“Preying On The Poor”: How Government And Corporations Use The Poor As Piggy Banks

Individually the poor are not too tempting to thieves, for obvious reasons. Mug a banker and you might score a wallet containing a month’s rent. Mug a janitor and you will be lucky to get away with bus fare to flee the crime scene. But as Business Week helpfully pointed out in 2007, the poor in aggregate provide a juicy target for anyone depraved enough to make a business of stealing from them.

The trick is to rob them in ways that are systematic, impersonal, and almost impossible to trace to individual perpetrators. Employers, for example, can simply program their computers to shave a few dollars off each paycheck, or they can require workers to show up 30 minutes or more before the time clock starts ticking.

Lenders, including major credit companies as well as payday lenders, have taken over the traditional role of the street-corner loan shark, charging the poor insanely high rates of interest. When supplemented with late fees (themselves subject to interest), the resulting effective interest rate can be as high as 600% a year, which is perfectly legal in many states.

It’s not just the private sector that’s preying on the poor. Local governments are discovering that they can partially make up for declining tax revenues through fines, fees, and other costs imposed on indigent defendants, often for crimes no more dastardly than driving with a suspended license. And if that seems like an inefficient way to make money, given the high cost of locking people up, a growing number of jurisdictions have taken to charging defendants for their court costs and even the price of occupying a jail cell.

The poster case for government persecution of the down-and-out would have to be Edwina Nowlin, a homeless Michigan woman who was jailed in 2009 for failing to pay $104 a month to cover the room-and-board charges for her 16-year-old son’s incarceration. When she received a back paycheck, she thought it would allow her to pay for her son’s jail stay. Instead, it was confiscated and applied to the cost of her own incarceration.

Government Joins the Looters of the Poor

You might think that policymakers would take a keen interest in the amounts that are stolen, coerced, or extorted from the poor, but there are no official efforts to track such figures. Instead, we have to turn to independent investigators, like Kim Bobo, author of Wage Theft in America, who estimates that wage theft nets employers at least $100 billion a year and possibly twice that. As for the profits extracted by the lending industry, Gary Rivlin, who wrote Broke USA: From Pawnshops to Poverty, Inc. — How the Working Poor Became Big Business, says the poor pay an effective surcharge of about $30 billion a year for the financial products they consume and more than twice that if you include subprime credit cards, subprime auto loans, and subprime mortgages.

These are not, of course, trivial amounts. They are on the same order of magnitude as major public programs for the poor. The government distributesabout $55 billion a year, for example, through the largest single cash-transfer program for the poor, the Earned Income Tax Credit; at the same time, employers are siphoning off twice that amount, if not more, through wage theft.

And while government generally turns a blind eye to the tens of billions of dollars in exorbitant interest that businesses charge the poor, it is notably chary with public benefits for the poor. Temporary Assistance to Needy Families, for example, our sole remaining nationwide welfare program, gets only $26 billion a year in state and federal funds. The impression is left of a public sector that’s gone totally schizoid: on the one hand, offering safety-net programs for the poor; on the other, enabling large-scale private sector theft from the very people it is supposedly trying to help.

At the local level though, government is increasingly opting to join in the looting. In 2009, a year into the Great Recession, I first started hearing complaints from community organizers about ever more aggressive levels of law enforcement in low-income areas. Flick a cigarette butt and get arrested for littering; empty your pockets for an officer conducting a stop-and-frisk operation and get cuffed for a few flakes of marijuana. Each of these offenses can result, at a minimum, in a three-figure fine.

And the number of possible criminal offenses leading to jail and/or fines has been multiplying recklessly. All across the country — from California and Texas to Pennsylvania — counties and municipalities have been toughening laws against truancy and ratcheting up enforcement, sometimes going so far as to handcuff children found on the streets during school hours. In New York City, it’s now a crime to put your feet up on a subway seat, even if the rest of the car is empty, and a South Carolina woman spent six days in jail when she was unable to pay a $480 fine for the crime of having a “messy yard.” Some cities — most recently, Houston and Philadelphia — have made it a crime to share foodwith indigent people in public places.

Being poor itself is not yet a crime, but in at least a third of the states, being in debt can now land you in jail. If a creditor like a landlord or credit card company has a court summons issued for you and you fail to show up on your appointed court date, a warrant will be issued for your arrest. And it is easy enough to miss a court summons, which may have been delivered to the wrong address or, in the case of some bottom-feeding bill collectors, simply tossed in the garbage — a practice so common that the industry even has a term for it: “sewer service.” In a sequence that National Public Radio reports is “increasingly common,” a person is stopped for some minor traffic offense — having a noisy muffler, say, or broken brake light — at which point the officer discovers the warrant and the unwitting offender is whisked off to jail.

Local Governments as Predators

Each of these crimes, neo-crimes, and pseudo-crimes carries financial penalties as well as the threat of jail time, but the amount of money thus extracted from the poor is fiendishly hard to pin down. No central agency tracks law enforcement at the local level, and local records can be almost willfully sketchy.

According to one of the few recent nationwide estimates, from the National Association of Criminal Defense Lawyers, 10.5 million misdemeanors were committed in 2006. No one would risk estimating the average financial penalty for a misdemeanor, although the experts I interviewed all affirmed that the amount is typically in the “hundreds of dollars.” If we take an extremely lowball $200 per misdemeanor, and bear in mind that 80%-90% of criminal offenses are committed by people who are officially indigent, then local governments are using law enforcement to extract, or attempt to extract, at least $2 billion a year from the poor.

And that is only a small fraction of what governments would like to collect from the poor. Katherine Beckett, a sociologist at the University of Washington, estimates that “deadbeat dads” (and moms) owe $105 billion in back child-support payments, about half of which is owed to state governments as reimbursement for prior welfare payments made to the children. Yes, parents have a moral obligation to their children, but the great majority of child-support debtors are indigent.

Attempts to collect from the already-poor can be vicious and often, one would think, self-defeating. Most states confiscate the drivers’ licenses of people owing child support, virtually guaranteeing that they will not be able to work. Michigan just started suspending the drivers’ licenses of people who owe money for parking tickets. Las Cruces, New Mexico, just passed a law that punishes people who owe overdue traffic fines by cutting off their water, gas, and sewage.

Once a person falls into the clutches of the criminal justice system, we encounter the kind of slapstick sadism familiar to viewers of Wipeout. Many courts impose fees without any determination of whether the offender is able to pay, and the privilege of having a payment plan will itself cost money.

In a study of 15 states, the Brennan Center for Justice at New York University found 14 of them contained jurisdictions that charge a lump-sum “poverty penalty” of up to $300 for those who cannot pay their fees and fines, plus late fees and “collection fees” for those who need to pay over time. If any jail time is imposed, that too may cost money, as the hapless Edwina Nowlin discovered, and the costs of parole and probation are increasingly being passed along to the offender.

The predatory activities of local governments give new meaning to that tired phrase “the cycle of poverty.” Poor people are more far more likely than the affluent to get into trouble with the law, either by failing to pay parking fines or by incurring the wrath of a private-sector creditor like a landlord or a hospital.

Once you have been deemed a criminal, you can pretty much kiss your remaining assets goodbye. Not only will you face the aforementioned court costs, but you’ll have a hard time ever finding a job again once you’ve acquired a criminal record. And then of course, the poorer you become, the more likely you are to get in fresh trouble with the law, making this less like a “cycle” and more like the waterslide to hell. The further you descend, the faster you fall — until you eventually end up on the streets and get busted for an offense like urinating in public or sleeping on a sidewalk. 

I could propose all kinds of policies to curb the ongoing predation on the poor. Limits on usury should be reinstated. Theft should be taken seriously even when it’s committed by millionaire employers. No one should be incarcerated for debt or squeezed for money they have no chance of getting their hands on. These are no-brainers, and should take precedence over any long term talk about generating jobs or strengthening the safety net. Before we can “do something” for the poor, there are some things we need to stop doing to them.

“Unjustified And Wrong”: The Poor Should Not Bear The Burden Of A Deficit They Didn’t Cause

GOP leaders in Congress who can’t stop talking about family values are proposing an array of deep cuts to food stamps, child tax credits, healthcare for the poor, and even block grants that help states with daycare and adoption assistance. Left untouched are military spending that has ballooned over the last decade and tax breaks for the richest Americans. This isn’t courageous or pragmatic. It’s fiscally irresponsible and morally wrong.

Religious leaders are not letting Rep. Paul Ryan—architect of the GOP budget proposal—get away with the fiction that this budget reflects the values of his Catholic faith. The U.S. Conference of Catholic Bishops has sent a series of letters to GOP-controlled House committees arguing that these cuts are “unjustified and wrong.” Bishops wrote this week that “a just framework for future budgets cannot rely on disproportionate cuts in essential services to poor persons” and bluntly conclude that “the proposed cuts to programs in the budget reconciliation fail this basic moral test.” Catholic leaders have called for “shared sacrifice,” putting “unnecessary military spending” on the table and—in a pointed critique of Republicans’ fiscal fantasy that we can balance the budget by cuts alone—reference the need for “raising adequate revenues.” When Representative Ryan recently spoke at Georgetown University, almost 90 professors and priests at the Catholic university urged him to stop distorting Catholic social teaching to advance his radical ideological agenda. Expect faith leaders to keep challenging budget proposals and economic policies that undermine bedrock principles of justice, compassion, and the common good.

We should not pit national security against economic security. An effective military and a responsive government that doesn’t turn its back on vulnerable families are both achievable if we move beyond false choices. The working poor struggling in minimum-wage jobs, the elderly, and a squeezed middle class did not cause our deficits. They should not be asked to bear the greatest burden.

“Saintly And Crafty”: After Papal Crackdown, We Are All Nuns

Catholic nuns are not the prissy traditionalists of caricature. No, nuns rock!

They were the first feminists, earning Ph.D.’s or working as surgeons long before it was fashionable for women to hold jobs. As managers of hospitals, schools and complex bureaucracies, they were the first female C.E.O.’s.

They are also among the bravest, toughest and most admirable people in the world. In my travels, I’ve seen heroic nuns defy warlords, pimps and bandits. Even as bishops have disgraced the church by covering up the rape of children, nuns have redeemed it with their humble work on behalf of the neediest.

So, Pope Benedict, all I can say is: You are crazy to mess with nuns.

The Vatican issued a stinging reprimand of American nuns this month and ordered a bishop to oversee a makeover of the organization that represents 80 percent of them. In effect, the Vatican accused the nuns of worrying too much about the poor and not enough about abortion and gay marriage.

What Bible did that come from? Jesus in the Gospels repeatedly talks about poverty and social justice, yet never explicitly mentions either abortion or homosexuality. If you look at who has more closely emulated Jesus’s life, Pope Benedict or your average nun, it’s the nun hands down.

Since the papal crackdown on nuns, they have received an outpouring of support. “Nuns were approached by Catholics at Sunday liturgies across the country with a simple question: ‘What can we do to help?’ ” The National Catholic Reporter recounted. It cited one parish where a declaration of support for nuns from the pulpit drew loud applause, and another that was filled with shouts like, “You go, girl!”

At least four petition drives are under way to support the nuns. One on Change.org has gathered 15,000 signatures. The headline for this column comes from an essay by Mary E. Hunt, a Catholic theologian who is developing a proposal for Catholics to redirect some contributions from local parishes to nuns.

“How dare they go after 57,000 dedicated women whose median age is well over 70 and who work tirelessly for a more just world?” Hunt wrote. “How dare the very men who preside over a church in utter disgrace due to sexual misconduct and cover-ups by bishops try to distract from their own problems by creating new ones for women religious?”

Sister Joan Chittister, a prominent Benedictine nun, said she had worried at first that nuns spend so much time with the poor that they would have no allies. She added that the flood of support had left her breathless.

“It’s stunningly wonderful,” she said. “You see generations of laypeople who know where the sisters are — in the streets, in the soup kitchens, anywhere where there’s pain. They’re with the dying, with the sick, and people know it.”

Sister Joan spoke to me from a ghetto in Erie, Pa., where her order of 120 nuns runs a soup kitchen, a huge food pantry, an afterschool program, and one of the largest education programs for the unemployed in the state.

I have a soft spot for nuns because I’ve seen firsthand that they sacrifice ego, safety and comfort to serve some of the neediest people on earth. Remember the “Kony 2012” video that was an Internet hit earlier this year, about an African warlord named Joseph Kony? One of the few heroes in the long Kony debacle was a Comboni nun, Sister Rachele Fassera.

In 1996, Kony’s army attacked a Ugandan girls’ school and kidnapped 139 students. Sister Rachele hiked through the jungle in pursuit of the kidnappers — some of the most menacing men imaginable, notorious for raping and torturing their victims to death. Eventually, she caught up with the 200 gunmen and demanded that they release the girls. Somehow, she browbeat the warlord in charge into releasing the great majority of the girls.

I’m betting on the nuns to win this one as well. After all, the sisters may be saintly, but they’re also crafty. Elias Chacour, a prominent Palestinian archbishop in the Melkite Greek Catholic Church, recounts in a memoir that he once asked a convent if it could supply two nuns for a community literacy project. The mother superior said she would have to check with her bishop.

“The bishop was very clear in his refusal to allow two nuns,” the mother superior told him later. “I cannot disobey him in that.” She added: “I will send you three nuns!”

Nuns have triumphed over an errant hierarchy before. In the 19th century, the Catholic Church excommunicated an Australian nun named Mary MacKillop after her order exposed a pedophile priest. Sister Mary was eventually invited back to the church and became renowned for her work with the poor. In 2010, Pope Benedict canonized her as Australia’s first saint.

“Let us be guided” by Sister Mary’s teachings, the pope declared then.

Amen to that.

“Ryan Shrugged”: Paul Ryan Suddenly Does Not Embrace Ayn Rand’s Teachings

Rep. Paul Ryan (R-Wis.) tried to send the message this week that, contrary to “urban legend,”he is not obsessed with philosopher and author Ayn Rand.

“I reject her philosophy,” Ryan told National Review on Thursday. “It’s an atheist philosophy. It reduces human interactions down to mere contracts and it is antithetical to my worldview. If somebody is going to try to paste a person’s view on epistemology to me, then give me Thomas Aquinas. Don’t give me Ayn Rand.”

Best known for her novels “The Fountainhead” and “Atlas Shrugged,” Rand advocated a philosophy that emphasizes the individual over the collective, and viewed capitalism as the only system truly based on the protection of the individual. She has been a significant influence on libertarians and conservatives.

Ryan, whose name has been floated as a possible running mate for GOP presidential candidate Mitt Romney, appeared to be distancing himself from Rand in response to a public letter he received this week from nearly 90 faculty and administrators at Georgetown University. In their letter, they criticize him for misusing Catholic social teaching in defending his budget, which hurts the poor by proposing significant cuts to anti-hunger programs, slashing Pell Grants for low-income students and calling for a replacement of Medicare with a voucher-like system. They also invoke Rand’s name.

“As scholars, we want to join the Catholic bishops in pointing out that his budget has a devastating impact on programs for the poor,” said Jesuit Father Thomas J. Reese, one of the organizers of the letter. “Your budget appears to reflect the values of your favorite philosopher, Ayn Rand, rather than the Gospel of Jesus Christ. Her call to selfishness and her antagonism toward religion are antithetical to the Gospel values of compassion and love.”

But any urban legend about Ryan’s affinity for Rand surely started with Ryan himself, who, prior to this week, had no qualms about gushing about Rand’s influence on his guiding principles.

“The reason I got involved in public service, by and large, if I had to credit one thinker, one person, it would be Ayn Rand,” Ryan said during a 2005 event honoring Rand in Washington, D.C., the Milwaukee Journal Sentinel reported in April 2009.

During the 2005 gathering, Ryan told the audience, “Almost every fight we are involved in here on Capitol Hill … is a fight that usually comes down to one conflict — individualism versus collectivism.” The event was hosted by The Atlas Society, which prominently features a photo of Rand on its website and describes itself as a group that “promotes open Objectivism: the philosophy of reason, achievement, individualism, and freedom.”

Ryan also said during a 2003 interview with the Weekly Standard, “I give out ‘Atlas Shrugged’ as Christmas presents, and I make all my interns read it. Well … I try to make my interns read it.” He noted that he “looked into” Rand’s work when he was younger, but reiterated that he is a Christian and reads the Bible often.

In 2009, Ryan posted two videos on his Facebook page raving about the importance of Rand’s views.

“If ‘Atlas Shrugged’ author Ayn Rand were alive today, here’s the urgent message I think she’d be conveying,” Ryan wrote alongside the first video, titled “Ayn Rand’s relevance in 2009.”

He says in the video:

What’s unique about what’s happening today in government, in the world, in America, is it’s as if we’re living in an Ayn Rand novel right now. I think Ayn Rand did the best job of anybody to build the moral case for capitalism. And that morality of capitalism is under assault. And we are going to replace it with a crony capitalism, collectivist, government-run system which is creeping its way into government. And so if Ayn Rand were here today, I think she would do a great job in showing us just how wrong what government is doing is. Not the quantitative analysis, not the numbers, but the morality of what is wrong with what government is doing today.

In the second video, titled “Ayn Rand & 2009 America, Part 2,” Ryan says it doesn’t surprise him that sales of “The Fountainhead” and “Atlas Shrugged” have “surged” since President Barack Obama took office.

“It’s that kind of thinking, that kind of writing, that is sorely needed right now. And I think a lot of people would observe that we are living in an Ayn Rand novel right now, metaphorically speaking,” Ryan says. “The attack on Democratic capitalism, on individualism and freedom in America is an attack on the moral foundation of America. And Ayn Rand more than anyone else did a fantastic job of explaining the morality of capitalism, the morality of individualism. This, to me, is what matters most.”

Some of Ryan’s critics took a shot at him for suddenly distancing himself from Rand.

“Not pure enough on entitlement cuts @philipaklein @robertcostaNRO Paul Ryan on Ayn Rand: ‘I reject her philosophy,'” Austan Goolsbee, the former chairman of Obama’s Council of Economic Advisers, tweeted Thursday.

UPDATE: 5:14 p.m. — Ryan spokesman Kevin Seifert downplayed the lawmaker’s apparent change of tune on Rand.

“I wouldn’t make too much of this one way or another. Congressman Ryan was not ‘distancing himself’ from Rand, merely correcting several false storylines that are out there, such as the myth that he requires all of his staffers to read Atlas Shrugged. Saying he ‘rejects Ayn Rand’s philosophy’ was simply meant to correct a popular falsehood that Congressman Ryan is an Objectivist — he isn’t now and never claimed to be,” Seifert said in a statement to The Huffington Post.

“In The Interest Of The Rich”: Romney’s Radical Theory Of Fairness

So, to recap Mitt Romney’s new stump speech, he thinks Americans should vote on whether they’re financially better off than they were in 2008 — which is to say, they should blame President Obama for the effects of the Great Recession. He accuses Obama of attempting to run the campaign instead on “diversions, distractions, and distortions.”

What does Romney mean by that? He means that Obama wants Americans to base their vote on who has their interest at heart. Obama argues, and I would agree, that Romney’s agenda advances the narrow interests of the richest Americans at the expense of the broader interest. And of course, this is a fundamental ideological divide between the two candidates and their parties. Democrats want to maintain (and slightly expand) the government’s role in redistributing income from the best-off Americans to the most vulnerable. Republicans consider that sort of redistribution essentially illegitimate. What Romney calls a distraction is actually the most important issue of the election.

That isn’t to say he ignores it completely. Romney’s speech does contain one somewhat oblique passage in which he attempts to turn the fairness issue back against Obama. His argument is revealing. Here’s how Romney puts it:

I have a very different vision for America, and of our future. It is an America driven by freedom, where free people, pursuing happiness in their own unique ways, create free enterprises that employ more and more Americans. …

This America is fundamentally fair. We will stop the unfairness of urban children being denied access to the good schools of their choice; we will stop the unfairness of politicians giving taxpayer money to their friends’ businesses; we will stop the unfairness of requiring union workers to contribute to politicians not of their choosing; we will stop the unfairness of government workers getting better pay and benefits than the taxpayers they serve; and we will stop the unfairness of one generation passing larger and larger debts on to the next.

In the America I see, character and choices matter. And education, hard work, and living within our means are valued and rewarded. And poverty will be defeated, not with a government check, but with respect and achievement that is taught by parents, learned in school, and practiced in the workplace.

Romney has to couch the implications of his argument carefully, but the underlying logic is perfectly clear. He believes that fairness is defined by market outcomes. If Romney earns a thousand times as much as a nurse in Topeka, it is solely because his character, education, or hard work entitle him to that. To the extent that unfairness exists, it is solely the doing of government: clean energy, laws permitting union dues, overpaid government employees, and so on. Aside from unfairness imposed by government, poverty is attributable to the bad choices or deficient character or upbringing of poor people.

Now I doubt that Romney actually believes the full implications of this, even though many Republicans certainly do. But it is striking that Romney’s formulation makes no allowance for the role of government in alleviating unfairness created by the marketplace. To be sure, he is just making a campaign speech, but every speech by Obama invariably has passages lauding the marketplace and wealth. Here’s Obama yesterday:

In America, we admire success. We aspire to it. I want everybody here to do great, be rich, go out and start a business. That’s wonderful.

Now, campaign rhetoric is campaign rhetoric, but in this case it reflects an underlying reality. Obama wants the government to do a bit more to reduce inequality, but he is not proposing to change the United States’ place as the most unequal advanced economy on Earth. His opponent has adopted the position that any interference with the natural level of inequality created by the market is illegitimate. He may not want to take that philosophy to its absolute limit, but he is running on a program that would go very far toward implementing it.

The desire by Democrats to center the campaign on this basic philosophical choice is not a distraction, nor is it an attack on wealth. It’s an attempt to highlight what the election is actually about.
