“New Voting Laws Show That The Struggle Continues”: Pointing To A Growing Lack Of Respect For Individual Voting Rights

Growing up in Mississippi more than 50 years ago, Sammie Louise Bates had to help her grandmother count the money needed to pay poll taxes. Living under Jim Crow laws angered Bates — and inspired her to become a lifelong voter.

Bates was 25 when the Voting Rights Act passed in 1965, abolishing poll taxes and other discriminatory voting practices. For most of her life she did not face hurdles to the ballot box like her grandmother did.

But in 2013, that changed. Bates was no longer able to vote because her home state of Texas passed a new restrictive voter ID law. To get an acceptable photo ID, she first needed to pay $42 for a birth certificate. The cost was too much: “We couldn’t eat the birth certificate,” she testified in a lawsuit, “and we couldn’t pay rent with the birth certificate.”

Bates is an example of the hundreds of thousands, perhaps even millions, of Americans who now face difficulties voting because of new state laws restricting the right to vote. On the 50th anniversary of the Bloody Sunday march, which galvanized support for the VRA, these Americans remind us that the struggle is not over.

After decades of progress, the past five years has seen the most extensive attack on voting rights since the VRA was signed into law. Since 2011, every state but one has considered legislation that would make it harder for many eligible citizens to vote, and half the states passed new voting restrictions. By the 2014 election, after lawsuits and repeal efforts, voters in 21 states faced tougher voting rules than they did in 2010.

These new voting restrictions — which go beyond Texas-style photo ID laws and include things like early voting cutbacks and voter registration restrictions — apply to everyone. But they are not neutral in their impact. While most people do have a driver’s license or a similar state-issued photo ID, for example, the 11 percent of Americans who do not are disproportionately African-American and Latino.

And while most people still vote on Election Day, minorities make up a disproportionate number of those who voted on the weekend and other early voting days cut in states like North Carolina and Ohio. The net effect of these changes is a voting system that is less accessible to minorities, especially those with modest incomes.

Race has played a significant role elsewhere as well. The push to restrict voting came after a surge in participation among African-Americans and certain other groups in 2008. Recent studies found that the more a state experienced increases in minority and low-income voter turnout, the more likely it was to push and pass laws cutting back on voting rights. The Brennan Center similarly found that of the 11 states with the highest black turnout in 2008, seven passed laws making it harder to vote. Of the 12 states with the largest Hispanic population growth in the 2010 Census, nine states did so. And of the 15 states that used to face special monitoring under the VRA because of a history of racial discrimination in elections, nine states passed laws that make it more difficult to vote.

Unfortunately, efforts to restrict voting show no signs of abating. In the first few weeks of this year, legislation was introduced in 17 states and already progressed in two.

All this points to an urgent and continuing need for strong legal protections for voting rights — protections sought and won by the brave marchers 50 years ago in Selma. But here’s the rub: in the midst of a controversial and racially-charged battle over voting rights, the US Supreme Court gutted a core provision of the VRA. The net result has been not only a loss of voter protections in the courts but also a marked increase in discriminatory voting changes in states that used to be covered by the law. This contributes to a growing lack of respect for voting rights — arguably the defining feature of American democracy.

So what can we do? For starters, urge Congress to update and restore the Voting Rights Act. Urge your state not to pass retrograde voting restrictions, and instead to modernize the voter registration system and adopt other sensible improvements like those recommended by a recent bipartisan presidential commission. And join the tens of thousands of Americans flocking to Selma this week in honoring one of our nation’s greatest accomplishments — the recognition of the equal right to vote for every eligible American.

We have come a long way, but we still have farther to go.

“Trying Every Trick In The Book”: Republicans Stop At Nothing To Attack Immigrants

On March 3, the House of Representatives finally voted for a clean DHS funding bill. Much of the media reported that Republicans saw the irresponsibility of their threats to shut down Homeland Security and passed a clean bill. But they didn’t, and no one should lose sight of that.

After trying every trick in the book to scuttle the bill, their leadership allowed the vote to happen, but Republicans never caved. Republicans voted over two to one (167-75) against the bill. It only passed because of full Democratic support.

It’s clear that Republicans will stop at nothing to attack immigrants. The fact that national security was on the line was immaterial: Republicans saw an opportunity to display their animus toward all immigrants, and Latinos in particular, and they took it.

This publicity stunt gave Republicans the chance to pander yet again to the most virulent anti-immigrant members of their party. Take, for instance, William Gheen of Americans for Legal Immigration and his comments during the heat of the DHS fight in mid-February:

[I] wouldn’t put anything past [the administration, because] the people who are supporting the organized and well-funded illegal alien invasion of our homeland have the blood of many thousands of Americans on their hands that have been killed, injured raped and robbed by illegal immigrants.

Sure, Gheen is a fringe extremist. But what he’s saying is strikingly similar to what we’re hearing from the Republican Party.

Kansas Secretary of State Kris Kobach, the architect of Mitt Romney’s “self-deportation” strategy, entertained the suggestion that Obama’s executive actions could eventually result in Latinos conducting an “ethnic cleansing” of their fellow Americans. Sen. Tom Coburn, Rep. Mike Kelly, and Rep. Louie Gohmert have also warned that the president’s immigration policies could lead to violence.

While some in the GOP tried to tell a different narrative — that this was just about reining in presidential excess and not about their being anti-immigrant — the fact is that the entire Republican Party is at fault. Not one House Republican signed the discharge petition to allow even a vote on the Senate’s bipartisan comprehensive immigration reform bill. And Senate Republicans who backed that bill, including Sen. Marco Rubio, now say they no longer support it. At this very minute, House Republicans are bringing up even more anti-immigrant legislation, including deportation-only legislation and a bill that would drastically change U.S. asylum and humanitarian protections to put domestic violence survivors and victims of human trafficking at serious risk.

Ultimately, it was Ann Coulter who summed up the Republican position on the DHS debate: Undocumented immigrants (she calls them “illegal aliens [who] have killed, raped and maimed thousands of Americans”) pose a greater threat to our nation than does ISIS.” While not all Republicans used language as biting as that, it was crystal-clear that Republicans believe that attacking immigrants, not funding DHS, should be the top priority.

Who would have imagined that a national party, never mind the Republican Party, would be so opposed to finding any solution for the almost 12 million undocumented people already here that they would risk our national security during the dangerous time we are in now? Yet that’s the reality of the GOP today, and it’s our responsibility to hold them accountable.

“Polls Show Most Americans Favor Pathway To Citizenship”: GOP Continues To Be Held Hostage By Aging, Nativist Tea Partiers

With all the high drama in Washington over immigration, you’d think the fate of undocumented workers represented a cataclysmic political divide — an ever-widening chasm that cannot be bridged. But it doesn’t.

Polls have long shown that a majority of Americans favor a pathway to citizenship for those residents who entered the country illegally. But new data show that isn’t a matter of blue states overwhelming red ones. In fact, there isn’t a state in the union, from the bluest to the reddest, where a majority opposes a path to citizenship, provided certain criteria are met, for those without papers, according to the Public Religion Research Institute.

The PRRI has used its data to create an American Values Atlas that shows the political inclinations of voters in each state. Unsurprisingly, some states are more immigrant friendly than others. In California, for example, 66 percent support a path to citizenship for the undocumented. In crimson-red Alabama, that drops to 56 percent. But that’s still a majority.

Yet, that very pathway is the mechanism that congressional Republicans have denounced as “amnesty” and refused to support. House Speaker John Boehner’s caucus has declined even to hold a vote on a proposal for comprehensive immigration reform.

Last fall, when President Obama took action through executive orders to grant temporary papers to as many as 4 million immigrants who met certain criteria, Republicans were apoplectic, claiming he was violating the Constitution and behaving like a despot. They have used every instrument at their disposal, from lawsuits to a pitched battle over funding for the Department of Homeland Security, to overturn the president’s orders.

Yet even the president’s executive action on immigration is not as unpopular as you might think. While his decision to use executive powers does not draw universal support, the aim of his action does. Three-quarters of Americans favor his policy of granting temporary documents to certain groups of immigrants. Said Robert Jones, CEO of the institute, “In today’s polarized politics, there are few major issues that attract this kind of bipartisan and cross-religious agreement.”

It makes you wonder: Who are those congressional Republicans listening to? Why are they opposing a policy with widespread support, even among GOP voters? (While more Democrats — 70 percent, according to the PRRI — support a path to citizenship, 51 percent of Republicans do, as well.)

The answer is depressing, if not surprising: The Republican Party continues to be held hostage by an aging and nativist minority of Tea Partiers who cannot stomach the idea of a browning America. (It isn’t considered polite to point this out, but more Tea Partiers hold views that show racial resentment than the public at large. As just one example, a 2010 New York Times poll showed Tea Partiers are “more likely than the general public, and Republicans, to say that too much has been made of the problems facing black people.”)

Among those who identify with the Tea Party, only 37 percent support a pathway to citizenship, according to the PRRI poll. Twenty-three percent would give them legal residency, while 37 percent want to deport each and every one of them, the poll said. (Never mind the logistical and financial nightmare that trying to round up every undocumented resident would represent.)

This is a huge problem for the GOP, as its strategists have pointed out for years. The party cannot afford to alienate Latinos, a growing bloc, as they have alienated black voters with their resistance to civil rights measures.

So rather than pander to an ultraconservative and xenophobic minority, the Republican Party’s leaders ought to educate them about the need for comprehensive immigration reform. As a practical matter, demographic change is already preordained: By the year 2042, according to the U.S. Census, whites will no longer constitute a majority, no matter what happens to undocumented immigrants. The GOP needs the allegiance of more voters of color if it is to regain the Oval Office.

But there is more at stake here than the survival of a political party. The nation also needs those immigrants; it needs their energy, their youth, their hopes and dreams. We ought to welcome them with open arms.

“The Hypocrisy Goes Much Deeper”: As RNC Gathers, More Prominent GOP Members In Bed With Extremists

It’s only been a few weeks since we learned that majority whip Rep. Steve Scalise (R-La.) had spoken to a white supremacist group in 2002, and again the Republican Party has a scandal about race on its hands.

As the RNC gathers today in San Diego for its annual strategy meeting to draft plans for its future, particularly how it will improve its outreach to minorities, another prominent GOP lawmaker has been discovered to be a fan of white supremacist thinking.

Dave Agema, a member of the Republican National Committee from Michigan, republished an essay by the white nationalist publication American Renaissance in a New Year’s Eve Facebook post. The racist article, par for the course for American Renaissance, said “blacks are different by almost any measure to all other people. They cannot reason as well. They cannot communicate as well. They cannot control their impulses as well. They are a threat to all who cross their paths, black and non-black alike.”

Agema reportedly found it “very enlightening.” Can that possibly be true?

Agema has since pulled the piece down, but he refuses to apologize or resign from the RNC. And this isn’t his first racist rodeo.

According to the National Journal, Agema has a well-documented history of making inflammatory and false remarks, such as that President Obama is a Muslim. The Journal points to another Agema Facebook faux pas. He apparently shared what he called an “eye opening” essay that posed the question: “Have you ever seen a Muslim do anything that contributes positively to the American way of life?”

At least in this case, some in the RNC have reacted appropriately by calling for Agema to resign or be removed. They include RNC head Reince Priebus and Michigan’s entire GOP delegation. That’s all well and very good, but where’s the outrage from Priebus or other prominent Republicans over Louisiana Governor Bobby Jindal’s plan to hold a prayer rally with the American Family Association (AFA)? Emails to Priebus’ and Jindal’s offices asking for comment were not returned.

On Jan. 24, Jindal, with AFA backing, will be praying at Louisiana State University in an event billed as “The Revival.” His partner, AFA, has defamed immigrants, the LGBT community and women. And just like American Renaissance, it has had horrible things to say about black people.

Let’s take a look at Jindal’s prayer partners.

  • An AFA leader has said, “Homosexuality gave us Adolph Hitler, and homosexuals in the military gave us the Brown Shirts, the Nazi war machine and 6 million dead Jews.”
  • The same staffer said African Americans “rut like rabbits” and women have no place in politics or the military.
  • Another has argued that Hispanics are “socialists by nature” and come to the United States to “plunder” our country.
  • And the group has repeatedly made the point that non-Christians are second-class citizens—“we are a Christian nation, and not a Jewish or Muslim one.” (Find a comprehensive look at AFA’s extremist statements and positions here).

Given a track record like that, I have to ask where’s the outrage from Jindal’s fellow Republicans? American Renaissance is clearly racist, but so are these statements about black people and Latinos. Shouldn’t they be condemned as well? And what about blaming gay people for the Holocaust?

So, if Agema is the big Republican elephant in the room stalking the GOP’s efforts to reach out to minorities, isn’t that true as well of any politician who is close to AFA?

Sadly the hypocrisy goes much deeper. As RNC Chair Priebus has berated Agema, rightly saying, “The tone and rhetoric from Agema is consistently offensive and has no place in politics or any rational conversation,” the chairman is also working closely with AFA.

At the end of this month, Priebus is leading an all expenses paid trip to Jerusalem for RNC members. So far, about 60 members (about 36 percent) of the RNC have accepted the offer, according to Haaretz.

And guess who is picking up the tab for this “incredible opportunity” Priebus is offering his fellow RNC members? You guessed right: the AFA.

“This Is Progress?”: The Unbearable Whiteness Of Congress

Cue the confetti: The new Congress sworn in on Tuesday is the most diverse in our nation’s history!

That would truly be a milestone to celebrate—until you see what that record “diversity” actually means. Ready? The breakdown of the 114th Congress is 80 percent white, 80 percent male, and 92 percent Christian.

That’s really diverse if, say, you are comparing our new Congress to the white supremacist group House Majority Whip Steve Scalise once addressed. It’s like Congress is stuck in a time warp: While our calendars read 2015, theirs reads more like 1955.

Look, I don’t care if you are a liberal or a conservative. It’s impossible to make the claim that our Congress accurately reflects the demographics of our nation. And it’s not missing by a little but a lot. If Congress accurately reflected our nation on the basis of race, about 63 percent would be white, not 80 percent. Blacks would hold about 13 percent of the seats and Latinos 17 percent.

But what do we really see? The new Senate has only two black senators. That statistic is even more striking given that earlier this week the first black person ever elected to the Senate, Edward Brooke, was laid to rest. Brooke won his seat in 1966 and served two terms. How far has Congress really evolved on race when in 50 years it has gone from one black senator to two? (Even the arguably more democratic House is only at 10 percent black members.)

Latinos, the fastest growing minority group in America, are even more underrepresented in Congress. They hold 3 percent of the Senate and a little over 7 percent of the House.

And let’s look at religion. Congress is now 92 percent Christian, resembling more to a papal enclave than our religiously diverse nation. The latest Pew Poll found that nearly 20 percent of Americans identify as atheist, agnostic, or not being affiliated with any religion. Yet there’s only one member of Congress, Rep. Kyrsten Sinema (D-AZ), who openly acknowledges she’s not a member of any religious group.

OK, let’s put race, ethnicity, and religion aside and address the most glaring underrepresentation in Congress of any group: women. This Congress will welcome more women than ever before at 19 percent of the House and 20 percent of the Senate. So what percentage of America is female? It’s 51 percent.

Even internally in the House, women are not getting their fair shake. While 19 percent of the House is female, just one woman will get to chair one of its 20 committees.

There are various reasons—some rather complex, some rather base—why our Congress doesn’t come close to reflecting the demographics of our nation. One that affects all the groups is that Congress moves slowly, and I don’t mean just on passing legislation. Historically the reelection rate for members of Congress is in the area of 95 percent. The benefits of incumbency are quite potent, especially in the all-important area of raising campaign funds. This is likely the single biggest reason why you don’t see Congress evolve demographically more quickly. (Term limits could be a prescription to speed change along.)

Minority communities also have had to deal with the issue of “racial gerrymandering,” where congressional districts are designed either to dilute the strength of a minority community, known as “cracking,” or over-concentrate them, known as “packing.” While “packing” will lead to the guarantee of a few seats in Congress, it also can reduce the opportunities for minority candidates, says Arturo Vargas, executive director of the Latino group NALEO. Finding the “sweet spot” between packing and cracking, he says, is central to creating more districts that provide minorities the opportunity to be elected to Congress.

And then comes the issue of women in Congress. The United States now ranks 98th in the world for the percentage of women serving in its national legislature, behind Indonesia and Kenya.

Why are so few women serving in our Congress? Studies have offered us a few reasons, some contradictory. One found that women have less interest in seeking elected office, with 48 percent of the men surveyed having considered a career in politics but only 35 percent of women. Partly this was due to women receiving less encouragement to go into politics and having lower self-confidence about running for Congress.

But in the case of black women, another study found no lack of interest. Rather, black women are not recruited to run because party bigwigs view them as being less electable and less likely to raise the campaign dollars needed to mount an effective campaign than white women or men.

With all that said, representation of each of these respective communities has increased in the new Congress. But as Vargas noted, “Progress never comes fast enough.”

So what would happen if our Congress accurately, or at least more closely, reflected our nation’s demographics? Would our Congress be less dysfunctional? That feels like the old Catskills joke that ends with the punch line “It can’t get any worse!”

But people in the underrepresented groups might see Congress as truly being representative of who they are and their views, as opposed to seeing it as an institution still dominated by the old guard. That could (possibly) lead to a Congress that’s more responsive. And that’s good for all of us, regardless of our race, religion, ethnicity, or gender.
