“Boehner Still Can’t Get His Act Together On ISIS”: A House Speaker Who Keeps Expecting Everyone Else To Work Except Him

It’s been nine months since President Obama launched a military offensive against ISIS targets in the Middle East. It’s been five months since the president publicly called on Congress to authorize the mission. It’s been four months since Obama used his State of the Union address to urge lawmakers to act. It’s been three months since the White House, at Congress’ insistence, provided draft legislative language to lawmakers.

But as The Hill reported this afternoon, House Republicans – who support the administration’s military offensive – still aren’t prepared to do any actual work.

President Obama should scrap his war powers request to fight Islamic terrorists and go back to the drawing board, Speaker John Boehner (R-Ohio) said Tuesday.

“The president’s request for Authorization of Use of Military Force calls for less authority than he has today. Given the fight that we’re in, it’s irresponsible,” Boehner told reporters after huddling with his rank-and-file members. Boehner said the president should withdraw the AUMF and “start over.”

It’s important to understand the nuances of Boehner’s whining on this issue. For quite a while, the Speaker said the legislative branch wouldn’t even try to authorize the war unless the executive branch did lawmakers’ work for them – Congress simply would not write its own bill, Boehner said, so it was up to the president to do the legislative work for the legislators.

Obama eventually agreed to write a bill for those whose job it is to write bills, only to discover that Congress doesn’t like his bill. The sensible, mature next move seems fairly obvious: if lawmakers don’t like the resolution the White House wrote, Congress can try writing its own version, agreed upon by lawmakers, and then voted on by lawmakers.

As of this morning, however, Boehner says he doesn’t want to. He wants the president to imagine what might make Republicans happy, then write another draft, at which point GOP leaders will let the West Wing know whether or not Congress is satisfied. If Boehner disapproves, presumably it’d be up to Obama to come up with a third.

This is quickly becoming a national embarrassment.

Not to put too fine a point on this, but the war, in effect, started nine months ago. Congress has a constitutional obligation to authorize the mission, but instead we have a House Speaker who keeps expecting everyone else to work except him.

I can appreciate the fact that this is not simply a matter of laziness. There are, as we’ve discussed before, significant policy disagreements – between Democrats and Republicans, between the House and the Senate – that are tough to resolve. Some lawmakers believe the draft resolution sent to Congress by President Obama goes too far, while some believe it doesn’t go far enough. Working out a resolution would be hard.

But here’s the fact that Boehner and his cohorts don’t seem to understand: it’s supposed to be hard. When lawmakers authorize the nation to launch a military offensive abroad, it’s difficult by design.

The Speaker, however, hopes to pass the buck, suggesting somehow it’s the White House’s job to write bills for Congress, and if Congress doesn’t like the president’s version, then Capitol Hill will just ignore the issue altogether. In effect, Boehner’s argument is that an ongoing war can just continue – indefinitely – no matter the cost or scope of the mission, and federal lawmakers are prepared to do literally no work whatsoever.

Rep. Adam Schiff (Calif.), the top Democrat on the Intelligence Committee, said today, “We may go down in history as the Congress that largely gave up its role in the war-making process.”

The irony, of course, is extraordinary. For years, Boehner and other GOP leaders have complained that Obama is an out-of-control tyrant, hell-bent on ignoring the Constitution and amassing excessive power in the executive. And yet, here we are, with the president pushing Congress to authorize a war that’s already started, and a Speaker content to sit on his hands.

Making matters worse, the more Obama tries to find a peaceful solution with Iran, the more Congress tries to intervene to derail the administration’s efforts. The more Obama wages war against ISIS, the less work Congress is inclined to do.

“It matters a great deal to the institution of the Congress what we do because future presidents are going to look back at this and they’re going to say ‘We can make war without a congressional vote,’” Schiff added. “It will have deep impact on our institutional role and our ability to serve as a meaningful check and balance on presidents’ ability to make war.”

Finally, evidence of Boehner’s legacy comes into focus.

“Only Fix Things After The Worst Has Happened”: The Conservative Case For Strengthening Amtrak

The Amtrak crash in Pennsylvania killed eight people and injured dozens more. It has sparked much hand-wringing in the media, though its death toll is surpassed every few hours on American highways.

Still, Republicans have not hesitated in their plan to sharply cut Amtrak subsidies, recently voting on legislation to do just that. One GOP congressman called Amtrak a “Soviet-style operation,” which presumably means he would prefer abolishing Amtrak altogether.

But Republicans, as the ostensible party of conservatism, have an obligation to consider the extant fact of Amtrak, which is a critical institution for millions of Americans. By supposed conservative principles, it is not appropriate to sacrifice the current needs of existing people in pursuit of an ideological utopia.

Michael Oakeshott famously described the conservative temperament as follows:

To be conservative, then, is to prefer the familiar to the unknown, to prefer the tried to the untried, fact to mystery, the actual to the possible, the limited to the unbounded, the near to the distant, the sufficient to the superabundant, the convenient to the perfect, present laughter to utopian bliss. [On Being Conservative]

It may be the case that slashing Amtrak’s subsidies or selling it to private companies would result in an overall improvement in service at some future point. (If you care to poke around, successful national rail is operated on all sorts of ownership grounds, from mostly private in Japan to state-owned in Sweden.)

But it is inarguably true that right now millions of Americans depend on Amtrak as it currently exists. It’s a tried, factual, actually existing institution that works well enough for the more than 30 million people who choose to take it every year. Indeed, ridership is actually up 50 percent since 2000. Most of that business is done in the Northeast Corridor, where the population is concentrated enough for true high-speed rail to be a reasonable proposition (someday).

However, it’s also an institution in need of help. As I’ve written before, Amtrak faces a slow-motion emergency regarding its two tunnels under the Hudson River connecting New York City to New Jersey. They’re over a century old, and due to flooding during Hurricane Sandy, will need a total overhaul at some point in the next several years.

Back in 2009, there was a capacity expansion planned that would have alleviated the pressure. That’s out of the question now, thanks to New Jersey Gov. Chris Christie, who bogarted some of the money so he wouldn’t have to raise the gas tax.

A new tunnel under the Hudson is by far the most important potential piece of infrastructure in the nation. Four hundred thousand commuters go through the existing tunnels every weekday. If one were to shut down (or, God forbid, collapse), the total throughput would be cut by something like 75 percent, because the remaining tunnel would have to go both ways. A great many of those people simply would not be able to get to their jobs during rush hour.

Any looming disaster like this presents a choice. A crisis might be the opportune time for reform. But it is simply preposterous to imagine that a new tunnel could be built without substantial federal support. With a likely cost of $7-10 billion, it’s probably too expensive for private corporations to even finance in the first place. (Though it was a private train company that built the original tunnels, there are none remotely that big anymore.)

So my question for all the supposed conservatives out there champing at the bit to abolish Amtrak: What say you to the 400,000 daily New Jersey commuters, or the 30 million Amtrak customers generally? On Oakeshottian grounds, I’d say that conservatives are obligated to make some accommodation of those people, regardless of their ideology about markets.

It doesn’t seem very conservative, much less responsible, to simply procrastinate and only fix things after the worst has happened — which is what’s going to happen.

“Particularly Shameless”: Rick Scott Lied On His Mother’s Grave — And Blew A Hole In The GOP’s Anti-ObamaCare Argument

When it comes to ObamaCare’s expansion of Medicaid, it may seem like a matter of simple logic for states to take the money that’s on offer. It would both help their most vulnerable citizens and pump lots of money into local economies.

Alas, logic and the contemporary Republican Party have little relation to each other, so most GOP-controlled statehouses have turned down the offer. But few have done so in a more clownish manner, or exposed the contradictions in the Republican position more clearly, than Florida Gov. Rick Scott.

Scott has flip-flopped on Medicaid, first opposing it, then supporting it, then opposing it again. This is bad, if not entirely unusual, political behavior. But Scott was particularly shameless, citing his recently deceased mother as his justification for suddenly embracing the expansion in 2013.

As he has now revealed, however, Scott was lying on his mother’s grave. He pretended to embrace the Medicaid expansion to secure a federal waiver for privatizing Florida’s Medicaid system, then quietly dropped his support once the waiver was granted. (The Obama administration’s decision to give the quid without first getting the quo, given who they were dealing with, was not its finest hour.)

So Scott used his deceased mother as a shield to lie about his motives in order to funnel federal taxpayer money to Florida businesses, then reneged on his part of the deal, leaving many poor Floridians to needlessly suffer and in some cases die. All par for the course for Scott, who before entering politics oversaw a massive amount of Medicare fraud as CEO of a large for-profit hospital operator.

At this point, one could say that, rank dishonesty and opportunism aside, at least Scott is standing on principle. He is turning down federal dollars to protect state sovereignty. Not a very attractive principle, but at least a principle, right?

Nope. Before the Affordable Care Act, the federal government made money available to states to create Low-Income Pools (LIP) that would reimburse hospitals that treated patients who couldn’t afford to pay for emergency services. Florida is receiving more than $1 billion a year in federal funds from LIP. The ACA, however, makes the LIP obsolete. It addresses problems of uncompensated hospitals by expanding Medicaid, greatly reducing the number of patients who cannot pay their bills.

The federal government has told Florida that it will not make the LIP funds available, pointing to the Medicaid funding which remains available. But Scott wants to have his cake and eat it, too. Not only is he demanding that the federal funding continue, he has actually filed a frivolous lawsuit arguing that the federal government is obligated to give Florida the LIP money. The Obama administration, having been burned by Scott already, is unmoved.

This lawsuit builds on the Supreme Court’s already shaky holding that allowed states to opt out of the expansion, pushing it to an extreme that would be too absurd even for the Roberts Court. It has virtually no chance of succeeding.

But the decision to file it is instructive. On the one hand, Scott is arguing that taking an extraordinarily good offer from the federal government to insure its poor citizens would be an intolerable intrusion on the sacred sovereignty of the state of Florida. On the other hand, Scott is arguing that Florida has a right to another source of federal tax dollars for health care.

There is, in other words, no actual principle involved here — not even a bad “states’ rights” one. It’s just pure partisan politics, with Florida’s poor people being punished as a result.

As Michael Hilzik of the LA Times observes, Scott’s disgraceful behavior reflects broader trends in Republican governance. The decision of Republican officials at the state level to reject the Medicaid expansion, while misleading their constituents about the dread ObamaCare, continues to have disastrous results for their citizens.

The ensuing mess in Florida — where a huge hole has been blown in the state budget because anti-ACA fanatics won’t take the Medicaid expansion — does at least provide a glimmer of hope for the longer term. Red-state legislators may not particularly care about the many poor people being needlessly denied access to medical care. But they will start to increasingly care about the medical professionals and hospitals who are also being screwed. Once Obama leaves office, it’s likely that more and more states will grudgingly take the federal money.

In the meantime, however, the consequences of misrule in these states will continue to be grim.

“Sympathy For The Speaker” GOP Leaders Appear To Know They Have A Credibility Problem

I have sympathy (not much, but some) for John Boehner.

When it comes to the Affordable Care Act, the Republican House Speaker is nearly always between a rock and a hard place.

On one hand, he and the GOP leadership must stand against President Barack Obama’s health care law, because the longer it remains on the books, the more likely those who receive its benefits are going to support Democrats, not Republicans.

On the other hand, if someday the Republicans repeal the law, after having returned to the White House with congressional majorities, they will be forced to devise an alternative — an impossibility given the reactionary impulses of today’s GOP.

In the former scenario, Republicans lose.

In the latter scenario, they lose.

So Boehner must thread the needle while hoping his credibility as a GOP leader isn’t badly tarnished, even as rank-and-file Republicans discover through their experience that Obamacare isn’t actually a harbinger of North Korean-style totalitarianism.

Of course, that’s easier said than done. Boehner reiterated the Republican position on health care on the May 3 broadcast of Meet the Press, saying that Obamacare wasn’t working.

“Obamacare made it harder for employers to hire people,” he said. “You can ask any employer in America, ask them whether Obamacare has made it harder for them to hire employees, and they’ll tell you yes.”

When asked why none of the Republican Party’s dire predictions about health care came true, Boehner responded: “You know why there’s more people insured? Because a lot more people are on Medicaid.” He continued, “Giving people Medicaid insurance is almost like giving them nothing, because you can’t find a doctor that will see Medicaid patients. So where do they end up? The same place they used to end up: the emergency room.”

Events later in the week suggested, however, that something wasn’t right about Boehner’s claims. On Wednesday, the largest independent study of its kind was released. It found that nearly 17 million Americans are now covered under the Affordable Care Act.

Some lost coverage (about 6 million), according to the RAND Corporation study, but many more found coverage, with a net gain of 16.9 million. The evidence also contravenes those who say Obamacare encumbers hiring. For one thing, the largest gains (nearly 10 million) were made in employer-run insurance plans. For another, some 80 percent of the working population under the age of 65 saw no change at all in their health care coverage.

That wasn’t the only reason to look askance at Boehner’s claims. Last Friday’s monthly jobs report showed the unemployment rate had dropped to 5.4 percent, the lowest it’s been since May 2008, before Obama won the presidency. Even wages, which have not typically kept pace with inflation, rose by 2.2 percent in the past year.

So something’s wrong with the picture Boehner is painting. If most employers are offering insurance, and if the job market is expanding, why is Boehner saying that the Affordable Care Act has led to less insurance coverage and more unemployment?

GOP leaders appear to know they have a credibility problem. They are shifting their stance against Obamacare from quantity to quality. According to a report in The Hill published after Boehner’s appearance on Meet the Press, the Republicans now concede that Obamacare has covered more Americans but argue that the coverage is inferior. Hence, Boehner’s comment about Medicaid: Doctors don’t take Medicaid, and having it is like having nothing.

Such a shift raises its own question of credibility. Why would a Republican Party that equates tyranny with the presence of government in the lives of individuals be worried about the government’s role in providing quality health care to individuals?

Some might judge this as hypocrisy and thus dismiss the new Republican position as entirely unworthy of scrutiny. There’s merit to that, as Washington wallows in hypocrisy. But hypocrisy can prevent us from seeing what’s really going on. In this case, I wonder if Boehner and the leadership are worried about holding their ranks, as the temptation to defect grows from within.

Over time, the Affordable Care Act will penetrate deeper into the population. The millions of Americans who will benefit from the law will have an incentive to maintain the status quo. They’ll likely support the Democratic Party as long as the Republicans demand repeal of the law. So, as of now, a vote for a Republican, from the point of someone covered by the Affordable Care Act, is a self-destructive vote. And among those millions are conservatives.

Some might argue that in saying things about Obamacare that just aren’t true, Boehner risks alienating conservatives that make up the base of the Republican Party. Why would they trust the House Speaker if he is so consistently wrong? There’s something to that, but a likelier explanation for the GOP’s continued, and shifting, stance against the health care law is that opposition, no matter how contorted, is the best way to keep the conservatives in line.

Given time, more conservatives are going to benefit from the law. And the more they do, they more they will vote their self-interests. And that’s why I have (a little) sympathy for John Boehner.

“This Is On Congress’ Head”: It’s Almost Like Our Political System Is Designed To Fail Our Infrastructure

Sometimes, congressional Republicans have an odd sense of timing. Just hours after the deadly derailment of Amtrak 188, GOP lawmakers on the House Appropriations Committee took up transportation spending measures, voting to slash Amtrak’s budget, while also rejecting Democratic proposals to bolster infrastructure and train safety.

As the debate unfolded yesterday, things got a little ugly. Rep. Steve Israel (D-N.Y.) argued that Congress bore some responsibility for the tragic accident by failing to make the proper investments. Rep. Mike Simpson (R-Idaho), incensed, responded, “You tied it directly to an accident and a tragedy and suggested because we hadn’t funded it that caused that accident and you have no idea what caused it – and that’s a shame.”

Soon after, Republicans on the Appropriations Committee went ahead and did exactly what they intended to do – cutting rail investment – as if the accident in Philadelphia hadn’t just happened the night before. For many conservatives, there’s no reason to connect the two – if the derailment was the result of human error, Congress and budgetary choices are irrelevant.

The truth is more complicated. The New York Times reports today on rail technology you probably heard Rachel talking about last night.

For the second time in two years, a passenger train traveling well above its speed limit has derailed, leaving a trail of death and injuries. And for the second time, existing technology that might have prevented the accident was missing.

Amtrak has installed the technology, known as positive train control, on parts of its rail network in the Northeast Corridor. But the technology, designed to automatically slow or stop a train to prevent accidents, was not available on a critical stretch of track in Philadelphia where Train No. 188 derailed on Tuesday night, killing at least seven and injuring more than 200.

Robert Sumwalt, a member of the National Transportation Safety Board, made things plain while talking to reporters yesterday afternoon: positive train control “is not installed for this area where the accident occurred, where the derailment occurred…. Based on what we know right now, we feel that had such a system been installed in this section of track, this accident would not have occurred.”

Among the votes House Republicans cast yesterday? Voting down a Democratic measure to invest immediately in expanded use of positive train control.

To briefly summarize, in late 2008, Congress actually approved the Rail Safety Improvement Act, which, among other things, required technological upgrades to the nation’s rail system, including mandates on the accident-avoiding positive train control, which can automatically slow trains down remotely.

But Congress also gave the entire industry all kinds of time: the deadline to extend positive train control to all major rail lines is the end of this year: December 31st, 2015. And even this is too soon for much of the industry, which has lobbied Congress to push the deadline to 2020. From last night’s segment:

“This is not a mystery and this is also not hard…. This is something we know how to do, and we’ve done it in patches, pieces of track here and there.

“We also know we need to do it. It’s no mystery here, because what we need to do is something that we need to do concerning our nation’s infrastructure, honestly as a nation we really just can’t be bothered to get stuff like this done. It’s almost like our political system is designed to fail our infrastructure.

“I mean, the people, American people, left, right and center, want infrastructure investment…. Politicians, however, don’t like voting for it…. We are a great nation that has allowed the world-class national infrastructure that our grandparents built and our parents handed down to us to erode and suffer and starve to the point that it is decrepit and deadly.

“This is a failure of governance. This is on Congress’ head.”

For more on this, David Leonhardt noted yesterday that federal investment in infrastructure is at a generational low, while Philip Bump added rail investment struggles to find political support at least in part because people in Republican districts generally don’t take trains.
