“It Isn’t About The Substance At All”: Why Republicans Are So Mad About Obama’s Immigration Order
President Obama is going to detail some executive actions he plans to take on immigration in a speech tonight, and you may have noticed that the debate over this move is almost completely void of discussion of the particulars. Instead, we’re discussing whether Obama is exceeding his powers. That’s an important question to address, but it also frees Republicans (for the moment anyway) of having to visibly argue for things like deporting the parents of kids who are already allowed to stay in the United States.
One thing you’ll notice as you watch coverage of the issue is that Republicans are seriously pissed off at Obama. And not in the faux outrage, pretend umbrage way—they are genuinely, sincerely angry. And while there may be a few here or there whose blood boils at the thought of an undocumented immigrant parent not living in constant terror of immigration authorities, for the vast majority it isn’t about the substance at all. So what is it about? Here’s my attempt at explaining it.
Obama is not showing sufficient deference to their midterm election win. Republicans just won an election, and like any party that wins an election, they feel that the American people validated all of their positions and everything they’d like to do, and rejected those of Democrats. There are reasonable arguments to be made against this belief. For instance, you could point out that since turnout in this election was an abysmal 36 percent and Republicans got a little over 50 percent of the votes for the House, they actually got a thumbs-up from only 19 percent of the electorate, which isn’t exactly “the American people.” Or you could note that if you add up the votes received by all 100 senators in the new GOP majority, the Democrats actually got 5 million more votes. These things may be true, but they don’t reduce the Republicans’ sincere belief that they have the people behind them. Whether they actually expected Obama to put aside his entire agenda because of the election, the fact that he shows no interest in doing so is obviously maddening to them.
Obama is backing them into a political corner. Republicans would frankly prefer not to have to talk about immigration at all, outside election-year pitches to primary voters about broken borders. Their fundamental dilemma is that on the local level, most of them have constituencies that are deeply hostile to immigrants and opposed to comprehensive reform, yet on the national level, the party must make inroads with Hispanic voters to have hopes of winning the White House. A big confrontation over immigration puts their crazy nativists like Steve King on the news and serves to convince those Hispanic voters that the GOP has nothing but contempt for them and people like them. Those crazy people are convinced that a big part of the motivation for Obama’s move is to create new Democratic voters (which it wouldn’t do), while the more sensible ones worry that it will make their task of winning Hispanic votes even harder (which it will do).
This move also seizes the agenda from them, in a way that divides Republicans against themselves. As Lisa Mascaro and Michael Memoli reported in an excellent article in today’s L.A. Times, “Republican leaders who had hoped to focus on corporate tax reform, fast-track trade pacts, repealing the president’s healthcare law and loosening environmental restrictions on coal are instead being dragged into an immigration skirmish that they’ve tried studiously to avoid for most of the last year.”
The only real way for them to stop him is to shut down the government, and they’re also probably mad that he has forced them into that internal and external debate. Not only are they now arguing amongst themselves about it (again), it means they have to put up with a lot of “Are you going to shut down the government?” questions from reporters, which have as their subtext, “Are you going to prove all over again what a bunch of reckless maniacs you are?” Their attempts to argue that if there’s a shutdown it will be Obama’s fault and not theirs will inevitably be rejected by both the press and the public, leading to even more resentment, since they feel as though they’ll be blamed for something that is his fault.
Aggressive Obama is bad Obama. Let’s face it, many if not most Republicans have never considered Barack Obama a legitimate president. This applies not just to Republican voters—49 percent of whom believed that ACORN stole the 2012 election for him, which would have been particularly difficult for the organization to accomplish given that it ceased to exist in 2010—but to its elected officials as well. Although it has calmed down of late, let’s not forget just how many years Obama spent trying to persuade people that he is, in fact, an American, including producing his birth certificate. Republicans have in the past viewed any Democratic president as having suspect legitimacy, but it’s been worse with Obama than prior presidents.
For that reason, Republicans have found even the most mundane exercise of his presidential power to be deeply disturbing. His bold move of hiring people to work on the White House staff was met with horrified cries that he had created “czars” who were wielding despotic and unaccountable power. When he set rules for federal contractors, as every president does, they were aghast. These kinds of things didn’t bother them when Republican presidents did them not only because they agreed with the substance of whatever those presidents were doing, but also because they regarded those presidents’ power as legitimately held. Over time, the narrative of Obama’s “lawlessness” took hold on the right, and ended up being applied to almost any executive branch action they didn’t like. In this case, he actually is approaching the limits of his authority, which makes it all the worse.
Obama is making them feel impotent. This is where all the other pieces come together. Being in the opposition party can be frustrating, because your role is fundamentally not to do things, but to try to stop the president from doing things. That’s an important task, but it isn’t quite as satisfying as remaking the country to suit your vision. Republicans’ greatest fear about this is that Obama will go ahead and do what he wants and they won’t be able to stop him, even though they worked so hard to gain full control of Congress after six long years. They won the election, his approval ratings are low, they firmly believe they’re right, and yet this president they loathe so much is about to just walk all over them anyway. No wonder they’re mad.

“Less Than American”: It Is In The Public Interest To Have People Assimilated And Participating Stakeholders In Our Democracy
Not so long ago, it seemed the debate over immigration reform was all about borders. Politicians competed to offer the most draconian solutions — higher fences, longer fences, electrified fences, armies of guards, fleets of drones, moats and crocodiles. Never mind that the Border Patrol had already more than doubled in a decade. Never mind that many of those here illegally never hopped a fence but simply overstayed a student or tourist visa. The nativist mythology has us under siege from relentless hordes striding toward Arizona on, in the fevered imagination of Tea Party Congressman Steve King, “calves the size of cantaloupes because they’re hauling 75 pounds of marijuana across the desert.” To pacify the border neurotics, authors of the bill that passed the Senate last summer included $46.3 billion to militarize our southern flank.
Now, with the bill stranded in the House, it seems the immigration debate is all about citizenship. To opponents, the idea of offering 11-plus million undocumented immigrants a pathway to citizenship — even a 13-year slog like the one envisioned by the Senate bill — is anathema, so politically toxic that the measure’s most prominent Republican sponsor, Senator Marco Rubio, pulled back as if he’d put his hand on a lit stove. To proponents of comprehensive reform, or at least to activists on the issue, citizenship is the prize, and nonnegotiable.
It’s beginning to look as if advocates of fixing our broken immigration system will face an unpleasant choice: no bill at all, or a bill that legalizes the foreigners who are already here but does not offer most of them a chance to become citizens. On Capitol Hill several lawmakers are quietly drafting compromises that give the undocumented millions little hope of full membership in America.
The first thing to note is that this is progress. The Republican mainstream view has moved in the last year or so, from Mitt Romney’s “self-deportation” to something considerably less callous. Most Republicans in Congress now say they can live with legalizing the undocumented as long as (a) we don’t call it amnesty and (b) we don’t reward lawbreakers by bestowing the precious gift of citizenship.
The second point that needs making — and my Times colleague Julia Preston made it last week — is that while citizenship is the priority for pro-immigration activists, to immigrants living here as a fearful underclass the aim is not so clear cut. For many of them, the priority is to be made legal, to come out of hiding and live their lives without the threat of deportation, without the risk of exploitation by unscrupulous employers, without wondering whether your spouse will make it home at night.
“The entire narrative behind comprehensive immigration reform has elevated the path to citizenship as this must-have component of an acceptable bill,” said Oscar Chacon, executive director of the National Alliance of Latin American and Caribbean Communities, a network of immigrant organizations that includes many foreigners here without visas. “What you hear from the undocumented is: ‘We like the idea of citizenship, but what really hurts us is that we are vulnerable, that I can’t easily get a job to feed my family, that I can’t drive a car without being at risk, that I want to be able to visit relatives back home and come back safely.”
Just to be clear, I believe (and so does Oscar Chacon) that deliberately creating a class of disenfranchised residents goes against the American grain. There are few precedents for consigning whole categories of people to a sub-citizen limbo, and they are not proud moments in our history. (See the Fugitive Slave Act of 1793 and the Chinese Exclusion Act of 1882.) It is clearly in the public interest to have people become assimilated, taxpaying, participating stakeholders in our democracy. Most Americans polled, including a majority of Republicans, agree that those now in the country illegally should be allowed to eventually apply for citizenship.
If House Speaker John Boehner is willing to brave the fury of his extreme flank and put the matter to a vote, a path to citizenship stands a decent chance of passing the House with a majority of Democrats and a minority of Republicans. You might even think Republicans would want to get immigration settled and off the table so they could begin wooing Hispanic voters on more favorable ground — social issues, taxes, education. But among the people most immersed in this issue, I can’t find many who expect Boehner to suddenly become a statesman and defy his fanatics. In part, let’s be honest, that’s because the Republican stance is, “We protect America from Obama.” It is also in part because they fear newly enfranchised Hispanics will become Democrats — which the Republicans, by opposing citizenship, make a self-fulfilling prophecy.
So it may well be that supporters of immigration reform have to choose between half a loaf and none at all. Half a loaf might include a prospect of citizenship for some undocumented immigrants — the so-called Dreamers, who entered the country as children, and those in the military — but not the majority. If that’s the option, should Democrats swallow hard and take it?
Yes, and here’s why.
First, even without a prospect of citizenship, legalization would make the undocumented much safer from the family-wrecking heartbreak of deportation, which has continued at record numbers under President Obama. It would free them to press for better education for their children, to approach the police when they are victims of crime, to challenge abusive employers, to seek medical care without fear of exposure. Some advocates of citizenship-or-nothing suggest that the president should simply use his prosecutorial discretion to stop deportations altogether, as he has done for the Dreamers and undocumented soldiers. But the public would view that as a grievous abuse of power, and Congress might very well take away his authority. An executive order is no substitute for a protection enshrined in the law.
Second, the legislation has other good things going for it. It puts a little sense into our archaic legal immigration system, and establishes some meaningful protection against future illegal immigration (like holding employers rigorously accountable for assuring their workers have legal status, much more important than fortifying the border.)
Third, this is not the end of the story. We elect a new Congress in 2014, and another in 2016, and so on, and the electoral clout of Hispanics will continue to grow. “I’m a firm believer in the notion of incremental change,” Chacon told me. “The best public policies — look at gay rights — have evolved, they didn’t happen all at once.”
And fourth, even if many undocumented workers never make it to citizenship, the injustice will last for just one generation. Their children are citizens by birth. Young Latinos are reaching voting age at the rate of about 50,000 per month. I suspect many in that rising generation will remember, and punish, the politicians who decided their parents should remain less than American.

“The GOP Is Driving In Circles”: Like Past Outreach Efforts, “Burning Glass” Is Doomed To Failure
Just days after Republican Ken Cuccinelli discovered that running as the transvaginal ultrasound candidate may have been a mistake in increasingly blue Virginia, three Republican women are launching a new effort to solve the GOP’s serious problem with female voters.
The Republican Party’s outreach to women — to the degree that it reaches out at all — has clearly not been working. Poll after poll shows that women favor the Democratic Party over the Republicans, and recent elections have confirmed it. President Obama topped Mitt Romney by 9 percent among women in 2012, and Terry McAuliffe beat Cuccinelli by an identical amount in Virginia in 2013. Among unmarried women, the gender gap is even more severe.
As Jonathan Martin reports in the New York Times, Republican consultants Katie Packer Gage, Ashley O’Connor and Christine Matthews hope to reverse the trend by launching a group called Burning Glass Consulting.
“We want to get smarter about how we communicate the Republican message specifically to women,” Gage told the Times. “Certainly there are challenges with other demographic groups, but women represent 53 percent of the electorate.”
According to the report, “The three strategists will undertake public opinion research, TV ads and general consulting for Republican candidates about how to better reach that majority.”
If this sounds familiar, it’s because the Republican Party has been down this road before. Just eight months ago, the Republican National Committee itself declared its intention to “stop talking to itself,” and improve outreach to minorities, the working class, and the same women that Burning Glass intends to target today.
“Instead of driving around in circles on an ideological cul-de-sac, we need a party whose brand of conservatism invites and inspires new people to visit us,” the Republican consultants who wrote the report optimistically suggested.
The suggestion didn’t take. On the contrary, Republicans have managed to move even further out of the mainstream — at a grave cost to their already tattered reputation.
Ultimately, Burning Glass Consultants will encounter the same problem the RNC did. Sure, a more moderate tone couldn’t hurt the Republican Party’s efforts to win over women — it may even help them on the margins. But there is no message fix that could paper over the fact that elected Republicans are devoting their efforts to shuttering women’s health clinics, restricting access to contraception, and trashing the Affordable Care Act’s maternity coverage, among a long, long list of other policies that are genuinely hostile to women.
Yes, the Republican Party would benefit if far-right candidates like Richard Mourdock would stop telling women that they can’t undergo an abortion after being raped, because “God intended” for them to be attacked. But the GOP would be even better off if that wasn’t the party’s official platform.
Burning Glass’ effort to attract female voters is surely well intentioned. But as Republicans are finding out in their unsuccessful push to attract Hispanic voters, actions speak louder than words.

“The President’s Pivot”: The Tactical Move To Immigration Reform Is Brilliant, And Republicans Know It
“Thus it is that in war the victorious strategist only seeks battle after the victory has been won, whereas he who is destined to defeat first fights and afterwards looks for victory.”
That quote, from Sun Tzu’s ancient Chinese treatise “The Art of War,” perfectly captures President Obama’s strategic victory over Tea Party members of Congress on the government shutdown and the debt ceiling debate. It also explains his immediate pivot to another topic that Tea Partyers hate and over which their obstinacy is likely to get the party hammered again: comprehensive immigration reform.
This is a brilliant tactical move on the president’s part. And Republicans know it.
As the G.O.P. was nearing its moment of collapse on the shutdown and debt ceiling, Representative Raúl Labrador, Republican of Idaho, said, “I think it’d be crazy for the House Republican leadership to enter into negotiations with him on immigration.” He continued: “And I’m a proponent of immigration reform. So I think what he’s done over the last two and a half weeks — he’s trying to destroy the Republican Party. And I think that anything we do right now with this president on immigration will be with that same goal in mind: which is to try to destroy the Republican Party and not to get good policies.”
The conservative columnist Charles Krauthammer laid out the president’s calculus more bluntly on Fox News: “With immigration, he wins either way. I’m not sure he thinks he can get it passed, seeing the resistance among the Republicans to the deal over the budget. I think he knows he’s not going to have a good chance of getting immigration through, but he thinks — and he’s probably right — that he can exploit this for the midterm election as a way to gin up support, for the Democrats to portray the Republicans as anti-immigrant, anti-Hispanic, etc.”
Republicans have a tough choice.
They can ride shotgun once again with the politically suicidal Tea Party faction, a group that the Pew Research Center for the People and the Press found this week to be “less popular than ever.” They can allow the most strident voices on the far right that oppose comprehensive immigration reform — Rush Limbaugh has likened it to the Republican Party’s “authoring its demise” — to direct their path and further alienate Hispanic voters, who are increasingly coming to see the party as an unwelcoming place. Mitt Romney lost the Hispanic vote by 44 points last year, and the Republican National Committee’s own autopsy on that loss surmised:
“If Hispanic Americans perceive that a G.O.P. nominee or candidate does not want them in the United States (i.e., self-deportation), they will not pay attention to our next sentence. It does not matter what we say about education, jobs or the economy; if Hispanics think we do not want them here, they will close their ears to our policies.”
Or Republicans can take the less likely path and demonstrate that they’ve been cowed enough to move ahead on a major piece of legislation that is supported by the majority of the American people — a July Gallup poll found that 71 percent of Americans believe that passing immigration reform is important. And that would be good not just for the president’s legacy but for the health of the country as a whole.
In a 2012 paper published by the Cato Institute, Raúl Hinojosa Ojeda, director of the North American Integration and Development Center at the University of California, Los Angeles, used computing models to estimate the following:
“Comprehensive immigration reform generates an annual increase in U.S. G.D.P. of at least 0.84 percent. This amounts to $1.5 trillion in additional G.D.P. over 10 years. It also boosts wages for both native-born and newly legalized immigrant workers.”
Comprehensive immigration reform is the right thing and the thing that Americans want. But the far right is hardly concerned with what’s right and has little appetite for agreeing with the will of the majority of the American people (despite talking ad nauseam about standing up for the American people).
The far right is angry at the government and the man at the top of it. According to a Pew Research report released Friday: “Anger at the federal government is most pronounced among Tea Party Republicans. Fully 55 percent of Republicans and Republican-leaning independents who agree with the Tea Party say they are angry with the federal government — about double the percentage among non-Tea Party Republicans (27 percent) and Democrats and Democratic leaners (25 percent).”
They have been blinded by that anger. The president knows that. And he knows that blind soldiers don’t often win battles. In choosing to pivot to immigration reform, he has created a win-win scenario for himself and the Democrats. Clever, clever.

“More Autopsies In The Future”: The GOP Makeover Is The Same As It Ever Was
In March, the Republican National Committee released its so-called autopsy of the 2012 elections. It focused mainly on the growing Hispanic vote — of which Mitt Romney garnered only 27 percent.
To avoid being seen as the party of “stuffy old men,” the report said, the GOP would have to change its messaging, become more inclusive, and embrace issues like immigration reform. Otherwise, the “Party’s appeal will continue to shrink to its core constituencies only.”
How is the rebranding effort working so far?
Not great. Earlier this month, Pablo Pantoja, the GOP’s Hispanic outreach director in Florida, switched to the Democratic Party, citing a “culture of intolerance surrounding the Republican Party.” He said he was partly inspired by the revelation that Jason Richwine, who co-authored a widely publicized anti-immigration report for the Heritage Foundation, once wrote a controversial dissertation arguing against admitting Hispanic immigrants with low IQs.
Incidents like that certainly aren’t helping the GOP’s image. Worse, fringe GOP candidates are making a splash in prominent statewide races, writes Josh Kraushaar at National Journal. He points to two states, Virginia and Colorado, where Republicans are losing ground despite the fact that Democrats there are vulnerable.
In Colorado, where Hispanic people made up 42 percent of all population growth between 2000 and 2010, Republican Tom Tancredo, who has taken a hard line against immigration reform, has emerged as a legitimate contender in the 2014 governor’s race. If Tancredo has read the RNC’s report, his March op-ed in the Christian Post — in which he chastised Sen. Rand Paul (R-Ky.) for speaking Spanish, and supported Romney’s disastrous “self-deportation” strategy — certainly doesn’t show it.
Virginia is even more worrisome for the GOP. The party’s nominee for the gubernatorial race in 2013, Ken Cuccinelli, is a hardcore conservative who has not only pushed for English-only workplaces, but has defended laws that criminalize sodomy, alienating younger voters who overwhelmingly identify with the Democratic Party. Polls show him trailing his Democratic opponent, Terry McAuliffe, despite the fact that McAuliffe has been called a “soulless hack” by members of his own party and worse.
Meanwhile, the GOP’s nominee for lieutenant governor, E.W. Jackson, is even more conservative, dragging the Republican ticket down further. (Among other controversial statements and positions, Jackson has claimed that Planned Parenthood has killed more blacks than the KKK.) As Dave Weigel at Slate put it, “Democrats win in Virginia, in off-years, when they convince suburbanites that the GOP has lost its mind.”
Furthermore, the GOP is struggling to come up with mainstream candidates who can compete in Senate races in Colorado and Virginia in 2014. The irony is that the GOP should be in a position of strength in those races, writes Kraushaar:
What’s remarkable is that these swing-state setbacks are taking place in what’s shaping up to be a promising political environment for Republicans. The off-year electorate, on paper, should be more conservative than in 2012, with younger voters and minorities less likely to show up for a midterm election. The scent of scandal threatens to weigh down Democrats over the next year. The implementation of Obama’s health care law, polling as poorly as ever, will be taking place right as the midterms begin in earnest. This is the stuff that should be catnip for prospective GOP recruits.
But instead we’re hearing crickets in these two Senate races, not to mention a handful of other battleground contests (Iowa, Michigan, Minnesota, and New Hampshire) where Republicans should be faring better. [National Journal]
Exacerbating the problem is that most elected Republican officials have no incentive to go after the Hispanic or youth vote. The average Republican district is 75 percent white and GOP congressmen overall represent 6.6 million fewer minorities in 2012 than they did in 2010, according to USA Today.
While the massive redistricting that produced those numbers might help Republicans keep their House seats, they certainly won’t help the party expand on a national level — which is where the ultimate prize, the presidency, will be determined.
Then there are the stream of controversial comments from the party’s right wing — like this from conservative icon Phyllis Schlafly, and this from pundit Ann Coulter. Put together, the party’s perceived hostility toward non-white groups could offset any goodwill built by the likes of Sen. Marco Rubio (R-Fla.), who has championed immigration reform in the Senate. The success of that legislation is seen by many GOP analysts as crucial to the party’s electoral prospects.
It’s worth keeping in mind that there’s a lot of room for growth in the Hispanic vote in the next couple of elections. Esther J. Cepeda at The Washington Post crunched the Census numbers and found that only 48 percent of eligible Hispanic voters went to the polls in 2012, compared to 64.1 percent of white voters and 66.2 percent of black voters.
If Democrats can rally those voters, especially in swing states, Republicans will be releasing more autopsy reports in the future.
