“How To Stop Government”: A Republican Field Guide To Obstructionist Techniques
In a recent Pew Poll, 80 percent of respondents said the president and Republican leaders were not working together to address important issues — and, by a two-to-one margin, said the G.O.P. was more to blame for gridlock.
Despite their minority status in the Senate, the people on the right side of the aisle have managed to muck up the works. Their obstructionist repertoire is so extensive that you almost need a field guide to their delaying techniques.
Here’s a start on that guide.
Filibuster Abuse: The practice of halting Senate deliberation is an old one, practiced by both parties, but the current Republican caucus has taken it to new heights. They have filibustered an unprecedented number of President Obama’s nominees. The District Court for Washington, D.C., perhaps the most important appeals court in the land, has four of its 11 seats vacant. The last time the Senate confirmed a judge was in 2006. The Republicans have filibustered all of Mr. Obama’s nominees because Republicans simply don’t want him to appoint any judges to a currently conservative court, which rules on appeals involving federal regulatory agencies, and which has exclusive jurisdiction over national security matters.
Boycotting: Also known as taking your marbles and going home, the most recent example came on Thursday, when Republicans refused to attend a meeting of the Environment and Public Works Committee, thereby blocking the nomination of Gina McCarthy as head of the Environmental Protection Agency. They claimed they were not completely satisfied with her answers to the more than 1,000 questions they dumped on her in the confirmation process. In addition to stymying Mr. Obama, holding up her nomination has the great virtue of hamstringing the E.P.A., which the right thinks shouldn’t exist in the first place. And that leads us to the next G.O.P. tactic:
Denial of services: Some government agencies require a certain number of members, or a permanent chief, to operate. If the Republicans don’t like those agencies, they simply make sure those positions never get filled. For instance, the National Labor Relations Board, which Republicans loathe because it protects workers, requires a quorum to take action. So the Republicans refused to confirm Mr. Obama’s nominees. Then they held fake pro-forma sessions during their vacations to try to prevent him from making recess appointments. He did that anyway and the Republican-packed D.C. appeals court (see above) ruled that the appointments were illegitimate — which could invalidate scores of decisions. The Republicans are playing this same trick with the Federal Consumer Financial Protection Bureau, which was created in response to the wildly reckless actions that led to the financial collapse of 2008.
Investigate again and again and again: When Darrell Issa, took over the House Committee on Oversight and Government Reform after the G.O.P. won the House majority in 2010, he said he wanted to hold “seven hearings a week times 40 weeks.” His supposed reason was that Mr. Obama is “corrupt.” That’s a frequent Republican talking point, but it’s so obviously ridiculous that I wonder if they actually believe it. In any case, the real reason is that endless “investigative” hearings cause trouble and distract administration officials from their actual jobs. The hearings on Benghazi, for example, have revealed none of the impeachable offenses that Republicans claimed would come to light. They have kept Congress and the administration focused on what happened in Libya eight months ago, which was awful, rather than on what is happening there today, which is awful.
Refuse to negotiate: Republicans in Congress used to complain that the Senate Democrats hadn’t produced a budget in the last four years. But recently the Democrats did just that. So the Republicans abandoned their old talking point and are now refusing to form a conference committee to reconcile the Senate budget with the House budget.

“Robert Bork’s Legacy”: The Prototype For Republican Entrenchment And Obstruction
Judge Robert Bork has died. But the tradition started by his failed 1987 nomination to the U.S. Supreme Court has sadly become entrenched.
Bork was a conservative hero and a threat to liberals. His nomination to the high court was thwarted not because of his intellectual fitness for the bench, but for his views and lower-court rulings on issues ranging from civil rights to abortion. In a famous address, the late Sen. Edward M. Kennedy warned of the specter of “Robert Bork’s America,” a world in which civil rights and women’s rights were imperiled.
Kennedy was not wrong in his assessment of Bork; nor was he wrong in opposing the nomination of a man who threatened to roll back hard-won advancements in social policy. The senator was criticized for politicizing a Supreme Court nomination, but the same charge could have been made against President Reagan for nominating someone with such a clearly conservative agenda. The trouble is that since then, an ideological witch-hunt has been imposed on a slew of nominees—even those for much less prestigious positions and nonlifetime appointments. The nomination of Donald Berwick, a widely respected physician and health policy maven, was stymied by Senate Republicans who said Berwick shouldn’t head the Centers for Medicare and Medicaid Services because he believed in some version of socialized medicine. The evidence for that was sketchy, based on comments Berwick made praising Britain’s National Health Service. In reality, conservatives just wanted to slow down the implementation of Obamacare while they fought it (unsuccessfully) in court.
Then there was Peter Diamond, who ultimately withdrew his nomination to the Federal Reserve amid threats of a filibuster by GOP Sen. Richard Shelby. Shelby expressed concerns that Diamond’s economic background was not the right sort for the Fed. The Nobel Prize committee had disagreed, awarding Diamond its prize in Economics.
Now, senators are sending subtle threats about putting a former colleague, Chuck Hagel, through the wringer if President Obama nominates him to be Defense Secretary. Hagel is a respected former Nebraska senator, a two-time Purple Heart winner, and was known as an expert on military affairs when he was in office. It’s also a gesture of bipartisanship for Obama to consider someone from the other party to be in his cabinet. But to some lawmakers, Hagel has not been sufficiently toady-like in his allegiance to Israel—actually, his allegiance to the Israeli lobby. The fact that Hagel served his own country in Vietnam and in the Senate seems to have taken a back seat.
Bork may well have been a poor addition to the Supreme Court. But thwarting nominations for the sake of frustrating a sitting president in the other party is the worst legacy his nomination has left.

One Person, One Vote? Not Exactly
Two economists, Brian Knight and Nathan Schiff, set out a few years ago to determine how much Iowa, New Hampshire and other early-voting states affected presidential nominations.
Mr. Knight and Mr. Schiff analyzed daily polls in other states before and after an early state had held a contest. The polls tended to change immediately after the contest, and the changes tended to last, which suggested that the early states were even more important than many people realized. The economists estimated that an Iowa or New Hampshire voter had the same impact as five Super Tuesday voters put together.
This system, the two men drily noted in a Journal of Political Economy paper, “represents a deviation from the democratic ideal of ‘one person, one vote.’ ”
A presidential campaign is once again upon us, and Iowa and New Hampshire are again at the center of it all. On Thursday, Mitt Romney will announce his candidacy in Stratham, N.H. Last week, Tim Pawlenty opened his campaign in Des Moines. The two states have dominated the nominating process for so long that it’s easy to think of their role as natural.
But it is not natural. It’s undemocratic, in fact. It is unfair to voters in the other 48 states. And it distorts economic policy in several damaging ways.
Most obviously, the federal government has lavished subsidies on ethanol, even though those subsidies drive up food prices and do little to solve the climate problem, partly because candidates pander to the Iowa corn industry. (Mr. Pawlenty, who now says the subsidies must end, is an admirable exception.) Beyond ethanol, a recent peer-reviewed study found that early-voting states received more federal dollars after a competitive election — so long as they supported the winning candidate.
Pork is hardly the only problem with the voting calendar. In the long run-up to the first votes, Iowa and New Hampshire also distort the national conversation because they are so unrepresentative. They are not better or worse than other states, to be clear. But they are different.
Their populations are growing more slowly than the rest of the country’s. Residents of Iowa and New Hampshire are more likely to have health insurance. They are older than average. They are more likely to work in manufacturing.
Above all, Iowa and New Hampshire lack a single big city, at a time when large metropolitan areas are crucial to lifting economic growth. Big metro areas are where big ideas most often take shape and great new companies are most often born. The country’s 25 largest areas are responsible for 52 percent of the country’s economic output, according to the Brookings Institution, and are home to 42 percent of the population.
Yet metro areas are also struggling with major problems. The quality of schools is spotty. Commutes last longer than ever. Roads, bridges, tunnels and transit systems are aging.
You don’t hear much about these issues in the first year of a presidential campaign, though. No wonder. Iowa, New Hampshire and the next two states to vote, Nevada and South Carolina, do not have a single city among the country’s 25 largest. Las Vegas, the 30th-largest metro area, and the Boston suburbs that stretch into New Hampshire are the closest these states come.
So the presidential calendar becomes another cause of what Edward Glaeser, a conservative-leaning Harvard economist, calls our “anti-urban policy bias.” Suburbs and rural areas receive vastly more per-person federal largess than cities. One big reason, of course, is the structure of the Senate: the 12 million residents of Iowa, New Hampshire, Nevada and South Carolina have eight United States senators among them, while the 81 million residents of California, New York and Texas have only six.
Bruce Katz, a Brookings vice president and veteran of Democratic administrations, points out that the world’s other economic powers take their cities more seriously. China, in particular, has made urban planning a central part of its economic strategy.
“The United States stands apart as an anti-urban nation in an urbanizing world,” Mr. Katz told me. “Our political tilt toward small states and small towns, in presidential campaigns and the governing that follows, is not only a quaint relic of an earlier era but a dangerous distraction at a time when national prosperity depends on urban prosperity.”
The typical defense from Iowa and New Hampshire is that they care more about politics than the rest of us and therefore do a better job vetting candidates. But the intense 2008 race between Barack Obama and Hillary Clinton showed that if Iowa and New Hampshire care more, it’s only because of their privileged status. In 2008, turnout soared in states that finally had a primary that mattered, be it Indiana or Texas, North Carolina or Rhode Island.
A more democratic system would allow more voters to see the candidates up close for months at a time. The early states could rotate each year, so that all kinds — big states and small, younger and older, rural and urban — had a turn. In 2016, the first wave could include states that have voted near the end recently, like Indiana, North Carolina, Oregon and South Dakota.
A rotation along these lines would enliven the political debate. Investments in science and education, which are the lifeblood of future economic growth, might play a bigger role in the campaign. You could even imagine — optimistically, I know — that the deficit might prove easier to address if Medicare and Social Security recipients did not make up such a disproportionate share of early voters.
The issues particular to small-town America would still receive extra attention because so many of the 50 states are rural and sparsely populated. It’s just that Iowa and New Hampshire would no longer receive the extreme special treatment they now do.
And that special treatment is a nice thing, indeed. It focuses the entire country, and its next leader, on the concerns of only 1 percent of the population, as if democracy were supposed to work that way.
At a recent candidates’ forum in Des Moines, The Wall Street Journal reported, the moderator did something that seemed perfectly normal: She chided Mr. Romney for not having spent enough time in Iowa lately. “Where have you been?” she asked.
