“Fundamentally Dishonest”: The Self-Contradictory Argument All Republicans Are Making On The Indiana Discrimination Law

Now that it’s becoming a national story, all the Republican candidates are going to have to take a position on the new Indiana law that for all intents and purposes legalizes discrimination against gay people. (If you’re in the market for a lengthy explanation of what the law does and doesn’t do and what the implications are, I wrote one yesterday.) And they all look to be coming down in the same place—one that’s fundamentally dishonest about the law and its implications. They’re essentially trying to have it both ways, supporting the establishment of a right of discrimination for religious business owners, but claiming that they are supporting no such thing. Here’s Jeb Bush talking to Hugh Hewitt yesterday:

Bush: I think if you, if they actually got briefed on the law that they wouldn’t be blasting this law. I think Governor Pence has done the right thing. Florida has a law like this. Bill Clinton signed a law like this at the federal level. This is simply allowing people of faith space to be able to express their beliefs, to have, to be able to be people of conscience. I just think once the facts are established, people aren’t going to see this as discriminatory at all.

Hewitt: You know, the Religious Freedom Restoration Act was signed in 1993. It’s been the law in the District of Columbia for 22 years. I do not know of a single incidence of the sort that Tim Cook was warning about occurring in the District in the last 22 years.

Bush: But there are incidents of people who, for example, the florist in Washington State who had a business that based on her conscience, she couldn’t be participating in a gay wedding, organizing it, even though the person, one of the people was a friend of hers. And she was taken to court, and is still in court, or the photographer in New Mexico. There are many cases where people acting on their conscience have been castigated by the government. And this law simply says the government has to have a level of burden to be able to establish that there’s been some kind of discrimination. We’re going to need this. This is really an important value for our country to, in a diverse country, where you can respect and be tolerant of people’s lifestyles, but allow for people of faith to be able to exercise theirs.

Just to be clear, the Indiana law is not like the federal RFRA, in both the context in which it was passed and its particular provision. The Indiana law specifically applies to disputes between individuals, whereas the federal law discusses only personal conduct the government is trying to regulate. (The federal law came about because of a case where two Native Americans were denied unemployment benefits because they had used peyote in a religious ceremony.) But in any case, Republicans like Jeb are trying to pretend that we can satisfy everyone, and that the Indiana law does so. But we can’t, and it doesn’t. We have to make a choice.

What Bush is doing here (and what Indiana Governor Mike Pence and the rest of the Republicans defending this law are doing as well) is a misleading little two-step. Their argument is: 1) We must allow religious people to discriminate; and 2) This has nothing to do with discrimination. But both those things can’t simultaneously be true. You can call it “simply allowing people of faith space to be able to express their beliefs” or “people acting on their conscience,” but the whole issue is that the act of conscience that they want to undertake is also an act of discrimination. That’s because the particular acts of conscience we’re talking about are those that are not in the realm of speech or worship but in the realm of commerce, and they involve another person.

The cases in question are essentially zero-sum conflicts of claimed rights. Janet wants to have an anniversary dinner in a restaurant; Mike, the restaurant owner, doesn’t want to serve gay couples. There are only two possible outcomes: Janet and her partner get served, in which case Mike has to give; or Mike gets to refuse that service, in which case Janet has to give. You can dress up Mike’s motivations any way you want—”sincere religious beliefs,” “act of conscience,” whatever—but that doesn’t change the fact that one person is going to win and the other is going to lose.

The liberals who object to the Indiana law are making their choice clear: Janet’s right to be treated equally trumps Mike’s desire to discriminate, even though that desire is based on religious beliefs. The conservatives who support the law are taking the opposite position: If it’s based on a religious belief, Mike’s right to discriminate trumps Janet’s right to be treated equally. I happen to disagree with the conservative position, but I would respect it a lot more if they’d just come out and admit what their position really is. Instead, they’re trying to claim that there’s no conflict between Janet and Mike and they aren’t taking a side.

But they are. These kinds of conflicts are the whole point of this law, the reason why Republicans wanted to pass it and would like to see others like it. Of course, nobody wants to say they support “discrimination.” But if that florist in Washington or that photographer in New Mexico whom Bush is defending have a policy that says, “We will accept the business of straight couples but not gay couples,” then they’re discriminating. Republicans want to make sure that business owners have a legal right to discriminate against potential customers in that fashion. They ought to just admit it.

“How The GOP Made Fiscal Responsibility Look Irresponsible”: It’s A Matter Of When, Not If, Republicans Will Cave

It’s a minor miracle: Both houses of the Republican-controlled Congress have passed a budget.

Now, that’s the easy part compared to getting appropriations bills to Obama’s desk that he will actually sign. And notwithstanding the bipartisan lovefest that surrounded the House bill fixing Medicare physician reimbursements (held up for the moment in the Senate over abortion), deep philosophical differences between the parties remain.

So a standoff between congressional Republicans and the White House is inevitable. (Unless you think Obama is going to suddenly want to repeal ObamaCare.) And under both Obama and President Bill Clinton, these stalemates have seldom ended well for the Republicans.

Why? Because even though the Constitution vests the most important taxing and spending powers in Congress, the president has some huge advantages. If the president doesn’t want to sign a given spending bill and Congress doesn’t have the votes to override the veto, lawmakers only have blunt instruments with which to force his hand. And since congressional Republicans tend to end up getting the blame in the media and in the polls, even those tools are of limited utility. The president knows it is a matter of when, not if, Republicans will cave.

Republicans are trying to rein in the spending driving both the long-term debt and the unfunded liabilities of the major entitlement programs the Democrats built. They are trying to be fiscally responsible.

You may not agree with all the cuts Republicans make in their budgets. You may not be convinced their numbers add up. But Paul Ryan and Tom Price have been more transparent about their fiscal vision than most of their detractors.

The president has a different vision, and he isn’t budging. To try and force his hand (if not change his mind), Republicans have relied on a series of high-profile manufactured crises: the fiscal cliff, various debt ceiling standoffs, government shutdowns, near-shutdowns of major Cabinet departments, the threat of across-the-board tax increases, you name it.

And that’s the problem. In the process, they have made fiscal responsibility look downright irresponsible.

As the national debt was careening toward $18 trillion, Republicans insisted there be some limit to the federal government’s borrowing power. But because of the means they used to try to compel the president, it was the Republicans who stood accused of refusing to pay Washington’s bills and letting the government default on its obligations.

In the fiscal cliff debate, Obama likened congressional Republicans to hostage takers when they tried to hold the line on spending and taxes. Fiscally-minded conservatives probably fancy themselves more green eyeshade accountants than hostage takers. But it’s true that the GOP’s weaponized approach made them look like irresponsible bad guys, at least in the mainstream media.

These battles haven’t been a total loss for Republicans. Far more of the Bush tax cuts have survived than once seemed likely. Sequestration has contained spending growth. But because sequestration hits defense spending as well as social programs, a lot of Republicans are as anxious for relief as the Democrats. This in turn annoys the party’s strongest fiscal conservatives. Why trust promises of future spending cuts when the leadership seems willing to roll back the ones already in effect?

Conservative activists are irritated by the fact they have little to show for the last time Republicans held the White House and Congress simultaneously — and probably feel a little guilty they didn’t do more to pressure Republicans at the time. So they have made up for it by pressuring Republicans to do things they don’t have enough power to do. And because the Republican leadership frequently says it will fight next time and then next time doesn’t come, their pleas for patience fall on deaf ears.

That’s true even among members of the House. A key group of fiscal conservatives clearly lacks confidence in the leadership but doesn’t have the votes or a plan to replace them.

While there has been substantial short-term deficit reduction, the fiscal picture over the longer term keeps getting bleaker. All conservative lawmakers can do is vote for bills they correctly see as entirely inadequate to fix the challenges facing the country — or deny leadership the votes to pass anything, except by working with the Democrats.

Thus the party of fiscal discipline often doesn’t seem disciplined at all.

“How Rand Paul Is Losing His Distinctiveness”: He’s About As Libertarian As An Ambitious Republican Can Be

As the 2016 presidential race has swung into motion in the last couple of months, we’ve heard a lot about Jeb Bush, and Scott Walker, and even Ted Cruz. But there hasn’t been a lot of news about Rand Paul, whom many people considered the most interesting candidate in the race. Paul has proven adept at gaining positive news coverage, and the fact that he’s a quasi-libertarian makes him a little less predictable than other candidates. In fact, that’s the core of his appeal. He can’t argue that he has a lengthy list of accomplishments; his 2010 Senate campaign was the first time he ran for any office, and he hasn’t authored any important legislation. Being different is what makes Rand Paul compelling.

But there’s only so different you can be. The guy who was supposedly so skeptical of the overuse of American military power is now proposing a huge increase in military spending:

The move completes a stunning reversal for Paul, who in May 2011, after just five months in office, released his own budget that would have eliminated four agencies—Commerce, Housing and Urban Development, Energy and Education—while slashing the Pentagon, a sacred cow for many Republicans. Under Paul’s original proposal, defense spending would have dropped from $553 billion in the 2011 fiscal year to $542 billion in 2016. War funding would have plummeted from $159 billion to zero. He called it the “draw-down and restructuring of the Department of Defense.”

But under Paul’s new plan, the Pentagon will see its budget authority swell by $76.5 billion to $696,776,000,000 in fiscal year 2016.

The boost would be offset by a two-year combined $212 billion cut to funding for aid to foreign governments, climate change research and crippling reductions in to the budgets of the Environmental Protection Agency, and the departments of Housing and Urban Development, Commerce and Education.

We should have seen this coming. Last August, I wrote that while Paul may have a few positions that don’t fit neatly into traditional Republican conservatism, the more central an issue is, the more likely he is to take the expected GOP line:

Even if being a little less ideologically predictable is part of Paul’s appeal, it turns out that there are some positions that are negotiable for a Republican presidential candidate trying to win over primary voters, and some that aren’t. A true libertarian can start off telling those voters that he favors low taxes and small government, and they’ll cheer. He can tell them he’s concerned about the militarization of the police, as Paul recently wrote eloquently about, and they might say, “I still think we need law and order, but I get what you’re saying.” He can tell them that government surveillance of Americans is getting out of control, and they might decide he has a point, even if they’re still concerned about fighting terrorism. But if the libertarian candidate goes on to say that because he believes in maximal personal freedom, he also supports abortion rights, same-sex marriage, and the legalization of drugs, they’ll raise their eyebrows and say, “Hold on there, buddy.”

That’s not what Rand Paul will be saying; on those last three issues, he ranges from firmly Republican (he opposes abortion rights) to essentially Republican (he opposes same-sex marriage but says it should be left up to the states) to somewhat less Republican (he opposes legalization but has suggested some sensible reform of marijuana laws). In other words, he’s about as libertarian as an ambitious Republican can be: pushing the GOP a bit on issues where the party is pulled by competing impulses (like law and order vs. skepticism of state power), but safely in the fold on every issue where there’s consensus in the party.

Why is Paul making this proposal now? It’s partly because the presidential race is getting going, but mostly because this intra-Republican argument over the budget has brought the issue of military spending back near the top of the agenda. If he wants to be competitive in the presidential race, Paul has to get on the right side.

Contemporary conservatism has four main pillars: low taxes, small government, “traditional” social values, and a large military. No one who wants to be the GOP presidential nominee can stray from any of them in any serious way. And this is Rand Paul’s dilemma: His distinctiveness as a candidate comes from the fact that there are areas in which he questions Republican orthodoxy, but if he questions parts of that orthodoxy that Republicans fervently believe in, they’ll reject him. But when he does things like propose a large increase in military spending, he ends up looking just like every other Republican.

“This Did Not Go According To Plan”: McMorris Rogers Gets An Earful On ACA

For much of 2013 and 2014, Republicans were on a quest to discover “Obamacare victims.” GOP officials were convinced the Affordable Care Act was wreaking havoc on families’ lives, and Republicans everywhere were hunting for horror stories.

In nearly every instance, those stories fell apart in the face of routine scrutiny, and most of the “victims” were actually far better off with the ACA than without it. One of the more notable examples arose early last year when Rep. Cathy McMorris Rodgers (R-Wash.), the House Republican Conference chair, used her party’s official response to the State of the Union to introduce America to “Bette in Spokane.”

Predictably, the story unraveled and McMorris Rodgers was pressed for an apology after pushing a misleading story. A year later, the Republican congresswoman hasn’t given up.

Cathy McMorris Rodgers, chair of the House GOP conference, took to Facebook to commemorate the fifth anniversary of the Affordable Care Act by asking to hear real-life horror stories from real people.

This did not go according to plan. McMorris Rodgers generated plenty of responses, most of which were from people who see the ACA as a lifesaver for their families.

I’m not altogether sure what the point of the endeavor was supposed to be. What exactly did the Republican congresswoman hope to accomplish?

But even putting that aside, this little incident should be a reminder to GOP lawmakers that their assumptions about “Obamacare” may not be in line with Americans’ reactions in the real world. In fact, if Republicans on the Supreme Court gut the law, consumers will be looking to folks like McMorris Rodgers to prevent systemic chaos.

Postscript: Wonkette joked, “[O]bviously, the takeaway here is that Obamacare is such a huge failure that the government is paying people to troll Facebook and lie about how much they like the ACA, because liberals are congenital liars, and poor Cathy McMorris Rodgers is a victim of cyberbullying, the end.”

Wonkette was kidding, but I wouldn’t be too surprised if this line took root in conservative media fairly soon, if it hasn’t already.

“The Great Wall Of China On The Rio Grande”: The Real Costs Of Foolish Plans To ‘Secure’ The Border

Sen. Ted Cruz launched his bid for the Republican presidential nomination this week by promising to “finally, finally, finally secure the borders” and put an end to unauthorized immigration. This will warm the hearts of restrictionists, no doubt. But it should scare Americans who love their pocketbooks and liberties more than they hate undocumented Latino immigrants.

Restrictionists accuse many of these immigrants of being welfare queens who come to America illegally and live off taxpayers. Cruz has contributed to the hysteria by proposing bills barring undocumented workers from ever receiving any means-tested benefits, presumably even after they become legal.

Accusations that undocumented Latinos strain the welfare system are a red herring. If anything, immigrants, legal and illegal, constitute something of a welfare windfall. How? By coming to this country during their peak working years, after another society has borne the cost of raising and educating them, they save our system a ton of money. Studies generally don’t take this windfall effect into account, and still find that the economic contributions of low-skilled Latinos far outpace their welfare use. For example, a Texas comptroller study found that although unauthorized workers consumed about $504 million more in public services than they paid in taxes, without them, the Texas economy would shrink by 2.1 percent, or $17.7 billion. A full accounting of these folks would likely show them to be an even bigger economic boon (especially since the employment participation rate of Latino men is higher than the native born, and their overall welfare use is lower).

Meanwhile, as Cruz and his ilk whine about the (exaggerated) welfare costs of immigrants, they act as if their own plans to erect the Great Wall of China on the Rio Grande would be costless. Nothing could be further from the truth.

Cruz wants to establish “100 percent operational control” of America’s southern border by completing a double-layer fence on the entire 2,000 miles, tripling the size of the border patrol, and quadrupling the number of helicopters and cameras.

This is beyond ill conceived. First of all, 45 percent of all illegal immigrants are visa over-stayers. So Cruz’s efforts are totally irrelevant for nearly half of America’s illegal immigrants. What’s more, even the Berlin Wall, the most fortified border in modern history, was successfully breached 1,000 times every year. That rate will be a gazillion times greater on America’s southern border, which is not a barren, open expanse of land. In fact, it has a varied and rugged terrain with mountains and valleys and national parks (one the size of Rhode Island) and rivers that the wall will have to hop, skip, and jump around.

The Rio Grande has myriad tributaries that feed millions of people on both sides of the border. If Cruz’s wall is anything like the current 18-foot-high structure with rust-red hollow posts sunk six inches apart in a concrete base, it will have to stop several miles short on each side to avoid damming the watershed, leaving major openings for people to walk through.

And what would a double-wall cost taxpayers?

It is very difficult to get a full grip, but the construction cost alone of a single-layer fence on the 1,300 or so unfenced miles would likely be upwards of $6 billion (assuming, as per a CBO study, pedestrian fencing costs of $6.5 million per mile and vehicle fencing costs of $1.7 million per mile). Annual maintenance costs would be hundreds of millions more.

Tripling the number of boots on the ground wouldn’t be cheap either. President Obama has already deployed 20,000 border patrol agents, over twice more than he inherited. Tripling this number would cost a whopping $7 billion or so more a year since, according to the CBO, the annual cost of an agent is about $171,400.

And the bill in dollars pales in comparison to the price Americans will have to pay in lost liberties.

Conservatives are outraged when the government confiscates private property for environmental or other ends. Indeed, Nevada rancher Cliven Bundy, a vile man with retrograde views on race, became an instant conservative hero when he stood up to Uncle Sam and let his cattle graze on land that the federal government had, in his view, illicitly obtained. Yet Cruz and his ilk have no qualms about authorizing Uncle Sam to perpetrate an even bigger property grab in the name of their Swiss-cheese wall.

Over half of the recently constructed 700 miles of fence was on private property that Uncle Sam deployed blatant strong-arm tactics to obtain. It confiscated ancestral land that had been in families for over 200 years and offered virtually peanuts to Texas landowners who couldn’t afford to hire expensive lawyers to duke it out with Uncle Sam in court. Oscar Ceballos, a part-owner of a small trucking business, recounts how a government lawyer went so far as to figure out how much his assets were worth to dissuade a free legal clinic from representing him in his fight against the government’s ridiculously low-ball initial offer. Cruz’s even grander wall ambitions will only compound such abuse.

Nor would Americans on the border be the only ones affected. The vast majority of undocumented workers are here because there are Americans, especially employers, who benefit from their presence. Hence, Cruz and his fellow anti-immigration fighters want to force all American employers to verify the work eligibility of potential hires — American or foreign, legal or illegal — against a federal database through E-verify. Should this program become mandatory, all Americans will be effectively required to obtain a government permission slip to work.

What’s ironic about Cruz’s crusade to build a wall between two free — and friendly — people, divert billions of taxpayer dollars to militarize the border, and abrogate the civil rights of Americans is that he is doing so while vowing to “stand for liberty.”

If this is his idea of liberty, what would tyranny look like under President Cruz? (Don’t answer that — I hope to never find out!)
