“The Power Of The Franchise”: Voting Still Matters When It Comes To Political Clout

More than a half-century after brave protesters marched and bled and died to demand the right to vote for black citizens, the ballot box remains a potent weapon for civic and political change — a radical undertaking that can shake up social systems and correct inequities and injustices. If there is any good news in the untimely death of Michael Brown, it’s that the black residents of Ferguson, Missouri, have been reminded of the power of the franchise.

As protests have ebbed and activists have sought solutions to police brutality, they’ve started to register Ferguson’s underrepresented black citizens to vote. That won’t solve every problem, nor will it produce instant results, but it’s certainly one obvious avenue toward social change.

It took tragedy and weeks of unrest — the unarmed Brown, a black teenager, was killed by a white police officer on August 9 — to awaken a sense of urgency. Even as the two elections of President Obama proved, once again, the persuasiveness of the ballot, many Americans, especially those in historically oppressed ethnic groups, failed to appreciate its power in state and local affairs.

As the demographics of Ferguson have changed over the last 10 to 20 years, its newer residents have not exercised their political clout. The city was about 80 percent white in 1980, but its white population was down to less than 33 percent by 2010, according to the U.S. Census. You wouldn’t know that from looking at its local leaders.

The city council of six has just one black member; the school board comprises six whites and one Latino. Of the 53 sworn police officers on the force, just three are black. That helps explain a law enforcement agency that shows disrespect and hostility toward its black citizens.

There is a danger, of course, in exaggerating the power of politicians to change the habits formed from centuries of racial injustice or to correct systemic inequities that remain stubbornly entrenched. Obama, indeed, is a case in point. He has attracted a noisy, if tiny, group of black detractors who regularly denounce him for failing to appreciably roll back the racism that has haunted black America for generations.

He has been criticized for failing to adopt a “black agenda” that would employ black Americans and close the gap between white and black earning power. He has been excoriated for occasionally reminding black audiences that hard work and responsible conduct engender success, even as racism remains a cultural force. He has even been castigated for failing to speak out more forcefully against police misconduct in Ferguson.

It’s understandable that there’s a degree of frustration and disappointment that Obama’s election hasn’t done more to mitigate historic forces. After his election in 2008, it seemed that barriers to black success would fall rapidly. Instead, there remains a significant gap in most measures of economic well-being, starting with the unemployment rate. While about 6.6 percent of whites are currently unemployed, about 12.6 percent of blacks are jobless.

That gap hasn’t changed in 50 years, and educational attainment doesn’t alter it appreciably. While the unemployment rate is lower for black college grads than for blacks with high school diplomas, there is still more joblessness among blacks with college degrees than among whites with similar educations.

There’s not much Obama, or any president, can do to change that. Still, elections matter because politicians can encourage progress in any number of ways, large and small. The Affordable Care Act — or Obamacare — is just one example of that. While its provisions apply to all Americans, it affects blacks disproportionately because they are less likely to be able to afford policies without it.

If the vote didn’t matter, Republicans would not have worked so hard over the last decade to block the franchise. They’ve pushed through voter ID laws, cut back early voting and purged voter rolls — all in an effort to block a few voters of color, a cohort that tends to vote for Democrats. That’s testimony to the enduring power of the vote, a power that Ferguson’s black citizens should put to good use.

“A Conversion On Political Rhetoric”: The Fascinating Political Evolution Of Paul Ryan

Paul Ryan’s new book The Way Forward is meant to be bought, not read.

You buy a book like this because you’re in a conservative book club, or you’re a big Paul Ryan fan, and you feel obliged. It’s like voting, but it costs money. Publishers commission these books hoping to get a big payoff if and when the author is nominated for president and suddenly a much larger share of the country feels obliged to vote, er, buy Ryan.

But there’s more to The Way Forward than that, largely because Ryan is an increasingly important and intriguing figure in Republican politics. His persona evolves — often, it seems — in tandem with the felt-needs of the GOP. Ryan has always been a little further to the right than the average elected Republican. But that didn’t stop him from corralling votes for Medicare Part-D when George W. Bush needed them. Then when the GOP constituents needed someone who looked good under a green eyeshade, he became a much sterner budget watcher, and strenuous fiscal conservative.

The first half of the Ryan book is a biography as starched and colorless as his collars. But the second half of The Way Forward is fascinating. It gives a view of what Ryan wants to be now and over the next two years, possibly as he contemplates a run for the presidency. And make no mistake: Ryan is transformed.

No longer is Paul Ryan the P90X-ripping, budget-slashing devotee of Ayn Rand that Democrats gleefully caricatured as someone who wanted to push grandma off a cliff. Today he’s the geeky white guy dancing badly at a black church, and then biting his lip and nodding to signal how much he is listening, and learning. He’s putting in an effort to expand his horizons personally. He is undergoing a political conversion, or at least a conversion on political rhetoric.

Quite literally, Paul Ryan experiences a kind of Come-To-Frank-Luntz moment when someone asks him who he is talking about when he refers to some people as “takers.” Ryan had in the past adopted the language of “makers and takers” to describe people who are paying more in taxes than they receive in benefits, and people who are receiving more benefits than what they pay. Ryan says this language was just in the air at the time he adopted it. And it was. A Nation of Takers was the scorching title to a sobering (and sober) book by Nicholas Eberstadt about the shape of America’s entitlement state. Eberstadt’s book is exactly the kind of doomsday look into the spreadsheets that Ryan was getting into then.

Today, Ryan won’t disavow the math, exactly, but he has discarded the implied insult he attached to it.

[W]hile the problem it depicts is real and worrisome, the phrase “makers and takers” communicated a lot more than just the dilemma I was trying to describe. That day at the fair was the first time I really heard the way it sounded. As I stood there, listening to the guy from the Democrats’ tent lay into me, I thought, “Holy cow. He’s right.” [The Way Forward]

Ryan also talks about his experiences of reaching out to constituencies where there aren’t many Republicans. In what is probably the most substantive political point in the book, Ryan says what many already suspect, that the 2012 election proved that “focusing heavily on simply turning out our traditional coalition is a losing strategy.”

Ryan does what a politician in this position should do — he takes his lumps just by showing up for constituent events among people who are not naturally aligned to him. Black constituents often tell him to his face that they disagree with him. “[A]t least they were telling me, personally, instead of just some pollster canvassing the neighborhood,” he writes. He says that these events communicate that a person who has conservative politics can still care enough to show up and talk to minority constituents.

This is the right thing politically, but it’s also the right thing to do, period. The GOP should follow Ryan’s example. It would be good for the country. Citizens deserve the competition for their votes that gerrymandering and polarization deny. No major party should effectively ignore an entire demographic or geographic group of Americans.

Now, there are no great revelations in this book. It’s filled with easy-to-understand anecdotes about the malfunctioning of the health-care system before and after ObamaCare, and the efficiency of market-oriented solutions. These will be repeated many, many times by Ryan in the medium-term of his political life.

Ryan also repeats Jack Kemp’s name over and over again, almost as much as he does Reagan’s. Kemp was a Republican who worked hard to make GOP principles appealing to urban and minority voters. He was HUD secretary under George H.W. Bush and Bob Dole’s vice presidential candidate. Kemp is an odd figure, combining the supply-side politics of a Dan Quayle with the social idealism of a George Romney. He referred to himself as a “bleeding-heart conservative.”

And a bleeding-heart conservative sounds great in theory. In a way, it’s what George W. Bush attempted with his “compassionate conservative” brand. But Kemp was never really a national figure, and his unique policy ideas never really got purchase among their supposed beneficiaries. He was admired more than followed. He made Republicans feel better about themselves, without winning great victories. Maybe the time is ripe for a return to Kempism. But I have my doubts.

“Oppressive Lethargy Of Choicelessness”: What Is The Kerner Commission And Why It Should Be Revisited In Light of Ferguson

What we must remember always — and something I have told many juries in the past — is that the most powerful person in the world, on a day-to-day basis, is not the president of the United States. No, it is a police officer. Your local police officer can engage you — one-on-one, every day of the week, anywhere and any place. Your local police officer has the authority and power to take your life; and more often than not, get away with it; particularly if you happen to be a black or brown male in our society.

And how does it, all too often occur, that a police officer — most often a white police office — happens to shoot and kill or otherwise brutalize a black or brown male? Because by doing nothing when our local police officers engage in everyday minor, but insidious wrongdoing — most often directed at black and brown community residents, we enable and embolden all law enforcement personnel to believe that any wrongful conduct is acceptable simply because they wear a badge. They assume and too many in our society accept that, because they are police officers, our Constitutional constraints, under which they are sworn to perform, do not also apply to them even though they apply to each and every other American citizen.

So when I discuss the civil rights issues we tackled yesterday and the civil rights issues we confront today, including those that focus on law enforcement, I constantly advance the position that, while everything has changed, nothing has changed.

When the race riots of the 1960s occurred in communities across the nation, President Lyndon Baines Johnson appointed a commission, chaired by Illinois Governor Otto Kerner. My mentor, the Honorable Nathaniel R. Jones, served as an Assistant Counsel on the staff of this commission before he assumed the position of General Counsel of the National Association for the Advancement of Colored People (NAACP) and then was appointed by former President Jimmy Carter to the federal Court of Appeals for the Sixth Circuit.

The Kerner Commission Report concluded that the trigger for the riots — throughout the country — invariably derived from confrontations between the local police and members of local African-American communities. It also concluded that the residents’ held an often justified perception of the largely white police as an occupying force which was in the community to serve and protect the interests of the privileged white communities rather than to serve and protect the legitimate interests of the local minority residents and that the police inherently harbored racist attitudes toward residents of minority communities that they were also charged to serve.

Moreover, the Commission found that the underlying conditions in the making over decades — in fact, over centuries — in African-American communities provided the context for the precipitating trigger incidents of the unrest in the 1960s: racially segregated communities, inferior schools, high unemployment, and insufficient or inadequate governmental responses and attention to community needs leading those who resided in minority communities to suffer from a societal-imposed color “cast” status. They became victims of what the Nigerian author, Chimamanda Ngozi Adichie, in her award-winning novel, Americanah, more recently described as the “oppressive lethargy of choicelessness” — a choicelessness growing out of government sanctioned inequality and second-class citizenship and a choicelessness that was waiting to explode.

Do these findings of the 1968 Kerner Commission sound familiar in 2014?

So, I urge President Barack Obama to revisit the Kerner Commission, some 50 years later; and to ascertain where — if anywhere — we have come since the founding of our nation with its original sin (slavery and its ongoing legacy); and where we have yet to go, since we are far, far from having arrived at a “more perfect union.”

What to do?

I propose that President Obama appoint a Commission, chaired by not one governor, but by two former presidents — Jimmy Carter and George W. Bush, under the auspices of the Carter Center and the George W. Bush Library; and comprised of distinguished and diverse members such as Governor Deval Patrick, Oprah Winfrey, Henry Cisneros, Retired Supreme Court Justices Sandra Day O’Connor, John Paul Stevens, David Souter, former Attorney General Janet Reno, to be supported by a staff of highly respected and renown professionals from all walks of life to address and to courageously face our past and our present in order to plot our course forward.

While everything changes, the one constant that has not changed is the deeply embedded institutional and individual attitudinal racism that pervades our country. The fact remains that the impetus for local community explosions — racism — almost always is triggered by a confrontation between police officers (most often white) and black and brown males — youth and men, alike.

In 1852, at the Friends House in Rochester, NY, Fredrick Douglass stated in his historic address entitled, What to the Slave is the Fourth of July?, that “We must do with the past only as we make it useful to the present and the future.” Such is as true today as it was in 1852. And it is as true today as it was in the 1960s.

“How Did The GOP Turn Into Such A Bunch of Clowns?”: Lurching From One Strategic Screw Up To The Next

For a lot of reasons, the current era will probably be seen as unusually consequential in the history of the two parties, particularly the GOP. For Republicans, it has been a time of ideological hardening and bitter infighting. But one aspect of the Republican dilemma hasn’t gotten as much attention as those: This is a time of unusual, even stunning, Republican political incompetence.

Let me back up for a moment, to put what I’m saying in context. As the 2012 election approached, liberals began to understand just how deluded many conservatives were about empirical reality, and in ways that could do them serious political damage. It’s one thing to deny climate change (a denial that may benefit you and your allies), but if you convince yourself that you’re going to win when you’re actually going to lose, you’re hurting no one but yourself. When they began to rally around a guy claiming to “unskew” the 2012 presidential polls that showed Barack Obama heading for a victory, liberals had a great time ridiculing them. But then it turned out that even within the Romney campaign—including the candidate himself—people who were supposedly hard-nosed political professionals had convinced themselves that it was just impossible they could lose, whatever the polls said. As seen in an unforgettable bit of election-night television, Karl Rove, the party’s most celebrated strategist, refused to believe that Romney had lost even when Fox News called the race for Obama.

Once the race was over, there was some soul-searching within the GOP about their loss, but most of it concerned the party’s image as a bunch of unfeeling, out-of-touch white guys who couldn’t appeal to young voters and Hispanics. (Needless to say, this is a problem they’ve yet to solve,) There was some discussion about the conservative information bubble and the distorting effects it can have, but nothing changed—lots of conservatives still get their news from Fox and Rush Limbaugh, and assume that everything in the New York Times is a lie.

There seems to be little question that the alternative media universe they built, which was once a strength for the right, has become a liability. But their biggest problem now isn’t the things so many conservatives believe about the world that aren’t true, or what they think will happen that won’t. It’s about the strategic decisions they make, and where those decisions come from. Think about it this way: Has there been a single instance in the last few years when you said, “Wow, the Republicans really played that one brilliantly”?

In fact, before you’ll find evidence of the ruthless Republican skillfulness so many of us had come to accept as the norm in a previous era, you’ll need to go back an entire decade to the 2004 election. George W. Bush’s second term was a disaster, Republicans lost both houses of Congress in 2006, they lost the White House in 2008, they decided to oppose health-care reform with everything they had and lost, they lost the 2012 election—and around it all they worked as hard as they could to alienate the fastest growing minority group in the country and make themselves seem utterly unfit to govern.

In fact, in the last ten years they’ve only had one major victory, the 2010 midterm election. But that didn’t happen because of some brilliant GOP strategy, it was a confluence of circumstance; the natural tendency for the president’s party to lose significant numbers of seats two years after he’s elected, and the stagnant economy would have meant a big GOP victory no matter what they did.

Since then they’ve lurched from one strategic screw-up to the next, the root of which is almost always the same: It happens because they’re deluded into thinking that the country shares their particular collection of peeves and biases.

In fairness, this is a challenge for both parties and, indeed, for everyone involved in politics. When politics is your life, it’s hard, if not impossible, to think like an ordinary, inattentive voter thinks. When you’ve spent so much time convincing yourself that you’re right; the idea that anyone else who’s even remotely fair-minded wouldn’t agree can seem nothing short of absurd. It can be hard to persuade people when you can’t put yourself in their shoes.

But again and again, Republicans seem shocked to find out that Americans aren’t on the same page with them. They’re flummoxed when the public doesn’t rise up in outrage to demand more answers on Benghazi. They’re befuddled when shutting down the government turns into a political disaster. They’re gobsmacked when the electorate doesn’t reject Barack Obama for saying “you didn’t build that,” and even more amazed when he gets reelected. And in between, they can’t come up with any strategy to accomplish their goals, whether in policy or elections. Again and again, they think the American public is going to see things their way, and when the public doesn’t, they never seem to learn anything from it.

It isn’t always pure bumbling; there are times when the GOP follows an unwise strategic path not because of miscalculation, but because of unavoidable internal dynamics within the party. For instance, they’ve failed to pass comprehensive immigration reform not because party leaders don’t understand the political necessity of doing so, but because most members of the House come from conservative districts where comprehensive reform is unpopular, and therefore it makes sense for them to oppose it.

It would be too simple to put the GOP’s recent string of missteps and disasters down only to the struggle within the party, which yields a course ultimately determined by its radical wing. It is important that Tea Partiers, while being very good at figuring out how to make life miserable for the rest of their party, are abysmal when it comes to devising strategies for appealing to the country as a whole. But it’s equally relevant that the supposedly more pragmatic and experienced conservatives haven’t found a way to handle the snarling beast on their right flank and turn the whole ghastly mess into something that can fight Democrats with any modicum of success.

This shows no sign of changing. They’re going to win seats this November, but once again it won’t be because they came up with some brilliant strategy. If they win the Senate it will be because Democrats are defending more seats this year, many of which are in conservative states. (Two years from now when that situation is reversed, Democrats will almost certainly take back the Senate if they lose it this year.) Republicans will probably gain a few seats in the House, but don’t forget that in 2012, they retained their sizeable majority despite getting fewer votes nationwide than Democrats: Their advantage there is baked into the distribution of congressional districts.

And look at the people lining up to run for the White House in 2016. Does any one of them seem like the kind of brilliant politician who can navigate the deadly obstacle course of a two-year long presidential campaign and win over a majority of American voters, including millions who aren’t already on board with his party’s agenda? Who might that be? Ted Cruz? Rand Paul? Bobby Jindal? Rick Perry? Facing that collection of political samurai, Hillary Clinton must be positively terrified.

There are still plenty of smart Republicans out there. But the days when Republicans would run circles around Democrats, outdoing them in fundraising, messaging, organizing, and every other aspect of campaigning and politics, are a fading memory. The 2010 election may have blinded us to how long it’s really been since they set out to achieve a political goal and made it happen through their acumen and judgment. I’m sure that one day the GOP will get its strategic mojo back. But it could be a while.

“Stone-Engraved Sacrosanct Principles”: The Tea Party Isn’t A Political Movement, It’s A Religious One

America has long been the incubator of many spiritual creeds going back to the Great Awakening and even earlier. Only one of them, Mormonism, has taken root and flourished as a true religion sprung from our own native ground. Today, however, we have a new faith growing from this nation’s soil: the Tea Party. Despite its secular trappings and “taxed enough already” motto, it is a religious movement, one grounded in the traditions of American spiritual revival. This religiosity explains the Tea Party’s political zealotry.

The mark of a national political party in a democracy is its pluralistic quality, i.e. the ability to be inclusive enough to appeal to the broadest number of voters who may have differing interests on a variety of issues. While it may stand for certain basic principles, a party is often flexible in applying them, as are its representatives in fulfilling them. Despite the heated rhetoric of elections and the bombast of elected representatives, they generally seek consensus with the minority in order to achieve their legislative goals.

But when religion is thrown into the mix, all that is lost. Religion here doesn’t mean theology but a distinct belief system which, in totality, provides basic answers regarding how to live one’s life, how society should function, how to deal with social and political issues, what is right and wrong, who should lead us, and who should not. It does so in ways that fulfill deep-seated emotional needs that, at their profoundest level, are devotional. Given the confusions of a secular world being rapidly transformed by technology, demography, and globalization, this movement has assumed a spiritual aspect whose adepts have undergone a religious experience which, if not in name, then in virtually every other aspect, can be considered a faith.

Seen in this light, the behavior of Tea Party adherents makes sense. Their zeal is not the mercurial enthusiasm of a traditional Republican or Democrat that waxes and wanes with the party’s fortunes, much less the average voter who may not exercise the franchise at every election. These people are true believers who turn out faithfully at the primaries, giving them political clout in great excess to their actual numbers.  Collectively, this can make it appear as if they are preponderant, enabling their tribunes to declare that they represent the will of the American people.

While a traditional political party may have a line that it won’t cross,the Tea Party has a stone-engraved set of principles, all of which are sacrosanct. This is not a political platform to be negotiated but a catechism with only a single answer. It is now a commonplace for Tea Party candidates to vow they won’t sacrifice an iota of their principles. In this light, shutting down the Government rather than bending on legislation becomes a moral imperative. While critics may decry such a tactic as “rule or ruin,” Tea Party brethren celebrate it, rather, as the act of a defiant Samson pulling down the pillars of the temple. For them, this is not demolition but reclamation, cleansing the sanctuary that has been profaned by liberals. They see themselves engaged in nothing less than a project of national salvation. The refusal to compromise is a watchword of their candidates who wear it as a badge of pride. This would seem disastrous in the give-and-take of politics but it is in keeping with sectarian religious doctrine. One doesn’t compromise on an article of faith.

This explains why the Tea Party faithful often appear to be so bellicose. You and I can have a reasonable disagreement about fiscal policy or foreign policy but if I attack your religious beliefs you will become understandably outraged. And if I challenge the credibility of your doctrine you will respond with righteous indignation. To question the validity of Moses parting the Red Sea or the Virgin Birth or Mohammed ascending to heaven on a flying horse is to confront the basis of a believer’s deepest values.

Consequently, on the issues of government, economics, race, and sex, the Tea Party promulgates a doctrine to which the faithful must subscribe. Democrats and independents who oppose their dogma are infidels. Republicans who don’t obey all the tenants are heretics, who are primaried rather than burned at the stake.

Like all revealed religions this one has its own Devil in the form of Barack Obama. This Antichrist in the White House is an illegitimate ruler who must be opposed at every turn, along with his lesser demons, Harry Reid and Nancy Pelosi. They are responsible for everything that has gone wrong with the country in the last six years and indeed, they represent a liberal legacy that has betrayed America’s ideals for the better part of a century. Washington is seen in the same way Protestant fire-breathers once saw Rome: a seat of corruption that has betrayed the pillars of the faith. The only way to save America’s sanctity is to take control of Washington and undermine the federal government while affecting to repair it. Critical to this endeavor is the drumroll of hell-fire sermons from the tub-thumpers of talk radio and Fox News. This national revival tent not only exhorts the faithful but its radio preachers have ultimately become the arbiters of doctrinal legitimacy, determining which candidates are worthy of their anointment and which lack purity.

Having created a picture of Hell, the Tea Party priesthood must furnish the faithful with an image of Paradise. This Eden is not located in space but in time: the Republic in the decades after the Civil War when the plantocracy ruled in the South and plutocrats reigned in the North. Blacks knew their place in Dixie through the beneficence of states’ rights, and the robber barons of the North had a cozy relationship with the government prior to the advent of labor laws, unions, and the income tax. Immigrants were not yet at high tide. It was still a white, male, Christian country and proudly so. When Tea Party stalwarts cry  “Take back America!” we must ask from whom, and to what? They seek to take it back to the Gilded Age, and retrieve it from the lower orders: immigrants, minorities the “takers” of the “47 percent,” and their liberal enablers.

Most critical to any religious movement is a holy text, and the Right has appropriated nothing less than the Constitution to be its Bible. The Tea Party, its acolytes in Congress and its allies on the Supreme Court have allocated to themselves the sole interpretation of the Constitution with the ethos of “Originalism.” Legal minds look to the text to read the thoughts of the Framers as a high priest would study entrails at the Forum. The focus is on text rather than context and authors; the writing rather than the reality in which the words were written. This sort of thinking is a form of literalism that is kindred in spirit to the religious fundamentalism and literal, Biblical truth that rose as bulwarks against modernity.

One thing that Tea Partiers and liberals alike both recognize is that the Constitution forbids the establishment of religion. The prohibition was erected for good reason:  to prevent the religious wars that wracked Europe in the previous century. The Enlightenment was to transcend such sectarian violence inimical to the social order together with the concomitant religious oppression that burdened individual conscience. By investing a political faction with a religious dimension the Tea Party presents a challenge to both religion and democracy.
