was called the Southern Strategy because while the South had been firmly Democratic since the Civil War, Lyndon Johnson’s signing of the Civil Rights Act and Voting Rights Act initiated an exodus of Southern whites to the Republican Party, enabling them to build an electoral college majority with the South as its foundation. They would win five of the next six presidential elections with that strategy.
A key component was to make the GOP the default party of white people, by running against what they associated with black people — not just civil rights, but things like poverty programs and crime. It required ongoing reminders of who was on who’s side. So in 1980, Ronald Reagan announced his campaign for president in the town of Philadelphia, Mississippi, where civil rights workers James Chaney, Michael Schwerner, and Andrew Goodman were murdered in 1964. He was not there to promote racial healing. Four years earlier, Reagan had told audiences how appalled he was at the idea of a “strapping young buck” buying T-bone steaks with food stamps, and he spent a good deal of the 1980 campaign railing against welfare queens. The race of the (largely fictional) offenders was lost on no one.
And as Stanley Greenberg, then a political scientist and now a leading Democratic pollster, found in his classic 1985 study of Macomb County, Michigan, the entire phenomenon of “Reagan Democrats” was built on racial resentment. “These white Democratic defectors express a profound distaste for blacks, a sentiment that pervades almost everything they think about government and politics,” he wrote. “Blacks constitute the explanation for their vulnerability and for almost everything that has gone wrong in their lives; not being black is what constitutes being middle class; not living with blacks is what makes a neighborhood a decent place to live.”
So when Reagan’s vice president ran to succeed him, it was little surprise that he would employ an inflammatory racial attack against his opponent, repeating over and over again the story of escaped convict Willie Horton. If Michael Dukakis were elected, George Bush’s campaign convinced people, hordes of menacing black felons would rampage through the land, raping white women and emasculating their husbands. They didn’t say it in quite those words, but they didn’t have to; Horton’s mug shot (aired endlessly on the news) and the story of his crimes was more than enough. While Bush is now treated as a noble and kind elder statesman, we shouldn’t forget that he ran one of the most racist presidential campaigns of modern times. “By the time we’re finished,” Bush’s strategist Lee Atwater said, “they’re going to wonder whether Willie Horton is Dukakis’ running mate.”
Today a Republican presidential candidate wouldn’t feature Willie Horton as prominently as Bush did, but it isn’t because they’ve seen the moral error of their ways. It’s because it doesn’t work anymore. While nearly nine in 10 voters in 1980 were white, their proportion has been dropping for decades, and it will probably be around seven in 10 in next year’s election. Mitt Romney won all the Deep South in 2012, and won white voters by more than 20 points — but still lost to Barack Obama by 126 electoral votes.
That doesn’t mean the GOP’s center of gravity doesn’t still lie beneath the Mason-Dixon line. Republicans control nearly all the state governments in the South, which provides them laboratories for their latest innovations in governing, and their hold on the House of Representatives is built on their strength in the South. But as a strategy to win the White House, counting on white people — and the white people who respond when their racial hot buttons are pushed — won’t ever succeed again.
The party’s candidates are still coming to grips with this reality. They’ve pandered to racists for so long that not upsetting them is still their default setting; when the issue of the Confederate flag came up, the first response almost all of presidential candidates had was just to say that the people of South Carolina will decide, which is procedurally accurate and substantively irrelevant. But if South Carolina’s governor can come out against the flag, it really is a signal that times have changed.
Smart people in the GOP know that if the party is going to win the White House again, they can’t do it with the Southern Strategy that served them so well for so long. The question now is whether they can come up with an alternative.

“To The Permanent War Caucus, It’s Always 1938”: When The Hitler Card Won’t Do, Play The Chamberlain Card
If he accomplished nothing else during his presidency, Barack Obama has surely earned a place in the Bad Political Analogies Hall of Fame. According to savants on Fox News and right-wing editorial pages, Obama is both Adolf Hitler and Neville Chamberlain, the British prime minister who capitulated to Nazi territorial demands in 1938.
That is, to the more fervid exponents of the Sore Loser Party, President Obama is both a psychotic dictator and a spineless appeaser of tyrants.
(I am indebted for this insight to Washington, D.C., attorney Mike Godwin, promulgator of “Godwin’s Law,” which holds that the first person to play the Hitler card in a political argument automatically loses.)
I’m thinking the law also needs a Chamberlain corollary, because the Permanent War Caucus on the Republican right accuses every American president who negotiates an arms pact with our putative enemies of weakening national security. Always and with no known exceptions.
President Nixon got compared to Neville Chamberlain for his (strategically brilliant) opening to China, as well as for the SALT (Strategic Arms Limitation Treaty) with the Soviet Union.
In 1988, something called the Conservative Caucus, Inc. took out full-page newspaper ads arguing that “appeasement is as unwise in 1988 as in 1938.” The ad mocked President Reagan with Chamberlain’s iconic umbrella, and compared Soviet premier Mikhail Gorbachev to Hitler.
In 1989, of course, the Berlin Wall fell and the USSR imploded.
Jonathan Chait sums up the right’s paradoxical case against Obama, weakling dictator: “He is naive in the face of evil, desperate for agreement, more willing to help his enemies than his friends. The problem is that conservatives have made this same diagnosis of every American president for 70 years…Their analysis of the Iran negotiations is not an analysis at all, but an impulse.”
Despite the fact that Tehran made concessions most observers thought were impossible, the right hates this deal because they hate all deals. Today, Israeli prime minister Benjamin Netanyahu and his U.S. supporters, such as the forever-wrong William Kristol, describe Iran’s leaders as the new Führer. The apocalyptic enemy before that was the Tehran regime’s bitter enemy, Saddam Hussein.
Anyway, we all know how invading Iraq worked out.
Iran is five times Iraq’s size, has three times its population, and has extremely forbidding terrain.
No matter. To the Permanent War Caucus, it’s always 1938 and blitzkrieg is eternally threatened. Netanyahu has been predicting Iran’s imminent acquisition of nuclear weapons for almost 20 years now — although the Wile E. Coyote bomb cartoon is a relatively recent touch.
Israel, of course, has a nuclear arsenal of its own.
But what really makes the Hitler/Chamberlain comparison so foolish isn’t simply that it’s a cliché. It’s that it completely misrepresents the power balance between the U.S., its allies, Britain, France, Germany, Russia, and China, and militarily weak, politically and strategically isolated Iran.
In 1938, Nazi Germany had the strongest military in the world. (Indeed, there’s a revisionist school that holds Neville Chamberlain was wise to postpone an inevitable war while Britain re-armed.)
Shiite Iran, by contrast, can scarcely project power much beyond its borders, and is threatened by traditional enemies on all sides. Examine a map of the Middle East. Tehran is almost 1,000 miles from Jerusalem. Ethnically and linguistically distinct, the Persians are surrounded by hostile Sunni Arab states, including Saudi Arabia, which repress their own Shiite minorities, and are fanatically opposed to the Ayatollahs.
Almost unknown in this country, U.S. client Saddam Hussein’s 1980 invasion of Iran — complete with nerve gas attacks on the Persians and Kurds –remains a bitter memory. ISIS terrorists are massacring Shiites by the thousands in Iraq and Syria. For that matter, check out the U.S. military bases ringing the Persian Gulf, along with omnipresent, nuclear-armed aircraft carriers and submarines.
One needn’t have a particle of sympathy for Iran’s odious theocratic government to see that we’ve got them totally outgunned and surrounded. Economic sanctions engineered by the Obama administration have really hurt. So yes, if they thought they could trust us, it would be very much in Tehran’s interest to make a deal and stick to it — putting the nuclear temptation aside in favor of what amounts to anti-invasion insurance.
But can we trust them?
President Obama explained his thinking to the New York Times’s Thomas Friedman: “We are powerful enough to be able to test these propositions without putting ourselves at risk. And that’s the thing…people don’t seem to understand.”
“[W]ith respect to Iran…a dangerous country, one that has engaged in activities that resulted in the death of U.S. citizens, but the truth of the matter is: Iran’s defense budget is $30 billion. Our defense budget is closer to $600 billion. Iran understands that they cannot fight us. You asked about an Obama doctrine. The doctrine is: We will engage, but we preserve all our capabilities.”
If you’re really strong, in other words, act strong.

“This Time, They’ve Gone Too Far”: Republicans Are Beginning To Act As Though Barack Obama Isn’t Even The President
It’s safe to say that no president in modern times has had his legitimacy questioned by the opposition party as much as Barack Obama. But as his term in office enters its final phase, Republicans are embarking on an entirely new enterprise: They have decided that as long as he holds the office of the presidency, it’s no longer necessary to respect the office itself.
Is that a bit hyperbolic? Maybe. But this news is nothing short of stunning:
A group of 47 Republican senators has written an open letter to Iran’s leaders warning them that any nuclear deal they sign with President Barack Obama’s administration won’t last after Obama leaves office.
Organized by freshman Senator Tom Cotton and signed by the chamber’s entire party leadership as well as potential 2016 presidential contenders Marco Rubio, Ted Cruz and Rand Paul, the letter is meant not just to discourage the Iranian regime from signing a deal but also to pressure the White House into giving Congress some authority over the process.
“It has come to our attention while observing your nuclear negotiations with our government that you may not fully understand our constitutional system … Anything not approved by Congress is a mere executive agreement,” the senators wrote. “The next president could revoke such an executive agreement with the stroke of a pen and future Congresses could modify the terms of the agreement at any time.”
It’s one thing to criticize the administration’s actions, or try to impede them through the legislative process. But to directly communicate with a foreign power in order to undermine ongoing negotiations? That is appalling. And just imagine what those same Republicans would have said if Democratic senators had tried such a thing when George W. Bush was president.
The only direct precedent I can think of for this occurred in 1968, when as a presidential candidate Richard Nixon secretly communicated with the government of South Vietnam in an attempt to scuttle peace negotiations the Johnson administration was engaged in. It worked: those negotiations failed, and the war dragged on for another seven years. Many people are convinced that what Nixon did was an act of treason; at the very least it was a clear violation of the Logan Act, which prohibits American citizens from communicating with foreign governments to conduct their own foreign policy.
This move by Republicans is not quite at that level. As Dan Drezner wrote, “I don’t think an open letter from members of the legislative branch quite rises to Logan Act violations, but if there’s ever a trolling amendment to the Logan Act, this would qualify,” and at least it’s out in the open. But it makes clear that they believe that when they disagree with an administration policy, they can act as though Barack Obama isn’t even the president of the United States.
And it isn’t just in foreign affairs. In an op-ed last week in the Lexington Herald-Leader, Mitch McConnell urged states to refuse to comply with proposed rules on greenhouse gas emissions from the Environmental Protection Agency. Never mind that agency regulations like these have the force of law, and the Supreme Court has upheld the EPA’s responsibility under the Clean Air Act to regulate carbon emissions — if you don’t like the law, just act as though it doesn’t apply to you. “I can’t recall a majority leader calling on states to disobey the law,” said Barbara Boxer, the ranking Democrat on the Senate Environment and Public Works Committee, “and I’ve been here almost 24 years.”
The American political system runs according to a whole series of norms, many of which we don’t notice until they’re violated. For instance, the Speaker of the House can invite a foreign leader to address Congress for the sole purpose of criticizing the administration, and he can even do it without letting the White House know in advance. There’s no law against it. But doing so violates a norm not only of simple respect and courtesy, but one that says that the exercise of foreign policy belongs to the administration. Congress can advise, criticize, and legislate to shape it, but if they simply take it upon themselves to make their own foreign policy, they’ve gone too far.
But as has happened so many times before, Republicans seem to have concluded that there is one set of rules and norms that apply in ordinary times, and an entirely different set that applies when Barack Obama is the president. You no longer need to show the president even a modicum of respect. You can tell states to ignore the law. You can sabotage delicate negotiations with a hostile foreign power by communicating directly with that power.
I wonder what they’d say if you asked them whether it would be acceptable for Democrats to treat the next Republican president that way. My guess is that the question wouldn’t even make sense to them. After all, that person would be a Republican. So how could anyone even think of such a thing?
