“More Stuff Made Up About Obamacare”: A Nasty Ideological And Racial Undertone To Bobby Jindal’s Latest Campaign

It’s been obvious from the beginning that a big part of the GOP strategy for demonizing Obamacare has been to convince existing beneficiaries of federal health programs that ACA coverage would come out of their hides. Thus the constant efforts to convince Medicare enrollees that ACA was financed by “Medicare cuts” (not at all true with the exception of the reductions in super-subsidies offered to the Bush-era conservative pet rock of Medicare Advantage policies offered through private insurers). There’s also a nasty ideological and even racial undertone to this campaign aimed at white middle-class retirees who view their Medicare benefits as earned (via both payroll tax contributions and a lifetime of work), as opposed to the “welfare” being offered to those people supported by Medicaid or Obamacare.

But leave it to Bobby Jindal to come up with a line of attack that pits existing Medicaid beneficiaries against those who would qualify for coverage if, over his dead body, the ACA’s Medicaid expansion were to be enacted in Louisiana. TPM’s Dylan Scott has the story:

Engaged in all-out war with the liberal group MoveOn.org over a pro-Obamacare billboard, Louisiana Gov. Bobby Jindal (R) has accused the organization — and liberals in general — of endorsing discrimination against the disabled through their support of the federal health care reform law and its Medicaid expansion.

“Liberal groups like MoveOn.org won’t say one word about caring for individuals with disabilities, or how Obamacare prioritizes coverage of childless adults ahead of the most vulnerable,” Jindal wrote in an op-ed in the Shreveport Times last Thursday. “They just want to intimidate states into accepting Obamacare’s massive new spending programs.”

What does Bobby mean by “prioritizing” coverage of childless adults? Simply that expanded coverage comes with a higher federal match rate than is available for traditional Medicaid (not high enough, of course, to convince ideologically motivated Republicans, especially in the South, to execute an expansion that in many cases would represent a fiscal windfall for state governments while significantly reducing the ranks of the uninsured).

How, exactly, does that hurt people with disabilities, or others currently qualifying for Medicaid? The short answer is that it doesn’t, as Scott explains with some help from experts:

[T]here are a few huge problems with Jindal’s rationale, which effectively undermine the whole line of attack. First, some disabled people could actually qualify for health coverage under the Medicaid expansion, according to MaryBeth Musumeci, associate director of the Kaiser Commission on Medicaid and the Uninsured.

“People with disabilities can be within the new expansion group,” she said. “The ACA provides the opportunity for some people with disabilities to qualify for Medicaid who never qualified before. Their incomes, while still low, could have been above the very, very low limits states had set or they may not have been eligible at all if they fell into the category of single, childless adults. So it creates an expanded opportunity for people with disabilities to gain coverage.”

Second, Obamacare should have no policy bearing on the traditional Medicaid program. Federal funding for the traditionally eligible population remains exactly the same, and the states retain the same flexibility to manage their programs as existed prior to the law. The ACA brings a new population into the program, but there is no policy reason that it would lead to “discrimination” — as Jindal calls it — or any other detrimental effects for disabled people enrolled in the traditional program.

“I think that’s right,” Musumeci said when asked by TPM if the Obamacare’s Medicaid expansion should have no effect on traditional Medicaid. “What the Medicaid expansion essentially does is it creates a new eligibility category. Like any other time Congress has expanded eligibility of the program, it is adding statutory authority to cover this new group of people.”

“But it’s built into the same underlying Medicaid program. States still have all of the flexibility that they previously had in terms of how they structure their care delivery system, their benefits packages, and all of those things.”

It would be interesting to know how well people with disabilities, and other current Medicaid beneficiaries, would fare in Louisiana if the national Republican “reform” of Medicaid, a block grant that reduced federal funding over time, were to be enacted. Let’s hope we don’t find out. But in the meantime, the “prioritization” argument against the Medicaid expansion is just another effort to frighten one group of safety net beneficiaries they have a stake in excluding others. It’s exactly what we’ve come to expect from self-styled conservative Christian warriors like Bobby Jindal.

“Back Street Abortions?”: New Law Could Force All Of Louisiana’s Abortion Clinics To Close

Women in Louisiana could lose all access to abortion services if the state succeeds in enacting a secretive overhaul of its clinic regulations. The requirements are so stringent that every one of the five clinics currently operating in Louisiana would have to close, according to a lawyer advising the clinics. The new regulatory framework would also impose a de facto 30-day waiting period for many women—an exceptional requirement.

“What it amounts to is a back door abortion ban,” said Ellie Schilling, a New Orleans attorney. “The way the [Department of Health and Hospitals] went about passing these regulations was in a secretive and undemocratic way. The public definitely doesn’t know what’s going on.”

DHH enacted the overhaul just before Thanksgiving, when it passed the rules as an emergency measure, effective immediately—exempting them from the normal comment period. None of the clinics were given notice; one heard about the declaration of emergency from  anti-abortion protestors.

It isn’t clear what emergency the agency was responding to. There has been virtually no reporting on the new rules, and DHH did not respond to questions submitted Monday. The Declaration of Emergency states that the agency proposed the licensing standards in order to comply with two acts passed by the Louisiana legislature in 2013, but a complete overhaul goes well beyond their demands. DHH formally declared its intentions to make the emergency rules permanent in December.

According to Schilling, the law gives the agency the ability to shut down every existing clinic in Louisiana immediately, by imposing new space requirements that none of the existing clinics meets. Providers would lose some of their rights to appeal noncompliance citations, while new and complex documentation and staffing requirements create more opportunities for DHH to cite clinics for deficiencies. “Deficiencies are used to create this impression of clinics being repeat offenders, and that’s a basis for revoking their license,” explained Schilling.

The regulatory overhaul would also give the state tools to prevent new clinics from getting a license. Proposed facilities—like a $4.2 million Planned Parenthood health center on South Claiborne Avenue in New Orleans—would have to prove to DHH that their services are needed; it’s unclear what criteria the agency would use to determine need. “It certainly seems that one intention is to prohibit Planned Parenthood from entering the market,” Schilling said. (Planned Parenthood clinics in Louisiana do not currently offer abortion services. “We are evaluating all our options” in light of the regulations, a spokesperson said.)

The new rules place a significant, unjustified burden on women by requiring that they undergo blood tests at least a month before an abortion procedure. That means that unless a patient happens to have gone to the doctor previously and had those tests done by chance, she will face a mandatory 30-day waiting period.

“I’ve never seen anything like this. It’s pretty outrageous,” said Elizabeth Nash, state issues manager at the Guttmacher Institute.

Louisiana already has a 20-week cutoff, and so the waiting period could dramatically shorten the window in which women are legally allowed to have abortions. There is no medical rationale for conducting those particular tests so far in advance; they are routinely conducted by providers prior to an abortion, and legislation passed in 2003 that tightened the laws governing Louisiana’s abortion providers stipulated that they had to be done within 30 days of the procedure. To the contrary, forcing women to delay the procedures increases their expense, and raise the risk of complications.

Dozens of other states have passed waiting periods or regulations, known as Targeted Regulation of Abortion Providers, or TRAP laws, which single out abortion providers with burdensome rules. But Nash said that a de facto 30 day waiting period combined with requiring clinics to prove need for their services makes Louisiana’s law striking. “It’s a great way to eliminate access,” said Nash.

All that’s stopping the state from completing the overhaul, Schilling said, is going through the motions of a public hearing. One is scheduled for Wednesday morning in Baton Rouge, but bad weather threatens to cancel it. It isn’t clear if the state would hold another hearing, as it was already scheduled at the very end of the comment period.  Legal challenges would surely follow, but as Nash warned, rolling back clinic regulations in the courts is challenging.

“As it is right now, you have to go to the major cities to have procedure done. If these clinics close, where will the patients go? Then what are we back to? Back street abortions?” said Missy Cuevas, who is fighting a legal battle with the state after her New Orleans clinic lost its license a little over a year ago. With more than two decades of work in women’s health, Cueva has seen the burden on Louisiana women grow as regulators clamp down. Five to ten women still call every day looking for services, even though she’s been closed for so long.

“If we make it any more difficult, where are the patients going to go—Houston? Atlanta? My patients can’t afford to go to Baton Rouge from New Orleans, much less to Houston or Atlanta. It’s going to force women to go back to what they used to do before, and women will die.”

“Greeting The New Year”: A Time Of Lightness And Optimism In A World Full Of Darkness

This is the season of lists: roundups and recaps, forecasts and resolutions.

What was the biggest story of the year? Snowden.

The best movie? “12 Years a Slave.”

The splashiest pop culture moment? Twerk, Miley!

Will the health care rollout roll over the president’s second-term agenda? Who’ll win in 2016? Who are the people to watch? Can Pope Francis top his 2013 cool points?

We resolve to go back to the gym and lose a few pounds, to pay off that credit card debt and up our savings, and to tell that overbearing boss to “chill out!”

I must say that as corny as it all is, I’m always entertained by it. In fact, “entertained” may be too mild a word. I’m enthralled by it, mostly because I connect with the more profound undercurrent of the moment: the idea of marking endings and beginnings, the ideas of commemoration and anticipation.

For that reason, the new year has always been my favorite time of the year.

When I was growing up, we had our own rural, Southern ways to mark it. Some folks spent New Year’s Eve at watch night church services, singing and praying and testifying. My brothers and I spent ours in front of the television waiting for the ball to drop in Times Square. Then, as the clock struck midnight and folks on television kissed and cheered and celebrated in a blizzard of confetti, we stepped outside to listen as old men blasted shotguns into the perfect darkness of the Louisiana night sky. Finally, we ate black-eyed peas (for good luck) and cooked greens (for good fortune). As the saying went, “Eat poor on New Year’s, and eat fat the rest of the year.” Things didn’t always work out that way, but hope was always heavy in the bowls of those old spoons.

To me, New Year’s was always a time of lightness and optimism in a world full of darkness. Anything could be, no matter what had been.

I never really made resolutions when I was young. But the older I’ve gotten, the more I’ve felt that resolutions are necessary, as much for the forced articulation of goals as for the setting of them.

So this year, these are my resolutions:

1. To stop treating politicians like sports stars, political parties like teams and our national debate like sport.

Politics is not a game. There are real lives hanging in the balance of the decisions made — or not made — by those in power. Often, those with the most to lose as a result of a poor policy move are the most vulnerable and most marginalized. Those folks need a voice, and I will endeavor to be that voice.

2. To force politicians to remember, with as much force and fervor as my pen can muster, that they are servants, not rulers.

A democracy is a government by the people, for the people. Politicians too often bend in the presence of power. They believe that it is they who possess power, rather than the people who elected them. And power and money are kissing cousins; you will rarely find one not cozied up to the other. Money is corruptive, and power addictive. Together they work against the greater good. That cannot stand.

3. To remember that justice is a natural aching of human morality.

In the core of most people is an overwhelming desire to see others treated fairly and dealt with honestly. That is not a party-line impulse but a universal one. I will do my best to highlight that basic quality. For instance, I believe that there will come a time when we will all look back at the brouhaha over same-sex marriage in disbelief and disgrace, and ask: Why was that even a debate?

4. To focus more fully on the power and beauty of the human spirit.

Regardless of their politics, the vast majority of the people I meet, when they can speak and listen and act of their own accord and not in concert with a group, are good, decent and caring people. Most work hard or want to. They love their families and like their neighbors. They will give until it hurts. They fall down, but they bounce back. They are just real people, struggling to get a bit and get by, and hoping to share a laugh and a hug with an honest heart or two along the way. That is no small observation and not one of little consequence. I believe that I can write more about those traits.

Those are my resolutions, ones I will strive to keep, ones I’ll reflect on even if I fall short. What are yours?

“A Thinking, Moral Person Doesn’t Defend Nostalgia For Jim Crow”: What Duck Dynasty’s Phil Robertson Can Teach Us About Empathy

Yes, I have something to add to the Duck Dynasty controversy, wherein reality TV star Phil Robertson got in trouble for expressing anti-gay views, was suspended by A&E, and has now become the cause celebre of nitwit conservative politicians from across the land. This won’t take long.

I’m not even going to bother addressing the idiocy of the “constitutional conservatives” who think the First Amendment guarantees you the legal right to (1) a cable reality show and (2) never be criticized for anything you say. Nor am I going to talk about Robertson’s anti-gay statement, except to say that nobody buys you couching your bigotry in “biblical” terms just because you call yourself a Christian and throw out some scriptural references. Once you start campaigning to have people who eat shellfish and the sinners who work on the Sabbath executed (the Bible says so!) then we’ll accept that you’re just honoring your religion.

It’s Robertson’s comments about how happy black people were living under Jim Crow that I want to focus on, because they have something to teach us about empathy and individual change. Ta-Nehisi Coates says what needs to be said about the actual reality of which Robertson was so blissfully unaware, but in case you haven’t seen it, here’s what Robertson said about the Louisiana of his youth:

“I never, with my eyes, saw the mistreatment of any black person. Not once. Where we lived was all farmers. The blacks worked for the farmers. I hoed cotton with them. I’m with the blacks, because we’re white trash. We’re going across the field…. They’re singing and happy. I never heard one of them, one black person, say, ‘I tell you what: These doggone white people’—not a word!… Pre-entitlement, pre-welfare, you say: Were they happy? They were godly; they were happy; no one was singing the blues.”

I don’t have trouble believing that Phil Robertson never saw the mistreatment of black people with his own eyes, so long as he’s thinking about mistreatment as dramatic things like lynchings and cross-burnings. Maybe as a child, he wasn’t aware of what life was like for black people in Louisiana in those days. But he isn’t a child anymore. He’s a 67-year-old man, and it’s 2013. And part of being a thoughtful adult is realizing that maybe the narrow world of your childhood, as seen through a child’s eyes, was not in fact the entire world. By now, Robertson has had plenty of opportunities to learn about the horror of the Jim Crow era. He can read, and I imagine he owns a television. It shouldn’t be news to him. We’ve had a rather lengthy discussion about it over the last half-century or so.

What Robertson is saying is, “Forget about all that—the real truth lies in what I saw, which is that the black people I knew didn’t complain to me about Jim Crow, so that means that for all intents and purposes it didn’t exist.” But empathy requires us to at least try to imagine that our own experiences might not be the same as everyone’s. Sometimes it even requires that we consider the possibility that our experiences, and the perspective we originally had on them, distort reality. If your neighbor let you borrow his shovel and you thought, “What a nice guy,” and then later you found out that he also used that shovel to bury the 14 runaways he murdered, you wouldn’t say, “He couldn’t be guilty, because he was a nice guy who once lent me his shovel.” You’d understand that the shovel-lending, nice though it may have seemed at the time, didn’t accurately reflect his entire person.

And they may not like it, but white people who grew up in the South during Jim Crow have an extra responsibility to reflect on their own experience, their youthful perspective, and the reality so many people endured. They lived under a terrorist regime that treated them quite well while it committed horrific crimes against their fellow citizens. It may not be fair to say to someone today, “You should have stood against it,” particularly if they were young at the time. But it is fair to say that they now need to understand what it truly was, and if in 2013 they still think that blacks were “singing and happy” before they got welfare and turned all uppity, then they need to wake up.

OK, so I will say one more thing about the conservatives now rallying to Robertson’s cause. The way a thinking, moral person would react to his statements is to say, “Listen, I may not agree with his views about certain things, but he’s only one character on that program, and there’s a lot of value there.” A thinking, moral person doesn’t defend nostalgia for Jim Crow and compare gay people to those who commit bestiality. If you want to love this particular sinner but hate his sin, you’ve got to acknowledge the sin. And my conservative friends, the next time you’re wondering why gay people, black people, and pretty much anybody who is a minority of any kind all consider you intolerant? It isn’t liberals unfairly maligning you. It’s this kind of thing.

“Duck Dynasty And Quackery”: Intolerance That Is Disarming Is The Most Dangerous Kind

I must admit that I’m not a watcher of “Duck Dynasty,” but I’m very much aware of it. I, too, am from Louisiana, and the family on the show lives outside the town of Monroe, which is a little over 50 miles from my hometown. We’re all from the sticks.

So, when I became aware of the homophobic and racially insensitive comments that the patriarch on the show, Phil Robertson, made this week in an interview in GQ magazine, I thought: I know that mind-set.

Robertson’s interview reads as a commentary almost without malice, imbued with a matter-of-fact, this-is-just-the-way-I-see-it kind of Southern folksiness. To me, that is part of the problem. You don’t have to operate with a malicious spirit to do tremendous harm. Insensitivity and ignorance are sufficient. In fact, intolerance that is disarming is the most dangerous kind. It can masquerade as morality.

A&E, which airs “Duck Dynasty,” moved quickly to suspend Robertson, as his comments engaged the political culture wars, with liberals condemning him and conservatives — including Gov. Bobby Jindal of Louisiana, a possible presidential candidate — rushing to his defense.

Let me first say that Robertson has a constitutionally protected right to voice his opinion and A&E has a corporate right to decide if his views are consistent with its corporate ethos. No one has a constitutional right to a reality show. I have no opinion on the suspension. That’s A&E’s call.

In fact, I don’t want to focus on the employment repercussions of what Robertson said, but on the content of it. In particular, I want to focus on a passage on race from the interview, in which Robertson says:

“I never, with my eyes, saw the mistreatment of any black person. Not once. Where we lived was all farmers. The blacks worked for the farmers. I hoed cotton with them. I’m with the blacks, because we’re white trash. We’re going across the field. …They’re singing and happy. I never heard one of them, one black person, say, ‘I tell you what: These doggone white people’ — not a word! …Pre-entitlement, pre-welfare, you say: Were they happy? They were godly; they were happy; no one was singing the blues.”

While this is possible, it is highly improbable. Robertson is 67 years old, born into the Jim Crow South. Only a man blind and naïve to the suffering of others could have existed there and not recognized that there was a rampant culture of violence against blacks, with incidents and signs large and small, at every turn, on full display. Whether he personally saw interpersonal mistreatment of them is irrelevant.

Louisiana helped to establish the architecture for Jim Crow. First, there were the Black Codes that sought to control interactions between blacks and whites and constrain black freedom. The Jim Crow Encyclopedia even points out that in one Louisiana town, Opelousas, “freedmen needed the permission of their employers to enter town.”

Then, in 1890, the State Legislature passed the Separate Car Act, which stipulated that all railway companies in the state “shall provide equal but separate accommodations for the white, and colored races” in their coaches. The landmark Plessy v. Ferguson case was a Louisiana case challenging that law. The United States Supreme Court upheld the law, a ruling that provided the underpinning for state-sponsored racial segregation, and Jim Crow laws spread.

Robertson’s comments conjure the insidious mythology of historical Southern fiction, that of contented slave and benevolent master, of the oppressed and the oppressors gleefully abiding the oppression, happily accepting their wildly variant social stations. This mythology posits that there were two waves of ruination for Southern culture, the Civil War and the civil rights movement, that made blacks get upset and things go downhill.

Robertson’s comments also display a staggering ignorance about the place and meaning of song in African-American suffering. As for the singing of the blues in particular, the jazz musician Amina Claudine Myers points out in an essay that the blues was heard in the late 1800s and “came from the second generation of slaves, Black work songs, shouts and field hollers, which originated from African call-and-response singing.” Work songs, the blues and spirituals were not easily separated.

Furthermore, Robertson doesn’t seem to acknowledge the possibility that black workers he encountered possessed the most minimal social sophistication and survival skills necessary to not confess dissatisfaction to a white person on a cotton farm (no matter how “trashy” that white person might think himself).

It’s impossible to know if Robertson recognizes the historical resonance and logical improbability of his comments. But that’s not an excuse.
