“Flood The Government With Lawsuits”: Charles Murray And The Right’s Plan To Subvert Democracy
Early last week, a watchdog website hosted by People for the American Way, a liberal advocacy group, reacted with alarm to a political-legal strategy outlined in a new book by the conservative social theorist Charles Murray. Normally when liberals assail Murray it’s in connection with his infamous tome The Bell Curve, which made him synonymous with race science—specifically the presumption that I.Q. differences between whites and blacks can be partially attributed to genetics.
Twenty years later, Murray has moved on to a more direct form of conservative activism, and taken a critical look at the mixed record of various expensive right-wing efforts to roll back the New Deal consensus. As you might expect from someone as deterministic as the author of The Bell Curve, Murray has concluded that the conservative movement’s shortcomings must be explained via reference to its political DNA and the political DNA of its competitors. But rather than reason much as he did two decades ago that these shortcomings reflect the intrinsic weakness of his ideology, he has concluded instead that the system is rigged against it. Appealing as populist libertarian ideas are to him and his cohort, or as they should be in the abstract, they simply can’t compete in a democratic environment with downwardly distributive progressivism. For the right to gain advantage, it will have to change terrain.
In his latest book, as PFAW explains, Murray hopes “to have one or a few anti-government billionaires kick in to create ‘The Madison Fund,’ a legal group that would flood the government with lawsuits challenging the enforcement of regulations they deem unnecessary.”
This is an apt description of Murray’s strategy, but the strategy itself happens to be the least revealing or alarming in his book. By The People is not first and foremost a book about billionaires subverting federal regulations, or beleaguered citizens seeking redress with the help of libertarian philanthropists.
It is instead about the impossible odds conservatives face if they hope to implement a libertarian agenda, and thus about the need for conservatives to think more devilishly about how to subvert democratic and quasi-democratic processes. The book’s title—By The People—has been held up for ridicule for exemplifying the emptiness of the populist appellations conservatives typically apply to the handiwork of wealthy, self-interested ideologues. But perhaps the joke’s on us, and Murray’s simply using a different form of the word “by” than Abraham Lincoln had in mind when he wrote the Gettysburg Address.
The subtext of Murray’s argument is that principled conservatives can only set back liberalism with rearguard action, and that even then, they can hope only for modest victories. Remarkably, the 100-page buildup to the strategy that has PFAW so concerned reads less like a battle cry than like a manifesto of hopelessness—or perhaps like a letter of surrender to the left. Murray tells his fans that “a restoration of limited government is not going to happen by winning presidential elections and getting the right people appointed to the Supreme Court”—asking them to accept, as a premise, that the billions of dollars conservative activists have spent trying to advance the cause through the White House have been wasted, or at least could have been better spent.
Like an adolescent Ayn Rand devotee, Murray can’t quite come to grips with the unattractiveness of his ideology. He is perfectly aware that the policies he opposes and the regulations he wants to overwhelm with litigation could theoretically be overturned by Congress and a conservative president. But to him, the unlikelihood of that outcome isn’t attributable to the normative weaknesses of his worldview but to a playing field that’s tilted against it. His ideas falter not because the people don’t support them, but because a series of ingredients, including—in his words!—the democratization of the House of Representatives, have corrupted the political system systemically. To the extent that “the people” he claims to be speaking for don’t rise up to challenge this corruption, it’s because they run up against what Murray calls “the fundamental theorem of democratic politics”—the fact that “people who receive government benefits tend to vote for people who support those benefits.”
“As of 2012,” Murray laments, “approximately half of all Americans received such benefits.” And more than one in three receive such generous benefits (either through welfare or retirement programs) that “the continued security of those programs is likely to be near the top of the recipients’ political calculations.”
Conservatism has been checkmated, not by a superior player, but by an unscrupulous one. Under the circumstances, Murray sees no choice but to move the game from the chessboard into the wild.
In truth, there’s nothing particularly novel or disquieting about the scheme Murray’s drawn up, except insofar as the procedural extremism conservatives have deployed in the Obama era is alarming in general. From the moment conservatives lost the White House six and a half years ago, they’ve been asking judges to do on their behalf what they’ve been unable to accomplish in the democratic branches. A few weeks from now, the Supreme Court will issue a ruling in a case that was devised as part of an explicit strategy to hobble the Affordable Care Act through the judiciary, knowing that the legislature wouldn’t be able to do it for them.
This strategy has been intermittently successful, but has also run aground when its objectives—such as paralyzing the administrative state by flooding the courts with litigation—are unsupportable or too nakedly political. Notwithstanding Murray’s continued influence over conservative thinking, including favorable mentions just this month by GOP presidential candidates Jeb Bush and Rand Paul, his latest big idea will run into a feasibility problem: even if it were attempted, it wouldn’t work particularly well.
What’s refreshing about By The People is that it blows right past the typical pretense that conservatives are, humbly and alone, defending the constitution and the rule of law, except to the extent that he believes the country went off the constitutional rails in systemic fashion several decades ago. He happily admits that his means here are subversive, undemocratic and of questionable legality. His substantive aims are not so different from those of, for instance, National Review writers Reihan Salam and Ramesh Ponnuru, who have outlined an agenda for the GOP Congress that includes unwinding the cooperative federalist models, responsible for so much of the regulatory and redistributive status quo Murray detests, and subjecting the regulatory regime in the crosshairs of his litigation strategy to legislative approval. But what Murray sees that others don’t, or won’t admit, is that these goals can be achieved only by short-circuiting the normal policy-making process.
It’s a shame in a way, because notwithstanding his Romney-esque conception of the political economy of modern welfare states, Murray’s overall critique of the American political system has a lot of merit to it. Were Murray’s central purpose to make Congress and the executive branch more responsive to the public, irrespective of the public’s political disposition, he’d find a lot of support in unexpected places. But that’s not his central purpose, and for good reason. As infuriating and frustrating as the U.S. government’s many corruptions are, they do not explain why conservatives have failed to upend enforcement of environmental, anti-discrimination and workplace-safety regulations. That’s why his preferred instrument of reform isn’t the ballot box, but the court system, and that in turn gives away the game. The former helps ensure that policy reforms have public sanction. The latter makes it possible to sneak ones that don’t By The People.

“Rat Bait”: Beware Of Republicans Playing Games!
Because you may have missed this story over the weekend, here’s some important news for lefty critics of Hillary Clinton, via the New York Times‘ Parker and Corasaniti. It focuses on the biggest GOP oppo research operation of them all, and ever, America Rising:
For months now, America Rising has sent out a steady stream of posts on social media attacking Mrs. Clinton, some of them specifically designed to be spotted, and shared, by liberals. The posts highlight critiques of her connections to Wall Street and the Clinton Foundation and feature images of Democrats like Senator Elizabeth Warren of Massachusetts and Mayor Bill de Blasio of New York, interspersed with cartoon characters and pictures of Kevin Spacey, who plays the villain in “House of Cards.” And as they are read and shared, an anti-Clinton narrative is reinforced.
America Rising is not the only conservative group attacking Mrs. Clinton from the left. Another is American Crossroads, the group started by Karl Rove, which has been sending out its own digital content, including one ad using a speech Ms. Warren gave at the New Populism Conference in Washington last May.
“Powerful interests have tried to capture Washington and rig the system in their favor,” intones Ms. Warren, as images of Mrs. Clinton with foreign leaders flash by.
The new-style digital campaign captures some basic facts about 21st-century communication: Information travels at warp speed on social media, it is sometimes difficult to know where that information comes from, and most people like to read things with which they agree. The result, said Ken Goldstein, a professor of politics at the University of San Francisco who specializes in political advertising, is something more sophisticated.
“Politics is usually basic math,” he said, “and this is a little bit of calculus, thinking a couple steps ahead.”
You know, when it came out during Watergate that Richard Nixon’s campaign staffers were pulling this kind of crap in the 1972 Democratic primaries (mostly aimed at poor doomed Ed Muskie), it was a really big scandalous deal. Now it’s smart politics, or “calculus.” Progressives should beware playing their game.

“Ronald Reagan Doesn’t Live Here Anymore”: Why It’s High Time Liberals Stop Tiptoeing Around Race
Earlier this week, New York City Mayor Bill de Blasio, along with a gaggle of bored reporters and some boldfaced names in the progressive movement, unveiled a “Progressive Agenda to Combat Income Inequality.” Much like the media event that accompanied its unveiling, the agenda is supposed to be understood as a kind of 21st-century, liberal version of the storied “Contract with America,” the PR stunt that, as legend (erroneously) has it, rocketed Newt Gingrich and the Republican Party to power after the 1994 midterm elections. As my colleague Joan Walsh reported on Thursday, this backward-looking attempt to lay out a forward-looking platform for the Democratic Party did not go entirely according to plan.
Which is not to say it was a failure. In fact, for a photo-op held during a non-election year in May and headlined by a relatively unknown local politician, the unveiling of the agenda probably got more attention than it deserved. Even so, as Joan relayed from the scene, there was some tension at the event — and not only because President Obama’s hard sell of the Trans-Pacific Partnership (TPP) is driving some liberals to distraction while making others defensive. Sure, the agenda does call on lawmakers to “[o]ppose trade deals that hand more power to corporations at the expense of American jobs, workers’ rights, and the environment,” which is basically how the TPP is described by its foes. But that discord was for the most part kept under the surface.
The real reason de Blasio’s stab at playing the role of Progressive Moses was a bit awkward (despite going much better for him than it did for Ed Miliband) is knottier and harder to ignore. And it didn’t only trip up Hizzoner, but also marred a same-day Roosevelt Institute event on “rewriting the rules” of the economy, which was keynoted by no less a figure than Sen. Elizabeth Warren. It’s an issue that’s long dogged the American left, and the United States more generally, and it’s one that will not go away, no matter how fervently everyone may wish. It is, of course, the issue of race; and as these D.C. left-wing confabs showed, it will dash any hope of a liberal future unless the “professional left” gets deathly serious about it — and quick.
If you haven’t read Joan’s piece (which you really should), here’s a quick summary of how race wound up exposing the fault lines of the left at two events that were supposed to be about unity of purpose. Despite American politics becoming increasingly concentrated over the past two years on issues of mass incarceration and police brutality — which both have much to do with the legacy of white supremacy and the politics of race — neither de Blasio’s agenda nor the Roosevelt Institute’s report spend much time on reforming criminal justice. To their credit, folks from both camps have agreed that this was a mistake and have promised to redress it in the future. Still, it was quite an oversight — and a shame, too, because it justifiably distracted from an agenda and a report that were both chock-full of good ideas.
I wasn’t in the room when de Blasio’s agenda or the Roosevelt Institute’s report were created, but I feel quite confident in saying that the mistake here was not a result of prejudice or thoughtlessness or even conscious timidity. I suspect instead that ingrained habits and knee-jerk reflexes — born from coming of age, at least politically, in the Reagan era — are more likely to blame. Because while the radical left has been talking about and organizing around racial injustices for decades, mainstream American liberalism, the kind of liberalism that is comfortably within the Democratic Party mainstream, is much less familiar with explicitly integrating race into its broader vision.
Let me try to put some meat on those bones with a concrete example also taken from earlier in the week. On Tuesday, President Obama joined the Washington Post’s E. J. Dionne, the American Enterprise Institute’s Arthur Brooks, and Harvard’s Robert Putnam at Georgetown University for a public conversation about poverty. And while you’d expect race to come up — what with the African-American poverty rate being nearly three times that of whites, the African-American unemployment rate being more than two times that of whites, and the African-American median household income being barely more than half that of whites — you would be incorrect. As the Atlantic’s Ta-Nehisi Coates noted in response to this strange conversation, “the word ‘racism’ does not appear in the transcript once.”
Again, it strikes me as unlikely that simple bigotry is the reason. A more probable explanation is that mainstream American liberals like Obama and Dionne (Brooks is a conservative and Putnam is not explicitly political) have become so used to tiptoeing around white Americans’ racial anxieties that they cannot stop without a conscious effort. For the past 30-plus years, mainstream liberalism has tried to address racial injustice by focusing on the related but distinct phenomenon of economic injustice. The strategy, as Coates puts it, has been to “talk about class and hope no one notices” the elephant in the room, which is race. And for much of that time, one could at least make a case that the strategy worked.
But as I’ve been hammering on lately in pieces about Hillary Clinton, the ’90s are over. What made political sense in 1996 doesn’t make nearly as much sense today. Like the Democratic Party coalition, the country is not as white as it used to be. And the young Americans whose backing liberals will need to push the Democrats and the country to the left are the primary reason. If it was always true that the progressive movement could not afford to take the support of non-white Americans for granted, it’s exponentially more true now, when the energy and vitality of the progressive movement is so overwhelmingly the product of social movements — like the Fight for $15 or #BlackLivesMatter — driven by people of color.
As Hillary Clinton seems to understand, a key component of smart politics is to meet your voters and your activists where they are, rather than where history or the conventional wisdom tells you they should be. For the broader progressive movement, that means shaking off the learned habits of the recent past — and, more specifically, overcoming the fear that talking forthrightly about unavoidably racial problems, like mass incarceration, will scare away too many white voters to win. Economic and racial injustice have always been seamlessly interconnected in America; but as leading progressives learned this week, the time when liberals could talk about class but whisper about race is coming to an end.

“Wall Street Vampires”: Lurking In Their Coffins, The Enemies Of Reform Can’t Withstand Sunlight
Last year the vampires of finance bought themselves a Congress. I know it’s not nice to call them that, but I have my reasons, which I’ll explain in a bit. For now, however, let’s just note that these days Wall Street, which used to split its support between the parties, overwhelmingly favors the G.O.P. And the Republicans who came to power this year are returning the favor by trying to kill Dodd-Frank, the financial reform enacted in 2010.
And why must Dodd-Frank die? Because it’s working.
This statement may surprise progressives who believe that nothing significant has been done to rein in runaway bankers. And it’s true both that reform fell well short of what we really should have done and that it hasn’t yielded obvious, measurable triumphs like the gains in insurance thanks to Obamacare.
But Wall Street hates reform for a reason, and a closer look shows why.
For one thing, the Consumer Financial Protection Bureau — the brainchild of Senator Elizabeth Warren — is, by all accounts, having a major chilling effect on abusive lending practices. And early indications are that enhanced regulation of financial derivatives — which played a major role in the 2008 crisis — is having similar effects, increasing transparency and reducing the profits of middlemen.
What about the problem of financial industry structure, sometimes oversimplified with the phrase “too big to fail”? There, too, Dodd-Frank seems to be yielding real results, in fact, more than many supporters expected.
As I’ve just suggested, too big to fail doesn’t quite get at the problem here. What was really lethal was the interaction between size and complexity. Financial institutions had become chimeras: part bank, part hedge fund, part insurance company, and so on. This complexity let them evade regulation, yet be rescued from the consequences when their bets went bad. And bankers’ ability to have it both ways helped set America up for disaster.
Dodd-Frank addressed this problem by letting regulators subject “systemically important” financial institutions to extra regulation, and seize control of such institutions at times of crisis, as opposed to simply bailing them out. And it required that financial institutions in general put up more capital, reducing both their incentive to take excessive risks and the chance that risk-taking would lead to bankruptcy.
All of this seems to be working: “Shadow banking,” which created bank-type risks while evading bank-type regulation, is in retreat. You can see this in cases like that of General Electric, a manufacturing firm that turned itself into a financial wheeler-dealer, but is now trying to return to its roots. You can also see it in the overall numbers, where conventional banking — which is to say, banking subject to relatively strong regulation — has made a comeback. Evading the rules, it seems, isn’t as appealing as it used to be.
But the vampires are fighting back.
O.K., why do I call them that? Not because they drain the economy of its lifeblood, although they do: there’s a lot of evidence that oversize, overpaid financial industries — like ours — hurt economic growth and stability. Even the International Monetary Fund agrees.
But what really makes the word apt in this context is that the enemies of reform can’t withstand sunlight. Open defenses of Wall Street’s right to go back to its old ways are hard to find. When right-wing think tanks do try to claim that regulation is a bad thing that will hurt the economy, their hearts don’t seem to be in it. For example, the latest such “study,” from the American Action Forum, runs to all of four pages, and even its author, the economist Douglas Holtz-Eakin, sounds embarrassed about his work.
What you mostly get, instead, is slavery-is-freedom claims that reform actually empowers the bad guys: for example, that regulating too-big-and-complex-to-fail institutions is somehow doing wheeler-dealers a favor, claims belied by the desperate efforts of such institutions to avoid the “systemically important” designation. The point is that almost nobody wants to be seen as a bought and paid-for servant of the financial industry, least of all those who really are exactly that.
And this in turn means that so far, at least, the vampires are getting a lot less than they expected for their money. Republicans would love to undo Dodd-Frank, but they are, rightly, afraid of the glare of publicity that defenders of reform like Senator Warren — who inspires a remarkable amount of fear in the unrighteous — would shine on their efforts.
Does this mean that all is well on the financial front? Of course not. Dodd-Frank is much better than nothing, but far from being all we need. And the vampires are still lurking in their coffins, waiting to strike again. But things could be worse.

“The Fact That I Don’t Like Her Is Irrelevant”: Don’t Be Blinded By The Hillary Clinton Hologram
I argued last week that left-of-center pundits who are demanding someone in the Democratic Party pose a challenge to Hillary Clinton are not offering arguments. Instead, they are expressing anxiety. Fears, not reasons. They worry that Clinton won’t earn the party’s nomination, but instead seize it as a birthright, which runs afoul of liberal commitments to merit, competition, and fair play.
Because the Republicans have no such concern (despite Jeb Bush’s urging to the contrary), I argued that the stakes are too high for restarting debate over first principles. Unlike 2008, Hillary Clinton now stands alone with no significant opposition in sight. That may change, of course, but for now, she is the best choice for maintaining Barack Obama’s broad voting coalition and for protecting the hard-won progressive gains of the president’s administration.
It was a cold-blooded analysis, perhaps made colder by the fact that I wasn’t writing from the heart. I was instead writing as a voter, and voters must, I contend, try to pierce, as much as possible, through the “hologram” of American politics, as the late great populist Joe Bageant put it. So I’m getting in line behind the Democratic frontrunner even though I personally prefer a dialectic over values, issues, and ideals; even though I personally believe that ideological duels among like-minded partisans is healthy and good; and even though I personally dislike Hillary Clinton.
I realized this dislike in 1991 when I was 17 years old. Arkansas governor Bill Clinton was running for the nomination against Jerry Brown (who had been, and is once again, governor of California). Brown had accused Clinton of “funneling money to his wife’s law firm for state business.” Pressed to respond, his wife said: “I suppose I could have stayed home and baked cookies and had teas, but what I decided to do was to fulfill my profession.”
This comment is usually seen as an artifact of the “culture wars” and the “debate” over the legacy of second-wave feminism. But there’s more to it than that. At the heart of Clinton’s “cookies-and-tea” comment was a kind of rank classism that drove a wedge between voters who would otherwise find common ground in advancing mutually beneficial agendas. Labor is labor, whether done in public or in private, but the Ivy League-educated wife of a presidential up-and-comer was too elitist to see the truth of the matter. The result was stay-at-home mothers — like my own housekeeping mom — splitting from the Democrats and running into the waiting arms of GOP conservatives.
Even so, I believe Hillary Clinton would make a decent president, maybe even a good one, despite her elitism leaving a memorably bad taste in my mouth. People are usually surprised to hear that. They are surprised, I suspect, because the parties and the media, consciously and unconsciously, encourage voters to view candidates as if they were products — as a brand whose image embodies a vast web of psychological phenomena. This despite the fact that familiar candidates like Hillary Clinton are mere mortals whose views and policy positions have long been known. Even so, if you buy a product, the assumption is that you like it. And indeed, candidates have been “sold” to voters for decades. In The Selling of the President, a classic of the 1968 presidential election, the late journalist Joe McGinnis wrote that once politicians and ad men “recognized that the citizen does not so much vote for a candidate as make a psychological purchase of him, [it wasn’t] surprising that they began to work together.”
Since 1968, that profitable alliance has grown in size and sophistication. Anyone can see that. What we can’t see is our political blindness. As Joe Bageant put it, we don’t see the candidates; we see their “hologram.” “All things are purchasable, and indeed, access to anything of value is through purchase. Even mood and consciousness, through psychopharmacology, to suppress our anxiety or enhance sexual performance, or cyberspace linkups to porn, palaver, and purchasing opportunities. But most of all, the hologram generates and guides us to purchasing opportunities.”
The hologram draws much of its power from the fantastical desire for the perfect candidate. Case in point: Barack Obama. He was going to bring change to Washington. How wonderful! Though he did try, the president soon learned he could not transform politics as usual. No way. Indeed, the man who promised to overcome partisanship became, thanks to total Republican obstruction, a pure partisan.
Democratic voters must try to pierce through the Hillary Clinton Hologram, as much as they can, to see the person. The mere mortal. The flawed, maybe tragic, human being. The woman who once thought herself too good to bake cookies at home. She has baggage and can be found ideologically wanting. But none of that matters. What matters is that she’s a Democrat who will protect social-insurance programs, defend higher taxes on the wealthy, and continue peace talks with Cuba and Iran. And what matters is that her campaign has become a juggernaut that has the potential to roll over her Republican opponent.
In comparison, the fact that I don’t like her is irrelevant.
