“A Visceral Reaction Like None Before”: The Gun-Vote Backlash Has Only Just Begun
As the Boston area was gripped by the manhunt that followed the Marathon bombings late last week, the opinion pages of the Concord Monitor just up the road in New Hampshire were consumed with another subject: Senator Kelly Ayotte’s vote against legislation to expand background checks for gun purchases. The paper’s lead editorial Sunday decried Ayotte’s rationale for opposing the bill as “utter nonsense” and an “abomination.” The letters to the editor section is riddled with anti-Ayotte broadsides, the tenor of which are conveyed by their headlines: “Ayotte’s vote should propel her out of office.” “Beyond disappointed.” “Ayotte did not represent her New Hampshire constituents.” “Enabler of murderers.” “Ayotte’s ‘courage.’” “Craven pandering.” “Reckless vote.” “Illogical vote.”
If gun control advocates are going to have any chance of resurrecting reforms after last week’s crushing defeat, much is going to depend on the depth of the initial backlash against the Democratic or swing-state Republican senators who opted to vote with the gun lobby. In a piece the day after the vote, I lamented that some leading liberals and mainstream media types were so willing to chalk the vote up to the predictable dynamics of the gun control issue, thereby essentially letting the senators who cast the crucial votes against the legislation off the hook for their decisions. One major columnist avoided holding accountable the senators who took the actual votes by wishing that President Barack Obama had acted more like a president in a movie.
But there are signs that the reaction against the vote will be stronger than what has followed prior setbacks for the cause. First, of course, there was the angry cri de coeur from Gabby Giffords. On Friday came spontaneous protests around the country at district offices of senators who voted no. The Brady Campaign to Prevent Gun Violence has set up a number for people to text so they can be patched through to the office of a senator who went the other way. “In years past when we lost on a vote, we had to generate [reaction], we had to push people,” says Brian Malte, the group’s director of mobilization. “This time it’s just directing it to the right place. It’s ‘I’m so angry, what should I do?’”
Perhaps the most surprising outburst came from Bill Daley, the former Clinton commerce secretary, JP Morgan Chase executive and Obama chief of staff. Daley, son and brother of the Chicago mayors of the same name, is no one’s idea of a conscience liberal—in fact, he was a leading voice during the past two decades for making the Democratic Party more welcoming to centrist types, be they pro-business moderates like himself or red-state working-class voters who, yes, cling to their guns. But there he was in Sunday’s Washington Post excoriating the four Senate Democrats who voted against the background-check legislation, particularly Heidi Heitkamp, the newly elected North Dakotan who does not face voters again for another five years:
I want my money back. Last October, I gave $2,500 to support Heidi Heitkamp’s campaign to become North Dakota’s junior senator. A few weeks later, she won a surprise victory. But this week, Heitkamp betrayed those hopes. She voted to block legislation to make gun background checks more comprehensive. Her vote — along with those of 41 Republicans and three other Democrats — was a key reason the measure fell short of the 60 votes needed for passage.
Polling has shown that nine in 10 Americans and eight in 10 gun owners support a law to require every buyer to go through a background check on every gun sale. In North Dakota, the support was even higher: 94 percent. Yet in explaining her vote, Heitkamp had the gall to say that she “heard overwhelmingly from the people of North Dakota” and had to listen to them and vote no. It seems more likely that she heard from the gun lobby and chose to listen to it instead.
Daley is just one person, but this seems pretty significant to me, as a sort of signal to establishment Democrats nationwide. For so long, party poo-bahs have cosseted Democrats from red or purple districts on issues such as gun control—heck, Daley’s fellow Chicagoan Rahm Emanuel deliberately picked pro-gun candidates to run for the House in 2006. Some liberals still seem inclined to cut the Gang of Feckless Four a lot of slack. But here is Daley turning the frame on its head—instead of making excuses for Heitkamp et al, he praised the Democrats running for reelection in tough states who did for the legislation, Louisiana’s Mary Landrieu and North Carolina’s Kay Hagan. They, not Heitkamp and the other three no’s (Max Baucus, Mark Begich and Mark Pryor) will be getting his money from now on, he said.
On the Republican side, the accountability will be left up to the voters in swing states like New Hampshire or Ohio, where Rob Portman also voted against the legislation (after letting it be known that he couldn’t cross party lines on guns after having already done so on gay marriage). It is not at all hard to envision a Democrat running against Kelly Ayotte on a law-and-order-line—here she was, a former attorney general, voting to leave a huge loophole in our system for making sure that felons are unable to purchase guns.
Of course, it won’t be easy. Ayotte, for one, is not even up for reelection until 2016, allowing plenty of time for the memory of her vote to recede in voters’ minds. As political scientists note, the unique circumstances of the gun debate still plays to the advantage of the NRA. But as my colleague Nate Cohn argues, the NRA’s sway has been overstated for some time now—the fact is, not a few senators have managed to survive in purple or red states despite consistently voting against the gun lobby. Last week’s setback was a sign that some senators were not yet willing to embrace that reality, and by doing so, they of course further enshrined facile assumptions of NRA prowess.
But their votes do seem to have produced a visceral reaction unlike any we’ve seen for some time on this front. And rightly so. It would take a jaded soul indeed to feel nothing on reading, say, of the scene Wednesday night in the Oval Office when some of the families who lost children in the Newtown massacre learned that 45 senators had not seen it in them to vote for even the most measured, limited reform: “Mr. Obama hugged the brother of one victim, Daniel Barden, who was 7, and told him to take care of his mother, who was sobbing quietly.”

“Once Again Senators”: Obama Prosecutes Terrorist Suspect And The “Little Generals” Complain Again
Sulaiman Abu Ghaith, Osama bin Laden’s son-in-law and an al Qaeda spokesperson, appeared in a New York courtroom this morning, and pleaded not guilty to plotting to kill Americans. It was his first court appearance after having been captured on Feb. 28 and flown to New York last week.
Of course, there apparently has to be a political angle to the proceedings, and as Adam Serwer noted, several congressional Republicans are “furious” at the Obama administration for “prosecuting an alleged terrorist.” And why might that be? Because the GOP officials disapprove of the use of the federal court system.
Several Senate Republicans are slamming the administration’s to move its latest terror suspect through the federal court system, bypassing the military tribunals in Guantanamo Bay, Cuba. […]
“Military detention for enemy combatants has been the rule, not the exception. By processing terrorists like [Ghaith] through civilian courts, the administration risks missing important opportunities to gather intelligence to prevent future attacks and save lives,” according to a joint statement by Sens. Kelly Ayotte (R-N.H.), Lindsey Graham (R.S.C.) and John McCain (R-Ariz.).
Do we really have to explain this to Congress again?
Look, we have a very capable system of federal courts, which have tried and convicted plenty of terrorists. We have also have a terrific system of federal penitentiaries, which have a record of never, ever allowing a convicted terrorist to escape.
On the other hand, we also have a system of military commissions, which tend to be an ineffective setting for trying suspected terrorists. It’s why every modern presidential administration has relied on civilian courts for these kinds of trials. It’s why the Pentagon, Justice Department, and intelligence agencies are unanimous in their support for trying accused terrorists in civilian courts. It’s why folks like David Petraeus and Colin Powell — retired generals McCain, Graham, and Ayotte tend to take seriously — agree with the Obama administration and endorse Article III trials.
So why must Republicans rely on stale, misleading talking points?

“Rage-Driven Fanaticism”: Deluded Republican Reformers
Conservative pundits and intellectuals have spent the past week or two—ever since the publication in Commentary magazine of Peter Wehner and Michael Gerson’s “How to Save the Republican Party”—talking about, well, how to save the Republican Party. They have lots of ideas—some good, some not so good, most very sober-minded policy prescriptions. I wrote a short blog post about this on Thursday. But then I reflected: This topic needs a longer treatment. The party they purport to support and care about has been engaged in burning down the house of American politics for three or four years now, and they are saying nothing about it; and until they say something about it, everything else they say is close to meaningless.
As I’ve written many times, the conventional view of what’s wrong with the GOP gets at only a portion of the truth. When The New York Times or Politico does such a story, the story inevitably focuses on policy positions. Immigration. Same-sex marriage. Climate change. Tinker with these positions, several sages are quoted as saying, and the GOP will be back in the game.
God knows, policy positions are a problem. But they are not the problem. The problem is that the party is fanatical—a machine of rage, hate, and resentment. People are free to scoff and pretend it isn’t so, but I don’t think honest people can deny that we’ve never seen anything like this in the modern history of our country. There’s a symbiosis of malevolence between the extreme parts of the GOP base and Washington lawmakers, and it is destroying the Republican Party. That’s fine with me, although I am constantly mystified as to why it’s all right with the people I’m talking about. But it’s also destroying the country and our democratic institutions and processes, which is not fine with me.
The party can change all the positions it wants, but until people stand up and yell “Stop!” to this fanaticism, it won’t mean anything. In fact, the problems feed into each other, because the idea that today’s Republican Party can change its stripes on same-sex marriage or immigration is absurd, and it is absurd precisely because of the rage and fanaticism I’m talking about, much of which is directed at brown people and gay people. Such a party cannot change its stripes on these issues until the mindset and world view are changed.
Immigration, you say? I’ll believe it when I see it. In fact, I’ll make a prediction now: I bet the House is likely to break immigration reform into two pieces, enforcement and path-to-citizenship. Maybe more, but for now let’s say two. A big majority of Republicans will support the former. The latter will pass, if it does, with a small number of Republicans joining nearly all Democrats, and therefore only with John Boehner breaking the Hastert Rule once again. And the haters will go on hating.
And the following people will write nothing about it: David Brooks; Ross Douthat; the aforementioned Wehner and Gerson; Reihan Salam; Yuval Levin; Ramesh Ponnuru. Now I know most of these gentlemen, and I like them. But they’ve been participants to varying degrees in these recent conversations I’m talking about, and frankly, they are wasting their own and their readers’ time. They’re like a family in deep denial at the Thanksgiving table. Guys, debating the best way to cook brussels sprouts is of marginal utility. Whether Cousin Ruthie wears her hair this way or that way is not worth dwelling on. The overwhelming fact at hand is that Uncle Ralph is drunk again, and he’s being a belligerent racist homophobic ass again, and he is preventing any civility and progress from taking place, and it’s been this way for four Thanksgivings in a row, and you are intentionally choosing to say nothing about it.
I do not understand how they can watch this and let it happen—to their party!—without saying anything. This past week, we have had four Republican senators—Ted Cruz, Lindsey Graham, Kelly Ayotte, and Rand Paul—in essence demand that a cabinet nominee, Chuck Hagel, disprove rumors against him. It’s one thing for Breitbart bloggers to do that. But senators? Using tactics that are straightforward McCarthyism? If one of the above named or some other prominent conservative pundit criticized that quartet, then good for them. But I sure didn’t see it, and I think I would have.
Like me, I’m sure many of you were aghast at those people who cheered John McCain when he lectured the parent of the son who was killed in the Colorado shooting. There was blood lust in that cheer, just like the blood lust in the boos back in the presidential primary season of that gay soldier. Are any conservative thinkers writing that this kind of thing makes them sick and ashamed?
We all know the problem. It’s Rush Limbaugh and his imitators and Roger Ailes and his network. They drive this hatred daily, and they intentionally misinform and lie; you think it’s an accident that polls always find Fox viewers the least connected to empirical reality? Pushing this fury and constructing this alternate reality is great for business. But it’s horrible for America. And the “serious” conservative pundits by and large try to pretend it doesn’t exist, or it’s not that bad, or MSNBC does the same thing in reverse. Well, it does exist, it is that bad, and no, MSNBC does not do the same thing in reverse. MSNBC has an agenda, but it doesn’t craft its messages in such a way as to make it viewers hate half the country.
This is the poison in our politics. Nothing changes until it changes. Somebody has to initiate it, and the people I named are the only people who can. Of conservative thinkers—and I apologize to him in advance for naming him, because I’m sure praise from me in this context will make him wince—only David Frum has addressed this problem. His 2011 New York magazine essay “When Did the GOP Lose Touch With Reality?” said it well. He understands that this problem is one of the central facts of our current historical moment.
If that were my party or movement, I promise you I would criticize it (and I did, in a book in 1996, as Brooks and others know). I sure wouldn’t be wearing blinders and pretending that my side could solve its problems with the right kind of EITC expansion. I’d be glowering at Uncle Ralph as he poured himself another, getting surlier and surlier, and I’d be scheming to take the bottle away.

“Shallow, Ignorant, And Totally Unserious”: Why Republicans Can No Longer Be Trusted on National Security
It’s been clear, at least since the 2012 election, that the Republican Party has abrogated its role—really, abandoned any interest—in shaping or seriously discussing American foreign policy. But only recently has this indifference shifted into toxic territory, and on Tuesday the fumes formed a poisonous cloud, the likes of which hadn’t been witnessed in decades.
The occasion was the Senate Armed Services Committee’s vote on Chuck Hagel’s nomination as secretary of defense. In the end, Hagel pulled through, but only on a party-line vote (all Democrats in favor, all Republicans opposed) and after a debate that raised doubts less about Hagel than about the modern GOP’s inclination—and the Senate’s ability—to oversee anything as consequential as national security.
Hagel’s Jan. 31 confirmation hearings had been appalling enough—not just for his own lackluster performance, but more for his inquisitors’ bizarrely narrow focus. They asked almost nothing about the issues that will face the next defense secretary: the budget, the roles and missions of the Army, the balance of drones vs. manned aircraft, the size of the Navy, the future of Afghanistan, or the “pivot” from Europe to Asia. Instead, they hectored the nominee about the adequacy of his fealty toward Israel, his animosity toward Iran, and whether he was right or wrong about the 2007 troop-surge in Iraq.
There was all that in the follow-up session on Feb. 12, plus a whiff of paranoia and sedition that’s rarely been cracked open since the days of Joseph McCarthy.
The stench started wafting through the air with the comments of Sen. David Vitter, Republican of Louisiana, who trumpeted the warnings that in 2008 Hagel gave a speech to the Arab-American Anti-Discrimination Committee. Vitter called for halting the hearings until a video of the speech could be found, to see whether the nominee had voiced extremist or anti-Israeli comments.
Then came Sen. Ted Cruz, freshman Republican from Texas, who seemed to be explicitly angling for McCarthy’s inheritance. Cruz shuddered that Hagel had made $200,000 over a two-year period from Corsair Capital, which has contracts abroad, yet he could not tell the committee whether any of that money came from a foreign government. It would be “relevant to know,” Cruz intoned, “if that $200,000 … came directly from Saudi Arabia, came directly from North Korea. I have no evidence to suggest that it is or isn’t,” but there should be an investigation.
At that point, Sen. Bill Nelson, Democrat of Florida, lambasted Cruz for having “impugned the patriotism” of Hagel, for accusing him of getting “cozy” with terrorists.
Now Cruz is but a freshman; his idiocies can’t be ascribed to his party as a whole. But Sen. James Inhofe of Oklahoma is the Armed Services Committee’s top-ranking Republican, and he not only sided with Cruz but snapped back at Nelson’s admonitions. Hagel’s nomination had been “endorsed” by the Iranian government, Inhofe said. “You can’t get any cozier than that.”
That was too much for Sen. Carl Levin, the usually amiable and tolerant committee chairman. “I have been endorsed by people I disagree with totally,” he said. “I don’t want people who hate me to ruin my career by endorsing me.”
Sen. Claire McCaskell went further, warning Inhofe and Cruz, in a “have you no shame, senator” moment, to “be careful” with their tactics of character-smear and guilt-by-association.
Even Sen. John McCain, the erstwhile Republican leader, seemed abashed by the storm he’d helped unleashed against the nominee a month before. “I just want to make it clear,” McCain said, “Sen. Hagel is an honorable man. He has served his country. And no one on this committee at any time should impugn his character or his integrity.” It was reminiscent of the time, on the 2008 campaign trail, when a woman, fired up by the gunplay rhetoric of his running mate Sarah Palin, started going on about the socialist Muslim Barack Obama—and McCain felt compelled to dial down the passion, defending his opponent as a good American. One wonders, does McCain lie awake at night, gnashing his teeth at the hash that he’s made of his own reputation and the noisome role he’s played in turning his country’s politics into a cesspool?
Still, McCain’s move to reticence had no effect on Inhofe, who clanged the alarm bells still louder. Hagel, he said, had voted against a bill labeling the Iranian Republican Guard Corps as a terrorist organization (because, by definition, it wasn’t). He’d voted against unilateral sanctions against Iran (because unilateral sanctions have no effect). He’d appeared on Al Jazeera TV and agreed with the show’s hosts that Israel had committed war crimes (the first part is true, the second part is not).
On the few occasions during the session when Republican senators explored substantive issues, it was soon clear they had no idea what they were talking about. Sen. Kelly Ayotte, a Republican from New Hampshire who has often stood alongside McCain and Sen. Lindsey Graham to bash President Obama on Benghazi, tried to make much of Hagel’s co-authorship of a 2012 report by an ad hoc group called the U.S. Global Zero Nuclear Policy Commission. Ayotte expressed shock that, in the wake of North Korea’s third nuclear test, Hagel had not removed his name from this report, which called for eliminating one leg of our nuclear triad. “We have three legs to our nuclear triad,” she said (yes, senator, that’s why it’s called a “triad”), as if it were some nuclear holy trinity.
Ayotte too is new; she seems not to know what a nuclear triad is. She certainly isn’t aware that, even among conservative thinkers in the nuclear-weapons realm, the idea of scrapping one leg of the triad—namely, land-based intercontinental ballistic missiles—is at least a respectable notion. The argument is that ICBMs are vulnerable to nuclear attack and, at the same time, tipped with multiple, highly accurate warheads that make an opponent’s ICBMs vulnerable to attack. In other words, by their very existence, ICBMs create an incentive for both sides to launch a pre-emptive attack in the event of a crisis.
But Ayotte’s remarks were seconded by Sen. Jeff Sessions, who does know something about nukes yet seems trapped in 1982. Hagel, he charged, “comes out of the anti-nuclear left,” as if, first of all, there is such a thing these days. It’s worth noting who wrote that Global Zero report along with Hagel: Thomas Pickering, a veteran U.S. diplomat and former ambassador to Moscow; Richard Burt, a State Department negotiator in the Reagan administration; retired Gen. John Sheehan, former commander-in-chief of U.S. Atlantic Command; and—not least—retired Gen. James Cartwright, former vice chairman of the Joint Chiefs of Staff and, before that, head of U.S. Strategic Command, which manages the nuclear arsenal. Hardly a pack of lefties.
Not to sound like a Golden Age nostalgic, but there once was a time when the members of the Senate Armed Services Committee prided themselves on having an understanding of military matters. They disagreed in their conclusions and sometimes their premises. But most of them worked to educate themselves, at least to the point where they could debate the issues, or ask questions of a general without coming off like complete idiots. The sad thing about this new crop of senators—especially on the Republican side—is they don’t even try to learn anything; they don’t care if they look like complete idiots, in part because their core constituents don’t care if they do either.
After Tuesday’s vote, Sen. Levin adjourned the session, saying, “We thank you all, and we look forward to another wonderful year together.” The other senators laughed, but it really wasn’t funny.

“Torture Queen”: Kelly Ayotte Did Something For Us All To Be Proud
So who is Kelly Ayotte anyway, to be threatening to place an unprecedented (in modern times) hold on a secretary of state nominee? She hasn’t done much yet in the Senate, but the one thing she did really try to do was to pass an amendment that could have permitted the United States to torture suspects again.
This all unfolded in late 2011, and the amendment didn’t become law. But it’s instructive anyway. After Obama limited interrogation techniques to those found in the Army Field Manual, some on the right started barking about how since the field manual is available online, terror suspects would know what they might be subjected to, and somehow of course this added up to appeasement and so forth. Adam Serwer reported at the time for Mother Jones:
“When a member of Al Qaeda or a similar associated terrorist group, I want them to be terrified about what’s going to happen to them in American custody,” said Senator Joe Lieberman (I-Conn.), explaining his support for the amendment. “I want them not to know what’s going to happen, I want that the terror that they inflict on others to be felt by them as a result of the uncertainty that they can look on the Internet and know exactly what our interrogators are limited to.” In an exchange with Senator Lindsey Graham (R-S.C.), Ayotte acknowledged that part of her goal was to reauthorize some Bush-era “enhanced interrogation techniques” other than waterboarding.
Great. Something for us all to be proud of. No wonder she picked up where Lieberman left off. Quite a “worthy” successor to him as the third amigo.
She also became known, while her name was briefly on some short lists to be Mitt Romney’s veep choice, for parrotting the “apology tour” lie. PolitiFact destroyed her in this post over the summer. Demagogic nonsense, which American voters handily rejected.
I want to emphasize again what a new low in partisan warfare it would be to place a hold on a secretary of state nominee. If there’s one cabinet post that just has to be filled, it’s that one. State was the first cabinet agency created by Congress, meaning that the secretary of state is the oldest cabinet position, and to most people it’s the most venerated and important post of all of them (Treasury logs a few votes).
For one senator, especially a relatively junior one, to deny a reelected president his choice to head State would be rather amazing. I see that some on the right are calling such a potential move payback for what the Democrats did to John Bolton. Not an insane point, but three responses to that.
One: The UN ambassador (which Bush nominated Bolton to) ain’t the secretary of state by a longsihot. Two: Bolton had a particularly incendiary history of attacking the UN, the very body before which Bush wanted him to represent our country (which he ultimately did, as a recess appointee).
Remember this quote?: “The Secretariat building in New York has 38 stories. If it lost ten stories, it wouldn’t make a bit of difference.” I know all our wingers will say that’s true, but wingers, imagine a Democrat nominating to head the Pentagon someone who said the building could lose the E ring and it wouldn’t make a bit of difference.
Third: Opposition to Bolton was hardly limited to liberal senators. Fifty-nine former diplomats from both parties signed a letter urging Bush not to name Bolton. The day Rice faces that kind of opposition, then the two cases will be parallel. Until then, not so much.
