“A Future Cheney Could Do It All Again”: The U.S. Will Torture Again—And We’re All To Blame

Reliably enough, out came Dick Cheney to trash the Senate torture report and to say of the use of torture: “I’d do it again in a minute.” None of us doubt that he would. But the more interesting and challenging question is: Could he?

More precisely, could a future Cheney, after a future terrorist attack on the U.S. mainland, get away with it? Could a future administration set up the whole fraudulent and immoral apparatus—a Department of Justice defining torture so narrowly that it somehow magically doesn’t include sleep deprivation or rectal hydration or waterboarding, followed by a CIA and military saying “Hey, what’s the big deal? It’s all legal!”? (Even in his press conference Thursday, CIA chief John Brennan acknowledged that it all could happen again: “I defer to the policymakers,” he said, as to what might occur.)

People like me are supposed to say something like: No, we’re better than that. Alas, I say we are not better than that. It could happen again. Easily.

In fact, let’s go further. Cheney is a figure of horror and ridicule these days (although by no means to everyone—to the Fox News audience to which he spoke the above words Wednesday, he’s oracular). But can we honestly say that back in 2002, 2003, 2004, he wasn’t carrying out the people’s will? We get the government we deserve, de Tocqueville said. And in the Bush-Cheney regime, we got exactly that.

There exist four mechanisms in our democracy by which the state can be compelled to live up to what we call, rather farcically in a gruesome week like this one, “our ideals.” There is the will of the people; the resolve of the political class; the courage of the media; and the authority of the courts. With regard to our torture regime, all four failed, and failed completely.

The people were, in theory, against torture. I have on my screen here a study from Reed College (PDF)  that asserts that from 2001 to 2009, majorities of public opinion consistently opposed torture, by averages of about 55 to 40 percent. That may be, in the abstract. But were Americans ever so worked up about the practice that they demanded it not be undertaken in their name? Never.

In fact, for most of the Bush era, the opposite was the truth. I remember very clearly the public mood after the 9/11 attacks. There was appropriate anger and shock and sorrow. But it bled into other less honorable manifestations, a paradoxical combination of, on the one hand, a lust for revenge in any form among a certain segment of the populace, and on the other hand a tremulous fear among a different segment that sanctioned anything being done in its name. Too many people reverted to a childlike state, and they wanted a daddy-protector. And no, this wasn’t understandable under the circumstances.

As for the political class, I doubt I need to give you a very hard sell on its failure. It was thoroughgoing and bipartisan. The timorous Democrats, with a few noble exceptions like Robert Byrd, largely bought into the global war on terror. The Republicans, well, you know about them. The foreign-policy establishment of Washington and to some extent New York lined up behind the administration on nearly every important question. The urge among this class is always to swim with the tide: In 2003, when the Council on Foreign Relations was casting about for a new leader, it settled on Richard Haass, who had been in Bush’s State Department. He has said since that he was 60-40 against the war, but one would have been hard pressed to know that then, back when his boss, Colin Powell, was warning us about those weapons of mass destruction that didn’t exist. On the torture question, this class was outraged when it was easy to be outraged, like when the Abu Ghraib story broke, but the outrage was never sustained.

Among the media, there were to be sure many brave journalists—Jane Mayer, Robin Wright, many others—who broke story after story about torture. We’re in their debt. But their great work was more than balanced out by the equivocation caucus—well, we can’t really be sure it’s torture. And then there was the segment of the media that actively cheered it all on. More broadly, the media as a whole were afraid to break ranks. I have had a number of conversations with prominent media people—in TV and radio, names you’d know—who, by way of trying to defend their lack of zeal and confrontation in those post-9/11 days, tried to explain how many furious emails they got when a report diverged modestly from the accepted line.

And the legal system? Again, there were some courageous judges who tried. A Virginia federal judge named Gerald Bruce Lee ruled in 2009  that four Abu Ghraib detainees could sue CACI, the private military contractor in Iraq. But overall the legal system has done little to say “this was against the law.” Much of the fault for that, of course, lies with Barack Obama, who chose early on not to seek prosecutions of Bush administration officials. And even now, in the wake of this report, what is your level of confidence that anyone will be prosecuted as a result of the release of this report? I thought so.

Failures top to bottom. Now, one would like to say that we as a society have learned the lessons of these failures and would not permit this to happen again. Don’t count on it. If there is another terrorist attack on the U.S. mainland, the odds are strong that we will reenact this grim tragedy from start to finish, if a neoconservative regime happens to be ensconced in the White House. The people would respond with the same fear, which would give license to the same behavior, and the political class and the media and the courts would probably go along.

So yes, it’s a moral horror that Cheney says he’d do it all again. But it’s also all too likely that a future Cheney could do it all again. That’s the far greater moral horror, and the one we don’t want to face, because it implicates us.

“The Cycle Of Republican Radicalization”: The Particularly Intense Loathing Republicans At All Levels Have For Obama Feeds The Cycle

Yesterday, the Washington Post reported on a Quinnipiac poll from a week ago showing a striking change in public opinion on immigration. The question was whether undocumented immigrants should be deported or should be able to get on a path to citizenship. Clear majorities of the public have long favored a path to citizenship (especially if you provide details of what that path would entail, which this poll didn’t). But that has changed, because Republicans have changed. As the Post described the Quinnipiac results, “Although [Republicans] supported citizenship over deportation 43 to 38 percent in November 2013, today they support deportation/involuntary departure over citizenship, 54 to 27 percent.”

That’s an enormous shift, and it provides an object lesson in a dynamic that has repeated itself many times during the Obama presidency. We’ve talked a lot about how the GOP in Congress has moved steadily to the right in recent years, but we haven’t paid as much attention to the movement of Republican voters. But the two feed off each other in a cycle.

Immigration is a perfect example. Before this latest immigration controversy, Republican voters were at least favorably inclined toward a path to citizenship. But then Barack Obama moves to grant temporary legal status to some undocumented people (and by the way, nothing he’s doing creates a path to citizenship for anyone, but that’s another story). It becomes a huge, headline-dominating story, in which every single prominent Republican denounces the move as one of the most vile offenses to which the Constitution has ever been subjected. Conservative media light up with condemnations. And because voters take cues from the elites on their own side, Republicans are naturally going to think the order was wrong while Democrats are going to think it was right.

But what the Quinnipiac poll suggests — and granted, this is only one poll and we won’t know for sure until we get more evidence — this process also ends up shifting people’s underlying beliefs about the issue. In this case, the controversy makes Republicans more conservative.

Let’s take another example. People like me have mocked Republican officeholders for the way they shifted on the wisdom of health insurance reform that involves establishing a marketplace where people can buy private insurance, providing subsidies so those with modest incomes can afford it, and imposing an individual mandate to ensure a wide risk pool. When Mitt Romney passed a plan on that model in 2006, Republicans thought it was an innovative, market-based solution to the problem of health insecurity and the uninsured, but when Barack Obama passed a similar plan in 2010, they decided it was a freedom-murdering socialist nightmare.

But it’s safe to say that the average Republican voter didn’t have much of an opinion on that particular kind of health care reform prior to Barack Obama becoming president. They did, however, have opinions on the underlying question of whether it’s the responsibility of the government to make sure that everyone has health coverage. You’d expect most Republicans to say no, since they believe in the free market and aren’t favorably inclined toward the safety net. And most did — in Gallup polls, the number of Republicans answering no to this question has consistently been over 50 percent. In 2006, for instance, it was 57 percent. But since then the rejection of government having this responsibility has gone from a majority position among Republicans to near-unanimity. In 2013, it reached 86 percent.

So it isn’t just that Republican voters were convinced that the Affordable Care Act is a bad thing. As a group they moved to the right, with the minority of them who believed in a government responsibility for health care either changing their minds or changing their party affiliation.

This movement hasn’t happened on every issue; for instance, you might be surprised to learn that substantial numbers of Republican voters appreciate the reality of global warming and favor taking steps to address it; in some cases, even a majority of them do, depending on what specific question is being asked (see here for some examples). My guess is that there are two reasons we haven’t seen a similar movement to the right on climate. First, there is some diversity of opinion within the GOP elite, from outright climate denialism on one end to acknowledgement of reality on the other (without, it should be said, accepting that anything ought to be done about it). Second, and perhaps more important, the issue has never been at the top of the news agenda for an extended period in recent years, particularly in a conflict that pits all Republicans against Barack Obama.

But when an issue like immigration or health care does meet those criteria, you get a particular cycle. Elite Republicans take their place in the fight against Obama; then rank-and-file Republicans follow along; then pushed by their constituencies, the officeholders harden their positions, which in turn pulls their voters farther to the right, and on it goes. The particularly intense loathing Republicans at all levels have for Obama feeds the cycle, pushing them toward not just disagreeing with him on particular courses of policy but rejecting the underlying principles he holds.

Is this cycle going to continue after Obama leaves office? If Hillary Clinton wins in 2016, it probably will.

“Acting On Our Collective Fears”: Darren Wilson; America’s ‘Model Policeman’

Truth is stranger than fiction; it is also most certainly harder to accept.

In a nearly hour-long interview with ABC’s George Stephanopoulos on Tuesday, a day after thousands of protesters took to the streets from coast to coast, expressing outrage that yet another white police officer got away with the murder of another unarmed black person, Wilson stuck to his story: “I just did my job. I did what I was paid to do. I followed my training…. That’s it.”

Sure, there are plenty of reasons to doubt his account. If he knew Michael Brown was a robbery suspect, why did he politely stop him and Dorian Johnson for jaywalking only to “have a conversation,” as he described to Stephanopoulos? If the West Florissant section of Ferguson is “really a great community,” why did he testify that it was a not very “well-liked community” and a hotbed of anti-police sentiment?

And yet, despite all the equivocations, the shooting death of the teenager on August 9 and Monday’s grand jury decision not to indict Wilson were entirely unsurprising. They are the predictable outcomes of a criminal justice system doing exactly what it was meant to do. For all the dissecting and debating of the veracity of Darren Wilson’s grand jury testimony this week, one thing seems crystal clear. He was in fact doing his job.

Indeed, by this standard, isn’t Darren Wilson actually a model police officer?

He certainly thinks so. When asked by Stephanopoulos if he could make “something good” come of this experience, he said he would “love to teach people” and give them “more insight in uses of force.” That he may have logged more time on first-person shooters—emptying clip after clip to take down demonic super-villains who “run through shots”—than actual police work is beside the point. Darren Wilson has the kind of experience that many Americans value.

Evidence abounds that the United States is the world’s most punitive nation. More people are behind bars and incarcerated at higher per capita rates here than anywhere in the world. African-Americans are the nation’s prime suspects and prisoners. White police officers are our chosen protectors, enforcing the law in the name of public safety.

In a Pew research poll conducted shortly after Ferguson made national headlines this summer, researchers found that most Americans have a “fair amount of confidence in local police.” Eighty-five percent of respondents, white and black, gave a fair to excellent rating on police “protecting people from crime.” And on “using the right amount of force,” 66 percent of respondents gave a fair to excellent rating; white support stood at 73 percent and blacks at 42 percent. Though a clear racial divide exists, African-Americans are only 13 percent of the population nationally. Everyone is therefore implicated in police performance writ large, if not by choice, certainly through political representatives.

Critics and protesters of police violence among African-Americans and on the political left, as polling data suggests, see things differently. They are organizing against the routine killing of unarmed men and beating of helpless women on an unprecedented scale not seen since the anti-lynching movement of the last century. Even with such evidence in hand that black men are twenty-one times as likely to be killed by law enforcement than white men, as analyzed in a recent report by ProPublica, today’s movement like the one before it might fail to overcome deeply entrenched fears of black criminality without a massive shift in white public opinion and a new model for law enforcement.

Most whites do not realize they are reading from very old racial scripts. When Ida B. Wells, the world’s leading anti-lynching activist and black social worker of the early twentieth century, tried to explain to a wealthy suffragist in Chicago that anti-black violence in the nation must end, Mary Plummer replied: blacks need to “drive the criminals out” of the community. “Have you forgotten that 10 percent of all the crimes that were committed in Chicago last year were by colored men [less than 3 percent of the population]?”

Like Mary Plummer, Darren Wilson is emphatic that the issue is not racism. Brown’s African-American neighborhood is “one of our high-crime areas for the city,” he said during the interview. “You can’t perform the duties of a police officer and have racism in you. I help people. That’s my job.” On that day, “the only emotion I ever felt was fear,” before my training took over. “We are taught to deal with the threat at hand.”

Implicit bias research tells us that most Americans are afraid of black people and subconsciously associate dangerous weapons and animals with them. They see things often that are not there. Stanford psychologists Rebecca Haley and Jennifer Eberhardt note in a study last month that the more people perceive blacks as criminals or prisoners, “the more people fear crime, which then increases their acceptance of punitive policies.”

The truth is that Wilson has no regrets. He wouldn’t do things differently. He’s looking forward to a new chapter in his professional journey as a teacher, trainer or a consultant. He’s our representative figure—a model policeman—acting on our collective fears.

“Re-Purposing The Grand Jury”: The St. Louis County Prosecutor Implicitly Conceded The Need For A Trial

Here is the irony of St. Louis County Prosecutor Robert McCulloch’s announcement Monday night that a grand jury had declined to indict officer Darren Wilson for the shooting of Michael Brown: The entire presentation implicitly conceded the need for a trial.

McCulloch was at pains to persuade the public that the grand jury had extensively weighed all the available evidence, and that it pointed to the conclusion that Wilson had not committed a crime. He talked about witnesses who changed their stories once they were presented with knowable facts that contradicted their original claims. He discussed the forensic evidence suggesting that Wilson’s initial shots against Brown occurred during a struggle in or near Wilson’s police cruiser, and that Wilson only began firing again after Brown, who’d initially fled, began moving toward him again. He talked about the lack of agreement over the position of Brown’s hands when Wilson fired the second, fatal barrage of shots.

So far as I know, McCulloch was under no obligation to discuss this evidence publicly. Nor was he under any obligation to release the evidence into the public domain following his remarks, as he repeatedly pledged to do. He presumably did these things to assure us that the decision not to prosecute Wilson was arrived at fairly and justly.

The problem with this is that we already have a forum for establishing the underlying facts of a caseand, no less important, for convincing the public that justice is being served in a particular case. It’s called a trial. It, rather than the post-grand jury press conference, is where lawyers typically introduce mounds of evidence to the public, litigate arguments extensively, and generally establish whether or not someone is guilty of a crime. By contrast, as others have pointed out, the point of a grand jury isn’t to determine beyond a shadow of a doubt what actually happened. It’s to determine whether there’s probable cause for an indictment, which requires a significantly lower standard of proof. That McCulloch appeared to turn the grand jury into an exercise in sorting out the former rather than the latter suggested he wanted no part of a trial.*

And, in fairness, it would have been extremely difficult to convict Wilson in a trial. But that’s a separate question from whether or not the verdict would be seen as legitimate after the fact. If McCullough was truly as concerned as he suggested tonight that the public accept the process that’s allowed Darren Wilson to walk away a free man, he had an obvious way to help ensure that this would happen. That he chose to avoid it demonstrates a rather appalling level of cynicism.

UPDATE: Some readers have argued that it would have been unethical for McCulloch to go to trial with a case he didn’t believe in. Two points in response: 1. Well, he went to the grand jury with a case he didn’t believe in, and it’s pretty unusual for that to happen, too. Clearly, the reason he did that was to make the process of letting Wilson off the hook look fair–again, not the typical purpose of grand juries, which are about establishing probable cause for an indictment. My point is that there’s a much better venue for establishing the fairness of the process (and for nailing down what actually happened)–a trial. Conversely, if this were simply about assessing probable cause, then the platonically correct move would have been to avoid a grand jury altogether, since McCulloch clearly didn’t think it exists. 2. Yes, it would have been hard to convict Wilson. But that doesn’t mean there wasn’t a case to be built. That McCulloch didn’t believe in the case says as much about him and his biases as it does the underlying facts. A different prosecutor could have easily come down differently.

“Despite The Non-Stop Coverage”: Surprise; Americans Are Confident In Government’s Ability To Handle Ebola

This morning the White House announced that Ron Klain, who was formerly the chief of staff to Vice President Biden, will coordinate the government’s response to Ebola. Klain will be the “czar” Republicans were asking for, I suppose because they had to demand the administration do something it wasn’t yet doing (thus is the nature of opposition). Which seems like a perfectly reasonable idea — you can never have too much coordination, and Klain is generally respected for his organizational skills.

But as much as Republicans have been arguing that everything is spinning out of control and the government isn’t protecting us from a deadly disease that might just bring about a zombie apocalypse, it turns out that the public isn’t going quite as crazy as you might think.

Don’t get me wrong — there are plenty of people who are reacting irrationally to a disease that has so far infected a grand total of two people in this nation of 316 million, both of whom were health care workers treating a man dying of Ebola (if that doesn’t describe you, you’re safe). But the growing number of Ebola polls shows that the public actually has a pretty good amount of confidence that the government can handle this.

That’s not what you might think if you tuned into the panic-a-thon that is cable news, or even much other news. Every evening news show is leading with Ebola every night, and every newspaper has multiple stories every day about the disease. There’s a danger that we could create a self-fulfilling prophecy, one in which the public is portrayed as losing their collective minds, which makes it more likely that they will end up doing so.

But let’s look at what they’re actually saying. It turns out that on some questions, partisanship has a big impact, which is actually encouraging in a way. It tells us that Ebola is much like other issues, where politics provides the filter through which things are being viewed. Whether it’s the economy or health reform or national security, Republicans are always going to be less likely to express confidence in the ability of a government run by Democrats to do anything right (and vice-versa).

So, via Eric Boehlert, in the latest Washington Post poll, 62 percent of respondents said they were very confident or somewhat confident in the government’s ability to respond to an Ebola outbreak. Among Democrats, the number was 76 percent, while among Republicans it was a still-healthy 54 percent. A Pew Research Center poll taken two weeks ago found something similar:  69 percent of Democrats said they had a great deal or fair amount of confidence in the government’s ability to handle Ebola, while 48 percent of Republicans agreed. Pew pointed out that in 2005, when George W. Bush was president, the same question was asked about bird flu and the numbers were reversed (with Democrats then expressing even less confidence than Republicans do now).

That tells a story not of widespread public hysteria but of rather ordinary partisanship. And a new Kaiser Family Foundation poll also shows a more reasonable public than you might expect if you were just watching the panic-a-thon on cable news. Among the questions Kaiser asked was this:

Which do you think is more likely: Ebola will spread and there will be a widespread outbreak in the U.S.; or Ebola will be contained to a small number of cases in the U.S.?

Ebola will be contained: 73

There will be a widespread outbreak: 22

And people in both parties expressed confidence in the Centers for Disease Control, with 79 percent of Democrats and 70 percent of Republicans saying they’d have confidence in the CDC to contain the disease and prevent if from spreading if there were a case of Ebola in their area.

As a news story, Ebola lends itself perfectly to sensationalistic, ratings-grabbing news. It’s mysterious, threatening, dramatic, and carries the theoretical potential for global disaster. But so far, despite the non-stop coverage and Republicans’ insistence that chaos reigns, most of the public seems to think that our government is capable of handling it.
