“The Media’s Collusion With Politicians?”: Should A Member Of The Press “Clear The Air” With A Politician?

One of the arguments that is often used to point out unfairness is to suggest what things would look like if roles were reversed. For example, pointing out that a remark was sexist by asking what it would look like if the same thing were said to a man.

That kind of argument is so often abused that I tend to avoid it. Nevertheless, it was the first thing that came to mind when I heard that Fox News reporter Megyn Kelly had a private meeting with Donald Trump and reported that they had a chance to “clear the air.”

Let’s remember what happened here. In a Republican presidential debate Kelly asked Trump some tough questions. He didn’t like them and went on for days and weeks to say horribly sexist things about her. The feud disturbed the relationship Fox News had with the presidential contender and became the focus of a lot of press reports.

Here is where I want to employ the role change argument. What would we be saying about a media reporter who asked a Democratic candidate tough questions that eventually led to a private meeting to clear the air? I submit that holy hell would break out about the media’s collusion with politicians and failure to play their role as watch dogs.

In no way do I mean to imply any sympathy for Megyn Kelly. She is part of a media institution that, while pretending to be “fair and balanced,” is nothing more than a mouthpiece for conservatives. I’d propose that is why so few people find this whole episode to be unremarkable…it’s what we expect from Fox News.

I’ll not be breaking any new ground when I point out that this is actually a perfect example of how that network is not a news organization, but a PR arm of the Republican Party. But in this case, I think it still needs to be said out loud.

“Enough Is Enough”: It’s Time For Reporters To Break Out Of The Trump Rally Press Pens

Is the only thing more shocking than Donald Trump’s campaign manager being charged with simple battery of a reporter the fact that the crime isn’t all that startling, given the bullying campaign’s open contempt for reporters?

Enough is enough.

With Trump’s top aide, Corey Lewandowski, now facing charges, focus has shifted back to the increasingly abusive relationship between the GOP front-runner and the campaign press, and the unprecedented barrage of attacks journalists have faced, including constant insults hurled at them by the candidate himself. (Reporters are “disgusting” “horrible people,” Trump regularly announces.)

Sadly, news organizations have brought some of the degradation on themselves by acquiescing to all kinds of Trump campaign demands, such as the rule that they camp out inside mandatory press pens at events. Basically, the Trump campaign disparages the media, and news organizations do nothing in response — except shower him with even more coverage. (Talk about a win-win for him.)

“For ratings and clicks, they’ve allowed themselves to be penned up like farm animals at his rallies and risked scuffles with the Secret Service for covering the events like actual reporters,” wrote Eliana Johnson at National Review.

In fact, the press pens have become a hallmark of Trump’s war on the press.

“Unlike other presidential campaigns, which generally allow reporters and photographers to move around at events, Trump has a strict policy requiring reporters and cameramen to stay inside a gated area, which the candidate often singles out for ridicule during his speeches,” Time reported.

And Time should know.

In February, a Secret Service agent lifted Time photographer Chris Morris up off the ground and choke-slammed him onto a table after Morris momentarily “stepped out of the press pen to photograph a Black Lives Matter protest that interrupted the speech.”

It’s long past time for journalists to demand their freedom from Trump press pens. It’s like deciding to finally stop taking Trump’s phone-in interviews. Escaping from the pens represents a simple way for news organizations to assert their obvious right to cover the Trump campaign on their own terms, rather than being penned in at campaign events and living in fear of having access denied if coverage is deemed to be too critical.

Covering the Trump campaign on a daily basis today appears to be a rather miserable media existence. Reporters are threatened by staffers, and the Trump communications team seems to be utterly nonresponsive to media inquires. (“There is no Trump press operation,” one reporter told Slate.)

But it’s even worse than that. Just ask CBS News reporter Sopan Deb. In January at a Trump rally in Reno, a Trump supporter demanded to know if Deb was taking pictures on behalf of ISIS. Then, in March, after Trump’s raucous would-be rally in Chicago was canceled, Deb was covering mayhem unfolding on the streets when he was “thrown to the ground by Chicago cops, handcuffed, arrested, and detained in jail.”

I give journalists on the Trump beat credit for trying to make the best of a very bad situation. My question is why aren’t bosses standing up more forcefully for their staffers on the Trump front line? Why aren’t executives saying “enough” to the campaign bullying? And why don’t they take collective action and fix the obvious problems with how the Trump campaign is mistreating the press?

In case you missed it, last year 17 journalists representing scores of news organizations met for two hours in Washington, D.C., because they were so angry with how Hillary Clinton’s campaign was limiting access for journalists.

“The problems discussed were the campaign’s failure to provide adequate notice prior to events, the lack of a clear standard for whether fundraisers are open or closed press and the reflexive tendency to opt to speak anonymously,” The Huffington Post reported.

Looking back, the press’s Clinton complaints seem minor compared to the disrespect and invective the Trump campaign rains down on the press. But at the time, news organizations banded together and insisted that changes be made. (“The Clinton campaign is far less hostile to reporters than Donald Trump’s campaign,” The Huffington Post recently noted.)

So why the relative silence in light of the constant Trump mistreatment of the press? Why did news outlets quickly marshal their forces when Democrat Clinton was the target of criticism, but they apparently do very little when the Republican front-runner is trampling all over the press? Why the obvious double standard for covering Trump and Clinton?

Note that last November, several news organizations discussed their concerns with the Trump campaign. “Representatives from five networks — ABC, NBC, CBS, Fox and CNN — discussed their concerns about the Trump campaign restrictions on a Monday conference call, but did not present the campaign with any specific access requests,” according to The Huffington Post.

But very little came of it. “Facing the risk of losing their credentialed access to Trump’s events, the networks capitulated,” BuzzFeed reported.

Indeed, in the wake of that meeting, press pens at Trump rallies have recently become even more restrictive, with longer avenues of exit and entries created to separate journalists even further from rally attendees.

More recently, BuzzFeed reported, “Two network sources also confirmed the unprecedented control the television networks have surrendered to Trump in a series of private negotiations, allowing him to dictate specific details about placement of cameras at his event, to ensure coverage consists primarily of a single shot of his face.”

So yes, news organizations have had behind-the-scenes negotiations with the Trump campaign. But the result has been to let Trump “dictate specific details about place of cameras at his event.”

Just amazing.

And note that it’s not just the press pens. Here’s a list of the news organizations that have had reporters banned from previous Trump events, presumably because the campaign didn’t like the news coverage: The Des Moines Register, Fusion, The New York Times, BuzzFeed, Politico, The Huffington Post, National Review, The Daily Beast, and Univision.

Over and over we’ve seen this pattern play out: Report something negative about Trump and watch your press credentials get yanked. This kind of bullying, of course, is unprecedented for American presidential campaigns. The tactic goes against every principle of a free press, inhibiting the news media’s unique role in our democracy to inform the public, without fear or favor.

Yet to date, I’m not aware of outlets banding together to make concrete ultimatums in response to the Trump campaign’s bullying. Instead of collective action, we get sporadic, nonbinding complaints from editors.

But what kind of signal does that send, other than capitulation?

“Out Bullying The Bullies”: The Donald Trump Vs. Fox News Clusterfuck, Explained

A quick recap of the tumultuous, on-again/off-again relationship between Fox News and Republican frontrunner Donald Trump:

Trump has an ally in Fox News.

Trump doesn’t like Megyn Kelly.

Trump irons things out with Roger Ailes.

Trump is boycotting Fox News.

Trump is no longer boycotting Fox News.

Trump spends New Year’s Eve with Fox News.

Trump might not show up at Fox News’ GOP debate.

Trump is kind of a chicken for ducking Fox News’ debate.

Trump is “definitely not” going to the debate.

Why can’t these two frenemies just get along?

Like the bickering Sam and Diane duo from Cheers sitcom fame, Trump and Fox News obviously belong together (they like all the same things!), but they just can’t get past their stubborn differences.

Thursday night’s Fox-hosted primary debate on the eve of the Iowa caucus has now been completely overshadowed by the roiling feud between friends/enemies Trump and Fox, as the two institutional bullies lock horns. Is the current impasse a lasting one, or will the harsh words be papered over in the days and weeks to come the way previous Trump vs. Fox skirmishes ended in handshakes and smiles? It’s too soon to tell.

What’s so strange about the discord is that Trump is practically the living personification of the Fox News id: He’s a bigoted nativist who wallows in Islamophobia and thrives on dividing Americans and insulting President Obama as an un-American radical.

After the traditionally nice campaign of Mitt Romney in 2012, you’d think Fox News would be loving the insult-throwing Trump, a candidate who, like so many Fox anchors and hosts, isn’t afraid to make stuff up. Trump mirrors the often-tasteless brand of divisive rhetoric that Ailes helped hallmark at Fox.

But the truth is, Trump seems to hold Fox in the same general contempt that he holds the rest of the press. Meaning, from the Trump worldview, Fox doesn’t operate on a similar plane as him. Fox is subservient to Trump and — in his mind — should be in the business of touting his campaign. If and when it does not, Trump loses his cool because he doesn’t like to be second-guessed by “lightweight” journalists.

This represents a whole new world for Fox, which has controlled the conservative debate, and in turn controlled Republican politicians, for more than a decade. Fox sets the parameters. Fox picks the agenda. Fox grooms a handful of Republicans for right-wing media stardom. That’s why I can’t recall anyone ever picking such a public fight with Fox News from inside the GOP tent the way Trump has. It’s simply not done. And Fox’s frantic, off-key corporate response to Trump’s jabs has confirmed that executives there have very little practice fighting intramural skirmishes.

Forget that Fox cemented Trump’s right-wing celebrity status in 2011 when it handed over uninterrupted airtime for him to unfurl his misguided birther campaign against President Obama. Forget that Sean Hannity’s basement is probably lined with Trump for President posters.

Without Fox News’ exaggerated generosity over the years, and without Fox providing endless free airtime in the form of promotional blitzes to tout Trump as a possible presidential player, it’s unlikely Trump today would be perched atop the Republican field.

Trump this week is exercising a power play, pure and simple. (He knows he’s the reason Fox likely sold ads for the debate at a sky-high rate.) Bottom line: Roger Ailes is finally facing someone who’s willing, and eager, to out-bully him. And do it in public.

Of course what makes all this angry back-and-forth so funny is that one combatant is supposed to be a news organization. News organizations aren’t supposed to have bizarre, on-going public spats with one party’s leading candidate. Anchors on a news channel aren’t supposed to plead with candidates to show up at debates. And the head of a news channel doesn’t usually try to patch things up by directly phoning powerful politicians. But this is Fox News, so all the normal rules go out the window.

Indeed, the underlying truth here is that if Fox News conducted itself as an ethical news outlet, these kinds of messy spats and hurt feelings wouldn’t be an issue. Instead, Fox is often run as a Republican National Committee marketing arm, or a GOP clubhouse, raising expectations from Republicans in terms of how they’ll be treated. Trump clearly senses a weakness there and is now trying to exploit it.

In August, I suggested that Fox News, via the unwieldy Trump charade, had “eaten the Republican primary season” and that the “slow-motion fiasco is only going to get much, much worse for Republicans.”

Boy, has it. Democrats are likely pointing and laughing this week.

“Turning The Health Care Corner”: The Health Care Talking Points That “Everyone Knows” To Be True Are Due For An Update

Political journalism is sometimes criticized, fairly, for its “pack” mentality. Major news organizations wait for the conventional wisdom to organically take shape, and then the players stick to their scripts, reinforcing an agreed upon consensus. In practically no time at all, there are certain political facts that “everyone knows” to be true.

But soon after, that gets dull, the conventional wisdom invites skeptics, and contrarian instincts kick in. Maybe, the political world starts to wonder, those truths that “everyone knows” aren’t so true after all.

For the last several weeks, the consensus in establishment circles was that the Affordable Care Act’s open-enrollment period was not only a disaster, but a catastrophe that would destroy Obama’s presidency, the Democratic Party, the American health care system, and the very idea of progressive governance. Pundits could hardly contain their analogies – this was Obama’s Katrina, Obama’s Iraq, Obama’s Watergate, Obama’s Iran-Contra, and even Obama’s Bay of Pigs.

But the funny thing about narratives is that they’re sometimes fleeting. Ezra Klein suggests today that “Obamacare” may finally be “turning the corner.”

There are increasing reports that HealthCare.Gov is working better – perhaps much better – for consumers than it was a few short weeks ago. “Consumer advocates say it is becoming easier for people to sign up for coverage,” report Sandhya Somashekhar and Amy Goldstein in the Washington Post. “The truth is, the system is getting stronger as it recovers from its disastrous launch,” writes Sam Baker in the National Journal. Applying “was no problem at all, with no delays,” says Paul Krugman.

Reports from inside the health care bureaucracy are also turning towards optimism. People who knew the Web site was going to be a mess on Oct. 1st are, for the first time, beginning to think HealthCare.Gov might work. Data backs them up: By mid-November, the pace of enrollment in the federal exchanges had doubled from what it was in October.

The Obama administration is certainly acting like they believe the site has turned the corner. Somashekhar and Goldstein report that they’re “moving on to the outreach phase, which had taken a back seat as they grappled with the faulty Web site. Next week, the White House will host an insurance-oriented ‘youth summit’ aimed at people ages 18 to 35, an age group whose participation in the health-care law will be critical to its success.”

Why didn’t the White House do this sooner? Because officials didn’t much see the point in directing people to a website that didn’t work. If they’re increasing the website, it’s the result of greater optimism.

Perusing the news this morning, there are more than a few compelling pieces along these lines. The L.A. Times has a terrific article, for example, on “the Obamacare success stories you haven’t been hearing about.” NPR today highlighted some Californians who received cancelation notices – and are thrilled with the results. National Journal made the case yesterday that Obama not only can recover from the troubled rollout; he already has.

Moreover, Greg Sargent has a great piece noting that for all the talk about health care crushing Democrats, there’s a credible argument that the Republican position “is actually a political liability of its own.”

Yes, some of these pieces were written by center-left observers who may be predisposed to hope “Obamacare” succeeds, but note that we weren’t seeing any of these kinds of reports a few weeks ago when the feeding frenzy got underway. On the contrary, Ezra, Greg, and others were openly critical of the administration’s obvious mistakes and missteps as they unfolded.

The conventional wisdom won’t change quickly or easily, but you can almost see the consensus shifting in real time. There are some important issues the administration still needs to address, and failure very much remains an option. For that matter, if it’s a mistake to exaggerate the importance of every piece of bad ACA news, the law’s defenders must be equally cautious about exaggerating the importance of every positive development, too.

But for those stuck in the “Obamacare is and will remain a disaster” story, it’s time for a reality check. The system is improving, enrollment is increasing, more consumers are smiling, horror stories are failing, and health costs are shrinking.

The health care talking points that “everyone knows” to be true are due for an update.

“The Minority Defeats The Majority”, Again: The Media Needs To Tell Readers The Truth About GOP Filibustering

The death-by-filibuster of the Buffett Rule in the Senate yesterday revealed, among other things, that the news media still has a ways to go in learning how to report on the era of the 60-vote Senate.

Most Americans, not surprisingly, do not realize that majorities can no longer get their way in the Senate. After all, it wasn’t that long ago that most key votes in the Senate were based on simple majority voting. Only since 1993 has constant filibustering been common, and only in 2009 did Republicans create a situation in which virtually everything requires a supermajority. Reporting in these circumstances is a bit tricky, but if you are going to tell the full story of a bill killed by filibuster, you need to report not just the outcome — a bill lost — but that majority sentiment was thwarted by a minority.

So, how did the major papers do yesterday? Neither the New York Times nor the Washington Post had the word “filibuster” in their on-line front page headlines or teasers. The Post story does get the “F” word into her second paragraph, which is good. The Times story merely refers to the 60 votes the Democrats “needed” to pass the bill, without mentioning that the 60 votes were “needed” to break a GOP filibuster until way down in the eighth paragraph. Politico called it a “filibuster” in the second graf. But none of the three stories said explicitly that a minority of Senators defeated a majority.

CNN’s web story was particularly awful, reporting simply that “the Democrats fell nine votes short.” There was no mention of a filibuster, or that the “nine votes short” added up a 51 vote majority — so no one reading the story could deduce that a majority of the Senate favored the policy. The Los Angeles Times, in a broader story, also claimed that the Buffett Rule was blocked by “Republican-led opposition,” whatever that means. Again, no mention at all of a filibuster, or which way the majority voted.

None of this is good enough. Whether one supports the filibuster, opposes it, or (as I do) hopes for a middle course, it’s simply not informative enough to just say that something was “blocked” without explaining that it was blocked by a minority of Senators who deployed a filibuster.

The decision of the Republican minority to create the 60 vote Senate — and the willingness of the Democratic majority to go along with it — remains perhaps the most important single structural fact of Congressional procedure. It has been at least as important as any other factor in shaping Obama’s legislative agenda. And news organizations still aren’t telling readers and viewers the full truth about what’s happening.
