“The Moment Of Truth”: The GOP Must Admit It Was Wrong On Obamacare
Is there any accountability in American politics for being completely wrong? Is there any cost to those who say things that turn out not to be true and then, when their fabrications or false predictions are exposed, calmly move on to concocting new claims as if they had never made the old ones?
The fact that the Affordable Care Act (ACA) hit its original goal this week of signing up more than 7 million people through its insurance exchanges ought to be a moment of truth — literally as well as figuratively. It ought to give everyone, particularly members of the news media, pause over how reckless the opponents of change have been in making instant judgments and outlandish charges.
When the health-care Web site went haywire last fall, conservatives were absolutely certain this technological failure meant that the entire reform effort was doomed. If you doubt this, try a Google search keyed to that period relating the word “doomed” to the health-care law.
It should be said that the general public was much wiser. A CNN poll in November that Post blogger Greg Sargent highlighted at the time found a majority (54 percent to 45 percent) saying that the problems facing the law “will eventually be solved.” Political moderates took this view by 55 percent to 43 percent, independents by 50 percent to 48 percent. Only Republicans — by a whopping 72 percent to 27 percent — and conservatives (by 66 percent to 33 percent) thought the law could never be fixed.
Their representatives in Washington, moderate conservatives as well as the tea party’s loyalists, followed the base’s lead. In mid-November, for example, Sen. Rob Portman (R-Ohio) told Fox News flatly that the law is “destined to fail,” “fundamentally flawed” and “not ready for prime time.” House Speaker John Boehner predicted dire outcomes before the Web site fiasco. He repeatedly insisted, as he did in July, that “even the Obama administration knows the ‘train wreck’ will only get worse.”
This attitude affected more neutral observers. Forbes magazine posted a piece on Nov. 22 under the headline: “What to do if and when Obamacare collapses.” The op-ed modestly acknowledged that “it’s too soon to write an epitaph for Obamacare,” but then barged forward, since “its crises are piling up so fast that one has to begin looking ahead.”
At this point, the etiquette of commentary typically requires a “to be sure” paragraph, as in: To be sure, the law could still face other problems, blah, blah, blah. But such paragraphs are timid and often insincere hedges. After all, every successful program, even well-established ones such as Medicare, Social Security and food stamps, confronts ongoing challenges.
So let’s say it out loud: The ACA is doing exactly what its supporters said it would do. It is getting health insurance to millions who didn’t have it before. (The Los Angeles Times pegged the number at 9.5 million at the beginning of the week.) And it’s working especially well in places such as Kentucky, where state officials threw themselves fully and competently behind the cause of signing up the uninsured. Those who want to repeal the law will have to admit that they are willing to deprive these people, or some large percentage of them, of insurance.
Too many conservatives would prefer not to say upfront what they really believe: They don’t want the federal government to spend the significant sums of money needed to get everyone covered. Admitting this can sound cruel, so they insist that their objections are to the ACA’s alleged unworkability, or to “a Washington takeover of the health system” (which makes you wonder what they think of Medicare, a far more centralized program). Or they peddle isolated horror stories that the fact-checkers usually discover are untrue or misleading.
Thus the moment of truth, about the facts and about our purposes.
From now on, will there be more healthy skepticism about conservative claims against the ACA? Given how many times the law’s enemies have said the sky was falling when it wasn’t, will there be tougher interrogation of their next round of apocalyptic predictions? Will their so-called alternatives be analyzed closely to see how many now-insured people would actually lose coverage under the “replacement” plans?
Perhaps more importantly, will we finally be honest about the real argument here: Do we or do we not want to put in the effort and money it takes to guarantee all Americans health insurance? If we do — and we should — let’s get on with doing it the best way we can.

“Authored By Reagan”: It’s Worse Than Paul Ryan, The Right Has A New Ugly, Racial Dog Whistle
While attention focuses on Paul Ryan’s remarks about inner city culture, another dog-whistle theme continues its slow roil: food stamp abuse. More even than Ryan’s twisting narrative, the brouhaha around food stamps helps make clear that conservatives seek to conjure a much bigger bogeyman than “lazy” minorities.
Ostensibly worried that too many people prefer welfare to work, House Republicans this January stripped $8.6 billion from the food stamp program. This threatened to reduce monthly food assistance by an average of $90 per family — from households that are barely hanging on, with average gross monthly incomes of just $744. Yet far from conceding defeat, states are joining battle by adjusting their programs in ways that evade the cuts, bringing the food stamp debate back.
Just last week, House Speaker John Boehner warned that “states have found ways to cheat, once again, on signing up people for food stamps,” and he implored his colleagues “to stop this cheating and this fraud from continuing.” Cheating and fraud constitute stock themes in the conservative assault on food stamps — tropes applied indiscriminately to both recipients and government. And therein lies a clue to the real target.
To see the actual agenda clearly, though, it helps to reach back to Ronald Reagan, for he perfected today’s conservative assault on food stamps.
Reagan frequently stumped by sympathizing with the anger of voters waiting in line to buy hamburger, while some young fellow ahead of them used food stamps to buy a T-bone steak. With this tale, Reagan invoked the stereotype of the welfare recipient who abuses government benefits to live in luxury (Reagan’s other version: welfare queens).
The comedian Jon Stewart recently compiled a montage of contemporary conservative talking heads spinning just these sorts of yarns about food stamps. It would have been funnier if people weren’t actually being pushed into hunger.
Going to the racial dimensions of these hackneyed fictions, when Reagan initially told the T-bone steak story, he identified the food stamp abuser as a young “buck,” a term then commonly used among Southern whites to refer to a strong black man. This veered dangerously toward open racism, and in any event proved unnecessary. Even after Reagan dropped that term from future renditions, the racial element continued just below the surface, with welfare recipients implicitly colored black.
But this was not a simple plot to demonize minorities. Rather, Reagan had another scapegoat in mind, and here we come to the heart of dog-whistle politics. Ostensibly, even more than grasping minorities, the greatest enemy of the middle class was liberal government. After all, it was government that was reaching into taxpayer’s pockets and wasting their hard-earned dollars.
By “darkening” government itself, Reagan provided the kindling for a taxpayer revolt that ostensibly would cut off funds to the lazy and irresponsible — but that in fact generated enormous windfalls for the very rich. In the 1980s, by one estimate, the top 1 percent of Americans reaped tax cuts worth a trillion dollars, and they’ve received a further trillion dollars from the Reagan tax cuts in each ensuing decade.
Tax cuts for the very rich were just the beginning. By trashing safety-net programs as massive giveaways to undeserving minorities and thereby engendering a general hostility toward government, the right has systematically attacked New Deal programs across multiple domains — from education and housing to marketplace and workplace regulation — undoing in area after area the policies that once promoted an equitable distribution of wealth.
Perhaps to understand the full devastation wrought by modern racial politics, we should bring forward another figure from the shadowed background of the T-bone steak story: the cashier. In the 1970s, she was more likely to be unionized and relatively well-paid, with good benefits. Today, whether white or black or some other race, she is likely working without union protection for a minimum wage whose value has sharply fallen and that cannot sustain a small family above poverty. Indeed, like many Wal-Mart employees, it’s the cashier who today is on food stamps.
When House Republicans war against food assistance, just as when Ryan tilts at government poverty programs that don’t work because of a tailspin of culture in our inner cities, their real target is progressive government. Yes, race-baiting superficially aims at minorities and hits nonwhite communities hard, including the 24 percent of food stamp recipients who are black. But just as cuts to food aid also afflict the 38 percent of program participants who are white, dog-whistle politics savages Americans of every race.
And it devastates every class, too, for this sort of racial politics doesn’t just slam the poor, it imperils all who are better off when government protects the broad middle rather than serves society’s sultans. When conservatives blow that dog whistle, government is the target, and you’re a likely victim.

“What States’ Rights?”: House GOP Fights For Food-Stamp Cuts
Ordinarily, when conservative policymakers complain about “fraud” and “cheating” in federal programs intended to help poor people eat food, they’re referring to individuals accused of abusing the system unfairly. But over the last few days, congressional Republicans are using familiar rhetoric in an unfamiliar way.
Republican leaders are threatening to take congressional action to stop state governors from flouting the food stamp cuts contained in the 2014 farm bill.
The governors of at least six states – New York, Connecticut, Rhode Island, Pennsylvania, Montana and Oregon – have now taken measures to protect more than a combined $800 million in annual Supplemental Nutrition Assistance Program benefits, and more states are expected to follow suit. Their actions threaten – over time – to wipe out the more than $8 billion in cuts over 10 years to the food stamp program that were just passed by Congress as part of the 2014 farm bill.
But those who initially supported the food stamp cuts are warning that retaliatory actions may be coming.
As a policy matter, the underlying change is a little tricky. Republicans successfully cut food aid to the poor – though not nearly as much as they’d hoped – which mostly affected 17 states that participate in the “Heat and Eat” program, which connects federal LIHEAP (Low-Income Home Energy Assistance Program) assistance with SNAP (Supplemental Nutrition Assistance Program).
At last count, six of the affected governors – five Democrats and one Republican – have decided to start fiddling with the books, moving money around so low-income constituents won’t lose their food benefits. Other governors appear eager to do the same.
And this has apparently outraged Republicans on Capitol Hill. House Speaker John Boehner (R-Ohio) told reporters late last week that he wants Congress to “try to stop this cheating and this fraud from continuing.” Rep. Frank Lucas (R-Okla.), who helped write the relevant legislation, wants a full congressional investigation and new measures intended to guarantee food-stamp cuts.
Remember, the “cheating” and “fraud” is in reference to state officials trying to help low-income residents access food.
For its part, the Obama administration seems a lot less concerned than Congress.
Rep. Kevin Yoder (R-Kan.) expressed anger Friday over the possibility that none of the cuts to the SNAP program would be realized and asked USDA Secretary Tom Vilsack during an appropriations hearing whether he had any inside knowledge that states would nullify the benefit reductions.
Vilsack said he didn’t know or suspect what the states would do, but defended their right to take action.
“Frankly, as a former governor and former state senator, I respect the role of governors and legislatures to make decisions that they think are in their state’s best interests,” Vilsack said.
GOP lawmakers found this unsatisfying. Expect to hear quite a bit more about this in the coming weeks.

“The GOP Is Trying To Repeal The 20th Century”: The Right’s Crusade Against Overtime Pay, Why They Despise Worker Rights
Silly me: President Obama’s executive order to expand opportunities for overtime pay Thursday seemed like a win-win. Currently, if you make more than $23,000, you can’t necessarily receive overtime; the president’s order would raise that cap, and also make it harder for employers to classify people with almost no supervisory duties as “supervisors” and thus exempt.
Where’s the downside? Newly qualified workers currently being forced to work overtime without pay will now get higher wages. Or, if their employer doesn’t want to spring for the overtime pay (traditionally time and a half), they will have to expand their workforce to get the work done. Higher wages and/or more jobs: Sounds good, right?
Not to Republicans, of course. The backlash to the president’s overtime-pay expansion just makes clear what we’ve known for a long time: They oppose every attempt by government to reward hard work and protect the rights of workers – unless it applies to the very wealthy.
Speaker John Boehner sounded unusually befuddled opposing Obama’s move. “If you don’t have a job, you don’t qualify for overtime. So what do you get out of it? You get nothing,” he told the Washington Post. “The president’s policies are making it difficult for employers to expand employment. And until the president’s policies get out of the way, employers are going to continue to sit on their hands.”
The president’s policies are in fact making it harder for employers to exploit their workers. That’s all. As Jared Bernstein told the New York Times. “I think a potential side effect is that you may see more hiring in order to avoid overtime costs, which would be an awfully good thing right about now.”
Or you’ll see higher wages, which would also be an awfully good thing. One of the major causes of rising income inequality is that back in the 1970s, rising productivity suddenly became detached from rising wages. For decades — since the labor-rights reforms and social welfare advances of the ’30s and ’40s — the two lines climbed in tandem, with higher productivity translating into higher paychecks. The two came apart, in what’s become known as “the great divergence,” at the same time as income inequality began to climb. There are many reasons for the productivity-wage split, including a stagnant minimum wage, declining union membership, and weaker labor rights overall – including less compensated overtime.
Republicans no longer accept that it was government intervention in the economy, first in the Progressive era and then, more forcefully, after the Great Depression, that created the greatest economic boom and the biggest middle class in history. The 40-hour work week. The weekend. Vacations. Child labor laws. The minimum wage. Social Security. Health and safety protection. All of these represented government intervention on the side of working people, to balance the playing field with exploitive employers, and to carve out a realm of family and personal life that could be protected from ceaseless labor. Progressive public policy essentially created childhood, as a time when kids who weren’t wealthy might be educated and protected from labor abuse.
These became bipartisan values, with some debating around the margins, through Richard Nixon’s administration. But then a pro-business backlash put all of those gains back on the table. Republicans are now trying to repeal the 20th century.
“The federal government, in particular, shouldn’t be involved in labor markets in any way, shape or form,” says Jeffrey Miron, economic studies director at the Cato Institute. Cato is a libertarian think tank, but Miron’s once-radical point of view is now the GOP mainstream.
We’ve seen Republicans, like friend-of-the-poor Paul Ryan, fiercely oppose even modest increases in the minimum wage – even though earlier hikes always had a decent amount of bipartisan support. In fact, more Republicans today are openly insisting there shouldn’t even be a minimum wage, from formerly sensible Tennessee Sen. Lamar Alexander to Texas Gov. Rick Perry and his home state ally Rep. Joe Barton. GOP Senate candidates in North Carolina and Iowa have made abolishing the minimum wage a pillar of their campaigns.
We already know Republicans hate unions, whether public or private sector. One of the hottest CPAC sessions last week focused on “the Wisconsin model” of public sector union busting, but we also saw how hard GOP elected officials in Tennessee fought a union drive among Volkswagen workers there.
Some on the right have even clamored to bring back child labor. Newt Gingrich suggested poor kids should work as janitors to earn their school lunches, in order to fight the “culture” of poverty. (Like Paul Ryan, he doesn’t seem to see that food is the best answer for hunger.) Utah’s Tea Party Sen. Mike Lee has declared federal child labor laws “unconstitutional,” while up in Maine, wingnut Gov. Paul LePage would like to lower the legal working age from 16 to 12.
I’ve never understood why Republicans believe rich people need more money to ensure they’ll work harder, but the non-rich don’t deserve such incentives. From skyrocketing CEO pay to lower tax rates, the GOP defends putting more money in the hands of rich folks as a good thing. Giving more money to working people, by contrast, only encourages slackers and moochers. The president can’t wait for Republicans to join the 21st century while they’re busy repealing the 20th. He’s right to do whatever he can to boost workers’ wages on his own.

“An Inconvenient Constitution”: Fighting Obama On Immigration Is Not Enough, GOP Wants To Sue Him Too
The House Republican caucus wants to sue President Barack Obama.
They say he isn’t living up to his constitutional obligations on a range of issues—and in particular, that he’s not faithfully executing immigration laws. They cite his Deferred Action for Childhood Arrivals policy, put into place by executive order in 2012, which halted deportations of people who were brought to this country as children—the so-called “dreamers.” There are roughly 1.1 million of them, according to the best estimates.
To gut that measure, along with parts of the Affordable Care Act and a grab bag of other administration policies, House Republicans crafted and passed what they are calling the “ENFORCE the Law” Act. It would create what amounts to a legal shortcut. House members could file a lawsuit against the president, and it would go directly to three-judge panel of a federal district court—and from there, could be appealed straight to the Supreme Court.
The measure is unlikely to become law, since Senate leaders have declared it dead on arrival. Even if they hadn’t, it might not survive a court challenge: Experts say it openly tampers with the constitution.
Still, the vote for ENFORCE is a statement, and one that directly violates the immigration principles Republicans outlined in January. At the time, the leadership professed support for a pathway to “legal residence and citizenship for those who were brought to this country as children through no fault of their own, those who know no other place as home.” But that was nearly two months ago—and ENFORCE represents the House’s first vote of the year on immigration.
It makes the vote Democrats have been demanding, on the reform bill that passed the Senate last year, seem a lot less likely. (And it’s not like prospects were good in the first place.) “It doesn’t require much to look at what House Republicans are doing today and question whether or not they’re serious about moving forward on comprehensive immigration reform,” White House press secretary Jay Carney said Wednesday. That’s a departure from statements that both the president and House Speaker John Boehner have made this winter, insisting legislative reform still stands a chance. Last month, Carney called a meeting about immigration between the two men “constructive”; Boehner called it “healthy.”
Republicans may have been trying to underscore a message with the vote: that Obama should not even consider addressing deportations with executive authority, as he did with DACA, and as immigrant-rights groups are demanding he do again. “If he stopped deporting people who are clearly here illegally, then I think any chance of immigration reform is dead,” Senator Lindsey Graham warned in February. But as the prospects for immigration reform dim, Obama may wonder why he’s waiting for the House to meet him partway.
