“An Election-Year ‘Hustle The-Base’ Strategy”: Democrats Should Boycott Latest Benghazi Charade
House Minority Leader Nancy Pelosi is trying to make the GOP’s latest Benghazi theater more than partisan drama by asking Speaker John Boehner to appoint an equal number of Democrats and Republicans to the new “investigative” panel he’s convening. The speaker is unlikely to do that, so Democrats should boycott this latest GOP fundraising stunt.
Five House committees have already investigated the Benghazi tragedy and issued biased reports; there have been two Senate committee reports plus the Accountability Review Board’s findings. The bipartisan reports found errors on the part of State Department personnel and recommended staffing and other changes. But because none of the investigations were able to charge then-Secretary of State Hillary Clinton with incompetence, or prove that President Obama tried to cover up the truth to get re-elected, Republicans won’t believe them, and insist there’s more to “investigate.”
Thus we have the latest House Benghazi stunt – and Democrats should stay away from it. There’s precedent for boycotting such a panel: Dems did so in 2005, when Republicans organized a sham “investigation” into how President Bush handled the Katrina catastrophe, when it became clear the effort was meant to be a whitewash, not a thorough probe.
I admit, Benghazi is to progressives what climate change is to conservatives: No matter how much the right wing shrieks about it, and purports to have new evidence of wrongdoing, we don’t believe it. The difference is, progressives are right. The notion that a newly uncovered email from national security communications staffer Ben Rhodes “necessitated” this latest investigation is another partisan cover story.
On one level, the new committee is actually a rebuke to histrionic House Oversight Committee chair Darrell Issa, whose many forays into the swamp of Benghazi conspiracy theories uncovered nothing to hurt Democrats, not even the Rhodes email. As ranking Democrat Elijah Cummings has pointed out, Issa denied Democratic members the most basic tools with which to participate in his committee’s sham investigation:
Over the past year, House Republicans have conducted their Benghazi investigation in a completely partisan manner by denying access to hearing witnesses, leaking cherry-picked excerpts to create a false narrative, issuing unilateral subpoenas without Committee votes, releasing multiple partisan staff reports, excluding Democratic Members from fact-finding delegations to Libya in violation of the Speaker’s own rules, and launching unsubstantiated accusations that turn out to be completely false. So I do not have much faith that a new select committee will be any different.
The new committee won’t have any more power than Issa’s did. And there’s no reason to believe chairman Trey Gowdy will be smarter or fairer than Issa (check out Simon Moloy’s profile here.) Gowdy is the Oversight Committee member who has set his hectoring of witnesses to action-movie music and posted it to You Tube. He is likely to out-Issa Darrell Issa.
There’s possible political risk in boycotting the Gowdy charade. “Some of these hearings are going to be televised,” political scientist Norman Ornstein told the Washington Post’s Greg Sargent. “The question is, does it make more sense to be in there, participating in the process and pointing out Republican overkill again and again, or does it make more sense to further destroy the image of the committee by staying out of it?”
It’s true that as the Oversight Committee’s leading Democrat, Cummings has been able to regularly thwart Issa and counter the chair’s allegations in the media. But he did so at a constant disadvantage, since he was shut out of the investigative process by Issa. There’s no reason to expect Gowdy to treat Democrats any differently. (Cummings’ office says he has not yet taken a position on the boycott idea.)
Gowdy’s committee is best understood as as a base-energizing fundraising tool for the GOP, part of what Politico’s Michael Hirsch calls “the Benghazi industrial complex,” engineered to damage Clinton so much she either can’t run for president or decides it’s not worth the pain. Of course, Benghazi fever hasn’t spread beyond the fever swamps of Obama hatred that afflict the GOP’s far-right base. But that’s enough to keep it alive, and potentially make it a potent midterm-election organizing tool. House Democrats should make that role clear by boycotting it.

“Why Don’t We Just Pack Up And Go Home?”: Republicans Are Afraid To Take The Blame For Their Own Actions
Just this week, House Speaker John Boehner (R-Ohio), House Majority Leader Eric Cantor (R-Va.), and House Budget Committee Chairman Paul Ryan (R-Wis.) have all presented the identical argument: passing immigration reform will be very difficult because Republicans consider President Obama fundamentally untrustworthy.
The general thrust of the argument is that GOP lawmakers aren’t confident that the Obama administration will enforce federal law, and as such, they don’t want to vote for reform. Even if Congress approves sweeping border-security measures intended to satisfy GOP lawmakers’ demands, they say, Obama, the out-of-control, “lawless” radical, may simply blow off laws (or parts of laws) whenever it strikes his fancy.
It’s a deeply silly posture, based largely on fantasy and this partisan pretenses, but House Minority Leader Nancy Pelosi (D-Calif.) took this one step further yesterday during a notable press briefing.
“When [Republicans] say … they don’t trust the president to do it, why don’t we just pack up and go home?” she said. “We have a democratic system. We have checks and balances. We have three branches of government. In fact, we’re the first in the Constitution – the legislative branch. And what we’re supposed to do is legislate, and not make up excuses as to why we don’t.”
“That’s not a reason not to do an immigration bill, that’s an excuse not to do it,” she added. “And around here, you have to always differentiate between what is a reason, and what is an excuse.”
This may have seemed like a throwaway line, uttered in frustration, but Pelosi actually raised a critically important point. If Republicans believe their own rhetoric, why would Congress even show up for work at all?
Pelosi’s response may have sounded flippant, but there’s nothing rhetorical or theoretical about the Republican assertions. If the majority of the House of Representatives is sincere, and GOP lawmakers seriously believe President Obama simply ignores laws whenever he feels like it, and acts unilaterally to impose his will, Constitution be damned, why doesn’t Congress “just pack up and go home”?
Indeed, consider the legislative process over the last month or so. Both the House of Representatives and the Senate passed appropriations bills, directing the executive branch to finance government operations. But if Republicans don’t trust the president to faithfully execute the laws approved by the legislative branch, why did Congress bother? Why didn’t Republicans balk and declare they would only appropriate funds after Obama had earned their trust?
Soon after, lawmakers in both chambers approved a farm bill, which the Obama administration will now help implement. But if the House GOP is convinced the rascally president ignores laws, why did they vote on the farm bill in the first place?
House Republicans keep voting on all kinds of measures, which would be an odd thing to do if they’re convinced the American system of government has broken down so severely that a lawless White House is prepared to ignore federal laws on a whim.
And therein lies the point: lawmakers keep voting on legislation because they probably don’t seriously believe their own talking points. They’re not genuinely convinced Obama will blow off federal laws, because if they were, they would bother to pass new federal laws.
What’s likely happening is that Republicans may kill immigration reform and they’re afraid to take the blame for their own actions. The “we can’t trust Obama” line is a fig leaf, and a rather transparent one at that.
Of course, if I’m mistaken, and House Republicans genuinely believe they see a president who casually disregards and/or breaks laws he doesn’t like, they can prove their sincerity by stopping the legislative process and beginning impeachment proceedings. But so long as GOP lawmakers continue to legislate, working under the assumption that the executive branch will still execute federal laws, the inanity of the Republican argument on immigration will be increasingly obvious.

“And Here We Go Again”: Republicans Are Really, Really Bad At Hostage Negotiations
For some time, I’ve been arguing that we should not just extend the debt ceiling but get rid of it altogether. It’s a weird historical anomaly that serves no practical purpose other than allowing the opposition party, should it be sufficiently reckless, to threaten global economic catastrophe if it doesn’t get its way. I assumed that your average Washington Democrat would share this view, but now I’m beginning to think that if you’re someone like Nancy Pelosi or Barack Obama, the debt ceiling is actually quite helpful, and you’d be sorry to see it go.
Because here’s what keeps happening: The debt ceiling approaches. Republicans begin making threats to torpedo the country’s economy by not raising it, and thereby sending the United States government into default, if their demands aren’t met. We then have a couple of weeks of debate, disagreement, and hand-wringing. Republican infighting grows more intense, and their reputation as a bunch of radicals who are willing to burn down the country to serve their extreme ideology is reinforced. At the end of it, the Republicans cave, the ceiling is raised for some period, and we do it all again in a few months.
And here we go again. The debt ceiling is going to have to be raised in the next month or so. Since the deficit is now at its lowest point since Barack Obama took office, it’s hard for Republicans to say that slashing the budget is so urgent that it justifies threatening to send America off an economic cliff. So what will they demand as their price for assenting to a debt ceiling increase? The answer is…they can’t decide. Yesterday, the House leadership proposed that they demand either a repeal of the “risk corridor” provision in the Affordable Care Act, which protects against a “death spiral” in the individual insurance market (here’s a good explainer on that), or approval of the Keystone pipeline. As Jonathan Chait pointed out, “Republicans have decided that one of these policy demands is so vital that they can insist its fulfillment justifies the threat of global economic calamity. They’re just not sure yet which one.” But it turned out that they couldn’t even unite around one of those two things, and that proposal of the leadership’s is now dead.
So here’s where we are. The Republican position is that something or other, let’s call it the Policy Change To Be Named Later, is so urgent, so pressing, so essential to the future of this great nation that if they don’t get it, whatever it turns out to be, they will force the government into default. And as soon as they figure out what the PCTBNL is, they’ll let us know.
Meanwhile, the Democrats’ position is simple: the debt ceiling needs to be raised, without conditions. Period. And that’s just what’s going to happen. There’ll be some hemming and hawing between now and then, but Democrats are going to win this, and Republicans are going to lose, and look like fools. Given that, if you were Barack Obama, wouldn’t you be perfectly happy to go through this routine a few more times?

“It’s Working”: The Ultimate Reason To Support Resolution Authorizing Use of Military Force To Stop Chemical Weapons In Syria
The ultimate reason to support the Congressional resolution to authorize the use of military force to stop chemical weapons use in Syria is clear: it’s working.
Over a year ago, the U.S. proposed that Syria turn over its chemical weapons for destruction by the international community and join the chemical weapons treaty that bans their possession or use. Syria refused, and Russia refused to demand that it do so.
Today they have both said yes. There is only one reason. They hope to stop the use of military force that President Obama has proposed to degrade their ability to deliver these weapons — and make the regime pay a price for the indiscriminate slaughter of 1,400 adults and children using chemical weapons containing poison sarin gas.
Many of my fellow Progressives — who like me were strong opponents of the Iraq War — support President Obama’s request for Congressional authorization to use force to sanction chemical weapons use in Syria and deter its future use. They include Congressman Keith Ellison, the Co-Chair of the Congressional Progressive Caucus; former anti-war presidential candidate Howard Dean, progressive columnists E.J. Dionne and Gene Robinson; and of course former House Speaker Nancy Pelosi.
But for those who do not want to see the use of military force in Syria, the best thing they can do to assure that the military action is not needed is to support the Congressional resolution authorizing the president to use military force if necessary. That is the absolute best way to make certain the Syrian regime actually gives up its chemical weapons once and for all — and that there is no need for the U.S. to take military action to force Assad to comply.
As the President argued last night, we need to make certain that the Russians and Syrians are absolutely convinced that if they do not make good on their new promise to turn over Syrian chemical weapons, military action will ensue — it’s that simple.
Three additional arguments have been used over the last few days that need to be addressed:
1). Some have argued that it is never justified to use force to counter malicious use of violence.
There are some Progressives who are truly pacifists — who feel that the use of force and violence is never justified.
I respect the convictions of those who hold pacifist views, but I do not agree with them.
When Governor Orville Faubus of Arkansas refused to allow the integration of the schools in Little Rock, Arkansas in 1954, it would have been easier for the rest of America to simply shake our collective fingers and decry racism. It would have also been more popular. Instead the federal government sent troops from the National Guard to enforce the desegregation order with the threat of force.
Sometimes the threat — or actual use — of force is necessary — especially to prevent violence.
That’s why we empower police departments with the ability to use the force of arms when necessary to prevent violent acts.
2). Some politicians worry that supporting the President’s proposal is simply too unpopular. They should remember that polls showed the public opposed the possible bombing campaign in 1999 that was aimed at protecting Kosovars from ethnic cleansing as well. A Gallup poll in February 1999 showed that 45 percent of the public opposed the proposed bombing compared with only 43 percent who supported it.
After the campaign was successful at achieving its goals, that opposition turned into public support, and the issue played very little role in the November 2000 Congressional elections.
3). Some opponents say simply, the use of poison gas in Syria is just not our problem. Let someone else worry about it, they say.
In fact, of course, nothing could be further from the truth. If the use of chemical weapons and other weapons of mass destruction can occur with impunity any where on our small planet, they will be used more and more frequently in military conflicts. And if they are, they pose a massive danger for human beings everywhere.
If Assad can get away with using these weapons with impunity, that will ultimately endanger us all.
But assume for a moment it were possible to isolate their use, so that it would never impact those of us thousands of miles away from the streets of suburban Damascus. Can we just ignore the suffering of those who are its victims?
There was another story about another middle eastern road – the road to Jericho – where the hero of the tale did not ignore an injured foreigner who lay suffering by the roadside. That of course was the story of the Good Samaritan – the quintessential story that is at the center of the Christian New Testament. It was the story Jesus used to explain what it meant to “love your neighbor as yourself.”
Can we sit by and ignore the cries of people in foreign lands who are slaughtered in Rwanda, or ethnically cleansed in Kosovo, or gassed by the Nazis? I don’t think so. And sometimes getting involved is not always clean and sterile. Sometimes it is messy and inconvenient and difficult.

“Pleading Ignorance”: Congress Can’t Pretend It Didn’t Know About NSA Surveillance
Having been, at one place or another in my career, on each side of the perennial debate in Washington about “who knew what and when,” I knew it was a matter of time before we started hearing it about the leaked NSA operations.
Since leaving government, I have written before about the weird dynamics of “briefing” Congress on sensitive operations, e.g., Nancy Pelosi’s claim that she didn’t know about CIA’s program of “enhanced interrogations” during the Bush Administration. Now, and perhaps ironically, we have a spate of Republicans saying they knew little or nothing of the NSA operations
So, what’s the real story behind this typical Washington play to the media?
The media, of course, has a field day because on any day, they can get someone in Congress who wants to get their face on TV to say most anything – this whips up the hysteria that gives the story legs.To them, it’s media Nirvana – it’s the Trayvon Martin case of national security, and the best thing since the “torture” scandal.
Here is what’s behind all this political smoke:
There are some traditional Republican vs. Democrat tensions at work, in that it’s an opportunity for Republicans to criticize a Democratic President.
The NSA operations are very awkward for many Democrats to support (and many don’t) because of their liberal views on personal liberties and conciliatory approaches to national security.
Likewise, Republicans – who traditionally are more aggressive in national security matters – are also reluctant to support a Democratic administration, even though they may agree with the NSA operations.
The “tea party” faction of the Republican Party opposes the NSA operations – and as such is aligned with the most liberal Democrats on the issue. Strange bedfellows indeed.
Members of the two intelligence committees, Republican and Democrat, seem generally to support the NSA operations – and they also seem to know the most about them. They should.
However, complaints that “we didn’t know about this” are now being heard from both congressional Republicans and Democrats who are not on the intelligence committees.
Coming, perhaps, are internal divisions within the intelligence committees, some Republican-Democrat spats and some between the committee leaderships and rank and file committee members. This is awkward for the intelligence committee leaderships.
The lawyers at the Department of Justice, are – uncomfortably perhaps – in bed with each other on the NSA ops, because the programs were started in the Bush administration and continued into the Obama administration. And the president himself has supported the programs in every opportunity he has had to talk about them. He clearly believes that privacy and security are in proper balance with the NSA operations – or at least not out of balance.
So, who (probably) knew what and when about the compromised NSA program?
Some relevant background: Ever since Watergate, the Church and Pike Committees, the creation of the intelligence committees and the enactment of the Foreign Intelligence Surveillance Act (by the Democrats, FYI) in the 70’s, there have been various legal requirements for the intelligence community to keep the Congress informed about what they are doing. And the Congressional Seniors, often called the “Gang of Eight” (majority and minority leaders of each house and majority and minority members of the intelligence committees), get briefed in more detail on the most sensitive intelligence activities and operations.
Now, put yourself in the place of the directors of the various intelligence agencies. If you have any political sense at all (and you wouldn’t be a director if you didn’t), you are going to tell all about your agency’s various activities and operations, including all the risks – at least to the gang of eight. This way no one can later accuse you of withholding information when one of these sensitive programs goes south or is compromised. And, because the most sensitive activities and operations are often the most risky, the odds of failure or compromise are correspondingly high.
So, we can assume that – at the very least – the gang of eight was fully briefed on the NSA operations. And we can also assume that any other member of the intelligence committees who expressed interest in the programs would have likewise had a complete briefing, including on-site briefings by agency technicians, if such were requested.
How about an ordinary member of Congress who was interested in these programs? They can also get briefings if they request them, and should approach their own party leaderships if they want additional information, or go to the leaderships of their house’s intelligence committee. Are these briefings often complex, technical and time consuming? Yes, for sure.
However, the suggestion that information is somehow being withheld from them is, frankly, silly, just as it was for Pelosi, a 10-plus year member of the gang of eight and a former chairman of the House Permanent Select Committee on Intelligence, to say that she didn’t know about the CIA’s enhanced interrogation program.
They know. They may wish they didn’t when the story hits the news, but they know. In fact, it’s to the administration’s advantage – whether Republican or Democrat – that they know all the details. In short, they are all in this boat together, whether they like it or not.
